PRESENT : Chairwoman Barbara Holcomb , Daniel Baker , Maurice Harris , Robert Scannell , Robert Christianson , Jack Lawe , Sam Slack . ABSENT : Arnold Albrecht . The following are Notes from a Special Meeting held by the Planning Board of the Town of Ithaca , on Tuesday , October 30 , 1973 , P 7 : 30p . m . , primarily for further discussion of the proposed Zoning Ordinance . 1 . Mrs . Holcomb outlined a ' request that had come to her atten- tion from a homeowner on Coddington Road who has a tract of land con- taining 124 acres and having on it one large farm house . The request is to convert the farm house into 4 units . This is not permitted under the present zoning ordinance . Mrs . Holcomb asked for the Board ' s feelings on whether the owner could , under Section 281 of Town Law , subdivide the lot and under cluster set aside 120, 000 sq . ft . for open space and thus be allowed to t1cluster" the 4 units in one building . The consensus of the Board was that this plan would be acceptable , contingent , of course , on approval by the Tompkins County Health Department.. Mrs . Holcomb will so advise the homeowner . 2 . MONKEMEXER request for final site plan approval of proposed subdivision on East King Road . Mrs . Holcomb read a letter from Mr . Evan Monkemeyer which refers particularly to the first cluster of 8 units in two buildings that he wishes to begin construction on immediately . The total pro- ject is for 111 units. The letter was accompanied by a Memorandum of Law from Herbert N. Monkemeyer . The Messrs . Monkemeyer contend that the site plan being presented at this time , is not substantially different from that which was presented and approved along with the rezoning in December of 1971 . The Planning Board was of the opinion that the plan is quite different and the steps required for site plan approval must be gone through again . Mr. Scannell stated that if the Town Attorney is in agree- 0 ment with the Planning Board , the Chairwoman of the Planning Board should simply state to Mr . Monkemeyer that the procedure must begin again . Mr . Kroohs felt that Mr . Buyoucos did not really want to rule on this matter directly. Mr . Kroohs wondered if a compromise could not be worked out . . It was Mr . BuyoucosI suggestion that the Town of Ithaca Planning Board - 2- October 30 , 1973 matter go directly to the Town Board , Mr. Francese suggested setting up a Public Hearing for the next Planning Board meeting for the proposed segment of the develop- ment . Mrs . Holcomb did not agree because the rezoning of the land is tied to the original plan and that must be a plan for the total development . Mr . Francese suggested calling the new plan Stage 1 and rezone the other two sections back to the original status . Mrs . Holcomb maintained her opposition to calling a Public Hearing for the 6th of November stating that she felt that Mr . Monkemeyer should come into a regular meeting and then see about a public hearing at a later date . Mr . Kroohs noted that water line already goes past the property but sewer does not . He stated that Mr . Monkemeyer would like to put the sewer in the ground along the road in advance of getting site plan approval . Mr . Scannell said that he could see no objections to letting him do this . Mr . Scannell further stated that this matter could be handled , if the Planning Board saw fit , by calling Mr . Monkemeyer on the telephone and thereby avoiding his coming to another meeting . Mr . Francese repeated that he thought the Planning Board should call a Public Hearing for November 6 , 1973 . . MOTION by Mr . Robert Scannell , seconded by Mrs . Barbara Holcomb : RESOLVED , that the Planning Board of the Town of Ithaca hold a Public Hearing on the 6th day of November , 1973 in the Town Office at 7 : 30 p . m . for the purpose of considering a preliminary site plan change for the lands owned by Monkemeyer and zoned multiple residence on East King Road . There was no further discussion and the Chair called for a vote . All members present voted aye . The Motion carried unanimously . 3 . VINCENT FRANCIAMONE request to rezone land at 108 Ridgecrest Road from R- 30 to R- 15 . Mrs . Holcomb stated that the Town Attorney , James Buyoueos , had agreed with the Planning Board decision that the one acre res- triction stated in the zoning ordinance prevented Mr . Franciamone from being rezoned to multiple . Mrs . Holcomb further stated that she had written a letter to Mr . Franciamone explaining this ruling . Mrs . Holcomb read a letter from Mr, Franciamone dated October 29 , 1973 , requesting the rezoning of his property from R4W30 to R- 15 and submitting proposal B i . e . , splitting his lot in two and constructing two , two- family douses . In his letter , Mr . Francia� . mone stated that his proposal would meet the requirements of Section 11 subdivision 2 of the Zoning Ordinance . The Planning Board reviewed the plans Mr . Metz remarked that a building permit cannot be issued for a lot without there being direct access to a public road . The back lot cannot have access to the road through a driveway owned by the owners of the back lot without reducing the front lot below 15 , 000 sq . ft . Town of Ithaca Planning Board - 3 - October 30 , 1973 Mrs . Holcomb will. refer the matter to the Town Attorney . The Planning Board will consider the request for rezoning at the next regular meeting , November 6 , 1973 , The meeting was adjourned at 10 ° 45 p . m , by the Chair , Respectfully submitted , Nancy M. I ' 108 Ridgecrest Road Ithaca , New York 14850 October 29 , 1973 Chairman of the Planning Board Town of Ithaca 108 East Green Street Ithaca , New York 14850 Dear Chairman : I am in receipt of your letter dated October 25 , 1973 informing me of the decision of the planning board rejecting my proposal . as indicated in my application of October 22 , , 1973 . A careful analysis of the minutes of the Planning Board meeting has indicated that if one acre was available the Planning Board would consider my request of rezoning my lot to multiple residence . So please keep in mind that additional land is being purchased under contract . In the meantime I am submitting this application and Proposal B for rezoning to R- 15 so that I can split my lot and construction can begin immediately,. - Proposal B includes two , trio - family houses and will meet the requirements of Section 11 subdivision. 2 of the Zoning Ordinance . Our Ithaca Planning Board has been considering a new zoning ordinance since Mr . Francese presented the first rough draft of a proposed zoning, ordinance in 1970 . Three years have passed without completion of a new zoning ordinance . The Plannin7. Board has only accomplished spot rezoning of certain areas including the Beacon Hills Development . Since my land adjoins Beacon Hills Development it has adversely affected my property . The category of R- 15 is included in the proposed zoning ordinance , inthe area on Ridgecrest Road . Certain areas have already been given approval for R- 15 . I respectfully request that this matter be placed on the agenda of the Town of Ithaca Planning Board set for November 6 , 1973 ® I respectfully request the rezoning of my lot to R - 15 .
