M . in the Town of Ithaca Town Hall , 126 East Seneca Street , ( second floor ) , Ithaca , New York , PRESENT : Chairwoman Barbara Holcomb , Daniel Baker , Robert Scannell , Maurice Harris , Liese Bronfenbrenner , Robert Christianson , Richard Black , Sam Slack , Lawrence P . Fabbroni ( Planning Engineer/ Building Inspector ) , Reynolds Metz ( Assistant Building Inspector ) , John McQueen ( Law Student ) . ALSO PRESENT : Archie Brown , Richard S . Prince , Alexander Poyuzina , Bob Wright , Edward M . Olmstead , Alfred Eddy , Nelson Eddy , Mark Charlton ( WTKO Radio ) . REPORT OF PLANNING ENGINEER Mr . Fabbroni reported that it is hoped that the zoning ordinance, will be ready for Public Hearings in October , 1975 . REPORT OF BUILDING INSPECTOR Mr . Metz reported that he has received an application for a building permit from Madison Electric Company in re their property at 615 Five Mile Drive , just south of Shippos ' land . They want to build an office building addition to the sheet metal warehouse . Mr . Metz asked that since Madison Electric is right next to Shippos , does if affect anybody and also does a light industrial zone come before the Planning Board . The plot plan shown on the permit application does not show the right of way for the flood control - - it shows the Lehigh Valley Railroad right of way . Mr . Fabbroni felt that there was a question about the flood channel going back there and that he had been on the site wish the Corps of Engineers . Mr . . Fabbroni felt that there might be an easement going through there for the flood channel . Mrs . Holcomb stated that the discussion concerns the calling of a Public Hearing for a site plan presentation for an additional office :juilding for Madison Electric on their property in the Light Industrial zone off Five Mile Drive . She noted that there is time on the agenda far the July lst meeting , Mr . Fabbroni requested that this discussion be tabled for a few minutes and requested that the Planning Board call a Public Hearing to consider the Retreat House for the Immaculate Conception Church on Five Mile Drive on July 1st . Mr . Fabbroni also requested that the oard formally say that at that meeting also the Board will considez, ✓�) e Leonardo Subdivision . MOTION by Mrs . Barbara Holcomb , seconded by Mr . MOTION by Mrs . Barbara Holcomb , seconded by Mr . Robert Christia.n.- RESOLVED , that the Planning Board of the Town of Ithaca shall hold a Public Hearing on July 1 , 1975 , at 8 : 15 p . m . to consider a site plan for a proposed new office building for Madison Electric , Inc . , on their land in a Light Industrial Zone off Five Mile Drive . Anthony Leonardo on his property off Danby Road on a new road known as Sesame Street . • There being no further discussion , the Chair called for a vote . Aye ® 8 Iday - 0 The MOTION was declared to be carried unanimously . SIERRA CLUB DISCUSSION OF CIRCLE GREENWAY ( BICENTENNIAL ) Mr . Metz announced that Mrs . Mullholland of the Sierra Club has announced that the Sierra Club is having a discussion on the Circle Greenway in connection with the Bicentennial at the Library on Thursday , June 19 , 1975 . PUBLIC HEARING : CONSIDERATION OF THE SITE PLAN FOR A CHURCH AND SCHOOL. FOR THE CHURCH OF THE SEVENTH DAY ADVENTISTS ON THEIR PROPERTY AT : 1217 - 19 TRUMANSBURG ROAD ( PARCEL NO . 6 - 26 - 4 - 42 ) Mrs . Holcomb declared the Public Hearing duly opened at 7 : 45 p . m . * sf; d presented the Clerk ' s Affidavit of Posting and Publication for the %Record . Messrs . Archie Brown , Bob Wright , Richard Prince and . Alexander 1 ;.1yuzina ( Builder ) were present on behalf of the Church , Mr . Brown described the proposed Church as being located �-,,jproxiMtely 300 ' from Route 96 and having a nice wide open driveway `: : ;_Nance to provide for easy ingress and egress . He stated that they h1ave met all the standards . The tax map was inspected and it was no -� L- d that the front entry of the building is at ground level and the i)a.ck entry is also . One side lot line is 15 ' from the right of way Town of Ithaca Planning Board ® 300 June 17 , 1975 into the Odd Fellows property . The property in question is in an R- 15 zone . The parking lot is down in back of the Church . The building will be about 12 ® high at the front and 221 at the back . Mr . Fabbroni asked who is the architect on this project . Mr . Poyuzina stated that the designer is Ford Homes which are prefab , prepanelled with the walls finished on the inside . Mr . Fabbroni asked if they are approved by the State - - he was wondering why there was no seal on the drawing , Mr . Christianson stated that they are an excellent company and fully approved and that he would give their work a very high recommen- dation . Mr . Prince noted that the building will have a brick veneer anO will be constructed with 3 / 4 " exterior plywood . Mrs . Holcomb asked if there would be any problems with the Cite Plumbing Inspectors in connection with prefab buildings . The indica- tion was that there would not be problems , Mrs Poyuzina noted that they will do their own wiring . Mr . Fabbroni stated that the plumbing must meet the City Code which is essentially the State Code . He noted again that the builder will do the plumbing but then he must check with the City Water Department , Mr . Fabbroni questioned the parking scheme as well as the number of spaces . He asked how large the membership is . • Mr . Prince stated that this building will be built to hold up to 300 people , but there are only 60 members right now . They antici - pate 30 cars , but they usually have about 12 cars in the parking lot . Mrs . Holcomb asked if they are presently building just the Church , or the Chl.=h and the School . Mr . Prince stated that they are ; ust building the Church at the moment because they do not have enough land according to their Church rules for a School . Mrs . Holcomb noted that the Board needs to have a more permanent > i. - n plan for the record , Mr . Prince noted that the driveway is 251 wide with a 501 mush- room entranceway to make the access nice and wide . Mrs . Holcomb asked if they need to go to the State for a permit for a curb cut . ^Ir . This hearing tonight is a preliminary hearing and if there is no substantive change from this plan we can • have a second hearing that need not be publicly advertised . Mrs . Holcomb also noted that this subdivision plan when approved will have to be recorded in the County Clerk ' s Office as a subdivision , a map , Mr . Fabbroni requested that bearings and dimensions be shown on MOTION by Mrs , Barbara Holcomb , seconded by Mr , Maurice Harris : RESOLVED , that the Planning Board of the Town of Ithaca grant :lid hereby does grant preliminary approval to the subdivision plan for. Eddy Hill Farms , being a division of the present tax parcel no , 6 - 28 - 1 - 26 . 2 into four parcels ; one of 8 acres approximately , one of 26 acres approximately , one of 15 acres and the remainder to be in th6 fourth parcel . There being no further discussion , the Chair called for a vote , Aye - 8 Nay ® 0 The MOTION was declared to be carried unanimously , The Public Hearing was closed by the Chair at 8 : 40 p . m , CONSIDERATION OF SIGN PROPOSAL FOR NCR Mr . Edward Olmstead of NCR was present and presented a request nor a new sign for the enlarged NCR plant at 950 Danby Road . Mr . Olmstead stated that the old sign will be placed on the south side of the elevator penthouse and that they do not need a permit for this old sign . However , they are requesting a permit for the new sign w-h1ch is 4 ' x 15 ' and to be placed in the turn-around island at the entranceway . Mrs . Holcomb read from Section 7 , subsection ( b ) of the Sign GrdInance : " l . On each parcel of land on which a business is lcoated , cne free standing sign shall be permitted , except that if a business hps entrances for vehicular traffic on more than one street , two free vt• anuing signs are permitted . Such sign shall not have a sign area ^.neater than 100 square feet , nor shall the sign , including any frame cr structure , extend more than 24 feet in height above ground level , If a second sign is permitted , the sum of the sign area of both signs , when added together , shall not exceed 100 square feet , except as permitted in paragraph " 3 " below . Mr . said that there will not be any flood lighting - there are W ais for lighting at this time , Town of Ithaca Planning Board - 6 - June 17 , 1975 Mrs . Holcomb noted that 100 square feet is the maximum allowed for a sign of this nature and the height limit is 241 . This proposed • sign is well within those limits . She noted further that the sign has to be 15 ' from the right of way line and there is no problem in this connection . MOTION by Mr . Robert Christianson , seconded by Mr . Richard Blacks RESOLVED , that the Planning Board of the Town of Ithaca recom- mend and hereby does recommend to the Town Board that approval be granted to NCR for their proposed sign measuring 4 ® x 151 and to be located in the parking circle at the north end of their building complex . There being no further discussion , the Chair called for a vote . Aye - 8 Nay - 0 The MOTION was declared to be carried unanimously . SUMMER SCHEDULE Mrs . Holcomb stated that she would like to have the Planning Board meet only once a month during July and August . This was agreeable . Vehicle and Traffic Law 11660-a (McKinney Supp . 1974 ) was enacted in 1971 to deal specific - ally with traffic regulations at shopping centers . n A town board may enact local laws or ordinances re- lating to traffic regulation pursuant to a request from the owner or person in charge of the shopping center . Traffic regulations permitted under this section include stop signs , no- parking signs , and designation of safety zones . N . Y . Vehicle and Traffic Law 11100 ( b ) (McKinney Supp . 1974 ) states that all the rules of the . road re - lating to obedience to traffic regulations shall ap- ply to the parking area of any shopping center lo- cated in a town that has adopted local laws or or- dinances regarding such . Of course , under 11660-a , a town may act only after a request from the shop- ping center officials . k CONCLUSION In order for traffic regulations in a shopping center to have legal status , there must first be a request from the owner or person in charge . Second- ly , the town board must enact local laws or ordin- ances relating to traffic regulation in the shopping center .
