Schwan, Supervisor Andrew W. McElwee, Councilman Noel Desch, Councilman Victor Del Rosso, Councilman ABSENT: Robert N. Powers, Councilman ALSO PRESENT: James V. Berkey, Christopher Circle Robert L, Bruce, County Representative Other town residents Members of Radio, TV, and Press Supervisor Schwan called the meeting to order at 5:10 p.m. APPROVAL OF MINUTES Supervisor Schwan noted that in the third paragraph on page 2 of the minutes of October 7, 1971> in the fifth line "Lakeside" should be corrected to "Lakeshore", Motion by Councilman McElwee; seconded by Supervisor Schwan, RESOLVED, that the minutes of the meeting of October 7, 1971, with the correction above noted, be approved. Unanimously carried. Motion by Councilman Desch; seconded by Councilman McElwee, RESOLVED, that the minutes of the meeting of May 10, 1971 be approved as presented. Unanimously carried. FIRE CONTRACT WITH THE CITY OF ITHACA - PUBLIC HEARING Proof of posting and publication having been presented, the Public Hearing with respect to the Fire Contract between the City of Ithaca and the Town of Ithaca was opened at 5:15 p.m. Fire Chief Weaver spoke of the proposed 1972 fire contract between the Town of Ithaca and the City of Ithaca. He said that under the terms of the contract the Town is obliged to provide a map showing a number of details and providing a street directory, but that their most recent guide was a copy of the tax roll dated 19^4, and that they had not been receiving current information with regard to new Town streets or roads. Planning Consultant Peter Francese said he would provide Chief Weaver with a copy of our latest highway map and keep him up to date in the future. Chief Weaver said he would provide a cartographer if the Town would provide the information. sc - 2 - November 4, 1971 Chief Weaver also stressed that some attention should be given to the delineation of areas of protection as between the City of Ithaca and the Village of Cayuga Heights. This was particularly necessary in the Forest Home area with the problem of crossing the bridges there. Chief Weaver also said the Town ought to look into the matter of the 90-day termination clause in the fire contract, since he did not be lieve the Town of Ithaca could provide its own fire protection on such short notice. Town Attorney Buyoucos felt all future contracts should not carry the 90-day termination clause. Chief Weaver noted he was particularly unhappy about the "one engine" requirement of the contract, particularly with reference to the Tomp- kins County Hospital, National Cash, and some other areas. No other persons wishing to be heard. Supervisor Schwan closed the public hearing, and the following motion was made: Motion by Councilman McElwee; seconded by Councilman Desch, RESOLVED, that the amount of $28,943.00 as consideration in a con tract between the City of Ithaca and the Town of Ithaca, whereby the City of Ithaca agrees to furnish fire protection for a one-year per iod for the year 1972 in the Town of Ithaca, excepting the following areas, to wit: aj the Village of Cayuga Heights b) the area comprising all the territory lying between the east boundary of the Village of Cayuga Heights and the east boundary of the Town of Ithaca c) the Hamlet of Forest Home exclusive of the structure housing the Cornell University Filtration Plan be approved, the approval of the contract, however, to be contingent on approval by the Town Attorney. Unanimously carried. FIRE CONTRACT WITH VILLAGE OF CAYUGA HEIGHTS - PUBLIC HEARING Proof of posting and publication having been presented, the Public Hearing with respect to the Fire Contract with the Village of Cayuga Heights^was opened at 5:20 p.m. No persons appeared to be heard and the Hearing was thereupon terminated. Motion by Supervisor Schwan; seconded by Councilman Desch, RESOLVED, that the amount of $10,656.00 as consideration in a contract between the Village of Cayuga Heights and the Town of Ithaca, whereby the Village agrees to furnish fire protection for the year 1972 to the Hamlet of Forest Home and that portion of the Town to the north of Forest Home and between the east boundary of the Village of Cayuga Heights and the east boundary of the Town of Ithaca, be approved, the approval of the contract, however, to be contingent on approval by the Town Attorney. Unanimously carried. PRELIMINARY BUDGET - 1972 - PUBLIC HEARING Proof of posting and publication having been presented, the Public Hearing with respect to the Preliminary Budget for the Town of Ithaca for 1972 was opened at 5:30 p.m. ^ Mr. Berkey and Mrs. Livesay raised questions about the $41,000.00 | | which had been authorized to be expended for well exploration in Inlet Valley. Supervisor Schwan said the money had been paid to Layne-New York, Inc. well drillers, that none of it had been paid to Lozier Engineers; that Lozier Engineers are a consulting firm which the Town of Ithaca has used for many years; that the money for the well-drilling was appropriated from the Town-wide surplus and put into a capital account entitled "Well-drilling Exploration." Mr. Berkey asked what the current balance was in the general fund. Super visor Schwan said that although it is difficult to figure until the year is over and it is known in what accounts there will be a surplus, at this time it is roughly $40,000.00. - 3 - November 4, 1971 After some further discussion. Supervisor Schwan asked if there were any other persons to be heard. No other persons wishing to be heard the Hearing was terminated. Motion by;Councilman Desch; seconded by Councilman Del Rossoy RESOLVED^,' that the Town Board of the Town of Ithaca adopt the Preliminary Budget 1972 as the Annual Budget for the fiscal year beginning January 1, 1972, and BE IT FURTHER RESOLVED, that the Town Clerk of this Town shall pre pare and certify duplicate copies of the Annual Budget adopted pur suant to Section 202-a of the Town Law, and deliver one copy to the Supervisor of the Town to be presented by him to the Board of Super visors of Tompkins County. Unanimously carried. (A copy of the Budget as adopted Is appended to these minutes.) SPECIAL DISTRICT ASSESSMENT ROLLS - PUBLIC HEARING Proof of posting and publication having been presented, the Public Hearing with respect to Special District Assessment rolls was called to order at 6:00 p.m. No persons appeared who wished to be heard. Motion by Supervisor Schwan; seconded by Councilman Del Rosso, RESOLVED, that the Public Hearing with respect to Special District Assessment Rolls be adjourned until 5:00 p.m. on November 18, I971 and that the Town Clerk be instructed to re-piiblish and post the notice of a Public Hearing in the Ithaca Joumal/'to appear ten days prior to the meeting, in accordance with Town Law. BIDS ON ^iroW PLOW *fo Supervisor Schwan reported that two bids had been received for a^new 9-foot-phe-Way Snow Plow, and opened by the Town Clerk at 2:00 p^m. on October 29, I971 in accordance with notice to bidders. One bid was received from Prink Snow-Plows of Clayton, New York, in the • amount of $1,405.00 ^d another bid from Charles J. Blackwell, Inc., Horseheads, N. Y. in the amount of $f;*30P..6o. Proof of publication and posting of the notice to bidders, in accord ance with a resolution of the Town Board at its meeting on October 7# 1971, was presented. Motion by Supervisor Schwan; seconded by Councilman Desch, RESOLVED, that the Town of Ithaca accept the low'bid of Charles J. Blackwell, Inc. in the amoiint of $1,350.00 for tti^ purchase of a new Prink 9-foot One-Way Snow Plow Model 64o K. Motion by Supervisor Schwan; seconded by Councilman Del Rosso, RESOLVED, that upon recommendation of the Park Council the Town Board of the Town of Ithaca appoint Robert Mann of 503 Warren Road, Ithaca, New York, to the County Environmental Management Council as a repre sentative of the Town of Ithaca. TAX REFUNDS .n^" ' . Supervisor Schwan; seconded by Councilman Desch, ^ RESOLVED, that the Town .Bpard of the Town of Ithaca authorize refunds to Mr. Zelaway Sawyer, 130 Ridgecrest Road, Ithaca, New York, for water benefit paid in May to the extent of one unit ($75.09) and for sewer benefit paid in May to the extent of one unit (|l23.o5). Unanimously carried. INLET VALLEY CEMETERY ASSOCIATION Supervisor Schwan read a letter dated September 22, 1971 from Frank Aioanese, Attorney, who represents the Trustees of th'e Inlet Valley cemetery Association requesting the Town of Ithaca to take over this cemetery pursuant to Section iffoi (o); of the Not-Poriprofit Corpora-:. 10ns Law. Mr. Albanese stated that there are tio longer persons in . ^onumj^ity willing to act as Trustees .and that thd'cemetery would . : ? He stated that the^cemetery is'well kept and / 'maintained at the present time but how much longer it could be kept Supervisor Schwan read his j^teply to Mr. Albanese,dated September 28, 1971, requesting further information about main- ^ iuvolvod, area of the cemetery, whether it has j ? land,^whether people are still being buried there, who opens I is performing the maintenance now, the •annual costs for the last five to ten years, the amount of the Trust jund, how it is invested, and the annual return. Mr. Albanes..e replied October 25, 1971 and enclosed informational inaterlai Georgia, one of. ths Trustees, dated October l4, ^ answering all Mr. Schwan's questions, except with reference to V Trust .fimds for which he enclosed a statement of the fundS atValley Cemetery Association, showing totalfunds balance of $11,648.00. At 5^ this draws $582.40 interest per year. ^ ^ere was some discussion of what the Town's responsibilities are in this connection, how it would be kept up, the hiring of personnel to: maintain it, whether it would be necessary to hold a public hearing to take over the cemetery, whether the Town would be setting a pre- , cedent in taking over the cemetery, and whether the Town would con tinue it as an active cemetery. This item was tabled until the regular meeting of the Town Board on December 13, 1971 in order to give the Town Attorney an opportunity to look into the matter and make a recommendation to the Board at that time. Mrs. Holcomb mentioned that there had been a complaint made to the Town Clerk that there is an area on Coddington Road between the City Line ^d. the entrance to Ithaca .College that requires lighting. Super^sor Schwan said he would write a letter to Paul Parinella, Business and Finance and Treasurer at Ithaca College about this problem. In connection with intersection lights, Mrs. Livesay suggested that xp mignt be a good idea to re-assess the Town*s policy of only put- 1 intersections of approved Town roads or streets. Super-I schwan agreed that such a re-assessment should be made, possibly _ in terms of lights at intervals.of a certain number of feet. Council man pesch felt that we would almost have to get into the matter of forming .lighting districts to handle the situation. EASTERN HEIGHTS LIGHTING DISTRICT Supervisor Schwan reported that on October 6, 1969 there was a resolution of the Town Board of the Town of Ithaca for the formation of a Lifting District in Eastern Heights (Phase 2). However, there does not appear to be any record of a public hearing on this matter. Mr, Schwan said that the Towii of Ithaca lights intersections of approved town roads or streets, but that Eastern Heights requested ornamental lights in between the intersections. The New York State Electric & Gas Corporation has estimated that such lighting will- cost $2,835.00 annually. This ^ount would be raised through ad valorem taxes. Aif. i.O I : V- 90 6 - November 4^ 1971 TOWN OF ITHACA WATER SYSTEM - DESIGN STUDY - PUBLIC HEARING Proof of publication and posting having been presented with respect to the expenditure of not to exceed. $30^^000,00 for ari" engineering design study of.a Town water system, the Hearing was^opened at 6:45 Supervisor Schwan^reported that after long "study and meetings with pa various, municipalities and other groups in regard to long-term water supplies, it is the conclusion of the Town Board that we should pro ceed with engineering design study of a Town of Ithaca water sys tem, using Bolton Point and the Inlet Valley wells as a source. He pointed out that the Town of Ithaca has three choices: (1) To continue buying water from the City of Ithaca at a rate-and-a-half, to go it alone with a Town-wide water system, or proceed via intermunicipal cooperation. Mrs, Livesay expressed the opinion that the Town of Ithaca'Should follow the third method. She said she'^was not opposing the engineering design study, but did feel that the Town of Ithaca should make a strong effort to keep the channels of communication open with the City of Ithaca. Supervisor Schwan assured her that they would be, ^ t After some further discussion and no other persons wishing to be heard, the public hearing was terminated. Consideration of a motion to authorize the expenditure of not to exceed $30,000 for a design study of a Town water system was tabled until the next meeting of the Town Board in order to give the Town Attorney sufficient time to draft an appropriate resolution. l^ESOLUTION OF INTENT Supervisor Schwan; seconded by Councilman Ddsch, RESOLVED, that with a view of exploring the possibilities of primary | and long-range water supplies at Bolton Point for the- Towns of Dryden, Ithaca, Lansing, and for the Village of Cayuga Heights, the elected Boards of these municipalities agree to share in establishing a fund to finance preliminary studies and to approach Lozier Company as engineer for these studies and to serve as consultant on ths means of approaching State and Federal agencies for authorization to con struct a possible alternate water supply and to acquire the appropri ate State and Federal funding. MONKEMEYER RE-ZONING - PUBLIC HEARING Proof of publication and posting having been presented, the Public Hesxing with respect to re-zoning 15.15 acres of land owned by He.rbert Monkemeyer on East King Road for the constru^ion of 111 units fr^m R-30 to multiple residence, was opened at 7:00 ^Jm. This proposal was recommended to the Town Board by the Planning Board of the Town of Ithaca for the following reasons: (1) the site is nekr a large commercial zone in the Town of Ithaca; (2) it is sited on ' ^ King Road East which can be considered a primary road so there appeai^e ^ to be no traffic problem; (3) it is in accordance with the general plan of surroiinding commercial development with high density residen- ^ tial as a buffer zone between commercial and single family dwellings; (4) its proximity to a major state highway further decreases the likelihood of any traffic problems; and (5) its proximity to major sites of employment minimizes travel distance between home and work. Mr, Monkemeyer was represented at the hearing by his attorney, Norman Freeman, and one of the residents of the area, Sharon Staz was repre sented by her attorney, Richard Thaler. Wells & Koetter, architects for Mr. Monkemeyer, presented detailed plans and maps and outlined the proposal for the Town Board. During the discussion, Sharon Staz, through her attorney Mr. Thaler expressed considerable concern over drainage problems and how the proposal might affect wells in the area. Such,.C9ncern was alsp ex pressed by Mr. Edward Ai Whit lock, of King Rjoad..',The architects,. , , Wells &:i,|Coetter, felt this was btrictly an engihi$9i*ing problem which they would solve. In the course of the discussion there was some, cpntroversy with regard to a proposed agreement between Mr. Eyan;Mbnkemeyer and Miss Sharon Staz. Ihis matter was argued between Mr.;, I'reeman and Mr. Thaler with no clear-cut outcome. Mr. Thaler requested a delay in approving this proposed re-zoning until his client was properly pro tected and other people in the area were protected with respect to run-off and drainage. Mr. Freeman felt the matter could be resolved between the parties. The Town Board felt it Would 'Tike to look into the matter of run-off and drainage before making any definite commitmeht with respect to re-zoning this property. Therefore, ;'^he.mattei^ tabled until December 13, 1971, the next regular meeting of the Town Board. Mr. Freeman requested thiat the Board take it Up at the proposed November l8th meeting of the Board. The Board said it might be taken up at that time, but for the moment would hold to December 13, 1971. Wo other persons wishing to be heard, the Public Hearing was termi nated at 7:50 p.m. COMMUNICATIONS .. r, Supervisor Schwan read a letter from a Mr. and Mrs. Owler of 1512 Slaterville Road with regard to the possibility of getting a right ' of way across land of Mi^. Marion for a gas service to their home. It was suggested that the Supervisor contact the New York State Electric & Gas Corporation to see what can be done for the Owlers. SPECIAL IMPROVEMENT DISTRICTS ASSESSMENT ROLLS PUBLIC HEARING Proof of posting and publication having been presented, the Public Hearing with respect to the Special Improvement Districts Assessment Rolls was opened at 5:20 p.m. j Supervisor Schwan reported that there had been some revision in the formula: for assessing undeveloped acreage to take into consideration the fact that the further one moves back on the land away from the mains. :the longer it will be before the land can be developed and the unit assessment has been scaled down on the general fonnula to 1/4 of a unit per acre for acreage up ta 1,000 feet from the mains, 1/6 of a unit per acre for acreage from 1,001 to 2,000 feet from the mains, jsind 1/8 of a unit per acre for acreage from 2,001 to 3,000 feetr-froin-the maihs^ lahd at $0.01 per thousand of assessed valuation beyond 3>000^.feet from the mains. The Board felt this was a more equitable method of assessing benefit on undeveloped acreage. F. W, Hornbrook presented himself and indicated that he felt he should be "guaranteed" water to his acreage. Supervisor Schwan set id that since the water is supplied by the City of Ithaca he could not "guarantee" Mr. Hornbrook water any more than any other Town resident. He felt, however, that Mr. Hornbrook would be able to get water tp his acreage under all normal circumstances. n No other persons wishing to be heard, the Hearing was tenninated.
