SECTION 1 The Town of Board hereby elects to provide all
eligible employees with a retirement incentive
program authorized by Chapter 41, Laws of 1997.
SECTION 2 The commencement date of the retirement incentive
program shall be October 1, 1997.
SECTION 3 The open period during which eligible employees may
retire and receive the additional retirement
benefits, shall be sixty-six (66) days in length.
SECITON 4 The actuarial present value of the additional
retirement benefits payable pursuant to the
provisions of this local law shall be paid as one
lump sum, or in five annual installments. The
amount of the annual payment shall be determined
by the Actuary of the New York State and Local
Employee's Retirement System, and it shall be
paid by the Town of Groton for each employee
who receives the retirement benefits payable
under the local law.

SECTION 5 If any part or provision of this local law or
the application thereof to any person or
circumstance be adjudged invalid by any
court of competent jurisdiction, such judgment
shall be confined in its operation to the part
or provision or application directly involved
in the controversy in which such judgment
shall have been rendered and shall not affect
or impair the validity of the remainder of this
local law or the application thereof to other
persons or circumstances, and the Town Board
of the Town of Groton hereby declares that it
would have passed this local law or the remainder
thereof had such invalid application or invalid
provision been apparent.
SECTION 6 This local law shall take effect immediately
upon filing in the office of the Secretary of
State in accordance with section twenty-seven
of the Municipal Home Rule Law.

SECTION 1. The Town of Board hereby elects to provide all of its eligible employees with a
retirement incentive program authorized by Chapter 41, Laws of 1997.
