Call to Order: Supervisor Engman called the meeting to order at 4 : 30 p . m .
Agenda Item No. 2 — Set Public Hearing to hear public comment regarding the
Proposed Local Law Amending Fence and Wall Requirements and Adding
Related Definitions in Chapter 270 (Zoning) of the Town of Ithaca Code
TB RESOLUTION NO . 2009=220a Setting a Public Hearing Regarding a Local Law
Amending Fence and Wall Requirements and Adding Related Definitions in
Chapter 270 (Zoning) of the Town of Ithaca Code
RESOLVED , that the governing body of the Town of Ithaca does hereby set a public
hearing for Monday. , December 7 , 2009 at 6 : 20 p . m . to hear public comment relative to
a local law amending fence and wall requirements and adding related definitions in
Chapter 270 (Zoning) of the Town of Ithaca code ; and
FURTHER RESOLVED , that the Town Clerk shall post a notice of the time and place of
this public hearing in the daily newspaper at least ten days prior to the public hearing .

VOTE : Supervisor Engman , aye ; Councilwoman Leary , aye ; Councilman Stein ,

Agenda Item No. 3 = Discuss and Consider Approval of Collective Bargaining
Agreement with Teamsters Local 317 for Public Works Department Employees
TB RESOLUTION NO . 2009=221 : Approval of Collective Bargaining Agreement
with Teamsters Local 317 for Public Works Department Employees
Town Board Minutes: November 23, 2009
WHEREAS , effective January 1 , 2008 , the Town Board recognized Teamsters
,
Local 317 as the exclusive representative for collective bargaining purposes of all full-
time probationary and full -time post- probationary Department of , , IPbblic Works
employees in the following position titles : Laborer, Motor Equipment, Operator, Heavy
Equipment Operator, Working Supervisor, Maintenance Worker, Engineering
Technician I , Senior Engineering Technician , Heavy Equipment Mechanic , and
Assistant Automotive Mechanic ; and
WHEREAS , the Town has been negotiating a contract in good faith , since the
first meeting with Teamsters on March 25 , 2008 through their last meeting on November
4 , 2009 ; and
WHEREAS , the Town ' s negotiations team , comprised of the Town Supervisor,
Human Resources Manager, Highway Superintendent and LeRoy Kotary , Consultant ,
has reviewed the attached tentative agreement and recommends it for approval ; and
WHEREAS , the employees in the collective bargaining group met on Tuesday,
November 10 , 2009 and voted affirmatively to ratify the contract ;
Now therefore be it
RESOLVED , that the Town Board of the Town of Ithaca does hereby accepts the
recommendation of the negotiations team and approves the signing of the collective
bargaining agreement between the Town of Ithaca and Teamsters Local 317 ; and be it
further
RESOLVED , the contract is effective November 23 , 2009 through December 31 ,
2011 , with retroactive pay for the employees dating back to January 1 , 2009 ,

SECONDED : Councilwoman Hunter
VOTE : Supervisor Engman , aye ; Councilwoman Leary , aye ; Councilman Stein ,
aye ; Councilman Goodman , aye ; Councilwoman Hunter, aye . Motion
approved — Unanimous

increase of 4 . 5% for 2009 and 1 . 5% for 2010 ;

Now, therefore , be it
RESOLVED , the Town Board of the Town of Ithaca does hereby approve ,the
said wages for the collective bargaining employees for the year 2009 and 2010 As,_ filed
in the Human Resources Office .

SECONDED : Councilman Goodman
VOTE : Supervisor Engman , aye ; Councilwoman Leary, aye ; Councilman Stein ,
aye ; Councilman Goodman , aye ; Councilwoman Hunter, aye . Motion
approved — Unanimous
