HomeMy WebLinkAboutPB Minutes 1997-06-03TOWN OF ITHACA PLANNING BOARD JUNE 3, 1997 The Town of Ithaca Planning Board met in regular session on Tuesday, June 3, 1997, in Town Hall, 126 East Seneca Street, Ithaca, New York at 7:30 p.m. PRESENT: Vice Chairperson Eva Hoffmann, James Ainslie, Robert Kenerson, Candace Cornell, Gregory Bell, Herbert Finch, Jonathan Kanter (Director of Planning), John Barney (Attorney for the Town), Daniel Walker (Director of Engineering), JoAnn Cornish (Planner), Geri Tierney (Planner). ALSO PRESENT: Peter Trowbridge, Mark Inglis, Joseph Westbrook, Charles Pomada, Tom Salm, Tom Hoard, Robert O'Brien, Alex Leary, John Yntema. Vice Chairperson Hoffmann declared the meeting duly opened at 7:35 p.m., and accepted, for the record, the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and in the Ithaca Journal on May 23, 1997, and May 28, 1997, together with the Secretary's Affidavit of Service by -Mail of said Notice upon the various neighbors of the properties under discussion, as appropriate, upon the Clerks of the City of Ithaca, Town of Danby, and the Town of Ithaca, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants and /or agents, as appropriate, on June 2, 1997. (Affidavit of Posting and Publication is hereto attached as Exhibit #1.) Vice Chairperson Hoffmann read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. AGENDA ITEM: PERSONS TO BE HEARD: There being no one present to be heard, Vice Chairperson Hoffmann closed this segment of the meeting. PUBLIC HEARING: CONSIDERATION OF FINAL SITE PLAN APPROVAL FOR THE PROPOSED CONSTRUCTION OF A 18218 +/- SOUARF FFFT AMITIMI Tn Tug PETER DEMJANEC. R.A , AGENT: Vice Chairperson Hoffmann declared the above -noted matter duly opened at 7:36 p.m., and read aloud from the Notice of Public Hearings as posted and published and as noted above. Joseph Westbrook, Associate of Peter Demjanec, stated that Peter Demjanec was unable to attend this hearing, and he would be glad to answer any questions of the Planning Board. The Montessori School has answered all of the Town Engineer's concerns for the drainage. PLANNING BOARD MINUTES 2 JUNE 3, 1997 APPROVED - JUNE 174 1997 Mark Inglis, Associate of Peter Demjanec, stated that the Montessori School also received all the variances needed. Vice Chairperson Hoffmann stated that the Montessori School still needs a variance from New York State Uniform Fire Prevention and Building Code regulations. Mr. Inglis stated that was correct. There have been discussions with Bill Stewart from the State, who granted a field variance with the condition that the school change one wall to an area separation wall, which has been changed on the drawings. The Montessori School is awaiting confirmation from the State. Planner Geri Tierney stated that Mr. Demjanec has not received the written variance, but that someone from his office would write a letter indicating this. There was a letter supplied to the Planning Board before the meeting stating that the school has not yet received the written variance from the State. Vice Chairperson Hoffmann asked the Planning Board if everyone has visited the site to see what the situation looks like with the water and drainage swales. All Board Members indicated that they had visited the site. Board Member Herbert Finch stated that he visited the site today. The proposed plans for drainage swales look to be a great benefit for the water situation on this site. Board Member Candace Cornell stated that she visited the site when it was raining. It is typical that there is a lot of water flowing in that area, but it seems the plans would adequately resolve this solution. Vice Chairperson Hoffmann stated that she visited the site just before this meeting, and water was still in the swales. Some grading could help the water flow away. Mr. Inglis stated that the site survey plan shows the swales to be dead level, so the slightest depression will fill with water. If there was a slight grade to the swale it would drain properly, and that is part of the plan. Board Member Cornell asked if the Town Engineer approved the drainage plans. Mr. Westbrook stated that the Town Engineer has looked at these plans. Planner Tierney stated that the Town Engineer has looked at these plans, and has indicated that the drainage plans are adequate. Vice Chairperson Hoffmann stated that she had some problems understanding the sections supplied of the drainage elevations. Ms. Hoffmann asked if Mr. Inglis could point out Section E on the enlarged map of the sections. Mr. Inglis pointed out the sections, and explained the grade levels for the Board to understand. The Planning Board indicated to Mr. Inglis and Mr. Westbrook that the drainage elevations that were supplied to the Board were very poor and difficult to read. In the future, the plans should be clearer for identification purposes. PLANNING BOARD MINUTES 3 JUNE 311997 APPROVED -JUNE 174 1997 Planner Tierney stated that the plans supplied to the Planning Department had a cover letter attached. The drainage information was submitted to the Town Engineer, and passed on to the Planning Board. Vice Chairperson Hoffmann stated that she had difficulties figuring out the location of the fire lanes on the drawings, and how far the fire lanes extended. There is a label indicating fire lanes, but it is difficult to see where they are supposed to be located. Planner Tierney pointed out on the enlarged map the signs location and fire lanes extensions. road. Vice Chairperson Hoffmann asked if parking would be eliminated on both sides of the Planner Tierney stated that is the school's intention. Vice Chairperson Hoffmann asked what does the fire department require. Planner Tierney stated that she was not sure, but this Board has asked the school to propose that. The Zoning Officer for the Town stated that it would be adequate and the fire trucks would be able to enter okay. Mr. Inglis stated that the fire department requires a fire lane wide enough for a fire truck to pass. Board Member Cornell asked what would the school be doing to rectify the current situation of parking in a fire lane. Charles Pomada, General Contractor for the School, stated that the school has an office staff who could contact the owners or the law enforcement if needed. Board Member Cornell stated that the EcoVillage fire this past year has made the Town really look at the issues of fire lanes. Vice Chairperson Hoffmann asked Mr. Walker if the drainage plans for these projects were sufficient, and if he was satisfied with this situation as proposed. Director of Engineering Daniel Walker stated that he was satisfied with the surface drainage. The surface drainage information around the building was supplied, and there were some findings noted. The drainage should be adequate to protect the building. The drainage swale to the north side would need to be maintained for the water from uphill not to come into the area of the building. This is a drainage swale for the property above the school. The elevation sections show the swales to be fairly level, but would be graded off slightly for proper drainage. The profile shows that the drainage ditch is deeper up stream than down stream. Planner Tierney stated that the Board should eliminate condition "a" in the proposed resolution because the School has already met that condition. Attorney for the Town John Barney asked if the Montessori School received a field variance from the State. Planner Tierney responded, no. PLANNING BOARD MINUTES 4 JUNE 311997 APPROVED -JUNE 174 1997 Attorney Barney stated that when the school receives the written variance letter then the condition would be met, so condition "a" should be left in the resolution. Vice Chairperson Hoffmann stated that this is a public hearing, and asked if anyone from the public would like to speak. No one spoke. Vice Chairperson Hoffmann closed the public hearing, and asked if anyone was prepared to offer a motion. MOTION by Herbert Finch, seconded by Candace Cornell: NOW, THEREFORE, BE IT RESOLVED: 1. That the Planning Board hereby grants Final Site Plan Approval for the proposed building of a 1,218 +/- square foot addition to the Montessori School, as shown on the site plan entitled "Montessori School, 120 East King Road, Ithaca, New York 14850" prepared by Peter Demjanec, revised May 7, 1997, and other application materials, conditioned upon the following: a. The applicant submit, prior to issuance of a Certificate of Occupancy a record of application for and receipt of all necessary agencies; permits from County, State, and /or Federal b. The applicant amend the site plan to delete the sentence "6. No site grading is required."; c. The applicant submit, prior to issuance of a Certificate of Occupancy, one original or mylar copy and two paper copies of the final site plan. There being no further discussion, Vice Chairperson Hoffmann called for a vote. AYES - Hoffmann, Cornell, Finch, Bell, Ainslie, Kenerson. NAYS - None. The MOTION was declared to be carried unanimously. (NOTE: The adopted resolution is hereto attached as Exhibit # 2.) Vice Chairperson Hoffmann duly closed the Final Site Plan Approval for the Montessori School located at 120 East King Road at 8:01 p.m. PUBLIC HEARING: _CONSIDERATION OF FINAL SITE PLAN APPROVAL FOR 1) PROPOSED EXPANSION OF THE EXISTING "J LOT" PARKING LOT FROM 160 SPACES TO _354 SPACES; AND 2) THE PROPOSED EXPANSION OF THE EXISTING " " M LOT =i. =NM W49w4�w =I = =���w.rja I� LOOK. TAUBE & CHIANG P.C., AGENT: Vice Chairperson Hoffmann declared the above -noted matter duly opened at 8:02 p.m., and read aloud from the Notice of Public Hearings as posted and published and as noted above. PLANNING BOARD MINUTES 5 JUNE 3, 1997 APPROVED -JUNE 174 1997 Robert O'Brien, HOLT Architect, stated that Ithaca College is here to seek Final Site Plan Approval for "J" and "M" lots. Ithaca College has met all of the requirements that the Planning Board had requested, and asked if there were any questions from the Board. Vice Chairperson Hoffmann asked if there have been any changes to this proposal since the last meeting. Planner JoAnn Cornish stated that there have been no changes. Ithaca College has met the conditions set forth in the Preliminary Site Plan Approval. Board Member Cornell stated that she was not able to attend all the meetings on this proposal, but have read the material presented. The students at Ithaca College have a lot of concerns. Ms. Cornell asked if the concerns of the students have been resolved satisfactorily. Vice Chairperson Hoffmann stated that a student from Ithaca College has spoken to the Board on two occasions. The main concern of the students was the number of parking spaces that would cover the green space. Nothing has really changed as far as that is concerned. This is the same proposal that was originally submitted. Vice Chairperson Hoffmann opened the public hearing. Tom Salm, Vice President of Business at Ithaca College, stated that the student who spoke to the Board is a member of the Environmental Society at Ithaca College. The Society would like Ithaca College to become involved with a regional transportation effort. Ithaca College informed the Society if they would like to lead that charge the College would be more than happy to cooperate with them. That particular student graduated last month, but would be staying at the College until the fall to help get things started on the Transportation Plan. The College had a ride share plan at one time that fell by the board, and the College would like to see it resurrected. This parking is very important to Ithaca College to get the parking back on the right side of Route 96. There is some parking at the Axiohm, and the College does not think it is a good condition for people crossing the road. This particular parking lot (J lot) would give the College proper handicapped and disabled access to Ford Hall. The public needs good access for Ford Hall and to attend concert performances. There is no good way to get these spaces to Ford Hall other than going to the higher lot with a bridge. Most of the students understood this plan, and explained in detail to the Student Governments. The Student Government took no specific action other than concurring that the Environmental Society should work with the College on the transportation problems. Board Member Cornell stated that in a previous meeting, Mr. Kanter asked if Ithaca College was going to consider changing their policies about transportation. Director of Planning Kanter stated that this is happening with Ithaca College. The planning process would be looking at a number of things including transportation and environmental issues. Transportation is one of the big issues that needs further research. There PLANNING BOARD MINUTES 6 JUNE 39 1997 APPROVED - JUNE 17. 1997 are a lot of opportunities for adding additional bus transportation or car pooling. This could be applied to the campus situation. Mr. Salm stated that the College has a subsidized arrangement with the City of Ithaca to get transportation to Campus. The transit system arrives more than before. This was an effort to encourage the students to use public transportation. It is good that the campus has this transportation, especially on the weekends with students leaving the bars instead of wandering in the roads or driving. That has been very successful, and the campus has been doing that for a number of years. Ithaca College and Cornell University have jointly subsidized public transportation on Friday and Saturday nights. Ithaca College is more than willing to do more. This is a public relation issue. Ithaca College is going to be doing some planning with the Town Planning Staff for improvements. Board Member Cornell stated that there have been discussions about having paths through Ithaca College for students to get from one place to another, such as College Circle, Ms. Cornell stated that she heard that Ithaca College was hesitant to have these paths. Mr. Salm stated that whether the College wanted the paths or not, the paths are already there. John Novarr operated a shuttle at one point to attract students to College Circle, but it received little use because most students have their own cars and do not want to walk. The College also had a liability concern because it was a dark area to walk across the playing fields. The distance of 1,500 +/- feet at night is not well lit, so it would not be a good idea for students to travel through there. Board Member Cornell asked if Ithaca College would be rethinking and recreating a new transportation plan where students would not need cars. Mr. Salm stated that the College would try that, but the students like to have their own cars on campus. The College plans to work with the Town Planning Staff on the transportation plan as part of an overall master plan. Board Member Cornell stated that Cornell University's solution is to charge high parking fees. Mr. Salm stated that Ithaca College does not charge faculty or staff parking fees, but students were charged $50 a year. Most of the parking for people is close to their buildings. Board Member Cornell stated that there are other ideas to get students into public transportation or walking. Ms. Cornell asked if Ithaca College could light the pathway for students to use. Mr. Salm stated that the College does not know if the students would use the path or not, and that would need to be researched further. PLANNING BOARD MINUTES 7 JUNE 39 1997 APPROVED -JUNE 17, 1997 Board Member Robert Kenerson asked if the new parking configurations would get Ithaca College out of the Axiohm parking lots. Mr. Salm stated that Ithaca College is out of Axiohm. The new parking lot includes 90 new parking spaces for the people who were parking at Axiohm. Vice Chairperson Hoffmann asked if Ithaca College was relying on the students to start the Transportation Plan to address the parking issues. Ms. Hoffmann further stated that Ithaca College should take this responsibility and task upon itself. Mr. Salm stated that was correct. Ithaca College and the students would be working together on the Transportation Plan. Attorney Barney asked what is the Planning Board's role here in terms of whether people bring cars to the Ithaca College campus. Attorney Barney stated that he was having trouble understanding why the Planning Board was trying to tell Ithaca College how to run their campus. There are people who feel that way, but there are differences of opinion on it. He is not sure how this is relevant to this particular proposal being considered. The Planning Board is considering Final Site Plan Approval, and the Board has already explored this proposal for a great deal of time previously. Vice Chairperson Hoffmann responded that these questions were brought up in the interest of preserving more green space in the future, and also because the Planning Board has heard complaints about the traffic situation along Route 96 near Ithaca College. Board Member Cornell stated that this is an opportunity for the Planning Board members to express their opinions. Attorney Barney stated that the Board has already reviewed this proposal at length. Board Member Cornell stated that the Board does not always have these occasions to talk to Ithaca College representatives. Mr. Salm stated that if anyone has concerns, he would be willing to talk on a longer term basis of any concerns. Board Member Cornell stated that she believes that this is a good time for Ithaca College to be proactive. Vice Chairperson Hoffmann stated that this is a public hearing, and asked if anyone from the public wished to speak. No one spoke. Vice Chairperson Hoffmann closed the public hearing, and brought the matter back to the Board for further discussion. Planner Cornish stated that at the Preliminary Site Plan Approval phase was for Ford Hall and "J" and Wit parking lots, which are now separate issues. This issue is only for the "J" and PLANNING BOARD MINUTES 8 JUNE 39 1997 APPROVED -JUNE 174 1997 "M" lot expansions. Ford Hall would be revisited at a later date. For the record, on May 21, 1997, a height variance and a special approval were granted by the Zoning Board of Appeals for Ithaca College. Vice Chairperson Hoffmann stated that she has some concerns about "J" lot. After reviewing the drawings, the only way to get in and out of "J" lot by car or otherwise is through the existing lot. Ms. Hoffmann asked if someone parked their car in the far eastern end of the proposed extension of "J" lot, how would a person get from there to Ford Hall or surrounding areas, except by walking back along "J" lot itself. Peter Trowbridge, Landscape Architect, stated that there is no new parking at Ithaca College. These are replacement parking spaces. The extreme eastern end of "J" lot would be student permitted parking for the Towers. The western end of "J" lot would be for staff and faculty parking. When staff and faculty vacate the parking spaces at 5:00 p.m., those spaces could be used for Ford Hall functions. People would not be parking in the extreme eastern end unless they need to park in vacant student spaces. Mr. Salm stated that the parking in the eastern portion of "J" lot would be for students living in the Towers. Students could park close to their living complexes. Ithaca College tries to have people park as close as they can to where they need to go. Vice Chairperson Hoffmann stated that her concern is when people walk they try to take the shortest route whether it is steep or not. There should be some thoughts of where people might end up walking after they have parked, and arrangements made so that there are steps or trails so people do not walk in inappropriate places. Mr. Salm stated that he does not disagree with Ms. Hoffmann, except with the College's experience on this particular lot. The Tower students seem to pretty much park in this lot. There has not been a problem with other students from other complexes parking there and walking down the hill. If a path were being developed the College would either put in steps or a walkway. Board Member Cornell stated that the Town would be holding meetings on the draft Park, Recreation, and Open Space Plan. Since the Town has parks and trails in the vicinity of Ithaca College, it would be wonderful if Ithaca College could attend the meetings also. Mr. Salm stated that this is part of Ithaca College's Master Plan to work with the Town Planning Staff. MOTION by Candace Cornell, seconded by James Ainslie: NOW, THEREFORE, BE IT RESOLVED• 1. Vice Chairperson Hoffmann stated that "the parking lot expansions as shown on ", should be added to condition 1. after "That the Planning Board hereby grants Final Site Plan Approval for ". Attorney Barney stated that condition "c" should be changed to "One (1) original or mylar copy and two paper copies of the final site plan to be delivered to the Town of Ithaca prior to the issuance of a building permit." Vice Chairperson Hoffmann stated that condition "a (1) and (ii)" should start with "The applicant submit a ". Attorney Barney stated that condition "a" could read "Receipt of all necessary permits from county, state and /or federal agencies prior to the granting of certificate of occupancy including without limitations." That would make the language clearer. Board Member Bell asked what happens to the existing trail located where the expansion of "J' lot would be built. PLANNING BOARD MINUTES 10 JUNE 39 1997 APPROVED - JUNE 174 1997 Mr. Trowbridge stated that this is not a recreation trail, it is a cross country running trail. The trail would begin off the eastern end of the sidewalk and reconnect to the existing trail. The elevations are very consistent and virtually level. Board Member Cornell asked if Ithaca College considered some sort of permeable surface to the parking lot to allow the water to flow into the ground. Mr. Trowbridge stated that they have built a number of that exist in Ithaca, in order to create a permeable asphalt lot, the asphalt so the water would drain away or a considerable not be practical in Ithaca. This is not a community where acceptable detail. It would require that they put three underneath the parking lot, which would minimize maintenanc permeable lots. With the soil types there needs to be pure sand under amount of permeable fill. It would permeable asphalt is generally an to four feet of drainage material e. Director of Engineering Walker stated that in the proposed resolution condition "b" should be eliminated because they have met those requirements. Mr. O'Brien stated that he received a letter from T.G. Millers, which states that no permit or review of the water main relocation is required by the Tompkins County Health Department since the water mains are considered to be part of a private water system. They have confirmation of this with Tompkins County Director of Environmental Health, John Anderson, Staff, Planner Cornish asked Mr. O'Brien if he could make a copy of that letter for the Planning Mr. O'Brien responded, yes. There being no further discussion, Vice Chairperson Hoffmann called for a vote. AYES - Hoffmann, Bell, Ainslie, Kenerson, Cornell, Finch. NAYS - None. Vice Chairperson Hoffmann stated that the Race Office Supply van is often parked in the parking lot right next to the main entrance to the ramp making it difficult for anyone, but especially persons needing wheelchairs or walkers to enter for Town Hall meetings. Ms. Hoffmann asked if the Planning Staff could ask Race Office Supply if they could move the van to another location. Director of Planning Kanter stated that he would mention it to the appropriate person. Board Member Finch stated that Ithacare construction has begun, and the Montessori School construction has also begun. Director of Planning Kanter stated that the Planning Board received a copy of the scheduled meetings for public information on the draft Park, Recreation, and Open Space Plan. The meetings are scheduled in three different locations. Mr. Kanter asked if anyone from the Board would be able to attend these meetings. The Planning Staff would like to get people from the Town Board and Conservation Board to attend any of the scheduled meetings. Board Member Cornell stated that she would try to attend all the meetings. Board Member Ainslie stated that he would be able to attend the meeting at the Alternative School. Director of Planning Kanter stated that the Planning Staff have had discussions with Ithaca College of the trails. Ithaca College was concerned about vehicular access to East King Road at some point. This might be a proposal in the future to connect to the Monkemeyer property. Ithaca College has hired consultants for the transportation and circulation planning. Ithaca College would be part of the Park, Recreation, and Open Space Plan about the trail systems. Ithaca College seems to be willing to enter into this type of play).. The Planning Board had a brief discussion about how Ithaca College could fit into the Town's Park, Recreation, and Open Space Plan along with the Comprehensive Plan.
