Keilbach, (Lanny) Joyce, Egan, Ellio LeMaro, Ivan Chairperson Grigorov declared the meeting duly opened at 7:30 P.M. and accepted for the record the Clerk's Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on May 7, 1990, and May 10, 1990, respectively, together with the Clerk's Affidavit of Service by Mail of said Notice upon the various neighbors of each of the properties under discussion, as appropriate, upon both the Clerk and the Building • Commissioner of the City of Ithaca, upon the Tompkins County Commissioner of Planning, and upon the applicants and /or agents, as appropriate, on May 8, 1990. PUBLIC HEARING: CONSIDERATION OF SUBDIVISION APPROVAL FOR THE PROPOSED SUBDIVISION OF 2.69 + /- ACRES FROM TOWN OF ITHACA TAX PARCEL NO. 6- 31 -2 -21, LOCATED AT 691 FIVE MILE DRIVE, RESIDENCE DISTRICT R -15. WILLIAM F. MURPHY JR. AND LYNN S. MURPHY, OWNERS; KARL A. KEILBACH SR., APPLICANT. Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Mr. Karl Keilbach addressed the Board and stated that he wishes to purchase 212 acres out of 512 acres which is owned by the Murphys. Mr. Keilbach stated that he proposes to build a house on the 212 acres. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone present wished to speak. No one spoke. Chairperson Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. Robert Miller remarked that he did not see anything wrong with is the proposal. Nt Planning Board -2- May 15, 1990 • Eva Hoffmann, referring to the parcel of land, wondered if there was any water, such as the Inlet, going by toward the railroad side. Assistant Town Planner George Frantz said that the back part of the lot is quite low, and believed that the back part is in a floodplain. Mr. Frantz noted that the proposal is a fairly straight- forward subdivision, and meets zoning requirements. There appearing to be no further discussion, Chairperson Grigorov asked if anyone were prepared to make a motion. (Adopted-Resolutions' attached hereto as Exhibit No. 1.) Chairperson Grigorov declared the matter of Subdivision Approval for William & Lynn Murphy /Karl Keilbach Two -Lot Subdivision duly closed. PUBLIC HEARING. CONSIDERATION OF SUBDIVISION APPROVAL FOR THE PROPOSED SUBDIVISION OF 1.84 ACRES FROM TOWN OF ITHACA TAX PARCEL NO. 6- 46 -1 -12, LOCATED AT 838 CODDINGTON ROAD, RESIDENCE DISTRICT R -30. LYMAN E. AND JEAN E. BAKER, OWNERS /APPLICANTS. Chairperson Grigorov declared the Public Hearing in the above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. Ms. Jean Baker addressed the Board and offered that she has • deeded 1.84 acres over to her son. Ms. Baker said that her son wants to build a one - family home. Chairperson Grigorov noted that this was a Public Hearing and asked if anyone present wished to speak. No one spoke. Chairperson Grigorov closed the Public Hearing and brought the matter back to the Board for discussion. Virginia Langhans asked about an existing building located on the lot. Ms. Baker responded that it is a storage shed. Robert Kenerson wondered how far the existing house is from the new property line. Ms. Baker replied that it is about 401. Eva Hoffmann asked if there would be a shared driveway. Ms. Baker responded, yes, a shared driveway. Mr. Kenerson wondered about sewer and water connections. Ms. Baker said there is water but no sewer. There appearing to be no further discussion, Chairperson Grigorov asked if anyone were prepared to make a motion. PUBLIC HEARING: CONSIDERATION OF A REPORT TO THE ZONING BOARD OF APPEALS WITH RESPECT TO A REQUEST FOR SPECIAL APPROVAL, PURSUANT TO ARTICLE V, SECTION 18, PARAGRAPH 4, OF THE TOWN OF ITHACA ZONING ORDINANCE, AND A REQUEST FOR A VARIANCE FROM THE MAXIMUM ALLOWABLE HEIGHTS, AS SET FORTH IN ARTICLE VIII, SECTION 44, PARAGRAPH 4, AND ARTICLE V, SECTION 18, PARAGRAPH 16, OF SAID ORDINANCE, FOR THE PROPOSED "THERMAL STORAGE PROJECT AT CHILLED WATER PLANT III ", CERTAIN PORTIONS OF WHICH ARE TO BE LOCATED IN A RESIDENCE DISTRICT R -30, AND FURTHER, CONSIDERATION OF SITE PLAN APPROVAL FOR THOSE PORTIONS OF SAID PROPOSED "THERMAL STORAGE PROJECT AT CHILLED WATER PLANT III" LOCATED WITHIN A LIGHT INDUSTRIAL DISTRICT. Chairperson Grigorov declared the Public Hearing in the • above -noted matter duly opened and read aloud from the Notice of Public Hearings as posted and published and as noted above. response Philip L. University, University, and Cox, Director Facilities Engineering, approached the Board, appended a showed slides of the proposed project. map of Cornell Cornell Mr. Cox stated that the Thermal Storage Tank will be located southeast of Chilled Water Plant III, and will be interconnected to the plant. The tank will be constructed of welded steel, insulated, and painted to blend into the surrounding environment. Mr. Cox stated that Cornell has decided to reduce the tank height by 40', to an overall height of 701, adding that Cornell did this in response to concerns by both the Town and the Campus community about the visual impact of the tank. Mr. Cox commented that no additional thermal storage tanks are planned. Any new peak capacity beyond this project will have to be provided by new chillers located in an expansion at one of the three central plants, or in a new plant. No plans are in place for peak capacity beyond this project. Mr. Cox offered that the University intends to complete design during the Summer of 1990, begin construction of the project in the Fall of 1990, and commission it during the Summer of 1991. n U Planning Board • Chairperson asked if there questions. .4- Grigorov noted that this was a were anyone from the public who had May 15, 1990 Public Hearing and any comments or Doug Brittain, of 135 Warren Road, spoke from the floor and expressed a concern about the railroad right -of -way as the Town has a recreationway that goes through there. ACRES, RESIDENCE Assistant Town Planner George Frantz wondered if Cornell had decided on a color. Mr. Cox responded that it would be a neutral color . Mr. Cox offered that the exterior of the storage tank would not be lighted. Town Engineer Dan Walker stated that the only concern he has is the stabilization of slopes on either side for construction. Mr. Cox responded that Cornell is aware of the problem and would take care of it. Attorney Barney, referring to the visual impact, wondered when Cornell was going to decide on a color for the tank. Mr. Cox replied that Cornell would choose a color, such as buff or sand, and would • notify the Town of their decision. There appearing to be no further discussion or comments from the Board, Chairperson Grigorov asked if anyone were prepared to offer a motion: (Adopted Resolutions in re Report to the Board of Appeals on those portions in Residence District R -30 attached hereto as Exhibit No. 3.) Chairperson Grigorov declared the matter of the proposed Cornell Storage Project at Chilled Water Plant III duly closed. SKETCH PLAN REVIEW: RESIDENTIAL CLUSTER SUBDIVISION, PROPOSED TO CONSIST OF 203 LOTS AND 104 TOWNHOUSE UNITS PLUS APPROXIMATELY 30 ACRES OF OPEN SPACE, PROPOSED FOR LOCATION ON MECKLENBURG ROAD ON TOWN OF ITHACA TAX PARCEL NO. 6 -27 -1- 13.12, 95 +/- ACRES, RESIDENCE DISTRICT R -15. ANTHONY CERACCHE, OWNER; PRODECON PROJECT DESIGN AND CONSTRUCTION, APPLICANT. Chairperson Grigorov opened the discussion on the above -noted matter and read aloud from the Agenda as noted above. • A map was appended to the bulletin board. A Planning Board -5- May 15, 1990 • Mr. Arel LeMaro addressed the Board and stated that the prime objective of the proposed development is to provide affordably priced equity housing to first -time homebuyers who currently live or work in the Ithaca community. The proposal is to develop 95.36 acres of land along the north side of Mecklenburg Road. The property is bounded on the south by Mecklenburg Road with approximately 1550 feet of road frontage. It is bounded on the west by the Eddy Hill, Inc. property, on the north by the Perry property, and on the east by the City of Ithaca line. Mr. LeMaro said that the land is zoned R -15. A small intermittent creek (Linderman Creek) traverses the parcel in an east -west direction. The parcel has municipal water and sewer service readily available and accessible to the site. Mr. LeMaro stated that the proposed land use is to consist of a residential clustered subdivision with detached and attached single- family dwelling units. Approximately 66 acres will consist of detached single - family dwelling units, and 29 acres of attached single- family townhouse units. Mr. LeMaro offered that 31% (30 acres) will consist of public or private open space. It is proposed to dedicate approximately 8 acres of woods to the Town for a tree park. Mr. LeMaro said that a total of approximately 307 attached and detached single - family dwelling units are planned in the clustered subdivision. About 203 units will be detached homes on lots of 5,400 • square feet or larger, and road frontage on cul -de -sacs will be 40' minimum, 54' minimum in all other areas. Approximately 104 units will be townhouses clustered in groups of 2 to 6 units per structure. Mr. LeMaro said that the local roads /cul -de -sacs will have a 60' right -of -way. Total roads will be approximately 14,900 linear feet. Mr. LeMaro said that there will be a Homeowners' Association or a Not For Profit Organization, Mr. LeMaro said that there would be no rental units in the project; the structures will be For Sale only. Chairperson Grigorov asked if there were any other comments. There being none, Chairperson Grigorov declared the matter of the Prodecon Project Design and Construction Residential Cluster Subdivision Sketch Plan Review duly closed. OTHER BUSINESS Assistant Town Planner George Frantz discussed the change in the SEQR process, in that the environmental assessment is done at an earlier stage of a project. Mr. Frantz stated that he thought this could be discussed at length at the next meeting. Mr. Frantz mentioned a SEAR review of the McDonald's project with the idea of the Board making the environmental determination at that • point, before even getting into site plan review. Planning Board -6- May 15, 1990 • Mr. Frantz mentioned the Shalebrook subdivision, in that the Perry family would like to go forward with that project. That the Planning Board, in making recommendation to the Zoning Board of Appeals, determine and hereby does determine the following: a, there is a need for, the proposed use in the proposed location, as demonstrated by review of the information presented by the applicants b, the existing and probable future character .o-f the neighborhood will not be adversely affected, given the proposed design of the project, its location, and industrial character of land uses in the immediate vicinity of the proposed project; c. The proposed change is in accordance with a comprehensive plan of development-of the "Town . 4. That the Planning Board report and hereby does report to the Zoning Board of Appeals its recommendation that the request for Special Approval for the proposed Cornell University Thermal Storage Project at Chilled Water Plant III be granted by the Zoning Board of Appeals. 59 That the Planning Board report and hereby does report to the Zoning Board of Appeals its recommendation that the request for a variance from the' maximum allowable heights as set forth in Article VIII, Section 44, Paragraph 4, and Article V, Section 18, Paragraph 16, of the Town of Ithaca Zoning Ordinance be granted by the Zoning Board of Appeals.
