M . on June 11 , 1968 . Members Present : Chairman Desch , Members Vasse , R . Collins , Scannell , Phillips , also David Cowan , Zoning Officer . Members Absent : Schwan , Baker , Lacy . Also Present : Mrs . Livesay , Mr . Gordon , Mr . Austin , Mr . Gaydosh and Mr . Frandzen . F2ANID5CN FR°-�R, 4944ZW SUBDIVISION - Final Approval Phase I od Mr . McNeil , engineer and Mr . William Fran 3l55en presented the final plan for Phase I of the subdivision south of and adjoining the Eastern Heights Subdivision . Phase I consists of 6 lots on the extension of Park Lane . The developer is also seeking preliminary approval of the remaining portion of the 62 lot subdivision 34 acres . The area is i; n an R- 15 zone . At - the time of the schematic presentation the developer was asked to make several modifications of the connecting street intersections and to further investigate the drainage situation . The engineer reviewed the drainage program with the chairman and the State Highway Department Engineer after the schematic presentation . The park proposal was discussed at length and members Scannell and Phillips had some reservations about the back lot play park shapes and sizes . The public hearing was closed at 8 : 00 P . M . Mr . Phillips moved that final approval 'be granted to Phase I contingent upon approval by the city and the county Health Department of the water and sewer plans . Motion seconded by Vasse . Approval unanimous . - Mr . Scannell suggested that the Phase II park question be restudied and he voluntered to look at some possible alternatives and to present these to the board at the July meeting . ROAT STREET , - ENIDE-E6C-ADO Mr . grade l=am o representing Highland Road Construction Co . requested the Planning Board to express its opinion concerning the possibility of developing 2 large '. ots at the west end of Roat Street . He presented a map of the two parcles involved as made by Carl Crandall June II , 1964 ( lots 474 and 477 and lots in question ) . The ma n item of concern to the board is the question of access to the lots . Except for a 15 foot strip from Roat Street there is no direct access . There is also some question about the description of the property at the east end . At present the property pipes cannot be found and there is a garage apparently overlapping the property . ' Planning Board Minutes June II , 1968 Page 2 The Planning Board recommended to the developer that he obtain enough property from the adjacent owners to create a 50 foot " Y " connection to Roat Street . The property within this 50 foot " Y " would then be deeded to the Town to create a decent turn around for maintenance equipment . The board also suggested to Mr . Cowan , the Zohi. ng Officer , that he report these + recommendations to the Zoning Board . Mr . Gordon and Mr . Austin appeared in opposition to the development . EASTERN HEIGHTS SUBDIVISION - PHASE II Mr . Thaler and Mr . McNeil presented the final plan for the subdivision on Snyder Hill Road . The plans indicated the modifications requested at the Preliminary submission . The chairman reviewed the proposal with the developer and expressed concern about the steep streets dead ending directly across from house sites . Thtis problem has been corrected by the developer by offseting the lots . The developer submitted a letter informing the Planning Board that he would dedicate a 2 acre Park on the north side of Snyder Hill Road when that parcel was. developed . After considerable discussion the board moved the proposal be approved with the following contingency ( Motion by Scannell second by Phillips ) • The developer shall dedicate an area to the Town on the north side of Snyder Hill Road ( adjacent to the road ) in the 27 acre undeveloped parcelfor the purpose of developing a park . This area shall be a minimum of 5 acres and shall be dedicated to the Town prior to sale of more than 70% of the lots In the Eastern Heights Subdivision . Approval for the development on the parcel on the north side of the road shall be contingent upon the acceptable design of this Parkarea as required by the Planning Board . EASTERN HEIGHTS DEED - OPTION CLAUSE The board discussed the clause in the Eastern Heights Deeds which makes reference - to the home owner having the privilege of selling the house to the Eastern Heights Development Corporation in the event that the homeowner was required to move unexpectidly . The question of legality was raised and how this relates to the question of potential future upgrading or downgrading of the area . The board asked the chairman to confer with the Town Attorney on the matter . � _ J • i r . Planning Board Minutes - June II , 1968 Page 3 LANSING APARTMENTS EAST SWIMMING POOL LOCATION ° i Messrs Talandis and Nangorni requested that the board approve a location for the swimming pool which is different than the one the board had authorized at the time of final approval . The new location is south of the Lansing East access } drive a distance of 60 feet ( minimum ) from the south property lines and 360 feet west of Warren Road . This location is in an area which the developer has already established as a park . The pool will not disrupt the use of the remaining park area . This is recorded on a map of the Lansing East Site now on file in the Town . Motion made by Phillips seconded by Vasse that the alternative site be approved . The meeting adjourned at 10 ; 30 P . M .
