Call to Order: . Supervisor Valentino called the meeting to order at 5 : 30 p .m . , and led the assemblage in the Pledge of Allegiance . Agenda Item No . 4 - Report of Fire Commissioners. Bob Romanowski , Ithaca Fire Department . See Attachment # 1 . Mr. Romanowski - The Ithaca Fire Department is increasingly being called for hazardous materials and marine safety. It is for rescue of persons in the lake and recovery of someone who has been unfortunate enough to drown . This has fallen onto the IFD to take of. It is a tremendous amount of work for the County and the different areas around . The third item is disaster planning for this area . The big item is to be able to tie the communications together. This has taken a turn so that the ' County will have to be involved with the funding . it cannot be two entities funding everything for this area without some input from the County. Agenda Item No. 6 Approval of the Town Justices ' 2001 Annual Reports (Attachment #2 Supervisor Valentino - We have received a report from Justice Larkin , Ms . Hunter - We will have Justice Bordoni 's report next month . RESOLUTION NO. 20024 - Approval of Town Justice Clarence Larkin - s 2001 Annual Report 1 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 WHEREAS, I Town Justice Clarence Larkin has presented his 2001 Annual Report to the governing Town Board as required by Town Law; now, therefore be it RESOLVED, that the governing Town Board of the Town of Ithaca hereby accepts for filing by the Town Clerk, the attached 2001 Annual Report of Town Justice Clarence Larkin. The motion was unanimously carried. Councilman Lesser - Has there been any progress in balancing the load between the two Justices? Supervisor Valentino - I think that there has been some progress . There is still a little hard to tell . The 2002 annual report will show the progress . Agenda Item No. 113 - Set Public Hearing to Consider Amendment to Special Land Use District #4 to Allow Food Processing and Distribution at 1251 Trumansburg Road . I Supervisor Valentino - The public hearing is set for February 11 , 2002 at 6 : 30 p . m . RESOLUTION NO. 2002-2 — Set Public Hearing to Consider a Local Law Amending Local Law Number 1 of the Year 1987 to Permit Limited Food Processing Activities in Special Land Use District Number 4 Located Off Route 96 RESOLVED, that the Town Board of the Town of Ithaca hold a public hearing at the Town Hall, 215 North Tioga Street, Ithaca, New York, on the 11th day of February, 2002 at 6:30 p. m. for the purpose of considering a proposed local law amending Local Law Number 1 of the year 1987, which amendment would permit wholesale processing and distribution of seitan, tofu, and soy milk under certain conditions in Special Land Use District Number 4 located at the former Cornell Statler West facility off of Route 96 in the Town of Ithaca; and it is further RESOLVED, that at such time and place all persons interested in the proposed amendment may be heard concerning the same; and it is further RESOLVED, that the Town Clerk of the Town of Ithaca is hereby authorized and directed to publish a notice of such public hearing in the Ithaca Journal published in the City of Ithaca, Ithaca, lNew York, and to post a copy of same on the signboard of the Town of Ithaca, said publication and posting to occur not less than ten days before the day designated above for the public hearing. 2 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 MOVED: Councilwoman Russell SECONDED: Councilman Niederkorn VOTE: Supervisor Valentino, aye; Councilwoman Russell, aye; Councilwoman Grigorov, aye; Councilman Lesser, aye; Councilman Niederkorn, aye; Councilman Burbank, aye. The motion was unanirnously carried. Attorney Barney - Does anyone have any questions about the law itself? Councilwoman Russell - Attorney Barney, I was wondering about the limitations under Section I , triple iii . Attorney Barney - The limitations were discussed at the Planning Board with the applicant . The applicant was comfortable with the limitations . We are not imposing the limitations on them . I need to get a sense from the Town Board . In drafting this , I took the tack that we have what is basically a residential area and this facility. We want to limit as much as possible any commercial encroachment into that . We made it fairly restrictive . The original suggestion was to simply state , "we allow wholesale processing and distribution of food products" . We could have a pineapple cannery under that determination . We limited it to just what they wanted to do . The Planning Board limited the food products , the amount of space , the number of trips and number of employees . They wanted to keep it in a relatively small perimeter. The Town Board may choose to make the law broader. Councilwoman Russell - I was thinking much broader. I thought that it could be opened up a little . Attorney Barney - The applicant requested four vehicle trips per week. The Planning Board added a 50% factor to each of these . It allowed a little room above and beyond what they had requested . Mr. Kanter - I believe Ithaca Soy started the original use that was different from the catering . They might have initially started with the catering and evolved into . food processing and distribution . Mr. Epicure has owned the business for about a year. It is listed in the current phone book. They are entering a new phase where they are expanding . It was discussed with the Planning Board . That is what initially brought the application before the boards . Mr. Frost discovered that their building permit was for a use different from . what they are doing . They are expanding into some of the old kitchen space that has not been used for a long time in that building . Councilwoman Russell - Does the restriction in the current SLUD conflict with Part A? Attorney Barney - I read that the existing kitchen is related to the off premises catering as the subdivision 1 uses . The subdivision 2 uses added a series of limitations . This would be a subdivision 3 use , which has its own set of limitations . All of which is subject to the paragraph 3 uses on A56 , which is vibrations , noise , odors , smoke , etc . The six vehicle trips 3 January 14, 2002 Regular Town Board Meeting Approved February 111 2002 were intended to relate to deliveries and not to employees coming and going . I . can clarify that language . Agenda Item No. 3 - Report of Tompkins County Board of Representatives: I i Tim Joseph , TC Board of Representatives - I apologize for being late . I was involved in pulling and replacing an air compressor from our community water system . It has stimulated a renewed interested in the municipal water supplies . In the last two years Mr. Koplika- Loehr and myself have alternated coming here to make reports to you . We had pretty much excused Ms . Kiefer who was the other representative in the Town because she had to go to Cayuga Heights and Lansing meeting . Now the Town is represented by seven different board members . We worked out a rotation . Mr. Koplika- Loehr and I will still come to most of the meetings . Each of the other five are going to come once during the year. The board will see everyone who represent the Town at one time or another over the course of the year. The County Boardi agenda for tomorrow night's meeting does not contain any resolutions . We re-appointed committees at our last meeting . Most of them have not met. Things are only just starting to get rolling for the year. I did meet with Supervisor Valentino to talk about County and Town relations . There is nothing dramatic to report , accept a commitment on both of our parts that the way that things have been going is not good and we would like them to get better. We both want to work hard to bring people back together as much as we can . We want to work with the other towns as well . We talked about what kind of tasks can we undertake together 1 that will have us functioning more cooperatively together with less fighting over issues . Supervisor Valentino - There are a lot of items that we do agree on . Councilman Lesser - Are there any agenda issues that you think my affect the Town in the upcoming year? Mr. Joseph - Town lissues are often planning issues . We have a new Planning Commissioner at the County level, We also have a new Planning Chair. One of the things that Supervisor Valentino and I talked about is that the strongest need for cooperation between the County and towns is on planning issues . We talked about trying to revive the Planning Federation . I do not have a specific agenda around those issues , but I would like to see more coordinated planning . Everyone is aware of the ways in which the Town tries to control and regulate development . They are really at a disadvantage if the developers can do whatever they want just over the line . It makes it very hard for any one town to successfully impose any regulation . I think there is a strong need that is being more and more recognized for coordination and trying to come up with plans for development that go beyond single towns . We would like pla 1 s to conceive of countywide priorities . Then each town has to act to try and make that happen . I think it will be our challenge . The Vital Communities Initiative is one of the tools that can help us get a handle on that . I have not been all that impressed with 4 January 14, 2002- Regular Town Board Meeting Approved February 11 , 2002 what it has achieved so far. Never the less , it is the right strategy. I would like to keep pushing it and hope it will accomplish more than it has to date . Mr. Kanter We have invited the new Planning Commissioner over in order to introduce him around and tell himl what we are working on . Agenda Item No . 14 - Consider Authorization to Execute Contract with NYSEG Solutions, Attorney Barney - We thought the board should ratify the agreement. We talked about it at one of the board meetings . The consensus was to go ahead with it . I am not sure we had a formal resolution to do it . Supervisor Valentino - This is an alliance between Tioga County and Tompkins County regarding electric expenses. RESOLUTION NO. 2002-3 — Ratifying the Execution of an Agreement with NYSEG Solutions, Inc, for Natural Gas Supply Pursuant to Public , Bid Conducted by the Municipal Electric & Gas Alliance WHEREAS, the Town of Ithaca is a member of the Municipal Electric & Gas Alliance, a group which solicits bids for a number of municipalities for natural gas supply and electric supply; and WHEREAS, NYSEG Solutions, Inca has submitted the bid that is recommended by Municipal Electric & Gas Alliance; and WHEREAS, it is appropriate for the Town of Ithaca to enter into a contract with NYSEG Solutions, Inc. ; and WHEREAS, the Supervisor has executed such a contract after consultation with various Board members; and WHEREAS, the Board wishes to ratify the execution of such contract by the Supervisor; NOW, THEREFORE, be it RESOLVED, that this Board ratifies the execution of an agreement between the Town of Ithaca and NYSEG Solutions, Inc. for the supplying of natural gas for the Town of Ithaca, a copy of which is attached to this resolution and made a part hereof, such agreement to be upon the terms and conditions set forth in the attached agreement; it is further RESOLVED, that the action of the Supervisor in so executing the agreement is hereby ratified and that the Supervisor is hereby authorized to take any other steps, provide any 5 i i i January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 certifications, or engage in any other actions, which may be necessary, desirable, or appropriate in ord Ir to effectuate the intention of the foregoing resolution. The motion was unanimously carried. i Agenda Item No. 5 - PERSONS TO BE HEARD - South Hill Civic Association . I Richard DePaolo , 26 Northview Road - I live on South Hill . I wanted to talk about a couple of issues related to Agenda Item No . 16 . Assuming that my conversation with Mr. Walker today was true and the Town has committed to it's portion of the funding for the phosphorous removal project , I applaud you for your efforts . The recently issued SPDES permit for the plant allows for a phosphorous contribution to. the lake of 40 pounds per day. Prior to the issuance of that permit for the previous two years the plant had been averaging roughly 29 pounds of phosphorous per day. This is conceivably an issue only if the proposed sewer district expansion goes forward before the phosphorous removal is implemented . I do not know the chronology. I looked at the overview documents from Stearns & Wheler. I think it is in the Town 's best I interest to try to insure that these two elements of the project materialize roughly at the same time so that you do not end up in the situation where there is more of an increased flow thIrough the plant with the current technology .. It would allow for a phosphorous expansion rather than reduction . Mr. Walker - We are looking at a 180-day design period . We could begin construction by this fall . Mr. DePaolo - I am sure the Town is committed to its portion of the funding . I understand that $ 1 . 3 million is the unfunded portion of the element . The Town 's stake in that comes out to about $450 , 000 . d There is a potential situation where anytime there is a sewer permit expansion , you are supposed to implement technology , as you seem to be doing , that will allow for the plant Ito achieve a no net increase in phosphorous . While that in all likelihood is going to be the case in this situation , the permit is currently structured to allow, in operational terms , a 37% increase in phosphorous over what the plant has been . currently doing . You could at the end of the day wind up in a situation where you make a significant investment , in terms of technology, and due to growth in outlying communities end up in a situation where you have more phosphorous entering the lake through the plant than is currently entering . I understand that the technology offers a quite considerable reduction . The Town. should safe guard against that by asking the DEC to follow up on its commitment to reduce the phosphorous limit lin the permit commensurate with the technology that . is available . There is something in the SPDES permit that says , " should advanced phosphorous treatment become available , the permit will be restructured to reflect that fact" . I think it is in your best interest to 6 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 make sure the department lowers that permit limit . It ultimately is the backstop for phosphorous entering the lake through the facility. Agenda Item No. 15 Consider Concurrence with Formation of Ulysses Water District Number 3 . Supervisor Valentino - This is basically comes as a request . They need a resolution from the Town that says yes , if we can work out all portions of the contract we are willing to allow water service in this area : Mr. Kanter - The board might want to add a Whereas that refers to the documentation of the growth inducing impacts that the Town of Ulysses did provide it . RESOLUTION NO. 20024 — Town Board Concurrence with Formation of Ulysses Water District Number 3 with Supply from the Town of Ithaca WHEREAS, The Town of Ulysses has applied for the Formation of Water District No. 3 in the Town of Ulysses which is proposed to connect to the Town Of Ithaca West Hill Water Service Area at the end of the existing Town of Ithaca Watermain on Rte 96, and WHEREAS, Improvements to be constructed by the Town of Ulysses to serve the water district include a .pump station on Woolf Lane in the Town of Ithaca, and a 260, 000 gallon water storage tank on Van Dorns Road which will provide increased pressure and additional storage that will benefit portions of the Town of Ithaca water system. on Rte 96 and Woolf Lane and allow retirement of an existing Hydropneumatic Booster station in the Town of Ithaca, and WHEREAS, The Town of Ulysses has requested and anticipates approval from the City of Ithaca Board of Public Works of an agreement to purchase water from the City of Ithaca which is the current Source of Supply for the West Hill Service Area, and WHEREAS, The Town of Ulysses has adequately documented in their environmental review that potential environmental impacts, including growth inducing impacts, will not be significant, and WHEREAS, The Town of Ithaca Director of Engineering has reviewed the engineering Report for the Proposed Water District No. 3 and has determined that the Town of Ithaca West Hill Distribution System has the capacity to convey water to the Town Ulysses to provide the Design Maximum Day Demand of 230, 000 Gallons Per Day, and WHEREAS, The Town of Ithaca and the Town of Ulysses have an understanding that a water transmission agreement between the Two towns will be executed prior to the construction of the Water Improvements. NOW THEREFORE, BE IT RESOLVED, That the Town of Ithaca Town Board concurs with the Formation of the Town of Ulysses Water District No. 3, and provided that the City of 7 January .14, 2002 Regular Town Board Meeting Approved February 11, 2002 Ithaca Agrees to sell water to the Town of Ulysses, and that appropriate agreements are executed between ) all parties, the Town of Ithaca will provide water transmission services to the Proposed District. Agenda Item No. 16 - Consider Approval of Engineering Service Contract for IAWWTP Phosphorous Removal Project. i Mr. Walker - A couple of the items that were missing a couple of months ago was the actual final engineering report from Stearns & Wheler. We received it in December 2001 . It was good that we had them look at it more closely. They were able to come up with a revised schematic plan . It cut about $750 , 000 to $ 1 million off the construction cost . They were trying to use existing structures that were currently unused on the facility. In reviewing the layout , they found that by relocating the phosphorous stripping tanks , which are now smaller type of facility than what was originally envisioned , to the tail end of the plant. They can save quite a bit of money in extra piping and pumping costs . I feel that us asking them to take a close look at it has come up with a better solution and is more cost effective . They have eliminated the need for predata on the technology . It will be incorporated into the basic design contract . It will reduce the engineering fees by about $43 , 000 from the original . think we have received the things that we asked for. Councilman Lessen - How much phosphorous removal is this technology going to allow for? I Mr. Walker - Our current permit is at 1 milligram per liter. We are doing about six tenths of a milligram . This should get us down under one tenth of a milligram per liter and possibly lower. Attorney Barney - This resolution relates to changes recommended by the attorney advising the Joint Sewer Committee . Could we expand it out to include the Attorney for the Town of Ithaca ? I have a number of comments on the general conditions in paragraph 3 . They are lopsided favoring the engineer. I think they can be modified to be more neutral , if not more favorable to the Town . I will get the board a letter with my comments . Supervisor Valentino - We have authorization to sign this upon the modifications . Attorney Barney - I do not know if the Town wants to be limited to signing which include those changes . I would) say that the Town of Ithaca signs the contract with the advice and after consultation with the attorney advising the Joint Sewer Committee and the Attorney for the Town . 8 i January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 RESOLUTION NO 2002-5 — Town Board Approval of Engineering Services Contract for IAWWTP Phosphorus Removal Project WHEREAS, The Joint Sewer Committee overseeing the operation of the IAWWTP has recommended proceeding with the Phosphorus Removal Project recommended in the Stearns and Wheler Engineering Report entitled Tertiary Phosphorus Removal Upgrade dated December2001, and WHEREAS, Stearns and Wheler has submitted a proposal for engineering services to develop the Final Design — Phosphorus Removal Facilities dated December 5, 2001 , with a total cost for basic services for the final design not to exceed $368, 400, and WHEREAS, funds for this project are available in the IAWWTP budget, and WHEREAS, The City of Ithaca Board of public Works has approved this contract, and WHEREAS, The Town Engineer has reviewed the proposal scope and agreement and has recommended proceeding with this phase of the project, and WHEREAS, The Attorney representing the Sewer Committee has reviewed the Contract Agreement and has suggested minor modifications to the contract to protect the owners. NOW THEREFORE, BE IT RESOLVED, That the Town of Ithaca Town Board approves proceeding with the Design Phase of the Phosphorus Removal Project and authorizes the Town Supervisor tot Sign the Contract for the Town of Ithaca in a form satisfactory to her, after consultation with the Attorney advising the Joint Sewer Committee and the . attorney for the Town. Supervisor Valentino = This is the time of year where we go through the process of obtaining services of our auditors for the year. It is a confirmation confirming the arrangements . RESOLUTION NO. 2002=6 — Authorization to Engage the Services of Scirabba Walker & Co. . LLP to Conduct an Independent Audit for the Year Ended December 31 , 2001 9 January 14, 2002 Regular Town Board Meeting . Ritter has discussed this with the Conservation Board . The Conservation Board would like to make sure that we continue in some format of what they had as associate members . They feel that the folks that have contributed as associates have 16 i January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 been really helpful to them . The one concern that 1 have with the by-laws is that I feel that it is fine to have whatever we decide is important with the associates or the people who are non -voting members . We need to make sure in the by- laws that we are very clear on what our expectation is . They can be involved in subcommittees as long as there are three regular members . It sounded fine to me . Councilwoman Grigorov - Associate members do not want to be committed to coming to every meeting . Councilman Lesser - The Environmental Committee does have associate members . Ms . Ritter - The thought was that the Conservation Board did not want the number specified as to the number they wanted to have . I think that they felt they have come to a point and realized that they have enough members . The associate member may just be serving for a short period of time on one specific project . Most of the time our associate members are regular attending members of the board . We might have someone who wants to regularly attend and then have others who want to serve project to project or on a certain project. They did not want to specify a number because they were not really sure on the future what every associate member's participation would be . They did not want to put it down in writing that they have a special number. The Town Board and Conservation Board would have input on who the associate members would be . Councilwoman Russell - It could become a burden at some point to the staff to have so many members . Ms . Ritter - We talked about that . We felt that if it came to that point it would be easy to not allow any more associate members at that point . Councilwoman Grigorov - How many associated members are there now? Ms . Ritter - There had been two associate members . Supervisor Valentino - I need to open the public hearing . The Town Clerk had proof of posting and publication . Agenda Item No. 19 Cont'd . Mr. Kanter - There are several people who have submitted letters of interest in serving on the board . There may not be enough slots for them now as regular members . They are free to come to the meetings and participate . Ms . Ritter - There is some notion that we could find someone who has a specialty. We would like to have the ability to have a specialist become an associate member and work on that project , i i Councilwoman Grigorov - Is there any reason someone cannot participate as a member of the public? Ms . Ritter - We have not had that situation come up . I know that people who have been continuing to participate on the board have had some sort of title . They are either an associate member or Conservation Board member. I do not know if they would be as interested to participate if they were not a member. These are not scenarios that have happened . We are looking ahead to what an associate member might be . We have not looked at associate membership like this before . It has been something that is ongoing . We are now going to have rules about what an associate member can and cannot do so we need to look at who an lassociate member might be . Historically, they have only been members that have retired from the board , but want to still maintain activity . We may encounter at times a great applicant that has a lot of enthusiasm and we do not have an opening . We might want to bring that person on as an associate member sort of knowing that our older members are likely going to be moving on eventually. We would then have that person that we could move into a voting member of the Conservation Board . The associate member could be thought of as a trainee Conservation Board member. Councilman Burbank - Have associate members been the same members year to year? Ms . Ritter Libby de Prouse and John Meigs were the associate members last year. Libby is now moving on . She does not want to be an associate member this year. I think Mr. Unsworth is going to be moving into the associate membership category if we have this position . We do I of need to appoint him until we settle on the associate membership . . He has indicated a desire to go into associate membership . Supervisor Valentino - I feel comfortable with the Town Board making appoints on the recommendation of the Conservation Board and that there be at least three voting members on any subcommittees . I am not sure what to call the associate members . Attorney Barney - We could call them advisors . Ms . Ritter - Do yo 1 not like associates? Attorney Barney - II do not care about associates . The word member is what worries me . Ms . Ritter - They had considered eliminating associate member and just saying that they are a Conservation Board associate . j 18 I January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 Councilwoman Russell - They may not need by- laws if we can incorporate these things into our local law. Ms . Ritter. - This will help clear up who the Conservation Board members are and who the associates are . We can look at our new applicants and find places for them . We will need to put this into a local law, correct? Attorney Barney - It probably is not mandatory, but it is a good idea . Mr. Kanter - We will need to amend the current local law because there are some conflicting provisions in the local law with what we have been talking about . The Conservation Board did not have a strong feeling about having their own by- laws . We could address all these points in the local law, then we could eliminate having by- laws . The current local law states that they shall have their own by-laws . Ms . Ritter - The only problem that we have had is that we did not get any EMC member from the Conservation Board last board . Councilwoman Grigorov brought up the issue if an associate could be a new member or would it have to be the retired voting members . Is there a feeling amongst the board on particular rules about the associate? Councilwoman Grigorov - We could take a look at it . Ms . Ritter - We do have the potential for this year of recommending an associate be one of our new applicants . Supervisor Valentino - We need to go through the process of amending the local law. In the mean time what do we do about appointing members to the Conservation Board ? Councilwoman Russell - We just appointed members to the Conservation Board . Ms . . Ritter - Do we need to have the local law in place before we do this? We have been doing this . The Town Board just has not been approving the associates . Attorney Barney - I do not know if there is any problem with the Conservation Board inviting anyone they choose to invite to participate in their discussions and help them in their deliberations as long as they are not looking for a monetary reimbursement from the Town . They could probably continue doing what they are doing in the interim . I would prefer that the word " member" was not part of their title . We can call them associates pending the modification of the local law to conform . Then when the local law is formally adopted , then the Town Board can appoint the associates . Councilwoman Russell - It might be helpful for a Town Board member to go to a Conservation Board meeting . Ms . Ritter - They did bring up Councilwoman Russell 's suggestion at the last meeting . Attorney Barney ' In the eyes of the Town Law, the Planning Board and Zoning Board of Appeals serve as quasi discretionary boards taking actions that are subject to legal challenge . The Conservation Board is technically an advisory board . I do not believe that they have independent authority to make decisions that are challengeable by court . It would be up to the Town Board if they wanted to compensate them . There is a clear distinction in Town Law between the Planning Board and Zoning Board of Appeals and other town bodies . Motion unanimously carried. Agenda Item No. 24 - Consider Approval of the Joint Recreation Partnership. i Supervisor Valentino This needs to be taken off the agenda and moved to February. We had a Board .of Recreation Partnership meeting . We had a long discussion concerning the changes that the County was proposing to make relative to the Partnership monies to within two years hire a piart-time board member separate from the City to help us . The County watered it down . We have a new version that will be coming around for review and approval . Every municipality approves of the language. Then at the last minute , a committee of the County changed the language . i The Partnership is functioning . Agenda Item No . 23 - Consider Authorization to Apply for Grant Funding from the New York State Archives and Records Administration . I Ms . Hunter - We do not have a resolution for tonight . We are attempting to work with the Records Management Advisory Board and pinpoint specific projects that we can agree upon to go and seek funding . The grant application deadline is January 31St. We have a Records Management AdvisIory Board meeting tomorrow. We have two main projects . The first is the physical storage of the maps . The second is for the completion of an electronic indexing system . This system was started by an intern . He has since gone off to school and it is incomplete . There are aspects of the projects that people in house want to do . We are going to work through that tomorrow . We are looking for authorization from the board to apply for funding from the New York State Department of Education State Archives and Records Administration . They have an annual grant review. . RESOLUTION NO. 2002- 16 — Authorize Applications for 2002-2003 New York State Archives and Records Administration Grants WHEREAS, funding is available from the New York State Department of Education 's , State Archives and Records Administration for the management of municipal records; and WHEREAS, the Town 's Records Management Advisory Board has identified the physical storage of maps and drawings, and the completion of an electronic indexing system as needed projects; NOW, THEREFORE, be it RESOLVED, that the Town of Ithaca apply for grants from the State Archives and Records Administration for completion of an electronic indexing system and other need projects, and that the Town supervisor be, and she hereby is, authorized to execute such grant applications on behalf of the Town after consultation with the Town 's Records Management Advisory Board. Mr. Noteboom Every year the board has to agree to go through what we work out as our projected projects for the next year. It is what we have committed our budget to . The motion was unanimously carried. Association of Towns Annual Meeting Resolutions : I Supervisor Valentino - Does anyone have any objection to the proposed resolutions ? Our list is shorter this year. The Towns feel strongly about the need for the Highway funding to continue . There is a growing concern about the things that are beginning to get exemptions from taxes : The speed limit resolution is interesting . We had an interesting discussion last year at the meeting . There is a problem with getting the State to be realistic about town speed limits. 46 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 Mr. Frost - I was glad to see the resolution for the code enforcement aid . When I first started with the Town the State was reimbursing us 15% . Then is started to decrease every year and the reimbursement was eliminated . I think that one of the things to providing quality enforcement of regulations is understanding the codes . The codes are getting much more complex. There is training available , but we are looking at hundreds of dollars to go out of state to some of these things . I think that if the State is going to impose stringent codes and mandating the enforcement to all municipalities that they should provide reimbursement. Councilman Burbank - I do not like the language of the State Aid resolution . Conversation was not auditable. Attorney Barney - It is interestingly close to the description against religion and government being intermingled . Supervisor Valentino = We can try to have some different language put in . Councilman Niederkorn - The speed limit resolution sounds as if they do not want to set speed limits for the smaller towns . Supervisor Valentino - They do not act on them . Mr. Noteboom - Some towns do not want the State to act on speed limits . Councilman Niederkorn - It could be done on a case-by-case basis . Mr. Noteboom - It is done on a population basis . Supervisor Valentino - It is enabling legislation that is allowing towns that wanted to set their own speed limits to apply. Mr. Noteboom - This is what this resolution states . Supervisor Valentino - Yes . It is telling the towns to go do what they need to do yourselves now . Councilman Burbank - Is the petitioning process successful ? Mr. Noteboom - It is a long process . It takes one and a half to two years for speed limit changes . Attorney Barney - Historically, it is a long process and is not that successful . They have standards based on the number houses and number of accidents . It is a point system . The speed limit is not lowered if you do not have enough points . 47 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 Agenda Item No . 26 - Report of Town Committees (Attachment #8) Transportation Committee, Councilman Lesser - I raised the issue at our end of year meeting of what might be insufficient patrolling of traffic violations . I asked rather the board might want to consider the . possibility of a special benefits district for additional policing . Following that meeting Attorney Barney looked at State law and it turns that there is not a possibility to create a special district for that purpose . There are a couple of ways that we might proceed . One would be to go back to our State representatives and ask for a change in the State Law. We could also add it as a townwide benefit . It is a question of how much policing we would want . We could ask for one additional fulltime officer for the Town . In that case we would be paying the salary and benefits , which is $30 per hour. It is roughly $ 60 , 000 per year. Sheriff Meskill stated that he. would be able to supply the car without cost . Attorney Barney - We would have to pay it out of general revenues . i Councilman Lesser - The other option is to get the law changed . Is there enough interest on the part of the board to proceed ? The Sheriff's Department will have a representative come in and talk about how it will work, what they might do , and how much enforcement you would actually get with this amount of money. Attorney Barney - The Town needs to decide if they are preparing to front the money or commit to the money. Mr. Noteboom - Recently there was an article in the paper that Deputy Sheriff Jeter spent all of his time in Newfield . I do not understand how that mechanism works . It would be a question to ask the Sheriff . Supervisor Valentino - I do not see how they could do that. Mr. Noteboom - . It was in the paper about the nice work that he was doing . Councilman Lesser - We would be looking for certain kinds of patrol . We would make decisions about certain areas . The Transportation Committee has identified problem areas in the Town where there is a substantial amount of speeding . We are working with Sheriff Meskill to get a list of where accidents occur. We may be able to identify very clearly where the obvious locations for additional patrol may be . These officers have rotating shifts . It is very clear from budget hearings that the monies are not available in the future for additional patrol . We have heard complaints from our constituents about traffic problems and violations . We will have to play for it if we want to do this . Traffic calming measures could be more expensive and create other problems . Supervisor Valentino - We have contracted with the School District for $4 , 000 to have an officer at the school during the morning drop-off. Is that something different? 48 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 Attorney Barney - I did not do any legal research for that contract . It was only $4 , 000 . 1 assumed that we had the authority to do that . We want to look into that when we start talking about funding $ 60 , 000 to. $70 , 000 . The other possibility to consider is a Town Police Department . The board clearly has the authority to do that . We represent the Town of Spencer and they have a patrol car. Mr. Carvill - We gave the City of Ithaca $33 , 000 more to hire a fireman . We budgeted $20 , 000 last year that did not get expended for a DARE officer through the Sheriff's Office . We budgeted $4 , 000 for a crossing guard . It is the cost of less than one penny at a source of $ 145 million assessment level . Supervisor Valentino - We have talked with people in the community about this to see if there is interest . We can at least have the Sheriff's Office come in and start the discussion . Mr. Frost - Geographically, what is interesting is that to go to Ulysses , Enfield , Newfield , or Danby you need to go through Ithaca . We are adjacent to every municipality except for Groton . Most of the time if they are going anywhere they are going to pass through the Town unless they are going to Groton or the outer skirts of Dryden . Supervisor Valentino - We have a lot of schools in the Town of Ithaca . Mrs . Drake _ We are having a lot of problems on Warren Road in front of that school . This might help that problem . Councilman Lesser - We would be able to target our problem areas . Supervisor Valentino - We can talk with the Sheriff . Councilman Lesser - I can see if they are available to come to the February meeting . Supervisor Valentino - Our residents do have concerns . Cayuga Lake Watershed Intermunicipal Organization . Councilwoman Grigorov - We have had a series of sessions with a consultant about how best to proceed with implementation of the completed plan for improvement and protection of the lake . Waste Management Project. Councilwoman Russell - The Environmental Impact Statement is scheduled to come out February 22"d . Sewer Contract Committee. 49 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 Supervisor Valentino - Councilwoman Russell and I are currently on the sewer subcommittee with the City. The committee needs to be in more of a system with each member having two representatives . There are some good things coming along . Cayuga Heights has now agreed to becoming a partner. We are moving ahead with their phosphorous grant . We are working . on the agreement and working with our engineers . The thing that I am really, extremely concerned about at this point is our auditors that we hired for the Joint Sewer Contract to do the laudit last year, have not been able to complete their audit . They are still sorting out the debt . The other thing that has me concerned is the fact that even though this is a joint activity , these funds should not be coming from the City funds. We need to have a separate fund . It has been very difficult to account for that money. Our belief is that it is illegal for Town funds to be combined with the City's funds . When we look at the difficult financial situation of the City, if the worse case scenario happens where they have to file for bankruptcy , those Ifunds of ours will be lost . It becomes extremely urgent for us to put as much pressure on' the City as we can to get those funds in a segregated fund the way it should be . Dryden agrees with us whole- heartedly that this needs to be done as soon as possible . We need to do this now. We have about $4 million between our operating money and the capital projects money. I do not care whose portion is what at this point . I want all the money that belongs in the sewer fund to segregate . Then we can figure out whose percentage is what . Mr. Walker - In the Capital Reserve fund , 42% falls to the Town . There is about $2 million in that fund . We have been paying about. 36% of the operating funds . Councilwoman Gri'gorov - Are they in City accounts? Attorney Barney = lHypothetically, they are in one City account. It is one big account that all money is tossed in . It could be mixed in with the Building and Grounds Department. Supervisor Valentino - There are portions of the County and portions of the City money that Mr. Cafferillo has adjusted at different interest . Councilwoman Russell - Our auditors were absolutely appalled . Attorney Barney Given the possibility of litigation , the board might want to discuss it in executive session . Mr. Carvill - There are specific requirements . The culmination of a joint activity fund is very much mandated by the State Comptroller. It arises itself out of contractual arrangement between municipalities that jointly provide revenue resources . It has its own committee or group that approves expenditures . It is not part of a generalized operating fund . We would not use that money for roadwork . It is a self- independent , set of accounting records of which all the money is segregated and kept apart : In this case three municipalities have thrown their money into the pot , and this fund is to govern it . Town Clerk b. Highway Superintendent c. Director of Engineering Mr. Walker - We are close to having a Tompkins County Emergency Management Plan ready in draft form . They want to introduce that to all legislative leaders in the County. Some time in the next two months there will be a half-day meeting for Town Board members and Supervisors to have an introduction to the plan . I will let the board know as soon as possible when that is going to be . d . Director of Planning Mr. Kanter - It sounds like the preliminary plans for the Hannah Pew Trail are progressing . We will want to seta community meeting sooner rather than later for public review. Supervisor Valentino - I have been asked when there is going to be a meeting . Mr. Kanter - We should get it out to the public before the plans get too far along . February or March would be a good time to hold a meeting . Councilwoman Grigorov - Would we have the meeting here ? Mr. Kanter - I think we would probably want to go out into the Eastern Heights area . The Planning Board heard the sketch plans for the College Circle Phase II and III developments . As part of that , the applicants and Ithaca College is proposing a community building be added to the future phase 'development . This is part of Ithaca College's new involvement with the apartment development . We realized going through the current zoning for a multiple residence zone that it does not currently allow community buildings. The proposed zoning would allow for a community building . The Planning Board referred a proposal to the Town Board to consider amending the current MR zoning to allow community buildings in that zone . I think we will schedule that for a quick discussion at the February meeting and ask the board to consider setting a public hearing . The public hearing could then be held in March. It would coincide with the College Circle plans as they proceed . Councilman Lesser Was Ithaca College 's involvement with College Circle Apartments discussed ? Mr. Kanter - The board is interested in finding out more details on Ithaca College's involvement. They want to know what kind of agreement they are going to have and what kind of presence are they going to have on the site . I think the board felt that if Ithaca 51 January 14, 2002 Regular Town Board Meeting Approved February 11 , 2002 College is truly run, ning it as if it were other campus housing , there is a great potential for improving a lot of the problems that are there now. They were interested in seeing detailed wording of the agreement that would be forthcoming . Councilwoman Grigorov - There is noise problems coming from the apartments . Mr. Kanter - They would lease it and have an agreement where Ithaca College is saying that they would have full policing authority and patrolling . There would be resident advisors living in the buildings . It ;would include the whole range of things that they do on campus . Attorney Barney - ,I Tom Salm stated that they would be treating it as if it were part of the Ithaca College cant pus . There was no writing before the Planning Board . We requested it be brought in as part of their preliminary approval process . The hook is that they want to increase the permitted density to 750 people . The Planning Board was quite clear that they wanted the area handled better. e. Director of +Building and Zoning Mr. Frost - There was a significant dollar difference of construction value due to Ithaca College and Cornell University spending more dollars on construction . There was several million dollars difference more in 2001 for construction activities than 2000 . There was roughly $4 million' spent more on businesses in 2001 . The value of construction was significantly higher in 2001 . 1 also included copies of the revenues . Overall we had several thousands dollars more in revenues this year than we did last year. We spent a bit higher than what we anticipated as well . f. Human Resource Manager g . . Budget Officer Mr. Carvill - I looked at the end of year to see where we stand . In this rolling recession , to get a one and a half or two percent stock dividend is gold . Across the board in all of our operating funds we were able to maintain an increase in fund balance of roughly three percent on a $ 12 million budget. We turned out better than most CEOs . Supervisor Valentino - I heard today that the sales tax money that is going to be coming in is very good . People spent a lot of money the last quarter. Attorney for the Town Attorney Barney - The Notice of Appeal for the Appellant Court for the County Bostwick Road lawsuit has been started . Mr. Noteboom , Mr. Walker and I had a discussion this afternoon on the architects contract this afternoon for the highway facility. In those discussions , we felt it would be wise to set a public hearing tonight to discuss that facility at the February meeting . We are hopeful that by the February meeting we will have an estimate and budget for the project . We are hoping that some plans will be available as well Mr. Kanter - When would be the best time to do the SEQR review? Do we have to do it to set up the referendum ? Is there going to be comparable information to what would be going to the Planning Board at that point? Mr. Walker - Maybe . Mr. Kanter - I understand the timeframe and the necessity to get. things going , but on the other hand the SEQR review is something that we should not short circuit . It could hold up the process if there is not sufficient information . Attorney Barney - The hope is that there will be . We are pushing it make to the March 11th meeting if we do not set the meeting for February. We at least have a shot at it . Mr. Noteboom - We need the information by the end of January . Mr. Kanter - We need to decide how we are going to classify it as a SEAR action and if it .needs to be coordinated . There is going to be three different boards working on different aspects of the approval , Town Board , Planning Board and Zoning Board of Appeals . Attorney Barney - We can talk about that after the meeting or later on this week. I do not know if it is a Type I action at this point . The problem is that the Permissive Referendum period runs from whenever you adopt this resolution for a period of thirty days . Supervisor Valentino - We are setting a public hearing even though we have not had a chance to have good dialog with the community on this project . Attorney Barney - I am looking at it from the technical side . Mr. Walker - At the very least we can provide a refresher presentation . We did go through the facility needs evaluation in 1998 . We had a consultant in and review everything . . At that time it was before the Town Board at several different meetings in a row. That was four years ago . Due to a number of delays , we are looking at not being able to get a contract out until June or July. That means we would not start construction until August or September. The public works side knows we have a significant need for the space . The question is if we can survive without the new space . Yes , because we have been doing it for the last five years . We will have a presentation in February about the project . We will get it publicized . The architects have been doing a . lot of work on their own time in anticipation of the contract . This discussion was prompted by the December 31 " Town Board meeting, where Town Board members directed the CB to re-consider the adoption of By-laws, and to specifically focus on amending language pertaining to Associate Membership. Town Board members had reiterated concerns, initially raised by the Town Board in 1995 , concerning Associate Membership, especially regarding the CB's practice of self-appointing these non-voting members . In addition, John Barney had expressed concern about having more than nine members serving on the Board, a requirement mandated by State Law. Attorney Barney did, however, mention a provision in State Law allowing "Alternate" members to serve on Planning and Zoning Boards, and stated that he would research its applicability to the CB . The members of the CB firmly support having non-voting member participation on the Board. The Board feels that Associate Members serve an important role on the CB . Typically, Associate Members are previously voting members of the Board who are interested in scaling back their activities, but maintain a continued interest in participating on the Board. The Associate Membership title provides a recognized position for these members, allowing the Board to retain experienced people on the Board, while making room for new members. Without the non-voting membership status, it is feared that the Board would lose the participation of these members. Associate Members contributions are important. For example, during the last four years it has been Associate Members who have served the role of secretary of the Board, taking notes and preparing minutes of Board meetings. In addition, one former long-time Board member, who recently became an Associate, has expertise in local planning which has been a great asset to the Board. His continued involvement as an Associate means the Board can continue to obtain his valuable advice and insights. Members understand the Town Board's desire for oversight on these appointments and supports requiring Town Board approval of these members. The title is not as important to CB members, but one strongly supported suggestion was to remove the term "Membership" from Associate Membership, and call the position an "Associate" . This was recommended based on members' review of the 1995 Town Board minutes, with the thought being that elimination of the term "Member" , would help to further differentiate this position from voting members, and avoid any association with the nine member limit. Other title suggestions included " Ex-Officio" , " Ad-hoc " , and " Affiliate " . 1 CB members expressed a strong preference for maintaining a non-voting member, rather than a voting "Alternate" member. Members saw the "Alternate" as largely equal to a regular voting member, and felt that this would necessitate more active participation than what the current Associate Member may be intending. It was felt that the appeal of becoming an Associate member was the ability to miss occasional meetings, or to leave town for a period of time. Some Board members were not comfortable with allowing a voting "Alternate " member the same flexibility of membership currently enjoyed by Associate Members. The Board also expressed a desire not to specifically limit the number of Associates. Associates may have variable roles, some only offering their expertise on a specific short-term project, while others may prefer a more continuing role. The Board feels it unlikely that numerous persons would serve as Associates, but feels that if the size started to became too cumbersome, that both the CB and the Town Board,'! could decide not to approve any additional "Associates" . Further, the member's of the CB would like to permit Associates to participate on subcommittees. Currently, Local Law states that CB subcommittees must be composed of a minimum of three voting members. The CB wants to maintain this prerequisite, but to also specifically allow Associates as long as the committee had three voting members. In addition, the CB would like the Town Board to consider allowing Associates to serve as the CB representative on the Tompkins County Environmental Management Council (EMC). Because many CB members are actively involved in Board projects and activities, as well as commitments to work, families, or other community organizations, it not always easy to find a CB member willing to take on this additional role . Allowing an interested and eligible non-voting member would increase the pool of prospective EMC representatives. As always, the EMC member would be subject to Town Board approval. In summary, and in response to the Town Board directive to members of the CB to consider these issues, the CB has the following recommendations : Continue to maintain a non-voting member status on the CB Obtain Town Board approval for all appointment to the CB Change the title of the non-voting member, if necessary, to " Associate" , or something similar Do not expressly limit the number of non-voting members Allow non-voting members to participate on CB sub-committees Consider allowing a non-voting member to be appointed to the Tompkins County EMC Adoption of any or all of these recommendations will likely require the re-drafting and amendment of sections of Town, Local Law No . 4 of 1993 , rather than the CB By-laws. In fact, the CB. did not have a strong opinion about having their own By-laws (as currently required by Local Law No . 4 of 1993 ), and would support having all of the above issues covered in an amended local law. To do so, however, will require time for the drafting and review by Board members. In the meantime, the CB needs to be able to adequately assess what its current membership is, both in terms of voting and non-voting members . To do so, the CB needs to have some feedback from Town Board members on the recommendations listed above . Clifford has been an active member of the Conservation Board„ and has served for two years . The members of the Conservation Board ask that the Town Board consider this recommendation for Chair. The terms of office for Barney Unsworth, John Yntema, Don Weir, and Richard Fischer expired on December 31 , 2001 . Each of these members has expressed an interest in continuing to serve on the Board. The Conservation Board asks the Town Board to consider the reappointment of these four valuable members for a two-year term. The Board is delaying its recommendation of new Board members until there is a resolution on the issue of participation by non-voting members. Until that time, the Conservation Board would like to reserve the existing vacancy(s) for current members, who either presently serve, or who are considering serving in 2002, as an Associate Member. The members affected by this decision have actively served for many years on the Conservation Board. The Town did receive letters from three residents who expressed an interest in serving on the Conservation Board. An Interview Committee was convened and interviews were held in late December. The Committee found all three candidates to be well-suited for serving on the Board, with each candidate possessing their own unique background or expertise in the environmental field. We are waiting for the agreement to be signed to go any further . This should be done in January. We have reviewed and made changes to a plan. This will continue after the agreement has been signed . Parks and Trails East Shore Park will require lawn repairs in the spring . The lawn was destroyed with all the bird watching activity. We also are discussing this park site as a boat launching area for the fire department. We will keep the board informed when we have more details. Maintenance of the parks and trails continued during this month of December. We did have to mow the lawns in the parks at least once during the month. Roads Due to the warm and dry weather we have been able to work on a lot of maintenance projects such as cleaning ditches and culvert pipes and patching roads that needed to be done . Other projects include building mailbox posts (for replacement of broken posts during snow removal), hauling materials for stockpiles, replacing and maintenance of signs. We also started putting in under drains on W . King Road, which is on our 2002 project list for repaving. The Highway crews continued working on surveying and preparing as-built drawings for projects within the Town. Water and Sewer The Town's Highway crews repaired three water main breaks—on Vista Lane and 116 Kay Street . The crews also fixed a water main break for the Town of Dryden at 1504 Hanshaw Road . 'The Town of Dryden repaired a water main break during this month and have decided that their crews are trained enough to continue repairing their own. Other water work included performing several confined space entries, cleaning out overflow catch basins, and installing rail frames on Pine Tree Road and Trumansburg Road water tanks . The Highway crews continued to mark out underground dig sights during December. Other projects included sewer lateral clean outs, repairs to sewer lines, and locating and raising manholes within the Town . Protects for December 1 . Parks and trail maintenance . 2. Hauling of stone for 2002 projects . ghk Town Engineer's Report for 1/14/02 Town Board Meeting GENERAL Records Management Engineering staff is continuing to work with existing record maps of the Town ' s water and sewer systems to develop an electronic GIS record map. All Town maps are being catalogued in the map database. The Staff has also been working with the Planning and 7oning staffs to develop a proposal for a storage system that will be space efficient but also allow easy access to the paper originals without damage. This proposal will be reviewed by the records management advisory board and will be supporting documentation for a SARA grant application. Park and Open Space The Engineering staff is coordinating with the Highway Department and Planning Department on the Hanna Pew Trail project. . Plan development is being finalized, design survey work has been done and design development is progressing. Highway The Engineering Staff has provided technical support to the Highway staff for the contract management of the Maple Avenue Construction project. Final Project payments have been approved and the contract file is being closed. 911 /Emergency Operations Center Committee The Town Engineer is the Town of Ithaca representative on the building committee. The Town Engineer and Town Supervisor have been working with Barbara Blanchard, Chair of the Committee, on a proposal for the use of the Station Five site and the County Attorney is drafting a memorandum of understanding. Tompkins County Emergency Management Planning Committee The Town Engineer has been meeting with the committee that is drafting the Tompkins County Comprehensive Emergency Management Plan. The plan is being developed with guidelines from the Federal Emergency Management Agency and includes provisions for coordination of response and recovery efforts to deal with major natural and man made emergencies or disasters. The plan will provide guidance for preparedness, response and recovery policy and procedures. The committee is nearing completion of the draft plan and will be scheduling a meeting for public officials to introduce the document. EARTH FILL PERMITS No activity has occurred on the City of Ithaca application for the proposed demolition and construction spoil disposal site on the Landstrom lot. No new permits were issued in December. WATER PROJECTS Integrated Water System Final project planning and design work on improvements for the integrated water system is on hold until completion of the revised SCLIWC agreement. TOWN ENGINEERS REPORT 1 / 14/02 West Hill Water System Installation of the Pump Station on Oakwood Lane and construction of 2000 feet of 10 Ductile Iron Pipe has been completion . All buried piping has been completed, pressure tested and chlorinated . The pump station has been completed and the pumps and piping have been assembled . The Control building has also been installed, with all related piping and control valves . Town Staff is working with the Electrician, Bolton Point staff and NYSEG on installation of the electric service and controls for the facility. The Town of Ithaca parks department will be completing landscaping work around the Oakwood Tank site in the spring. This will include new tree and shrub plantings in a plan developed with the City of Ithaca. The Engineering Staff is continuing to work on preliminary plans and an engineering report for the part of the West Hill Water System behind the Biggs complex and the Hospital . SEWER PROJECTS Intermunicipal Sewer System The Intermunicipal sewer Committee has been continuing to work on the Draft Agreement for expanding the partnership in the sewer system . The Intermunicipal Sewer Group includes the three existing partners in the Joint Sewer Subcommittee of the City of Ithaca, The Town of Ithaca, and The Town of Dryden, plus the three potential partners which are the Village of Lansing, The Village of Cayuga Heights and the Town of Lansing. The group is also working on the scope of the Environmental Impact Statement required by NYSDEC. West Hill Sewer System Survey Work for the replacement of the Trumansburg Road Hospital sewer line has been completed by the Engineering Interns. The Town Engineer is in the process of developing a design and construction plan for replacement of this sewer lin in 2002. At the request of a Town resident a preliminary evaluation of the cost and benefit to extend sewer along Trumansburg Road from Fire Station 5 to Hayts Road is being developed. The Town Engineer has been looking at a possible sewer line along the North end of West Haven Road, which would serve possible frontage lots on land owned by Ecovillage. DEVELOPMENT REVIEW Site work for the PRI Museum of the Earth started in September. The Town Engineering staff has been inspecting the site periodically to ensure compliance with the approved site plan . The contractor has installed the required sediment and erosion control measures and is maintaining them . No site related problems have been noted . Project work has been shut down for the winter. Eco Village is continuing on the site work for the second resident group with construction on the roadways and driveway. Installation of the sanitary sewer system is also underway. December 4, 2001 Meeting : Independent Wireless One Cellular Antennas at NYSEG Substation, Maple Ave: The Planning Board granted Preliminary and Final Site Plan Approval and issued an affirmative recommendation to the Zoning Board of Appeals regarding Special Approval for a proposal to attach telecommunication antennas onto an existing NYSEG pole at the Maple Avenue substation, Town of Ithaca Tax Parcel No . 63 - 1 -5 , Residence District R-30 . The proposal includes attaching three cellular antennas to an existing utility pole and installation of an equipment compound within the existing NYSEG substation. Presentation of Proposed Town of Ithaca Revised Zoning Ordinance and Map : Planning staff presented a summary of the draft revised Zoning Ordinance and Map that has been distributed by the Codes and Ordinances Committee to boards and committees for internal review and comment. A follow-up working meeting may be scheduled by the Planning Board in January to compile comments regarding the draft Zoning Ordinance and Map. December 18 , 2001 Meeting : Cancelled CURRENT PLANNING DEPARTMENT PROJECTS/FUNCTIONS The following are accomplishments or issues that have been dealt with over the past month. SEQR Reviews for Zoning Board : Five new SEQR reviews for the Zoning Board were done since the December report: ( 1 ) request for a variance to place a storage building and recreational vehicle on a parcel of land which does not contain a permanent residential building as a primary use, 201 Sandbank Road, Residence District R-30, Brian Keith Barfield, Appellant; (2) request for special approval and a height variance to install telecommunications antennas and equipment on a Town-owned water tank, Sapsucker Woods Road, Residence District R- 15 , Nextel Partners, Appellant, Kristin Campbell, Agent (the Planning Board granted site plan approval on 11 /20/01 ) ; (3) request for special approval and a height variance to install telecommunications antennas and equipment on an existing utility pole at the NYSEG substation, Maple Avenue, Residence District R-30, Independent Wireless One, Appellant, Harris Beach LLP, Agent (the Planning Board granted site plan approval on 12/4/01 ) ; (4) request for modification of conditions of previous approval regarding reconstruction of a single-family residence after fire damage to allow for a continuation of use of an interior building loft and exterior window dormers, 934B East Shore Drive, Residence District R- 15 , Ivar and Janet Jonson, Appellants; and (5) request for a variance to construct a single-family residence on a parcel which does not front on a public road, 380 Pennsylvania Avenue, Residence District R-9, Orlando Iacovelli, Appellant. Codes and Ordinances Committee : The Committee met on December 19, 2001 . A quorum was not present. Informal discussion focused on ( 1 ) the possible need to revise some of the proposed draft Zoning Ordinance provisions regarding mobile homes/farm worker housing within State/County Agricultural Districts based on a recent Court of Appeals case ; (2) whether the Town should implement a prohibition or regulations regarding Concentrated Animal Feeding Operations (CAFO ' s) ; and (3 ) a preliminary outline regarding the Generic Environmental Impact Statement for the revised Zoning Ordinance and Map. The next meeting is scheduled for Wednesday, January 16, 2002 , where the 2002 meeting schedule will be approved. Other agenda items will include continuation of discussion regarding the three items above, the overall timeframe for completion of the zoning revisions, an update regarding distribution of the revised Zoning Ordinance and Map to other boards and committees for review and comment, and discussion of work plan priorities. for 2002 . Transportation Committee : The Committee met on December 13 , 2001 , and had further discussion regarding available traffic data (accidents, volumes) and in particular, identification of locations for compilation of accident , data. A list of areas where accident data should be compiled is being forwarded to the County Sheriff, who has agreed to assist the Town with that data. The Committee also discussed the issue of speed enforcement, and whether the Town could pay the Sheriff' s Department for additional services for patrolling and speed enforcement in certain areas. The main focus of the meeting was on possible components and elements of a Town transportation plan. The next meeting, scheduled for Thursday, January 17, 2002, will focus on a continuation of the discussion regarding the transportation plan, as well as an update on the Forest Home Traffic Calming Study. ITCTC Planning Committee : The Planning Director and other Town representatives attended the December 18'h, 2001 joint meeting of the Ithaca-Tompkins County Transportation Council (ITCTC) Planning and Policy Committees. Jonathan Kanter was elected as Vice-Chair of the ITCTC Planning Committee for 2002 , and John Gutenberger was elected to continue as Chair of the Planning Committee , Ron Anderson was elected to continue as Vice-Chair of the Policy Committee for 2002 , and a vote on Chair of the Policy Committee was deferred until the first meeting in January after the County Board of Representatives selects their representative to serve on the ITCTC Policy Committee . There was also an update regarding the County Freight Transportation Study. It was reported that the Freight Study will no longer include recommendations regarding truck route designation for Pine Tree Road, Ellis Hollow Road or Route 366 because of the strong neighborhood reaction at the last public meeting and the fact that the designation of any one of these roads could have additional impacts on other roads in the area. The final report will be distributed soon and will be discussed at upcoming ITCTC meetings in early 2002 . It was also reported that the NESTS Transit Planning Project is underway, and the consultant will be conducting a telephone survey in January/February , Route 366 Bridge Project: NYSDOT has confirmed that the shoulders on .the realigned Judd Falls Road can be five feet wide without affecting the right-of-way width, so five foot wide shoulders will be designed into the project. NYSDOT also confirmed that the bicycle/pedestrian 2 r f s path can be re-designed to incorporate some meandering to provide a more naturalistic character. Final plans, including details of grading, stormwater management and sedimentation/erosion control, will be forwarded for our review. Project contracts are expected to be awarded by NYSDOT in Spring of 2002, with project completion anticipated for December 2003 . Agricultural Land Preservation Program: The owners of the property which is the subject of a possible agricultural conservation easement have indicated that they would like to have their own appraisal of the easement value conducted. We will wait to hear from them with the results. Regional Sewer Project — Environmental Impact Statement (EIS) : Town representatives attended a meeting on December 10, 2001 with some of the regional sewer representatives and the consultants to discuss and clarify how the analysis of growth inducing impacts should be addressed in the Environmental Impact Statement. It was determined that each. of the basic growth areas (Town of Lansing, Village of Lansing, and Town of Dryden) will have to be handled differently because of the nature of the proposed sewer integration project and the situations in each area. The consultant' s original projections for development potential were coming out extremely high, and might be misleading regarding realistic growth potential related to the addition of sewers (e .g. , in Town of Lansing) or expansion of planned sewer area (e.g . , Town of Dryden) . The consultant is expected to circulate a draft summary of the proposed methodology for the growth analysis prior to proceeding with the EIS analysis. Newsletter: [Note : It is time to start thinking about articles for the Winter/Spring issue . Ideas should be forwarded to the Planning Department for consideration . The target for distribution of the Winter/Spring issue is approximately mid-March. That means draft articles should be targeted for submission to the Planning Department by mid-February. A feature article probably should deal with the proposed revised Zoning Ordinance and Map and its schedule of public meetings, etc .] Conservation Board : Planning staff presented a summary of the draft revised Zoning Ordinance and Map to the Conservation Board on December 6, 2001 . The Board will review the draft and send comments to the Codes and Ordinances Committee in early February . The Conservation Board also reviewed proposed changes in the South Hill Conservation zone boundaries, based on recommendations by staff and the Town ' s consultants (Robert Wesley and Nancy Ostman), as a result of follow-up field visits and review of the Ithaca College plant/ecology study. The Conservation Board recommends incorporating additional changes into the proposed boundaries, and authorized staff to send these recommendations to the subcommittee that is working with the Town Board and Ithaca College on the proposed Conservation zone. SCLIWC 's -union contract was passed by all five municipalities -and signed by the negotiating committee . Safety Committee : Continued the review of the draft Safety Manual . Training and Development : See attached copy of brochure describing the Excelling in Supervisory Management Certificate program . This program will run in 2002 with one session offered each month . The training group has begun work-on-a-Leader-ship-series ,,, which-is-projected-to-Iaunch in 2003 . I will update the Board as the details progress , as you may be interested in participating in it . Highway Department completed their annual safety training provided by Norm Wiley , Loss Control Consultant , PERMA , Kristie Rice , Assistant Director of Building and Zoning , provided a lesson on fire extinguisher use and allowed 3 employees to practice putting out a fire . Personnel — Civil Service : Employee new wage letters where sent out to all the- employees , elected and appointed officials . This letter notifies the employees of their new wages but also gives them information regarding cost associated with the wage and benefits . These include the town 's cost for health insurance , retirement , disability, workers' compensation and other benefits . Met with Councilman Burbank for orientation and review of the personnel policies . Connie did a lot of work putting together the years of service appreciation certificates and awards for 5 , 109 15 and 20 years of service for the employees that Cathy passed out at the year end luncheon , which will continue annually. Records Management Day : Connie and I worked very hard on Records Management day to get all the files put into the database and ready for disposition . I was impressed with the program and the ease of its use . Blood Drive : I met Ryan Bonvillian , American Red Cross , and Andy Olmetti , City of Ithaca , to set up a blood drive that would be held at town hall .
