HomeMy WebLinkAboutTB Minutes 2010-08-09 Regular Meeting of the_ Ithaca Town Board Monday, August 9, 2010 at 5 : 30 p. m . 215 North Tioga Street, Ithaca, NY 14850 Y Minutes Board Members Present : Herb Engman , Bill Goodman , Pat Leary, Eric Levine , Tee- Ann Hunter, Rich DePaolo , and Susan Riha Call to Order & Pledge of Allegiance Supervisor Engman called the meeting to order at 5 : 30p . m . Report from County and City Officials - None Quarterly Report from the Fire Commissioner Commissioner Bill Gilligan addressed the Board at this time and went over his submitted report . He stated that the Commission is working on revamping various reports and that he would welcome the Board 's input on what they would like to see , what they find useful and what they find confusing so that reports can be tailored in the future . He went on to say that the Fire Commission 's Charter is still under review and needs to be updated to accurately reflect the Commission 's role and responsibilities . Questions from the Board — Bruce Bates asked if the breakdown showing Town calls could be further broken down into types of calls for the Town . He also asked if the Incident comparisons by year could be broken down to show if there was an increase in gas leaks and powerlines down , and if so , whether that could be attributed to cutbacks? Mr. Gilligan responded that some categories that were grouped and now are not would show movement one way or the other that may not be accurate , and these will even out and get a real picture after a couple of cycles . Mr. Bates asked if the Fire alarm attendant position is going to be removed since the boxes are . Mr. Gilligan stated that it may next year, but this year there is still dismantling that needs to be done . Supervisor Engman stated that he found the pie chart on location of calls to be very helpful and he wondered if the defining of the lines could be a little broader because there seems to be little distinction between some items , at least to the layperson . Mr. Gilligan responded that he would look at that also . Mr. Engman went on to ask if the Commission will weigh in on the request for a new firetruck by the City. Mr. Gilligan responded that that is a Capital Budget issue , not an Operations Budget and the Commission has not discussed it at all . He added that he would look into that though . TB 8-9-2010 Councilwoman Leary asked about the false alarms and whether they are system issues or malicious? Mr. Gilligan responded that they are grouped on the report and he would look into whether they could be separated out. Councilwoman Hunter asked what a "good intent call" was and Mr. Gilligan did not know. She then asked about EMS calls and why the fire department goes on them . Mr. Gilligan responded that IFD response is based on the reported need for assistance from dispatch . Sometimes dispatch does not know and frequently IFD is there before Bangs . Mr. Bates added that dispatch goes by NAV : Nearest Appropriate Vehicle when determining who to call out to a scene . Persons to be Heard and Board Comments Peter Stein addressed the Board as a Northeast resident , not speaking as a County Legislator. Mr. Stein talked about the Pine Tree Rd issue regarding the raising of the bridge and widening of the road . He has heard from many residents that this will cause an increase in truck traffic and speed and he would like the Town and the County to work together to see that resident concerns are looked at . He stated that he had reviewed the legislative history and the project justifications were three -fold : to increase the transfer of goods , to satisfy the needs of the town for pedestrian safety and to help facilitate bicycle traffic . He thought it should be a collaborative effort and information should be sought as to whether the traffic would increase . The Board wondered how it would have a voice in the process since it is a County Road and a County Project, and Ms . Brock stated that the County should be doing a SEQR review and that is when and how the Town could become involved as an interested agency. Supervisor Engman stated that he would ask the County about its schedule . Mr. Stein then went on to re-address the speeding issue in the Town , saying that maybe the Town needs to look at its own police force . Mr. Engman responded that it is a town - wide problem , not just East Hill and there is no easy answer. Lois Buck, Pine Tree Rd — Ms . Buck reiterated Mr. Stein 's points and stated that she and her neighbors were trying to understand the impact the project may have on their neighborhood , and added that they are worried not only about increased quantity of trucks , but also the increased size of trucks traveling through the neighborhood . Claire Nicoletti — Eastwood Commons commented that fracking is a major concern and if the bridge is raised , that will allow those types of trucks to go through . She thought the least that should happen is the speed limit should be reduced . She asked some workers taking measurements who said they were working for gas drilling . Councilwoman Riha explained Cornell has a large LINC project going through the process and they are testing for that drilling , not fracking . She added that the LINC project will go through the Planning Board stages and truck routes would be set for those trucks . Lucia Shorey, Pine Tree Rd She spoke about neighborhood ' s concerns about overweight trucks coming down Route 79 . She added that they are not a student 2 TB 8-9-2010 neighborhood , but a family neighborhood with many small children and they have safety concerns about the traffic . They have offered to allow the sheriff' s cars to sit in their driveways to ticket them , but nothing is done . Board Comments : Councilwoman Leary asked what role the Town has and how we can address the concerns just stated . Discussion followed on state standards for roads and ways to apply for alternatives to them and about the SEAR process . Councilwoman Hunter asked that the topic be put on the agenda for the August Study Session and Councilwoman Riha added that we need more information on truck routes and where they are coming from and going to as well as speeds really traveled on the roads , not just perceptions of speed , and state standards for roads and the process for not adhering to them . Councilman DePaolo added that ultimately we are up against a state philosophy on how and why they build and expand roads and there are funding avenues out there for those who don 't want to build the norm , but the county does not seem to pursue those . Too often the easiest route to funding is the only one investigated . Supervisor Engman added that this is a town -wide issue and the college (s) are the main employers in the area and they are going to continue to grow and neighborhoods are going to continue to be affected . Added Agenda Items — 1 . Discuss whether to set an August Study Session meeting and its agenda 2 . Schedule a possible Youth Council presentation 3 . Executive Session to consider the employment history of a particular person . Approved . 5 : 45 Public Hearing Regarding a Local Law Electing a Retirement Incentive Program as Authorized by Chapter 105 , Laws, of 2010 for the Eligible Employees of the Town of Ithaca Supervisor Engman opened the public hearing at 6 : 28 p . m . There was no one wishing to address the Board on this item and the hearing was closed . TB RESOLUTION NO , 2010-139 : Adoption of " A Local Law Electing a Retirement Incentive Program as Authorized by Chapter 105 , Laws of 2010 for the Eligible Employees of the Town of Ithaca" WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held by said Town on August 9 , 2010 , at 5 :45 p . m . to hear all interested parties on a proposed local law entitled "A LOCAL LAW ELECTING A RETIREMENT INCENTIVE PROGRAM AS AUTHORIZED BY CHAPTER 105 , LAWS OF 2010 FOR THE ELIGIBLE EMPLOYEES OF THE TOWN OF ITHACA" ; and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and 3 TB 8-9-2010 WHEREAS, said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law , or any part thereof ; and WHEREAS , pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been determined by the Town Board that adoption of the proposed local law is a Type II action because it constitutes " routine or continuing agency administration and management , not including new programs or major reordering of priorities that may affect the environment" pursuant to 6 NYCRR § 617 . 5 (c) (20) , and thus adoption of the proposed local law is not subject to review under SEQRA ; NOW, THEREFORE , be it RESOLVED , that the Town Board of the Town of Ithaca hereby adopts said local law entitled "A LOCAL LAW ELECTING RETIREMENT INCENTIVE PROGRAM AS AUTHORIZED BY CHAPTER 105 , LAWS OF 2010 FOR THE ELIGIBLE EMPLOYEES OF THE TOWN OF ITHACA , " a copy of which is attached hereto and made part of this resolution ; and it is further RESOLVED , that the Town Board of the Town of Ithaca does hereby elect to provide the benefits of Part A of Chapter 105 of the Laws , 2010 , commencing on October 4 , 2010 for all eligible employees who retire with an effective date of retirement set during the 89 day period beginning with and immediately following the commencement date and who are otherwise eligible as specified by Part A of Chapter 105 , Laws of 2010 ; and be it further RESOLVED , that the Town Clerk is hereby directed to file said local law with the Secretary of State as required by law. TB RESOLUTION No. 2010=140 : Approval of a Noise Permit for Welcome Back BBQ at Ithaca College WHEREAS a noise permit application was submitted by Hillel at Ithaca College for a Welcome Back BBQ to be held on the Muller Chapel Law with a student band and associated amplification on August 29 , 2010 from 4 : 30 p . m . thru 6 : 30 p . m , and WHEREAS , a public hearing was duly held at the August 9 , 2010 regular meeting of the Town Board Therefore be it RESOLVED , that the Town Board approves a Noise Permit for the function on said date at said time . MOVED Councilwoman Riha SECONDED Councilwoman Hunter VOTE Ayes : Engman , Goodman , Leary, Riha , Levine , Hunter and DePaolo Motion passed unanimously . The Board discussed who would be and should be notified of these public hearings and events . Ms . Terwilliger stated that she had spoken with both representatives and advised them that the College Events main office has a list of neighborhood associations that need to be notified . 5 : 55 Public Hearing re. : a Noise Permit for Ithaca College : IC After Dark Supervisor Engman opened the public hearing at 6 : 31 p . m . There was no one present to address the Board on this item and the hearing was closed . TB RESOLUTION No. 2010=141 : Approval of a Noise Permit for IC After Dark at Ithaca College WHEREAS a noise permit application was submitted by Ithaca College for " IC After Dark" to be held on August 22 , 2010 from 5 : 30 p . m . thru 8 : 00 p . m . with a DJ and associated amplification located in the Center Quad . WHEREAS , a public hearing was duly held at the August 9 , 2010 regular meeting of the Town Board Therefore be it 5 TB 8-9-2010 RESOLVED , that the Town Board approves a Noise Permit for the function on said date at said time . MOVED Councilman Goodman SECONDED Councilman DePaolo VOTE Ayes : Engman , Goodman , Leary , Riha , Levine , Hunter and Depaolo Consider setting a public hearing = Noise Permit for Ithaca College Senior BBQ TB RESOLUTION NO . 2010- 142 : Set Public Hearing for consideration of a Noise Permit for the Senior Class BBQ on the Ithaca College Campus WHEREAS the Town of Ithaca has received a Noise Permit application from the Senior Class at Ithaca College for a BBQ with a DJ on Friday , September 3 , 2010 from 5 : 00 — 8 : 00 p . m . , Therefore be it RESOLVED , that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall , 215 North Tioga Street , Ithaca , New York , on the 23`d day of August , 2010 , at 4 : 35 p . m . for the purpose of considering the above Noise Permit . , and FURTHER RESOLVED , that at such time and place all persons interested in the proposed permits may be heard concerning the same ; and FURTHER RESOLVED , that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the official newspaper of the Town of Ithaca and to post a copy of same on the signboard of the Town of Ithaca . MOVED Councilwoman Hunter SECONDED Councilwoman Riha VOTE Ayes : Engman , Goodman , Leary , Riha , Levine , Hunter and DePaolo Consider Authorization to Award the Bid for the Forest Home Traff ic Calming Project Phase I Motion was made by Councilwoman Riha and seconded by Councilman DePaolo . Discussion - An email from the Brittain Brothers was discussed in detail . The bottom line was the lamp posts covering is aesthetic and was removed from the initial bid after the bids all came in too high . Mr. Weber hopes that there will be unexpended money at the end of the project that can used toward getting that veneer on the lamp posts . The Board and Mr. Weber were very clear that it is our intention to do everything we can to make that happen . Mr. Weber also went on to add that this is Phase I of the project , and the 6 TB 8-9-2010 veneers could be added to future phases also . Discussion followed with other options such as going back to the state and other traffic calming measures in other areas of the Town and uniformity in treatment to all . Mr. Weber will report on the progress of the project and the financial status at the next regular meeting . TB RESOLUTION NO . 2010=143 : Authorizing the Award of the Construction Contract for the Town of Ithaca Forest Home Traffic Calming Phase I Improvements WHEREAS , plans , specifications and bid documents have been duly prepared relating to the construction of highway improvements known and identified as the Town of Ithaca Forest Home Traffic Calming Phase I Improvements (hereinafter also referred to as " improvement " ) by McFarland -Johnson , Inc . , Binghamton , NY (hereinafter also referred to as " Engineer") , a competent engineer duly licensed by the State of New York , and WHEREAS , the NYSDOT Region 3 Plan and Program Management group has reviewed the plans and specifications for the Forest Home Traffic Calming Phase I project construction and provided authorization to proceed with advertisement for bidding , and WHEREAS , the Town Board authorized the advertisement for bids and the Director of Public Works has advertised for, and solicited bids for, the construction of such improvement , and WHEREAS , Bid Proposals for the improvement were received and opened by the Town of Ithaca on Wednesday, July 28 , 2010 , at which time four bid proposals were received , and WHEREAS , the Engineer has prepared a tabulation of the Bid Proposals and has determined that the Bid Proposal submitted by Binghamton Road Electric , LLC is the responsive low Base Bid for the improvement in the amount of $362 ,407 . 00 , which is less than the authorized capital construction cost of $371 , 250 . 00 , and has made a recommendation for award of the contract to Binghamton Road Electric , LLC , 170 East Service Road , Binghamton , New York 13901 as the lowest responsible bidder, and WHEREAS , the NYSDOT Region 3 Plan and Program Management group has reviewed the recommendation for award for the Forest Home Traffic Calming Phase I project construction and provided authorization to proceed with the award of a contract to Binghamton Road Electric , LLC ; now, therefore be it RESOLVED , that the Town Board of the Town of Ithaca awards the contract for construction of the Forest Home Traffic Calming Phase I improvement to Binghamton Road Electric LLC , 170 East Service Road , Binghamton , NY 13901 as the lowest responsible bidder, and authorizes the Town Supervisor to sign the contract for the 7 TB 8-9-2010 improvement , subject to the approval of the Director of Public Works and Attorney for the Town . MOVED Councilwoman Riha SECONDED Councilman DePaolo VOTE Ayes : Engman , Goodman , Leary, Riha , Levine , Hunter and DePaolo Motion passed unanimously . Consider Authorization to Award Contract for Construction and to Establish the Ridgecrest Road Water Tank Improvement Capital Project Fund TB RESOLUTION No . 2010-144 : Authorization to Award Contract for Construction of the Ridgecrest Road Water Tank Improvement and to Establish the Ridgecrest Road Water Tank Improvement Capital Project Fund WHEREAS : On July 19 , 2010 the Town of Ithaca Director of Public Works/Highway Superintendent received bids for the Ridgecrest Water Tank Improvement for removing the existing interior coating and placement of new coating , and WHEREAS : The Director of Public Works has reviewed the bids and qualifications of the bidder and has recommended that the low bid of $ 115 , 800 . 00 for the total project made by JNP Construction Corporation of 50 Louis Court , South Hackensack , NJ is a qualified bid , and WHEREAS : At the May 24 , 2010 Town Board meeting under Resolution No . 2010- 100 the maximum amount of $ 150 , 000 . 00 was authorized to be expended by the Town of Ithaca for this improvement , now therefore be it RESOLVED : that the Town Board of the Town of Ithaca authorizes the award of the contract for the Ridgecrest Tank Improvement project to JNP Construction Corporation of 50 Louis Court , South Hackensack , NJ , subject to final approval of the contract documents by the Town Engineer and Town Attorney, and be it further RESOLVED : that the Town Supervisor is authorized to execute such contract upon such approval ; and be it further RESOLVED : that the Director of Public Works is authorized to approve change orders to such contract upon receipt of appropriate justification provided that the maximum amount of such change orders shall not in the aggregate exceed $ 10 , 000 . 00 without prior authorization of this Board , and provided further that the total project cost , including the contract , engineering , legal and other expenses does not exceed the maximum authorized cost of the project , and be it further 8 TB 8-9-2010 RESOLVED : that the Town Budget Officer is directed and authorized to record all necessary and appropriate budgetary and cash transactions transferring $ 125 , 800 to establish the capital project fund " Ridgecrest Road Water Tank Improvement" project . Consider Setting a Public Hearing for the Hungerford Hill Rd Pump Station Water Improvements TB RESOLUTION No. 2010-145 : Order Setting a Public Hearing for the Hungerford Hill Road Pump Station Water Improvements WHEREAS , a plan , report and map , including an estimate of cost , have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Ithaca , Tompkins County, New York, relating to the creation and construction , pursuant to Article 12 -C of the Town Law, of water system improvements to be known and identified as the Town of Ithaca Hungerford Hill Pump Station Water Improvement , and hereinafter also referred to as " Improvement , " to provide such water Improvement including extensions , to the present Town water improvement , such water system Improvement to be constructed and owned by the Town of Ithaca , and WHEREAS , said plan , report and map , including estimate of cost , were prepared by a competent engineer, duly licensed by the State of New York , and have been filed in the office of the Town Clerk of said Town , where the same are available during regular office hours for public inspection , and WHEREAS , the area of said Town determined to be benefited by said Town of Ithaca Hungerford Hill Pump Station Water Improvement consists of the entire area of said Town excepting therefrom the area contained within the Village of Cayuga Heights , and WHEREAS , the proposed Improvement consists of the water improvements set forth below, and in the areas of the Town as set forth below, and as more particularly shown and described in said plan , report and map presently on file in the office of the Town Clerk : The placement of a 17 foot X 26 foot pre -cast concrete building , installation of pumps , meter and control valves within the building , and installation of 1 , 300 feet of 8" 9 TB 8-9-2010 water main that will connect the Hungerford Hill Tank directly to the East Hill Transmission Tank, together with related ancillary facilities , and WHEREAS , the maximum proposed to be expended by the Town of Ithaca for the aforesaid Improvement is $ 400 , 000 . 00 . The proposed method of financing to be employed by said Town of Ithaca consists of temporary financing under a bond anticipation note , and upon maturity of the bond anticipation note , the issuance of serial bonds of said Town of Ithaca to mature in annual installments over a period not to exceed 20 years , such bonds to be paid from assessments levied upon and collected from the several lots and parcels of land in said Town of Ithaca water system benefited area which are deemed benefited by said Improvement , so much upon and from each as shall be in just proportion to the amount of the benefit which the Improvement shall confer upon the same , and WHEREAS , it is now desired to call a public hearing for the purpose of considering said plan , report and map , including estimate of cost , and the providing of the Improvement , and to hear all persons interested in the subject thereof concerning the same , all in accordance with the provisions of Section 209 -q of the Town Law; NOW, THEREFORE , IT IS HEREBY ORDERED , by the Town Board of the Town of Ithaca , Tompkins County, New York, as follows : Section 1 . A public hearing shall be held by Town Board of the Town of Ithaca , Tompkins County , New York, at the Town Hall , 215 North Tioga Street , in Ithaca , New York , in said Town , on the 13th day of September, 2010 , at 5 :45 o'clock P . M . , Prevailing Time , to consider the aforesaid plan , report and map , including estimate of cost , and the question of providing the Improvement , and to hear all persons interested in the subject thereof concerning the same and to take such action thereon as is required by law. Section 2 . The Town Clerk is hereby authorized and directed to cause a copy of this Order with a Notice of Adoption to be published once in the official newspaper, and also to post a copy thereof on the town signboard maintained by the Town Clerk, not less than ten ( 10) nor more than twenty (20) days before the day designated for the hearing as aforesaid , all in accordance with the provisions of Section 209-q of the Town Law , Section 3 . This Order shall take effect immediately. The question of the adoption of the foregoing Order was duly put to a vote on roll call , which resulted as follows : Supervisor Engman — Aye . Consider Amending the Public Interest Order for the East Shore Dr. Water Improvements Project TB RESOLUTION NO, 2010-146 : Approval of an Amendment to the Public Interest Order for the East Shore Dr. Water Improvements Project WHEREAS , a map , report and plan , including an estimate of cost , have been duly prepared in such manner and in such detail as has heretofore been determined by the Town Board of the Town of Ithaca , Tompkins County , New York , relating to the creation and construction , pursuant to Article 12 -C of the Town Law, of water system improvements to be known and identified as the Town of Ithaca East Shore Drive Water Improvements , and hereinafter also referred to as "improvement , " to provide such water improvement including extensions , to the present Town water improvement , such water system improvement to be constructed and owned by the Town of Ithaca , and WHEREAS , said map , plan and report , including estimate of cost , were prepared by a competent engineer, duly licensed by the State of New York and have been filed in the office of the Town Clerk of said Town , where the same are available during regular office hours for examination by any person or persons interested in the subject matter thereof ; and WHEREAS , the area of said Town determined to be benefited by said Town of Ithaca East Shore Drive Water Improvements consists of the entire area of said Town excepting therefrom the area contained within the Village of Cayuga Heights , and WHEREAS , the proposed improvement consists of the water improvements set forth below, and in the areas of the Town as set forth below , and as more particularly shown and described in said map , plan and report presently on file in the office of the Town Clerk: Construction and installation of approximately 6 , 000 feet of new 12 - inch Ductile Iron Pipe ( DIP) water main along the east side of East Shore Drive commencing from the intersection of Renwick Place and Lake Street , then extending north to the intersection of Remington Road and East Shore Drive , and continuing north along East Shore Drive to the Town of Ithaca/Town of Lansing municipal boundary. The improvement also includes an 8 - inch Polyethylene water main loop serving the lake houses from Number 916 to Number 940 , along with multiple service lines serving the remaining houses in the Town along East Shore Drive . The improvement also includes the construction of a pressure regulating station consisting of a pre -cast concrete building , pressure regulating valves and related piping to be located on Remington Road , and ancillary facilities , and 11 TB 8-9-2010 WHEREAS , the maximum proposed to be expended by the Town of Ithaca for the aforesaid improvement is $2 , 500 , 000 . The proposed method of financing to be employed by said Town of Ithaca consists of temporary financing under a bond anticipation note , and upon maturity of the bond anticipation note , the issuance of serial bonds of said Town of Ithaca to mature in annual installments over a period not to exceed forty years , such bonds to be paid from assessments levied upon and collected from the several lots and parcels of land in said Town of Ithaca water system benefited area which are deemed benefited by said improvement , so much upon and from each as shall be in just proportion to the amount of the benefit which the improvement shall confer upon the same , and WHEREAS , the aforesaid improvements have been determined to be an Unlisted Action pursuant to the regulations of the New York State Department of Environmental Conservation promulgated pursuant to the State Environmental Quality Review Act , the implementation of which as proposed , the Town Board has determined will not result in any significant environmental effects ; and WHEREAS , the Town Board of the Town of Ithaca duly adopted an Order on December 21 , 2009 calling a public hearing upon said plan , report and map including an estimate of cost and the question of providing water_ supply improvements to be known as the Town of Ithaca East Shore Drive Water Improvements , such public hearing to be held on the 11th day of January, 2010 , at 6 : 20 o 'clock P . M . Prevailing Time , at the Town Hall , 215 North Tioga Street , in Ithaca , New York , in said Town , at which time and place all persons interested in the subject thereof could be heard concerning the same ; and WHEREAS , notice of said public hearing was duly posted and published as required by law; and WHEREAS , said public hearing was duly held at the place and at the time aforesaid and all persons interested in the subject thereof were heard concerning the same ; and WHEREAS , it is now desired to authorize the improvement to be known as the Town of Ithaca East Shore Drive Water Improvements ; NOW, THEREFORE , BE IT RESOLVED , by the Town Board of the Town of Ithaca , Tompkins County, New York , as follows : Section 1 . It is hereby determined that it is in the public interest to establish said Town of Ithaca East Shore Drive Water Improvements and to make the water improvement hereinafter described and such water improvement is hereby authorized . The area hereby determined to be benefited by said Town of Ithaca East Shore Drive Water Improvements is all of that portion of the Town of Ithaca outside of the Village of Cayuga Heights , Section 2 . The improvement consists of the water improvements set forth below, and in the areas of the Town as set forth below, and as more particularly shown 12 TB 8-9-2010 and described in said map , plan and report presently on file in the office of the Town Clerk: Construction and installation of approximately 6 , 000 feet of new 12 - inch Ductile Iron Pipe ( DIP) water main along the east side of East Shore Drive commencing from the intersection of Renwick Place and Lake Street , then extending north to the intersection of Remington Road and East Shore Drive , and continuing north along East Shore Drive to the Town of Ithaca/Town of Lansing municipal boundary . The improvement also includes an 8 - inch Polyethylene water main loop serving the lake houses from Number 916 to Number 940 , along with multiple service lines serving the remaining houses in the Town along East Shore Drive . The improvement also includes the construction of a pressure regulating station consisting of a pre -cast concrete building , pressure regulating valves and related piping to be located on Remington Road , and ancillary facilities . The maximum proposed to be expended by the Town of Ithaca for the aforesaid improvement is $2 , 500 , 000 . The proposed method of financing to be employed by said Town of- Ithaca consists of temporary financing under a bond anticipation note , and upon maturity of the bond anticipation note , the issuance of serial bonds of said Town of Ithaca to mature in annual installments over a period not to exceed forty years , such bonds to be paid from assessments levied upon and collected from the several lots and parcels of land in said Town of Ithaca water system benefited area which are deemed benefited by said improvement , so much upon and from each as shall be in just proportion to the amount of the benefit which the improvement shall confer upon the same . Section 3 . It is hereby determined that the estimated expense of the aforesaid improvement exceeds one -tenth of one per cent of the full valuation of the taxable real property in the area of said Town outside of villages and , therefore , in accordance with the provisions of subdivision 13 (a) of Section 209 -q of the Town Law, the permission of the State Comptroller is required for such improvement . The Town Clerk be and hereby is authorized and directed to file a certified copy of this Amended Order in the office of the State Department of Audit and Control , at Albany , New York, together with an application in the form prescribed by said State Comptroller for the approval of the State Comptroller to the providing of the aforesaid improvement , within 10 days after the adoption of this Amended Order. The Town Supervisor be and hereby is authorized and directed to execute said application on behalf of the Town . Section 4 . Pursuant to subdivision 6 (d ) of Section 209-q of the Town Law, the Town Clerk is hereby directed and ordered to cause a certified copy of this Amended Order to be duly recorded within ten days of the receipt of notification of the approval of the State Comptroller in the Office of the Clerk of the County of Tompkins , which when so recorded , shall be presumptive evidence of the regularity of the proceedings and action taken by the Town Board in relation to the aforesaid improvement . It is hereby further determined that all of the allocable cost of the aforesaid improvement shall be borne wholly by property within the Town of Ithaca water improvement benefited area , being the entire area of the Town outside of any village . Consider Authorization to Contribute to the Reserves of the Greater Tompkins County Municipal Health Insurance Consortium The Board discussed the repayment process and guarantee that it is going to happen . Ms . Drake explained that all the municipalities are voting on the same resolution and since the Consortium Board is not seated yet , they could not enter into a contract for paying back the monies . The Consortium members and TCCOG have the clear understanding of the payback process and the clear intent is in numerous minutes of the various boards and committees that have been working on this . It is an intermunicipal trust issue . The Board asked that it be made clear that one of the first orders of business for the new Consortium Board should be entering into a contract detailing the payback process and timeline to the municipalities loaning the monies . Ms . Drake agreed and will pass that along . The Board then discussed the voting system for the Consortium Board and the "weighting" of votes . There are different safety mechanisms in place to prevent the City and the County , who have the largest block of votes , to keep from joining together to control votes . At least three municipalities would have to agree with them to move a vote forward . The minimum requirements are : 10 years of fire department experience, with at least 3 years as an assistant chief or higher. The search committee is to recommend eight candidates to Mayor who will make final selection, subject to final approval of the Common Council . • The search Committee will be composed of: • Three Common Council members (JR Clairborne, Joel Zumoff, Svante Myrick) ; • Three Board of Fire Commissioners members (Bill Gilligan, Tom Hoard, and Maureen Kelly) ; • Human Resources Director Schelley Michell-Nunn • One outside expert to assist in the technical evaluation of the applicants . • Fire Fighter Hiring list - Our information is that 59 people scored between 95 - 100 on the exam. We don ' t have a break down on numbers in the diversity target range, although at our June meeting it was reported that the likely hiring pool did not significantly (or at all) increase the available women or minorities in the group of 59 . Monthly training sessions have been scheduled, including hazardous materials handling, chemical suicides , CPR training, and helicopter landing zone training for medical evacuations . • Items in progress : BFC Report to Town of Ithaca Board 9 August 2010 • Traffic calming device remediation. — The Board of Fire Commissioners intends to write a letter to the Board of Public works regarding removing speed bumps and diverters on South Street and Wood Street in the vicinity of Titus towers . • Resource Recovery: A proposal waiting review by City Attorney's office - pending hiring of additional staff (in the City Attorney' s Office) . • Charter revision : Some minor aspects of the Board ' s responsibilities have been recommended for revision. There is a larger question on the role of the Board that should also be addressed in considering charter revisions to the City Charter. • 2011 Fire Department Budget : The Board reviewed the City and Fire Department budget procedures at its July 13th meeting and held a special meeting to review the proposed departmental budget with Acting Chief Dorman and Deputy Chief Parsons prior to the Department' s budget submission to the Mayor. This included budget scenarios of 0% increase in expenditures, 2% increase, and maintaining the current roster (which is the funding required to maintain the current level of staff and resources for next year) . None of these scenarios included any increase for a new contract with the Fire Fighters and Officers (Assistant Chiefs and Lieutenants) . The Contract is currently under negotiation . • A meeting with Mayor Perterson was held on April 28 , 2010. In addition to Mayor Peterson, the meeting was attended by Council member JR Clairborne, BFC Commissioners Hoard and Gilligan . Clairborne, & BFC Commissioners Tom Hoard and Bill Gilligan . Department Operations : 1 . Search for a new fire chief- we anticipate that this will be a fairly lengthy process once it is actually underway and feel that it's important to not expect the department to operate without a permanently named chief beyond the current year, if at all possible. This is not any reflection on the fine job that Acting Chief Dorman is doing, but the longer the position remains unfilled the more potential there is for internal organizational issues to disrupt the operation of the department. Also, and equally important is the need to have a person in place who is in a position to speak for the department's long term resource and staffing requirements to meet community public safety needs . The person in this position should work well and effectively with the public, with public bodies, and with public groups. 2 . Diversity within the department. The recent efforts to expand the pool of applicants taking the firefighter exam were good first steps, but I believe this is an area that will continue to be challenging to address. 3 . Reports on operations - volume, types, geographic distribution of calls for use by the BFC, Common Council, and Town Board . 4. Traffic Calming devices on South and Wood Street that have a significant negative impact on fire department apparatus. 5 . Long term planning for the department - station location, training, recruitment, equipment. 6 . Role of Volunteers in the Department. Items related to role of the Board of Fire Commissioners 1 . The Board has a number of responsibilities in the City Charter - many of these appear to either no longer be relevant or are inconsistent with current practice. Some of these Bob Romanowski had presented previously, but there should be a complete review of the Charter related to the role of the BFC. 2 . Role of the Board in long term strategic planning for the department to address the needs of the community and the department. 3 . Filling the vacant position on the board 4. Following up the survey that was done last spring - regarding development of all the City's Boards and Committees that have volunteer and appointed Board members . 5 . Role of the Board in relation to the Town and the City. To pursue all of these items would take more time then is realistically available from the Board or from the Common Council over the next 12 months, but we feel it would be useful for the 4 of us to discuss priorities and to begin a dialog on these items . That revised policy will go to the Town Board in August for consideration . The committee reviewed the Vacation Buy Back policy with discussion to continue at the August meeting . In conjunction with the above policy discussions the committee reviewed the current practice of how exempt — salaried staff account for and use additional hours worked beyond the 40 hour minimum . The committee supported the request from the Town of Caroline for temporary dental insurance to one of their employees that was being kicked of Teamster's dental . There was some discussion regarding elected officials pay , especially regarding the Justices pay. This item will be discussed further at the August meeting . In the July Employee Relations meeting the committee discussed past comment card topics of bike racks and pay levels for CDL class A versus class B . The committee was updated on the status of several topics that had been referred to Personnel Committee . New suggestion cards received where briefly discussed , which included topics of ; enforcing the no smoking policy, 360 degree feedback on PWD management staff , question regarding having one person overseeing the mowing of parks , and DOT training regarding weight limits for CDL drivers . Bolton Point's Personnel & Organization Committee received an update from each manager and discussed the request to increase the hours for the part time Account Clerk Typist from 20 hours to 30 hours per week. Briefly the additional position of Valve and Hydrant Maintenance Worker was discussed . Judy updated the committee on the status of the June CPI -W ( 1 . 6%) and how things are progressing with the Health Consortium . Personnel — Civil Service : Orientation was conducted for seasonal staff that started in July and for the Water Treatment Plant Operator Assistant . Organized and participated in the interviews for the Sustainability Planner position . Worked with the Planning Department Review Committee to finalize the Job Announcement and revised the Job Description for the Director of Planning position . Prepared and revised the documents required for the early retirement incentive program . Letters and a packet were sent to the possible candidates . Commercial Insurance ( Ithaca Agency — NYMIR Insurance Company) : no new claims . Have worked with PWD staff regarding 2 incidents were a guide rail was damaged and a stop sign was damaged so that the cost could be collected by the person ' s insurance company. Workers ' Compensation ( Public Employers Risk Management Assoc — PERMA) : There were 3 poison ivy claims submitted . This will be discussed at the Safety Committee . Health and/or Dental Insurance : There was progress with the unions and their role on the Board . Over 80% of the employees represented by a union have consented to the Joint Committee idea . The State has reviewed the application material and have reduced the start up reserving requirements , which makes the consortium possible . The Town will need to contribute to the start up reserves in the amount of $44k but will be contributing an additional $92k to help off set what the City and County are short . The Town will be reimbursed the additional funds plus interest . This has truly been an example of municipal cooperation . Other Items : The third lunch with Board members and staff was held and seemed to be well received by those attending . Time was dedicated to continuing work on the 2011 budget . The project involves the development of a 72 +/- unit senior housing building, a 60 +/- unit assisted living facility, a 106 +/- space park and ride lot, stormwater facilities , a community garden, and a new public road on approximately 13 . 5 acres . The proposal will also involve rezoning the entire 35 +/- acre property from Medium Density Residential to a new Planned Development Zone to address future potential development on this overall parcel . [Note: The proposed assisted living facility has subsequently been withdrawn from the proposal.] July 20, 2010 Planning Board Meeting : Sketch Plan Review — Cornell Energy Recovery Linac (ERL), Dryden Road and Pine Tree Road : The Planning Board reviewed a sketch plan for the proposed Cornell University Energy Recovery Linac (ERL) project located north of the Pine Tree Road and Dryden Road (NYS Route 366) intersection, Town of Ithaca Tax Parcel No . ' s 63 - 1 -8 .2, 63 - 1 -2 .2, 63 - 1 - 12, 63 - 1 -3 . 1 and 63 - 1 - 3 . 3 , Low Density Residential Zone. The proposal involves construction of an underground accelerator tunnel ( 14-foot diameter and +/- 1 km long) , a cryogenic facility, and an extension to the existing Wilson Laboratory (+/- 185 ,000 gross square feet of building space) . The project will also involve new stormwater facilities , parking, outdoor lighting, and landscaping . The Planning Board will discuss the draft scoping document for the Environmental Impact Statement at the next meeting and consider scheduling a public scoping session . Cornell University, Owner; Steve Beyers , P.E. , Engineering Services Leader, Agent, CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following have been accomplished over the past month . Codes and Ordinances Committee (COC) : The Committee met on July 21 , 2010 and continued review of the draft local law establishing a Limited Historic Commercial Zone, and briefly discussed the approach to drafting regulations regarding the permitting of fireworks displays . The next COC meeting is scheduled for August 18 , 2010 at 7 : 00 p. m. Tentative agenda items include TowtofIthacaPlarncng Dir`ec ors Repor t continuation of review of comments received regarding proposed amendments to the Conservation Zone, review of revised draft of Limited Historic Commercial Zone, possible discussion regarding affordable housing provisions , and possible discussion regarding possible regulations regarding fireworks displays (if ready) . Planning Committee : The Committee met on July 14, 2010 to discuss the draft Planned Development Zones (PDZ) for ( 1 ) the Ithaca Beer Co . proposal off Elmira Road for a new brewery, restaurant and beer garden ; (2) the Conifer proposal on Trumansburg Road ; and (3 ) the Vine Street Cottages proposal on Mitchell Street. The Committee voted to recommend to the Town Board to consider referring the Vine Street concept plan to the Planning Board for a recommendation . The Town Board at its Study Session on July 26th did refer the concept plan to the Planning Board for sketch plan review, and the sketch plan review is scheduled for the August 3`d Planning Board meeting. The Committee also decided to send the draft Ithaca Beer Co . PDZ and the draft Vine Street PDZ (pending comments from the Planning Board on the concept plan) to Susan Brock for review and comments . The Conifer PDZ has some issues to address prior to returning to the Committee for review, including the park-and-ride lot (ownership, operation/maintenance and funding) , how the withdrawal of the assisted living facility from the Phase I plan will affect the PDZ, and phasing of the road, infrastructure and commercial development in the plan . The Committee requested that a meeting be set up with Conifer, Cornell, TCAT and the Town to discuss details of the park-and-ride lot prior to further review of the PDZ. The August Planning Committee meeting is being cancelled due to vacation schedules . The next meeting will be scheduled for Thursday, September 9 , 2010. Comprehensive Plan Committee : The July and August Committee meetings have been cancelled to accommodate summer vacation schedules and to give staff time to assemble written sections of the Plan update for discussion with the Committee . Sections will include an introduction and background, a description of the public input process (including results of the residents survey) , the draft vision statement, updated goals and objectives , brief updates on existing conditions in the Town, key issues to address in the next 10 - 15 years, and a proposed land use plan map. The next meeting of the Committee is tentatively scheduled for Thursday, September 23 , 2010 at 6 : 30 p .m. Conservation Board: The July meeting was cancelled. The next meeting is scheduled for Thursday, August 5th, 2010. Agenda items include discussion and possible recommendation regarding the draft stream setback law and update on swallow-wort eradication at the Town water tank site. Agriculture Plan: Staff prepared a draft of the Plan for review by the Committee. Sections of the Plan being prepared by Cooperative Extension are still pending. ITCTC : The ITCTC (Ithaca-Tompkins County Transportation Council) Planning and Policy Committees held a special joint meeting on July 20, 2010. The main item was approval of a TIP amendment regarding the Newfield Covered Bridge Preservation project, based on a grant received from the Federal Highway Administration ' s National Historic Covered Bridge Preservation Program. Sustainability Planner Interviews : The Director of Planning participated in interviews of candidates for the Sustainability Planner position during the week of July 26th. Further information on the selection process should be available at the August 91h Town Board meeting. 2 TOWN OF ITHACA Public Works Department Month of July Board Report August 9, 2010 Meeting Roads: • Roads were hot patched and brush cut in preparation for surface treatment. • Stone was stock piled for the upcoming surface treatment. • Replacement of storm sewer was begun on the lower end of Snyder Hill Road. • A portion of the road ditch on the lower end of Park Lane was lined with fabric and surge stone to prevent eroding on that section. • Roadside and easement mowing continued . • Weed trimming was performed along several sections of guiderail. • We assisted the Town of Ulysses with cleaning out culverts and surface treating installation. • Catch basins were repaired and cleaned on Penny Lane and Harris B. Dates Drive . • Shoulders were repaired on several roads. • A driveway culvert was installed on Burleigh Drive . • Trench shoring safety training was scheduled for 7/ 30. • Brush trimming continued along various roads. • Residents dropping off brush and yard waste continued with over 70 entries signed in. Parks, Trails, and Preserves : ■ Fibar mulch was delivered and spread at the Salem Park playground . ■ Construction of the new playground at Northview Park was started . ■ The City of Ithaca Forestry crew provided assistance by grinding stumps on Honness Lane Walkway and along Warren Road . ■ Weekly site checks and regular grounds maintenance were performed . ■ A section of East Ithaca Recreation Way was repaved and new stone dust applied in the area damaged during Cornell University's water, line construction. ■ Provided support for West Hill Community Garden. ■ Ball field maintenance at Valentino Field. ■ Maintenance work at East Shore Park was done by summer youth crew. ■ Several incidents of vandalism and graffiti were dealt with at Tutelo Park. ■ A thunderstorm with heavy winds brought down several trees along various trails. These were cut up and removed . ■ "No Motor Vehicles" signs were reinstalled at both ends of the Summerhill Walkway. Fortunately in spite of my personal adversity the tasks and functions of the position continue with the support of Ithaca High School student Sarah Heath who has steadfastly worked on educational and encouragement materials for the Safe Routes to School Effort. With a change in preliminary design, delays in obtaining an easement and state requirements it appears the Warren Road Walkway will not be completed this construction season. These factors do not lessen the Town ' s responsibility for implementation of the education and encouragement efforts . Sarah using the Healthy Passport concept is developing a similar tool with safe walks from all of the identified and easily walk-able apartment complexes in the Northeast school area. The plan is to have this tool ready for distribution to Northeast School students whenever the walkway is completed. Even with my getting sick and my computer crashing Ithaca College student Lauren Boardman has kept both the West Hill Community Garden and the youth job squad steadily producing. The Garden Council is planning an Open House to which you are all invited on Thursday, August 19 from noon to 3p.m. with the acoustic music of Mutsu and at 2 pm a magician who will amaze you. Program will be at garden with activities in the Conifer Village Community Room should the weather not cooperate . Youth employment was the focus of July with over 90 contacts from youth or their caregivers inquiring about opportunities for jobs . This year due to drastic cuts in county, state, and federal support for youth employment programs there were far fewer positions available for youth. The employment network lead by county youth services began meeting in December when county cuts to municipal programs were confirmed. The funding situation worsened with state budget issues and lack of traditional federal appropriations . In spite of this the town maintained its commitment to the student work initiative prugrain with 30 youth hired to date and two pending. The Town ' s effort provides year round opportunities until funding is expended. This year the Town has had a critical role in the Southside/LACS Farm Project at Three Swallows Farm and our own "job squad" at the West Hill Community Garden.
