Letter-Mr. & Mrs. Levy JULY 8, 1968 At a regular meeting of the Town Board of the Town of Ithaca^ Tompkins County, New York held at the Town Offices, 108 East Green Street, Ithaca, New York on the 8th day of July, 1968, at 4 o'clock p.m., there were: n PRESENT: Supervisor William B. Kerr, Councilman Andrew ¥. McElwee, I I and Harry U. Baker. Also Present: Attorney James Buyoucos, Highway Superintendent Marion Morey, Zoning Officer David Cowan, Clerk Myrtie Hewitt, Lozier Engineer James Dunlap, Mrs. Livesay from Snyder Hill and several residents from Clover Lane area, reporters from The Ithaca Journal and WTKO. RESOLUTION 23'^ - ClOVEH LANE- Water Several residents from the Clover Lane area appeared protesting further taps on the water line in that area. Upon motion made "by Supervisor Kerr, seconded by Councilman McElwee the board ordered the issuing of water permits stopped on Clover Lane as the line is being used beyond its capabilities at the present tim.e and the original residents are being served on a 4" line designed originally for nine residents. Duly adopted. * * * RESOLUTION 235 - POSTING ROADS - Clover Lane w Upon motion made by Councilman Baker and seconded by Councilman I McElwee it was duly resolved to have the Town highway department patch the Clover Lane road and then immediately proceed to post the road against over-weighted vehicular traffic. * -jf -jf Attorney Buyoucos suggested that an investigation be made of all town roads and wherever it was deemed necessary, roads should be posted against heavily over-weighted vehicles as to conform to town law. Supervisor Kerr was authorized to write Mr. Longest of Clover Lane regarding his carrying over-loads and also returning signs to their proper places at the dead end of Clover Lane. Vacancies in Town Offices The following are letters of resignation received by the Town - Board: From Councilman Joseph N. Mayer:- "It is with deep feeling of impending personal loss that I must resign from the Ithaca Town Board. The years that I have been associated with town affairs, the members of the Board, and the I people of our town have been very rewarding. I can only hope in : ! some measure I have been able to fulfill the obligation of an elected representative, and that I have contributed in a degree towards making Ithaca a finer town. 7/8/68 As of June 29 we will be moving to Seneca Falls and thus relinquish residency, after twenty-two years, in Ithaca. Please accept my resignation as of this date." Sincerely, Joseph N. Mayer, Jr. From Justice Richard LaFave:- "This is to advise that I will soon be moving out of the Town of Ithaca and therefore will no longer be qualified to serve as Justice of the Peace. I would like to state that for the past five years I have ' ' enjoyed working with the members of the town board very m-uch and regret having to resign. Please accept my resignation as of August 1, 1968. Thank you." Very truly yours, . Richard W. LaFave Death of Harry N. Gordon, Councilman Due to the death of Councilman Harry N. Gordon, the following memorial.'resolution by the board is being incorporated in these minutes. A copy is being sent to his widow. MEREAS Harry Gordon was elected Supervisor for-the Town of Ithaca, commencing January 1, 19^2 and WHEREAS, the said Harry Gordon continued to serve continously as Supervisor until December and TOEREAS the Said Harry Gordon was appointed Councilman and served until his death on July 6, I968, and WHEREAS the Said Harry Gordon devoted all his energies to the well being of the people of this town during his long period of service for which he received their warm esteem, now therefore be it RESOLVED, be unaminous vote, that this board expresses its profound sorrow at the passing of the late Harry Gordon whose compa^ny we were long privileged to enjoy and let it be said that we, and the people whom he served so well will miss his wise counsel, and be it further. . , RESOLVED that this board extends its sympathy to the widow and family of Harry Gordon. RESOLUTION 236 - ZONING ORDINANCE COmiTTEE-Temporary Chairman Due to Edmund Weatherby declining the temporary chairmanship of the Zoning Ordinance Committee, Supervisor Kerr moved and Councilman McElwee seconded the motion to appoint Mr. Gerard O'Brien of 130 Snyder Hill Road to serve in this capacity. " Duly {mm carried. n * * * 7/8/68 n RESOLUTION 237 - APPROVAL OF MINUTES Supervisor Kerr moved that minutes of the meeting of the Board held on the 10th day of June 1968, as submitted by the clerk be approved. Seconded by Councilman McElwee and adopted unanimously * * -x- RESOLUTION 238 - APPROVAL OF WARRANTS Councilman McElwee moved that warrants dated July 8, 1968 as ^ submitted to the Board be approved for payment in the following amounts. Seconded by Councilman Baker and unanimously passed. ' Harold -Smith-Coddington Road-Water Service Mr. Smith of 509 Codddington Road has expressed a desire for water service from the new South Hill Water District. Although he is not in.the newly established district, he is Just outside the '**1 district and the line will .pass very near his residence. The I contention of the board is that.he may enter upon contract withthe town whereby.he agrees to pay for the installation from theline to his property, and whereby the town will not be liablefor any damages incurred, also upon the formation of water districtincluding-^his" property he will be committed to Join said district. This will be contingent upon the approval of the City of Ithaca accepting.an additional.tap at this time. ... RESOLUTION 239 - BOARD OF EDUCATION - CUSTODIAL CHARGES... .. . . ' . FOR USE OF BUILDINGS Upon a motion made by Councilman McElwee, seconded by Supervisor Kerr the bill for custodial'services at the Cayuga Heights School and Northeast School used for the June. Primary in the amount of$57.00 is to be paid under protest. The Clerk was instructed to write Mr. Banner, Assistant Superintendent of the City SchoolDistrict and members of the board siting resolution #202 ofthe April 8, 1968 meeting also quoting resolution 24o of theJuly 8, 1968 meeting. Motion carried. * -x- -x- RESOLUTION 240 - USE OF TOWN QF ITHACA VOTING MACHINE n A motion was made by Supervisor Kerr and seconded by Councilmani j McElwee- that^use of Town of Ithaca voting machines by the City School-District- will.be granted .upon the condition that an^ assessment for setting up plus a. flat fee of $100. per day permachine will charged until such .tim.e as. the City School District sees fit to dispense with charges for services at the schoolsused as polling places for elections other than school elections Duly Passed. -x- -x- -x- Building Permits Attorney Buyoucos suggested to the Board that.future buildingpermits should require the following information: Purpose, 7/8/68 itsi number of rooms^ type of rooms, whether owner plans to rent or sell, whether owner plans to occupy same. Buyoucos, Highway Superintendent Marion Morey, Zoning Officer David Cowan, Clerk Myrtie Hewitt, Lozier Engineer James Dunlap, Planning ®oard Chairman Noel Desch, Otto Schoenfeld, Attorney Harry Hamilton, Attorney Robert Grant, Leonard Liberman, Justice Hartsock, William Pransden, Reporters from Ithaca Journal, WTKO and WHCU. Leonard Liberman appeared before the Board with his attorney Robert Grant presenting map, petition and other pertinent data requesting proceedings to form a sewer district on East Shore Drive and to be known as the East Shore Drive Sewer District, RESOLUTION 24l - EAST SHORE DRIVE SEWER DISTRICT bsonard Liberman Upon motion made by Supervisor Kerr, seconded by Councilman McElwee the board ordered a Public Hearing to be held at the regular meet ing of the Town Board to be held September 9^ 19^8 at 4o*clock to consider petition and hear all persons interested for or against the establishment of a sewer district to be known as the East Shore Drive Sewer District, Duly adopted. * * * RESOLUTION 242- OTTO SCHOENFELD-SIMSBURY DRIVE SUBDIVISION ^3 Upon motion made by Supervisor Kerr, seconded by Councilman McElwee it was resolved that the map presented by Otto B, Schoenfeld and his attorney Harry Hamilton, dated August 12, I968 and titled "Pinaly^ Plans-Otto B, Schoenfeld, Williamsburg Park-Subdivision #3 Simsbury Drive Development-Village of Cayuga Heights-Town of Ithaca" and the roads known as Simsbury Drive and Brandywine Road as shown thereon with the sewer and water mains therein be accepted and approved. It being understood that the road connecting the subdivision of Christopher Circle be completed to the specifications of the Town of Ithaca and be accepted as a Town Road at that time that the matter of the title of the easterly portion owned by Rocco Lucente is transferred to the Town of Ithaca, •Jf -x- * 8/12/68
