Green Street, Ithaca, N.Y., on the 4th day of October, I968 at 4 o'clock there were: PRESENT; Supervisor William B. Kerr, Councilman Andrew W. McElwee, || Harry U. Baker, Noel Desch and Victor Del Rosso. | [ Also Present: Attorney James V. Buyoucos, Highway Superintendent Marion Morey, Deputy Clerk Phoebe Bartholomew, Lozier Engineer James Dunlap, Norm Jordan from Eastern Heights, Inc., Ben Boynton, residents from Town of Ithaca and reporters from Ithaca Journal, WTKO and WHCU. RESOLUTION 271 - ACCEPTANCE OF PARK LANE-Eastern Heights Sub-Division^ Resolved by the Town Board to accept Park Lane in the Eastern Heights Sub-Division subject to an agreement with Eastern Heights, Inc. that the sidewalks will be installed and completed to meet specifications by August 1, 1969. Be It Further Resolved that the developer is hereby required to deposit a $55000. bond to guarantee the sidewalks installation. Supervisor Kerr moved. Councilman McElwee seconded. Resolution was duly adopted. Mr. Jordan appeared for Eastern Heights, Inc. and agreed to the above commitments. * * * EASTERN HEIGHTS, INC.-RECREATION AREA & PEDESTRIAN WAY /i i The Town Board tabled Eastern Heights, recreation area and pedes trian way until next meeting. Noel Desch, Walter Schwan and Marion Morey are to make a study and report their findings to the Town Board at the November meeting. * * * RESOLUTION 272 - FIRE PROTECTION CONTRACT WITH VILLAGE OF CAYUGA HEIGHTS Voted Resolved that a Public Hearing be held by the Town Board at 4:45 o'clock P.M., November 7, 19^8 in the Town of Ithaca Offices, 108 E. Green St., City of Ithaca, for the purpose of hearing all persons interested in the renewal of a contract with the Village of Cayuga Heights for fire protection for a one year period on the basis of $7,100. whereby the Village agrees that its Fire Department will give fire protection for the year 19^9 in the Hamlet of Forest Home and in that portion of the Town to the north of Forest Home and between the east boundary of Cayuga Heights and the east boundary of the Town of Ithaca. * * * nREQUEST FOR PUBLIC HEARING-RIMAIMIHG LANDS OF S.W. BARNES j The Town Board denied the request of Ben Boynton to schedule a Public Hearing for the November meeting on the rezoning of the remainder of S.W. Barnes property. The Board felt as long as the Public Hearing was not yet held by the Planning Board it would put undue duress on the Planning Board decision. * * * 10/4/68 33 RESOLUTION 273 - REFUND ON STREET OPENING PERMIT MR. HINKEIMAN - 110 SALEM DRiW Supervisor Kerr moved that refund of $100. be made to Mr. Hinkelman for street opening permit at 110 Salem Drive. Seconded by Council man McElwee and unanimously adopted. * * * "OFFICIAL HIGHWAY MAP" Councilman Noel Desch presented the "Official Highway Map" to the Town Board and to the many residents of the Town attending the meeting. He explained in detail the need for new roads and re alignment of existing roads to help alleviate the flow of traffic in and around the Town. Councilman Del Rosso suggested the re moval of West Haven Road.Extension on the existing "Official High way Map." Councilman McElwee moved they approve "Official Highway Map, Town of Ithaca, September, I968" with modification that West Haven Road Extension be deleted from the map. Councilman Del Rosso seconded. Ayes: Kerr, Desch. Noes: Baker. * * * RESOLUTION 27^ - "OFFICIAL HIGHWAY MAP" Resolved by the Town Board of the Town of Ithaca to approve "Official Highway Map, T^wn of Ithaca, September, I968" with West Haven Road Extension deleted from said map. Duly approved. * * * n i i RESOLUTION 275 - APPOINT PLANNING BOARD CHAIRMAN ! I Resolved that the Town Board of the Town of Ithaca hereby appoint Walter Schwan, Chairman of the Town of Ithaca Planning Board. Unanimously approved and duly adopted. * * * RESOLUTION 276 - MINUTES - SEPTEMBER 9, I968 Councilman Baker moved that the minutes of the meeting of the Town Board held on the 9th of September, I968 as submitted by the clerk be approved with the addition of the following resolution passed at the previous meeting. Councilman Desch seconded. Unanimously approved. * * * RESOLUTION 277 - NATIONAL CASH REGISTER SEWER LINE Resolved that the Town Board agrees to accept easements from the Morse Chain Company over Morse lands for the South Hill Sewer and also to accept title to that portion of the present National Cash ^ Register Company Sewer line running northerly' from the point of i connection of said National Cash Register line and the South Hill ^ ' Sewer line running westerly from the highway and north to the City Line. The Town agrees to maintain and replace the said National Cash Register sewer line north from the point of connection to the City line. The Town Attorney and the Supervisor are authorized to negotiate and execute all documents and the Town Board ratifies the letter written to National Cash Register Company by James V. Buyoucos, Town Attorney, October 2, 1968. * * * RESOLUTION 278 - WARRANTS - OCTOBER 4, I968 Councilman McElwee moved that warrants dated October 4, I968 as 10/4/68 v 34 submitted to the board be approved for payment and seconded by Supervisor Kerr and duly approved. Proof of publication and posting were presented. The hearing for the City was held at 4:45 P.M. Supervisor Kerr moved the following resolution: RESOLVED that the contract with the City of Ithaca for fire pro tection for the year 1969 be renewed at a cost of $20,885. fo^* fire protection in the Town of Ithaca except the following areas, to wit: 2!the Village of Cayuga Heights the area comprising all territory lying between the east boundary of the Village of Cayuga Heights and the east boundary of the Town of Ithaca. 3) the Hamlet of Forest Home exclusive of the structures housing the Cornell University Filtration Plant. Councilman Desch seconded and an all "aye" vote carried. * * * RESOLUTION 280 - TRANSFER OF FUNDS Supervisor Kerr moved that $32,550. be transfered from Part-Town funds to Highway Fund, Item I per I968 budget. Seconded by Councilman McElwee and duly approved. * * * RESOLUTION 281 - SCHOOL CROSSING GUARD Upon motion by Supervisor Kerr and seconded by Councilman Baker it was unanimously voted that Mr. Truman Bower, 24 Salmon Creed Road, Ludlowville, N.Y. be appointed as crossing guard for the North east School area at the monthly rate of $100. * * * RESOLUTION 282 - ELECTION INSPECTORS Voted resolved to approve additional democratic and republican election inspectors whose names did not appear on list submitted at May meeting of the Board. Shore Dr. 272-2547 Thev above names were approved by the Town Board, Town of Ithaca, on October 7, 1968, 36 n IMVENTORY OF HIGHWAY MACHINERY, TOOLS & EQUIPMENT Pursuant to Highway Law, Section l42 (3)^ Superintendent of Highways Marion Morey, filed an inventory of highway machinery, tools and equipment. Mr. Morey recommended the purchase of 3 radios for the highway department. * * * RESOLUTION 283 - APPOINTMENT TO CITIZENS ADVISORY | | COMMITTEE • Supervisor Kerr moved to appoint Mr. Frank Alexander of 536 Cayuga Heights Road to represent the Town of Ithaca on the Citizens Advisory Committee. Unanimously approved and duly adopted. * * * RESOLUTION 284 - PRELIMINARY BUDGET HEARING Two changes were proposed in the budget as considered by the Town Board at the October 4th meeting. 1) Councilman McElwee moved that account 10121 (Part-town. Plan ning Board-Compensation of employees) be increased from $500. to $2000. to allow for compensation for the Planning Board members. Seconded by Councilman Desch and duly approved. 2) Councilman Desch moved that account I9OO (Town Engineer) be increased from $6000. to $l6,000. and the title for that account be changed from Town Engineer to Town Engineer, Planning and Consulting. Unanimously approved and duly adopted. RESOLVED that the Town Board does hereby prepare and approve as a Preliminary Budget of this Town for the fiscal year beginning January 1, 19^9^ the itemized statement of estimated revenues and expenditures hereto attached and made a part of this resolution and BE IT FURTHER RESOLVED that the Board shall meet at 4:50 P.M. on Thursday, November 7, I968 at the Town Offices, IO8 E. Green St., City of Ithaca, for the purpose of hearing any person for or against any item or items therein and BE IT FURTHER RESOLVED that the Deputy Town Clerk shall give notice of such public hearing in the manner provided in Section 113 of the Town Law, and that such notice shall be posted and shall be pub lished in The Ithaca Journal at least twice in substantially the following form: NOTICE OF HEARING UPON PRELIMINARY BUDGET NOTICE IS HEREBY GIVEN THAT the preliminary budget of the Town of Ithaca for the fiscal year beginning January 1, 19^9> has been com pleted and filed in the Office of the Town Clerk of said Town at 108 East Green Street, City of Ithaca, where it is available for inspection by an interested person at all reasonable hours. FURTHER NOTICE is hereby given that the Town Board of said Town of Ithaca will meet and review said preliminary budget and hold a public hearing thereon at the Town Offices, 3rd floor, IO8 E. Green Street, City of Ithaca, at 4:50 P.M. o'clock on the 7th day of November, I968, and that at such hearing axiy person may be heard in favor of or against any item or items therein contained. PURSUANT to Section 113 of the Town Law, the proposed salaries of the following Town Officers are hereby specified: Supervisor $4800.00 Justice of the Peace 2200.00 Justice of the Peace I8OO.OO Councilmen (4) each '6OO.OO Superintendent of Highways 85OO.OO Town Clerk 5000.00 Town Engineer, Planning & Consulting I6OOO.OO By Order of the Town Board Phoebe Bartholomew Deputy Town Clerk October 1? & I8, 1968 10/4/68 n RESOLUTION 285 - PUBLIC HEARING ON SPECIAL DISTRICT ASSESSMENT ROLLS n Voted resolved that the Town of Ithaca has prepared assessment rolls of the parcels of land included in the following Special Improvement Districts: Ellis Hollow Road Sewer Hanshaw Road Sewer Northeast Sewer Renwick Heights Sewer Slaterville Road Sewer East Ithaca Water East State Street Ext. Water Forest Home Water Glenside Water Northeast Water Renwick Heights Water Snyder Hill Road Water South Hill Water Trumansburg Road Water Willow Point Lake Road Water and has apportioned and assessed upon such parcels of land in pro portion to the amount of benefits the improvements shall confer upon the same^ the costs chargeable to said districts in connection with the construction of public water and sanitary sewer systems therein which are payable in the year 1969 and therefore BE IT RESOLVED that the Town Board will hold a public hearing there on at the Town Offices, IO8 E. Green Street on the 7th day of November, 1968 at 4:00; 4:03; 4:06; 4:12; 4:15; 4:l8; 4:21; 4:09; 4:24; 4:27; 4:30; 4:33; 4:36; 4:39 and 4:42 in the order listed above, at which time it will consider any objections which may be made to said assessment rolls and apportionments. * * * RESOLUTION 286 - DATE FOR NOVEMBER BOARD MEETING Voted resolved that to conform to Town Law the Town Board will meet Thursday, November 7j I968 for a regular and budget meeting combined. * * * RESOLUTION 287 - CANDLEWYCK DRIVE INSPECTION Supervisor Kerr moved to authorize Mr. Morey to inspect Candlewyck Drive for future acceptance as a Town road. Duly approved. * * * RESOLUTION 288 - WATER MAINS-FERNANDEZ PROPERTY lib HONNESS LANE Voted Resolved that the Town will share the expense of installing water mains to the Antonio Fernandez property at II8 Honness Lane which is in the East State Street Ext. Water District and the water main being on the opposite side of the street from the pro perty involved. The Board resolved to share 50^ of cost up to a maximum of $220. for installation of mains to the property line. * * * 10/4/68 38 RESOLUTION 289 - APPOINTMENT OF TOWN CLERK AND RECEIVER OF TAXES " Supervisor Kerr moved to appoint Mr. Edward P. Riley of 300 Forest Home Drive as Town Clerk and Receiver of Taxes for a provisional period through July 1, 19^9 at an annual salary of $6,000,00. Seconded by Councilman McElwee and duly adopted. * * * Meeting duly adjourned at 8:10 P.M. Green Street, City of Ithaca at 4:00 o'clock P.M. on Thursday, November 7, 19^8. PRESENT; Supervisor William B. Kerr, Councilmen Andrew W. McElwee Harry U. Baker, Noel Desch and Victor Del Rosso Also Present: Attorney James V. Buyoucos, Highway Superintendent Marion Morey, Town Clerk, Edward P. Riley, Assessor Donald Franklin, Zoning Officer David Cowan, Lozier Engineer James Dunlap, Lozier Inspector William 0'Boyle, Attorney Edward King, Planning Board Chairman Walter Schwan, Gerard O'Brien, Roger Livesay, and reporters from the Ithaca Journal, WHCU and WTKO. f—j RESOLUTION 290 - PUBLIC HEARINGS-SPECIAL DISTRICTS I i The Public Hearings started promptly at 4:00 P.M. Proof of publi cation and posting were presented for the following hearings: Ellis Hollow Road Sewer 4:00 Hanshaw Road Sewer 4:03 Northeast Sewer 4:06 Renwick Heights Sewer 4:09 Slaterville Road Sewer 4:12 East Ithaca Water 4:15 East State Street Ext. Water 4:l8 Forest Home Water 4:21 Glenside Water 4:24 Northeast Water 4:27 Renwick Heights Water 4:30 Snyder Hill Road Water 4:35 South Hill Water 4:36 Trumansburg Road Water 4:39 Willow Point Lake Road Water 4:42 Roger Livesay and Gerard O'Brien of the Slaterville Road Sewer District appeared and each asked questions about the assessments of their own particular plots. Supervisor Kerr, Councilman McElwee and Assessor Don Franklin answered with explanation satisfying to both parties. It was agreed that Roger Livesay of 147 Snyder Hill Road - Land unit which is in the Slaterville Road Sewer District be changed from 3 units to 2.3. Since no other persons appeared to be heard, the hearings were declared closed and Supervisor Kerr, offered the following resolution and moved its adoption: VOTED RESOLVED that the prepared assessment rolls for the Special Improvement Districts of the Town of Ithaca listed above be approved for the year 19^9.
