HomeMy WebLinkAboutPB Minutes 1973-08-28 r TOWN OF ITHACA PLANNING BOARD AUGUST 28 , 1973 A regular meeting of the Town of Ithaca Planning Board was held on Tuesday , August 28 , 1973 , in the Town Offices at 108 East Green Street , Ithaca , New 'fork , at 7030 p . m . PRESENT : Chairwoman Barbara Holcomb , Arnold Albrecht , Robert Scannell , Peter Francese ( Plannin Consultant) , Kenneth Kroohs ( Planning Engineer) , David Cowan Zoning Officer) , and Reynolds Metz (Assistant Zoning Officer) . ABSENT : Robert Christianson , Maurice Harris , Daniel Baker , Jack Lowe , Sam Slack . ALSO PRESENT : Mr . Arthur " Dutch" Prince , Mr . Anthony Leonardo , Mr . Richard MacDowell , Mr . Leo Passi , Mr . Charles Firenze , and members of the press and radio . The meeting was opened at 7 : 45 p . m . by the Chair . PUBLIC HEARING m ® CONS IDEItAT ION OF PRELIMINARY APPROVAL OF PLOT PLAN FOR A RESIDENTIAL SUBDIVISION ON DANBY ROAD PROPOSED BY ANTHONY LEONARDO , At 7 : 45 p . m . Chairwoman Holcomb opened the Public Hearing , read the Legal Nctice as published in the Ithaca Journal on August 22 , 23 , and 24 , 1973 , and presented the Town Clerk ' s Affidavit of Posting and Publication for the record . Mrs . Holcomb began by explaining that although a quorum was not present , the Public Hearing could be held . Any action on the proposal would have to wait however , until there was a meeting at which a quorum was present . Mr . Leonardo showed the Board the plot plan for the proposed subdivision and a preliminary plot plan for his entire parcel of land . Mr . Leonardo pointed out that all of the requests made by the Planning Board at their August 14 , 1973 , meeting had been complied with . The discussion centered around the placement of park land within the subdivision . The plot plan showed it on the northern border of the site , approximately 7001 West of Danby Road . Mr . Leonardo indicated that he had originally intended to dedicate land on the West border of the site . That would place his park adjacent to Buttermilk Falls State Park . The Board was much more interested in the Northerly location since this would be more central to the subdivision and adjacent to land presently owned by Mat Associates . Approximately 200 ° North of Mr . Leonardo ° s property , the Mat Assoc . land is zoned multiple residence . Mrs . Holcomb noted that with the Northerly location for the park , it may be possible to acquire more land from Mat Associates when they begin to build . This would then ® create a good- sized park . Mr . Kroohs asked about the slope of the land in the proposed park area . Mr . MacDowell , surveyor for Mr . Leonardo , stated that the slope averaged about 6% . Mr . Scannell stated that 6% was suitable for park land . Town of Ithaca Planning Board = 2- August 28 , 1973 Mr . Kroohs noted tha -L he and Mr . James Calhoun for the Soil . Conservation Service had walked over the site and discussed the drainage problems , Mr . Calhoun had written a series of recommendations for the subdivision. A copy of those recommendations is on file in the Planning Engineer ' s Office . Mr . Leonardo had received a copy of the recommendations and has incorporated them into his plan . Mr . Scannell stated that he felt the section now before the Board , Lots 1 - 9 , was well designed ® Mr . Francese asked if Lot # 9 could be used because of the stream which crosses it diagonally . Both Mr . Leonardo and Mr . MacDowell said that it could be used either as it is or by diverting the stream slightly . Mr . Kroohs mentioned that any diversion would require State Department of Environmental Conservation approval . Mrs . Holcomb asked if there were any comments from the floor . Mr . Charles Firenze introduced himself and stated that he is interested in purchasing Lot # 3 from Mr . Leonardo and building a house on it . He explained that he had already sold his house and therefore was interested in what the remaining approval procedure was and how soon a building permit could be issued . Mrs . Holcomb explained that the Planning Board would have to meet with a quorum to pass on the preliminary site plan , and then meet to issue final approval . The Board agreed that final approval could be issued as early as September 11 , 1973 . Mr . Kroohs noted that any approval had to waite for rezoning by the Town Board from Rm30 to R- 15 . The Public Hearing on the rezoning is to be held on September 10 , 1973 . Mr . Passi asked if the road had to be accepted before any building permits could be issued . Mr . Cowan said yes , building permits may be issued only on approved roads . Mr . Kroohs explained that for the Town Board to accept the road , both the Town Attorney and the Town Highway Supervisor must recommend acceptance to the Town Board . Mr . Kroohs suggested that Mr . Leonardo have a plan prepared showing the proposed right of way with bearings and distances ( the plot plan would suffice if the bearings and distances are added) , a deed prepared , and that these be brought to the Town Attorney as soon as possible . At the same time , he should construct the road to Town specifications so that Mr . Morey could inspect it before the September 10th Town Board meeting . Mrs . Holcomb closed the Public Hearing at 8 , 01 p . m . ST . CATHERII E _CIRCLE SUBDIVISION mo ARTHUR "DUTCH" PRINCE . Mr . Prince appeared before the Board to ask if it would be possible to include one more lot in his subdivision approval . He explained that the sewer was complete and he expected approval by the Village of Cayuga Heights before the end of the week . Also , the water was almost completed and approval should be forthcoming shortly for that . Mr . Prince told the Board that he had people interested in buying Lots 1 and 2 of Block 1 , and Lots 1 and 2 of Block 2 . In both cases the lots would be combined and one house built on the two lots . The problem arises in that Lot 2 of Block 1 was not part of the conditional approval granted for the subdivision on June 19 , 1973 . The Board felt that since the house was to face Christopher Circle Extension and utilize sewer and water from Christopher Circle Ext , that there was no reason why a building permit could not be issued for the house . Town of Ithaca Planning Board ® 3 - August 28 , 1973 Mr . Prince asked when it would be possible to obtain a building permit . Mrs . Holcomb replied that as soon as Mr . Prince had complied with all of the conditions of approval and had proof of inspection of the various utilities she would come into the Town Office and sign the plana Mr . Prince could then file the plan with the County Clerk and receive a building permit . WALTER WIGGINS ' BARN ON DANBY ROAD , Mr . Cowan reported that he will call Mr . Wiggins about the barn Mr . Wiggins wished to construct 4 6 apartments in. Mr . Cowan will ask about Mr . Wiggins ' plans now for the property and request permission to inspect it . Mr . Kroohs noted that he had contacted the electrical inspector and been told that Mr . Wiggins had electrical approval for one apartment , a second apartment needed some alterations before approval would be granted , and approval for two more apart = ments . had been requested . /BEACON HILLS VILLAGE SIGN APPLICATION© Mr . Cowan opened the discussion by reading Section 5 , para® graph 2b and Section 13 , paragraph b of the Sign Ordinance . These sections stated that a sign advertising a subdivision could be granted a permit for a period of one year . However , if such a sign were over 25 sq . ft . the Planning Board must review the application . The Beacon Hills sign would be 48 sq . ft . • Mr . Cowan presented the application to the Board . The app 1M cation had a scale drawing of the sign attached to it . Mr . Kroohs presented a copy of the 100 feet to the inch site plan on which Mr . Schlough of Beacon Hills Village had sketched the location of the sign . The sign is to be erected on the South side of East King Rd . approximately 1 , 300 feet West of Ridgecrest Road . The Board felt that the sign was in order . Mrs . Holcomb noted that Mr . Cowan or Mr . Metz should check to see that only permitted information will be on the sign . The Board could not pass a resolution on the application since a quorum was not present . Therefore , the natter was tabled until the next meeting at which a quorum was present , SPECIAL MEETING DATE , Mrs . Holcomb suggested that the Planning Board meet to pass on the Leonardo subdivision preliminary approval and the Beacon Hills Village sign application on September 4 , 1973 . Mr . Scannell and Mr . Albrecht agreed to this meeting . Mr . Kroohs will attempt to contact the remaining members of the Board . ZONING ORDINANCE .
