PRESENT: Chairperson Fred Wilcox. Eva Hoffmann, James Ainslie, Herbert Finch, Robert Kenerson, Gregory Bell, Jonathan Kanter (Director of Planning), John Barney (Attorney for the Town), Daniel Walker (Director of Engineering), George Frantz (Assistant Town Planner). ALSO PRESENT: Robert KelloQQ. Alan Teeter. James Teeter. Chairperson Fred Wilcox declared the meeting duly opened at 7:34 p.m., and accepted, for the record, the Secretary's Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on December 27, 1996. and December 31, 1996, together with the Secretary's Affidavit of Service by Mail of said Notice upon the various neighbors of the property under discussion, as appropriate, upon the Clerks of the City of Ithaca, Town of Danbv, and the Town of Ithaca, upon the Tompkins County Commissioner of Planning, upon the Tompkins County Commissioner of Public Works, and upon the applicants and/or agents, as appropriate, on December 31, 1996. (Affidavit of Posting and Publication is hereto attached as Exhibit 41.) Chairperson Wilcox read the Fire Exit Regulations to those assembled, as required by the New York State Department of State, Office of Fire Prevention and Control. AGENDA ITEM: PERSONS TO BE HEARD. There being no one present to be heard, Chairperson Wilcox closed this segment of the meeting. AGENDA ITEM: SE _R DETERMINATION, PROPOSED TEETER SUBDIVISION, LOCATED ON GRAY ROAD. Chairperson Wilcox duly opened the above- mentioned matter at 7:39 p.m. James Teeter, 330 Enfield Falls Road stated that he wants to build a house on the property in question (3.0 +/- acres from Tax Parcel No. 33 -1 -27.2. 53.3 = -- acres in size), and would like to transfer this property to his daughter. The remaining parcel would be transferred to his son. Assistant Town Planner George Frantz stated that Mr. Teeter would like to transfer the 3 acre parcel to his daughter as shown on the survey map. The remaining 50 acres of the farmland would not be effected by this subdivision. �J • • PLANNING BOARD MINUTES K APPROVED - JANUARY 21, 1997 JANUARY 7, 1997 Chairperson Wilcox stated that he noticed Mr. Frantz's comments in the SEQR. In discussions with the Planning staff it was mentioned that this house was already being constructed. He asked if the house would interfere with any zoning requirements. Assistant Town Planner Frantz stated that the house complies with zoning. It is the only house that would be on the farm parcel itself. The old farm house is on a separate lot. Mr. Teeter stated that this part of the farm is in the Town of Ithaca and the other part of the farm is in the Town of Enfield. Chairperson Wilcox asked Mr. Frantz to describe the proposed subdivision as related to the Unique Natural Area. Assistant Town Planner Frantz stated that the County has mapped a number of areas that they refer to as Unique Natural Areas around Tompkins County. In the Town of Ithaca, the County has at least three areas, which are called unnamed future sites. The County has them on their map, but the Town does not have any information about why they are on the map. The Teeter property is located in one of these designated areas by the County. The issue is that the Unique Natural Area the County has mapped on the Teeter's property covers a fairly deep ravine, which is known as the Steep Hollow Creek. The ravine starts along the area of Route 327 and continues into the Town of Enfield. Chairperson Wilcox asked Mr. Frantz if he could point out where the house is on the property. Assistant Town Planner Frantz pointed out the house for the Planning Board. Mr. Frantz stated that the house is in a field, not in the woods. One corner of the lot does extend into the ravine, but the Planning staff's assessment shows that there is no significant adverse impact to the Unique Natural Area or to the ravine. Board Member Gregory Bell asked ivir. Frantz how many feet it is from the edge of the house to the edge of the ravine. Assistant Town Planner Frantz responded, approximately 100 feet. Board Member Bell asked Mr. Frantz if the woods start at the edge of the ravine. Assistant Town Planner Frantz responded, no, but some of the fields go into the ravine. Board Member James Ainslie asked ivIr. Frantz if there was a natural stream. Assistant Town Planner Frantz responded, yes. Board Member Ainslie asked N/Ir. Frantz if the stream was on the edge of the ravine. I PLANNING BOARD MINUTES 3 JANUARY 77 1997 • APPROVED - JANUARY 21, 1997 Assistant Town Planner Frantz responded, no. It is approximately 200 to 300 feet from the top of the ravine down to the stream. Board Member Kenerson asked Mr. Frantz if the house that is being built was not in a wooded area. Assistant Town Planner stated that was correct, the house is being built in a field. Chairperson Wilcox stated that the Conservation Board submitted a letter stating that they did not feel that there was any significant environmental impact. MOTION by Herbert Finch, seconded by James Ainslie: NOW, THEREFORE, BE IT RESOLVED: That the Town of Ithaca Planning Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above - referenced action as proposed and, therefore, an Environmental Impact Statement will not be required. There being no further discussion, Chairperson Wilcox called for a vote. AYES - Wilcox, Hoffmann, Ainslie, Finch, Kenerson, Bell. • NAYS - None. The MOTION was declared to be carried unanimously. That the Town of Ithaca Planning Board hereby waives certain requirements for Preliminary and Final Subdivision Approval. as shown on the Preliminary and Final Subdivision Checklist, having determined from the materials presented that such waiver will result in neither a significant alteration of the purpose of subdivision control nor the policies enunciated or implied by the Town Board, and 2. James Teeter of Gray Road at 7:50 p.m. PLANNING BOARD MINUTES 5 JANUARY 711997 • APPROVED - JANUARY 21, 1997 AGENDA ITEM: OTHER BUSINESS. Director of Engineering Daniel Walker stated that Rocco Lucente has requested a lot line modification facing Briarwood Drive at the intersection of the Town's park right -of -way. Mr. Lucente is constructing a two family home on this lot. The proposed lot line modification will make this lot 50 feet deeper for a total depth of 150 feet. Tax Parcel No. 70- 10 -3.5, which is approximately 26 acres, would be two- tenths of an acre smaller. Mr. Walker stated that he has accepted this as a minor modification of the Briarwood Park Subdivision, and he signed the plat for the Planning Board, as he is authorized to do for minor modifications. Mr. Walker stated that this is the report to the Planning Board that he is required to give. (Engineer's Report of the Briarwood Park Lot Line Minor Modification approval is hereto attached as Exhibit 94.) AGENDA ITEM: CONTINUATION OF DISCUSSION REGARDING DRAFT PARK, RECREATION AND OPEN SPACE PLAN, TO`IVN OF ITHACA (GEORGE FRANTZ, ASSISTANT TOWN PLANNERI. Chairperson Wilcox duly opened the above - mentioned matter at 7:55 p.m. Director of Planning Kanter stated that the proposed Park and Open Space Plan is still in the very early stages, and there would be plenty of time for comments and revisions. Assistant Town Planner Frantz stated that the Plan refers to a substantial sum of money; $7.8 million. Over the next 20 years, $1.6 million would be proposed for the development of new parks and $1.8 million would be for the development of new bicycle and pedestrian facilities. In addition the plan proposed that the Town of Ithaca establish a Purchase of Development Rights Program. This would essentially target the primary agricultural areas in the West Hill area, West King Road area, and the South Hill area, as well as a number of parcels with significant natural resources that have em ironmentally sensitive assets. That proposal would cost approximately $3.5 to $3.6 million. Board Member Bell stated that he is curious about the date on the memo that was supplied to each member of the Board from the Association of Towns for the Environmental Protection Fund. The application deadline for that money was January 3, 1997. Assistant Town Planner Frantz stated that the memo was received a few days before the Planning Board mail out. This particular application cycle is the first year of a multi -year program. Board Member Bell asked Mr. Frantz if there will be an annual cycle for applications. Assistant Town Planner Frantz responded. yes. There might be another announcement in late 1997 for a grant program. At that point, hopefully. the Town of Ithaca would have made its commitment to a Purchase of Development Right Program, and could be in a competitive position to be awarded a $500,000.00 grant. • PLANNING BOARD MINUTES 6 JANUARY 7, 1997 • APPROVED - JANUARY 21, 1997 Director of Planning Kanter stated that he is not sure that this particular announcement relates to the Environmental Bond Act that was just passed or whether this is something different. Mr. Kanter stated that he attended a meeting that was held by the Tompkins County Planning Department on several different grant programs that are available. The monies from the Environmental Bond Act is the grant the Town would be most interested in. One of the categories in this Act is the Conservation and Open Space Lands, which would fit into the Purchase of Development Rights and consen-ation easements for farmland and open space land for the Town's plan. The State is very unclear on deadlines and application procedures for the Bond Act money. The Town would be interested even though the program is not in place yet. The State does not know what the timing of the release funds would be, but the Town should submit a letter of interest to the State. The funding would be put into the 1997 -1998 State Budget. The money has already been included in the approved Budget. The County Planning Department was encouraging the Town to submit conceptual plans as a starting point. It would be important to get some contacts with the local legislative office. There would need to be negotiations between the legislature and the governors office to approve these projects. Chairperson Wilcox asked Mr. Kanter if he knows of a possible dollar amount. Director of Planning Kanter responded, no. Chairperson Wilcox stated that Mr. Frantz speculated as much as $40 million. • Assistant Town Planner Frantz stated that S40 million is expected to be available for this program through the Environmental Bond Act. Another possible source would be the Federal Government. In the 1996- 1997 fiscal year, $14.5 million was allocated for Agricultural Purchase of Development Rights Programs, and they. anticipate doubling that figure in the nest fiscal year. If the Town adopts this concept (program), it would be in a good position to capitalize on new arant programs. The Town of Ithaca, if it initiates a purchase of development rights program, will be one of the first Towns in New York to do so. The only other program he is aware of is in the Town of Pittsford near Rochester. The Town of Pittsford is almost fully developed and they decided that they wanted to preserve their last few hundred to thousand acres of farmland. They are paying $10,000.00 an acre for Purchase of Development Rights. Mr. Frantz stated that he would like to go over the cost of each park system. The idea is to put a series of neighborhood parks each within a half mile of homes in major developed areas of the Town. Three community /area parks which would serve the entire Town would have major facilities such as baseball or softball diamonds, soccer fields, picnic facilities. etc. Then connecting the parks with the houses and with each other, as well as connecting homes with the downtown City would be approximately 20 to 25 miles of bicycle and pedestrian paths. The cost of this would be S3.4 million. That would be the bad news, but the good news would be that the Town is now funding a current parks department in the current budget in the range of $100,000.00 a year for capital projects in the parks department. If the Town maintains that level of funding, that would represent $2.1 million over the nett 20 years. That would be two- thirds of the anticipated cost of • this plan already. The Planning staff is proposing other methods of funding, one of which is grant applications. PLANNING BOARD MINUTES 7 JANUARY 7, 1997 • APPROVED - JANUARY 21, 1997 With a plan like this the Town would be put into a very— competitive position. The grants could be anticipated within the range of $600,000.00 if the staff aggressively pursue grants on an annual basis for park development. That would bring it to approximately $700,000.00. Another potential beneficial money source that the Town has yet to start tapping would be individual donations. This is something that the staff has not begun to tap in. Board Member Robert Kenerson asked Mr. Frantz if that investment is against a grant as matching funds. Assistant Town Planner Frantz stated that there would need to be a lot of volunteer effort, which is one of the things listed as a high priority for building play structures, park pavilions, benches, landscaping, tree 'plantings, etc. The Town might need to put up some of the costs for materials and then have volunteers building it at substantial savings. An example, a pavilion was constructed at the Coddington Road Community Center this past summer. The Town and the Community Center received a donation of $10,000.00 for the materials towards a new pavilion. In this case, the Town's contribution was the Youth Conservation Corp Program, who did most of the construction. A lot of the finishing work on the pavilion was completed by Community Center volunteers. Board Member Ainslie stated that there was to be a park next to the Old One Hundred at the end of Bostwick Road. He noticed the sign for the Assembly of God Church is down, and a new sign is up for James Schaffick. Mr. Ainslie asked Mr. Frantz if he knows if the land was for sale. • Assistant Town Planner Frantz responded, no. Director of Planning Kanter stated that the park is there. The Town has the deed to the park, which is approximately eight acres. Board Member Ainslie asked if that would make a difference since the property is under a real estate agent. Assistant Town Planner Frantz stated that it has been mentioned that the church has had some problems raising funds for the new church. Board Member Ainslie asked if the park would still be there. Assistant Town Planner Frantz responded, yes, because the Town owns the park. Another source of funding could be covered by the anticipated fees in lieu of land that the Town can generate as the Town develops over the next 20 years. One of the benefits of the Town having a park plan is that there are several parcels that could be developed in the future. The Town would not need beyond 40 or 50 foot wide for a bike path, which means there could be cash from these developers in lieu of park land. The Town reserves the right to collect a fee in lieu of land as EcoVillage grows in the future. If a parcel in the South Hill area is developed in the future, there would not be a need to have a park dedication there in terms of land, so the Town would be • able to collect a fee in lieu of The staff factored this into the cost. PLANNING BOARD MINUTES 8 JANUARY 79 1997 0 APPROVED - JANUARY 21, 1997 Chairperson Wilcox stated that the Planning Board could not arbitrarily make a determination that the Town would prefer a fee in lieu of instead of land. The Board would need to make a determination first. Assistant Town Planner Frantz stated that a way to do that would be to refer back to the plan and map which has determined that this particular parcel of land is not a suitable location for a public park for the 1997 Park, Recreation, and Open Space Plan. Tapping into the national standards of the number of acres of park per thousand people of population would help the Planning Board to make their decision of park land determination. There are two parts of the report that would help the Planning Board to come to a decision. Board Member Kenerson asked if this would be a 20 year project. Assistant Town Planner Frantz responded, yes. Board Member Kenerson asked who would be managing and coordinating this project for 20 years, and if the monies would be tied in with the applications made. Mr. Kenerson further asked if it would be the Town Board or Planning Board. Assistant Town Planner Frantz stated that he sees it as a collective effort with the Town Board leading and assuring it in the work priorities each year. Board Member Kenerson asked if the grants would equal matching funds, and if the matching funds would be coming from donations or bonding of some kind. The tax payers are in an ugly mood about increasing taxes. Assistant Town Planner Frantz stated that he has had discussions with Richard Schoch (Park's Manager), to keep up the $106,000.00 per year improvements. It might be years for $20,000.00 to be spent in capital Board Member Kenerson asked if municipalities could accumulate funds for future projects. Director of Planning Kanter stated that could be done in capital reserve funds. Assistant Town Planner Frantz stated that the idea is that money is there in case an opportunity comes along that the Town could apply for the grant. Board Member Eva Hoffmann stated that %1 4r. Frantz mentioned in Chapter 6, that the Parks Department Budget includes some money that is spent by the Park's Department employees working for other departments. Mr. Frantz suggested this as a future thing that could be billed to those departments. It does not look like a huge part of the money, but it could help. N1s. Hoffmann asked if she read this section correctly, if this could be done already now. C PLANNING BOARD MINUTES 9 JANUARY 7, 1997 • APPROVED - JANUARY 21, 1997 Assistant Town Planner Frantz stated that hopefully it could be done right away. Mr. Frantz stated that- he has mentioned this to Richard Schoch and Fred Noteboom (Highway Superintendent). They understand that it would be a good idea to do it. One of the problems is that the Parks Department and the Highway Department work very closely together, and they have not distinguished who is doing what for whom. If the Parks Department happens to have an excavator or a front end loader, then the Highway Department would shift the equipment and personnel to parks for that project. The Town learned a lot with the South Hill Recreationway Project, that the staff needed to do this t%.pe of accounting. Director of Planning Kanter stated that the Nvav the 1997 Budget was set up, that it is much more specific and detailed in terms of tracking things. It is now the matter of having the individual staff person who are working on different projects to keep track of their own hours and assign it to the proper budget line. Board Member Hoffmann asked if the mone%. left for park use could be used for purchasing land or purchasing development rights, or does the money need to be used for maintenance and construction. Assistant Town Planner Frantz stated that the Town's intention is that the money be limited to construction projects. The Town has been very successful in getting property owners to donate land, especially for bike ways. Hopefully, the Town could continue to do this. On South Hill, the Iacovelli's park site was a donation of ).5 acres. On East Hill, the Town is proposing a neighborhood park in the area between Mitchell Street and Honness Lane, where these landowners could donate park land to the Town. The new landowners of Black Oak Lane want to preserve it as open space. Director of Planning Kanter stated that the staff would be pushing for grants, and the Town could have preliminary designs for each park. When grant programs have money available, and something is sitting on the shelf that is ready to go, the Town would be in a good position to apply for a grant. Even if the staff knows that a park may not be developed for ten years, they still could develop some concept plans as to how the park would be seen by having ideas ready to go. They could have public meetings to get some good input from the community on what they would prefer to have in the Town of Ithaca. Board Member Herbert Finch stated that there was a story in the paper today about the way the Town of Ulysses is hoping to move in on the canal grant monev and they were talking about the Black Diamond Trail. Mr. Finch asked if the Town is in conversation with them to be collabrating with the Town of Ulysses. Assistant Town Planner Frantz stated that he also read the article. The Black Diamond Trail is the State Parks Project, and they have the funding for it. In the last discussions with some of the staff at the State Parks was that they were closing in on a purchase deal with NYSEG in which they would acquire the old railroad grade from Cass Park to Trumansburg. Nlavbe the Town of Ulvsses will do some projects that are associated y with the Black Diamond Trail. Board Member Finch asked if the Town is in a position or is the Town cooperating with and communicating with the State Parks people. PLANNING BOARD MINUTES 10 JANUARY 7, 1997 APPROVED - JANUARY 21, 1997 Assistant Town Planner Frantz stated that the Town is cooperating with the State Parks people. The plan reflects this and one of the problems the State Parks is facing in designing the Black Diamond Trail is having it go under 115,000 kilovolt power lines. ivir. Frantz pointed out on a map where a section of the Black Diamond Trail could be re- routed. Director of Planning Kanter stated that there have been discussions with people who are involved with the Canal Corridor initiative grant money. Trail development and recreational kinds of facility development is not what they have intended for that program. Possibily if it is something that would link a hotel with a shore front area through a trail, maybe, but they said not to put the hopes into that type of facility. Mr. Kanter stated that he is glad that he attended the seminar with the Tompkins County Planning Department because they dealt with three different programs at the same time. They mentioned that the Environmental Bond Act money will be available for things like a trail. Board Member Finch stated that he is not as concerned about the specifics of trails or grants as he is with the communication lines with the Town of Ul %,sses. Assistant Town Planner Frantz stated that when the staff gets the draft ready for distribution, it would be worthwhile to send a few copies to the Town of Ulysses Planning Board and to the Office of Parks, Recreation, and Historic Preservation to get their feedback. isDirector of Planning Kanter stated that something that would be more directly related would be the County trail study that was done 1995 -1996, which looked at a lot of linkages for possible trail systems in the County. The link between the Town of Ulysses and the Town of Ithaca is the Black Diamond Trail. The link between the Town of Dryden and the Town of Ithaca is the extention of the East Ithaca Recreationway. Board Member Finch asked if either of those Towns were working towards a park plan. Director of Planning Kanter stated that he thinks the Town of Lansing is doing more than the Town of Ulysses and the Town of Dryden. The Town of Dryden is doing work on a master plan. Board Member Kenerson asked if this would tie in with the County's Comprehensive Plan. Director of Planning Kanter responded, yes. Board Member Kenerson asked if they are doing a countywide analysis. Director of Planning Kanter stated that they are kind of doing an analysis. So far it is pretty much limited to trails and linear recreation ways. The County does not have it's own county park system, it is all local and State parks. The County does not have money available to help with local park development. Board Member Kenerson asked if the Countv is eligible for the funds. • PLANNING BOARD MINUTES 11 JANUARY 7, 1997 . APPROVED - JANUARY 21, 1997 Director of Planning Kanter responded, ves, especially for community development block grants, which could be tied in with park and recreation development. The County does channel those funds. Board Member Kenerson stated that this whole thing is money related. Mr. Kenerson stated that he thinks the Town should push where they can to get what could be done now to be done now keeping in mind that the Tovvn's taxes should not be increased without limits. Attorney Barney stated that a couple of people on the Town Board have been anxious to see some substantial monies be put aside for this purpose. Board Member Kenerson stated that the money is what drives this thing, and the Town needs to have everyone in order to what the money is needed for and how to get it. Director of Planning Kanter stated that the Town should get the public involved by getting them interested in the plans for the future. Board Member Kenerson stated that these things need to be in place before the development rather than after the development. Director of Planning Kanter stated that looking ahead to where the development would be anticipated • is what the staff tries to deal with in the general plan. The staff would need to prioritize the Town on where the population is as to where a park would be needed each year. Board Member Kenerson asked how much grant money could the Town get if this plan works. Director of Planning Kanter stated that there are millions of dollars out there that the Town could get. Board Member Kenerson stated that these grants are usually matching grants, and the Town of Ithaca would need to come up with some money to match the money in order to get the grant. Board Member Bell stated that most of the parks today have been very sports oriented and suburban in scale. He would like to see some of these parks with an urban scale and more pedestrian oriented. It would depend on where they would be located, but the scale of State Parks and most of the Town parks do not lend themselves to certain kinds of activities such as just sitting around looking at the trees. Assistant Town Planner Frantz stated that it would not be hard to do, because a lot of the Town's parks are predominantly woods with walking paths through the woods. Mr. Frantz stated that he envisions the Town staying with this concept. The Parks Department introduced benches along the South Hill Recreationway a few- years ago. which has become very popular. Board Member Hoffmann stated that there is an important street light missing at the entrance ramp to Route 13 where it comes off of Route 34 near the Junior High School. Ms. Hoffmann stated that she was driving one night in the dark, when she went north on Cayuga Street to the stop sign at Lake Street. She said she was looking for the entrance ramp to get onto Route 13, and she had a hard time seeing where to get on the entrance ramp because there is not a light there. Ms. Hoffmann stated that she does not know whether this is in the Town or not. Attorney Barney stated that it is in the Town. but it is the Department of Transportation's ball game there because it is a State Route. Board Member Hoffmann stated that mavbe the light was lost in the reconstruction when they worked on Route 13's bridge. Attorney Barney stated that there were a series of lights there. Assistant Town Planner Frantz stated that the City directed to shut off the lights. The City paid for the lights, and the City decided that they did not want them on their section of Route 13. anymore. Attorney Barney stated that the lights continue past Purity Ice Cream until the area of the traffic merge. There has been some accidents in the darken area. The road is not very well marked. Board Member Ainslie stated that along the railroad tracks, across from the high school, it is very dark. Chairperson Wilcox stated that the Village of Lansing turned off their lights also. Attornev Barnev stated that the Town of Ithaca turned off some lights. because thev felt it was inappropriate to have the lights go off in the City and back on in the Town. It would be too distracting for people. Attorney Barney stated that the Planning Board should make a resolution to the Town Board to request them to pursue some lighting from the Department of Transportation. Board Member Hoffmann stated that this would be a safety issue because there is no lights there. MOTION by Eva Hoffmann, seconded by Herbert Finch: RESOLVED, that the Town of Ithaca Planning Board hereby requests that the Town of Ithaca Town Board contact the Department of Transportation about this serious safety issue of no lights at the entrance ramp to Route 13 from the north bound lane of East Shore Drive, and that the Board urges the DOT to put at least one light there to correct a dangerous situation.
