Others Andres Perez-Charneco , Tompkins Weekly. Call to Order Supervisor Valentino called the meeting to order at 5 : 30 p . m . and led the assemblage in the Pledge of Allegiance . Board Comments Supervisor Valentino brought the Board ' s attention to the guidelines and instructions for dealing with union recognition that was on the table when they arrived . She reported that the Town received a letter from the Teamsters Union requesting recognition for the Town ' s water, sewer, and highway employees . Supervisor Valentino commented that the Board should proceed as they have in the past because there is no recognition at this point . Susan Brock is researching it and will have more information at the November 19th board meeting . Councilman Engman proposed that the Board meet as a committee of the whole within the next month to talk about the board transition , committee structure , and other issues board members might want to bring up . He suggested that it be held in the back conference room so that it' s more informal with the public and the two new board members invited to attend . Councilman Burbank thought that it was a great idea and that it would be beneficial for the Board . Other board members concurred . Agenda Item No. 12 — Discussi g on and Consider Approval of 2008 Health Insurance Rates Approved on November 19, 2007 Page 1 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 Ms . Drake brought the Board ' s attention to the quote included in their packets . It is an 11 . 4 % increase . Councilman Burbank noted that the biggest increase proportionally was . in the rate for double . Ms . Drake commented that the rate for double is approximately twice the rate for the individual and added most plans have individual or family coverage . The Town has double coverage because there is approximately a one-third split , which helps reduce the costs on double coverage . If the Town did not carry double coverage , then the family rate would be more . Supervisor Valentino moved the resolution to accept the 2008 health insurance plan . Councilman Cowie seconded . Carried unanimous . TB RESOLUTION NO. 2007 479 — Approval Health Insurance Plan for 2008 WHEREAS, the Human Resources Manager has received the annual renewal for health insurance for 2008 from Excellus BlueCross BlueShield of Central NY for the BluePPO Option H Plan, which resulted in a increase of 11 . 4 % for monthly premiums; and Individual Double Family 2008 $ 441 . 42 $ 905. 78 $ 1, 301 . 28 2007 $ 396. 25 $ 813 . 09 $ 1 , 168. 12 Increase $ 45. 17 $ 92. 69 $ 133. 16 WHEREAS, the Personnel Committee has discussed the rate increase and plan, and recommends no change to the plan; and WHEREAS, Town Board has discussed the increase as outlined by the renewal for 2008, and wishes to enter into an agreement with Excellus to provide the outlined BluePPO Option H Plan with no changes; and Now, therefore, be it RESOLVED, the Town Board of the Town of Ithaca does hereby authorize, and direct the Town Supervisor to enter into an agreement with Excellus BlueCross BlueShield of Central NY to provide the BluePPO Option H Plan for health insurance coverage for the employees, elected officials, and retirees upon the advice of the Attorney for the Town and the Human Resources Manager; and be it further RESOLVED, Employees, Elected Officials, and retirees shall contribute based on the percentages prescribed in the Town 's Personnel Manual. Absent: Councilman Stein Agenda Item No . 13 - Discussion and Consider Approval of 2008 Dental Insurance Rates Supervisor Valentino reminded everyone that employees pay the full cost for dental insurance . There are approximately 23 employees with dental coverage . The rate increase for 2008 is 5 % . Supervisor Valentino moved the resolution to accept the 2008 dental insurance plan . Councilman Burbank seconded . Carried unanimously . TB RESOLUTION NO. 2007= 180: Approval of Dental Insurance Plan. WHEREAS, the Town Board of the Town of Ithaca wishes to continue the agreement with Guardian, to provide dental insurance for certain Town of Ithaca employees, retirees and elected officials; and WHEREAS, the quote from Guardian increases the individual and family monthly premiums for 2008 by 5%, the rates are as follows: 2007 $34 . 52 Individual $93. 27 Family 2008 $36. 25 Individual $97. 94 Family Increase $ 1 . 73 $4 . 67 And WHEREAS, the Town Board has discussed the coverage and the premiums as outlined above; Now, therefore be it RESOLVED, the Town Board of the Town of Ithaca does hereby authorize and direct the Town Supervisor to enter into an agreement with Guardian to provide dental coverage for certain Town of Ithaca employees, retirees and elected officials upon the advice of the Attorney for the Town and the Human Resources Manager; and be it further RESOLVED, all participants are required to pay 100% of the monthly premiums. Residents have until . October 15th to pay their water and sewer bill . Any bill not paid by then is put on the tax roll to be collected as taxes . Absent: Councilman Stein Other Business — SPCA ( See attachment #2 ) Supervisor Valentino brought the Board ' s attention to the Memorandum of Understanding with the SPCA on the table when they arrived . The MOU was put together by a subcommittee of the Council of Governments that met with the SPCA. The SPCA agreed to extend the current contract through March 31St and the towns would pay on a pro-rated basis . The Council of Governments setup a subcommittee to draft A Request for Proposals . Steve Whicher and Jackie Kipola from the County have been assisting the subcommittee with the RFPs . The subcommittee will meet to finalize the draft and then take the proposal to the Council of Governments for approval on November 29th . Supervisor Valentino added that all municipalities have agreed to the MOU except for the Town of Groton because they have found another provider. Supervisor Valentino commented that the Council of Governments' meetings have a spirit of cooperation amongst the members . Councilman Engman added that a few people were wondering how much it cost the SPCA to take out a full page ad in the Ithaca Journal . Walter Lynn , Village of Cayuga Heights Mayor, checked into it and the cost was between $3500 and $5000 . Councilman Engman commented that despite the SPCAs insistence that they did not particularly care whether they retained the dog control function , they spent a substantial amount of money to try to lobby the municipalities to do so . Supervisor Valentino explained that they have received some of the SPCAs financial records and board members are welcome to come in and look at them . She has talked with Steve Thayer, City Controller, and Steve Whicher, County Administrator, about the records . They feel that they need to talk to the SPCA some more because some of the ways they are distributing their overhead costs for their facilities are questionable with regard to how much they are saying are municipal responsibilities . It also looks as if municipalities are being charged for .cats to some extent even though only the County has a cat contract. Councilman Engman added that County staff had researched what other counties are doing . There are a couple of counties where the county runs the system for all the towns . It is a county run shelter. There are many models as to how dog control can be done . Supervisor Valentino stated that the SPCA and the municipalities seem to be on the same page of trying to figure out what is going to work best for the community . Councilman Engman commented that if the Town Board agrees with what the Council of Governments has set forward , it obligates the Town to increase its contribution for the first few months . Then if the decision is made to go with the SPCA , then the Town would jump up to the full doubling that was proposed . It seemed to Councilman Approved on November 19, 2007 Page 9 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 Engman that the Town should have the money in the budget just in case . If the towns go out to bid , it is hard to tell what the cost would be . Supervisor Valentino explained that she did not put an increase in the budget because the Town has an adequate fund balance . They are able to do a budget amendment to transfer the money. Councilman Burbank understood the rationale , but thought it would be more prudent to include it in the budget because the cost is going to increase significantly. Supervisor Valentino responded that it would be about a 2 % increase in the tax rate . She added the Board would not be able to approve the budget at this meeting because a public hearing would need to be held to increase the tax rate . Councilwoman Leary commented that Supervisor Valentino has looked at the SPCA financials and that there were questions about the accounting . She asked if Supervisor Valentino was comfortable in doubling the cost of the contract if nothing is found . Supervisor Valentino would rather wait and see because there are a lot of variables. Councilwoman Leary stated that she was talking about agreeing to the MOU because if the Town agrees to it , then they are committed to doubling the contract if it doesn 't work out . She is not real happy committing ahead of time to the doubling . Councilman Cowie asked if after April [2008] the Town could bargain for something better. Supervisor Valentino felt that there was a good chance that they would be able to do that . Councilwoman Leary asked what motivation the SPCA had to negotiate 175 % if the Town is already committed to 200 % . Supervisor Valentino did not think it affected the bargaining that much . In her mind , because they don 't know for sure what the contract is going to look like or what another year' s budget would look like , she felt more uncomfortable about raising the tax rate for something that the Board is unsure about at this point . Councilman Engman added that the other factor mentioned at the Council of Governments meeting was the SPCA considers itself to be making a sacrifice for the first few months to give municipalities the time to adjust and they are taking less than they think they need . That is the part the SPCA is saying they are willing to compromise . If the Town decides to stick with the SPCA , then that is when the full amount would come due . It may well be that the municipalities and the county may decide to go a different direction and therefore that is the part that then becomes negotiable . Councilman Engman explained that the other thing that could happen since there will be an RFP process is people will come back with bids to run it . So that will be part of the determining factor. It doesn 't mean that the Town is obligated to go with the SPCA at the full amount after this period of time . There are other options that will be considered . Councilman Cowie asked if Supervisor Valentino and Councilman Engman regarding the possibility of going with the SPCA , but not at the 200 % rate after April . Supervisor Valentino thought there was a possibility of going with the SPCA , but not at that full amount . They might be able to work something out with them , but she does not know that for sure . She asked what motivation other bidders would have to give a substantially lower bid . Other bidders might bid just under what the SPCA contract would be . Councilwoman Leary reiterated she was uncomfortable having a committed amount in the MOU of 200 % . Supervisor Valentino explained that the Town is only committed for the 3 months . Councilwoman Leary was concerned about what happens after the 3 months if they fail to find another party to contract with Supervisor Valentino saw Councilwoman Leary' s point and explained that the MOU is not binding . Her understanding was if an agreement is not met , the SPCA was making clear that this would be the cost . Councilman Burbank had been concerned about there being an institutional provider , which is why he has such a high comfort level with the SPCA. He is loath to consider going to an individual provider, who might on a given year , come in with a lower bid , but could be out of business the next year , or cutting corners . Councilman Burbank asked if the RFPs could be structured so that they were only asking for institutional providers . Supervisor Valentino thought that it had to be open , but the proposal could be rejected . They ( Council of Governments ) are asking for references , financial information , and other information that verifies the ability to perform the service . Councilman Cowie agreed with Councilman Burbank about having an institutional provider. He was encouraged that there was a high degree of cooperation and is hoping that it can continue on other issues . He asked if there was a comparison made on what other municipalities pay per capita for dog control . Supervisor Valentino was hopeful that the Council of Governments would be able to do that and come back to the municipalities with a lot of information to answer the questions that have been raised . Councilwoman Leary asked if the Town could go back to the Council of Governments with a slightly amended version of the MOU . She would like to add , " no more than" before 200 % in the MOU . It would read , " no more than 200 %11 . Supervisor Valentino said she could try to have the language added . Councilman Burbank brought everyone' s attention back to the budget and stated that he would prefer to build funding into the budget . However, if it is the only item that tips the budget into increasing the tax rate , then he would yield to the wisdom of taking it out of the fund balance . Councilman Cowie asked if the Board could be reminded of how much a 50 % increase and a 100 % . increase was . Mr. Carvill responded that the SPCA wants to increase to $41 , 700 and the Town currently has $20 , 700 in the budget . He calculated the cost to be approximately $ 7 , 000 for January — March 2008 , The Board discussed the pros and cons of putting the full amount into the budget versus taking the amount out of fund balance . The Board members concurred not to include the full amount in the budget . Councilman Burbank wondered what would happen if the Town of Ithaca chose not to adopt a change in the water rate , but the other Towns adopt the change . Mr. Tunison explained that all municipalities need to approve the water rate . Councilman Burbank asked if the Town were to object , would it need to go back to the other municipalities for discussion . Mr. Tunison further explained that if the water rate was not increased and there was a shortfall of funds as a result , then each of the 5 municipalities based on their consumption over the past 12 months would be responsible for making up the shortfall . Carried unanimously . TB RESOLUTION NUMBER NO. 2007- 183 : Approving Amendment to the Southern Cayu_ga Lake Intermunicipal Water Commission Agreement Increasing the Water Rate Charges. Councilman Burbank commented that a month or so ago there was an upset resident regarding a street light that had gone out and not been replaced . At the time it seemed like the Town ' s link to the electric company to remedy that was not as good as it could be . He asked if the situation had been improved . Mr. Noteboom responded that staff was able to take care of it for the resident . Most of the work for the evaluation is going to be done by the Tompkins County Area Development , but they need to have a letter of support from the Town . Councilman Engman further explained that the evaluation is intended to connect water and sewer with development . In other words there is a realization that where water and sewer go , development follows . Therefore , it is necessary to know where the infrastructure is and look at the full picture . Then , hopefully , development could be steered to where it should be across the county . Councilman Engman thought there might be some proposals for where it should go rather than where it might go without a plan . Supervisor Valentino was willing to sign a letter of support from the board . Mr. Walker added that the City looked at the impact of providing sewer in the Town of Lansing . So there is a lot of data to be looked at before the study begins . Supervisor Valentino stated that Don Hartill had brought that up during the meeting and she will follow up to make sure the other data is used . Mr. Kanter added that the Economic Development Collaborative has been talking about the study as well . One of the reasons they initiated the study was because they were fully aware of the Lansing sewer study. He thought the study would also include other hamlets and more remote areas , where there is not currently adequate sewer or water to further the County Comprehensive Plan ' s goals . Supervisor Valentino wrapped up the discussion stating that she would put together a letter of support from the Town of Ithaca . With no one interested in addressing the board , Supervisor Valentino closed the public hearing and brought the issue back to the board . Supervisor Valentino explained that in response to Councilman Stein ' s concern over using the fund balance to maintain the fire tax rate , she is proposing that the fire tax rate be increased from $ 3 . 74 per thousand dollars of assessed value to $3 . 92 per thousand dollars of assessed value . The increase covers two new fire fighters for half a year and equipment replacements . Mr. Carvill stated , "without using any fund balance, the board is looking at an increase of approximately $ 0 . 26 per thousand dollars of assessed value . However, at the last board meeting the board expressed interest to retain some monies to meet some unanticipated , ensuing need . Therefore , reflecting back upon that , rather than using up the total $282 , 000 of accumulated fund balance , which is a direct result of assessments over the past few years of going up without moving the fire tax rate has accumulated some money. The fund has also made $ 100 , 000 of interest income over the last two years . $ 192 , 000 was used to meet this year' s cost without raising the tax rate to $4 . 02 . This means an additional $ 53 , 000 of the fund balance was used to try to compensate so that the taxpayer would not feel a huge increase in one year, but in the ensuing year there is the potential for an additional increase between $ 0 . 26 and $0 . 18 . There is a $ 0 . 07 potential that may exist in 2009 . " Councilman Engman was concerned about the amount of appropriated fund balance for fire protection in 2007 was $ 101 , 000 and then for 2008 would be $ 123 , 000 . Then the preliminary for 2009 is $ 181 , 000 . So the trend is to an increasing use of the unexpended fund balance , but there will only be $ 100 , 000 . He asked if the assessments would have to increase substantially in order to make up the difference . Supervisor Valentino responded the county is saying that the assessments are going to Approved on November 19, 2007 Page 19 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 go up because assessments have been held at 85 % for 3 years . Notices will be mailed in January of increased assessments . Councilman Engman thought that it was taking a chancy proposition . Supervisor Valentino offered another back up solution to a shortfall . She explained that sales tax money from the general fund can be used to supplement the fire fund . Councilman Cowie stated that they also needed to look at the cost pressures coming from fire protection itself. Those requirements have a huge impact on costs . He wondered if the Town could start a dialog with emergency service personnel . Supervisor Valentino responded that they have met with them this year and they have been looking at ways of minimizing that response , but there are mandates for responding that need to be followed . Councilman Engman added that in discussions over the new countywide emergency response system , he asked Brian Wilbur if that might lead to less of this because then everyone can communicate with one another. Mr. Wilbur indicated that it might , but Councilman Engman thought it was necessary to keep suggesting that it would be a good use of the new system . Mr. Walker stated that the issue with the Ithaca Fire Department is staffing and equipment . Station 6 has 2 people on a shift with one engine . Four people are really needed because 2 people go into the building and 2 people serve as backups on the outside . If there is a rollover or car fire , they are going to protect the public . The problem is they cannot send 4 people in one truck because they don 't have the staffing . Councilman Cowie did not have a problem with the personnel needed at actual events . Mr. Walker added that through the years all volunteer programs have been eliminated , which was the way they used to get manpower to the site . Absent: Councilman Stein Agenda Item No . 9 - Public Hearing to Consider Adoption of 2008 Town of Ithaca Preliminary Budget as the 2008 Final Budget Supervisor Valentino opened the public hearing and invited members of the public to address the board . With no one interested in addressing the board , Supervisor Valentino closed the public hearing and brought the issue back to the board . Supervisor Valentino walked the board through the changes that were made to the budget before it was adopted as the 2008 Preliminary budget . The Preliminary budget includes : $3 . 92 fire tax rate , shortfall of $50 , 000 in the Part-Townwide fund , an additional full -time Code Enforcement Officer, an additional full -time Planner, and the salaries for the elected officials and staff. Supervisor Valentino requested that $ 50 , 000 be taken from the Part-Town Highway Fund and move it into the Part-Townwide Fund to cover the shortfall . The board decided to discuss wages before proceeding with adoption of the budget . Agenda Item No . 11 - Discussion and Consider Approval of Employee Wages for 2008 ( See attachment #7) Ms . Drake introduced the agenda item to the board and directed their attention to the materials in their packets . The spreadsheets reflect a 2 . 2 % increase over 2007 wages , as approved at the October board meeting , a Code Enforcement Officer at fulltime , a Planner position at fulltime , and 2 additional fulltime seasonal Public Works employees . The average increase is 6 . 4% over 2007 . Supervisor Valentino stated that she felt a 3 % increase was a more appropriate wage increase for the employees than 2 . 2 % . Councilman Cowie responded that the board has been wrestling with the cost of living adjustment problem since he has been on the board . He offered two ideas to the board . The first being adjusting the increase closer to 2 . 7 % . Second , have the board direct the Personnel Committee to find a system that may use the CPI as a basis , but has other criteria as well . He would like to establish a system that rewards longevity and similar things . Councilman Engman thought that going to a formula was a cleaner and clearer way of predicting what the cost of living is over time . It does have drawbacks ; one being it looks at the past and not to the future . He felt that the board has always been aware that the formula may not be the right one or it may need an additional component to it for it to be accurate . Councilman Engman also thought the board needed to look at the comparability study that is done every few years to compare where the Town is with regard to similar municipalities . He agreed with Councilman Cowie ' s suggestion Approved on November 19, 2007 Page 21 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 because the formula may not be good enough yet . Councilman Engman added that he talked earlier with Mr. Kanter and he made the point that when there is a hard and fast formula , it takes out any element of discussion with staff. Councilman Engman thought this was a good point because there should be mutual discussion with staff throughout the process . The hard and fast formula decreases communication . Councilman Cowie agreed with Councilman Engman , but was troubled by the connection between the comparability study and the cost of living adjustment . He felt that the board needed to proceed with caution with that linkage . Councilman Cowie gave the example that the town is paying 5 % more for labor than the comparable municipalities . Would that then mean less of a cost of living adjustment for those individuals? He thought it could be used for setting a comparable wage structure , but after that the cost of living adjustments should be based on a formulated or negotiated basis . Councilman Engman responded that separating the two works if the Town was falling behind what the comparables are , but if the Town is ahead of the comparables , how is it adjusted . Councilwoman Leary added that the Town needs to be careful about what towns are being called comparable and make sure the towns used are truly comparable to the Town of Ithaca . She further stated that the comparability and cost of living adjustments should be linked consistently. Councilman Engman agreed . Supervisor Valentino thought there was another element that the Town might not be looking at closely enough . The Town of Ithaca has strived to keep its workforce small and there has been a tremendous amount of cross training . When someone is out for a long period of time , existing staff is able to fill in for the person without having to hire additional personnel . She was trying to think of how that could be taken into consideration because job descriptions do not always tell the expectations . One way to look at it is there are some municipalities that have a lot of staff because their staff isn 't as productive . She further explained that it is an important component because it keeps the costs down ; staff likes it because they get more interesting assignments , the productivity and morale is higher. It may mean that employees are the highest paid in the county , but it does not necessarily mean that the Town ' s cost per employee is higher than other municipalities . Councilman Cowie responded that they have looked at every possible comparable and the comparable indicate that the Town is in a good position . He asked Ms . Drake if they compared the ratio of staff to the population of the Town . Ms . Drake responded that they had not because some municipalities have fire and police services . Councilman Cowie added that there is no doubt that the Town has an extraordinary staff. Councilman Burbank brought the board back to the COLA issue . He thought that the board had identified that they are not comfortable with their overall system . The essential issue for the budget is how to keep the employees approaching COLA so that Approved on November 19, 2007 Page 22 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 they are not slipping backward . He shared the concern that 2 . 2 % seems disconnected from the emerging reality and thought they are entering scary economic times . It is going to affect employees and taxpayers . The board ' s job is to create a balance . Supervisor Valentino pointed out that the majority of the employees . are not in the A- Fund paid by the taxpayers . The majority of employees are in Highway and Part-Town , which are not funded by tax dollars but from other sources . Councilwoman Leary thought that was a good point . Supervisor Valentino asked Councilman Cowie if he would like to make a motion . He moved the resolution and suggested that the language in the proposed resolution be changed . Instead of reading , " hereby approve the said wages" change it to read , " Resolved that the governing Town Board of the Town of Ithaca does hereby approve a 2 . 7 % wage increase for the employees of .the year 2008 for the final budget as filed in the Human Resource Office" . Councilwoman Gittelman seconded the motion . Supervisor Valentino asked if there were any additional comments . Mr. Kanter commented that he thought the staff would appreciate the discussion of the board . There had been a lot of concern on the part of the employees and Mr. Kanter really appreciated the board considering the percentage increase . Supervisor Valentino encouraged the new board to look at the issue further and to engage staff in discussions . RESOLUTION NO. 2007- 188 - Approval of Year 2008 Employee Wages. WHEREAS, the governing Town Board of the Town of Ithaca has reviewed the proposed wages for the Town of Ithaca employees for the year 2008 as presented to the Board Personnel Committee (see attachments); Now, therefore, be it RESOLVED, the governing Town Board of the Town of Ithaca does hereby approve the said wages for the employees for the year 2008 for the Final Budget, and as filed in the Human Resources Office . Ms . Drake suggested the board move on to another agenda item so she could research whether or not the increased salaries would need to be re- published . Agenda Item No . 20 - Discussion and Consider Adoption of 2008 Town of Ithaca Preliminary Budget as the 2008 Final Budget Councilwoman Leary suggested that the Town make a gesture of support to the County Library . Supervisor Valentino said she agreed that the Town should pay something towards the library, but there needs to be a broader discussion - regarding who is paying what and who is responsible for what . Each year the Town ends up in an unfriendly atmosphere with persons coming before the board . Her hope was that instead of giving the library $5 , 000 that the Town helps to form an intermunicipal committee to analyze who is paying what and make recommendations about funding . Councilman Engman agreed that the discussion needed to be opened with the other municipalities , especially the County and the City . He thought it would be easier to make the argument for discussion if the Town gave a minor one-time contribution to show good will and good public relations with the other municipalities . Councilman Engman suggested that $5 , 000 be given to the County to be used for the library . Councilman Cowie agreed with Supervisor Valentino and stated that without clarity it seems like they are enabling a bad system . He asked Councilman Engman what the difference was between giving $5 , 000 as opposed to saying the Town is willing to do something together. Councilman Engman explained that the Town is not necessarily willing to do anything . The Town might say after the discussion that the library is the county' s responsibility. He thought it was a show of good faith to give a minor amount in order to smooth the way to the discussions . Otherwise it could be interpreted that the Town only wants to have a committee so the cost could be shifted to someone else . Councilwoman Leary was persuaded by the basic argument that other towns do have satellite libraries . Supervisor Valentino interjected that the satellite libraries are funded by the county. Councilwoman Leary stated that she objected to the way-out-of- proportion suggestion that was made to the Town , but she did agree with the principle . Supervisor Valentino thought that the Town needed to be careful when making a contribution because it is her experience that once the door is opened with a contribution , it is hard not to continue with the contribution . She did not know what the $ 5 , 000 would do . Councilwoman Leary responded that it would help the library. Supervisor Valentino suggested that Councilwoman Leary make a motion that the Town make a $ 5 , 000 one-time contribution with the understanding that there will be a study made of contribution funding of different agencies . The board agreed and suggested that the motion include language stating that the Town works with the Council of Governments to explore the funding and appropriate share by municipalities of those agencies . Councilman Engman seconded . Supervisor Valentino reviewed that the Town was giving $ 5 , 000 to the County for the library with the understanding that it is for 2008 only. Councilwoman Leary added that the Town should be clear that $5 , 000 should not be subtracted from the County' s contribution to the library. The board discussed the legal requirements of funding outside agencies . Ms . Billings prepared a draft resolution based upon board discussion and offered to read the resolution language . The board discussed the proposed resolution and settled upon the following language : "to give $5 , 000 to the County as a one time contribution for the library with the understanding that there will be a study working with the Council of Governments to explore the appropriate share of funding by municipalities of agencies and facilities , and with the understanding that this will be in addition to the money already budgeted by the County in 2008 to support the library" . Councilman Cowie asked if more of these items are going to be brought up for discussion . Councilwoman Leary said that she had been thinking about TCAT . Supervisor Valentino responded that all municipalities agreed not to do anything with TCAT at this point. Councilwoman Leary stated that she would never think of putting in the funding to be an equal partner , but she thought that it might let the Town have a little more influence as a stakeholder if they put in some money . Supervisor Valentino explained that the Town is already having a lot of input through the TGEIS project and the Transportation Committee . She did not feel giving them any money would help the Town to do anything . Councilman Engman interrupted with a point of order stating that there was still a motion on the floor that needs to be voted upon . Councilman Cowie disagreed because the board was discussing a general problem . Supervisor Valentino added that the board is discussing items that will directly increase the property tax. She was going to vote against funding the library and felt that the study was important . Funding the agencies would make the dynamic worse ; the problem needs to be faced head on . Councilwoman Leary would like to see TCATs structure move in a direction that allows municipalities to make smaller contributions and not be a full member. It is currently set up as all in or all out. Supervisor Valentino thought Councilman Cowie wanted to know if there were other things anyone was thinking about adding to the budget. She reviewed the items she outlined at the beginning of the budget discussion . Councilman Cowie stated that he Approved on November 19, 2007 Page 25 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 would be voting against the funding because he did not think this was the way government should work . The Town needed to figure out the funding . Councilwoman Leary stated that she was against the funding of the youth employment program passed at the last meeting because she thought it was a little peripheral to the Town ' s main business . She suggested that the funding of that program be cut if additional monies were needed . Councilman Cowie said that they were Town residents . Supervisor Valentino added it was youth development and the Town is in the business of helping youth . Councilwoman Leary countered that a line needs to be drawn at some point . Councilman Cowie thought it was a valid debate , but for him it wasn 't about the money. It was about the operation of government and intermunicipal cooperation . Councilman Engman thought that the board should acknowledge that Town residents use the library and use TCAT . There is a great demand for more TCAT services in parts of the Town . He has heard that there are too many buses that do not have any business in Forest Home continually going across the bridges . The buses are empty. For the Town to have some impact , there needs to be some indication that the Town is willing to make some movement . It is what intermunicipal cooperation is about . Councilman Engman disagreed with the idea that somehow it is bad management to put forth a little effort and a little sacrifice in order to promote better intermunicipal cooperation on the library and on TCAT . Supervisor Valentino thought Councilman Engman misunderstood her because she didn 't say there wasn 't money to fund the library and TCAT . She did say that the fund balance was available if it was needed and felt that her suggested approach was logical in dealing with inconsistencies that the Town is looking at . Supervisor Valentino agreed with Councilman Engman that the Town needs to find ways to have their voice heard with TCAT or any other agency , but she did not think that giving them a small stipend of money would get the Town there . Councilman Cowie thought $5 , 000 did not seem serious . What seemed serious was to approach them and initiate discussions . Supervisor Valentino would be happy to raise the money with a plan . Councilman Burbank called the question on the proposed library motion . Councilman Stein, absent. Motion Failed Supervisor Valentino asked if everyone understood what was in the budget. Ms . Drake asked to be recognized . She had information regarding raising the wages of elected public officials after they had been advertised . The wages could be raised , but it would require a local law and a public referendum . [ Board laughed in response. ] Councilman Burbank stated that it presents a process problem because the board had tried to link the wages . Ms . Drake explained that the board is a meeting behind where they typically discuss salaries and reminded the board that a resolution needed to be passed for the elected officials' salaries . Councilman Cowie moved the resolution adopting the elected officials' wage for 2008 at a 2 . 2 % increase . Councilwoman Leary seconded . Absent: Councilman Stein Agenda Item No . 20 - Discussion and Consider Adoption of 2008 Town of Ithaca Preliminary Budget as the 2008 Final Budget Mr. Walker reminded Supervisor Valentino that they needed to talk about .the sewer charges for the Sewer Treatment Plant, Supervisor Valentino stated that the final budget for the City Sewer Plant has an increase for the Town of $ 171 , 000 over what the board had budgeted . She explained that the cost of chemicals have increased substantially. Mr. Walker added that the phosphorous removal program has a lot chemicals involved with that addition . The program has finally come on- line , which has caused the increase in costs . Supervisor Valentino commented that the phosphorous going into the lake from the plant has been reduced by about 43 % . She explained that she did not increase the amount budgeted for 2008 because the sewer fund has a healthy fund balance . Mr. Walker thought that the line item should be changed to reflect the money coming from an appropriated fund balance . Supervisor Valentino didn 't think it was necessary to change the line item at this point because a budget amendment could be done as the money was needed . Mr. Carvill wanted to appropriate the additional $ 171 , 000 from the sewer fund balance . Mr. Walker said that the Sewage Treatment charge is line G8150 . 400 and the proposed preliminary budget was $800 , 000 , but based upon the information from the City , the amount should be raised to $972 , 000 . Supervisor Valentino moved adoption of the 2008 Preliminary Budget as the Town of Ithaca ' s 2008 Final budget . Councilwoman Gittelman seconded . Supervisor Valentino Approved on November 19, 2007 Page 28 of 29 Town of Ithaca, Town Board Minutes, Budget Meeting, November 8, 2007 recapped that the board was looking at no increase at the property tax , there ' s a $0 . 18 increase in the fire rate , and changes in the water and sewer benefit districts . TB RESOLUTION NO. 2007492: Adoption of the 2008 Town of Ithaca Final Budget WHEREAS, the properly advertised public hearing has been held to consider the adoption of the 2008 Preliminary Town of Ithaca Budget as the 2008 Town of Ithaca Final Budget, and WHEREAS, the Town Board has discussed and reviewed all modifications to the said budget as presented by the Town Supervisor and Budget Officer, now, therefore, be it RESOLVED, the Town Board of the Town of Ithaca hereby approves and adopts the 2008 Preliminary Town of Ithaca Budget, as presented by the Town Supervisor and Budget Officer, as the 2008 Town of Ithaca Final Budget. This is a memorandum of understating between the Tompkins County Council of Governments and the Tompkins County Society for the Prevention of Cruelty to Animals ("SPCA"). WHEREAS, certain constituents of the Tompkins County Council of Governments are required by Article 7 of the New York State Agriculture and Markets Law to provide certain animal control services, and WHEREAS, these constituent municipalities have contracts with the SPCA to provide - animal control services for the calendar year 2007, and WHEREAS, the SPCA has indicated to the constituent municipalities that fees paid pursuant to the 2007 contracts are insufficient to cover the costs of providing the animal control services and the SPCA has indicated the need to charge significantly higher fees in future years in order to cover the cost of providing the services, and WHEREAS, the constituent municipalities aspire to provide the animal control services in an economically efficient manner, now, therefore, the parties have reached the following understanding: 1 . For the period January 1 , 2008 through March 31 , 2008, the Constituent Municipalities and the SPCA will maintain their contractual relationships with the same terns and conditions as the 2007 contracts and the SPCA will continue to provide the same level of services during this period. The charge to the municipalities shall be 1 % of the rate set forth in the 2007 contracts. ' ` 26 On or before December 1 , 2007 .the . SPCA will provide aa�_omprehensive list and description of the services that it provides pursuant to the current animal control contracts. 3 . The constituent municipalities will work together to create a Request for Proposals soliciting proposals to provide animal control services beginning April 1 , 20089 The SPCA may make a proposal in response to the request for proposals. 4. Except as otherwise. . provided . herein, in the event that the constituent municipalities are unable to award a contract to the SPCA or another entity prior to April 1 , 2008, the constituent municipalities and the SPCA will maintain their contractual relationships with the same terms and condition for the period April 1 , 2008 through December 31 , 2008. The SPCA will continue to provide the same level of service during this period. COMMISSION BOLTON POINT WATER SYSTEM AGREEMENT TO CHANGE WATER RATE SCHEDULE THIS AGREEMENT to change Water Rate Schedule is made as of the 1 st day 6.> January, 2008 , between the TOWN BOARD OF THE TOWN OF DRYDEN, Tompkins County, New York, on its own behalf and on behalf of all water districts in the TOWN OF DRYDEN served by the Southern Cayuga Lake Intermunicipal Water Commission, (hereafter referred to as "Dryden"), the TOWN BOARD OF THE TOWN OF ITHACA, Tompkins County, New York (hereinafter referred to as "Ithaca") , the TOWN BOARD OF THE TOWN OF LANSING, Tompkins County, New York, on its own behalf and on behalf of the Town of Lansing Consolidated Water District (the Town of Lansing and such district are hereinafter collectively referred to as "Lansing Town"), VILLAGE OF LANSING, on its own behalf and as successor to LANSING WATER DISTRICT 1 , Tompkins County, New York, (hereinafter referred to as "Lansing Village"), and VILLAGE OF CAYUGA HEIGHTS , Tompkins County, New York, (herein after referred to as "Cayuga Heights") , all of the parties hereto sometimes collectively or individually referred to hereinafter as "Municipalities" or "Municipality", WITNESSETH : WHEREAS , the above named municipalities have entered into an amended, supplemental, restated and consolidated agreement of municipal cooperation for construction, financing and operation of an intermunicipal water supply and transmission system dated as of June 5 , 1979 as the same has been amended from time to time (the "Agreement ') ; and WHEREAS , pursuant to the Agreement each municipality agreed to pay to the Southern Cayuga Lake Intermunicipal Water Commission (hereinafter referred to as "Commission"), water revenues based upon, in part, a water rate schedule annexed as Exhibit I of Schedule A to the Agreement; and WHEREAS , based on changes in costs, the Commission believes it is advisable to adopt a new water rate schedule in the form annexed to this modification agreement; and WHEREAS ; Schedule A of the Agreement provides that the water rate schedule may not be changed by the Commission without the written agreement to such change of all the parties; and WHEREAS , Exhibit I of Schedule A to the Agreement has been amended from time to time since the initial date of the Agreement; and WHEREAS , the parties believe it is necessary to amend Exhibit I of Schedule A further; and WHEREAS , the parties are willing to agree to such change; NOW, THEREFORE, in consideration of the premises and the mutual undertakings of the parties pursuant to the Agreement, the parties hereby agree that Exhibit I of Schedule A annexed to the Agreement be amended effective January 1 , 2008 to read as set forth on the Exhibit I annexed hereto , . and such exhibit is adopted as Exhibit I, the water rate schedule, for all purposes under the Agreement. D RATE STRUCTURE : The flat rate charge per 1 ,000 gallons shall be non-fluctuating and equal to two dollars and thirty-two cents ($2 . 32) . This rate is equal to one dollar and seventy-four cents ($ 1 . 74) per 100 cubic feet. The foregoing rate will be the rate charged for all regular quarterly bills sent after January 1 , 2008 . The water charge will then be multiplied by the number of units on the master meter and this will be the billing rendered . If the calculation of the water consumed per dwelling unit is less than the allowable consumption for a three-quarter inch meter, then the billing will be calculated by multiplying the number of units on the master meter times the minimum base charge for a three-quarter inch meter (e. g. , if there were 20 dwelling units on the master meter, and total water consumption shown by the master meter was 100,000 gallons , the Commission billing would be $464. 00 (20 units times $23 . 20) rather than $232 . 00 ( 100,000 gallons at $2 . 32/ 1000 gallons)) 6of8 :r An annual charge for each fire protection main serving a fire suppression system will be billed along with the first quarterly water bill of the calendar year. The annual charge for this service shall be $20.00 per diameter inch of the pipe supplying the fire suppression system. The pipe supplying the fire suppression system is the pipe needed to supply the fire suppression system, installed downstream of the system control valve. Statement of need : Increasing housing supply and revitalization of commercial districts are two of the Tompkins County Economic Development Strategy' s three goals. Both require improvements to water and sewer infrastructure, especially in the non-urbanized areas of the county. The proposed infrastructure study is, therefore, an integral step to achieving affordable housing and revitalization goals. In particular, to provide for housing to be reasonably affordable, housing requires density. Continving to build individual homes on 1 -2 acre lots is not an affordable approach to providing housing. Dependable water and sewer infrastructure is also critical for revitalization of our town and village centers. Preliminary scope of work: A consultant would be hired to : • Update the 1994 county-wide evaluation of water and sewer infrastructure working with local municipal staff. • Prepare a conceptual plan of water and sewerage infrastructure, including potential service areas, to support future growth. • Prepare preliminary costs to expand infrastructure to accommodate planned growth. _ Work would reflect anticipated growth of the municipality. Some municipalities have extensive planning for water and sewer. In these cases the current study will serve mostly to summarize that information in the single county-wide evaluation. In the case of communities with no water and/or sewer, the consultant will never-the-less consider the potential need for public water and/or sewer over the next ten to twenty years.
