Y . at 7 : 30 p . m . on Tuesday , November 11 , 1975 . PRESENT : Chairman Barbara Holcomb , Robert Christianson , Maurice Harris , Daniel Baker , Richard Black , David Martin , Sam Slack , Lawrence Fabbroni ( Planning Engineer/Building Inspector ) , Robert Bonnell (Assistant Engineer ) , ABSENT and EXCUSED : Liese Rronfenbrenner . ALSO PRESENT : Robert O ' Malley , Attorney Stanley Tsapis , William Tompkins , David Singley , Dr . Louis Munchmeyer , Mrs . Walter Mulholland , Gregory Kasprzak , Alan Goodman ( Ithaca Journal ) , Bob Lynch ( WTKO ) . The Meeting was called to order by the Chair at 7 : 3 - p . m . APPROVAL OF MINUTES MOTION by Mr . Robert Christianson , seconded by Mr . Maurice Harris : RESOLVED , that the Minutes of the Planning Board Meeting of June 17 , 1975 , be approved as submitted . There being no further discussion , the Chair called for a vote . Aye - Holcomb , Christianson , Harris , Baker , Slack . Nay - None . Abstain - Martin ( Mr . Martin was not a member of the Planning Board at that time . ) DAVID J . MARTIN , NETT MEMBER OF THE PLANNING BOARD WELCOMED Mrs . Holcomb and Mr . Christianson on behalf of the Planning Board welcomed Mr . Martin to his first meeting as a member of the Planning Board , REPORT OF BUILDING INSPECTOR Mr . Fabbroni reported that in the month of October 1975 , 5 permits were issued for neily homes and 5 permits were issued for additions to homes plus 1 commercial building permit , for a total of $ 281 , 000 . 00 , as opposed to permits for 4 new homes and 6 permits for additions for a total of $ 128 , 600 . 00 last year . Mr . Fabbroni reported that there are indications that the Beacon Hills project is in negotiations between the original developer and the mortgage holder to work out their differences . We hope that the outcome will be some action on the project . REPORT OF THE PLANNING ENGINEER Mr . Fabbroni reported that the reconstruction of Williams Glen Rd . is completed as of this week •and is now a Town road . ''here is now a new timetable for the letting of the sewer contracts Town of Ithaca Planning Board - 2 - November 11 , 1975 . which , it is hoped , will be Pebruary 1st , 1976 . Mr . Fabbroni was re - ferring to the five sewer . extensions within the Town . Ms . Susan Blumenthal will be presenting the proposed Park and Open Space Plan' at the next meeting of the Planning Board on November 25 , 1975 . Mr . Fabbroni reported that we have received a tentative approval from the State for a " safer roads and pavement marking program " . This program involves putting signs up in locations that need them and have never had signing . .Approximately $ 7 , 000 . 00 will be received for this project . Mr . ' Fabbroni introduced his new Assistant Engineer , Bob Bonnell , who has been hired initially under the CETA program . REPORT OF THE COUNTY PLANNING BOARD Mrs . Holcomb said that there is no report from the County Planning Board because they meet later in the month . Mrs . Holcomb recommended that the pattern for reporting on the County Planning Board be changed to the second meeting of the month . ROBERT W . BONNELL , NETT MEMBER OF TOTIN OF ITHACA STAFF WELCOMED rsr . Christianson , on behalf of the Planning Board , welcomed Mr . Bonnell to the Town of Ithaca staff . Mr . Fabbroni commented that Mr . Bonnell has a background in forestry and photography . Mr . Bonnell will be helping Mr . Fabbroni with the park plans , zoning needs , documentation and enforcement . P & C SIGN - JUDD FALLS PLAZA Mr . Fabbroni reported that the new P & C sign is now in place and totally legal . BEAUJOLAIS RESTAURANT - ROBERT O ' MALLEY - RECONSIDERATION OF PARKING AREAS Mr . Fabbroni stated that he asked Mr . O ' Malley to come to this meeting and noted that most of the members of the Planning Board are aware that when the Restaurant use was approved they talked about a parking area alongside and below the restaurant . Mr . Fabbroni said that certain things have happened to close off the parking in back of the restaurant and Mr . O ' Malley can fill the Board in with the details of what has happened with the Health Department , Mr . O ' Malley stated that they took the existing parking lot and made it bigger ( on the south side ) . He said that they had to build a septic system out in back and the State made the decision where it was ® to go . He stated that the septic system had to go where the parking area was to go back of the restaurant . He stated that they basically made the existing parking lot sufficient for all but the busiest nights , which are Friday and Saturday . The overflow is across the street on land that he has leased . He stated that he did gravel it off so that snow plows along Elmira Road will not affect the cars . He noted that the cars are now off the shoulder of the road . Town of Ithaca Planning Board - 3 - November 11 , 1975 Mr . Black asked if the alternate parking area is next to the house across the street . Mr . O ' Malley said that it was and to the north . Mr . O ' Malley noted that from a safety standpoint it is not very well lighted and that Mr . Fahbroni has recommended to him that he put in a light there . Mr . Black asked how the access from the street comes about there , Mr . O ' Malley stated that there are two openings - an entrance and an exit . Mr . Christianson asked how many cars are being parked there . Mr . O ' Malley stated that he has never had it full but about 20 cars could park there . Mr . Tsapis , attorney for Mr . O ' Malley , commented that the Departmen of Environmental Control has stated that they have land rights also , but that he is , at this point , not really sure of the constitutionality of their stance , but that Mr . O ' Malley is not in such a financial position at this time to fight this question . Mrs . Holcomb commented that there is also a practical matter in question and that is if there were parking over the septic field it may be subject to the breaking of tiles . Mr . Fabbroni felt this problem could be overcome by design . Mr . Tsapis stated that , in effect , the State has confiscated this land . Mr . O ' Malley feels that in the event of breakage they would always make any necessary repairs . Mrs , Holcomb noted that there is a very swampy area in back of the existing septic system and the topography is such that it just does not make sense to have the parking there . A. concern is that even though • there is parking across the street , it does present a problem safety- wise for people to cross the street . Mr . Tsapis noted that Mr . O ' Malley is installing lights so that the area will be lighted , Mrs . Holcomb asked Mr . Fabbroni to comment on a possible dual use by Mr . O ' Malley with the Millbrook Bread parking lot . Mr . Fabbroni , pointed out that there is a big drop off in the back , but there is a possibility in front . Mr . Fabbroni commented that he did not know what kind of leasing arrangements Mr . O ' Malley has at the present time . Mr . O ' Malley stated that he looked into this idea and actually the only nights that he needs additional parking are Friday and Saturday and Millbrook is open on Friday nights . He commented further that he has had the area across the street since he opened the restaurant , but it has not been gravelled all that time . It has been gravelled for about two weeks . He stated that he has never had more than 5 customer cars there . He stated that he does require the employees to park there to keep them out of the parking area near the restaurant . He noted that he has gotten the cars off the road and off being near the road . He said he would be in agreement with the Millbrook Bread idea if there were not the conflict on Friday nights . Mr . Fabbroni noted that at the Millbrook site there are guard rails around the whole parking lot and they park employees there too . It drops off into a swampy jungle type area in the rear . Mr . Black asked how the owner of the house near the proposed ligh- ting feels about the lights . Mr . O ' Malley stated that it is her land that he leases . There followed a lengthy discussion of the safety of the people crossing the highway ® Mr . Black thought that it was more critical in the daytime than at night . Mr . O ' Malley agreed and added that his restaurant is more " seeable " at night than in the daytime . Town of Ithaca Planning Board - 4 - November 11 , 1975 Mr . Christianson felt that he had no qualms about anybody under 65 getting across the road . Mr . Tsapis commented that unfortunately there is no alternative . Mrs . Holcomb asked what the capacity of the restaurant is . Mr , O ' Malley stated that it is about 65 and there is no bar . Mrs . Holcomb supposed that most people come two by two . Mr . O ' Malley said that half come two by two and half come in four . Mr . Fabbroni asked if they have any examples of how many people they have had in a typical week . Mr . O ' Malley could not give accurate figures but he surmised that there are two turnovers , maybe 2 - 1 / 2 on Friday and Saturday ® He noted that there is no overflow parking at lunchtime . Mr . Black asked if they have a way for people to come in and drop people off and then pull around and out and park across the street . Mr . O ' Malley felt that he really did not , but people have done that and they have upon occasion parked cars for patrons . Mr . Fabbroni noted that there is also a 400 ® year old tree and a bunch of shrubs . He commented in jest that they could tear that all up , but then we would have a lot different environment . The restaurant would then stick out more as a commercial site than it does now , Mr . Harris asked if there were any usable land on the north side of the house before it slopes down . Mr . O ' Malley replied No - - in back of the house there is about two or three feet before it drops off to the septic tank area . Mr . Black was of the opinion that an engineer could have designed a system for Mr . O ' Malley that would not have break- ing tiles . Mr . O ' Malley said that they did that and the State still would not buy it . Mr . Christianson asked what can we do about it ? Mrs . Holcomb commented that maybe the Planning Board should recom® mend this to the Town Board as a change in a site plan which we approved , The Board could recommend that they be allowed to use the parking area across the road in place of the proposed area which is now a septic field with conditions . MOTION by Mrs . Barbara Holcomb , seconded by Mr . Robert Christiansons RESOLVED , that the Planning Board of the Town of Ithaca recommend and hereby does recommend to the Town Board of the Town of . Ithaca acceptance of the following change in the site plan that said Town Board previously approved for the Beaujolais Restaurant . The proposed change concerns only the loc ation of the additional parking area . The Planning Board recommends , with the following conditions , that the Beaujolais Restaurant be allowed to use leased lands directly across Elmira Road for employee and overflow parking to replace the previously approved parking area behind the restaurant , 1 . That negotiations with the New York State Department of Environ- mental Conservation be continued with a view to receiving permission to • park in the area behind the restaurant previously approved by the Plan- ning Board and the Town Board which area is now a septic field . ? . That if at any time the leased land across Route 13 becomes un- available to Beaujolais Restaurant for parking , Beaujolais Restaurant must come back to the Planning Board for future consideration of the parking problem . Town of Ithaca Planning Board a5 - November 11 , 1975 3 . That the proposed overflow parking area be adequately lighted , Any lighting plan for the area must be approved by the Town of Ithaca Engineer , 4 , That said parking area across Elmira Road be used for employee parking and overflow parking for the restaurant only , 5 . That attempts be made to negotiate with the owners of the MillbrooY Bread property to see if there is any way that Beaujolais Restaurant can use their parking lot on the nights , . usually Friday and Saturday , when an overflow parking area is needed . . If such negotiations are successful the Millbrook parking area would replace the leased area across Route 13 . There being no further discussion , the Chair called for a vote . Aye - Holcomb , Christianson , Harris , Baker , Black , Martin , Slack . Nay - None . The MOTION was declared to be carried unanimously . DISCUSSION OF MORSE CHAIN OBTAINING LEHIGH VALLEY RAILROAD RIGHT OF STAY RUNNING FROM STONE QUARRY ROAD UP TO AURORA STREET Mr . William Tompkins and Mr . David Singley were present on behalf of Morse Chain . Mr . Harris asked for particulars about a State Law on railroad right of ways that he had heard about . Mro Fabbroni stated that he had been apprised of this law by Mr . Noel Desch and that Mr . Desch suggested that it is set up something like the following : 1 . State has first right of refusal . 2 . Other municipalities . 3 . Gas and Electric Company ends up buying it . Mr . Fabbroni noted that the Board had asked Mr . Tompkins to come to this meeting to explain to them just what is going on as more of a gesture of courtesy since , as far as he could determine , the Planning Board has no overriding jurisdiction as far as the sale of private lands is concerned . The following items were discussed in connection with this matter ,* 1 . County plan for loop road . 2 . Bikeways between the City and the Town along this right of way . 3 . Town Board members mentioned a possible easement some day for a water line . Mr . Black asked about the width of the strip and Mr . Tompkins stated that it is 661 . Mr . Black asked where it comes back down to grade and Mr . Tompkins said down near the valley , past Stone Quarry , Mr . Fabbroni commented that it curves out by Buttermilk . It is the railroad line that crosses over via the overpass on Elmira Road . Mr . Tompkins noted that it is a serving railroad . He said that it is some- what vital to their operation . They use it to haul out their scrap they have several tons per week . He commented that they could use i- rucks but it would be very expensive and difficult . He noted that the L (: high Valley Railroad is in bad financial straits . He noted that this use would be to Morse Chain ' s advantage as well as to the Railroad ' s . Town of Ithaca Planning Board - 6 - November 11 , 1975 • He said that they will continue to serve Morse Chain as a railroad as long as they are in operation . Mr , Tompkins presented a map of the proposed right of way entitled " Property and Surrounding Land Use - Morse Chain , July 22 , 19700 such plan being No . B - 118815 , Sheet D and Sheet 1 and 2 of two . Mr . Black asked if Morse Chain is buying all of the right of way ] and . Mr . Tompkins said no , only the part down to Stone marry . Mrs . Holcomb wondered what would happen should the Lehigh Valley Railroad not continue to use this line . Mr . Tompkins said that they would then have to buy a railroad to continue sending out the scrap . Mr . Fabbroni asked how many car loads are used in a week . Mr . Tompkins said the average was two to three cars a week . Mr . Harris asked about the water line question . Mr . Fabbroni stated that for obvious reasons this right of way and the slope it has is ideal for a water line , bikeways , or whatever . Mrs . Holcomb asked how much of the 66 ' do they intend to use ? Mr . Tompkins stated that according to the Federal regulations they must have 22 ' clear on each side of the center line which would be 441 total , Mrs . Holcomb noted that since this is essentially a courtesy to the Planning Board for the Planning Board ' s information , there does not seem to be any problem except for the question that Noel Desch and Larry Fabbroni and Monty Harris brought up as to a prior use committ- ment . She noted that the railroad is not abandoning it , they are sel - ling only the land , not the trains , the cars and the service . Mr . Christianson stated that he agreed with the proposal and then wondered if the railroad should go out of business , would it be possible to have a piggy back to the valley ? Mrs . Holcomb stated that there is really not a need for a resolu- tion , the Board will speak to the Town Board on this matter , Mr . Tompkins stated that in accordance with the terms of the con - tract with the railroad , Morse Chain would need a letter from the Planning Board that they have no objections to this proposal , MOTION by Mrs , Barbara Holcomb , seconded by Mr . Robert Christianson :. RESOLVED , that the Chairman of the Planning Board be authorized to send a letter to Morse Chain stating that the Planning Board has no objections to Morse Chain purchasing a land right of way running from Stone Quarry Road up to South Aurora Street from the Lehigh Valley 17 ' lroad . There being no further discussion , the Chair called for a vote . Holcor. b , Christianson , Harris , Baker , Black , Martin , Slack . may - None , The MOTION was declared to be carried unanimously . *:. : CUSSION OF A PROPOSAL FOR A MEDICAL CLINIC ON DuBOIS ROAD Dr . Louis Munchmeyer and Attorney Stanley Tsapis were present and Town of Ithaca Planning Board - 7 - November 11 , 1975 presented a site plan for the proposed medical offices to be located on DuBois Road , entitled " Dr . Munchmeyer et al , October 23 , 1975 , Site Plan and Elevations - Marshall Erdman and Associates , Inc . " Mr . Tsapis stated that the persons making this proposal , i . e . , Dr . Munchmeyer , Dr . Kilgore and Dr . Goodfriend , have an option to purchase the George VanEpps property on DuBois Road . The property in question is on the East side of the highway and in an R- 30 zone . The doctors now operate out of the Professional Building at 1301 Trumans - burg Road . He pointed out that the building has been designed by Marshall Erdman and Associates , a firm which specializes in medical offices . He commented that this firm also designed the offices for Drs . Yale , McKeown , Stewart , etc , on Cliff Street , Mr . Tsapis stated that the building will have two stories with a basement that will be empty . He further stated that there is to be no commercial property involved in this proposal , i . e . , no pharmacies , no dentists . Mr . Tsapis stated that this request falls under Article I , Section 1 , paragraph 26 ( page 3 ) of the Zoning Ordinance which reads : " A ' clinic ' is a building or any part of a building which is used for the group practice of medicine by several physicians in which certain facilities other than reception are shared by the occupants and in which patients are diagnosed or treated by physicians specializing in various ailments and practicing as a group . " Mr . Tsapis stated that the doctors intend to bring in a fourth doctor , who is already on his way , specializing in chemo -therapy . At present , there is no such specialist in this area . He stated that they need the additional room and they want to be in the ' . own building . He commented that what they are proposing is a substan- tial improvement to the area although it is a residential area . Mr . Fabbroni asked what kind of lab there would be or treatment area ? Dr . Munchmeyer stated that they would have the ussual lab work but there would be no Xmrays and no overnight patients . Mrs . Holcomb stated that because this proposal opens a question of strict interpretation of the Ordinance , i . e . , whether it is a clinic or not a clinic , she would suggest that it is the business of the Zoning Board of Appeals to make such a determination . She suggested that the Planning Board not continue this discussion in that area , but should make comments to the Board of Appeals as a help to them . Should the Board of Appeals rule that it does not fall within the terms of a medical clinic as defined by the Ordinance , the Planning Board comments would not affect such an adverse fuling . Mr , Tsapis stated that he would like the Board ( Planning ) to assumt at this point that the proposal is within the purview of the Zoning Ordinance as proposed and thus tell him and Dr . Munchmeyer what the Board thinks of the matter so that they could . go to the Zoning Board of Appeals with some sort of recommendation from the Planning Board in order to comply with the special approval requirement of the Board of Appeals (Article V , Section 18 , paragraph 11 ) . ® Mrs . Holcomb repeated her comment that this Board should not make a determination as to whether it is a clinic or not , but rather whether it is a good plan or not . It was noted that all the doctors involved in this proposed building would be internists , Mr . Black asked about the existence of a sewer system . It was noted that there is no sewer . There will be a septic tank and well . Town of Ithaca Planning Board November 11 , 1975 Mr . Tsapis stated that the well is already dug and they have sufficient water to do what they need . He noted that they cannot do anything without Health Department approval , Mr . Christianson asked exactly where the proposed property is situated . Dr . Munchmeyer stated that it is approximately 2001 to 4001 north of the intersection of Indian Creek Road and on the east side of DuBois Road , Mr . Martin commented that chemo- therapy had been mentioned and asked if this requires X- ray or cobalt treatment , Dr . Munchmeyer said NO * Mr . Tsapis stated that each floor of the building ( 2 ) would cone tain 3 , 300 sq . ft . Mrs . Holcomb asked if they have any contour maps available ? Mr . Tsapis said that he did not at this time . Dr . Munchmeyer said that there is about a 10 ' fall over 2001 east from DuBois Road , Mrs . Holcomb commented that the parcel is near Indian Creek and presumably drains eventually into that Creek . Dr . Munchmeyer noted that the parcel contains approximately 2 ® 3 / 4 acres . Mrs . Holcomb wondered what the effect of the proposed State corridor for the Route 96 improve ment would be . Mr . Fabbroni stated that he thought that that was a point to be brought out to Dr . Munchmeyer that there might be a possi ® . bility of a highway going past his building some day . Mrs . Holcomb asked if there are any restrictions on the Planning Board approving anything going into that area . Mr . Fabbroni was of the opinion that there were not at this point . Mrs . Holcomb commented that because this is a special use in an R� 30 zone the usual yard requirements really do not mean anything . Mr . Black noted that the plan indicates a screen of plantings as required in a commercial zone . Mr . Black wondered if the plan as shown constitutes parking in the front yard ? Mr . Tsapis stated that there is plenty of room for parking and if that is a problem , it can be moved . Mrs . Holcomb stated that the parking as shown is back 501 and the requirement is that there be no parking in the legal front yard which is 301 . Mr . Tsapis stated that with regard to drainage , they would be happy to make it a condition of approval by Mr . Fabbroni . He stated that they would accept any reasonable condition so that they could go to the Zoning Board of Appeals meeting on the 24th of November . Mr . Christianson commented as follows . 1 . He certainly likes the idea . 2 . He likes the location - it has immediate access to the hospital without going on to Route 96 , 3 . He seriously doubts that there would be any sort of drainage problem in this area . 4 . He liked one opening to DuBois Road , Mrs . Holcomb asked what the daily volume of traffic might be . �:Nr . Muncfineyer stated that there would be at most 50 cars per day for the three doctors , with not much increase at all with four doctors '_here . Town of Ithaca Planning Board - 9 - November 11 , 1975 . Mr . Black wondered if the black-topped parking area would cause an undue amount of water run-off from it . Mr . Fabbroni suggested a swale on the lower end of the parking lot would retain and disperse increased run-off at a slower rate . Mrs . Holcomb proposed that the following letter be sent from the Chairman of the Planning Board to the Chairman of the Town Zoning Board of Appeals (with copies to each member of said Board ) with the concurrence of the Planning Board members .* " On November 11 , 1975 , at its regular meeting , the Planning BoaYd of the Town of Ithaca reviewed and discussed the plans for a proposed medical facility presented by Dr . Louis Munchmeyer et al with Mr . Stanley Tsapis acting as their attorney . It was the consensus of the Planning Board that if the Zoning Board of Appeals of the Town of Ithaca should find that the proposed building and use fall within the definition in Article I . Section 1 , paragraph 26 of a medical clinic and , therefore , is subject to special approval of said Zoning Board of Appeals , the Planning Board offers the following comments for the information of said Board of Appeals . 16 That the building on the lot seems to meet rear yard , side yard , and front yard requirements of an R- 30 District . We recognize , however that R- 30 residential requirements really have little meaning for this sort of specialized use . 2 . That based on the information nresented to us that approximately 50 cars per day will constitute the patient traffic load , the parking area seems to he adequate for employee and patient parking . 3 . That we have not seen plans for , nor do we pass judgment on , any matters concerning surface drainage , and therefore , that if this plan should he approved by the Zoning Board of Appeals a drainage plan must be approved by the Town Engineer before permission is given to build . 4 . We note that a screening from the adjacent properties has been indicated . 5 . That some members of the Planning Board felt that this is a desirable use for this area and that no member of the Planning Board offered any adverse comments . However , we took no formal action in this matter feeling that this determination falls more properly within the jurisdiction of the Zoning Board of Appeals . MOTION by Mr . Maurice Harris , seconded by Mr . Richard Black : RESOLVED , that the foregoing letter he sent to the Zoning Board of ppoals by the Chai I- rman ; . There being no further discussion , the Chair called for a vote , Aye - Hoicomh , Christianson , Harris , Baker , Black , Martin , Slack . CIV None , The. MOTION was declared to be carried unanimously , Town of Ithaca Planning Board - 10 - November 11 , 1975 SLIDE PRESENTATION AND DISCUSSION OF CIRCLE GREENWAY BY MRS . WALTER MULHOLLAND OF THE BICENTENNIAL COMMITTEE Mrs . Walter Mulholland and Mr . Gregory Kasprzak presented several colorful slides of the proposed " Circle Greenway " which is a walking tour of the City and Town of Ithaca and the official project of the City of Ithaca BiCentennial Committee . After the slide pre- sentation , Mrs . Mulholland stated that what is requested of the Town of Ithaca is Town permission to mark by signs and have a guide book printed for the Circle Greenway which would include those areas in the Town . She noted that there are some landowners in the Town that they need permission to put up markers also ® ® Blatchley , Guidi and Sweet . She hoped that there would be markers in Forest Home and that there may be permission granted for access to the Forest Home Chapel . She commented that a lot of neighborhoods are beginning to help the Committee . Mr . Kasprzak outlined what is expected of the Town . He noted that. the Circle Greenway is a City BiCentennial Commission project , He stated that there might be some costs involved . He said that they are proposing to set up an administrative group for the Circle Greenway that might involve many groups . He stated that they are asking the Town ' s cooperation and basically an approval of the project in princi � pal . He said the details will come later , He said that the insurance responsibilities would be up to the Town or the City or Cornell or . whatever , on Public Lands . He stated that the total walk will be about 30 miles . Mr . Christianson asked what Mrs . Mulholland and Por . Kasprzak wanted this Board to do . Mr . Kasprzak said that they wanted the per - mission of this Board at first for them (Circle Greenway ) to work with Mr . Fabbroni on that part of the Circle Greenway that is in the Town of Ithaca . Mr . Christianson stated that what is necessary then at this point is an approval in concept . Mr . Kasprzak agreed and stated that that would then give them official access to Mr . Fabbroni . He continued that they want to be sure that the Circle Greenway project agrees with the Town ' s future plans for recreation , etc . Mr . Christianson said that he was sure that most of the Board members are in agreement with the concept . MOTION by Mr . Sam Slack , seconded by Mr . The Planning Board looks with favor upon Mr . Lawrence Fabbroni , Town Engineer , spending time with the Greenway Committee in further development of the project . .
