Y . , at 7 : 30 p . m . PRESENT : Chairman Barbara Holcomb , Richard Black , Niaurice Harris , Daniel Baker , Liese Bronfenbrenner , Sam Slack , Lawrence Fabbroni ( Planning Engineer/Building Inspector ) , Robert Bonnell ( Assistant to the Engineer ) . ALSO PRESENT : Cathy Valentino ( Town Councilwoman ) , Beverly Livesay ( County Board Representative ) , T*lillis S . Hilker , E . L . Hollister Mrs . E . L . Hollister , 1 . L . Tompkins , Mrs . M . L . Tompkins , Dr . Frank Flacco , Alfred Eddy , Bob Wright , Mary Currier ( WICB -TV ) , Chairman Holcomb declared the meeting open at 7 : 38 p . m . APPROVAL OF MINUTES MOTION by Mr . Sam Slack , seconded by Mr . Richard Black : RESOLVED , that the Planning Board Minutes of January 20 , 1976 , be approved with the correction that the one sentence typed twice be deleted . • Aye - Holcomb , Black , Harris , Baker , Bronfenbrenner , Slack . Nay - None . The MOTION was declared to he carried unanimously . REPORT OF THE BUILDING INSPECTOR Mr . Fabbroni reported that he issued 3 single family building permits and 3 building permits for additions in the month of March 1976 for a total of $ 121 , 675 . 00 as compared to 3 single family permits and 3 additions in March 1975 for a total of $ 112 , 500 . 00 , He noted that 1976 has been generally slower than last year over the last three months . Mr . Fabbroni reported that he has served notice on Beacon Hills and has set up a procedure through his letter to them by which he as building inspector will proceed . He stated that his first inspection will take place on April 5th and he will report on that inspection to the Town Board on April 12th . He stated that it may become necessary to require the removal of some structures and the repair of others which , if not repaired , will have to be removed . He noted that he is requiring the completion of required repairs within 60 days and remo ® val within 120 days . He stated that the services of two experts in the fields of architecture , engineering or building will be utilized ifrepairs are not completed . He stated that an expert must also be . provided by the landowner and that the findings of his inspection so reported will be submitted to the local Supreme Court for a ruling as to what should be done . He stated that he has spelled out the pro0 cedure by which to resolve this long - standing problem . It is clear that Mr . Erdman is still the landowner , and that the Sibley Corporation may be involved in any future development . Town of Ithaca Planning Board - 2 - April 6 , 1976 REPORT OF THE PLANNING ENGINEER • Mr . Fabbroni reported that the major thing that has become clear is that the sewer project is in very bad shape , He stated that the probability of 7 % interest precludes it being done with the existing monies available . The bonding of the existing sewer debt is a problem if the rate is over 7 - 1 / 4 % . An option is to seek Federal Funding but the Town must get on the program this year and the outleok for that is not optimistic . He stated that he is pursuing this through Gary Lee and many letters to the Department of Environmental Conservation . Mr . Fabbroni presented a request in the form of a letter from Mr . Vincent Franciamone to rezone his land from R- 30 to R~ 15 . Mr . Fabbroni requested that the Planning F{ .:j �.rd consider reimbursinc' Mr . Dennis Colliton for his costs involved in the Coy Glen report which will be given to the Town . Mr . Fabbroni likened this project to the Bikeway Study . Mrs . Holcomb asked what the requested amount would be . Mr . Fabbroni stated that it is around $ 200 . 00 , Mr . Black asked if Mr . Colliton had any other reimbursement coming such as from Cornell . Mr . Fabbroni said that he did not . Mr . Fabbroni said that he thought that the Town will get a lot more than $ 200 . 00 worth out of this Study . MOTION by Mr . Richard Black , seconded by MY . Maurice Harriss • RESOLVED , that the Planning Board of the Town of Ithaca hereby authorizes a payment of $ 200 . 00 to be made to Mr . Dennis Colliton for expenses incurred in the research , study and printing of his Coy Glen study , two copies of which will be given to the Town of Ithaca by Mr . Colliton . There being no further discussion , the Ciiair called for a vote . Aye - Holcomb , Black , Harris , Baker , Bronfenbrenner , Slack , Nay - None . The MOTION was declared to be carried unanimously . The Board expressed their appreciation of a job®well -done by Mr . Colliton , PROPOSED MEETING DATE - PLANNING BOARD Mr . Fabbroni presented a proposed Agenda for the Planning Board and requested that it meet on April 20 , 1976 . The proposed Agenda was accepted , but because of time committments by some of the members , the meeting date was set for Wednesday , April 21 , 1976 . PUBLIC HEARING : CONSIDERATION OF PRELIMINARY SITE PLAN APPROVAL FOR SNYDER HILL ROAD SUBDIVISION m HILKER . • Mrs . Holcomb declared the Public Hearing duly opened at 8 : 20 p . m . and presented for the record the Clerk ' s Affidavit of Posting and Publication of same . Mrs . Holcomb noted that this proposed subdivision is the piece of land that is in Eastern Heights on the upper side of Snyder Hill Road . Town of Ithaca Planning Board - 3 - April 6 , 1976 She commented that the 5 - acre proposed park that has been outstanding • for many years is in this subdivision area . Mr . Hilker stated that his proposed subdivision contains 22 . 2 acres more or less . Mr . Hilker presented a map of the Eastern Heights Subdivision dated April 6 , 1967 , Mr . Hilker stated that the subdivi - sion will contain 43 lots and will be developed in two phases - 21 in phase 1 and 22 in phase 2 . Mr . Hilker stated that in relation to the 5 - acre park still not deeded to the Town , Mr . Stan Goldberg is offer - ing at this point to swap that 5 acres for 7 acres in the area under the moratorium precluding any further development ® He noted that 14 lots would then be a swap out . He stated that there will be little increase in the number of lots and traffic using Snydor Hill Road . He said that he is ultimately looking for 43 lots over about a five-year period . Mrs . Beverly Livesay commented that the area of the proposed sever acres is roughly hilly and the reason for the 5 - acre park being chosen north of Snyder Hill was that it was a flat area . Mr . Hilker stated that if the Town accepts the alternate for the originally proposed 5 - acre park on the north side of Snyder Hill Road , then Mr . Hilker proposes to develop that parcel of land on the north side of Snyder Hill Road for 43 single family dwelling _ and he will deed to the Town a parcel 2 . 2 acres in the northeast corner of this parcel ( 6 - 61 - 1 - 8 . 1 ) for parkland for this development . A water line • easement to the Hungerford Hill tank runs through this 2 . 2 - acre parcel . This is the flattest piece of land in this particular area . It would be served by a proposed road . Mr . Hilker presented a subdivision plan for Hilker Construction , Inc . for the Snyder Hili Subdivision dated March 15 , 1976 . This plan showed the proposed 2 . 2 - acre park in the northeast corner . Mr . Hilker noted that the proposed lots are all at least 15 , 000 sq . ft . and some are larger . Mr . Hilker stated that his company would like to have final approval on the first portion ( phase 1 ) and preliminary approval on the second portion ( phase 2 ) at this time and then final approval on phase 2 in about 2 years . Mr . Hilker noted that the water line is looped for each phase . Mr . Fabbroni stated that he has gone over the sewer and water plans with Mr . Hilker and they have made some modifications . He stated that at this point he could see no problems , He noted , however , that the drainage question in this area ( Eastern Heights ) is always a problem . Mr . Fabbroni stated that he has talked to Mr . Hilker some - what about cutting this drainage area off right at the road that goes up to the Hungerford Hill tank thus having the drainage brought down to Snyder Hill Road and across Snyder Hill Road to the existing ditch on the east side of Skyvue Road . This would once and for all cut off the drainage area above the proposed development in the Town of Dryden . Right now everything does back down to the one stream . The • entire Eastern Heights development is drained down to this point north of the Tudor Road park and this stream . He noted that there are problems with the ditch on the Marion land and the stream between properties on Slaterville Road , Mr . Black wondered what had happened to the diversions , Mr . Fabbroni said that they have all grown over and silted over . Mr . Fabbroni stated that the ideal solution in the long run , as this area Town of Ithaca Planning Board - 4 = April 6 , 1976 is subdivided , would be to bring things down in a balanced fashion . • That way no one drainage way would become problems . He noted that there is a block of Marion land and a block of Frandsen land that are now problems . He commented that a balanced flow down the hillside is the answer . This subdivision plan will establish the end limits to the Snyder Hill drainage area . Mr . Black suggested that it might be best to bury a small perfora� ted pipe under a swale backlot on the Town of Ithaca-Town of Dryden Line to cut off the upland drainage area . Mr . Black stated that he would suggest this type of sub®drain to keep backyards dry . Mr . Hilker commented that the northeast area of his proposed sub division has at least 101 of ground cover before you get to rock . With reference to the Eastern Heights Section II 5 � acre park area , Mrs . Holcomb stated that Mr . Slack and Dr . Lowe ( former Planning Board member ) had agreed after studying the area that the best five acres were in the northwest corner of the proposed subdivision area . Mr . Fabbroni stated that the presently proposed 2 + acre park area is the flattest land in the area to be subdivided and is adjacent to open Cornell land . Mrs . Holcomb stated that she had talked to Mr . James W . Yarnell of Campus Planning at Cornell University on this concept of using land owned by Cornell for an expanded park and he was very optimistic . Liability is the big question . A $ 1 . 00 easement or an indeterminate lease may be an answer , She felt that a proposal could be presented to the University . Mrs . Holcomb read a letter received from Mr . I . S . Goldberg , King ' s Lane Co . , P . O . Box 915 , Ithaca , dated Parch 8th , 1976 , re " Former Backner Farm , Snyder Hill Road " , as follows : " To a Town of Ithaca , 126 E . Seneca St . , Ithaca , N . Y . Dear Sir * This is in confirmation of our conversation with W . S . Hilker , president of Hilker Construction Co . Inc . , in which we have agreed to the following : A ) Upon the town of Ithaca ° s approval of Hilker ° s subdivision as generally submitted , and upon the sale of that land to Hilker , King ° : Lane Co . will deed , for park use , your request for approximately five to seven acres of land in the southeast corner of the Eastern Heights subdivision . If there are any questions , please feel free to contact me . Thank you . " Mrs . Holcomb asked for general comments from the Board as to �•7hether thisis a reasonable compromise for this area , i . e . , 7 acres . Since no comments were forthcoming , Mrs . Holcomb asked if there were a consensus that acceptance of Mr . Goldberg ' s plan together with Mr . Hilker ° s is a good way to move in developing parks in this area . The members of the Planning Board agreed that they approved of this approach . Town of Ithaca Planning Board � 5 - April 6 , 1976 Mrs . Valentino asked how the Town can make this concrete in terms of the present owners . Mr . Hilker stated that before he will even consider buying this property all encumbrances must be removed from the land . Final approval on Mr . Hilker ' s proposed land will be contingent on transfer of the parks . Mrs . Holcomb asked if the members of the Planning Board could see any problems with granting preliminary approval of Mr . Hilker ' s pro - posed subdivision as it is laid out . Mr . Slack stated that he could see no problems wth the exception of water on to Snyder Hill Road , Mr . Fabbroni said that the problem was not water on to Snyder Hill Road , it is eater down to Slaterville Road . MOTION by Mrs . Barbara Holcomb , seconded by Mrs . Liese Bronfen � brennera RESOLVED , that the Planning Board of the Town of Ithaca give and hereby does give preliminary subdivision approval to the site plan as presented by Mr . Willis S . Hilker for development of approximately 22 . 2 acres of land on Snyder Hill Road in the Eastern Eeights Sub- division . Said site plan , presented April 6 , 1976 , shows 43 R� 15 lots to be developed in two phases . Said subdivision is approved only if , prior to final subdivision approval , the Eastern Heights Corporation or their successors , will deed to the Town of Ithaca seven ( 7 ) acres more or less in the southeast corner of phase 2 of the Eastern Heights Development , thereby meeting the requirements in an alternate way for the original 5 acres required in the parcel where the Hilker Subdivi- sion is being proposed . There being no further discussion , the Chair called for a vote . Aye - Holcomb , Black , Harris , Baker , Bronfenbrenner , Slack . Nay - None . The MOTION was declared to be carried unanimously . Mrs . Holcomb informed Mr . Hilker that it will be necessary for him to secure tax parcel numbers for the proposed 43 lots and that he must acquire Health Department approvals . Mrs . Holcomb also requested that the area of the proposed park be clearly designated on the site plan prior to filial subdivision approval , Mrs . Livesay commented that it should be noted that this develop ment will add another 60 or 70 cars to Snyder Hill Road traffic and that she hoped that the Town Board is looking into this road and the hill and the walking traffic problems . The Chair declared the Public Hearing in the Hilker Subdivision 0 proposal duly closed at 9e28 p . m . PUBLIC HEARINGS CONSIDERATION OF FINAL SUBDIVISION APPROVAL FOR EDDY HILL , INC . ( FORMERLY MARSHALL FARM ) , MECKLENBURG ROAD , Mr . Bob Wright of Northeast Appraisals , Inc . was present for this public hearing and the request by Eddy Hill , Inc . for final subdivision Town of Ithaca Planning Board April 6 , 1976 approval , Mrs . Holcomb declared the Public Hearing in the above- noted mat= ter duly opened at 9 : 30 p . m . and presented for the record the Town Clerk ' s Affidavit of Posting and Publication of same . Mr . Fabbroni reviewed the past history of the Eddy Hill Subdivi - sion . The Marshall Farm originally contained over 196 . 6 acres and preliminary subdivision approval was given for four parcels - one containing 28 acres , one containing 15 acres , one containing 8 acres and the remaining parcel containing the remainder of the total original acreage . However , Mr . Fabbroni noted that the subdivision map given preliminary approval has never been filed with the County Clerk , Mr . Wright stated that the 8 - acre parcel was surveyed and deeded off ( fronting on West Haven Road ) . This survey has been filed with the County Clerk , Mr . Wright stated that the 15 - acre parcel has been set aside for Chases Roadstand , Inc . He stated that the 28 - acre parcel has been spelled out and the remainder of the land kept for farm purposes . Mr . Fabbroni stated again that at this point Eddy Hill Inc . is requesting four additional lots within the 28 - acre parcel . He noted again that the preliminary subdivision approval ( 4 parcels ) was never filed and stated his concern for utility easements for remaining land back lot from gest Haven Road , Mrs . Holcomb stated that the Planning Board would be compounding the error if it were to approve this present four- lot subdivision . Mr . Fabbroni agreed that there is an illegality here . Mrs . Holcomb stated that she would suggest that this whole area ( the 196 . 6 acre original parcel ) should be filed on a map showing the original four-parcel subdivision and the four presently proposed parcels as a further sub® division . Mr . Fabbroni said ( indicating on map ) that the sewer for the rest of the remaining acreage is going to come up a natural valley from Elm Street Extension west of Valley View Road , Mrs . Holcomb asked if Eddy Hill Inc . has ever come in with a final map with property easements shown on the map so that the Planning Board can hold an official public hearing on the whole thing which would then imply the approval including these presently proposed four lots . Mr . Fabbroni indicated the plan (map ) being submitted at this meeting is titled " Subdivision Map of Lands on West Haven Road , 4 / 1/76 , Howard R . Schlieder , L . S . " Mr . Fabbroni said as a clarification , that the Planning Board actually gave conditional final approval , but the proecures have not been carried out by Eddy Hill . He suggested that the whole area should be considered as a request for preliminary appro = val . It was generally stated that the depths of the lots seem to be too small to meet Health Department and drainage considerations . Mrs . Holcomb stated that the Planning Board requires a topo map to show water drainage . Drainage was thereupon discussed and appears to be a real problem . Mrs . Holcomb stated that the Board requires an opinion from the Health Department as to what they consider appropriate for this area and sizes of the proposed lots . The Planning Board determined that they would take no action on Town of Ithaca Planning Board - 7 - April 6 , 1976 this proposal at this time . • The Chair declared the Public Hearing closed at 9 : 47 p . m . PROPOSED ADDITION SALINO ELECTRIC MOTORS , 630 ELMIRA ROAD , Mr . Fabbroni stated that Salino Electric Motors has requested a building permit for a proposed addition to the existing building at 630 Elmira Road ® The proposed addition contains approximately 1 , 000 sq . ft . Salino Electric Motors is in a light industrial district . Mrs . Holcomb read from the Minutes of the Town of Ithaca Planning Board dated February 17 , 1970 , as follows " Mr . Peter Augustine requested preliminary approval for construc - tion of an electrical equipment repair shop in back of an existing house at 630 Elmira Road . The property is within a light industrial zone and there is no change in zoning required , It was recommended by the Board that some type of filter be pro vided to prevent air pollution from the ovens that will be used . Mr . Baker made a motion we approve this plan . she motion was seconded by Bob Christianson and unanimously passed . " and from the Minutes of the Town of Ithaca Planning Board dated March 17 , 1970 , as follows ° " Mr . Peter Augustine requested final approval for construction of an electrical equipment repair shop in back of an existing house at 630 Elmira Road . He was given preliminary approval at our February meeting with the stipulation that some type of air pollution filter be provided . All other requirements have been met . Bob Christianson made a motion to grant final approval to Mr . Augustine ° s proposal , The motion was seconded by Arnold Albrecht and unanimously passed . " Mr , Fabbroni also presented a sign application from Sal -Aug Corp . for Salino Electric M" tors dated March 26 , 1976 , together with a check for $ 7 . 50 . Mrs . Holcomb referred to an opinion of the Zoning Board of Appeals in the Bell ' s Grocery Store matter whereby they determined that a commercial use is compatible with a light industrial district . ( See Zoning Board of Appeals Minutes March 9 , 1974 ) . Mr . Fabbroni noted that the cornfield adjacent to this property is owned by Mancini . MOTION by Mr . Maurice Harris , seconded by Mr . Richard Black : RESOLVED , that the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board the approval of the pro- posed addition to Salino Electric Motors located at 630 Elmira Road , • Ithaca , N . Y . , and to be used for a repair shop . Said addition is shown on Building Permit application dated February 25 , 1976 , from Sal �Aug Corporation . There being no further discussion , the Chair called for a vote , Aye - Holcomb , Black , Barris , Baker , Bronfenbrenner , Slack . Nay - None . Town of Ithaca Planning Board - 8 - April 6 , 1976 The MOTION was declared to be carried unanimously . • The Planning Board now considered the sign application from the Sal -Aug Corp . presented earlier by Mr . Fabbroni , Mr . Robert Bonnell spoke to the matter . Mr . Bonnell stated that a sign pre -dating the Sign Ordinance is involved in this matter plus a sign modified and added to after Sign Ordinance adoption for which no permit was applied for or acquired . The sign structure is within the 100 sq . ft . limit for a free - standing sign in a business and industrial district . The sign structure appears closer than the 15 ° set -back requirement from the road right of way , but this is difficult to determine because of the company being located on the Elmira Road which is NYS Route 13 with its variable right of way and positioning of roadway within the right of way . Mr . Bonnell stated that it is definitely off the right of way however . MOTION by Mr . Sam Slack , seconded by Mr . Maurice Harris . RESOLVED , that the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board of the Town of Ithaca that the sign for Salino Electric Motors be approved as presented . There being no further discussion , the Chair called for a vote . Aye - Holcomb , Black , Harris , Baker , Bronfenbrenner , Slack . Nay - None . . The MOTION was declared to be carried unanimously . DISCUSSION OF EAST HILL SHOPPING PLAZA SIGNS , Mr . Bonnell stated that the " What ' s Your Beef " restaurant had applied for a sign permit on March 15 , 1973 , and it was denied , but the sign was erected without permit . The sign is over - sized . Mr . Bonnell stated that the " Expressions Unlimited " store sign is in place with no permit and it is over - sized . Mr . Bonnell stated that the " Rite -Aid Pharmacy " store sign is also in place with no permit and it is over- sized . Mr . Bonnell stated that the " Colorful Carpets " sign on that store is in place with no permit and it is over - sized . Mr . Bonnell stated that the " Norgetown Laundry and Dry-Cleaning " store sign is up with no permit and it is also over - sized . Mr . Bonnell stated that Mr . Stewart Knowlton , the manager of the East Hill Plaza was going to appear at this meeting to speak to these matters , but he has not come . Mr . Bonnell thought that if the applica- tions were presented in a straight forward way , the matters could come before the two Boards ( Planning and Town ) or else they could go to the Zoning Board of Appeals . Mrs . Holcomb stated that she would like to present a formal request from the Planning Board to the Town Attorney for an opinion as to the position of the Town of Ithaca Board of Appeals in the sign • ordinance review and approval process .
