REGULAR TOWN BOARD MEETING
February 14 , 1995
Present : Supervisor Doug Austic ; Councilpeople Catherine Stover ,
Tom Reitz , Bob Weatherby , Ben Curtis ; Highway
S uperintendent Jim Meeker ; Deputy Clerk Paula Mount .
Others Present : Jim Seafuse , Peter Meskill , Free Press Reporter /
S tacey Young , Joseph Micilcavage .
Supervisor Austic called the Regular Board Meeting of the Town
Board to order at 7 : 30pm and led those present in the Pledge of
Allegiance to the Flag of the United States of America .
Mr . Austic entertained a motion., moved by Mrs . Stover , seconded
by Mr . Reitz , to approve the , minutes of . the Regular Town Board
411 Meeting of 1 / 10 / 95 ; Special . Board . Meeting of 1 / 14 / 95 ; Public
Hearing of 1 / 26 / 95 and Special Board Meeting of 1 / 26 / 95 .
Mr . Curtis said he had an addition to . the minutes of January
10th ; page 5 / Insurance : add after Workers Comp . " and the way in
which proposals per insurance . had been . reviewed " . Figures for
total amount budgeted . " have been . for some time 40 % more than
the " . . . . .
Hearing no further discussion the minutes were unanimously
approved .
CLAIMS
Mr . Austic entertained a motion to approve Claims # 10 - 55 in the
total amount of $ 66 , 457 . 78 ; moved by Mr . Reitz , seconded by Mr .
Curtis .
Mr . Curtis stated he wished to go on record regarding his concern
of pre - payment of trips .

Report : Trumansburq . Fire Department
P eter Meskill reported that three bids had been received for the
fire truck . These bids will be reviewed and one awarded at the
✓ illage Meeting on February 22 , 1995 .
Report : Representative Peter Meskill
S erving on two different committees this year . Four recycling
centers will remain open through 1995 / Ulysses is one that will be
open . Notified about this last Wednesday . Suggested the Town
send another letter reiterating their position regarding Cat
Licensing .
Joseph Micilcavage from Superior Disposal Service , Inc . gave a
410 short presentation on recycling efforts of his company . Superior
is an alternative recycling agent in competition with the County .
Reports
Deputy Clerk , Paula Mount reported $ 1980 . 57 collected for the
month January of
_ y of which $ 1796 . 77 was turned over to the
Supervisor . SARA Grant application was completed and mailed to
Albany as of February 1 , 1995 ; reported that the Clerk and Deputy

will be attending Association of Towns Meeting in NYC .
Highway Superintendent , Jim Meeker reported they had hauled stone
and sand , salted and plowed as needed .
Councilperson , Tom Reitz distributed a membership list and
summary of the Recreation Partnership .
Supervisor , Doug Austic distributed Cash Flow Statements and
reviewed .
Mr . Austic referred to a letter received from Jim
Seafuse / Shursave Grocery Store . Mr . Seafuse stated he had
attended the Village Board Meeting last night and requested water
from the Village because of his on - going problems with the County
and State and the poor water quality at the store . The Village
Board suggested that in order for them to consider this request ,
the Town would need to establish a single user water district . A
✓ esolution to that effect , prior to their February 22nd meeting
w ould be appreciated , and they would then act on it . Requested
this five years ago , the Town complied with this request , but at
that time the Village refused . I have to have water to the store
by June 1st and an answer of plan of action to Mr . Andersson / TC
Health Dept . by March 1st . Was in hopes of the Town getting
w ater in by the time I needed it , but as it stand now , need to
proceed on my own . Am here to also say that if the Town wishes ,
I will pay for the work I need to have done , but if the Town
w ishes to increase the size of the pipe , or other aspects of the
job and wish to pay for the difference , may be something to
consider .
Discussion ensued .
Mr . Curtis moved , seconded by Mr . Weatherby the following :
RESOLVED : that the Town Board of the Town of
Ulysses considers it to be in the best interest
of the Town to assist the Shur Save Grocery to
resolve their present difficulty with water and
FURTHER RESOLVED : that the Town Board supports the
formation of a single user water district if that
appears to be the most practical solution .

OLD BUSINESS
Water Grant
Mr . Austic stated that he and Mr . Rachun had met with Farmers
Home Administration to discuss their Grant / Loans . May be
something helpful , but will need further investigation .
Insurance Update 1 4
H ave several insurance proposals . Meeting was scheduled for
Saturday , March 11 at 9 : 00am to meet with various agents .
E lderly Property Exemption
Mr . Curtis moved , seconded by Mr . Reitz the following :

WHEREAS , the Town Board of the Town of Ulysses has established a
maximum income real property tax exemption eligibility
level , pursuant to Section 467 of the Real Property Tax
Law , and
WHEREAS , BY RESOLUTION THE Board extended eligibility by
establishing a sliding scale of exemption percentages
for those with income between $ 17 , 500 and $ 24 , 999 . 99
pursuant to the Real Property Tax Law ,
NOW THEREFORE BE IT RESOLVED , that the resolution establishing a
maximum income exemption eligibility level for persons
65 years of age or older , adopted pursuant to Real
Property Tax Law Section 467 , are amended to read as
follows :

Association of Towns Resolutions
The following resolutions were unanimously acted upon by the Town
Board . Mr . Curtis , representing the Town at the Association
Meeting will vote as follows :
1 . Wicks Reform - Yes
2 . Infrastructure Impact Fees - No
3 . State Aid for Code Enforcement - Yes
4 . Local Government Records Management Funding - Yes
5 . Workers Compensation - Yes
6 . Real Property Tax - Yes
7 . Local Surcharge on Justice Court Proceedings - If monies to
be increased to local Justice Court , vote Yes ; if monies to
be increased in surcharge and sent to State , vote No .
8 . Foil Fees - Yes
9 . The Landfill Closure - Yes
NEW BUSINESS
Building Proposal
Mr . Austic said that with the prospect of obtaining a SARA grant ,
need to consider doing something to this building . Building
Committee has some thoughts and plans ; Mr . Curtis has expressed
in the past doing something with other organizations . Thus , Mr .
Austic asked Mr . Curtis to research and bring back plans
regarding what he has in mind , prior to April 1st .
Joint Ulysses / T - Burg Water District Plan Proposal
Mr . Austic distributed Memorandum of Understanding developed by
Joint Committee . This is for review and possible discussion in

Highway Resolution
Mr . Curtis moved , seconded by Mrs . Stover the following :
AUTHORIZATION TO PARTICIPATE IN COOPERATIVE PURCHASING
OF HIGHWAY SERVICES WITH TOMPKINS COUNTY
WHEREAS , the Office of the State Comptroller has ruled that
counties may no longer extend their bids for public work
( services ) to political subdivisions , and
WHEREAS , General Municipal Law Section 119 - 0 provides for
municipalities entering into cooperative purchasing agreements to
jointly bid needed services , and
WHEREAS , General Municipal Law , Article 5 - G , Section 119 - 0 states
that " any agreement entered into hereunder shall be approved by
each participating municipal corporation or district by a
majority vote of its governing body " , now therefore be it
RESOLVED , that the Town of Ulysses be hereby authorized to
participate with Tompkins County in the cooperative purchasing of
the following highway services :
- Installation of Perforated Tubing for Subsurface Drainage
- Bridge Repair
- Steel Sheet Piling Supply & Installation
- Liquid Bituminous Materials
- Installation of Guiderail
The Town of Ulysses reserves the right to accept or reject all
bids .

Youth Commission Appointee
Mr . Austic stated that John Rodgers has resigned from the ' outh
Commission ; he has received a request to serve from Michel
✓ onderweidt . Mr . Reitz moved , seconded by Mr . Weatherby to
appoint Michel Vonderweidt as the representative from the Town of
U lysses on the Youth Commission .

H earing no further comments or business , Mr . Austic entertained a
motion to adjourn , moved by Mr . Curtis , seconded by Mr . Reitz .
