AUGUST 12, 1968
At a regular meeting of the Town Board of the Town of Ithaca,
Tompkihs County, New York held at the Town Offices, 108 East
Green Street, Ithaca, New York on the 12th day of August I968,
at 4 o*clock p.m. there were: *
PRESENT: Supervisor William 3, Kerr, Councilmen Andrew W. McElwee,
and Harry U, Baker,
Also Present: Attorney James V. Buyoucos, Highway Superintendent

Leonard Liberman appeared before the Board with his attorney Robert
Grant presenting map, petition and other pertinent data requesting
proceedings to form a sewer district on East Shore Drive and to
be known as the East Shore Drive Sewer District,

Upon motion made by Supervisor Kerr, seconded by Councilman McElwee
the board ordered a Public Hearing to be held at the regular meet
ing of the Town Board to be held September 9^ 19^8 at 4o^clock
to consider petition and hear all persons interested for or against
the establishment of a sewer district to be known as the East Shore
Drive Sewer District, Duly adopted,

RESOLUTION 242- OTTO SCHOENPELD-SIMSBURY DRIVE
SUBDIVISION #3
Upon motion made by Supervisor Kerr, seconded by Councilman McElwee
it was resolved that the map presented by Otto B. Schoenfeld and
his attorney Harry Hamilton, dated August 12, I968 and titled "PinaL^^
Plans-Otto B. Schoenfeld, Williamsburg Park-Subdivision #3
Sim'sbury Drive Development-Village of Cayuga Heights-Town of Ithaca"
and the roads known as Simsbury Drive and Brandywine Road as shown
thereon with the sewer and water mains therein be accepted and
approved. It being understood that the road connecting the^
subdivision of Christopher Circle be completed to the specifications
of the Town of Ithaca and be accepted as a Town Road at that time
that the matter of the title of the easterly portion owned by
Rocco Lucente is transferred to the Town of Ithaca,

Upon a motion by Supervisor Kerr and seconded by Councilman
Baker it was duly resolved that the town board accept as a
town road Landmark Drive in the Eastern Heights subdivision together
with.water and,sewer mains"and laterals per resolution I83 & l84
of February 12, 1968. The deed is to be recorded in the County
Clerk's office, ' n ' n ^

searches. All taxes-to. be paid to date of closing by Mr, Compton.
TiiisLproperty to.be free of liens and encumbrances and the Town of
Ithaca is permitted to take immediate possession of the permises

RESOLUTION"245-FIRE CONTRACTS-City and Village

Upon a "^motion "made by Councilman McEIwee and seconded by CouncilmanBaker, Supervisor Kerr was authorized to renegotiate a contract
with the City of Ithaca whose '5 year constract has expired, alsoto negotiate with the Village of Cayuga Heights for 19^9 Fire
Contracts/so figures may be forthcoming for budget purposes.

RESOLUTION,246 - MINUTES- July 8, I968
Councilman McElwee moved that minutes of the meeting of the boardheld on the 8th day of July 1968, as submitted by the clerk be
approved. Seconded by Councilman Baker and duly adopted.

Upon motion by Supervisor Kerr and seconded by Councilman McElwee
it was duly resolved to authorize Justice Hartsock to attend the
Magistrates Conference at Lake George in September.

RESOLUTION 248- HIGHWAY SUPERIITOENKENTS-COMPERENGE
Upon motion "by Supervisor Kerr and seconded by Councilman McElwee
it was duly resolved to authorize Marion Morey, Highway Superinten
dent to attend a conference, for highway officials at Grossinger*s
in"September.

Councilman Baker moved that warrants dated August 8, .1968 as-

Upon motion by Supervisor Kerr,.seconded.-by - Councilman McElwee
it was resolved to release the retainer of C.N.Y. by depositing
their retainer in their name in .a savings account whereby they
would benefit from interest thereon. This is a contingent upon a
figure verification from Lozier Engineers, also a bill in the
amount of $83.00 to Mancini Construction for repair of a broken
transit pipe on the A.A. Weir property at l440 Slaterville Road
-is to be deducted from-said retainer before releasing same. -

RESOLUTION 251 - DOG ENUMERATOR- I969-
Upon motion by Supervisor Kerr, seconded by Councilman Baker it
was resolved to appoint Mrs. ;Mary Jones, 15O Honness Lane as
dog enumerator for 1969<> census to start October 1st, 1968.

-- RESOLUTION 252 - RENEW NORTHEAST-SEWER -DISTRICT

Upon motion by Councilman McElwee, seconded by Councilman Baker,
it was duly resolved to authorize Supervisor Kerr to renew the
Northeast Sewer District Note due September 2, 1968. Principal ' '
payment of $12,000 plus interest $173950.765 total payment $293950.76.

RESOLUTION 253- TRANSFER OP FUNDS
A motion was made by Supervisor Kerr. seconded by Councilman
Baker and duly resolved to transfer $800. from contingency
account #10,000 to insurance account #1130,

RESOLUTION 254- DEPUTY ZONING OFFICER
Upon motion by Supervisor Kerr, seconded by Councilman McElwee
it was duly resolved that Donald P. Franklin be appointed as
Deputy Zoning Officer.

RESOLUTION 255-APPOINTMENTS-COUNCILMEN AND
TOWN JUSTICE
Upon a motion made by Councilman McElwee, seconded by Councilman
Baker the nom.ination of Noel Desch, 132 Updike Road was made as a
candidate,,to fill the .vacancy of the late Harry Gordon* s position
as councilman through December 31, I968. Councilman McElwee and
Councilman Baker voted "aye". Supervisor Kerr "noe". Mr, Desch
was duly appointed by the majority "aye"vote.

Upon a motion by Supervisor Kerr and seconded by Councilman
McElwee the nomination of Victor DelRosso of 13o Bundy Road was
made to fill the vacancy of Joseph N. Mayer, Jr. as Councilman
through Decem.ber 3I3,. 1988• An all "aye" vote carried.

Upon a motion.by Supervisor Kerr and seconded by Councilman
McElwee, John Barney of 211 Muriel Street was duly appointed
Town Justice to fill the vacancy let by Richard LaPave's resignation.

Traffic Signs at Northeast School
The Board authorized Mr. Morey to post "15 mile per hour" signs
within a block of the Northeast School to help reduce speed on
Winthrop Drive for the safety of the children. -
RESOLUTION 256--DEPUTY SUPERVISOR
It-, was duly resolved that Councilman McElwee previously appointed
Deputy, Supervisor in Mr. Kerr*s absence is hereby authorized by
the board to sign checks, drafts and other orders issued for and
in behalf of the Town of Ithaca.

City of. Ithaca-Department of Public Works Moritorium
The City of Ithaca*s Department of Public Works has notified the
Town of Ithaca that since a moritorium has been declared on water
service to those residents not in already established districts
that no further sewer permits are to be issued in these areas.
Residents particularly affected are those on Snyder Hill Road,
Sugarbush Lane and William Fransden property, and are within the
Slaterville Road Sewer District but are not in an established
water district. Inasmuch as it was the intent to ultimately
furnish this service to these areas, the board instructed Mr.
Dunlap to prepare necessary details for approval to include these
areas in the Snyder Hill Road Water District as Extension No. 1
Harold Smith—Coddington Road—Residents on Stone Quarry Road
Mr. Smith has expressed a desire for water service and possible
sewer inasmuch as his property lies very near both districts.
Mr. .Dunlap suggested a possible modification to include Mr.
Smith*s property within the South Hill Districts along with
Stone Quarry Road residents that have requested a study for water
and sewer services in that area.
