The Town of Ithaca Planning Board met in regular session on Tuesday, April 1, 1997, in Town Hall,
126 East Seneca Street, Ithaca, New York at 7:30 p.m.
PRESENT: Chairperson Fred Wilcox, James Ainslie, Robert Kenerson, Gregory Bell, Jonathan
Kanter (Director of Planning), John Barney (Attorney for the Town), Daniel Walker
(Director of Engineering), JoAnn Cornish (Planner).
ALSO PRESENT: John Wolff, Ellen Harrison, Mary Russell, Carolyn Grigorov, Martha

Chairperson Wilcox declared the meeting duly opened at 7:35 p.m., and accepted, for the record, the
Secretary's Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca
Journal on March 24, 1997, and March 26, 1997, together with the Secretary's Affidavit of Service by Mail of
said Notice upon the various neighbors of the properties under discussion, as appropriate, upon the Clerks of
the City of Ithaca, Town of Danby, and the Town of Ithaca, upon the Tompkins County Commissioner of
Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants and/or agents,
as appropriate, on March 28, 1997. (Affidavit of Posting and Publication is hereto attached as Exhibit #1.)

There being no one present to be heard, Chairperson Wilcox closed this segment of the meeting.
AGENDA ITEM: PRESENTATION OF TOMPKINS COUNTY WATERFRONT PLAN, JAMES
HANSON, TOMPKINS COUNTY COMMISSIONER OF PLANNING, AND PETER TROWBRIDGE,
PROJECT CONSULTANT,
Chairperson Wilcox declared the above mentioned matter duly opened at 7:36 p.m., and read aloud from
the Agenda.
Peter Trowbridge, Project Consultant from Trowbridge and Wolf Landscape Architects, gave a slide
show presentation of the Tompkins County Waterfront Plan. Mr. Trowbridge presented information from the
study along with public comments. The Tompkins County Waterfront Plan was summarized into colorful
books for review. The actual version is in a bigger book that is also available for people to review. Mr.
Trowbridge stated that the report is available through County Planning, which copies could be requested. There
was a client committee represented by all the municipalities in Tompkins County that bordered on the lake.
In addition to the Town of Lansing, Town of Ithaca, City of Ithaca, and the Town of Ulysses, Cornell
University and the Chamber of Commerce was also involved. The client committee gave the consultant team
direction, reviewed past meetings and responses, helped formulate strategy, ectertera. Mr. Trowbridge stated
that one of the first things that was done, that we needed to review all the planning studies that had been done .
in the past 20 years around the lake, and that summary is in the master report. Some of those ideas became

some of the ground work for this study. Then focus groups were established at the first public meeting to try
to scope out who had interest in this project. The first meetings involved approximately 80 to 100 people held
on Saturday mornings. There were three public hearings, and were well attended by people interested. At the
first session, the focus groups were established into three groups, such as recreation, natural resources, and
economic development. Out of these groups they were brain storming on what all the issues were, and also
bringing issues from the past planning studies for the group to review. The groups gathered the comments to
put them in terms of action oriented tasks. The comments were reviewed at the next two public hearings by
study teams to look at the issues the public mentioned. At the final meeting, the participants were asked to talk
about and give some priority ranking for the projects that they felt were most important to them. Mr.
Trowbridge's presentation summarized the five projects that seem to have the greatest priority. He also
mentioned some of the other projects the public felt were important.
Chairperson Wilcox opened the floor to questions from those present.
Town Board Member Ellen Harrison asked what type of opportunities does this plan have for the Town
with up coming projects.
Mr. Trowbridge stated that if the canal corridor initiative was not planned they would not be able to look
at any possible funding. It also would not allow a proposal for a Local Waterfront Revitalization Plan (LWRP).
Both cases require a certain amount of public consensus in the sense of building. This plan came from the
community.
Martha Armstrong asked if any dollar values have been applied for these projects.
Mr. Trowbridge stated that there were five high priority projects. The bigger book of the plan shows
estimated costs for those projects.
Town Board Member Harrison asked what is the time frame for the LWRP, and who is gathering the
information.
Director of Planning Jonathan Kanter stated that if the grant for the LWRP is received, it would be a
joint plan with the City and the Town, along with the surrounding municipalities. Then this would be a
regional plan. The project would take approximately 12 to 18 months to do.
Town Board Member Harrison asked if this would address the water quality issues and inner municipal
agreements.
Mr. Trowbridge stated that was correct.
Board Member Gregory Bell stated that the long list of projects is an impressive list, and if they were
built it would be wonderful. There is little mention of environmental quality in the plan, but it does bring out
the spirit of it. Mr. Bell stated that he would like to see generic comments, and then comments as to where
things fit into the future. The focus of this report is just projects, and that focus automatically excludes some
of the environmental concerns.

Mr. Trowbridge stated that Mr. Bell is right. There were broader discussions about different issues.
Some were preservation issues and conservation issues along with natural resource issues. The City is looking
to create more developable parcels. The City is acting as a facilitator, not to acquire property, but to reposition
the market for people to actually do things. Parcels in this area are divided into very small parcels.
Town Board Member Carolyn Grigorov asked if these small parcels are separately owned.
Mr. Trowbridge stated that was correct.
Conservation Board Member Barney Unsworth asked if there would be better funding potential if the
plan was able to accomplish inter County cooperation. Mr. Unsworth further asked about the environmental
factors, such as motorized boats and jet skis on the lake, and if there are any speed regulations.
Mr. Trowbridge stated that the City's Byway program deals with some of those issues, such as signage
and corridor management studies. There needs to be a multi County umbrella that allows sufficient water
quality.
Director of Planning Kanter stated that there could be a joint shared program or regulations between
the City and the Town. It might not be a full Cayuga Lake Noise Control Ordinance, but if it comes out of the
LWRP noise control would be a good idea. Any involved municipalities could join together with an inter
municipal agreement through a Harbor Control Management Plan. Right now the Town of Ithaca does not have
any land use control over the water.

Attorney for the Town John Barney stated that there is always an issue of State regulations of the water
Conservation Board Member Lois Levitan asked what are the ratifications for lead proposals on
increasing or decreasing motor boat traffic or pollution closer to the City.
Mr. Trowbridge stated that there are no new slopes developed. This brings more transient traffic to the
City if there were designations closer than Treman Marine.
Town Board Member Mary Russell asked if part of the regional plan funding comes from the State or
Federal Government. Ms. Russell further asked what are the chances of this happening.
Mr. Trowbridge stated that it looks good. The sponsoring municipalities would contribute in prorated
or agreed ways so the State would give approximately 50 percent for funding this project.
Director of Planning Kanter asked how far into the water would the Stewart Park performance stage
extend from the shore line.
Mr. Trowbridge stated that the stage would sit on the shore line. There are questions about the pier
extending into the lake. Mayor Cohen is interested in redeveloping a public pier in Stewart Park. The
performance area is constructed like a tent that sits on a wooden platform on the shoreline.

AGENDA ITEM: SEOR DETERMINATION. PROPOSED HUBBELL SUBDIVISION, LOCATED
AT 1308 MECKLENBURG ROAD,
Chairperson Wilcox declared the above mentioned matter duly opened at 8:42 p.m., and read aloud from
the Agenda.
Glenn Hubbell, 1308 Mecklenburg Road, stated that he has lived at the present location for the past 22
years with his late wife, Mary, and six children. The parcel is approximately 11 acres. He is very partial to the
view he has from his property. He is concerned about potential progress on the lands surrounding his property.
Mr. Hubbell stated that approximately a year ago his late wife and him, in lieu of her declining health, his
daughter would like to build a house on a lot near the present house to take care of his late wife. Mr. Hubbell
stated that he would like to give his daughter the lot designated on the recent survey. The lot would be 1.4 acres
of the 11 acres he already owns. The house would be built on the proposed lot, and would not change the
character of the community. Mr. Hubbell stated that he does not have any plans for the remaining property.
Director of Planning Kanter stated that Assistant Town Planner George Frantz reviewed this proposal,
and he did not identify any significant environmental issues. Mr. Kanter stated that a concern outlined in the
environmental assessment deals with the property being located in the Tompkins County Agricultural District.
•The necessary agricultural statements have been filed. The proposed building lot would not result in any
significant change in the surrounding area. Drainage is not a big issue. The slope is a fairly gentle sloping
down the hill. There is a creek to the north of the larger parcel, but it is well removed from the proposed
building lot on Mecklenburg Road. The Environmental Assessment recommends no significant environmental
impact.
MOTION by Robert Kenerson, seconded by James Ainslie:
NOW, THEREFORE, BE IT RESOLVED:
That the Town of Ithaca Planning Board hereby makes a negative determination of environmental
significance in accordance with the New York State Environmental Quality Review Act for the above
referenced action as proposed and, therefore, neither a Long Environmental Assessment Form, nor an
Environmental Impact Statement will be required.
There being no further discussion, Chairperson Wilcox called for a vote.
AYES - Wilcox, Ainslie, Kenerson, Bell.

PUBLIC HEARING. CONSIDERATION OF A PRELIMINARY AND FINAL SUBDIVISION
APPROVAL FOR THE PROPOSED SUBDIVISION AT TOWN OF ITHACA TAX PARCEL NO 27-
1 -14.1. +/- 11.3 ACRES IN AREA AND LOCATED AT 1308 MECKLENBURG ROAD, INTO TWO
LOTS, +/- 9.9 AND +/ -1.4 ACRES IN AREA RESPECTIVELY AG - AGRICULTURAL DISTRICT
AND RESIDENCE DISTRICT R-15. GLENN F. HUBBELL OWNER/APPLICANT
Chairperson Wilcox declared the above -noted matter duly opened at 8:49 p.m., and read aloud from
the Notice of Public Hearings as posted and published and as noted above.
Chairperson Wilcox stated that the Town approached Mr. Hubbell and asked him to alter the lot size
in order to make it easier for future extension of West Haven Road north. Mr. Hubbell was very agreeable, and
he will work with the Town as he understands the need of getting a connector road to Trumansburg Road for
the Fire Department.
Mr. Hubbell stated that there is natural gas right -of -way on of the proposed parcel as well as the
accessibility of water, which is just off the parcel. They would have all the utilities.
Director of Engineering Daniel Walker stated that the proposed parcel has available water, but the
• pressure might be low so they may need a booster pump. The sewer is on the other side of the road, and it

would be possible to install. The lot would be large enough for a septic system.
Board Member Ainslie asked if they would need to drill under the road.
Director of Engineering responded, yes. They could go with a four inch lateral as opposed to an eight
inch main, which is a smaller job.
Board Member Ainslie asked how deep would they need to drill.
Director of Engineering Walker stated that they would need to drill four feet deep with the possibility
of being deeper. The sewer down the hill is five or six feet deep.
Mr. Hubbell stated that his son -in -law was the contractor that put the extension up Mecklenburg Road
for the sewer a few years ago.
Board Member Bell stated that these documents mention that some of the parcel is R -15 zoned and the
other part is Agricultural. Mr. Bell asked where the boundary line for the Agricultural District is.
Director of Planning Kanter stated that the boundary is along the western proposed boundary of the new
lot, approximately 225 feet west of the eastern parcel boundary. The proposed lot would be entirely within the
R -15 district, and would need to meet all the R -15 lot requirements. Mr. Kanter showed the Board a survey
• with lines drawn to show a potential future road way connection for the West Haven Road extension. There
are no definite plans for the connector road way. Mr. Kanter pointed to a larger map to show the Board how
a connector road could be constructed from Mecklenburg Road to Bundy Road. Mr. Kanter also pointed out

• two options for the connector road off of Mecklenburg Road.

Board Member Ainslie stated that the Hubbells would need to position their house on the back side of
the proposed lot.
Mr. Hubbell stated that they have already discussed building the house in the far corner of the proposed
lot.
Board Member Ainslie stated that the lines drawn on the survey for the potential road connection shows
the road taking half frontage off the lot.
Director of Planning Kanter stated that if the Town were to bring the connector road in alignment with
West Haven Road, the road would need to be straight northward for approximately 100 feet.
Board Member Ainslie asked if Mr. Hubbell should consider moving the lot to the west because the
potential road connection would take the front yard from the house.
Attorney Barney stated that is now and what may happen in the future is the question.
Mr. Hubbell stated that the house would be located as close to the side lots on the north western corner
of the proposed lot.

Board Member Bell asked where the proposed lot is in conjunction with the Saddlewood Development
that was proposed last year.
Director of Planning Kanter pointed out on a map where the proposed lot is located. The previous
proposal from Saddlewood Development was on the other side of Mr. Hubbell's property from the proposed
lot.
Chairperson Wilcox opened the Public Hearing. No one spoke. Chairperson Wilcox closed the Public
Hearing, and asked if anyone was prepared to offer a motion.
MOTION by Robert Kenerson, seconded by James Ainslie:
NOW, THEREFORE, BE IT RESOLVED:
1. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and
Final Subdivision Approval, specifically, the requirement that building setback lines with
dimensions be shown on the plat, having determination from the materials presented that such
wavier will result in neither a significant alteration of the purpose of subdivision control nor the
policies enunciated or implied by the Town Board.
• 2. That the Planning Board hereby grants Preliminary and Final Subdivision Approval for the
proposed subdivision of +/- 1.4 acres from Town of Ithaca Tax Parcel No. 27 -1 -14.1, located
at 1308 Mecklenburg Road, as shown on a subdivision plat entitled "Survey for Glenn F. &

AGENDA ITEM: CONSIDERATION OF A RECOMMENDATION TO THE TOWN OF ITHACA
TOWN BOARD REGARDING ENDORSEMENT OF THE TOMPKINS COUNTY WATERFRONT
PLAN,
Chairperson Wilcox duly opened the above mentioned matter at 9:16 p.m., and read aloud from the

Director of Planning Kanter stated that Board Member Eva Hoffmann thought that there were references

• in the plan about modifications of the lake edge, such as stabilization on the shoreline next to the trail to keep
the trail from falling into the lake. Ms. Hoffmann's feelings were that those modifications should keep the
lake's natural appearance, not a man made appearance. Ms. Hoffmann liked the idea of the floating docks
being installed along the inlets. They would not necessarily be permanent structures, but would not be too
disruptive. They would provide good access opportunities for boaters. Ms. Hoffmann commented on public
access addressed in the plan. When someone proposes development on the waterfront area for commercial or
non - recreational nature, public access should be incorporated into the proposal. Overall Ms. Hoffmann thought
the plan was very good..
Board Member Kenerson stated that for this plan to proceed further, inter municipal cooperation should
be put together. Mr. Kenerson asked if there are any means being thought of to organize or implement.
Director of Planning Kanter stated that he has not heard anything yet, but that would be one way of
getting cooperation and funding mechanisms in place.
MOTION by Fred Wilcox, seconded by Robert Kenerson:
WHEREAS:
1. The Tompkins County Department of Planning has coordinated the Tompkins County
Waterfront Plan, which is a strategic plan for the southern end of Cayuga Lake Waterfront, to
• promote the scenic, historic, and recreational assets of the area as a "Southern Entrance to the
Eric Canal "; and
2. Representatives from Tompkins County, the City of Ithaca, Town of Ithaca, Cornell University,
and the Tompkins County Chamber of Commerce have participated in an Oversight Committee
responsible for overseeing the preparation of the above - referenced Plan; and
3. Three public workshops were held during the formulation of the Plan to solicit public
participation and comment, and these public workshops formed the basis for the Plan's
recommendations and priories; and
4. Among other elements, the Waterfront Plan includes an analysis of potential public access to
Cayuga Lake, which is included as an important strategy in the Town of Ithaca Comprehensive
Plan (1993); and
5. The results of the Plan have been summarized in a document entitled, "Tompkins County
Waterfront Plan," January 1997; and
6. The Planning Board, at a meeting held on April 1, 1997, has reviewed the above - referenced
Plan.
• NOW, THEREFORE, BE IT RESOLVED:
1. That the Town of Ithaca Planning Board hereby finds that the Tompkins County Waterfront
PLANNING BOARD MINUTES 9 APRIL 1, 1997

• Plan is consistent with and supportive of the or of the Town of Ithaca Comprehensive Plan
(September 1993); and
2. That the Town of Ithaca Planning Board hereby recommends that the Town of Ithaca Town
Board endorse the Tompkins County Waterfront Plan.
The Board agreed to delete "as a "Southern Entrance to the Erie Canal" from the first Whereas.

Chairperson Wilcox duly closed the matter of endorsement recommendation to the Town Board for the
Tompkins County Waterfront Plan at 9:30 p.m.
AGENDA ITEM: CONSIDERATION OF A RECOMMENDATION TO THE TOWN OF ITHACA
• TOWN BOARD REGARDING (1) THE POSSIBLE SUBSTITUTION OF A PARCEL THAT WAS
INTENDED TO BE DEDICATED AS A TOWN PARK FOR ANOTHER PARCEL ON OWNER'S
LAND, AND (2) LOCATION OF A POSSIBLE COMMUNITY PARK IN THE SOUTH HILL AREA
THE ORIGINAL PROPOSED TOWN _PARK PARCEL. CONSISTING OF 1 8 +/- ACRES IS
LOCATED ON EAST KING ROAD ADJACENT TO THE MONTESSORI SCHOOL AND IS PART
OF TAX PARCEL NO. 43- 1 -3.2. EVAN MONKEMEYER. OWNER; TERRY ROSWICK AGENT
The Planning Board received a memorandum from Mr. Kanter stating that the Monkemeyer proposal
was being pulled from the agenda for tonight's discussion. The Board had a brief discussion about the
memorandum. Mr. Kanter thought there was an agreement in place, but then Mr. Monkemeyer failed to come
through with a revised plan as was agreed. Mr. Kanter mailed a letter to Mr. Monkemeyer summarizing the
process of where the proposal stood, and urged him to work this out fairly soon.
AGENDA ITEM: APPROVAL OF MINUTES - MARCH 18 1997
Chairperson Wilcox stated that the March 18, 1997 Planning Board Minutes would be ready for
approval at the next meeting on April 15, 1997.
AGENDA ITEM: OTHER BUSINESS.
• Chairperson Wilcox stated that the Draft Environmental Impact Statement (DEIS) for the Cornell
University Lake Source Cooling Project is available for review. There are copies in the Planning Department
for anyone interested in reviewing the Draft.

Mr. Kanter stated that comments should be sent to DEC by April 21, 1997. He is requesting that both
the Town Board and Planning Board authorize staff to review the DEIS, and if appropriate, send comments to
DEC on behalf of the Boards.
Chairperson Wilcox stated that he authorizes the Planning Staff to review the DEIS.

and located at 1308 Mecklenburg Road, into two lots, +/- 9.9 and -/- 1.4 acres in area

�. This is an Unlisted Action for which the Town of Ithaca Planning Board is legislatively
determined to act as Lead Agencv in environmental review with respect to Subdivision
Approval, and
3. The Planning Board has reviewed and accepted as adequate the Short Environmental
