HomeMy WebLinkAboutPB Minutes 1975-03-18 TOTIN OF ITHACA PLANNING BOARD M MARCH 18 , 1975 The Planning Board of the Town of Ithaca met on Tuesday , March 18 , 1975 , at 7 : 30 p . m . in the new Town Hall at 126 East Seneca Street , Ithaca , New York , PRESENT : Chairwoman Barbara Holcomb , Robert Scannell , Maurice Harris , Daniel Baker , Richard Black , Sam Slack , Lawrence Fabbroni ( Planning Engineer/Building Inspector ) . ABSENT and EXCUSED : Liese Bronfenbrenner , Robert Christianson , ALSO PRESENT : Rocco P . Lucente , Warren Buck , Jane Harris , Alan Goodman ( Ithaca Journal ) , The meeting was opened by the Chair at 7 : 40 p . m . PUBLIC HEARING : CONSIDERATION OF PRELIMINARY SUBDIVISION APPROVAL OF SHARONWOOD DRIVE AND PINEWOOD PLACE IN NORTHEAST ITHACA FOR ROCCO Pe LUCENTE , DEVELOPER , Chairwoman Holcomb declared the Public Hearing in the above - named matter duly opened at 7 : 45 p . m . The Town Clerk ' s Affidavit of Posting and Publication of said Public Hearing was presented and noted for the record , Mr . Warren Buck , associate of Mr . Lucente , and Mr . Lucente ® presented an overall plan titled " General Plan of Development - Lands of Rocco P . Lucente " , dated April 1 , 1965 , comprising approximately 110 acres of lots and streets . The Planning Board approved a 21 - lot subdivision , Sharonwood and Pinewood , in April 1969 ( Subdivision Plan by Thomas G . Miller ) . How- ever Mr . Lucente did not file the approved subdivision map with the County Clerk as is required by State Law . Therefore , the Planning ' Board approval has lapsed and is null and void . Mr . Lucente now appears for a new approval of this subdivision . There followed a discussion of the Planning Board requirements for park land for the entire development . Mrs . Holcomb noted that some land has been set aside for park land to date - i . e . - 2 - 1/ 2 acres , north of Birchwood and east of Salem Drive with one intervening lot depth between the named road and the park area . She also noted that there is more than half way still to go in the overall development . Mr . Lucente pointed out that this area development was approved in 1965 and it would make it very difficult to change things around now . A lengthy discussion followed of size of park area , location or locations , and if there should be park area added . Mrs . Holcomb asked if there is any part of the development that is yet undeveloped that is a difficult area for building upon . Mr . 10 Lucente pointed out an area over towards Sapsucker Woods Road where it is very heavily wooded , He also noted that there is land bordering the Bird Sanctuary . •Town of Ithaca Planning Board - 2 - March 18 , 1975 Mrs . Holcomb suggested that Mr . Lucente and Mr . Buck take time ® to think more about the question of park land and then return to the Planning Board with a designation of some area in the undeveloped land for parkland . Mr . Buck asked how much land would be adequate to meet the Plan- ning Board requirements . Mrs . Holcomb stated that the requirement would be five to six acres to be set aside for park land or open space . Mr . Lucente did not feel that five or six acres should be required . Mrs . Holcomb pointed out some problems she could see with the 21 - lot subdivision presently under discussion . The drainage lines are not shown on the plan and she asked if they could be added . The Planning Board does not want drainage going across lots . Mr . Fabbroni felt that drainage was a very minor item compared to what Mr . Lucente has to figure out with the park question . Mrs . Holcomb asked what Mr . Lucente ° s plans are for the houses to be constructed . Are they single family to be sold ? Mr . Buck stated that they were . Mr . Lucente asked if there would be any possibility of cluster housing , The Planning Board agreed that there was , It could be planned in the undeveloped area . Mr . Lucente wondered if he should come in with a plan for town houses , would there be any chance to get . it through? Mrs . Holcomb stated that that would depend on a lot of things . Mrs . Holcomb returned the discussion to the 21 lots on what is presently designated as Sharonwood Drive and Pinewood Place . She stated that the Planning Board could give Mr . Lucente preliminary approval of his plan with conditions that have to be met . If there are no substantial changes we can give final approval without an additional Public Hearing provided that the conditions are met . The Planning Board could give final approval at the next meeting . Mr . Lucente asked if he could present the Planning Board with some sort of " intent " to give the park land . Mrs . Holcomb stated that the Planning Board could accept a letter of intent from Mr . Lucente at the next meeting of the Planning Board . Mr . Lucente indicated that he understood that the requirement was five to six acres in the remaining undeveloped land . MOTION by Chairwoman Barbara Holcomb , seconded by Mr . Robert Scannell : RESOLVED , that the Planning Board of the Town of Ithaca grant and hereby does grant preliminary subdivision approval for lands of Rocco P . Lucente , constituting 21 lots numbered 37 , 38 , 39 , 40 , 41 , 42 ; 31 , 32 , 33 , 34 , 35 , 36 ; on street presently designated Sharonwood Drive ; 77 , 78 , 79 , 80 ; on Pinewood Place ; 28 , 27 , 26 , 30 , 29 ; on Birchwood Drive ; conditional upon the followingo 1 . Submission of a letter of intent to set aside park land or 1� Town of Ithaca Planning Board - 3 - March 18 , 1975 • open space area in the undeveloped portions of Mr . Lucente ° s land generally easterly and northerly of this subdivision to constitute between five and six acres . 2 . That indications be made on the subdivision plan , pre- viously described by lot numbers , for surface drainage . It is the recommendation of the Planning Board that the lands indicated as " Reserved for Recreation Area " on map dated April 1 , 1965 , by Carl Crandall : General Plan of Development - Lands of Rocco P . Lucente , meet the open space requirements for this proposed subdi - vision , and previously developed lands roughly in the Salem Drive area . There being no further discussion , the Chair called for a vote . Aye - Holcomb , Scannell , Harris , Baker , Black , Slack . Nay - None . The MOTION was declared to be carried unanimously . DISCUSSION OF PROPOSED SIGN FOR BEAUJOLAIS RESTAURANT , ELMIRA ROAD ROBERT 01MALLEY . • Mr , Fabbroni presented an application for a sign together with an accompanying detail plan tendered by Mr' . Robert O ' Malley for Beaujolais Restaurant owned by Mr . O ° Malley on the Elmira Road; . The proposed sign is 41 x 41 and approximately 71 high at the most . The maximum size of a permitted sign in this zone is 100 square feet . Mr . Fabbroni felt that there was no problem in granting approval for this proposed sign . Mr . O ' Malley noted that the proposed sign will be 321 from the center of the highway . Mr . Scannell noted that this distance does not meet the requirements of the Sign Ordinance . It should be 15 ' from right of way . A brief discussion followed concerning the location of the res - . taurant as far as distance from the highway edge , the sight distances , etc . MOTION by Mr . Sam Slack , seconded by Mr . Maurice Harris . RESOLVED , that the Planning Board of the Town of Ithaca recommend and hereby does recommend the approval of the application by Mr . Robert O ' Malley for a sign for the Beaujolais Restaurant , The Planning Board recognizes that the location of the proposed sign does not meet the set-back requirements of the Town of Ithaca Sign Ordinance , however , in view of the existing situation , it is the opinion of the Planning Board that this distance is not necessary in this particular case . There being no further discussion , the Chair called for a vote . Aye - Scannell , Harris , Baker , Black , Slack . (Mrs . Holcomb had left the meeting for another committment ) .
