B Baker, N N. L LaMotte, & &;Z.O. H H. Slater p present. A Also present; R R. Dunn, R R. N Nobles, J J. D Dedrick, R R. H Hatfield, K. S Stevens, T T. Marchell, G. Sandsted & K. Werninck. IMMINW1 Public heraring to consider application of Richard Dunn to construct a single family dwelling at 1727174 Sodom Rd., Ithaca, and is requesting variance to Sec. 702 of Town of Dryden Zoning Ordinance. R. Dunn present - R. Nobles (present owner,of property) also present. Mr. Nobles stated he & Mr. Dunn were hunting friends & Mr. Dunn was interested in purchasing property if he could build house there. Mr. Nobles said he & his wife lived at that address, but he only had 120' of road frontage. Had sold aprox. 12 acres to Jeffrey Lee in'11982 & Lee had 10 yr. option to purchase a 14 acre piece. Nobles would grant Dunn an easement or r -o -w access across his property to 30 acre piece he hopes to sell in back. Mr. Nobles pointed out property locations on copy of tax map. Mr. Lee present & stated he had 1st refusal rights on remaining 90 acres. Also stated he knew nothing of Mr. Nobles intentions to sell until he'd received letter from Z. 0. about tonights public hearing. General discussion & disagreement between Nobles & Lee. P. Brellochs questiondd general topography of property, drainage, storm run -off. Mr. Nobles stated no problems w /that. Hearing closed. HEARING II Public hearing to consider application of John Dedrick to erect a 24' x 52' building at corner of Rte. 13 & North Rd. & is requesting variance to Sec. 905 of Town Zoning Ordinance J. Dedrick present - presented sketch - stated purpose of building was for more protection & less stress on equipment.) Hoping to be able to eliminate 1 - 2- • 2 of 3 wagons he now uses. Proposed Morton building (metal over wood frame) would set back further from road than wagons. General discussion & questions - Signs; 1 sign 4 x 8 feet, parking - may have more room w /building. Property hasn't been surveyed recently - No plans of becoming year round business. Mr. Dedrick owns aprox. 2 acre. Hearing closed. HEARING III Public hearing to consider application of First National Bank of Dryden to replace existing time & temperature sign at 120 North St. w/a new time & temperature sign & is requesting variance to Sec. 1506 of Town of Dryden Zoning Ordinance. K. Stevens present - Stated sign would be 5' shorter than existing sign, • same location as present sign & will be illuminated. Hearing closed. HEARING IV Public hearing to consider application of Ted Marchell to construct addition to existing structure at 4 Hall Rd. & is requesting variance to Sec. 1206 of Town of Dryden Zoning Ordinance. T. Marchell present - presented sketches of proposed remodeling of former HEP building. Plans to isolate noisy part of production from rest of building. Half of the building to be leased to tenants. More feasible to add on then to renovate. Future surrounding property owner (Spring Water Motel) sent letter to Board stating they had no objections to variance request. Hearing closed. • HEARING V Public hearing to consider application of Roger Sandsted to erect private - 3 - garage at 22 Dutcher Rd. and is requesting variance to Sec. 804 of Town of Dryden Zoning Ordinance. G. Sandsted & their contractor present to answer any questions - presented detailed sketch of proposed garage & its placement - only have 57' set back from road rather than required 70' - house approximately 65' from road (house over 150 years old) - have existing blacktop driveway. Hearing closed. HEARING VI Public hearing to consider application of L. Werninck & Sons Supply Co. Inc. to erect addition to their existing structure at 330 Main St., Freeville & is requesting variance to Sec. 701 of Town of Dryden Zoning Ordinance. K. Werninck present to answer any questions Board had. Proposed addition to be 100' x 300' - front facade will either be recessed or set forward couple • feet from existing building. Z. 0. Slater stated variance request necessary because business located in R B zone. No one present to speak for or against variance. Hearing closed. HEARING VII Z. 0. explained that McCutcheon would not be attending public hearing tonight, because proper procedure had not been followed by applicant. BOARD MOVED INTO EXECUTIVE SESSION 9:05 PM. Dunn must purchase minimum 15' legal road frontage to depth of access to proposed Dunn property. Seconded by J. Baker. No Discussion. VOTE 4 YES ( Baker ,Hatfield,Brellochs,LaMotte) 1 NO (Everett) variance GRANTED w /stipulation HEARING II (Dedrick) A. Everett motion to hold decision in abeyance until information concerning boundary survey, scaled location of structure, disposition of wagons & parking arrangement obtained. Seconded by J. Baker. No Discussion. VOTE 4 YES ( Ev erett,Baker,Hatfield,Brellochs) 1 Abstention (LaMotte) variance POSTPONED HEARING III (First National Bank) C. Hatfield motion to grant variance as proposed. No discussion. VOTE HEARING IV (Marchell) ALL YES Seconded by N. LaMotte. variance GRANTED C. Hatfield motion to grant variance as proposed. Seconded by N. LaMotte. No discussion. VOTE 3 YES (Hatfield,LaMotte, Baker) 2 NO (Brellochs,Everett) variance GRANTED HEARING V (Sandsted) A. Everett motion to grant variance as proposed. discussion. Seconded by N. LaMotte. No 0 0 - 5 - Hearing V (Sandsted cont.) VOTE ALL YES FEARING VI (Werninck) variance GRANTED N. LaMotte motion to grant variance as proposed. Seconded by A. Everett. No discussion. Hatfield motion to reject application because of technicality of applicant, not having followed procedure for filing a public hearing request. Seconded by A. Everett. No discussion.
