HomeMy WebLinkAboutPB Minutes 1978-09-05 1 TOWN OF ITHACA PLANNING BOARD SEPTEMBER 5 , 1978 The Town of Ithaca Planning Board met in regular session on Tuesday , September 5 , 1978 , in Town Hall , 126 East Seneca Street ( second floor ) , Ithaca , New York , at 7 : 30 p . m . PRESENT : Chairman Liese Bronfenbrenner , Bernard Stanton , Montgomery May , Jonathan Bradley , Carolyn Grigorov , Patrick Mackesey , Lawrence P . The Board members and all those present joined in congratulations to Mr . Fabbroni on the birth of his son , Lawrence John Fabbroni . REPORT OF THE BUILDING INSPECTOR Mr . Fabbroni reported that Building Permits were issued in the month of June , 1978 , for 12 additions or accessory buildings and one one - family home for a total of $ 75 , 000 worth of improvements , as compared to June of 1977 where permits were issued for 3 one - family homes , 2 two - family homes , and 8 accessory buildings for a total of $ 203 , 700 worth of improvements . Mr . Fabbroni reported that Building Permits were issued in the month of July , 1978 , for one one - family home , one four - family home , 13 accessory structures , and one minor addition ( a greenhouse ) for a total of $ 210 , 457 worth of improvements , as compared to July of 1977 where permits were issued for 3 one - family homes , one two - family home , and 5 additions or accessory structures for a total of $ 185 , 650 worth of improvements . Mr . Fabbroni reported that Building Permits were issued in the month of August , 1978 , for 4 one - family homes , 8 additions , and one light industrial structure for a total of $ 145 , 516 worth of improvements , as compared to August of 1977 where permits were issued for 3 one - family homes , one commercial structure , and 5 additions or accessory structures for a total of $ 830 , 144 worth of improvements . Mr . Fabbroni stated that this year is running pretty much behind last year - - a lot less new single family homes and more additions . REPORT OF THE TOWN ENGINEER Mr . Fabbroni reported that the primary project is , of course , the five - area sewer extensions . Mr . Fabbroni reported that the sewer is complete , with the exception of clean - up , on Elm Street , being 3 / 4 of a mile of improvement . Mr . Fabbroni reported that sewer and water are complete in Glenside Planning Board 72 - September 5 , 1978 and serves the whole Glenside community . He noted that the sewer has not ® been officially accepted as yet . Mr . Fabbroni reported that the sewer is complete , but not officially accepted , on Coddington Road south of Troy Road . Mr . Fabbroni reported that the sewer is complete on Slaterville Road with the exception of the pump station and forcemain . Mr . Fabbroni reported that roughly 1 / 3 to 1 / 2 of the sewer is com- pleted in Forest Home . He stated that construction is going on right now . Referring to both creeks in Forest Home , he stated that the creek crossings and pumping stations are one - half complete . He noted that by the first of October the sewer should be laid with the pump stations going in around the first of November . Mr . Fabbroni commented that the weather is co - operating very nicely . Mr . Fabbroni reported that , aside from the five - area sewer extensions , we are about 3 / 4 complete on the painting of the Christopher Circle tank . Mr . Fabbroni reported that the paving program is just about completed for this year . He noted that there was a lot more oiling and stoning done this year . Mr . Fabbroni reported that the Town is hoping to build a salt shed for salt storage at the Town Highway Facility this fall . ® Mr . Fabbroni reported that park construction is still coming up this year with the bikeway and Northview Road West park being worked on . Mr . Fabbroni commented in regard to the $ 1 , 000 , 000 sewer project , there has been a net so far of only $ 10 , 000 in change orders . REPORT OF THE PLANNING BOARD CHAIRMAN Mrs . Bronfenbrenner passed around to the Board a letter to Mr . Evan Monkemeyer from Mr . Fabbroni , dated July 27 , 1978 , in reference to his proposed Oak Ridge cluster development , setting forth 12 requirements for further review of this proposal by the Planning Board . Mrs . Bronfenbrenner announced that Mr . Monkemeyer is not ready at this point to meet with the Board as yet but is in hopes of meeting with the Board in October . Mrs . Bronfenbrenner led a brief discussion of the Town ' s Subdivision Regulations and asked the members for their comments as soon as possible . APPLICATIONS FOR SIGN PERMIT - - EAST HILL PLAZA . Mr . Fabbroni stated that three applications for sign permit had been submitted for a new location in the East Hill Plaza on what was formerly the FBC store , as follows : 1 . Aquarium Pet Supplies - 2 ' x 12 ' . q Pp 2 . Nautilus - 1 ' x 12 ' 3 . A relocation of the Roy ' s Bar -B - Que sign , 2 ' x 12 ' , to said new location . Mr . Fabbroni stated that the three signs all meet the requirements of Planning Board - 3 - September 5 , 1978 the Sign Ordinance insofar as being no more than the lineal front footage ® of the portion of the building they are to be placed upon . MOTION by Mr . Bernard Stanton , seconded by Mr . Montgomery May : RESOLVED , that -. the Town of Ithaca Planning Board recommend and hereby does recommend to the Town Board approval of the three signs for the East Hill Plaza as presented this date , September 5 , 1978 , for Aquarium Pet Supplies , Nautilus , and Roy ' s Bar - B - Que . There being no further discussion , the Chair called for a vote . Aye - Bronfenbrenner , Stanton , May , Bradley , Grigorov , Mackesey . Nay - None . The MOTION was declared to be carried unanimously . Mr . Fabbroni reported that St . Catherine of Siena Church in the Northeast area of the Town , would like to hang a hanging sign under their approved sign ; it would be a changeable message sign . He stated that it is generally the same format for three continuous weeks a year . Mr . Fabbroni stated that this is not in compliance because it is in a residential zone , the allowed size being one square foot . He noted that the original sign there has a variance . Mr . Fabbroni commented that there was never really any provision made for such signs , applications being taken on an individual by individual case . Mr . Fabbroni stated that the sign is located at the end of their driveway and can be seen from Hanshaw ® Road . Mr . Fabbroni noted that the previous application was denied by the Town Board but the Church did not make it clear that it was for three weeks only . MOTION by Mr . Bernard Stanton , seconded by Mr . Patrick Mackesey : RESOLVED , that the Town of Ithaca Planning Board recommend and hereby does recommend to the Town Board that a variance be granted by said Town Board for a hanging sign to be placed upon the existing sign at St . Catherine of Siena Church , for a three - week period . There being no further discussion , the Chair called for a vote . Aye - Bronfenbrenner , Stanton , May , Bradley , Grigorov , Mac:kesey . Nay - None . The MOTION was declared to be carried unanimously . Mr . Fabbroni presented an application for sign permit for the Texaco Self - Service Gas Station on the corner of Judd Falls Road and Ellis Hollow Road . He stated that the Texaco sign is 4 ' x 7 ' = 28 sq . ft . and is a free - standing sign . Mr . Fabbroni stated that there are other signs advertising the price of basically four different types of gasoline , two of which would be on each side of this sign , which they would propose to have at each driveway entrance . Mr . Fabbroni noted that they can have up to 100 sq . ft . on a free - standing sign , however , they would prefer to have the one free - standing Texaco sign and these two signs that sit on the grass at the entrance , rather than all on one free standing sign . Mr . Fabbroni stated that the two little signs measure 5 - 1 / 2 ' x 3 - 3 / 4 ' for a total of 42 sq . ft . , plus the 28 sq . ft . which equals 70 sq . ft . of signage . Planning Board - 4 - September 5 , 1978 Mr . Fabbroni noted that both drives are in and out , with one located ® opposite -rPine Tree Road . Mr . Fabbroni stated that there is another sign which is required by law stating that patrons must shut off their motors and no smoking . Mr . May stated that it was his opinion that the fixed sign without the movable sign looks far better . Mr . Robert Andree , Jr . , described what the free - standing sign would look like with Texaco and prices on it . He stated that the two proposed little signs are movable . Mr . Robert Andree , Sr . , stated that they have been to symposiums and are working with a man in Syracuse and that they want to keep the whole thing simple . The Board set aside further discussion of this matter until later in the meeting . PUBLIC HEARING : CONSIDERATION OF AMENDMENT TO PHASE I APPROVAL PREVIOUSLY GRANTED FOR EASTWOOD COMMONS , NORBERT S:CHICKEL , TO INCLUDE ONE ADDITIONAL BUILDING , TOWN OF ITHACA TAX PARCEL 6 - 60 . 1 - 1 - 45 . Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter duly opened at 8 : 00 p . m . and accepted for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on August 29 , 1978 , and August 31 , 1978 , respectively . Mr . Norbert Schickel appeared before the Board and indicated on the plans the Phase I area completed . The first building of Phase 2• 1.was indicated . Mr . Schickel commented that he was somewhat confused - - he will be back next month requesting approval of all of Phase 2 . Mr . Schickel stated that the building under discussion contains three units instead of four . Mr . Schickel stated that he wanted this building to be started for construction now and would like to add it as a part of Phase I . He noted that it has all been sold . Mr . Fabbroni stated that if the building is built according to plans , he has no problems with road , drainage , etc . He noted that it fits into Phase I . Mr . Fabbroni stated that sewer and water would have to be approved at construction . Chairman Bronfenbrenner asked for comments from either the Board or the public . There was none . The Chair declared the Public Hearing in the above - noted matter duly closed at 8 : 05 p . m . MOTION by Mrs . Liese Bronfenbrenner , seconded by Mr . Montgomery May : to RESOLVED , that the Town of Ithaca Planning Board grant and hereby does grant approval for this three - unit building as an addition to Phase I , previously approved , of Eastwood Commons , Norbert Schickel , Developer , to be known as Phase I ( a ) , Town of Ithaca Tax Parcel No . 6 - 60 . 1 - 1 - 45 . There being no further discussion , the Chair called for a vote . Planning Board - 5 - September 5 , 1978 Aye - Bronfenbrenner , Stanton , May , Bradley , Grigorov , Mackesey . Nay - None . The MOTION was declared to be carried unanimously . APPLICATION FOR SIGN PERMIT - TEXACO SELF - SERVICE GAS STATION , CORNER JUDD FALLS ROAD AND ELLIS HOLLOW ROAD . Chairman Bronfenbrenner stated that the Board would now resume consideration of the Application for Sign Permit as presented by Messrs . Andree . MOTION by Mr . Montgomery May , seconded by Mr . Patrick Mackesey : RESOLVED , that the Town of Ithaca Planning Board recommend and hereby does recommend to the Town Board that a variance be granted by said Town Board to allow for three signs , as presented this date , at the Texaco Self - Service Gas Station at the corner of Judd Falls Road and Ellis Hollow Road , being one free - standing sign and two portable signs . There being no further discussion , the Chair called for a vote . Aye - Bronfenbrenner , Stanton , May , Bradley , Grigorov , Mackesey . Nay - None . The MOTION was declared to be carried unanimously . ® Consideration of this matter ended at 8 : 12 p . m . REVIEW AND DISCUSSION OF THOSE SECTIONS OF THE PROPOSED ZONING ORDINANCE THAT HAVE BEEN COMPLETED BY THE CODES AND ORDINANCES COMMITTEE . Mrs . Bronfenbrenner led a brief discussion of the sections of the Zoning Ordinance revision as have been completed so far - - Mobile Home Residence Zone , Agricultural Zone , Conservation Area , Institutional Use Zone , Special Flood Hazard Area , Mrs . Bronfenbrenner urged the Planning Board members to review these sections , copies having been distributed , in depth , and to be prepared to discuss any changes or additions they may wish to see . PUBLIC HEARING : PRELIMINARY SUBDIVISION HEARING FOR PROPOSED SUBDIVISION ON RIDGECREST ROAD , BACK- LOT , LAGRAND CHASE , TOWN OF ITHACA TAX PARCEL 6 - 45 - 1 - 2 . 2 . At 8 : 30 p . m . Chairman Bronfenbrenner declared the Public Hearing in the above - noted matter open , and presented for the record the Clerk ' s Affidavit of Posting and Publication of the Notice of Public Hearing in Town Hall and the Ithaca Journal on August 29 , 1978 , and August 31 , 1978 , respectively . Mrs . Bronfenbrenner announced that Mr . Chase was not ready to present his subdivision proposal at this time , since Mr . Thomas G . Miller does not have the cost figures ready and also since his son had a baby over the weekend . Mr . Fabbroni stated that a letter went out to the landowners in the area from Mr . Randy Chase , dated August 2 , 1978 , stating that some development might occur on this land . Planning Board - 6 - September 5 , 1978 Mr . Fabbroni presented for the record a Petition signed by 42 residents of the Ridgecrest Road area , reading as follows : " August 23 , 1978 Mr . Noel Desch Supervisor , Town of Ithaca 132 Updike Road Ithaca , New York 14850 Dear Mr . Desch : We , the residents of Ridgecrest Road in the Town of Ithaca , are con - cerned about a recent letter from Randy Chase regarding the develop - ment of the Nellie F . Chase Estate . We have enclosed ' a copy of this letter from Mr . Chase to the Ridgecrest Road residents and are con - cerned about the development options included therein . As of August 22 , 1978 , they have proceeded to clear the Right of Way from Ridgecrest Road to the property of Nellie F . Chase per attached map . Although the options seem to be straight forward in Mr . Chase ' s letter we find that board members seem to be unaware of any develop - ment plans in this area . We are not opposed to development and realize the Town is inevitably ® going to grow , however , we feel that development can be done in such a way that will not be devastating to property values and neighbor - hoods and be a definite asset to the Town . We the undersigned thank you in advance for the anticipated written reply we know we can expect from you in this matter . " The attached letter read as follows : " MEMO TO : Ridgecrest Road Residents DATE : August 2 , 1978 RE : Nellie F . Chase Estate As we proceed to settle the estate of Nellie F . Chase in regard to the land west of Ridgecrest Road ( see enclosure ) , we are in the process of examining its various usages and the options available to us . Naturally we are seriously considering the land as a site for middle income housing . Its accessibility to public utilities , the tall pines , its convenience to downtown Ithaca , Morse Chain , NCR , and Ithaca College lead us to believe that it would be an attractive place to live . Is In addition there has been keen interest in the land ' s potential as a mobile home park . Once again , the features and convenience of the pro - perty make this a viable alternative . It has been suggested however , that a number of Ridgecrest Road home - owners would like to purchase individual sections of the land for Planning Board - 7 - September 5 , 1978 investment and recreational purposes . ® If you have any interest in acquiring a portion of the land , please contact me as soon as possible . I will be more than happy to discuss the matter at your convenience . Thank you . Sincerely , ( sgd . ) Randy Chase " Mr . Fabbroni stated that a mobile home park has never been dis - cussed with the staff or member of the Town Board . He stated that to zone a mobile home park in the Town of Ithaca would require a major change in the Zoning Ordinance and a major change in the zoning map . He stated that an owner can apply for any change he wishes , however , such a change would involve a minimum of six months of public hearings . He stated that people in this area are very sensitive to the matter of zoning in the area . Mr . Fabbroni stated that the subject matter of tonight ' s meeting would have been the typical subdivision on fairly large lots , as far as he knew . Mrs . Bronfenbrenner asked those present what type of development they would approve of in the area . ® Mr . Gerry Grasso , 160 Ridgecrest Road , stated that the residents were s basically concerned about the mobile home park . He stated that they are not opposed to any kind of development , such as 4 or 5 lots with middle income type houses . He stated that they are opposed to a mobile home park of any size . Mrs . Bronfenbrenner stated that a mobile home park is not permitted by the present zoning ordinance . Mr . Roger Smith , 113 Ridgecrest Road , asked if there were any area , particularly in the south side , zoned for mobile homes , or in the pro - posed ordinance revision . Mrs . Bronfenbrenner replied that it is not permitted under the pre - sent zoning ordinance and has not been drawn on any map for the proposed ordinance revision . Mr . Bill Brown , 139 Ridgecrest Road , asked what the criteria are for a variance . Mr . Fabbroni replied that this would really be a rezoning and not a variance . He noted that one of the many considerations would be the compatibility of a mobile home park with the area . Mr . Brown wondered what would be compatible with a mobile home park . Mr . Fabbroni felt that it would certainly not be appropriate right next door to a private home . He discussed single family zones , multi - family Is zones and a mobile home park in terms of restrictiveness . There followed a discussion of the " cluster " concept of subdivision development . Planning Board - 8 - September 5 , 1978 Mr . Gerry Grasso asked about zoning for apartments . The regulations under the present ordinance were described . Mr . Mark Brockway , 166 Ridgecrest Road , described the existence of statutes that prohibit the discrimination against mobile home parks . Mrs . Bronfenbrenner commented that it is true that there isosuch __ prohibition to a certain extent , although there are some court cases to the contrary . Mr . Frank Sharp , 162 Ridgecrest Road , posed the question that suppose area X , Y , and Z were under consideration for a mobile home park , would there then be extensive impact study done ? Mr . Fabbroni described the SEQR requirements . Mr . Bill Brown stated that the rumour was flowing that there was going to be a fairly large - sized mobile home park put in there . He asked what the proposal is thatvlr . Chase . is putting forth . Mrs . Bronfenbrenner stated that the Board does not have the proposal before them tonight . Mr . Fabbroni stated that he was of the opinion that the proposal would be a typical subdivision for one - or two - family homes . He stated that the Chases do not have enough information from the field work as to rock , etc . He stated that any clearing has been to allow the study of the topography . Mrs . Jean Brockway , 166 Ridgecrest Road , stated that she talked to Randy Chase and he is very interested in a mobile home park . She stated that Mr . Chase has stated that he has " certain assurances " that a rezoning would be no problem . There followed a general discussion of zoning in the Town of Ithaca . The matter was set aside awaiting further word from Mr . Lagrand Chase . Bronfenbrenner has informed me that the Oak Ridge cluster development will be placed on the agenda for the Septem ber 5 Planning Board meeting . In accordance with requirements discussed at the April 4 , 1978 meeting of the Planning Board , the following will be re - quired for further productive review of the Oak Ridge Cluster Development : ( 1 ) Contour intervals of not more than 5 feet should be shown by detailed survey . ( 2 ) Scale of maps presented shall be no smaller than 100 ' = 1 " ( 50 ' = 1 " would make the map less crowded and more readable ) . ( 3 ) Layout of clusters should reflect the topography and generally not be located in areas exceeding 10 % slope . Where terrain exceeds 10 % , detailed drawings of present and proposed contours at 2 foot intervals shall be presented for each building site . ` The need for retaining walls and storm sewers can only be determined at this level of detail . We have enclosed a copy of this letter from Mr . Chase to the Ridgecrest Road residents and are concerned about the development options included therein . As of August . 22 , 1978 , they have proceeded to clear the Right of Way from Ridgecrest Road to the property of Nellie F . Chase estate per attached map . Although the options seem to be straight forward in . Mr . Chase ' s letter we find that board members • seem to be unaware of any development plans in this area .
