At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County, New York held at the Town Hall , 215 North Tioga Street , there were present : PRESENT : Catherine Valentino , Supervisor; Mary Russell , Councilwoman ; Carolyn Grigorov, Councilwoman ; David Klein , Councilman ; Ed Conley, Councilman ; Tom Niederkorn , Councilman . ICall to Order: The Supervisor called the meeting to order at 5 : 36 p . m . , and led the assemblage in the Pledge of Allegiance . A_qenda Item No. 3 = Report of Tompkins County Board of Representatives. Tim Joseph , TC Board of Representatives - The County is conducting a search for a new County Administrator. The current County Administrator will be leaving in one week. The County is continuing its search for office space . The Ithaca Journal reported the County offices would be moving back into Biggs A Building . The report is wrong . The County did sign a lease with the company interested in buying the building . The lease would allow the County to remain in the building . The County records storage is in Biggs A . We are not moving offices back into the building . The County is in the process of looking into a records management center. The Community Justice Center is being moved into the old library building . The negotiations of selling the old library have fallen through . We were delaying the move of the Community Justice Center into the building . We decided that we did not want to delay any longer. The interested party did not make or accept an offer by the deadline . The set of new programs , Justice Center and Drug Courts , are beginning to get underway . The Family Court , Drug Court and Felony Drug Court has hired a coordinator to organize the new program . Aqenda Item No. 4 - Report of Fire Commissioners. i TOWN BOARD PAGE 2 JANUARY 8 , 2001 APPROVED - APPROVED - APPROVED - FEBRUARY 12, 2001 - APPROVED - APPROVED - APPROVED Bob Romanowski , IFD - The Fire Department had a wellness program proposition for Ithaca Colle This is an effort to enhance physical fitness in the Fire Department . Preliminary discussions do n look promising . Participation by personnel in other departments and agencies in the Disaster Management Program at Emensburg has not been productive . The Fire Department and City of Ithaca is turning efforts towards a disaster plan for the City and County . They are concentrating on making sure we are well protected and have a plan in place . The County Communications and 911 program are still putting forth effort to consolidate fire and police dispatch in the existing space in Central Fire Station , The City Planning Department's Traffic Calming Study continues with initiative for five different neighborhoods and planning stages . I urge the Town of Ithaca to be involved . They are looking to channel traffic on Cliff Street . It will have a negative impact on traffic in the Town of Ithaca . The City is considering narrowing Cliff Street to one lane . Three volunteer fire companies are being told to vacate their rooms at Central Station to make room for administrative office space . The department faces a severe space deficit . This is the first time in 178 years that there will not be volunteer fire fighter personal space in Central Station . The volunteer fire companies have to find secure storage facilities for their artifacts and personal equipment . The City Engineer's : office is applying for a grant that would include traffic signal preemption f emergency vehicles . This would include a receiver and controller at specified intersections . It wo also include transmitters in emergency vehicles for activation of a green light . Identification of k intersections is now in progress . Boston has this system . Their traffic accident rate has gone do between emergency vehicles and private vehicles . A volunteer recruitment committee is now being formed . It is replacing some of the Volunteer Coordinator's duties . The Volunteer Coordinator's position has been abolished . The duties and responsibilities have been left to the volunteers . The City awarded a stipend every year out of tax monies to each individual volunteer company . The last stipend received was $ 1500 per company. This last budget round has cut all money to the volunteer companies . Supervisor Valentino - Was the money included as part of the fire budget? Mr. Romanowski - Yes . It would have been a budget line for $ 1200 . The money has been eliminated . A portion of the money is being moved to a budget line for the Fire Department for equipment . The volunteer system has been in effect for over 175 years . It has saved an enormous amount of money for the City. It also has saved the Town of Ithaca money . The morale is low . It is hard to get volunteers to go through the training . Monthly training is mandated . The volunteer funding has been eliminated and they have been asked to . vacate their facilities . The two percent money is the only other funding for the volunteer fire fighters . Two percent of foreign fire insurance is taken by the St and then allotted to volunteer companies . APPROVED Councilman Conley - Paid fire fighters throughout the State are trying to eliminate volunteer companies. Their position is that it is a professional position with professional training . Some olunteers are not willing to keep up to date with the training . The volunteer system in Ithaca is a good system . Is there any hint of the paid firefighters putting pressure on volunteer firefighters? Mr. Romanowski - Yes , there is and there always has been pressure on volunteer fire fighters . The City of Ithaca is the only fire department in the area with paid fire fighters . The City of Ithaca will call in Trumansburg , Enfield and Cayuga Heights fire departments for stand by to fight fires in the City . Councilman Conley - It is bothersome that unions feel they would be better off without the volunteer system . Mr. Romanowski - Many career fire fighters started as volunteer fire fighters . They took the test to become career fire fighters. It is an undercurrent that has always been going on . It has become slightly worse over the last few years . The Town is a partner in the Fire Department . It is my responsibility to make sure the Town is aware of what is occurring in the Fire Department , Agenda Item No . 5 - PRESENTATION : Tompkins County Flood Hazard Mitigation Program . Kate Hackett, TC Planning Department - This program started in 1997 in response to the flood in January of 1997 . There was significant property loss during that time . The County appropriates money annually for this grant program . Any applicant funds one third of the proposed project . The municipality where the project is located pays for one third of the proposed project. The County funds one third of the project . Municipal approval is required . Applicants can be private or public landowners . This project is also part of a larger effort to coordinate environmental and economic issues . There is an advisory committee that oversees the program , the Flood Hazard Mitigation Advisory Committee . The committee recommends final approval of applications to the Board of Representatives . The program is both economic and environmental . We want to make sure the streams maintain their functions . Stream bank erosion can cause problems in septic systems . This is another identified source of pollution in many of the water bodies in Tompkins County . Water supplies can also be threatened by private wells . Public systems treat for water pollution . The purpose of the program is to prevent flood damage . It protects property and the environment . This will also help to reduce costs for governments and landowners . It alleviates environmental problems. This program does require permits from the Department of Conservation and the Army Core of Engineers . We are looking for long-term solutions to these problems . We want to make sure it is an efficient process; for the landowner, municipality, County and the environment . The role of the Flood Hazard Mitigation Advisory Committee is to review and prioritize the projects . We give our recommendations to the Board of Representatives to make the final decision on funding . We must consider upstream and downstream impacts of the proposed project . We do not want to TOWN BOARD PAGE 4 JANUARY 8 , 2001 APPROVED - APPROVED - APPROVED - FEBRUARY 12, 2001 - APPROVED - APPROVED - APPROVED cause more problems than what we are trying to fix . We want to insure effectiveness and coordina the work effort . Ms. Hackett presented slides of eroded stream banks in the Town of Ithaca to the Town Board, The State Constitution does prohibit gifts to private landowners . This program can be interpreted as a gift by some to private landowners . The State Water Conservation District Law allows public entities to spend public money on private landowners . It allows that financial aid be provided to any occupier of land within the conservation district to carry on erosion control , flood prevention , and sediment control measures . There is preference for spending money on private land on Federal , State and local levels . There are many Federal programs that utilize public money on private land . The State level has not had any formal opinions since 1990. The State does support expenditure of public money on private land for this purpose , if there is a public purpose . There must be a public purpose to this work . There is precedence for this program in the County . In 1998 , the County Attorney interpreted the County could spend public money on private lands for erosion and sediment control . Craig Schutt , Tompkins County Soil Water Conservation District - We are the administrators of this program . We contract with the municipalities to do the projects . The Town of Caroline has been very active in this program . They have the most active watershed committee in the County . Their watershed committee holds monthly meetings . The committee hol an annual spring walk where individuals of the committee walk the creek to identify potential projec and problem areas . It then sponsors an annual public forum where landowners can identify th property on a map and sign up for the program . The committee then discusses and prioritize potential projects . The Town of Caroline appropriates money annually to make sure there is money available for the projects . This increases the amount of work that can be accomplished . The Town of Lansing takes a different approach . They have been active in the program . The Town appropriates funds in its budget . The Town submits the projects and the Town Highway Department does a lot of the work . The Village of Dryden has applied for some projects and the Public Works Department has done some work . The Town of Dryden decided that they need to get the Village projects complete . The Town of Dryden is not applying for funds because they are supporting the Village . The Town of Newfield has completed a few projects . The Town did contribute money to the projects . The Highway Department worked with us on the projects . This process is not very different from the past application process . We need to be able to determine which projects meet the criteria . People were doing a lot of work for proposals that did not meet the criteria . We would have to turn then down . We work with the applicant to meet criteria . The final project will have a more complete budget and work plan . Our goal is to reduce future impacts from flooding . We consider upstream and downstream impact We do not do projects that will impact someone else 's property . The life span of the project and t TOWN BOARD PAGE 5 JANUARY 8 , 2001 APPROVED - APPROVED - APPROVED - FEBRUARY 12, 2001 - APPROVED - APPROVED . APPROVED practice used is reviewed . Municipal support is important. We do not consider projects that lack municipal support . We look at if the work being done is a cost effective way to deal with the problem and have a lasting affect . The impact on natural , historical and cultural features are considered . The impact on the overall watershed is reviewed . We also look at projects that could be completed within the year. We might consider a project that needed to be done in the next construction season . It would depend on the circumstances . The program is setup to get the project done within the same year. We are open to new , innovative ideas . Three proposal packets were sent to each municipality in December. The packets are due back to our office by February 9th . The Flood Hazard Mitigation Advisory Committee will meet soon after February 9th . The committee will be looking for completeness and prioritizing proposals . We will have the final proposal packets ready for the applicants by the end of February . The packets will be due back to the committee by the end of March . The Flood Hazard Mitigation Advisory Committee will make recommendations to the Board of Representatives by April . Successful applicants will be notified by May 1St . Contracts will be signed . Most work in our streams occurs between July 15th and October 1St . This is mandated by DEC regulations on stream work . Councilman Conley - The Town surrounds the City . Are there projects that may come from another town through the Town of Ithaca to the City of Ithaca? The must be intermunicipal cooperation . Mr. Schutt - We would like to see intermunicipal cooperation on projects . Councilman Klein - Has the Town had any projects? Mr. Noteboom - We did receive money from Soil and Water Conservation District for Brandywine Drive . We handled the budget requirements under the Storm Water Management line item . Councilman Klein - What is the average size of the grants ? Mr. Schutt - The grants average between $5 , 000 and $ 6 , 000 . Mr. Noteboom - The Town has received $8 , 000 on three different projects . Councilwoman Russell - Is it mandatory that the municipality have a local advisory committee? Ms . Hackett - Some municipalities have persons from Planning and Highway to review the project. We would like to receive a letter of support from the municipality. Agenda Item No. 6 - PERSONS TO BE HEARD. Fay Gougakis, 406 Utica Street, spoke in opposition of Cornell University purchasing the Town Hall located at 126 East Seneca Street. SEQR : " LOCAL LAW INCREASING THE INCOME LIMITATINS FOR THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH DISABILITIES " . RESOLUTION NO. 1 - SEQR: LOCAL LAW INCREASING THE INCOME LIMITATIONS FOR THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH DISABILITIES WHEREAS, this action is the enactment of a local law providing for an increase in the income limitations for the partial tax exemption for real property owned by persons with disabilities; and WHEREAS, this is an unlisted action for which the Town of Ithaca Town Board is legislatively determined to act as Lead Agency in environmental review with respect to the enactment of local laws; and WHEREAS, the Town Board, at a public hearing held on January 8, 2001 , has reviewed and accepted as adequate the Short Environmental Assessment Form, Parts I and II for this action; now therefore be it RESOLVED, that the Town of Ithaca Town Board hereby makes a negative determination environmental significance in accordance with the New York State Environmental Quality Review A for the above referenced action as proposed and, therefore, neither a Full Environmental Assessme Form, nor an Environmental Impact Statement will be required. MOVED Councilwoman Grigorov, SECONDED Councilwoman Russell. See Attachment # 1 . RESOLUTION NO. 2 - ADOPTION OF A LOCAL LAW INCREASING THE INCOME LIMITATIONS FOR THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH DISABILITIES. WHEREAS, a resolution was duly adopted by the Town Board of the Town of Ithaca for a public hearing to be by said Town on January 8, 2001 , at 6:30 p. m. , to hear all interested parties on a proposed local law entitled "A LOCAL LAW INCREASING THE INCOME LIMITATIONS FOR THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH DISABILITIES "; and WHEREAS, notice of said public hearing was duly advertised in the Ithaca Journal; and TOWN BOARD PAGE 7 JANUARY 8 , 2001 APPROVED - APPROVED - APPROVED - FEBRUARY 12, 2001 - APPROVED - APPROVED - APPROVED WHEREAS, said public hearing was duly held on said date and time at the Town Hall of the Town of Ithaca and all parties in attendance were permitted an opportunity to speak on behalf of or in opposition to said proposed local law, or any part thereof; and WHEREAS, pursuant to Part 617 of the Implementing Regulations pertaining to Article 8 (State Environmental Quality Review Act) it has been determined by the Town Board that adoption of said proposed local law would not have a significance effect upon the environment and could be processed without further regard to SEAR; now therefore be it RESOLVED, that the Town Board of the Town of Ithaca hereby adopts said local law entitled "A LOCAL LAW INCREASING THE INCOME LIMITATIONS FOR THE PARTIAL TAX EXEMPTION FOR REAL PROPER7Y OWNED BY PERSONS WITH DISABILITIES '; a copy of which is attached hereto and made part of this resolution; and be it further RESOLVED, that the Town Clerk is hereby authorized and directed to file said local law with the Secretary of State as required by law. WHEREAS, the Deputy Town Clerk has presented the 2000 Town Clerk's Office Annual Financial Report to the governing Town Board for their review and approval for filing; and WHEREAS, the governing Town Board has reviewed and accepted the said 2000 Town Clerk 's Office Annual Financial Report, now therefore be it RESOLVED, thcett the governing Town Board does hereby accept and approve for permanent filing the attached 2000, Town Clerk's Office Annual Financial Report. Motion carried unanimously. Agenda Item No. 9 - Appointment to Boards and Committees by the Town Supervisor and Town Board . Supervisor Valentino - We need to have staff support from Mrs . Kelley on the Water and Sewer Special District Assessment Review Committee . Ms . Whitmore has been doing a lot of work on records management. I would also like Te Ann Hunter to serve on the committee . Mr. Walker - We need to have a secretary from PEZ on the committee . Mrs . Drake - The committee should have more employee input . Supervisor Valentino - Mrs . Bryant could serve on the committee . I am taking myself off the committee . The members of Interview Committee for the interviewing of Planning Board members were Councilman Klein , Councilman Niederkorn , Rod Howe , Tracy Mitrano and Jonathan Kanter. We need to have Susan Ritter serve on the committee in replace of Mr. Kanter. We need to advertise the Planning Board vacancy again . sent in an application for myself to serve on the Tompkins County Water Resource Council . Mr. Kanter was a member of the Tompkins County Local Waterfront Revitalization Program . We need to have Ms . Ritter serve on the committee. Councilman Niederkorn - There are three separate committees . One involves staff coordination, which Mr. Kanter was a member. Councilwoman Grigorov is a member of the Municipal Officials Committee . Supervisor Valentino - Fred Wilcox represents the Town on the Planning Federation . Richard Fisch is the representative on the Natural Areas Commission . Attorney Barney - I have reviewed the contract and I have some concerns about the contract. It does not indicate what services are going to be performed . I assume the services ' to be performed are those services requested by the Town . We should add to the first paragraph that the services to be performed are those requested by the Town . The Town should have the right to terminate the contract at any point without cause . The Town typically provides insurance . Mr. Kanter is going to be driving to the Town to perform the contract . We need to make sure there is insurance coverage so that the Town is protected . Ms . Ritter - Mr. Kanter its not asking for travel expenses. He is going to be traveling to the area to see his wife . Attorney Barney - I am concerned about the indemnity clause in the contract . Councilman Klein - What have we done with our other professional service contracts? Attorney Barney - We had an indemnity agreement with the architects . We had negotiated an indemnity agreement . Councilwoman Russell - We should be discussing this in executive session . Supervisor Valentino - Claudia Brenner is interested in bidding on the project . Her firm does similar work to Mark Leathers' firm . There are differences between the firms . Ms . Brenner is not sure if she is listed on the Town RFP distribution list . Mr. Noteboom - I have talked with Ms . Brenner. The firm builds playgrounds , but they add themes to the playground . I have contacted several firms . We are meeting with Rusty Kealer of Earth Works . They make mounds of dirt for children to roll on . We have met with Dan Lee . His company has prefabricated playgrounds . We had intentions of building this playground ourselves. Mark Leathers came to us and offered to do a community build . He offered his services to do this . We are not bidding out the construction . Supervisor Valentino - Mr. Leathers would be able to bring in volunteers from the neighborhood to help . Our design would be used . Mr. Noteboom - It is our design . Mr. Leathers would need to have input. He would be carrying the liability with it. Mr. Walker - Park staff has been building park playgrounds . It has been in -house designs and i house builds . Councilwoman Grigorov - The architects must make some money on the project . Mr. Noteboom - I asked Mr. Leathers what he would be making on the project . Mr. Leathers responded he would only be providing services . He would not be making money on the project . Councilwoman Grigorov - Do we need to give other architects an opportunity? Attorney Barney - The Town is going to build a park with the Town design . The Highway Department would not be building the park. It would be done with volunteers from the neighborhood . Mr. Walker - Mr. Leathers lives in the neighborhood . He has children who will play in the park . Supervisor Valentino - The neighborhood would take more ownership of the park if they help to build the park . Councilwoman Grigorov - Do the other firms expect to be paid for building the playground? Supervisor Valentino - Yes . The other firms want to bid on the playground . Councilwoman Grigorov - Can we explain that Mr. Leathers is volunteering his time ? WHEREAS, the Director of Planning (Town Planner), Jonathan Kanter, has submitted his resignation effective December 31 , 2000; and WHEREAS, the Town Board is in the process of conducting a search for a replacement for Mr. Kanter, but has not yet appointed his successor; and WHEREAS, it is essential to have a person acting as Director of Planning (Town Planner) until the search is concluded and a new Director of Planning is appointed, and WHEREAS, Susan Ritter is currently the Assistant Town Planner, now, therefore, be it RESOLVED, the Town Board of the Town of Ithaca does hereby approve the appointment Susan Ritter as Interim Director of Planning, retro-active to January 1 , 2001 , and until th appointment of a new Director of Planning; and be it further RESOLVED, Ms. Ritter will receive an additional pay of $6. 00 per hour during this interim period, from account number B8020. 100. Councilwoman Russell -The report on the Vet School Incinerator is available . Supervisor Valentino - The Recreation Partnership will hold its next meeting this month . We will establishing board positions , budget procedures , bylaws , and our final contract . The committee w be hiring a consultant to look at the cost of Cass Park and golf course facilities . There is a lot that we agree on . The water association is almost finished with Cornell 's proposed licensing agreement . We are close to a Fire Contract with the Village of Cayuga Heights . We have not had a meeting on the City Fire Contract in a long time . We received a letter from the City that the Town has overpaid them by $ 115 , 000 on our water agreements . We will be receiving a check of $ 115 , 000 plus 3% interest . Mr. Carvill - The total slum was slightly over $ 125 , 000 . Supervisor Valentino - The City owes the Town another $8 , 000 for this year. Mr. Carvill has been trying to set up a meeting with our auditors so that we can audit the sewer records . Agenda Item No. 20 - Report of Town Officials for December 2000 . a. Town Clerk/Receiver of Taxes - See Attachment #4 b. Director of Engineering on See Attachment #5 Mr. Walker - The 911 Response Committee has met twice . They have narrowed down the potential sites of the emergency operations center. They are looking at the current facility at the airport , the public service building coat the airport, or a location on South Hill . Everyone seems to be leaning to the South Hill location . Ithaca College is planning a lot of construction that the Town has not been notified about . One possibility is for a new central services building at Ithaca College , The County could share space in the building for the emergency center. They do not plan to have the dispatch in the facility. The South Hill Station is a good site . There are some site constraints . The sketch for this site is being revised . The County will be meeting January 23rd to determine the location of the facility. The fire chief is in favor of the South Hill site . We lost a pump station on West Hill . We are relying on one pump at this time . We are preceding with the West Hill water improvement designs . Councilman Klein - Is there an alarm system for when the pump stations burn out? Mr. Walker - Bolton Point 's system detects that the pump is no longer . pumping water. They have a signal indicating if the pump is running . Mr. Noteboom - The purnp stations call us if their power goes out . c. Highway Superintendent - See Attachment #6 Councilman Klein - Was the sewer blockage at East Hill Plaza due to the grease traps? What facilities were involved ? What is the Town policy on cleaning out sewers when the owner and operator is clogging the sewer? Ashley management . believe Ling Lings is the problem . We have been in contact with Ashley management and are tryi to move this forward . Councilman Klein - Does the Health Department have anything to do with restaurants installing grease traps? Mr. Walker - Grease traps are required by our sewer use laws . Burger King installed a large buried pit grease trap . It is the correct type to install . The grease trap does have to be pumped out frequently . Councilman Klein - There are many restaurants in the Plaza . Mr. Walker - Sewer use laws describe grease as something that is not to go into the system . We are in the process of billing for the man hours to clean the sewer. Mr. Noteboom - I called Ashley management and notified them that we would be billing them . It cost the Town $ 1 , 370 . It is going to reoccur unless something is done about it . Mr. Walker - It is done about every 6 months . Councilman Klein - Cornell should be directed to install grease traps . The main sewer should have a grease trap like the grease trap at Burger King . Mr. Walker - There needs to be a grease trap at the discharge point of each facility. Sewer runs t full length of the back of the Plaza . The grease travels into our sewer. As they modify some of th facilities , we have been trying to get them to install proper grease traps . State sanitation law allows the small grease traps to be installed at the sink . Their capacity is 4 or 5 gallons . It is inadequate for commercial operations . The Health Department has them listed as approved devices . Councilwoman Russell - We could modify our sewer laws to require that there be more serious grease traps . Councilman Klein - We could pass stiff fines for violators. Mr. Walker - The sewer was checked the Friday before the blockage occurred . The following Monday we had crews cleaning the sewer. Supervisor Valentino - We do not get back the lost productivity the workers would have been doing . We need to make sure the bills reflect our actual cost . d . Director of Planning - See Attachment #7 Councilman Klein - I talked with Councilwoman Russell on the agreement with Cornell University on the Cradit- Moore House restoration . There was an article in the newspaper stating the house is rea to be sold . The exterior of the building has not been restored . Councilwoman Russell looked at t agreement with Cornell . The house is in Cayuga Heights , but it was a requirement of our Planning Board approval . The Town might want to act immediately to enforce the Planning Board resolution . Councilwoman Russell - In the agreement , the owner of the property is responsible for the landscaping . Cornell is also responsible for all the painting . Supervisor Valentino - We need to go over the agreement carefully and see how we want to proceed . Councilman Klein - Cornell originally wanted to pay $40 , 000 and have -the house moved . They wanted to put all the covenants on the future owner. The State was not comfortable with it . Cornell had to make sure it was all complete . When the property is sold , the owners will have maintenance covenants . The burden of the restoration was not put on the owner. The burden is on Cornell . It looks as if Cornell is ready to sell the house . The house is not ready to be sold . Councilwoman Russell - The property would be more attractive to a potential owner if they knew the landscaping would be done . Councilman Klein - It would also be more attractive if the work on the painting , trim , gutters and the roof was complete . Ms . Ritter - Barbara Ebert has unfinished portions of West Hill she would like to inventory for the ,historic resources survey . Ms . Ebert wanted to hire a student during January . The last resolution was for this coming summer. It was not for the interim winter period . Councilwoman Grigorov - The last resolution included monies to pay for services. Ms . Ritter - We paid for items that were done in 1997 . Part of the payment was for earlier work, but they had not delivered the product . We did not pay them because we did not have the product. Councilwoman Grigorov - Would this additional work be finishing the survey? Ms . Ritter - Yes . This summer they are going to be pulling the survey together. Supervisor Valentino - This person could work 40 hours per week for 4 weeks . Councilwoman Russell - Has work been started on this project? Ms . Ritter - The student might have come to into the office last week. Someone came into the office asking for information on building permits . Unfortunately Ms . Ebert has not been able to contact this person by phone . I am not sure what the current situation is . Mr. Carvill - There is $ 1 , 300 budgeted for interns . Supervisor Valentino - Is that budgeted for this project? Mrs . Drake - The money comes out of the Planning budget . Supervisor Valentino - When would the board be getting information on the detail of this work? Ms . Ritter - Ms . Ebert gave the board the maximum amounts . I do not know if this person has put in a 40 hour work week. Attorney Barney - The board could pass a resolution authoring the appointment of an intern as set forth in Ms . Ebert's letter, subject to the approval of the Town Supervisor. Mrs . Drake - We do not usually pass the resolution as an appointment of the person . The Town does not have this position to appoint someone to . It is usually done as reimbursing Cornell . Attorney Barney - The resolution could be to reimburse Cornell for the expenses of the intern . RESOLUTION NO. 11 - AUTHORIZATION FOR REIMBURSEMENT TO CORNELL UNIVERSITY. It is both ime and money efficient . Everyone helped the Town Clerk's Office organize the tax bills to be mailed in a quick and timely fashion . There is always some kind of an error that can lead to a mistake . A mistake is never really a mistake until it goes out the front door. It required regrouping and some special duties were performed . Extra hours were put in by Mrs . Kelley, Ms . Whitmore , Ms . Clark, Mr. Smith , Mr. Schrier and myself. The tax bills were organized to be mailed in three hours . Historically, this was a big plus . I would like to say thank you . It was a good job . Councilwoman Grigorov - It is good to hear. The board does not hear a lot about the process and the amount of work that occurs . Supervisor Valentino - The first set of tax bills we received were wrong . Thankfully Mrs . Kelley noticed it before we mailed them . We did need to collect the tax bills back from the Post Office and FedEx. The Assessment Department was closed due to the gas leak . Mary Mills came in and printed the bills while the building was closed . Mrs . Kelley and Mr. Carvill looked at the new printed bills to make sure they were correct. We were able to get the bills sorted and in the mail on schedule . Councilwoman Grigorov - Was the error made by the Assessment Department? Supervisor Valentino - . Part of the error was made by the Assessment Department. We had an error on our part as well . It was partly due to how the Assessment Department inputs the water and sewer and partly because of the way we sent the information over. Ms . Bryant was on vacation and we were not able to double check the sewer unit . It was mistakes that had occurred during the process. h . NetworklRecords Specialist. This law is enacted pursuant to Section 459-c of the Real Property Tax Law of the State of New York as amended through Chapter 222 of the Laws of 2000 . 2 . Pursuant to the provisions of Section 459-c of the Real Property Tax Law of the State of New York, real property located in the Town of Ithaca, owned by one or more persons with disabilities as defined in Section 459-c, or by a husband, wife, or both, or by siblings, at least one of whom has such a disability, and whose income is limited by reason of such disability, shall be partially exempt from taxation by said Town for the applicable taxes specified in said Section 459-c based upon the income of the owner or combined incomes of the owners. The software allows us to monitor the operation of the HVAC system and make adjustments as needed. During the initial setup of the software we found that the heating coils for the VAV units serving the Town Clerk' s office and the Court Offices were disabled by a service override. This setting was returned to the automatic setting and those spaces are now being heated to the right range. The winter snow season is now upon us and the Highway department has been doing an excellent job of snow removal on the parking lot and sidewalks. Records Management Engineering staff is continuing to work with all departments on implementation of the Town of Ithaca records management system. The system incorporates effective use of the various filing resources available. in the Town Hall with a computerized database to keep track of the documents. Park and Open Space The Engineering staff is coordinating with the Highway Department and Planning Department on the development of the Hanna Pew Trail Plan. Assistance will be provided on project planning and development, survey work, design development and construction document. Survey work has been planned and will be started after we receive the signed project agreement from NYS. Assuming the agreement is signed soon, the survey should be completed this winter and preliminary design will proceed when that data is received. Highway The Engineering Staff is working with the Highway Department on design development and construction documents for the Maple Avenue Road and Walkway improvement project scheduled for construction in 2001 . This project will be contracted out and will be bid in April for a construction start in June with project completion scheduled for August. STORM WATER MANAGEMENT East Hill The watershed model development has moved forward in conjunction with the development review of the Baker Institute project. The ArcView GIS software is being used to develop the watershed map information, and the CEDRA watershed modeling software is being utilized to evaluate the Hydrologic and Hydraulic characteristics. The final Baker institute plans have not been completed and the Watershed review will be finalized after the plans are submitted. The Eastern Heights drainage improvement project includes the work nearing completion on Park Lane and the stabilization of the drainage channel above Rte. 79 adjacent to the Ewing' s property. The design is being finalized to contract the stabilization work this winter. ATTACHMENT # 5 } TOWN ENGINEERS REPORT 1 /8/01 PAGE 2 EARTH FILL PERMITS There has been no activity on the City of Ithaca application for the proposed demolition and construction spoil disposal site on the Landstrom lot. The Town of Newfield supervisor has contacted the Town Engineer to reiterate that they are very interested in commenting on the project during the review. WATER PROJECTS Integrated Water System Final project planning and design work on improvements for the integrated water system is on hold until completion of the revised SCLIWC agreement. West Hill Water System Preliminary Planning and design work on a new pump station to replace the aging Cliff Street pump station has been completed. The existing water system hydraulic model has been updated and used to develop the design of the pump station and related watermain improvements. The proposed plan and engineering report has been sent to the City Public Works department for review and comment. Construction documents are being prepared for bidding this spring. The Engineering Staff is preparing preliminary plans and an engineering report for the part of the West Hill water system behind the Biggs complex and the Hospital . This is an old watermain and as the Hospital complex has develope over the years, significant regrading has occurred which has resulted in sections of the line being covered by over 20 fee of fill. This makes locating and repairing the line very difficult. Relocation of a portion of the line will be considered for construction, especially if a new use for the Biggs Building becomes a reality. Water System Mapping and Model The Engineering staff, including student interns, has been continuing to update the electronic database for the water system . This information will be used to update the town-wide water system hydraulic model, and will be used to provide information to locate water mains in the field. These tools are important for effective maintenance of the water system . Hanshaw Road Water Main Preliminary design is underway to develop a plan to replace portions of the Hanshaw Road watermain that have required frequent repairs. This watermain is the same age and condition as the Warren Road watermain replaced last year. This work would be coordinated with the proposed County Project to reconstruct Hanshaw Road. Much of the water main is located directly adjacent and below the County storm drainage system. SEWER PROJECTS Joint Sewer Agreement The SJS partners are continuing to work on the revised agreement for the Ithaca Area Waste Water Treatment Facility and jointly used interceptor sewers. l:VeportslERPT0101. doc TOWN ENGINEERS FTPORT 1 /8/01 PAGE 3 Intermunicipal Sewer System The Town Engineer has been reviewing the improvements to the interceptor and transmission sewers that the City has proceeded to construct without the approval of the Town. The Town Engineer is waiting for the requested additional information from the City detailing the capacity and costs of the improvements made during the reconstruction of Rte. 13/96, and the Lake Source Cooling Project. Once the Town Engineer has received the data, a recommendation regarding the appropriate contribution for the project will be presented to the Town Board. North East Sewer Improvements The Town Engineer is proceeding on the design and contract documents for relining the Hanshaw Road sewer main from the Village of Cayuga Heights line to Warren Road. This project is being prepared to bid in February with a construction contract for March or April. West Hill Sewer System The sewer line on the east side of Trumansburg Road from the City line north to the Biggs complex is one of the oldest sewer mains in the Town. This sewer, which serves the Hospital and the Lakeside Nursing Home, is old vitrified clay tile and is at capacity as well as requiring frequent maintenance for cleaning and root removal. The line is also a significant source of I&I. The Town Engineer is in the process of developing a design and construction plan for replacement of this sewer line in 2001 . l lreportsl ERPT0101. doc Agenda Item 20c Town of Ithaca Town Board, January 8, 2001 Highway Department Report For December 2000 Highway Work 2001 lacovelli Park We had several follow-up meetings and discussions with play ground designers regarding the play structure proposed for lacovelli Park. Specifications for lumber, pre- fabricated components and wood fiber surfacing materials are being finalized . Further site work on the basketball court, play structure and pavilion areas will be resumed after the ground thaws out . Construction of the play structure would likely entail using volunteers from the community during the month of May . Maple Avenue We hope to have a design finalized for Maple Avenue so that we will be able to go to bid after the March Town Board Meeting. We will then be able to get Town Board approval for the contractor to start construction in June 2001 , with completion by the middle of August . This will allow the work to be done after most college students are away and before they come back in the fall . William and Hannah Pew Trail A design will be ready for the stabilization of the stream behind Ewings property on Slaterville Road for the Town Board ' s approval to go to bid in March . We continue to work with the Planning Department to ensure that this project moves forward . East Shore Park We have contacted Lanny Joyce and George Hascup, Architect, as to the wishes of the Town Board on the design of the pavilion . Mr . Joyce will forward the revised design to us as soon as it is completed . We have a sign for the East Shore Park built and it will be installed as weather permits . Route 366 Bridge and Judd Falls Road Project We met with the New York State Department of Transportation' s design engineers and real estate people to discuss Route 366 Bridge reconstruction . They are looking to have a contract letting in May 2002 for construction in July 2002 . We discussed the design for Judd Falls Road and the pedestrian/ bicycle walkway utilizing a pedestrian bridge ATTACHMENT # 6 Agenda Item 20c across Cascadilla Creek and the old Judd Falls Road . We continue to work with Cornell University to have them take over maintenance of the walkway . Said condition required the obtaining of an easement to construct a path and provide access across a 25 foot wide strip of land located between the Montessori School Main Building and the new Middle School Building. CURRENT PLANNING DEPARTMENT PROTECTS The following are work items during the past month. SEQR Reviews for Zoning Board: One SEQR review for the Zoning Board was done since the December report: request for five year extension of previously approved variance to continue to permit the operation of an antique and second hand goods shop in an Agricultural District at 1308 Mecklenburg Road, Glenn Hubbell, Appellant. Codes and Ordinances Committee: The Committee met on December 20, 2000. The agenda focused on a review of the residential zone chapters of the Zoning Ordinance revision, which will continue at the next meeting. The Committee completed review of the Lakefront Residence Zone. The Committee agreed to target completion of its review of the revised draft Zoning Ordinance at the January and February meetings, and then circulate the further revised Ordinance to boards and committees for comment in March. With this schedule, public meetings could be held in April. It was also suggested that the draft Ordinance (or at least an Executive Summary) and map be put on the Town' s Web site. The Committee held off on approving a 2001 meeting schedule, and tentatively scheduled the next meeting for Friday, January 19, 2001 at 5 :00 p.m. Capital Projects Committee: (The next meeting will be scheduled sometime in January, 2001 .) North Campus Gateway Committee: (The next meeting of this Committee is scheduled for mid- January.) Historic Resources Survey: The Cornell Historic Preservation class presentation was held on December 12th at 7:00 p .m. in the Town Board meeting room. The class has now completed almost all of the West Hill area (which was the last remaining section of the Town to be completed) . To complete the unfinished portion of West Hill, Barbara Ebert has suggested the possibility of having one or two of her students work during the January break to complete the surveys. More information on this should be available from the Planning Department at the January 8th Board meeting. ITCTC Planning Committee: The Ithaca - Tompkins County Transportation Council joint Planning and Policy Committee meeting was held on December 19, 2000. Agenda items included an update on the NESTS Transit Planning project, a report by the consultant for the 2 Freight Transportation Study which is underway, a report on the 2001-2006 TIP program development, and election of officers for 2001 . Regional Planning Group - Sewer Consolidation: Among the numerous other meetings regarding the regional planning effort regarding wastewater treatment plant and sewer consolidation negotiations, the Planning Department and the Deputy Town Supervisor participated in the consultant selection committee meeting held on December 11th. This is to select a consultant to prepare a Draft Environmental Impact Statement (DEIS) regarding the components of the sewer consolidation project (e. g., extension of sewers into unserved areas in the Towns of Lansing and Dryden, a new intermunicipal agreement among existing and potential new partners, etc. The primary focus of the DEIS will be on growth inducing impacts of the proposal. The committee has narrowed down the prospective consultant list to one, and Stearns and Wheeler is in the process of requesting clarifications on the consultant's proposal and cost estimates. The proposal has come in with a much higher estimate than the municipal participants had originally planned on. After working with the prospective consultant further on scope and costs, it: is likely that the participating municipalities will have to decide whether and how to come up with additional funds for the DEIS. 2000 Annual Report: The Planning Department is in the process of preparing its Annual Report for the year 2000. This will be ready to be presented to the Town Board at the February meeting. Personnel: Jonathan Kanter is leaving the Planning Department on December 29, 2000 to join Frederick P. Clark Associates, Inc, a private planning consulting firm in Rye, New York. Susan Ritter has been asked to fill in as interim Director of Planning until a new Director is hired . Scoping Outline for DEIS was approved by Board almost one year ago. EcoVillage is now preparing DEIS . Timing of next submission is unknown. Next step is for EcoVillage to submit DEIS for Board' s consideration of acceptance for distribution for public comment and review . City Fill Site in Newfield : We are waiting for submission of fill permit application by City of Ithaca. The application will go initially to Dan Walker, who will then pass it along to Planning for Planning Board and ZBA review and approval . (Notifications on this . should go way beyond immediate neighbors of the site in Newfield, Enfield and Ithaca. Should also go to State: Parks, Tompkins County Planning, Dan Winch (County Rep. From Newfield), Town of Newfield officials, etc . ) Cornell Waste Management Facility DEIS : (Refer to December Planning Directors Report) Planning Inspections Pending : Major inspections and compliance confirmation will be coming up for Cornell Lake Source Cooling Project and Cornell North Campus Residential Initiative. These are both fairly complicated and will involve checking the Planning Board resolutions for compliance with conditions and closely checking details of the developments for compliance with the approved site plans . Zoning Ordinance Revision : Jon Kanter will continue to work as a consultant with the Codes & Ordinances Committee , Sue , and Mike on the Zoning Ordinance revisions . The Committee will complete review of remaining sections of the 9/99 draft Ordinance at the January and February meetings . Map revisions will also be completed in draft. At that point, the Ordinance will be re-drafted and distributed to boards and committees for review and comment (hopefully by March) . Several public meetings will then be held (March and/or April) , followed by public hearings at the Planning Board and Town Board . A SEQR review will have to be included in this process (possibly a Generic DEIS ) . The goal is to enact the new Ordinance and Map by June 2001 ( ?) . Pew Bikeway and Baldwin-Colle Properties : The grant agreement for the TEA-21 bikeway funds was signed by Cathy and sent to NYS Dept . of Transportation (NYSDOT) . Letters were sent to the Baldwins and Colles indicating that the Town supports the land conveyances outlined in their offering letters . Meetings will be set up in January with the State (Peter Bartolotta) and the Baldwins and Colles to go over details of the grant agreement and the land conveyances respectively. A survey of the trail right-of-way can proceed after we get the okay from NYSDOT (the agreement has to be in place) . The Town has also agreed to put together a subdivision application for the Baldwins to get approval to separate the trail strip from their remaining property for conveyance (donation) to the Town. The Town also agreed to have appraisals of the Baldwin and Colle trail strips so that their donation and purchase values respectively can be determined. We have agreed with the Baldwins and Colles that the land conveyances will be completed by late March/early April . The next steps will include preliminary designs and layout of the trail , then final engineering details (grading, drainage, landscaping, screening, etc . ) Neighborhood meetings should be held before designs proceed too far. Fred anticipates doing much of the construction in-house, probably over a two year period. Lake Source Cooling Monitoring Consultants : Benchmark Engineering of Buffalo, NY, was hired as the Town ' s consultant to provide the Town with assistance in reviewing and making determinations regarding Cornell ' s Lake Source Cooling monitoring program. This stems from an agreement between Cornell and the Town in which Cornell has agreed to deposit with the Town up to $50,000 over a five year period for the costs of hiring a consultant for the above-described purpose. Benchmark will be attending quarterly Data Sharing Group meetings , along with Mary Russell, who has been very involved in this process . Benchmark sent a letter to Cornell requesting release of detailed data so that they can begin reviewing the data and making preliminary observations (Cornell has made only generalized and incomplete data available to the Data Sharing Group and on their Web site. Benchmark also sent a letter to DEC with comments on Cornell ' s monitoring plan with some suggestions for additional data collection and monitoring elements (see file) . Benchmark is supposed to provide an annual report to the Town Board with their observations , recommendations, etc . They were hired for up to five years for a total contract amount not to exceed $50,000 . Historic Resource Survey: The Cornell Historic Preservation class completed their fourth semester working on the Town of Ithaca survey and presented this semester' s work on December 12`h . They were not able to complete all areas on the West Hill , which is their final area of the Town, and have suggested that one or two students work during the January break to complete the surveys of properties that they were notable to get to . Barbara Ebert is overseeing the students on this project. Barbara provided us with a status report which included a summary of work completed and remaining. 2 Several semesters worth of survey forms have been submitted to the Town (and are in a file box located in Jon Kant:er ' s office) . The remaining survey forms have to be finalized by Barbara and will have to submitted to the Town . The final step would be for a summer intern to put together a final report with recommendations to the Town (summer 2001 ) . South Hill Conservation Zone : Ithaca College has sent the Town a letter indicating that they have completed their plant/ecological study of the South Hill as part of their Master Plan, and are ready and willing to make this available to the Town . The College has also recommended a revision of the proposed Conservation Zone boundary, and would support the overall zone if the Town agrees to their proposed modification . Sue Ritter has been involved in this process and will oversee the follow- ups . The next step is to set up a meeting in January between Ithaca College and the Town ' s sub- committee that had been working on the Conservation Zone proposal to see if a consensus can be reached. This will also involve the Conservation Board on an advisory basis (and a member of the Conservation Board will be on the sub-committee) . The final steps would be to prepare whatever revisions to the zone and boundary result from discussions with Ithaca College (also factoring proposed revisions that were discussed with the Planning Board and Conservation Board regarding Monkemeyer lands) , complete a SEQR review (probably can be done with a Full EAF as the Six Mile Creek CD was done) , and hold public hearings at the Planning Board and Town Board. Purchase of Development Ri . ht� s Program . Agricultural Land Preservation : The primary focus right now is on the Genex property on West Hill . We are still waiting to hear about the grant application submitted to the State. The Town received a grant (from a local organization) to cover the local share of the estimated costs of the purchase of the agricultural conservation easement for the Genex property. If we receive the grant from the State, there will be a long process of working with the State to meet their requirements for the easement acquisition . If we do not receive the State grant, the Town Board will have to decide if they want to pursue acquisition of the Genex easement with local funds. If the Genex easement does not work out, the Town will have to return the grant award to the contributor (it cannot be used for any other purpose:) . Al Carvill has set up a special account to deposit the grant funds from the local organization to keep them segregated from other funds . The easements on the Eddy and Walker properties did not work out. Mr. Eddy felt that the appraised values of the easements on his properties were too low to make it worth his while . Mr. Walker is selling much of his Coddington Road land to a new owner, and we told him that the Town was not interested in an easement on his remaining land which would have only been about 15 acres . At some point, a meeting should probably be set up with the Agricultural Land Preservation Committee (consisting; of designated Town Board, Planning Board and Agric . Comm. Members) to update the Committee on what has happened so far, and get input on how to proceed . 3 Meanwhile, the Conservation Board is interested in advancing a similar conservation easement acquisition program for narural areas , as recommended in the Park and Open Space Plan . George Frantz is supposed to be putting together some recommendations on criteria and guidelines for such a program on a consulting basis . Development Review Database : Nipawan has created a wonderful database for the Town to be used for tracking development reviews that come before the Planning Board (probably can be used for Zoning Board reviews as well) . Planning staff is now familiar with the database and are using it to log in and track new projects . Nipawan has also logged in a number of years worth of previous projects . PEZ administrative staff is now being trained to use this database, and will be responsible for logging in new projects and keeping track of the status of projects as they go through the review process . (I also suggest that the PEZ meetings be re-activated. They were very useful in keeping track of project status and compliance with approvals and conditions , and ensuring proper communication among the involved staff. ) Hallberg Property Donation : Ed Hallberg has offered to donate a property on Troy Road to the Town (next to Troy Park) . His offer apparently involves the Town paying back taxes on the land. Staff walked the site. It is not appropriate for active recreation or park facilities , but has some values as open space (e . g. , trails , sitting and viewing areas, and stormwater management improvements) . Sue Ritter is obtaining information on how much would be involved with back taxes . This should be scheduled for Town Board discussion in January. 2000 Annual Report — Planning Department : Annual Reports are usually due for presentation to the Town Board at the February meeting . The Planning Department Annual Report consists of a listing and summary of Planning Board actions approved during the year, a summary of Planning Department projects and accomplishments, and a summary of development review accounting for the year. Jon Kanter will begin assembling the basic details for the Planning Board actions and the Planning Department project summary.
