HomeMy WebLinkAbout1986-12-02• TOWN OF DRYDEN ZONING BOARD OF APPEALS December 2, 1986 Zoning Board of Appeals met December 2, 1986 w /members D. Rose, N. LaMotte, J. Baker, C. Hatfield, & Z.O. S. Stewart. Absent: Chr. P. Brellochs. Also present: 0. Sodders, A. & R. Edmundson, S. Parsons, T. Isbell, J. Zwart, D. Yaw, D. Brumsted, & J. Golay. Acting Chr. D. Rose called meeting to order 7:35 PM. HEARING I Public hearing to consider application of Bernard Hicks to build three additional mini storage buildings at 226 Cortland Rd. and is requesting variance to Sec. 801 & 802 of Town Zoning Ordinance. No one present to represent B. Hicks. Board expressed their concern & dissatisfaction at lack of a representative. 0. Sodders - 245 Cortland Rd. expressed negative opinion on additional storage area. Stated he was dissatisfied w /present maintenance of grounds, • buildings, & old vehicles - outside storage etc. depreciated surrounding property values. Also concerned w /future retail sales & number of future variances that.may be sought. Hearing closed 8:03 PM HEARING II Public hearing to consider application of Albert Edmundson to temporarily store mobile home on his property at 40 Lower Creek Rd., Etna, & is requesting variance to Sec. 751 of Town Zoning Ordinance. A. Edmundson present - His son, Richard, spokesman. Explained that at present time he had no other place to store the home he'd purchased previously due to trailer parks no longer accepting older trailers. S. Parsons - 51 Lower Creek Rd. questioned possibility of limiting time trailer could be stored on property. 1 - 2 - R. Edmundson stated trailer would probably;be removed within one year. T. Isbell - 41 Lower Creek Rd. - No objections to storing trailer. Z.O. a S. Stewart stated he'd reed phone call from M. Shipherd saying he had no objections to trailer being stored & hoped Board would grant variance. Board questioned length of time trailer had already been there & if anyone had occupied trailer there. Edmundson stated it had been there since June & had never been occupied. Hearing closed 8:10 PM HEARING III Public hearing to consider application of James A. Zwart DVM to have veterinary clinic on property at Northeast corner of Rt. 13 & Johnson Rd. ® and is requesting variance to Sec. 901 & 902 of Town Zoning Ordinance (allowed uses). J. Zwart present - stated reason for applying for Vdri cZ nc E was at suggestion of Z. 0. because there was no reference in ordinance other than use as professional building (offices). Zwart also explained property was over 3 acres, access to be from Johnson Rd., building would be as near corner of Rt. 13 & Johnson Rd. as zoning permitted, only parking to be between front of building & Johnson Rd., & there would be no outside runs. Also proposed an apartment in basement for purpose of having some- one on site for care of animals. Present location (corner of Spring House Rd. & Rt. 13) no longer feasible. Too small, no.insulation, not enough room for separate X -ray room as required by Federal regulations. D. Yaw - 353 Johnson Rd. was pleased there would be no outside pens, but curious if Zwart aware of water -wet lands there. 1J_ Hearing closed 8:20 PM • .1 - 3 - p HEARING IV Public hearing to consider application of David Brumsted & John Golay to build two one family dwellings on'parcel of land off Whitted Rd. (approx. 70 Whitted Rd) & is requesting variance to Sec. 702 of Town Zoning Ordinance which requires that a lot have at least 125' of frontage on public road. Brumsted & Golay both present - Gave brief history of the 30 acre parcel & how it was originally mapped & plans for development. Stated it would not be feasible for one family to:build there, but w /two or more, utility hook up & driveway costs etc. became more feasible. In June 1979 similar variance was sought & granted for Gordon Whitted & Michael Pichael, but property was never developed. Hearing closed 8:36 PM BOARD MOVED INTO EXECUTIVE SESSION. ALL HEARINGS REOPENED 10:40 PM. DECISIONS: HEARING I (Hicks) N. LaMotte motion that request be tabled because of inability for board sr public to question applicant. Seconded by J. Baker. No discussion. VOTE ALL YES Application tabled until more info. available. HEARING II (Edmundson) C. Hatfield motion to grant variance w/ stipulation: 1. Trailer must be removed from property by June 1987 & variance cannot be renewed. Seconded by N. LaMotte. No discussion. VOTE ALL YES Variance GRANTED w /stipulation A. • f .1 HEARING III (Zwart) - 4 - J. Baker motion to grant variance w /stipulations. 1. Drawings as submitted show dimension from center line of Rte. 13 be increased to 901 . 2. Dog runs must be located inside building as stated earlier by applicant. Seconded by C. Hatfield. No discussion. VOTE ALL YES HEARING IV (Brumsted & Golay) Variance GRANTED w /stipulation C. Hatfield motion to grant variance w /stipulations: 1. Future development be declared subdivision subject to pl-ng. Bd approval. 2. Present owners willfiot seek services from Town of Dryden for their private road or portion of Whitted Rd. 3. Variance pertains to applicants only. Seconded by J. Baker. No discussion.
