PUBLIC HEARING
July 31 , 1995
Present : Supervisor Doug Austic ; Councilpeople Catherine Stover ,
Tom Reitz , Ben Curtis ; Town Attorney Bruce Wilson ; Code
Enforcement Officer Alex Rachun ; Town Clerk Marsha

S eafuse , Attorney Elena Flash , Skip Stedge .
S upervisor Austic opened the Public Hearing at 7 : 10pm and read
the legal notice as published . The reason for the public hearing
is to hear comment from the public regarding the establishment of
a single - user water district for tax parcel # 13 - 3 - 2 in the Town
o f Ulysses .
Mr . Austic said the Town accepted the petition from Jim Seafuse
w ith the stipulation that a few other things be submitted ; 1 ) an
e asement across the Duddleston property ; 2 ) confirmation from TC
H ighway Dept . / have a permit issued to Mr . Seafuse 7 / 24 / 95
stating they will allow him to do that ; 3 ) approval from TC
H ealth Dept . / have a letter from John Andersson 7 / 26 / 95 which
supports this ; 4 ) contract from the Village / their attorney is
w orking on this and will have it shortly ; 5 ) contract with Jim
Seafuse / will do that shortly ; 6 ) SEQR / been submitted by Mr .
S eafuse .
Mr . Austic asked for public comment .
Mr . Seafuse . felt it was a good idea .
Ms . Flash , representing John & Isobel Duddleston said there are a
couple of questions ; we are certainly supportive of this
project . . . asked if the line along Falls Road would remain a
private line or become a municipal line .
Mr . Austic said it will remain a line of the water district under
the responsibility of Jim Seafuse . Ms . Flash asked if it
w ouldn ' t be advisable to put in a larger line for the potential
o f bringing municipal water further down Falls Road ? Mr . Austic
said the Town had considered that ; would rather go along RT 96 to
pick up more users . At this time it was thought to go ahead with
the single - water user district .
Ms . Flash asked if the Town has any input or authority regarding
the meter ? Mr . Austic said the meter will be installed on the
right hand side of the road ; the Village will bill the Town for
the water and then the Town will bill Mr . Seafuse . It ' s usually
• one and one - half times the rate . Ms . Flash asked if there would
be any lien or other impact on the Duddleston ' s property ? The
answer was No . Ms . Flash also asked why it should not be a
multi - user water district and get permission from the Village .
Mr . Austic said that could be a problem , that is why it was
requested as a single - user district . Mr . Austic said that
Attorney Wilson suggested that this easement be tied to the water
district and not to the Duddleston ' s personally .
Short discussion regarding the Seafuse property and the water
district attached to that property .
Mr . Wilson said several resolutions will eventually need to be
passed , including one approving construction along highway lines .
Hearing no further comments , Mr . Austic suggested work on the

S EQR ; asked how long until all paperwork needed would be in
place .
Mr . Wilson said need contract with the Village , a couple of other
items ; shouldn ' t be long . Suggested putting it on the August
Town Board Agenda .
Mrs . Stover moved , seconded by Mr . Reitz to close the Public
H earing . Unanimously approved , the Public Hearing closed at
7 : 45pm .
