HomeMy WebLinkAboutPB Minutes 1970-11-24 'TOWN OF ITHACA PLANNING BOARD November 24 , 1970 The regular meeting of the Town of Ithaca Planning Board was held Tuesday , November 24 , 1970 , in the Town of Ithaca offices , 108 E . Green Street , Ithaca , New York , Present : Chairman Barbara Holcomb , Robert Scanhell , Pobez Christianson , eg Collins , Dan Baker , Sam S',l.ack , Peter. Frances-e ( Planning Consultant ) , David Cowan . A motion was made by Robert Scannell to approve the minutes of the September 22 meeting . Bob Christianson seconded the motion , and it was unanimously passed . Before approving the minutes of the October 20 meeting , the following corrections were recommended : ( 1 ) the spelling of the pro- posed mobile home development should. be " Beatham " ( not Beaton- as recorded in 'the minutes ) ; ( 2 ) The last sentence in thefourth parap- graphon the Beatham Mobile .Home Development should be changed to read that Mr . Beatham ' s proposal will be taken into consideration after the new zoning ordinance goest into effect . - ( 3 ) The word " screening." was misspelled in the section of the P &. 0 screening . The minutes were then approved as corrected . Kennilworth Associates : Discussion was, held about the proposed: development y enni wor ssociates at the corner of Judd Falls and Ellis Hollow Roads . The assumption is that municipal sewer service will be available , and also that a sufficient water supply will be available . There remains a question about .this since the developers have changed their plans and now- intend. to -also construct multiple residences , It was. decided that the Board would like an engineer ' s state- ment that sufficient water will be available and also a statement from the Health Board about the quality of this water . Barbara Holcomb recommended that we also obtain a . defiriite statement ( prefer- ably in A letter ) from the& City of Ithaca that they will provide &.9wor service to this development . A resident of the area stated that she and several other residents of this particular area �are very displeased with the quality of the shops to be housed in this development . Peter Fran - cese explained that the Planning Board has no power to control the shop ' s quality or to select the tenants in such a ' development . It was pointed out that the Board should work toward having more archi - tectural control in this and other similar situations . It was pointed out that when the Planning Board changes the . Zoning Ordinance ., it is on the basis of plans that were presented to the Board,. When these plans are not adhered to , the change in zoning 2 - • should no longer be in effect . When there: is, a breach, of faith , any previous action by the Board should: be rescinded . Barbara Holcomb Volunteered to go through all .the old minuteg. of the Planning Board and the Town . Board to..,see What Legal action. .was taken on this project and will report at the :next Piairing. Board meeting . Peter Francese suggested,- that another .publ e ;hearing. on-. the: Kennilworth Associates final plan be held at our next regularhy scheduled meeting,. Sam Slack solmoved . Danby Road :, The land is zoned for c`ommerc'ial use . Discussion was held on this. proposal .and• David Cowan pointed out that according to the :Zoning Ordinance.,, ;such A. ;development can,be constructed since multiple housng: ean be built only in resi - dential and/or agricultural districts . This area is presently zoned commercial: and cannot be rezoned since it is less than 1/2 acre . Therefore , residential housing cannot be built in this area . A question was raised about the requirement of parking space's for multiple residences . According to the present Zoning Ordinance , one parking space per unit is required . HOWever , under the new Zoning Ordinance , 1 . 5 spaces per unit will be required . Snowmobile legislation : According to legislation recently passed by the State of 17e`w ®rklt snowmobile operation is prohibited on all highways and Town roads unless specifically authorized by individual municipalities : A particular town may specify certain roads grid specific times which snowmobiles may operate on . This must be passed by the Tow' Board : If no action is taken , snowmobile operation is prohibited on all town roads and highways . Snowmobiles are also prohibited on all private property un- less permission has been given by the owner to use his property . Robert Scannell recommended that we have snowmobile users come in with a proposal stating what roads should be open for snow - mobile operation based on such factors as traffic counts , etc . It was reported that Mr . Schwan had received a letter from Mr . A . Adams listing road recommendations bas.ed on discussion he had had with snowmobile clubs . Peter Francese will request that before any action is taken by the Town Board on this matter they refer it to us for our recom4 mendations . Discussion was held about the possible use of railroad right - of- ways for snowmobilers and bicyclers . The Park Council is presently pursuing uses of all right - of=ways . It was reported that after January 1 , 1971 , snowmobiles will no longer be considered a motor vehicle . Anyone over 14 years of age will be allowed to operate a snowmobile , as well as anyone between- the ages of 10 and 14 who has had a course in snowniabile Operation . Snowmobile operators must carry liability insurance . It was suggested that the Board also make recommendations of time limit on snowmobile operation by specifyIng certain hours for operation . Discussion was held about the proposed new zoning ordinance . It was decided to hold a special meeting for further discussion of the ordinance on Tuesday , December 8 . This will be a working meeting and will not be open to the public . It was recommended by Barbara Holcomb that the Board meet at 7 : 30 for our regular meetings , but not schedule public hearings until 8 : 00 p . m . This will allow the Board time to do general work which is often left to the end of the meeting . • 4 There was no report from the Recreation Board this month since they had not had a meeting this month . ' . Peter Francese reported on the new ruling that the county planner must approve any new zoning changes , with few exceptions . If the county planner objects to some rezoning , it will take a_ 4 out of 5 vote from the Town Board to over - ride his vote . ( Previously , a 3 out of 5 vote was required to rezone . ) The meeting was adjourned at 9 : 30 p . m . Sam Slack so moved . The motion was seconded by Bob Scannell and unanimously passed . This public hearing will be on Tuesday , December 5 , at 7 : 30 p . m . Further discussion was held on the question of changes made in the Kenilworth Development after it had been approved by the Board . It was pointed out that although the Board cannot control the tenants in such a development , the general character of the proposal should remain the same as originally presented to the Board and citizens at the public hearing . A question was raised about the road problems that this development may create . The road will need to be changed to meet increased traffic needs and to prevent it from becoming a hazardous area . Ben Boynton re - ported that Kenilworth had looked into this . matter and had done engineering 40 work that had been requested of them . " ' The entrances were also changed as r equested . It was decided to hold further discussion until the public hearing at our next meeting . Cowan : David Cowan , Zonin Officer , reported that screening had almost immediately been put up on the aAak property as requested by the Board . He is still conferring with Ideman on the question of planting trees . Yaman Proposal : Mr . Paul Yaman would like to construct eight ( 8 ) apartment units on approximately one - half acre of land near the inter - section of King Rd . ( West ) and Danby Road . The land is zoned for commercial use . Discussion was held on this proposal and David Cowan pointed out that according to the Zoning Ordinance , such a development cannot be constructed since multiple housing can be built only in residential and / or agricultural • + J districts . is area is presently zoned commercial and cannot be rezoned since it is Tess than 1 / 2 acre .
