PRACTICAL DIFFICULTIES and /or UNNECESSARY HARDSHIP ns The proposed garage
has dimensions of 24 X 32'. Request further -relief to permit construction of the
garage as close as 15' from the rear lot line as indicated on the attached survey.
® When I requested the previous variance in Aug 1989, I did so on the basis of the
slope of the lot which necessitated placing the garage closer to the street. 1 asked
for and received a variance to place the garage as close as 50.5' from the centerline of
the street -- Ellis Hollow Road. Subsequent to the granting of that variance (see
attached 29 Aug 89 Notice of Decision and January 10, 1990 letter), I was able to have
fill hauled in and reduce, to some degree, the effect of the slope. I have been in-
formed by the concrete contractor that he can locate the rear wall of the garage as
see attziched

0 Request for variance continued
close as 15 feet from the rear lot line without increased costs
or difficulty in construction.
Therefore, I am requesting that I be granted a variance to allow
the rear portion of the proposed garage to be as close as 15 feet
from the rear lot line. Except for my house on my property,
there are no other structures anywhere in the vicinity of the
planned garage. Just beyond the rear lot line in question is a
stately apple tree which will not be affected by the garage
constructions it is at least 30 feet away from the proposed
garage.
By placing the garage slightly further back on the lot than was
originally anticipated, we will be able to achieve a better and
more pleasing appearance relative to the house since the garage
will not be located out "in front" of the house, and we will be
able to have continued use of the existing circular driveway.
Even in this location, however, the garage will be about 55 feet
from the centerline of the street at the closest point and about
20 feet from the side lot line at the closest point (not closer
than the 15 feet permitted). I

I. Wolcott: We even thought about putting it in front of the
house on the right hand side, but then we
discovered there just wasn't room at all no matter
how we did it without a variance. :1;t just, makes
more sense to put it on the left hand side,
because it isn't in any bodies way.
ADDITIONAL COMMENTS FRO,i THE FLOOR
T Wolcott: One thing,:i.t's not a two car garage, the size is
correct but there's a work room there.
Paul and Mary Smith stated for the record thev did not object to the

3. Thcre is a very large and eery nice white pine tree right
behind where I would l.;i_ke to place the garage. in order to conform
to the 70 feet, :I: would have to have the tree felled and removed.
Because, of the trees Size and proximity to el.ectri.ca.l. service
wires, I estimate that it Mould cost 500 to 1.000 dol.la.rs to remove.
i would then have to buy Kind plant a replacement, and then wait 50

the highway. If the garage were to be placed closer to the existing
structure as Air. Baker suggested, he would have to remove a white
pine approx. -IS' inches and tWo White SpruC..es 9 to .10 J_nches in
width. Mr. O'Connor was opposed to cutting down any of the trees
and asked what was the original. thought, behind the 70 foot set back?
