Home My WebLink AboutTB Minutes 1970-09-14TOWN OP ITHACA Town Board Regular Meeting September l4, I970 PRESENT: Walter Schwan, Supervisor Harry Baker, Councilman Andrew McElwee, Councilman ALSO PRESENT: James Buyoucos, Attorney David Cowan, Zoning Officer Peter Prancese, Planning Consultant Scott Carlson, SUDC Residents of Town of Ithaca Matthew McHugh, Attorney Members of Radio and Press ABSENT: Noel Desch, Councilman Vincent Del Rosso, Councilman Marion Morey, Highway Supt, Supervisor Schwan called the meeting to order at 4:30 p.m« APPROVAL OP MINUTES Suppvisor Schwan; seconded by Councilman McElwee R^OLTOD, that the minutes of the August 10, 1970 regular meeting and the August 17, 1970 adjourned meeting be approved as submitted^ f-n Carried, APPROVAL OP WARRANTS McElwee; seconded by Councilman Baker RESOLVED, that warrants in the following amounts be paid: General $86,705.47 Hl^way 14;923:70 South Hill Sewer Dist. Ext. #1 243.00with the exception of Vouchers 885 and 891. Carried. Mr. Mark Beathan, 344; King Rd. West, appeared before the Boeu^d and referred to the 30 mile trip required to take refuse to the landfill area. He stated he had consulted with the highway superintendent ^d found that they have a dump truck that is used sparsqly. Mr, Beathan felt that this truck could be used to haul garbage, to the dump for resridents of the Town who would bring their refuse to the Town Barns and place it in the truck. Councilman McElwee. felt the landfill operation was under the care of the County and not a Town function; he also felt that the To%m did hot Want to\get into the garbage business. Supervisor Schwan stated that it was 4 regulation that all garbage be-hauled in closed trucks arid further that the Town definitely did not want to get into the gairbage business. Mr. Baker concurred with this and felt that as long as we have collec tion by private contractojrs the -Town should not be involved, Mr, ^ Beathan left the meeting very upset and stated he felt the Town ! Board was arbitrary in its decision, - i n n • . ANNEXATION-MAPLE AVE> SITE ^ j City of Ithaca has agreed to the date of September 28, 1970 at 7-30 p^m. for a Joint Public Hearing regarding their requested annexation of the parcel of land in the Maple Avenue area. The Supervisor recognized Mr. Scptt^XJaflsohi Director of the New York State Urban Devo'ix>p»e«t who explained the history and baokgroimd of their housing projects and how the - 2 - September 14, 1970 sites were selected♦ He answered questions posed by members of theTown Board. A mee^ting was arranged to further discuss this subjectto be held 4j3P September 21, 1970 in the Town Board Room. FINAL estate - WATER STORAGE TANK - 2nd SQ^ HILL WATER DISTRICT A letter was read from Lozier advising that the final estimate for Hthe 500,000 gallon water storage tank on Ridgecrest Rd. was $5,085.75. IUnder terms of the contract the Town may elect to retain for one year5^ of tbe final estimate to implement the guarantee. Supervisor Schwan; seconded by Councilman BakerRESOLVED, that the final estimate from Lozier Engineers for thewater storage tank on Ridgecrest Rd. be paid less the 3% retainedfee of $1,798.50. ^ Carried. HICKORY PLACE4 PINEVIEW DRIVE The Town Clerk indicated she had received the abstracts and deedcovering Hickory Place and Pineview Terrace in the Savey Subdivision. Supervisor Schwan; seconded by Councilman McElweeRfijSOLVED, that Hickory Place and Pineview Terrace in the Savey Sub division be accepted as Town Roads. Carried. TOWN CLERK Supervisor Schwan advised that the Town Clerk would be leaving the r-|November since her husband was being transferred. He asked Itnat they appoint Mr. Edward L. Bergen as Deputy Town Clerk, effec- 'tive September 15, 1970, at an annual salary of $7,500. Councilman McElwee; seconded by Councilman Bakerk^olved, that Edward L. Bergen be appointed Deputy Town Clerk,effective September 15, 1970, at an annual salary of $7,500* Carried. DOG ENUMERATOR Councilman McElwee; seconded by Supervisor SchwanR^OLVED, that Mrs. June Miles, III5 Danby Road, be appointed DogEnumerator for the Town of Ithaca for I971. Carried. VARNA WATER DISTRICT - DRYDEN SEWER DISTRICT Supervisor Schwan pointed out that we have no formula for chargesto these districts for services rendered by the Town of Ithaca. Councilman McElwee will work with Supervlsox-to cheok into-this and work Out a possible formula. transfer of funds Motion by Councilman McElwee; seconded by Supervisor SchwauiRESOLVED, that the following transfer of funds be approved:Transfer from Surplus to Contingency $ 11,050Transfer from Contingency to:Account #1900 Town Engr., Plan. & Consult, $ 9,000 1133 - Insurance-Liab.600' 1510 - Ibwn Clerk 850 ' 1710 - Teoc Collector 600 Carried. n - 3 - September 1970 ROUTE 79 TRAFFIC Supervisor Schwan read the following communication from the City of Ithaca: "RESOLVED, that the Acting Traffic Engineer be directed to request the Traffic Division of the State Department of ^ Transportation to Establish r^^lations on Route 79 between the City of Ithaca and the community of Richford in Tibga County to remove through truck and bus traffic from this routejahd that he be directed further to request the Town Board of the Town of Ithaca to support the City's request and Join with it in its petition to the StatO* Supervisor Schwan felt that we need bus Service on ihis rOad; also that if the State granted this request to i*embVe through bus and trucks on Route 79> they could also do it on other area roadfe* Mr^ Armand Adams, representing Crispell's Charter Servicej spoke to the Board, He felt that this vfoUld be illegal since the State has accep ted 79 as an arterial highway, and it is ndt a City or T?own road. Buses and trudks.haVe received their chart^S from the State Public Service.,Commission to bberdte on this highwayi Also, Crispell' s has a considerable investment in garages on Route 79 at which they receive and service large vehicles. He felt such a move would be harmful to his client* A representative from the Greyhound Bus Lines advised that they were a regular route Carrier and this was the route accorded to them. Mr. Baldwin from the New York State Public Service Commission advised that he had contacted Albany and through routes do have rights over 79; Greyhound has rights. Any request to close 79 to through truck and bus traffic would have to go to the Public Service Commission. Motion by Councflm^ McElwee; seconded by Councilman Baker RESOLVED, that this mdtter be tabled until we can ascertain actual restrictions and get more information with reference to the use of Route 79 by through trucks and buses. Carried. REPORTS James A. Buyoucos - Town Attorney - reported as follows: 1. Pranciamone - injunction is still pending. 2. Kenilworth sign - Sign is down; they will go to Zoning Appeals Board for new sign. 3. Code of Ethics - working on this; will come up with projios^l by December. 4. Still have to review Park policy. 5. Working on WTKO request for rezonlng. Someone on the Board should be working on this. David Cowan, Zoning Officer: 1. Kenilworth sign is down. They will meet with the Board of Appeals next week for authority to proceed on new sign. 2. Ideman and P & C - if we will submit a sketch. Manager of P & C will put up necessary screening, etc. within a week; Ideman will do what the Planning Board designates. Peter Francese, Planning Consultant: 1. Requested Board to meet with him on Monday, September 21, 1970, 7:30 p,m. to further discuss and work on the Zoning Ordinance. - 4 - September ik, 1970 STATE TRANSPORTATION STUDY Supervisor Schwan to serve on policy committee; Peter Francese will serve on Technical Advisory Committee, Supervisor Schwan advised that Mr. Shub, D.O.T. in Syracuse, asked if the Town would take over Forest Home Drive. Proposed by-pass would be 4-5 years in the future. He asked if the Town took over this road, barricaded bridges, would the residents of Forest Home approve this? David Cowan expressed the opinion that this would be satisfactory. Coixncilman McBlwee | | also felt this would be a good solution to their problems. The Clerk is to write a letter to the Forest Home Association advising that the Town has been asked to take over Forest Home Drive and that our f ] suggestion is to close the bridges, except to pedestrian traffic. We would like an indication from the Association as to their feeling on the closing of the bridges, with the possibility that the by-pass will be built in 4-5 years.
