Review of Correspondence 18 , Consider Adjournment Regular Meeting of the Ithaca Town Board Monday, July 12 , 2010 at 5 : 30 p. m . 215 North Tioga Street, Ithaca, NY 14850 MINUTES Board Members Present: Herb Engman , Bill Goodman , Pat Leary , Susan Riha , Tee- Ann Hunter, Rich DePaolo and Eric Levine , Staff Present : Bruce Bates , Al Carvill , Judy Drake , Jonathan Kanter, Susan Ritter, Paulette Terwilliger and Jim Weber Call to Order & Pledge of Allegiance Supervisor Engman opened the meeting at 5 : 30p . m . and led the assemblage in the Pledge of Allegiance . AGENDA ITEM #1 Persons to be Heard and Board Comments Tom McDonald addressed the Board about the pathway from East Hill Plaza to the Summer Hill apartments . He thanked the Board for paving the path but reminded the Board that the residents are still concerned about the lack of lighting . He handed out letters from Conifer and Best Western (Attachments 1 & 2) stating that Mr. Weber had indicated he could possibly work with other interested parties . Mr. McDonald also noted that now that it is paved , they have seen vehicles using the pathway as a shortcut to the apartment complex which poses a threat to residents in wheelchairs and using walkers as well as pedestrians . He also wanted to reiterate his request for a pedestrian controlled light at the crossing from Rite Aid to - East Hill Plaza as well as his concern about batteries running low and beeping and finding some way for the Enforcement Officers to track their shelf life . He also had a new concern regarding the lack of lighting at the Maple Ave entrance onto Pine Tree Rd . This area is heavily traveled by pedestrians and people using TCAT and it is dangerous and not lit at all . Supervisor Engman thanked Mr. McDonald and stated that the Town would look into his concerns . Board comments — Councilman Goodman reported that Eco Village has been approached to apply for an EPA showplace grant . They will be working with the County and possibly looking at the County-owned property near the Biggs complex for an Eco- Village-density project/development , Supervisor Engman asked to add a discussion/update on the Black Diamond Trail to the agenda . The Board agreed . TB 7- 12-2010 Page 2 of 15 Councilwoman Hunter reported that she has drafted a letter to CHA regarding mitigation fee questions and sent it to members for their comments . She asked that discussion of the letter be put on the July Study Session agenda . . AGENDA ITEM #2 Report from County Legislature and City of Ithaca County Legislator Peter Stein — Mr. Stein talked about the increased cooperation between the town and the county. He is encouraged by that and discussed concerns he has heard from residents about speeders on Hanshaw Rd and the possibility of working with the town and the Sheriff' s department to do something about that . Since the Town does not have its own police force , he thought maybe we could work together to find a coordinated effort to control the speeding . Board Members DePaolo noted that widening streets may invite higher speeds , and Board Member Riha spoke about topography and the need for real data on speeds because sometimes the perception is not the reality . Supervisor Engman agreed that hard data is needed and added that the Forest Home traffic calming measures may be a test case for other locales . There was no one from the City present . AGENDA ITEM #3 5 : 45 Public Hearing re. : A Local Law Amending Chapter 230 of the Town of Ithaca Code, titled " Streets and Sidewalks" , to Revise Provisions Related To Excavation and Construction In Municipal Roadways and Highway Rights-of-Way Supervisor Engman opened the public hearing at 5 : 56 p . m . There was no one wishing to address the Board on the topic , and the hearing was closed at 5 : 57 p . m . Discussion focused on Section 230-3 Prohibitions and the interpretation that a resident would not be able to do general yard work without a permit . Mr. Weber thought the title made it clear that it applies only to excavation and construction ; some board members wanted it clarified . Councilman Levine offered an amendment to add the words " in connection with construction or excavation " in the Section 230-3 paragraph 1 after the words "other person or entity" to clarify the intent . Councilwoman Riha seconded the amendment and it passed unanimously. Motion was then made and seconded to adopt the local law as amended . a . Consider adoption TB RESOLUTION NO . 2010=124 * Adoption of "A LOCAL LAW AMENDING CHAPTER 230 OF THE TOWN OF ITHACA CODE , TITLED STREETS AND SIDEWALKS , TO REVISE PROVISIONS RELATED TO EXCAVATION AND CONSTRUCTION IN MUNICIPAL ROADWAYS AND HIGHWAY RIGHTS-OF-WAY" WHEREAS , New York Town Law, Highway Law , Vehicle and Traffic Law and Municipal Home Rule Law authorize the Town Board to establish a local law related to TB 7- 12-2010 Page 3 of 15 excavation and construction in roadways and highway rights-of-way in the Town of Ithaca for that part of the town outside the limits of any incorporated city or village ; and WHEREAS , the current excavation law of the Town of Ithaca dates back to 1965 and has not been changed or amended since then , except for 1986 changes to financial security provisions ; and WHEREAS , the Town Highway Superintendent/Director of Public Works has reviewed and modified a draft local law, prepared by the Tompkins County Council of Governments , amending the current requirements for excavation and construction in streets and highways in the Town of Ithaca ; and WHEREAS , a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be held by said Town on July 12 , 2010 at 5 : 45 p . m . to hear all interested parties on the proposed local law entitled "A LOCAL LAW AMENDING CHAPTER 230 OF THE TOWN OF ITHACA CODE, TITLED STREETS AND SIDEWALKS, TO REVISE PROVISIONS RELATED TO EXCAVATION AND CONSTRUCTION IN MUNICIPAL ROADWAYS AND HIGHWAY RIGHTS-OF-WAY" ; and WHEREAS , notice of said public hearing was duly advertised in the Ithaca Journal ; and WHEREAS , said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to the proposed changes to the revised excavation law; and WHEREAS , pursuant to the New York State Environmental Quality Review Act ("SEQRA") and its implementing regulations at 6 NYCRR Part 617 , it has been determined by the Town Board that adoption of the proposed local law is a Type 11 action because it constitutes " routine or continuing agency administration and management , not including new programs or major reordering of priorities that may affect the environment" pursuant to 6 NYCRR § 617 . 5 (c) (20) , and thus adoption of the proposed local law is not subject to review under SEQRA ; NOW, THEREFORE , be it RESOLVED , that the Town Board of the Town of Ithaca hereby adopts said local law entitled " A LOCAL LAW AMENDING CHAPTER 230 OF THE TOWN OF ITHACA CODE , TITLED STREETS AND SIDEWALKS , TO REVISE PROVISIONS RELATED TO EXCAVATION AND CONSTRUCTION IN MUNICIPAL ROADWAYS AND HIGHWAY RIGHTS-OF-WAY" , a copy of which is attached hereto and made a part of this resolution ; and it is further TB 7- 12-2010 Page 4 of 15 RESOLVED , that the Town Clerk is hereby authorized and directed to file said local law with the Secretary of State as required by law. AGENDA ITEM #4 Consider Authorization for Town Supervisor to Sign MOU with Town of Dryden for the Sustainability Planner Position Board Discussion focused on who would supervise the position . Ms . Drake reported that it has to be one person , not the Board , due to civil service requirements and Planning had already indicated they did not want the responsibility and the Supervisor had offered and been accepted at another meeting and that is who she went with . TB RESOLUTION NO . 2010-125 : Authorization to sign MOU Agreement with the Town of Dryden for the Sustainability Planner Position WHEREAS , the Town of Ithaca and the Town of Dryden received a grant from the Park Foundation to fund a Sustainability Planner position that would work 1/2 time at both towns ; and WHEREAS , the attached Memorandum of Understanding outlines how the funding and expenses will be shared between the municipalities ; now, therefore BE IT RESOLVED , that the Town Board of the Town of Ithaca does hereby authorize the Town Supervisor, subject to the approval of the Attorney for the Town , to sign the Memorandum of Understanding agreement between the Town of Ithaca and Town of Dryden for the Sustainability Planner position . AGENDA ITEM #5 Discuss Possible Planned Development Zone ( PDZ) for Ithaca Beer Proposal The Board received a copy of a draft PDZ . Councilwoman Hunter asked who had written the draft and Mr. Kanter responded that the Town has had no input on it yet , but that is the point of referring it to the boards and committees . The draft is just a starting point . 1 TB 7- 12-2010 Page 5 of 15 TB Resolution No. 2010-126 : Refer Draft Planned Development Zone for the Ithaca Brewery Development Proposal to the Planning Committee for Review and Recommendation Whereas , Ithaca Beer Co . is proposing to develop a +/- 81 acre parcel on Mancini Drive off Elmira Road ( NYS Route 13) on Tax Parcel No . 33-3-2 . 2 with a variety of uses , including a new brewery, a beer garden , and a pub/restaurant , which would require rezoning to a Planned Development Zone ( PDZ) , and Whereas , the Town of Ithaca Town Board at its meeting on March 8 , 2010 referred the proposal to the Planning Committee for a preliminary recommendation on the concept of pursuing a PDZ , and Whereas , the Planning Committee at its meeting on June 10 , 2010 recommended that the Town Board consider pursuing a PDZ to accommodate the proposed brewery, beer garden and restaurant , and Whereas , the Ithaca Beer Co . has prepared a draft PDZ , and the Town Board at its meeting on July 12 , 2010 has reviewed the draft PDZ , Now , therefore, be it resolved , that the Town Board of the Town of Ithaca hereby refers the draft Planned Development Zone for the Ithaca Beer Co . proposal to the Planning Committee for review and a recommendation . Y AGENDA ITEM #6 Discuss Draft Stream Setback Law Councilman Goodman stated that this has been a very long and involved process with a lot of feedback and comments from residents and committees . The Board talked about fertilizer and grazing and those that do so now can continue . Ms . Ritter stated that it is not a perfect law, but goes farther than we have and looks at quantitative things like tree p 9 q 9 cutting . Mr. Bates added that it is an educational law and the hope is that people will read it and think, I can do that to help protect the stream . The enforcement is more through cooperation and education . It was not designed to be a "we ' re going to find you ' and ticket you " kind of law. There is a lot of judgment calls in this , but hopefully through education , people will want to comply with this law. Discussion followed . a . Consider Referral to the Zoning Board of Appeals , Conservation Board and Planning Board for recommendation TB RESOLUTION NO . 2010-127 : Refer Draft Stream Setback Law to the Planning Board , Conservation Board and Zoning Board of Appeals TB 7- 12-2010 Page 6 of 15 Resolved , that the Town Board of the Town of Ithaca hereby refers consideration of the proposed Draft Stream Setback Law and proposed law adding related definitions to the Town of Ithaca Planning Board , Conservation Board and Zoning Board of Appeals for a recommendation . MOVED : Councilwoman Hunter SECONDED : Councilman Goodman VOTE : Ayes : Engman , Goodman , Leary, Riha , Levine , Hunter and DePaolo Motion passed unanimously. AGENDA ITEM #7 Discuss Dog Enumeration (See Attachment) Supervisor Engman gave an overview of the proposal stating that the Town is required to conduct a census as part of the animal control contract with Tompkins County Animal Control (TCAC) . He went over the memo from the Clerk's office regarding . costs . Discussion followed . It was noted that NYS repealed their requirement to do a census back in 1979 , but everyone still thought we had to do one . Supervisor Engman added that during contract negotiations with TCAC via TCCOG , each municipality agreed to conduct a census which will then be used to develop a ratio of dog population and human population to have a more fair distribution of costs . We think we will pay less when this is done . Discussion followed . Ms . Terwilliger explained how the enumeration will work . The Board had questions on the estimate numbers and house versus household . Ms . Terwilliger noted that it is household not house . The estimates were based on households owning dogs now and responding to the mail-out census and we are eliminating certain know complexes such as Overlook. Councilman DePaolo asked about talking to vets and getting numbers of dogs from them . Ms . Terwilliger stated that she had talked to her friend who is a vet and she didn 't think clinics would do that , and people also take their dogs to many different vets not necessarily in Ithaca. Discussion followed . There was some discussion on who should sign the contract and the resolution was changed to authorize the Supervisor to sign the contract . a . Consider approval to conduct a dog enumeration TB RESOLUTION NO. 2010-128 : Approval to Conduct a Dog Enumeration WHEREAS , the Board has decided it would be in the best interests of the Town to conduct a dog enumeration as outlined by the Town Clerk's office , THEREFORE , be it RESOLVED , that the Town Board does hereby authorize the Town supervisor to sign a contract with an interested party(s) to conduct a door-to-door dog enumeration in 2010 , on the terms described in the attached memo with the cost not to exceed $ 15 , 000 . AGENDA ITEM #8 Discuss Changes to the Personnel Manual Ms . Drake gave an overview of the changes . Councilman DePaolo asked why we were considering changes and did doing so deter union organization . Ms . Drake responded that not all of the differences between the two are being changed to be the same . Some are just easier to have everyone the same for administrative purposes . Discussion followed . Councilwoman Hunter noted that the Personnel Committee did discuss costs to the Town , union issues , and the like . TB RESOLUTION NO . 2010-129 : Approval of Revisions to Certain Policies of the Personnel Manual WHEREAS , the Teamster's contract with the Public Works staff was approved by the Town Board November 23 , 2009 , which changed some of the Town 's policies ; and WHEREAS , the Personnel Committee and Employee Relations Committee reviewed each of the items from the contract that was a change in order to determine if the changes should be extended to non - union staff ; and WHEREAS , the Personnel Committee recommends the following changes to be extended to the non - union staff effective August 1 , 2010 : • Clothing allowance — increase from $220 to $300 for Public Works Deputy Group ( Deputy Highway Superintendent , Parks Maintenance Manager and Water/Sewer Maintenance Supervisor) and to match the union contracts in the future . o Safety T-Shirt program - 5 t-shirts per year paid in full for PW Deputy Group and Civil Engineers , and to match the union contracts in the future . • Safety Toed Shoe Allowance —increase from $ 125 to $ 135 for all eligible employees based on policy, and to match the union contracts in the future . • Cell Phone Program - $20 per month allowance for approved staff using their personnel cell phones for town business , and to match the union contracts in the future . • Long� ( no change for current employees) Employees hired on or after August 1 , 2010 will receive a longevity payment based on the following schedule , and to match the union contracts in the future : 10- 14 years of service $ 150/yr 15- 19 years $200/yr 20 — 24 years $250/yr 25 or more years of service $300/yr • Retiree Health Insurance- (no change for current employees) Employees hired on or after August 1 , 2010 will be eligible for retiree health insurance at a prorated TB 7- 12-2010 Page 8 of 15 amount based on years of service with the Town once they have at least 10 years of service with the Town . Policy is to match the union contracts in the future . 10-24 years of service retiree pays 80% of monthly premium 25-29 years of service retiree pays 65% of monthly premium 30 or more years of service retiree pays 50% of monthly premium • Vacation time request- Requests for vacation time off that is for less than 5 days can be submitted up to 24 hours in advance . • Sick Time — family- Effective August 1 , 2010 employees may use up to 80 hours per calendar year toward the care of a sick immediate family member, and to match the union contracts in the future . Now therefore be it RESOLVED , the Town Board of the Town of Ithaca does hereby approve the revised Policies outlined above ; and be it further RESOLVED , the Human Resources Manager is directed to incorporate the revised policies into the Personnel Manual and distribute it to the staff . AGENDA ITEM #8 Discuss improvements to the HVAC system in Town Clerk Area Supervisor Engman gave the background . It will be much cheaper if the project is done in the summer. Discussion followed . b . Approve Budget Transfers and Project TB RESOLUTION NO . 2010- 130 : Budget Amendment for the Installation of New Heating System within the Town Clerks Office WHEREAS : the heating system within the old Post Office is insufficient to provide consistent temperature control for the office space currently housing the Town clerk's , and WHEREAS : options for the improvement to the temperature control have been investigated , identified and presented to the Operations Committee , and WHEREAS : the option for the installation of new piping , coils and controls creating a new heating zone for the Town Clerk's Office , totaling $8 , 600 has been heard and recommended to the Town Board for consideration at the May 20th meeting of the Operations Committee , and TB 7- 12-2010 Page 9 of 15 WHEREAS : the Town Budget Officer recommends appropriating $5 , 000 from the General TownWide Fund "Contingency" budget line A1990 . 400 and $3 , 600 from the Buildings and Grounds budget line A1620 . 400 to budget line A1620 . 245 Town Hall — Heating System Town Clerk Office , and be it RESOLVED : that the Town Board approve , authorize and direct the Town Budget Officer to record the appropriate budgetary amendment to establish funding to meet this expense . MOVED : Councilwoman Leary SECONDED : Councilman DePaolo VOTE : Ayes : Engman , Goodman , Leary, Riha , Levine , Hunter and DePaolo Motion passed unanimously. AGENDA ITEM # 9 Discuss Retirement Incentive Ms . Drake explained the background and the incentive . There are two employees who have indicated they would be interested if it were offered . Discussion followed . a . Consider setting public hearing TB RESOLUTION NO . 2010=131 : Setting a Public Hearing to Consider a Local Law Authorizing an Early Retirement Incentive for 2010 RESOLVED, that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall , 215 North Tioga Street , Ithaca , New York , on the 9th day of August , 2010 , at _5 : 45 p . m . for the purpose considering a local law establishing an early retirement incentive for employees of the Town for the year 2010 ; and it is further RESOLVED , that at such time and place all persons interested in such local law may be heard concerning the same ; and it is further RESOLVED , that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal published in the City of Ithaca , Ithaca , New York , and to post a copy of same on the signboard of the Town of Ithaca , said publication and posting to occur not less than ten days before the day designated above for the public hearing . TB 7- 12-2010 Page 10 of 15 AGENDA ITEM # 10 Consider Town of Caroline ' s request for dental insurance coverage Ms . Drake explained . Once the health consortium is up and running , this will not be an issue and the employee will be covered under that . There is no cost to the Town . The draft resolution was changed to define a time limit for the coverage . TB RESOLUTION NO . 2010 — 132 : Approval to Extend Dental Insurance to the Town of Caroline WHEREAS , the Town of Caroline has requested that one employee , who is losing dental insurance due to their union contract , be added to the Town 's dental insurance with no financial impact to the Town of Ithaca on a temporary basis , and WHEREAS , the Personnel Committee reviewed the request and recommend the Town Board considering the request ; Now , therefore , be it RESOLVED , the Town Board of the Town of Ithaca does hereby approve allowing one employee from the Town of Caroline to be added to the Town of Ithaca Dental Insurance with no financial cost to the Town of Ithaca on a temporary basis , or until the employee can participate in the dental plan offered by the Greater Tompkins County Municipal Consortium , but in any event , not to exceed one year from the date the employee enrolls with the TOI dental plan . MOVED : Councilwoman Hunter SECONDED : Councilwoman Leary VOTE : Ayes : Engman , Goodman , Leary , Riha , Levine , Hunter and DePaolo Motion passed unanimously . AGENDA ITEM #11 Black Diamond Trail Update Supervisor Engman requested the agenda item and gave an update . Essentially, there is no money to finish the bridges . There was a summit meeting with all involved parties — State has the money for the planning of the two bridges needed to complete the project but they have lost the money to build them or the remainder of the trail for a total of approximately $2M . They talked about possibilities to fundraise with businesses and foundations to build the bridges and then get the Public Works departments together to talk about building the trails . The State Parks say they can come up with $700- $800K worth of materials and the PW departments would have to build the work into their budgets and work plans . He went on to say that they are just exploring it and wanted comments , ideas or feelings on the possibility . The section from Taughannock State Park to Cass Park is ready to go except for the bridges . TB 7- 12-2010 Page 11 of 15 Mr. Weber added that he would be hoping that someone else would be responsible for obtaining all the permits associated such at curbcuts , wetland permits , etc , with the state so we are truly only building it . Mr. Kanter added that the SEQR is already done . Councilman DePaolo asked if other municipalities are willing to join in and Supervisor Engman responded that there would have to be an agreement with the other DPW 's and the smaller town may not have any equipment to do the work or maintain them so it would be an intermunicipal agreement . The State Parks have stated they do not have any equipment . He added that it would be a great boost to tourism and he attended a Black Diamond Trail public hearing and there were a lot of people who said they would ride to work if the Trail was done . It has some strong selling points , but it would be a challenge . Appoint Senior Typist for Codes MOVED : Councilwoman Riha SECONDED : Councilwoman Hunter VOTE : Ayes : Engman , Goodman , Leary, Riha , Levine , Hunter and DePaolo Motion passed unanimously. a . Town of Ithaca Abstract TB RESOLUTION NO . 2010-133a : Town of Ithaca Abstract WHEREAS , the following numbered vouchers have been presented to the Ithaca Town Board for approval of payment ; and WHEREAS , the said vouchers have been audited for payment by the said Town Board ; now therefore be it RESOLVED , that the governing Town Board hereby authorizes the payment of the said vouchers in total for the amounts indicated . AGENDA ITEM #13 Report of Town Officials Department of Public Works Mr. Weber reported that the County is now charging for brush drop off and we are now seeing a lot more at our location . We may need to have the outside contractor who takes care of our brush come in an extra time . Mr. Weber reported that the boom mower bid came in under budget and will be awarded to the lowest bidder. Ms . Brock asked about the Board approving the award which started the discussion about the process for approving and awarding equipment bids . Ms . Terwilliger noted that the resolution for this particular piece of equipment covered the solicitation and award . Discussion followed . The Board discussed who has the authority to award bids . Some Board Members want to see the evaluations of the bids and award them as a process ; others do not want to have to see routine types of bids again and again . There is a monetary threshold where the Board must approve an award and Ms . Terwilliger added that there is a difference between projects and products . Ms . Brock will do some research on the law and the issue will be discussed at the Study Session . Subscribed and sworn to before me this Town Clerk day of 20 Notary Public TOWN OF ITHACA Public Works Department Month of June Board Report July 12, 2010 Meeting Roads : • Three new 25-week seasonal workers began work. • Driveway culverts were installed on Chase Lane along with an 18" road crossing pipe . • An important 36" road crossing pipe on Winston Drive was replaced . • Brush and tree limbs were cut on roads around the Town. • Roadside mowing continued . • Ditching and repaving of the turn around on Updike Road was done . • A catch basin on Concord Place was repaired . • An 18" road crossing pipe on Juniper Drive was replaced . • Catch basins were cleaned as part of our continuing maintenance of stormwater facilities. • Low shoulders were patched in various spots. • Orchard Hill Road and Lois Lane were cold-mix paved and new shoulders installed . Orchard Hill Road ditches were cleaned and hydro-seeded prior to paving. • Gravel was hauled in for pub milling shoulder material. • We assisted the Town of Lansing with paving and they helped us with trucking. We also trucked material for the Village of Cayuga Heights. • Catch basins on Elm Street and Perry Lane werer also repaired . • We trimmed under guiderails and around our stockpile areas at the Public Works Facility. • Residents dropping off brush and yard waste continued with over 120 entries signed in. Parks, Trails, and Preserves : ■ Weekly site checks were performed. ■ Regular grounds maintenance continued . ■ Support of the Community Garden continued . ■ We completed construction of Salem Park playground - and some final site and landscaping details. Fibar mulch is scheduled to be delivered on July 8th. Our Youth Corp will install the base fabric and spread the fibar to one foot in depth. ■ The Summer Hill Walkway was paved . ■ Coordinate use of Tutelo Park and Valentino Field . Water: ♦ Lawn repair at the water valve repair site on Penny Lane was completed . ♦ Hydrant maintenance with factory representatives and suppliers . Replaced main values on six hard operating hydrants at no charge for the parts. ♦ A hydrant on Fairway Drive was replaced and moved further away from the edge of the cul-de-sac . Sewer: ► Weekly sewer pump station checks were performed . ► 104 Dig Safely New York mark outs were performed. ► Mowing began on sewer easements. Engineering: 4 Inspected 30 weekly simple SWPPPs . 4 Managed ten full SWPPPs. 4 Development review on various projects. 4 Traffic counts have been conducted on various roads. 4 Continue monitoring sanitary sewer flows. We are now above the City of Ithaca meter station. Work continues on plans for Hungerford Hill Pump Station. Ridgecrest Water Tank project has been let out to bid . Continue working with railroad and Health Department's review of East Shore Drive project. Forest Home Traffic Calming bids were opened and rejected . Project was . modified and rebid . July Projects 1 . Five summer youth workers begin July 6th. 2 , Snyder Hill storm drainage . 3. _ Northview Park playground construction. 4. Regular grounds maintenance and trimming. 5.
