HomeMy WebLinkAbout1986-07-01ZONING BOARD OF APPEALS JULY It 1986 • Zoning Board of Appeals met July 1,1986 with members.J. Baker, N. LaMotte, Chr. P. Brellochs, C. Hatfield, & Z.O. S. Stewart present. Absent: D. Rose. Also present: Paul Barbagallo. • Public hearing continued from June 5th to consider application of Pauls Food Mart for a sign larger than permitted by Town Sign Ordinance at his new store at 12 Freeville Rd. & is requesting variance to Sec. 1502 -6 of Town Zoning Ordinance. Paul Barbagallo present - presented sketch of proposed sign (& existing sign on building). Gave following information; sign to be 71x10' outside dimension, free standing, double faced, self illuminating (from inside), non - flashing, to be lighted z hour before sunset until 11:30 PM (2 hour after store closes), 7 days a week,bottom of sign will start 15' above ground (to keep from being hit by vehicles) set back to be approx. 20' from edge of road pavement. (approx. 32' from center line). Support for sign constructed from painted steel - not certain of materials used in frame. Board questioned; structural architect, is sign fixed or turning, & how many variances needed (set back, overall size, & overall height) Mr. Barbagallo stated a Syracuse firm, Electro Ad, putting sign up & is guaranteed, sign is to be fixed, not turning, & located approx. 15.8' West of entrance when traveling West of Rte 38 - Not to be centered in front of building. General discussion - In technical sense, although application stipulates only one area of non - conformance, there are in fact additional sections a sign of this proportion would affect - P. Brellochs explained code requirements of ordinance & how listed w /subdivisions etc. Also discussed lack of visibility of sign from Rte 13 as stated desired in application. Board moved into Executive Session. (Members visited site to explore & measure & familiarize themselves with location of power lines, parking lot, visibility, entrances, etc.) Public hearing reopened. N. LaMotte motion to grant variance. Seconded by J. Baker, with amendment stipulation that set back is to be outside State right -of -way plus 15' as -2- agreed to verbally by applicant. No discussion. VOTE ALL YES variance GRANTED (w /stipulation) N. LaMotte made motion to adjourn. Seconded by J. Baker. Meeting adjourned 9:00 PM.
