Green St., Ithaca, New York commencing at ^:00 o'clock P.M. PRESENT:William B. Kerr, Supervisor ABSENT: RECORDING SECRETARY: OTHERS PRESENT: Andrew W. Buyoucos, Attorney David Cowan, Zoning Officer Marion Morey, Sup't. of Highways James Dunlop, Lozier Engineer Sue Strandburg, Ithaca Journal Gary Gerard, WHCU Neil Littauer, WTKO Mrs. Roger Livesay, Snyder Hill Road The meeting was called to order by William B. Kerr, Supervisor. RESOLUTION 3^9 - NOTE RENEWAL TI Ellis Hollow Rd. Sewer District 2. East Ithaca Water District A motion was made by Supervisor Kerr and seconded by Councilman Desch that the Board approve renewal of the following Bond Anticipation Notes 1. Ellis Hollow Road Sewer District $90,000 Due March 1, I969 2. East Ithaca Water District $44,000 Due March 1, I969 and the Supervisor be authorized to execute such renewals and such other instruments as may be legally required to effect such renewals. A vote was taken with the following votes cast: Supervisor Kerr -- aye < Councilman McElwee aye Councilman Desch ^aye Councilman DelRosso-- aye * * * RESOLUTION 350 - CORRECTION OF SPECIAL DISTRICT ROLL A motion was made by Supervisor Kerr and seconded by Councilman DelRosso that $65.47 be refunded to the Receiver of Taxes, since the amount shown to be collected by the Receiver of Taxes for the Slaterville Sewer District was incorrect, and the Receiver of Taxes had paid the Town of Ithaca an excess of $65.4?. A vote was taken with the following votes cast: Supervisor Kerr aye Councilman McElwee aye Councilman Desch aye Councilman DelRosso aye * * * 2/10/69 RESOLUTION 351 - EXTENSION NO. 1 (ONE) TO SNYDER HILL ROAD WATER DISTRICT Voted Resolved to negotiate for inclusion of the William Frandsen property in the Extension No. 1 Snyder Hill Road Water District. Duly Passed. * * * INFILTRATION - Town of Ithaca Sewer Lines to Village Sewer Lines Supervisor Kerr read the Cayuga Heights Engineers letter to the Board, then passed the letter with instructions to Lozier Engineer Dunlop to find out what the specific problems were and actions necessary to remedy the conditions. * * * PROTEST LETTER - William Frandsen The Town Clerk was directed to write a letter to Mr. Frandsen advising the tax charge could not be refunded. The Town Board is aware of the situation, and is attempting to negotiate for his inclusion in the Ext. # 1 Snyder Hill Water District Rd. * * * RESOLUTION 352 - PUBLIC HEARING-SOUTH HILL SEWER DISTRICT INCREASE---$lb3jO^ A motion was made by Supervisor Kerr and seconded by Councilman Desch that the Town Board of Ithaca, meet and hold a Public Hearing at the City of Ithaca, Common Council Room, 3i'd floor, 108 E. Green St., on the 10th day of March I969 at 4:30 P.M. to determine whether or not it is in the public interest to authorize such increase and to hear all persons interested in the subject thereof, and to take such actions thereon as is required or authorized by law. A vote was taken with the following votes cast: Supervisor Kerr aye Councilman McElwee--aye Councilman Desch aye Councilman DelRosso-aye * * * RESOLUTION 353 - RUTHANN BROWN--TYPIST A motion was made by Councilman DelRosso and seconded by Councilman Desch that the salary of Ruthann Brown, typist increase $5.00 a week. A vote was taken and the resolution unanimously adopted. * * * RESOLUTION 35^ - EASTERN HEIGHTS HYDROPEUMATIC SYSTEM -- SNYDER HILL WATER n Voted Resolved that the request by Eastern Heights for removal of their hydropeumatic equipment such as HR controls, valves, piping, within booster pump station, air compressor, and sump pump, etc. which will not disturb the operation of this station, be granted. Lozier Engineer Dunlop to inspect and insure proper removal. Duly Passed. * * * 2/10/69 57 RESOLUTION 355 - APPROVAL OF MINUTES Voted Resolved to approve minutes dated January 13, 1969- Duly voted and passed. * * * RESOLUTION 356 - WARRANT APPROVAL Voted Resolved to approve warrants dated February 10, I969 in the following amounts: General Fund $51,830.13 Highway 5,067.12 2nd South Hill Water District 6,217.20 Snyder Hill Road Water District ,1,310.62 Northeast Sewer District 369.00 Duly voted and passed. * * * RESOLUTION 357 - CHANGE APRIL MEETING A motion was made by Supervisor Kerr and seconded by Councilman McElwee that the Regular April Meeting of the Town Board be moved from April 7, I969 to April l4, I969. A vote was taken with the following votes cast: Supervisor Kerr- aye Councilman McElwee aye Councilman Desch aye Councilman DelRosso aye * * * RESOLUTION 358 - BONDS - SUPERVISOR KERR A motion was made by Councilman McElwee and seconded by Councilman DelRosso that Supervisor Kerrs bond be reduced to $250,000. as of March 1, I969 and that the Boothroyd Agency be so advised. A vote was taken with the following votes cast: Supervisor Kerr aye Councilman McElwee aye Councilman Desch aye Councilman DelRosso aye * * * RESOLUTION 359 - AGREEMENT FOR THE EXPENDITURE OF HIGHWAY MONEYS A motion was made by Supervisor Kerr, seconded by Councilman McElwee that Agreement for the Expenditure of Highways Moneys be approved: General Repair $31,701.22 Permanent Improvement 3^,950.00 A vote was taken and the following votes were cast: Supervisor Kerr aye Councilman McElwee aye Councilman Desch aye Councilman DelRosso aye * * * 2/10/69 RESOLUTION 360 - VIOLATION OF ZONING LAWS-LUCEHTE Supervisor Kerr made the motion, seconded by Councilman Desch that the Board take Legal Action against Developer Lucente. An injunction and an order for Tenant Eviction, where Lucente has broken laws of the Zoning Ordinance. Inspection by Zoning Officer David Cowan and all action is to be immediate. An all "aye" vote carried. James Buyoucos, Attorney spoke against this measure. * * * Letters - Payment of Retainage Pee Slaterville Road Sewer District Project 1302-8 Marion Morey $60.00 due from C.N.Y. Construction Corp. These letters were turned over to Lozier Engineer James S. Dunlop for inspection before action would be taken. * * * Petition Letter - Horses 160 Poole Road Petition Letter was given to David Cowan for inspection of the situation. * * * Meeting adjourned at 6:10 P.M. *The Morse Chain Easement came in the mail February 11, I969.
