RESOLUTION #593 APPROVAL OF MINUTES Motion by Councilman Desch; seconded by Councilman McElwee RESOLVED, that the minutes of the May 11, 1970 meeting be approved as submitted. Carried. RESOLUTION #59^ APPROVAL OF WARRANTS Motion by Councilman McBlwee; seconded by Councilman Desch RESOLVED, that warrants in the following amounts be paid: 2nd South Hill Water District Ext. 1 $ 3^025.00 2nd South Hill Water District Ext. 2 2,670.00 South Hill Sewer District 20,450.70 South Hill S !wer District Ext. 2 185,78 General 48,754.27 Highway 11,170.83 Carried M RESOLUTION #595 PUBLIC HEARING - MAT ASSOCIATES - 5:00 p.m. ' I Supervisor Schwan opened the Public Hearing regarding the rezoning request of Mat Associates for land located at the intersection of King Rd. and Danby Rd. Representing Mat Associates: Nick Caruso, Architect; Dominic Urciuoli, Attorney. Presentation was made by Attorney Urciuoli for Mat Associates. Mr. Urciuoli displayed a map and drawing of the area to be rezoned and explained the various parts of the plan which included a shopping center, apartments, and single family dwellings. He answered questions which were raised by residents of the area and by the Councilmen. (See Hearing folder for full text,) Hearing was adjourned at 6:00 p.m. Motion by CounciSiman Desch; seconded by Councilman Baker RESOLVED, that the request of Mat Associates for rezoning lands located at or near the intersection of Danby Road and King Road be approved as shown on the map and description of the property, subject to the omission of items 7, 8, 9, 10 and 11; being Electrical Shop, Glass Shop, Heating Shop, Monument Works and Plumbing Shop; under Business "C" (Article VII, Sec. 34 of Zoning Ordinance), all upd)n request of the petitioner. And, subject further to the request of the petitioner that no outside storage be permitted. I Walter Schwan, Suprvisor, voting Aye An Andrey> McElwee, Councilman, voting Aye Harry Baker, Councilman, voting Aye Noel Desch, Councilman, voting Aye -2- June 8, 1970 W T K 0 TOWERS Mr. Bob Newman from W.T.K,^. requested permission to present to the Board for their discussion and consideration a new proposal for the W.T.K.O. towers. They are considering the same property, except that the towers are moved to the north and the first tower will be located more than 1,000 ft. off the road, instead of 300 ft. as in the original plan. He indicated that if the towers were not moved too far from the original site, the PCC might approve the new location sooner. Councilman McElwee indicated that he still felt this was not the logical use for the property in a residential area. ^ Mr. Buyoucos recommended that the Planning Bca*d go to work on the | Zoning Ordinance, Mr. Newman indicated he would just like to know j the feeling of the Board. Following opinions were expressed: ~ Schwan - felt plan is reasonable provided they have enough sideyard. ^ Baker - indicated he was for the new location provided we can take care of height as far as zoning ordinance is concerned. Cowan - Zoning Board of Appeals is only Board that can grant this variance, Noel Desch recommended that Mr. Prancese and Mr. Buyoucos get together on wording of ordinance and have it ready for next meeting. RESOLUTION #59^ MAPLEWOOD DR. & PINEWOOD PL. Mr. Morey reported that the street markers are in place for Maplewood Drive and Pinewood Place. The deed and map have been received and filed with the County Clerk's office. Motion by Supervisor Schwan; seconded by Councilman Baker RESOLVED, that these roads be accepted by the Town of Ithaca. Carried. SNYDER HILL SPEED LIMIT Supervisor Schwan advised contents of letter received from N.Y.S. Dept. of Transportation which advised study of marginal development along the Snyder Hill Road indicated it is still below minimum to support reduced speed limit. They suggested that a new request m be submitted in the Spring of 1971. Supervisor Schwan requested p' :• 'ss permission therefore to delete Snyder Hill Road from the list of 1_' roads to be submitted to the state for reduced speed limits. Granted. RESOLUTION#597 RECREATION COMMITTEE Mrs. Carl Valentino reported that she had two more members to add to the Recreation Committee: Mrs. Susan Soyring and Mr. Robert Christiansen. Motion by Supervisor Schwan; seconded by Councilman Desch RESOLVED, that Mrs. Susan Soyring and Mr. Robert Christiansen be appointed members of the Town of Ithaca Recreation Committee. Carried. Mrs. Valentino asked if the Board had an opportunity to look over the Recreation policy. The Board indicated they would like to get reaction of the new Recreation Committee; also that this could be brought up at a special Town Board meeting and possibly they could meet with the Recreation Committee. RESOLUTION #590 SUMMER HOURS Motion by Councilman Baker; seconded by Supervisor Schwan RESOLVED, that summer hours for the Town office be 8:30 a.m. to 4:00 p.m., June 8 through Labor Day, September 7, 1970. Carried. nRESOLUTION #599 TOWN CONSTABLE SupervisorSchwan advised that he would like to form a committee of the Board to investigate costs and feasibility. He felt that there is no sense in establishing speed limits, etc. if we have no one tp enforce them. Motion by Councilman Desch; seconded by Councilman Baker RESOLVED, that a committee of Supervisor Schwan and James Buyoucos be appointed to investigate the costs and feasibility of a Town Constable for the Town of Ithaca. Carried. 155 -3- June 8, 1970 TOWN ATTORNEY & TOWN PROSECUTOR Mr. Buyoucos indicated he would like to discuss this matter in an executive session. Matter tabled. RESOLUTION #600 CUSTODIAL SERVICES - POLLING PLACES Motion by Supervisor Schwan; seconded by Councilman McElwee RESOLVED, that the Town of Ithaca use the school custodians at the two polling places held in the schools. Northeast and Cayuga Heights, at the rate of $5.00 per hour; and BE IT FURTHER RESOLVED, that the list of alternate election inspectors as presented by the Town Clerk be approved. Carried. VAN EPFS ACCESS ROAD Supervisor Schwan advised that the road had been tarred in April, that he checked the road last Monday night, June 1, and the dust coating is not there. He wanted to know what should be done to require VanEpps to maintain and provide adequate dust control on this access road. After considerable discussion it was decided the Supervisor would advise VanEpps that dust coating was not adequate and that unless something is done about it, problem will be turned over to Town Attorney. GLENSIDE WATER DISTRICT Complaints have been received from this district with refernce to low water pressure. Supervisor Schwan felt it might be adviseable at this time to look into the district in terms of pipe size. Apparently the pipe size is inadequate. Houses on Coy Glen have added to this line straining the capacity even further. Council man Desch suggested that we defer this matter until we know where we are going with the water situation. Matter tabled. RESOLUTION #601 COUNTY WATER AGENCY Supervisor Schwan advised that we needed to submit a name from the Town of Ithaca to serve on the County Water Agency. Motion by Supervisor Schwan; seconded by Councilman Baker RESOLVED, that the Supervisor submit Councilman Desch*s name for appointment to the County Water Agency. Carried. RESOLUTION #602 TRANSFER OF FUNDS Motion by Councilman McElwee; seconded by Councilman Desch RESOLVED, that the sum of $2,400.00 be transferred from Account 1112 to Account 1900 to cover engineering costs. Carried. RESOLUTION #603 BANKING DEPOSITORY Motion by Councilman Desch; seconded by Councilman Baker RESOLVED, that the Tompkins Co. Trust Company and the First National Bank and Trust Company be, and the same hereby are designated as depository for all moneys coming into the hands of the Supervisor and the Town Clerk of the Town of Ithaca, County of Tompkins, and BE IT FURTHER RESOLVED, that this designation shall continue in effect until revoked by action of said Town Board. Carried, ZONING ORDINANCE Planning Consultant Peter Francese handed out information pertaining to the Zoning Ordinance. He advised this was a preliminaty outline which he would like to discuss.with the councilmen kt a later date in executive session. Meeting adjourned at 7:00 p.m. Eliz^eth K. Parrish Town Clerk
