PRESENT : Chairman Montgomery May , Barbara Schultz , James Baker , Carolyn Grigorov , Liese Bronfenbrenner , Edward Mazza , Lawrence Fabbroni ( Town Engineer ) Lewis Cartee ( Town Building Inspector ) , Nancy Fuller ( Secretary ) . APPROVAL OF MINUTES MOTION by Mrs . Carolyn Grigorov , seconded by Mr . Montgomery May : RESOLVED , that the Minutes of the Planning Board Meeting of September 15 , 1981 , be and hereby are approved as written . There being no further discussion , the Chair called for a vote . Aye - May , Schult :� , Baker , Grigorov , Bronfenbrenner , Mazza . Nay - None . The MOTION was declared to be carried unanimously . REPORT OF THE BUILDING INSPECTOR With each Planning Board member having in hand a copy of his Report of September 1981 , Mr . Cartee noted that 7 Building Permits were issued during the month of September , 1981 , for a total of $ 144 , 383 . 00 in improvements , as compared to 13 Building Permits issued in the month of September , 1980 , for a total of $ 83 , 57 .5 . 00 in improvements . Mr . Cartee commented , for the Board ' s interest , that so far in the month of October 14 Building Permits have been issued . REPORT OF THE TOWN ENGINEER Mr . Fabbroni reported that , as everyone is quite aware , we have had bad weather for some time now , so , the progress at the DeWitt park site is not too much farther along than in late August . He stated that , however , be that as it may , he hoped to get it graded and seeded before winter ' He commented that their best advice is to seed just before the snow flies . Mr . Fabbroni :reported that the Transit operations are doing very , very well . He noted record numbers of riders in East Ithaca during the first month of school being back in session . He stated that the expanded NET System is carrying about 5070 more . He noted that also EIT ( East Ithaca Transit ) ridership has increased almost as much . He described the utilization of the middle of the day runs as positive . Mr . Fabbroni reported that the Cliff Street Pump Station work is complete . He also reported that the water improvement matter is moving along . ' Planning Board - 2 - October 20 , 1981 Mr . Fabbroni. reported that Mr . Peter M . Lovi has compiled all of the information on the subdivision regulations that has been offered over the past ten years . He stated that Mr . Lovi will be adding to that , subtracting from it , etc . and then will be getting together with the sub - committee on a first draft of a new look at the subdivision regulations . Mr . May commented that the TOMTRAN grant acquisition had been approved by the County . Mr . Fabbroni stated that that was correct and added that the administration and operations scheme is to be worked. out . REPORT OF THE TOWN PLANNING DEPARTMENT Mr . Fabbroni stated that he had already mentioned what Mr . Lovi is doing in the area of the subdivision regulations . Mr . Fabbroni reported that Mr . Lovi and he areinvestigating actively different word processing equipment and data processing equipment as available from many different vendors . He stated that the staff has been looking at many approaches all over Town , and , in fact , Mr . Lovi this evening is attending a two - night institute at Cornell which will help guide us in our choice between a micro - computer and a mini - computer . This in - depth study of various hardware , software , and uses is by way of gathering information which , at this point , is leading us toward the installation of one station and seeing how our different departments would use it and how thE! process would interact . Mr . Fabbroni closed by noting that this is quite an active area of effort . REPORT OF COUNTY PLANNING BOARD CHAIRPERSON , TOWN COUNCILWOMAN SHIRLEY RAFFENSPERGER . Mrs . Raffensperger was unable to attend this meeting of the Planning Board , being involved in another meeting . and so she had submitted a written report with attachments to the Secretary with such report having been sent to each Planning Board member with their Agenda . Mrs . Raffensperger ' s report is attached to the Official Copy of these Minutes , but , in brief , it reads as follows : " COUNTY PLANNING BOARD - October 14 , 1981 Tomtran - first year program funded , accepted by CBR first priority : Ithaca - TC3 - Dryden - operable in about 6 months Reapportionment Update - presentation of reapportionment plan recommended by appointed committee . Court action and subsequent Board of Reps resolution approving weighted voting make situation uncertain . Student Housing Update - 547o of Cornell students living off - campus in Fall 1980 . Enclosed is copy of abstract of 1980 - 81 Off - Campus Housing report ( Cornell ) , including recommendations . Also enclosed for your information : Tompkins County Dept . of Planning Information System description Model form for Sellers and Lessors / Heating and Cooling Cost Survey " • PUBLIC HEARING : CONSIDERATION OF FINAL SITE PLAN APPROVAL FOR " COURTSIDE RACQUETBALL AND FITNESS CLUB TO BE LOCATED IN THE FORMER IDE ' S ROLLER RINK , CORNER JUDD FALLS ROAD AND MITCHELL STREET , TOWN OF ITHACA TAX PARCEL NO . 6 - 62 - 1 - 5 . Chairman May declared the Public Hearing in the above - noted matter duly Planning Board - 3 - October 20 , 1981 opened at 7 : 45 p . m . and accepted for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal ort October 13 , 1981 , and October 15 , 1981 , respectively . Mr . Thomas 1:1 . LiVigne appeared before the Board with the following drawings as prepared by his architect , O ' Brien Taube Associates : 1 . Site Plan with Landscaping - 10 / 20 / 81 . 2 . First Floor Plan - 10 / 20 / 81 . 3 . Second Floor Plan - 10 / 20 / 81 . 4 . Elevations - 10 / 20 / 81 . Mr . LiVigne stated that the plans have been changed slightly since the date of the preliminary approval ( Planning Board 9 / 15 / 81 ) in that the proposed addition is now 1 , 800 sq . ft , rather than 3 , 000 sq . ft . Mr . David Taube described the Site Plan in detail to the Board indicating the landscaping -by type , 90 parking spaces plus service access zone , and noting that there is essentially a hold - back of a minimum of 10 ' from all property lines . Mr . Taube stated that the landscaping is anticipated to be a two or three year planting plan using honey locust , deciduous red buds , and other shrubbery . He described the utilization of two flag poles enhanced by shrubbery . Mr . Taube also described the installation of pine and shrubbery at the entrance and at the east side of the property . Mr . Taube moved on to a description of the first floor referring to the drawing thereof . He described a " greenhouse as shown on the plan in the area of the lounge , and added that this amenity is pending the funds available . Mr . Taube proceeded to describe the second floor as shown on the plan . It was noted that there are proposed six courts in the existing building and two courts in the proposed addition , and that the courts extend up through the second floor . Mr . Taube stated that insofar as Building Code requirements go , there are a couple of items that they would want to go over with Mr . Fabbroni or the appropriate Town official since they need some help with certain inter - pretations . Mr . Taube then described the north and west elevations as shown on the elevation drawing . He noted that concrete block will be used sealed with heavy base masonry type material which will cover all the joints . The color scheme was described as being light beige with a red line and then a light brown . It was noted that the graphics will depict a ball bouncing along . The covered entry way was described using heavy timber , roofed , and enchanced by honey locust and the flag poles . Mr . Taube asked if there were any questions . Mr . May inquired , referring to the first floor plan , if the only • entrance is the one shown . Mr . Taube said that that was not so and proceeded to describe the entrance patterns . Mr . Mazza wondered if the game tables and lounge and reception area were arranged as a unit . Mr . LiVigne stated that the reception area is separated from the lounge area which is a more functional design than the previous approach . Planning Board - 4 - October 20 , 1981 Mrs . Grigorov stated that the greenhouse would be very nice . Chairman May asked if there were any comments from the public . Mr . David Jennings asked if there were to be any kind of food or beverages available . Mr . May responded that there was . Mr . Phillip .Freedman stated that there will be a soup / sandwich / salad bar , health drinks and alcoholic beverages , just as described at all the other hearings . Mrs . Grigorov inquired if the glass area is such that people can watch the games . Mr . Taube stated that that was correct - - on the first floor , three glass walls and on the second floor , three glass balconies . Mrs . Bronfenbrenner stated that because of the amount of parking , she could visualize people coming over from Ide ' s Bowling Lanes . Mr . LiVigne rioted that that is why they oriented the building in the direction they did . Mr . Taube inquired if pending approval of this proposal the process would then be to work with Larry Fabbroni and Lew Cartee on the building permit process . 1V1r . May stated that that was correct , however , if there were any changes of a substantial nature , they would have to come back to the Planning Board , Mr . Taube stated that he wanted to be able to work with his client as to • the two - three year planting plan . Mrs . Schultz inquired as to how much lighting there is existing at this time . Mr . Taube described the existing lighting and utilizing the plans described the additional lighting . Mr . Taube noted that there will be a sign at the entrance , additional signing on one side of the building and also signage at the Mitchell Street entrance . Mr . May asked if the applicant were planning to close the driveway to Ide ' s . Mr . Taube stated that the plan is to do this . Mr . May asked Mr . Fabbroni if he had any comments . Mr . Fabbroni stated that the applicants have brought everything in that was asked for and the concept has been gone over two or three times now . He also noted that Mr „ Taube understands that he has to discuss the Code re - quirements with the Town Building Department and satisfy the building permit requirements . MOTION by Mrs . Carolyn Grigorov , seconded by Mrs . Liese Bronfenbrenner : RESOLVED , that: the Town of Ithaca Planning Board grant and hereby does grant Final Site Plan Approval for " Courtside Racquetball and Fitness Club " to be located in the former Ide ' s Roller Rink , corner Judd Falls Road and , Mitchell Street , Town of Ithaca Tax Parcel No . 6 - 62 - 1 - 5 , including Club concept and proposed addition of 1 , 800 sq . ft . to said existing building , as shown on drawings presented this date , October 20 , 1981 , by Thomas P . LiVigne , et al , and prepared by O ' Brien Taube Associates PC , and dated October 20 , 1981 , withthe understanding that the landscaping plan be accomplished within a two y year time frame from approval . PUBLIC HEARING : CONSIDERATION OF SITE PLAN APPROVAL FOR PROPOSED ADDITION OF 10 ' x 12 ' TO SALINO ELECTRIC MOTORS , 630 ELMIRA ROAD , TOWN OF ITHACA TAX PARCEL N0 , 6 - 33 - 3 - 3 , AND , CONSIDERATION OF RECOMMENDATION IN RE SAID ADDI - TION TO THE TOWN OF ITHACA ZONING BOARD OF APPEALS . Chairman May declared the Public Hearing in the above - noted matter duly opened at 8 : 05 p . m . and accepted for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearings in Town Hall and the Ithaca Journal on October 13 , 1981 , and October 15 , 1981 , respectively . With the Board members having received with their Agenda the entire file on the premises , including the application for building permit , plot plans ( 2 ) showing previous addition and the proposed addition , Planning Board Minutes of April 6 , 1976 , and also having before them the completed Environmental Assessment Form ( EAF - * Short Form ) , as reviewed by Mr . Fabbroni , Mr . Fabbroni proceeded to describe the request from Mr . Salino now before the Board . Mr . FrCLbbroni stated that the requested addition is for a washing area that Mr . Salino needs and would like to have . Mr . Fabbroni pointed out that this addition requires Zoning Board of Appeals action . Mr . Fabbroni stated that Mr . Salino is presently doing his washing down • of items on the ground now on a slab on which he proposes the addition so he can be indoors . Mr . Fabbroni noted that Mancini ' s open land is adjacent . Mr . Fabbroni described the topography in the area , describing a steep drop - off as well as a power line that runs perpendicular to the road . Mr . Fabbroni commented that this proposal is really not a complicated thing . He noted that the access is on the other : side - of the building . He commented also that this proposal haT . t ? ldo with the interior workings of the building . Mr . Fabbroni stated that the Zoning Board of Appeals is , tomorrow night , October 21 , considering the side yard issue and requested variance since the side yard is 12 ' instead of 201 . He noted that the Zoning Board will be looking for some sort of recommendation from the Planning Board . Mr . Fabbroni pointed out that Mr . Salino is surrounded like a mountain in the middle of an oasis and he has had a valid type of a basis there for both the addition and the variance . Mr . Fabbroni stated that he had presumed that Mr . Salino would be here tonight , however he is not in the best of health . Mr . Fabbroni noted again that the land drops off 15 ' or 20 ' at least and the adjacent property is some 15 ' or 20 ' lower . Mr . Fabbroni :Mated that it is gravelly soil so there is no drainage problem , any water being absorbed well . Mr . Baker stated that he would agree with Mr . Fabbroni ' s description of • the property in question and its various aspects . were Chairman May asked if there / anyone who wished to speak . to this matter . No one spoke . Chairman May asked if there were any comments from the Board . Mrs . Schultz asked if Mr . Salino was - planning to heat the addition . Mr . Cartee stated that he was , in a way , since there is an existing window that Planning Board - 6 - October 20 , 1981 he can open which will let heat through from the main building . Mr . Cartee stated that Mr . Salino repairs lawnmowers , etc . , and he presently washes them down on the slab which is in place in the outdoors . Mr . Baker commented that there are several trees and it is very hard to see his building at all . Mr . May agreed that from a neighbor ' s standpoint , there would be no detriment . Turning to the EAF , as presented , Mr . May noted that all questions had been answered in the negative and Mr . Fabbroni , as reviewer , had recommended that a negative declaration of environmental impact be rendered by the Board . Mr . May asked if there were any comments ; there were none . MOTION by Mr . Montgomery May , seconded by Mr . . James Baker : RESOLVED , that the .' Town of Ithaca Planning Board , acting as lead agency in the review of the proposed 10 ' x 12 ' addition to Salino Electric Motors , 630 Elmira Road , '.Gown of Ithaca Tax Parcel No . 6 - 33 - 3 - 3 , approve and hereby does approve the Environmental Assessment Form as completed ; and FURTHER RESOLVED , that pursuant to the State Environmental Quality Review Act , Part 617 , this action is classified as Unlisted ; and FURTHER RESOLVED , that the Town of Ithaca Planning Board has determined from the Environmental Assessment Form and all pertinent information that the above -mentioned action will not significantly impact the environment and , • therefore , will not require further environmental review . Carolyn Grigorov : RESOLVED , that the Town of Ithaca Planning Board grant and hereby does grant Site Plan Approval for proposed addition of 10 ' x 12 ' to Salino Elec - tric Motors , 630 Elmira Road , Town of Ithaca Tax Parcel No . 6 - 33 - 3 - 3 , as shown on plot plan submitted by Mr . Joseph Salino , Owner , and reviewed by said Planning Board this date , October 20 , 1981 , pending the approval of the Town of Ithaca Zoning Board of Appeals of a requested side yard variance to permit the construction of such addition . There being no further discussion , the Chair called for a vote . Aye - May , Schultz , Baker , Grigorov , Bronfenbrenner . Nay - None . Abstain - Mazza ( conflict of interest ) . • The MOTION was declared to be carried . Chairman May declared the Public Hearing in re Salino Electric Motors duly closed at 8 : 17 p . m . SIGN REVIEW BOARD ( PLANNING BOARD ) - CONSIDERATION OF SIGNAGE FOR BELL ' S CONVENIENCE FOODS , (314 ELMIRA ROAD , TOWN OF ITHACA TAX PARCEL NO . 6 - 33 - 3 - 2 . 4 • Planning Board - 7 - October 20 , 1981 Neither Mr . nor Mrs . Bell appeared to discuss this matter with the Planning Board . ha.ving been notified by mail of this Agenda item . Mr . Cartee stated that inasmuch as this is the second time on the Agenda and , as before , the Bells are not here , he would request that the Board take some action , negative or affirmative , so that we can proceed with the matter . Chairman May stated that he agreed . Mr . May stated that he had a little difficulty sorting it all out and asked if the Board members had gone out to the site . All members present stated that they :had . Mr . May stated that he thought the Board really does not have jurisdiction to approve the amount of signage Mrs . Schultz stated that she could not tell just what was sign in the window and what was the back of a cabinet or stack of boxes that you could see through the window . Mrs . Schultz stated that the Bells should be informed of the Sign Law . Mr . Cartee stated that they had been sent at least two , or more , copies of the Sign Law . Mrs . Schultz stated that it is very confusing as to what you are looking at . Mrs . Grigorov stated that she did think he had a problem with lights inside the building as to when the store is actually open . Mr . Mazza said that he agreed with both ladies . MOTION by Mr . Montgomery May , seconded by Mr . James Baker : RESOLVED , that the Town of Ithaca Planning Board , in its capacity as the Sign Review Board , is in favor of the establishment known as Bell ' s Convenience Foods , 614 Elmira Road , Town of Ithaca Tax Parcel No . 6 - 33 - 3 - 2 . 4 , • Thomas G . Bell and Martha Bell , Owners , meeting the signage requirements of the Town of Ithaca Sign Law as to size of signs , number of signs , and total square footage of signs , with the general recommendation that , within that framework , the exception of the neon signs as to height be included . There being no further discussion , the Chair called for a vote . Aye - May , Schultz , Baker , Grigorov , Bronfenbrenner , Mazza . Nay - None . The MOTION was declared to be carried unanimously . PRESENTATION - RURAL REHABILITATION : MRS . BECKY BILDERBACK ( E . O . C . ) , " BETTER HOUSING FOR TOMPKINS COUNTY INC . " At 8 : 30 p . m . , Chairman May welcomed Mrs . Bilderback to the Meeting of the Planning Board and thanked her for coming . Mrs . Bilderback stated that " Better Housing for Tompkins County , Inc . " is formed out of the Economic Opportunity Corporation ( E . O . C . ) . She stated that they applied for the rural preservation combination funds which was a new New York State program last winter . She described the program as requir - ing that it be a non - profit private corporation on which no public officials may sit which , therefore , eliminated E . O . C . , and so " Better Housing for Tompkins County , Inc . " was formed out of E . O . C . She stated that they are Otied as closely as possible to E . O . C . with 50% of the officers from the E . O . C . Board . She noted that it will be a separate corporation . Mrs . Bilderback: described the current involvement with E . O . C . housing programs such . as " we! atherization " , " CHORES " , " Section 8 " which is an existing program of rental assistance and under which 1.8 units of modern rehab is taking place , and which involves the upgrading of units through Planning Board - 8 - October 20 , 1981 guaranteed higher rents to guarantee the rehab work . She noted that there is some of this in the City of Ithaca and the remainder in the County . She stated that it is technical assistance to homeowners , similar to INHS ( Ithaca Neighborhood Housing Service ) . She described the program as co - ordinated rehabilitation - planning , cost estimating , selecting contractors , monitoring work , financial planning , trying to get loans for people . She noted that it is co - ordinated with any existing programs in order to stretch the money people do have . She stated that there is NO money for the actual work - - the program is strictly adminis - tration and planning and really is stretching the homeowners money that they have however they got it . She commented that there are a fair number of people that need to do such - and - such but do not know how to go about it . She stated that " Better Housing " does expect to get ARC ( Appalachian Regional Commission ) funds to help with site development , drainage , sewerage . Mrs . Bilderback stated that to qualify for technical assistance , one must live within our area of Tompkins County outside the City , Cayuga Heights , and the northeast tract , therefore , it includes the south , west , and east part of the Town of Ithaca . She stated that the program is basically rural in nature . She stated that income -wise, the requirements are 90% of the local median income for a family of four which is roughly $ 17 , 000 . 00 . Mrs . Bilderback spoke of the program in the future involving housing work of any definition - - renovating , developing , managing , and working with Villages or Towns that get CD (_Community Development ) money . Mr . Fabbroni stated that he was not sure what was meant by " 90% of • median income " , and Mrs . Bilderback said it was those below that 907o and includes all sources of income . Mrs . Bilderback repeated that this program was for technical advice . Mr . May asked if Mrs . Bilderback had any literature on the " Better Housing " program . Mrs . Bilderback replied , not yet - - they are making it up presently . Chairman May thanked Mrs . Bilderback. for her presentation and asked that she forward the literature to the Secretary upon completion . REPORT BY LAWRENCE FABBRONI , TOWN ENGINEER , IN RE EAST ITHACA CIRCULATION STUDY , Mr . Fabbroni stated that he was most pleased to have this opportunity to speak on the East Ithaca Circulation Study to the Planning Board and be able to relate the background and history of the development of this report . With each of the Board members having received a copy of the " Executive Summary " of the Report prior to this discussion , Mr . Fabbroni proceeded : He stated that , as we started out studying the area , we had to identify a number of things : What are our problems ; what are our sensitive areas - - Forest Home , Cornell Orchards , Plantations , Pine Tree Road , Equine Research , etc . ; - - what are our basic land uses ; what zoning laws exist in the basic area ; what the traffic was- on all the roads ; safety problems ; site problems - - • Judd Falls Road / SR366 , Forest Home , Community Corners , Warren Road ; the existing transit in the area . He said this identification was part of the basic inputs into the whole objective of trying to make localized improvements . He stated that this project is an outgrowth from the unsuccessful efforts of the County as to the " loop road " of five years ago where many houses were to be impacted , the Cornell Golf Course would have been impacted , and so on . Planning Board - 9 - October 20 , 1981 r Mr . Fabbroni commented that that whole process left somewhat of a sour taste in people ' s mouth which , he thought , we are still seeing affecting this recent Oproject . Mr . Fabbroni stated that the Committee now said - - let us look at our local roads and what minimal additions there could be provided for future traffic , and so , at that . point we began to look at what the existing traffic was , utilized traffic data over five years from intersections and the area in general . He stated that the Village " corners " was a problem ; there were not a whole lot of options for Forest Home since Cornell closed the Campus for pedestrian reasons , and so on . Mr . Fabbroni , using maps , stated that , as a Committee starting to look at more specifics , they began with the Pine Tree Road area through a process as follows ::. 1 . None of the original alternatives ( the County plan of several years ago ) was viable . 2 . Many different. alternatives were . considered that took private property . 3 . It was noted that Pine Tree Road was developed on . both sides ; Dr . Baldwin ' s land and its significance was noted ; much private property involved ; the Cornell sheep grazing area had to be considered . Mr . Fabbroni stated that five or six alternatives were considered which eventually led to the conclusion that Pine Tree Road , with its existing traffic and with the filling in of sites presently undeveloped , would be sufficient , as well as Honness Lane , to be utilized as described in the Report . Mr . Fabbroni noted with emphasis that heavy truck traffic is a problem , but this • has to be addressed somehow in a regional concept . Mr . Fabbroni spoke of the traffic to Cornell University and back . He noted that Judd Falls Road carries 7 , 000 to 8 , 000 vehicles a day and commented that it was built as a cow path really . He stated that it has a useful life of about five to six years to go and noted that it is close to its limit already . Again utilizing mapping , Mr . Fabbroni stated that the 1968 Town of Ithaca Map indicated a proposed road alternative through Ellis Hollow properties and Page Book Bindery , but in spite of that delineation , they did develop that property . with that road on the map and openly discussed . He described that as an alternative to get people to the East Hill Plaza . At this point , the Secretary assisted Mr . Fabbroni with the mapping display , thus , notes were not taken . It may be stated that Mr . Fabbroni spoke of . the whole Study as it involves the Town of Ithaca , Cornell University , private citizens , and the optimum movement of traffic at the least impact and cost . Mr . Fabbroni emphasized the care and expertise that was involved ; the positive juxtaposing; of various entities involved , and the reasoned approach to all facets . Mrs . Grigorov commented that up until this moment she really did not fully understand the improvements proposed and she thanked Mr . Fabbroni for his in - depth recitation and ability to place the proposals clearly before the • Board , Chairman May concurred , as did the other Board members , and asked Mr .
