HomeMy WebLinkAboutPB Minutes 1971-04-06 TOWN OF ITHACA PLANNING BOARD T April 6 , 1971 The regular meeting of the Town of Ithaca Planning Board was held Tuesday , April 6 , 1971 , at 7 : 30 p". m . , in the Town of I- thaca Offices ; 108 E . Green Street , Ithaca , New York . PRESENT : Chairman Barbara Holcomb . , Dan Baker , . Jack Lowe , Maurice Harris , Robert Christianson , Fred Scott , Reg Collins , and Peter Francese ( Planning Consultant ) . Also present were about 15 residents - of the northeast area . Approval of the minutes for the March meeting was defered until next month ' s meeting . There was no report from the Park Council since they had not met this month . ZONING OFFICER - PART - TIME ASSISTANT : There was no report from the Zoning Officer , However , Barb, ara . Holcomb presented a resolution to the Board concerning the employment of a part -time assistant to the Zoning Officer . E F, i The resolution stated that the Town of Ithaca Planning Board "recommends . that the Town of Ithaca . establish . the . part - time position of Assistant to the Zoning ` Officer as an interim solution to help meet the growing demands for service from the Part - Time Zoning Officer in light of the increasing need for control of zoning violations and building supervision and in anticipation of a period of expanded activity when the new Zoning Ordinance. is enacted . It is proposed that this Assistant would carry out investi - gations and on the site inspections and such other 'routine duties as the Zoning Officer may assign him , all under the direction and supervision of the Zoning Officer . The Assistant to the Zoning Officer would not have responsibility for decision making but rather for information gathering and reporting . It is further proposed that . this - position be for approxi - mately 10 hours per week at an hourly rate of $ 2 . 50 - $ 3 . 00 with . an additional payment of 10 � per mile for transportation reim - bbursement when using a private car on the job . . It is Further proposed that the Town of Ithaca work through the Department of , City and Regional Planning at Cornell to find a student to fill the position who might find this sort of field work advantageous in his . professional training . � 4 - 2 - A motion was made by Bob Christianson that the Planning Board recommend this resolution to the Town Board . Discussion was held and it was suggested that the person chosen for this position be a full - time resident and have their own car . The motion was unanimously passed . ROLFE SUBDIVISION : Mr . Rolfe presented a proposal for a subdivision on Floral Avenue . The area is presently zoned R - 9 . He is requesting rezoning to multiple residence . in order to con - struct apartments . There is no public water available , so wells will have to be dug . The proposal calls for 12 units on 3 1 / 2 acres of land . The Planning Board will hold a public hearing on this subdivision at our next business meeting . Mr . Rolfe:. was requested to. inform all surrounding prope. rty owners of the public hearing . T;he . Board also requested that Mr . . Rolfe obtain a " statement from the Health Department concerning water on this � prope'rty . SCHOENFELD SUBDIVISION : Mr . Otto Schoenfeld presented a plan for the development of a group of town houses in the vicinity of. Burleigh Drive . The plan calls for 110 units , each to be sold separately for approximately $ 25 , 000 . Mrs . Holcomb reported that this type of construction is not permissable under our present zoning ordinance since there is no ordinance which covers this type of development . Under the present ordinance , it would be necessary to obtain a variance for the side lot or density requirements . Peter France-se will consult with the Town Attorney to . see if it is feasible to grant a variance on density and side yard require - ments . Further discussion was held and it was pointed out that pe.. rhap.s the old zoning ordinance should be amended to include this type of development since they are coming into existence all over. the country . Mr . Joseph DiGiacomo ( Winthrop Drive ) and Mr . John Tewey . ( Warwick Place ) reported that area residents are antagonistic toward the construction of this type of development in this vicinity . Mr . DiGiacomo stated that on previous occasions the Planning Board has assured area residents of the northeast that this area where the proposed construction is to to-ke place was to remain as -- a buffer zone . Mrs . Holcomb volunteered to go through the old minutes of the Planning Board to see exactly what actions had been taken . Fred Scott made a motion to table this proposal until we have the necessary additional information . The motion was . � seconded by . Dan Baker ,, and unanimously approved . r - 3 - BRINK : Mr . Millard Brink presented plans to reconstruct his barn � on - Rt . 13 . Peter Francese reported that he had checked with the power company and it would be virtually impossible to move the power lines as the Board had suggested . . Mr . ' Brink reported that he is planning to rebuild his farm approximately 100 feet from the road ( Rt . 13 ) . He will provide adequate fencing for his cattle , and will comply with rules of . the Board of Health for manure disposal . Pe.ter . Francese reported that the Zoning Ordinance only requires that construction be 100 ' back from the . road line or street _ right ,- of - way . Discussion was held , and Bob Christianson made a motion that the . Planning Board recommend to the Zoning - Board of Appeals that Mr . Brink be permitted to rebuild his barn no closer than 90 ' from the, western edge of the pavement of Rt . 13 ( presently zoned Commercial C ) or from the edge � of the traveled way of Calkins Road . The motion was seconded by Fred Scott , and unanimously approved . IDEMAN PROPOSAL : Mr . George Ideman was not present to present pans for the expansion of his business activities on . Judd Falls Road . WIGGENS PROPOSAL : Mr . Walter Wiggens presented a plan for developing his property on Danby Road . His proposal in '- cludes a plan . for a french gourmet - restaurant and multiple residence dwellings . At the present time , Mr . . Wiggens is asking for approval of construction . of the restaurant only . The area is presently zoned R - 30 . Discussion was held and Fred Scott made a motion that the Planning Board recommend to the Board of Zoning Appeals that a variance be given for the use . of the present farm house for development as the proposed exclusive restaurant by Mr . Wiggens at //S� Danby - Road . The motion was seconded by Bob Christianson and unanimously passed .
