HomeMy WebLinkAboutTB Minutes 1973-11-19TOWN OP ITHACA SPECIAL BOARD MEETING November 19, 1973 - 5s00 p.m. At a Special Meeting of the Town Board of the Town of Ithaca, Tomp- kins County, New York, held at the Town of Ithaca Offices at 108 East Green Street, Ithaca, New York, oh the 19th day of November, 1973, at ^ 5:00 p.m., there were PRESENT: Walter J. Schiiran, Supervisor Andrew W. McElwee, Councilmcui Noel Desch, Councilman Robert N. PbWers, Councilman ABSENT: Victor Del Rosso, Councilman ALSO PRESENT: Barbara Holcomb, Chaitman, Planning Board Kenneth Kroohs, Planner-Engineer FIRE CONTRACT - CITY OF ITHACA This matter was tabled at the November 8, 1973 meeting and re-scheduled for the meeting of November 19, 1973 (a special meeting). The City of Ithaca has requested $60,000 for fire protection for the year 1974, the Town having budgeted $34,981. There appearing to be no alter native at this time, the Board agreed to the increase, but with the understanding that they would confer with the City of Ithaca after the first of the year with a view to negotiating a more satisfactory contract than the present one. The increase would increase the fire rate of the Town from $1.02 per thousand to $1,509 per thousand. Motion by Supervisor Schwan? seconded by Councilman Desch, lUBSOLVED, that the budget for fire protection in the Town by the City? I of Ithaca be increased from $34,981 to $60,000. Unanimously carried. EASTERN HEIGHTS^ INC. - SEWER PIPE Supervisor Schwan reported that the Town of Ithaca had been billed by Chemung Supply Corporation for 412*5" of 30" pipe for storm sewer in Eastern Heights, Inc., in the amount of $3,423.06, and that this is an obligation on the pcurt of Eastern Heights, Inc. in accordance with an agreement between the Town of Ithaca and Eastern Heights, Inc. He said the Town has installed the pipe and paid for it; that Eastern Heights was billed for it on September 12, 1973 and has not paid for it to date. He suggested that the amount owing should be charged against Eastern Heights, Inc. on the tax bills which will be mailed out in December. It would, thus, become a lien against the property. There was some discussion as to whether it should be charged against one parcel or several parcels or against Eastern Heights, Inc. in some other way. It appeared that since all of Eastern Heights is divided into individual parcels it would have to be charged against a particular parcel or parcels. Councilman McElwee recommended that it be charged against more than one parcel, perhaps against as many as five or ten parcels. It was suggested that the Town Attorney's opinion on this matter should be solicited. The Supervisor said the difficulty was the time element, that the Assessment Division of Tomp- kins County is beginning to prepare the tax bills and is getting ready to put the figures into the computer at this time; that a decision had to be made quickly or the amount owing will not get onto the rolls. Motion by Supervisor Schwan; seconded by Councilman McElwee, WHEREAS, the Town of Ithaca has been billed by Chemung Supply Corporation for 412*5" of 30" pipe for storm sewer in Eastern Heights, Inc., in the amount of $3,423.06, and - 2 -November 19, 1973 WHEREAS, this is an obligation on the part of Eastern Heights, Inc. in accordance with an agreement between the Town of Ithaca and Eastern Heights, Inc., and WHEREAS, the Town of Ithaca has installed said pipe and paid .^ for same, and ^1 WHEREAS, Eastern Heights, Inc. was billed for the above- mentioned amount on September 12, 1973 by the Town of Ithaca, and has not paid same to date, NOW, THEREFORE, BE IT RESOLVED: That the said sum be charged against Eastern Heights, Inc., tax parcels 57-1-8.86 through 57-1-8.95, and become a lien against the said properties unless said payment has been made by Eastern Heights, Inc. prior to the time said amount is placed upon the assess ment rolls of the Town of Ithaca. Unanimously carried. TOWN OF ITHACA SEWER IMPROVEMENT - FOREST HOME, SLATERVIlLE ROAD, CODDINGTON ROAD, GLENSIDE ROAD, AND EtiM STREET E^tTENSlQN AREAS A public hearing Was held on this matter On November 12, 1973, At the heating several residents of the areas involved requested exten sions to their properties. Since changes to include the requested extensions were contemplated, the Town Attorney suggested that the hearing of November 12, 1973 be adjourned and another hearing be ® held. The hearing was adjourned until November 19, 1973 to give the Town Attorney an opportunity to prepare an order for a new public hearing (scheduled for December 3, 1973). The following action was therefore taken: An Order at a Special Meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, held at the Town Offices in the City of Ithaca, New York, on the 19th day of November, 1973. Powers, Councilman ABSENT: Victor Del Rosso, Councilman In the Matter of The Authorization of a Sewer Improvement in and for the Town of Ithaca, Tompkins County, New York, Pursuant to Article 12-C of the Town Law. WHEREAS, plan, report and map relating to the providing of a sewer improvement in the area of the Town outside of any villages was heretofore filed in the Office, of the Town Clerk, which provided for the furnishing of extensions to the existing sanitary sewer sys tem in said Town, and - 3 - November 19, 1973 WHEREAS, the Town Board of the Town of Ithaca by Order dated October 23, 1973, ordered! that a meeting of the Town Board was to be held at the Ithaca Town Offices at 108 East Green Street (third floor), Ithaca, New York, on the 12th day of November, 1973, at 5:30 p.mo, for the purpose of conducting a public hearing on the authorization ^ of the aforesaid improvement and establishment of the aforesaid bene fited area and the plan, report and map filed in relation thereto at which time all persons interested in the subject matter might be heard concerning the same, and for the purpose of taking such further action on the aforesaid matter^ as is authorized or required by law, and VniEREAS, stich public hearing was held at the time and place aforesaid hnd no objection.was presented to the construction of said sewer improvement, as described in said map, plan and report, but WHEREAS, certain residents in the Town of Ithaca expressed a desire that sewer mains and facilities in addition to those shown on said map, plan and repbrt be constructed as sewer extensions, and T-jherEAS, the Town Board at said meeting held on November 12, 1973 directed Lozier Engineers, Inc. to amend the said plan, report and map to provide for extensions to the said sewer system in addition to those previously shown, and WHEREAS, an amended plan, report and map showing additional extensions to the sewer system which were not shown on the original map, plan, and report as previously filed, is now duly filed in the Office of the Town Clerk of the Town of Ithaca and are available at the Town Clerk's Office for public inspection during regular office hours, and WHEREAS, (i) the benefited area continues to be the entire area of the Town outside of the Village of Cayuga Heights, and (ii) the proposed sewer improvement is the same as described in said first Order calling for a public hearing dated October 23, 1973, except for the additional extensions shown in the amended report, plan and map, and (iii) the method of assessing, levying and collecting the cost of said sewer improvement is the same as stated in said previous Order dated October 23, 1973, and in said map, plan and report as originally filed in the Town Clerk's Office, cuid (iv) the proposed method of financing to be employed consists of the issuance of serial bonds of the Town to mature in annual instalments not to exceed forty (40) years, and WHEREAS, in accordcince with said amended plan, map and report, the maximum amount proposed to be expended for said sewer improvement is the sum of $970,000.00 instead of $890,000.00, NOW, THEREFORE, IT IS ORDERED, by the Town Board of the Town of Ithaca, Tompkins County, New York, as follows, that: Section 1. A meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, shall be held at the Ithaca Town Offices at 108 East Green Street (third floor), Ithaca, New York, on the 3rd _ day of December, 1973, at 5:30 p.m., for the purpose of continuing the piiblic hearing previously held on November 12, 1973 on the authori zation of the aforesaid improvement and establishment of the afore said benefited area and the plan, report and map filed in relation thereto at which time all persons interested in the subject matter may be heard concerning the same, and for the purpose of taking such further action on the aforesaid matters as is authorized or required by law. Section 2. The Town Clerk is hereby directed to give notice of such public hearing by publishing a copy of this Order once in the Ithaca Journal, the official newspaper of said Town and by posting a copy thereof upon the signboard maintained by him pursuant to Section 30 of the Town Law and as required by the provisions of subdivision 3 of Section 209-q of the Town Law. - 4 ^ November 19, 1973 Section 3> This Order shall take effect immediately. The adoption 6f the foregoing order was duly put to a vote, and upon roll call, the vote was as follows: Walter J. Schwan, Supervisor - voting AYE Andrew W. McElwee, Councilman - voting AYE Noel Desch, Councilman - voting AYE Robert N. Rowers, Councilman - voting AYE The Order wa^ thereupon declared duly adopted.
