At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County , New York held at the Town Hall , 215 North Tioga Street , there were present : PRESENT : Catherine Valentino , Supervisor; Mary Russell , Councilwoman ; Carolyn Grigorov , Councilwoman ; David Klein , Councilman ; Ed Conley , Councilman ; Tom Niederkorn , Councilman . PRESENT : Debby Kelley , Deputy Town Clerk ; John Barney , Attorney for the Town ; Dan Walker, Director of Engineering ; Fred Noteboom , Highway Superintendent ; Jon Kanter, Director of Planning ; Al Carvill , Budget Officer. Call to Order: The Supervisor called the meeting to order at 5 : 30 p . m . , and led the assemblage in the Pledge of Allegiance . Agenda Item No. 3 - Report of Tompkins County Board of Representatives . Tim Joseph , TC Board of Representatives - The County has completed its recommended budget . A public hearing will be held Tuesday, November 14 , 2000 . The budget includes monies for the Recreation Partnership . The big changes are the increases in the Sheriff's Department , the Library and the Alternatives To Incarceration Initiative . These changes and the election of Judge Rowley signals a major change in how this County approaches issues of crime and justice . It goes to more than the ATI Initiative . The Recreation Partnership is another part of dealing with crime by inclusiveness . It includes everyone in the community . It deals with problems other than through punishing and revenge . I am looking forward to seeing it prove itself effective . Hopefully it will be a model for the State and counties . Councilwoman Grigorov - Do you think the defeated Transportation Bond Act will impact the County budget ? Mr. Joseph - It will not impact the County budget . It will possibly impact some projects that would have been done , but won 't be done . We will need to find other sources of funding . Supervisor Valentino - I support the Alternatives To Incarceration . It was a wise decision by the County Board . It is good to give it a chance . It would cut costs in the future . Councilman Conley - Is there an effort to make the Court House a total court facility? i TOWN BOARD PAGE 2 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED Mr. Joseph - It is too early to say . The court system needs more space . There are many Count offices that do not want to be in the Court House . Many offices do not want to be behind the security , It is not clear if the court needs all the space . It is not clear where we could move the other offices . Councilman Conley - I work downstairs of the Court House doing security . A State Representative was using the Law Library downstairs . He felt the court system would need more room . Mr. Joseph - We need to house another judge . Judge Ralihan has reached retirement . He can continue to function as a judge on a temporary basis while simultaneously being replaced . Judges serve a district much larger than the county , but they sit in the county where they are a resident . That county is required to provide them with office space . We need to provide an extra judge's chambers . The court system has wanted another courtroom that is adequate for holding jury trials . The Old Court House is an available space . The Old Library is a possibility . There have not been any decisions about what would move where . Agenda item no . 4 - Report of Fire Commissioners . Bob Romanowski , IFD - We held our Annual Memorial Service during Fire Prevention Week. In conjunction , we held the First Annual Medal Day Ceremony to honor outstanding fire fighters . Work continues on the County communications and the 911 system . It appears that all components of the police dispatch services will be consolidated into the existing 911 center. This is a move bein proposed as a means of smoothing the overall transition to a new center while improving th efficiency to the current system . Traffic calming concerns are continuing . The difference is between the needs of the public safety sector and the components of neighborhood traffic blockage . Marsha Linch is a volunteer coordinator. There is a proposal to change the volunteer coordinator position . The concept is being presented to the Civil Service Commission and Common Council 's Human Resource Committee . This position would be eliminated . The duties would be assigned to the Ithaca Volunteer Fire Fighters Unit . This new position is a non -funded position . The duties would entail the writing of grant application and other revenue producing activities for the Fire Department . The salary would be paid out of grant revenues and other revenues that she brings in . This is an effort to bring in extra money from other sources to fund the Fire Department . It would ease the strain on the tax payers of the City of Ithaca and Town of Ithaca . Brian Wilbur has been looking for extra money . The volunteer system is losing interested people . There is an on -going discussion with the Ithaca Volunteer Fire Fighters Unit . They do not know if they will be able to assume the volunteer coordinator duties . The Ithaca. Fire Department would like to change one position to pursue other revenue enhancing duties . They charge fees for inspection of public spaces . They charge fees for fire alarm inspections . They are getting to the end of where they can get revenue from fees . TOWN BOARD PAGE 3 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED t ouncilman Lesser - Has any consideration been given for the grant writer to find someone who ight volunteer for that position ? There might be people interested in being associated with fire afety . Mr. Romanowski - It is an ongoing discussion with the Board of Fire Commissioners . It will be pursued at their next regular meeting . There is reluctance on the part of the Volunteer Fire Fighters Unit to be able to put in the time to do this . We need to have someone in this position to at least be there sometime . Ms . Linch said that she would also put time in for the volunteer coordinator's position . Supervisor Valentino - Do you know how much her budget line costs? Mr. Romanowski - I would have to look it up . It is in the range of $20 , 000 to $29 , 000 . Supervisor Valentino - I have serious concerns about so little emphasis being put on trying to recruit volunteers . I know it is getting harder to do so . Grants come and go . The best way to keep fire costs down is to have a good volunteer system . Mr. Romanowski - We do have people interested . The biggest problem is when they then find out they need 110 hours of training , pass the physicals , spend all their time at the fire station , and give up a lot of family or business life that they might have . It is difficult . There is not the spirit of volunteerism . Our best source is the students coming in . They become bunkers in the bunker program . The bunker program is doing very well for itself . They only need to give two nights per week and they have a place to stay . They have a contract with the City . It is not an easy solution . We bring new people into the fire company . For every three or four that we bring in , we lose three quarters of them within the first six months . Attorney Barney - Mr. Romanowski , what were the training requirements when you started volunteering ? Mr. Romanowski - I went to training for one month , but two nights per week . We put in a Saturday at the Training Center . The training was less intensive than it is now. OSHA was not involved . With OSHA involved , we have requirements for face masks , type of equipment , training , and physical condition . It makes it expensive . One full outfit for one fire fighter is $600 to $800 . Councilman Lesser - Is it feasible to offer volunteers some compensation ? Mr. Romanowski - There has been long standing discussions . Once you start paying someone they are no longer a volunteer. We start getting into other critical areas of taxes and how people are treated . We have an incentive program for a number of men . There were eleven people who had over 300 alarms that they had attended . An award is given . It compensates for gas that they have used . We also have a fund that if they do something to their clothes we will replace it . The City is self- insured and they take care of anything that might happen to them . Supervisor Valentino - I have been working on some ideas for enhancements that might give some incentive for volunteer firemen . There might be some funding available . Agenda Item No. 6 as Renewal of Contracts for Services in the Year 2001 with the Following Agencies : Supervisor Valentino - The contracts are within or under what we had budgeted . a , Tompkins County Senior Citizens Council . Councilwoman Russell - What was the percentage increase ? Mr. Carvill - It was less than 3% . RESOLUTION NO. 164 - FUNDING AND AUTHORIZATION TO EXECUTE SUPPLEMENTAL AGREEMENT TOMPKINS COUNTY SENIOR CITIZEN 'S COUNCIL , INC. WHEREAS, The Tompkins County Senior Citizen 's Council, Inc. provides programs and services to benefit the Town of Ithaca Senior Citizen residents; and WHEREAS, The Tompkins County Senior Citizen 's Council, Inc. is requesting payment in the amount of $7935. 00 in 2001 to provide these said programs and services; and WHEREAS, it is necessary for the governing Town Board to approve the said paymen amount and enter into a supplemental agreement with the Tompkins County Senior Citizen 's Councir, Inc. to provide these said services pursuant to the agreement between the parties dated March 3, 1998; now therefore be it RESOLVED, the governing Town Board does hereby approve the payment of $ 7935. 00 in the year 2001 to the Tompkins County Senior Citizen 's Council, Inc. , and be it further RESOLVED, the Town Supervisor is hereby authorized and directed to execute a supplemental agreement for the year 2001 on behalf of the Town of Ithaca with the Tompkins County Senior Citizen 's Council, Inc. pursuant to the agreement between the parties dated March 3, 1998. Motion carried unanimously. b . Human Services Coalition . 4 Supervisor Valentino - The increase was not over 310 . TOWN BOARD PAGE 5 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED ESOLUTION NO. 165 - FUNDING AND AUTHORIZATION TO EXECUTE SUPPLEMENTAL GREEMENT HUMAN SERVICES COALITION. WHEREAS, The Human Services Coalition provides Human Services Planning and Coordination services for the Town of Ithaca ; and WHEREAS, The Human Services Coalition is requesting payment in the amount of $3000. 00 in 2001 to provide these said services; and WHEREAS, it is necessary for the governing Town Board to approve the said payment amount and enter into a supplemental agreement with the Human Services Coalition to provide these services pursuant to the agreement between the parties dated March 3, 1998; now therefore be it RESOLVED, The governing Town Board does hereby approve the payment of $3000. 00 in the year 2001 to the Human Services Coalition; and be it further RESOLVED, The Town Supervisor is hereby authorizes and directed to execute a supplemental agreement for the year 2001 on behalf of the Town of Ithaca with the Human Services Coalition pursuant to the agreement with the parties dated March 3, 1998, MOVED Councilwoman Grigorov, SECONDED Councilman Conley. Motion carried unanimously. . Coddington Road Community Center. RESOLUTION NO. 166 - AUTHORIZATION FOR INCREASE IN COMPENSATION CODDINGTON ROAD COMMUNITY CENTER FOR USE OF FACILITIES. WHEREAS, The Town of Ithaca has an agreement with the Coddington Road Community Center, Inc. (CRCC) for the use of certain facilities owned by the CRCC on Coddington Road, Ithaca; New York by the residents of the Town; and WHEREAS, The agreement provides for a stated level of compensation unless the parties agree to differing amounts; and WHEREAS, The parties wish to set the agreement amount for the year 2001 ; now therefore be it RESOLVED, That the governing Town Board of the Town of Ithaca agrees to pay the CRCC the sum of $6732. 00 for the year 2001 payable on February 1 , 2001 , pursuant to the agreement between the Town of Ithaca and the CRCC dates as of may 11 , 1992. MOVED Councilman Lesser, SECONDED Councilman Niederkom. Agenda Item No. 7 - Criteria and Policy for Use of the Town Hall by Other Organizations and Agencies. Supervisor Valentino - We have been getting requests to use the board room . On November 30th the Recreation Partnership will have their re-organizational meeting in the board room . On December 1St the DeWitt Historical Society will be holding their annual meeting in the board room from 5 p . m . to 7 p . m . It is going to be by invitation only . I had another request from Leadership Tompkins . They bring in an array of speakers . They wanted to use the building during the daytime hours from 8 : 30 a . m . to 4 p . m . Councilman Niederkorn - Leadership Tompkins meets regularly . Would it be an ongoing basis ? Supervisor Valentino - They requested the room for one meeting . They do not expect many people . The room is going to be very popular for people to want to use this facility . Councilman Lesser - How much of a burden would it be for some of the groups to provide an insurance certificate ? What do we do if many groups estimate 10 or fewer, and there are more than 10 ? Attorney Barney - The certificate is required of groups with more than 10 people . The Town coul ' require all groups to have an insurance certificate . Councilman Klein - A neighborhood organization would not have an insurance certificate . Who ar we protecting ? Are we protecting ourselves or the insurance company? We are insured through our insurance coverage . Attorney Barney - The Town 's insurance rates are fixed partly on the amount of claims . If someone from a civic organization were to fall and break their leg , the civic organization 's insurance company would cover the accident first . It would not be a loss to the Town because the Town is not involved . If there was no insurance policy , we would need to notify the insurance company . We are protecting our insurance carrier, but indirectly ourselves . Councilman Klein - We maintain risk retention deductibles . Councilman Conley - Could we pass the policy on a time limited basis ? Then we could review it . Supervisor Valentino - We can review the policy at any time . I like to be open to accommodating organizations . Councilwoman Russell - Under the title "Availability" in the policy , we should change " rear conference room " to " Aurora Conference Room " . Attorney Barney - Do you want to make both conference rooms available ? TOWN BOARD PAGE 7 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED upervisor Valentino - No . The Aurora Conference Room was designed to allow meetings in the vening . We are able to secure the rest of the building . It is very small . The courts use the Tioga conference Room for lawyer/client conferences . The Aurora Conference Room and the board room are designed so that there can be public use and the rest of the building is secured . Councilwoman Russell - At the last meeting we discussed allowing use by historic preservation organizations . Do we need a special category? Attorney Barney - I assumed they were charitable organizations . Civic organizations are a broad category . It should be its own category . Councilman Klein - Are the Town of Ithaca Republican and Democratic Committees included ? Councilwoman Grigorov - It is covered under " local political parties functioning within the Town of Ithaca alone " . Attorney Barney - I was not sure if the board wanted County or Statewide political groups . There are a lot of groups the Town Board did not want to use the building . Councilman Klein - The County political parties would be excluded . Supervisor Valentino - What about charitable organizations ? Attorney Barney - Donations are made to the organization and can be deducted on your tax return . 'ouncilman Klein - Should we include unions ? Councilman Conley - They have union halls . Councilman Klein - What about professional associations ? Attorney Barney - A category could be added for professional organizations . I am not sure that the Town would get the requests . Councilman Klein - We could wait and see what organizations ask for the use of the room . Attorney Barney - We need to be careful because of first amendment rights . The board cannot discriminate on what the particular organization stands for. For example , if there is a Town Nazi party we have to allow them because we allow the Town Republican and Democratic parties to use the building . Councilman Lesser - Is the League of Women Voters a charitable organization ? There are always going to be points where we need interpretation . Who is responsible as interpreters ? Attorney Barney - They need to be registered as charitable organizations . They provide a service of information . We could add it as a definition . TOWN BOARD PAGE 8 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED Mr. Walker - I am a member of the American Public Works Association . Would it be considered a outside group or a function of staff? Supervisor Valentino - Does the Town of Ithaca pay for your membership? Mr. Walker - Yes . Attorney Barney - We have Intermunicipal meetings of governmental officials and governmental bodies . Mr. Walker - I am also a member of the American Water Works Association . These associations probably would not want to meet in this building unless one of the committee members was a staff member. Councilwoman Russell - We have included organizations that have Town Staff as members . Supervisor Valentino - The Town of Ithaca is paying employee dues to professional organizations . If someone belongs to a club on their own then it is their own business . Councilman Niederkorn - There is going to have to be interpretation . We need to have a technique in which gray areas can be settled . Supervisor Valentino - Mrs . Kelley and I have discussed this . We will discuss it amongst ourselve 7 and if we still have a question we will call our attorney . Attorney Barney - We can build in a process . The initial determination is made by the Town Clerk' Office . If someone does not like the decision then they can appeal it to the Town Supervisor. Then they could appeal it to the Town Board . Councilman Niederkorn - I would like it to be based on the Supervisor's judgement . No appeals . Mr. Kanter - What about public schools? They let us use their facilities . Supervisor Valentino - Why would they need it? Mr. Kanter - They might not , but there might be an occasion when they need it . Attorney Barney - Schools have a variety of different types of activities . Would the board accept any school activity or would it be certain activities? Most schools have adequate space . Councilman Lesser - We could wait and see if we have any requests . Councilman Niederkorn - What about the lobby? Is the price for using the lobby included in the Shirley Raffensperger Meeting Room ? Supervisor Valentino - No . It should be a separate space . ouncilman Lesser - If the lobby is available , are we precluding food and beverages in the meeting room ? Supervisor Valentino - Yes . Does anyone have questions regarding the use ? Attorney Barney - Food and beverages are very easily messy . Councilwoman Grigorov - I would prefer that there were not food and beverages , but most meeting do have refreshments . We cannot limit it to donuts and coffee . Councilwoman Russell - We could ask that the refreshments be served in the lobby . Councilman Lesser - We could try it for now . If it becomes a problem then we will have to prohibit it . Mr. Walker - It could be allowed with prior approval . It would depend on what they planned . Attorney Barney - What about alcoholic beverages ? Councilwoman Russell - It is not allowed by law . ouncilman Klein - The applicant would not know about the law. ouncilwoman Russell - Why would we care if the organization received more donations than it cost them to use the room ? Attorney Barney - The theory is that they are using the Town 's public facilities and do you want the room to be used for fund raising purposes . It can be removed if the Town Board does not have a preference . We would need to put a limitation on the funds if the Town Board feels it is an inappropriate use . It is a policy decision . Councilwoman Russell - It would be hard to enforce . Organizations hold annual meetings where donations are made . Councilman Klein - It does not matter. Councilman Conley - They would not be holding bingo events . Mr. Carvill - There could be a raffle for door prizes . Supervisor Valentino - Raffles are not legal . Councilman Klein - We should delete it . Councilman Klein - It should be clear that payment is made at time of application . Supervisor Valentino - Does everyone have to pay a fee ? Councilman Conley - There are situations where the fee could be waived . Councilman Klein - The Town Board meets monthly . These can occur between board meetings . It would be hard for the board to determine if the fees are waived . Attorney Barney - The Town Supervisor could waive the fees . Councilwoman Russell - We could waive the fee if it were a governmental organization or if a Town official or staff member belongs to the organization . Attorney Barney - I reduced the fee by 50% for organizations that have a staff member or Town Official . It eliminates the need to have staff come and secure the building . It does not eliminate the cost of electricity and heating . There are some expenses . Councilwoman Russell - There are not much costs for the Aurora Conference Room . Councilman Klein - We have a cleaning service . Councilman Lesser - If it is a small group and there are no expenses besides lighting we shoul waive it . We need a procedure for it to be determined . Councilman Conley - The determination could be made the Supervisor and/or the Deputy Supervisor. Councilman Lesser - It could be circumstances where the Town determines if the fee can be waived . Attorney Barney - We can eliminate " d " and the Supervisor could determine if fees are waived . Supervisor Valentino - During normal business hours the heat and lighting is running . The fee is lower, but it is not an additional cost to us . Attorney Barney - We would have administrative expenses . Supervisor Valentino - The number of persons to require an insurance certificate is too low . Attorney Barney - We can change it to 20 people or less do not require an insurance certificate . Councilman Niederkorn - Is it easy to get the insurance ? Councilman Klein - It is normally an annual policy . They will give you a certificate naming the Town of Ithaca as an additional insured for the particular event . Supervisor Valentino - I do not want to make this complicated . We should change the number of persons in the group to a higher number. Councilman Klein - It is the nature of the organization . Some organizations would carry insurance if they put on certain type of events . Political organizations might not carry insurance . I do not know if the Town of Ithaca Democratic Committee carries insurance . Supervisor Valentino - It would not be often that the Town Democratic Committee had 30 people at a meeting . We might want to make the number of people higher before they are required to have an insurance certificate . Councilman Klein - The Town is insured . In some respects we are helping out our insurance carrier. The risk is low. Councilman Niederkorn - Who would get the insurance? Would the organizer obtain the insurance ? Councilman Klein - The organization carries it . We could set the number at 30 persons and see what happens . We did allow many groups to use our old facility and we never had a written policy nor did we require insurance . Supervisor Valentino - The kind of organizations that would want to use this building tend not to have insurance . Councilwoman Russell - Some groups should have insurance . The DeWitt Historical Society is holding their annual meeting here . They should have insurance . RESOLUTION! NO. 167- POLICIES FOR THE USE OF TOWN HALL FACILITIES, The Town Board of the Town of Ithaca has, on November 9, 2000, adopted the following policies relating to the use of the Town Hall facilities by persons or organizations not affiliated with the Town. Section 1 — A vailabilitV The Town Hall facilities, being principally the Shirley A . (b) Any state governmental agency or officer such as Workers ' Compensation Board hearing examiners, Department of Motor Vehicle hearing officers, and similar entities or individuals. (c) Any neighborhood civic organizations organized with respect to neighborhoods in the Town of Ithaca . (d) Local political parties organized and functioning within the Town of Ithaca alone. (e) Charitable organizations with offices in the Town of Ithaca or City of Ithaca such as United Way of Tompkins County, Hospicare, etc. but excluding meetings of religious organizations or denominations, or fraternal, secret, or exclusive societies. For this purpose, a charitable organization shall be one that has received a ruling or other document from the United States Internal Revenue Service determining that the organization qualifies as a tax exempt organization pursuant to Internal Revenue Code Section 501 (c) (3) . (f) Historical preservation organizations. (g) Organizations to which an employee or officer of the Town belongs and the membershi dues (or other membership fees) for which have been paid by the Town as part of th employment or professional responsibilities or education of the employee or office . Examples of such organizations include associations of Town Clerks, Municipal Planners, Engineers, or Code Enforcement Officers or other governmental or professional groups. Section 2 - Rules Regarding Use The use of the Town facilities by outside organizations shall be subject to the following rules: (a) No use shall be permitted if the use conflicts with any use, program, or meeting of any governing body or agency of the Town of Ithaca. For example, meetings shall not be scheduled to conflict with Town Board, Planning Board, Board of Zoning Appeals, Conservation Board, Town Justices, or other Town Board, Committee, or official conducting the business of the Town of Ithaca . (b) The use shall be limited to meetings (including lectures) and not for social events, dances, performances or other activities involving significant physical movement. (c) All meetings shall be open to the general public. (e) No food or beverages shall be served or consumed on the Town 's premises except in the Marble Lobby and then only with the express permission of the Town Clerk. Under no circumstances are alcoholic beverages to be served or allowed on the Town premises. (f) No admission fees or similar charges shall be made by the organization using the facility. (g) No organization or entity using the facility shall exclude any person seeking to attend the event by reason of such person 's age, race, creed, color, national origin, sex, disability, marital status, or sexual orientation. (h) Any organization or person using the premises shall be responsible for assuring that no damage is incurred to the premises during the period of use by such organization, entity or individual, shall be responsible for cleaning up the used premises immediately following their use and prior to the occupancy by any other entity or body, including any entity or body associated with the Town of Ithaca, and shall be responsible for restoring the room to its condition and configuration in existence prior to its use by such organization or person. tection 3 - Application Procedure Any organization seeking to use the premises shall apply for same on a form to be provided by the Town Clerk. Among other items, the form shall require the following information: (a) Name and address of applicant. (b) Facility requested (e. g. , Shirley Raffensperger Meeting Room or Aurora Conference Room). (c) Date of requested use. (d) Person in the requesting organization that will be responsible for the conduct of the persons attending the event and for cleaning up after the event. (e) Proposed use. (f) Estimated number of persons expected to attend event. Section 4 - Fees (a) An applicant for the use of the Town facilities shall pay the following fees for the use of the facilities at the time of application to cover the cost of providing the services (utilities, security, etc. ) for the use. (ii) If the use is at a time other than the normal business hours the fees will be: (A) $50. 00 for the Shirley Raffensperger Meeting Room. (B) $30. 00 for the Aurora Conference Room. (C) $40. 00 for any other facility the use of which is made available to the non - town organizations. (b) The foregoing fees shall be waived if the use is by a governmental body or officer. (c) If the organization or entity using the facility includes an employee or officer of the Town with appropriate security clearance for access to Town premises during the hours of the requested use, and if such person signs the application for use and agrees to be responsible for opening the premises for the intended use and assuring that the premises are closed and that all people are out of the building upon conclusion of the proposed use, the foregoing fees may be reduced by 50 % . (d) The Town Supervisor may, in his or her discretion, waive the fees altogether in thos circumstances where the Town Supervisor determines there is no additional cost to th Town in permitting the event to occur on the Town premises (e. g. , no janitorial costs, n utility costs, no security arrangements, etc. ) . Section 5 - Insurance Certificate Prior to the granting of authority to use the facilities, if the estimated number of people to attend exceeds 30 in number, the applicant shall provide to the Town Clerk an insurance certificate or binder or other evidence reasonably satisfactory to the Town Clerk and/or the Town 's insurance counsel, pursuant to which the Town is named as an additional insured for liability purposes in an amount not less than $ 1 , 000, 000 per occurrence and not less than $3, 000, 000 in the aggregate. The Town Clerk may, if in the Town Clerk 's reasonable discretion it is determined that there is a significant liability risk, require liability insurance in the foregoing amounts of groups of 30 persons or less. Councilman Niederkorn - How much time commitment does it involve ? Mr. Noteboom - This organization started in the City . They have included the County . We were concerned that the Town is not represented on Countywide planning . There are a few meetings a month . It is not a large commitment at this time . Mr. Noteboom - The resolution states that every time an expenditure is made we have to have permissive referendum . Attorney Barney - Yes . It does not change the bottom line or the number of the budget . There are some items that are not accurately reflected , Page 1 , Transfer to Capital Projects Line has $650 , 000 . This should show on the budget with a line under revenues that would show revenues of $650 , 000 from the fund balance . Under appropriations there should be a line that it as an appropriation for capital projects . It needs to be shown correctly . The total revenues and the total appropriations then come to $2 , 376 , 844 . The other corrections that should be made is after total appropriations , the lines of other uses should be taken out . They should not be there . The bottom of page 1 shows excess revenues , It should be removed . At the bottom of page 1 , Fund Balance , the actual fund balance should remain . The res should be removed . They are guesses . They cannot be justified at this point . It does not change th numbers of the budget . It cleans up the way it should be recorded . Councilman Lesser - Has the Commission approved the budget? Supervisor Valentino - The Commission has approved this budget and the numbers . I talked with them about the way it was recorded . They understand that as Treasurer of Bolton Point I am concerned about it , I am still concerned about the fund balance . When we do the annual report and auditor's report we are going to monitor it closely . My concern is that if it looks like the fund balance has been depleted without authorization of that money , then we are starting to get back into the old problem Bolton Point had where we are not charging enough for water. Mr. Carviil - Money should never come up from fund balance without coming before the governing board . Councilman Niederkorn - My effort is to try to simplify zoning to the extent that it can be done so that people can read it and understand it . I have not had a lot of luck . This is an improvement over what exists at the present time . It closes some loop holes . I will continue to try to simplify things as we go through the Zoning Ordinance . We are budgeting $ 11 , 000 for 2001 . What is the change? Mr. Carvill - The budget was modified to $ 10 , 700 in 2000 . It is for our new XEROX equipment and its maintenance and up gradings . There is less purchasing going into hardware . It is going towards support . It includes the GIS system , CAD upgrades . Councilman Klein - The next line is Preservation/Restoration . We budgeted $2 , 000 for 2000 . The 2001 budget is budgeted for $0 . 00 . Mr. Carvill - The individual doing this work is not available . We need to find a new resource . Councilman Klein - On the same page , A1680 . 205 , Work Administration . What does the number represent? Mr. Carvill - The figure in Work Administration represents all departments . The computer and hardware purchases is maintained by Ms . Titti . They are shared services combined into one line and one work unit . Councilman Klein - Does it include staff? Mr. Carvill - No . It is hardware and upgrades . Councilman Klein - Is the line Storm Water Management under Contractual Expense , A5132 . 460 , work that is being contracted out? Mr. Noteboom - It is where we have used the materials from storm water management projects . We have discussed contracting out a job using the money in that line item . It is not personnel . Councilman Klein - Is it equipment? Mr. Noteboom - No . It is for buying pipe and catch basins . They are items for the actual storm water management projects . It could be used to contract the work out . Councilman Klein - Line A2189 is engineering fees for services . Mr. Carvill - We have received $450 for fees that Mr. Walker charges for reviewing site plans . The budget for 2001 closely resembles the actual of the year 2000 . Councilman Klein - Does this come under the developmental fee ? Mr . Carvill No . It is charged by the Engineer for his review . The engineering is charged Townwide under he A- Fund . Under the B- Fund , either B2115 or B2691 , there are a lot of fees that come into the Part- own for Planning Board reviews . I am concerned that some of it is not being allocated properly to the Townwide . Mr. Walker - There has not been a lot of engineering time put into development review this past year. We have not had that many projects that have had major engineering time . The Planning Department has been handling most of the environmental reviews for drainage . Councilman Klein - The Planning Department charges are Part-Town . Clearly any development review fees that involve the Planning Department are rightly charged as income on the B- Fund . Since 100% of engineering is Townwide , any fees paid for engineering review should be revenue on the Townwide fund . Mr. Walker - There has not been a lot of engineering expense . Attorney Barney - The revenues are generated through the Planning Department function . Councilman Klein - No . The costs are coming out of the Townwide fund . Attorney Barney - We would pay the engineer the full salary whether there were any revenues coming in or not . These revenues are coming in as a result of a Planning function . ouncilman Klein - I disagree . Attorney Barney - These reviews are for Planning Board applications . Mr. Walker - They are charged back to the A- Fund for the engineering time . Councilman Klein - It is an incorrect allocation . If there are no fees coming in , then it is fine . The Townwide fund is paying for engineering services . It is engineering time . I do not care if it is a Planning function or another function , it should be off- setting the Townwide . Attorney Barney - The Village of Cayuga Heights does not contribute funds in to reduce the engineering cost . Councilman Klein - Cayuga Heights residents are paying for the Engineering Department , Attorney Barney - We do not take care of applications in Cayuga Heights , Cayuga Heights does not generate any revenues to off-set the expense . The Part-Town does generate the revenues . It is generated because of applications dealing with areas outside the Village of Cayuga Heights . Councilman Klein - All residents of the Town are paying for engineering . We need to reduce that column . The fees that are coming in to pay back the Engineering Department for the costs should be in the same fund . If Mr . Walk develops $ 1 , 000 of revenue analyzing or reviewing Part-Town projects , then there is nothin inappropriate for the money generated to go towards the Part-Town portion of his salary . Councilman Klein - There is no Part-Town portion of his salary. Attorney Barney - The Townwide tax fund is paid by everyone . It is not only the Village of Cayuga Heights . Mr. Carvill - Revenues are generated in a Part-Town fund at the time the applicant comes in and puts in their application . They are charged the application fee . The application fee is reflected in revenue account 2115 . The Planning Department assesses the application based on the size of the project, what is it going to take , time and expenses to review the site plan . We have ledgers . Planning maintains the hours . It is job cost out . Once they have reached their final level , the assessment is made . A letter is sent to the applicant stating the cost . The check needs to be received up front before we begin the process . We hold it in an escrow . I receive a charge back from Mr . Kanter of how much of the money comes back into the Townwide fund . It is called cost recovery . If we exceed the amount , the developer is notified and we send them a bill indicating the additional amount . Once the project is closed , before it is finalized , they turn it over if the requirement is there to have an engineer look at it . Mr. Walker spends time looking at the project . It is a flat review fee that is allocated into the A- Fund . It is not generated as a form of attempting to reimburse for his salary . Councilman Klein - What about the Planning fees ? Do we charge by the hour? Mr. Carvill - Yes . Mr. Walker - There is a fee for different step levels based on an hourly rate equivalent of the salaries . It is $30 an hour if my assistant is doing the evaluation work . It is $43 if I am do the work . Councilman Klein - It is being credited under Departmental Income , A2189 , Engineering Fees for Services . It should reflect all the engineering time spent even if it is a Planning Board function . Mr. Walker - We do not charge back for time I spend at Planning Board meetings . The actual revenues for this year is about $400 . There has ,not been a lot of development review occurring that has required the Engineering Department to review it . Councilman Klein - I thought it was a small percentage . Mr. Carvill - Historically , cost recoveries as well as a Planning fee was all receipted in as Planning Fee . There is a clear delineation between that which is a charge for services or a fee . The fee is a fee . It is not reflecting the review time . Councilman Klein - Account B261 , Development and Review Cost Recoveries . has $ 10 , 000 budgeted . The Planning Department is going to take in $ 10 , 000 worth of review time and Engineering is allocating $400 . 1 thought the proportion was off . Subdivision plats are being checked by Planning staff . They are doing most of the review work . They consult with me occasionally . Ms . Ritter has had extra training in storm water management . She is handling a lot of the basic storm water evaluation . Mr. Carvill - Historically , the number for engineering services was grossly inflated . This reflects the minimums of the amount of activity. It is a realistic budget dollar to the actual . Mr. Walker - The number also reflects what we charge other governments for design services . We charged the master meter project back to Bolton Point . We assumed that we would be doing more integrated water system work this year. We had a higher number for the budget . Until the agreement is signed we are not doing any engineering work . Councilman Klein - Are we painting one water tank per year? Mr. Walker -The tanks are on a 10 year painting cycle . We started painting two a year because we received prices that were very favorable . We have two tanks to be painted . One tank is on Hungerford Hill Road . The tank was inspected . The paint is in excellent condition . We decided not to put it in the budget for this year. The Trumansburg Road tank cannot be painted until we have a tero ,econd tank to back it up . ouncilman Klein - We spent $97 , 000 for painting the water tanks in the past year, then we drop to Supervisor Valentino - We saved a lot of money with painting two tanks at once Councilman Klein - It was mentioned that we had fallen so far behind that we had to pay a large amounts of money to catch up . We were going to try to do it on a more regular basis . Mr. Walker - The tanks will be on a regular painting cycle . The tanks that we painted four years ago will not be ready to be painted again for another five years . Councilman Klein - I wanted to make sure we were not being short sighted . Supervisor Valentino - We do not want to get behind again . Councilman Klein - Capital projects are being introduced in the sewer budget . G8120 . Mr. Walker - We have a significant amount of INI potential in the Northeast area . We are looking at realigning the sewer in the upcoming year. The amount budgeted is significantly higher than what the actual cost might be . We have old lines on Hanshaw Road from the Village line up to Warren Road . We are going to attempt to do the project as trenchless as possible . The line might be more troublesome because they are older. It is about 3 , 000 feet of pipes . would cost about $40 per foot . Councilman Klein - This is coming out of the project . Mr. Walker - Yes . The Hanshaw Road project will relieve pressure on the Cayuga Heights Wastewater Treatment Plant . The hospital project takes care of a serious problem . Councilman Klein - Are the projects designed ? Mr. Walker - We will design them this winter. Councilman Klein - Do we have to show the grant money that is coming in for the Hannah Pew Trail and Maple Avenue ? Should it be reflected in our budget? Mr. Carvill - It is a capital project budget . It will be established once everything is finalized . During 2001 when we are ready to initiate the project , we have to upfront the expenses to get it started . Then we start vouchering . We will establish a budget . It would come before the board to establish the capital project . When the sewer projects are initiated , the expenditures won 't be made directly out of the sewer fund . This ear marks the money and appropriates it for its purpose to put it out there for budget purposes . A resolution will need to be passed by the board to establish the project . Supervisor Valentino - The projects do not change the rate . We have the funds available within th budget to cover the costs . Our fund balances are healthy . Mr. Carvill - There is a lot of input from the Department Heads , Mrs . Kelley and the Accounting Office . Their effort helped in putting the budget together. Mr. Kanter - We have new resolutions for the board . Supervisor Valentino - I looked over the first resolution that was mailed out in the packets . Some staff and I felt that to include the bonding in that resolution was not our preferred way to approach the resolution . The likelihood that we would have to bond for this is none . We have ten years to complete the project . I thought it clouded the issue more on a permissive referendum . It would be much cleaner for us to get beyond a permissive referendum if it is clearly looking at the grant funding . Mr. Carvill talked with the State . The State wants to see a straightforward ; uncomplicated resolution to use the funds . The funds are available for us . They have been set aside . Attorney Barney - I included the bonding in the initial draft because we are being asked to sign an agreement . The agreement says that we will front the money for the project . We approached it by looking at if the worst situation were to occur, how would the project be funded . We initially talked about bonding . The issue is that they both require a permissive referendum resolution . The reason for putting the two into one resolution is that there would only be the need for one permissive referendum . Councilman Klein - Do we have a problem with coming up with our full share? We need to take it out f our fund balance until we are reimbursed . Supervisor Valentino - We have ten years . A lot of this work will be in -house . Mr. Kanter - We hope that it will not be a ten year project . We still have survey and work , land acquisition , and design to be done . This will take us into next year. It is going to be between one and two years for construction . It will be reflected in upcoming budget years . We have allocated $25 , 000 in the 2001 budget to cover some of the upfront costs . Councilman Klein - Would Town labor be charged to the specific fund ? Supervisor Valentino - Yes . Councilman Lesser - Is there much likelihood that the State will not meet the commitment that they have made ? Supervisor Valentino - It is very remote . Mr. Kanter - It is Federal money that is authorized and the State administers it . The State cannot hold it back unless if what we do does not qualify under Federal and State guidelines . Councilwoman Grigorov - Is the land being donated ? We will not receive more money if the cost exceeds the projected cost . After discussions with Attorney Barney , we realized we need a SEAR review for the trail project . There is a third resolution to pass the Environmental Review and SEQR . Supervisor Valentino - We need to pass the SEQR resolution before we pass the other resolution . Mr. Kanter - It is an unlisted action processed through a short Environmental Assessment Form . Councilman Niederkorn - Was there any public opposition to the project? Mr. Kanter - No . The landowners surrounding the trail have been supportive . We have not gone out to the community . We will need to do so . Supervisor Valentino - It was mentioned in our Parks and Open Space Plan . At this point we have not seen any opposition . Councilwoman Russell - Has the public been using the lands informally? Supervisor Valentino - Yes . Councilman Klein - The details of the specific path need to be developed . It is behind a number of houses . Mr. Kanter - We will set up neighborhood meetings during the design phase . Mr. Noteboom - I have met with the Eastern Heights neighborhood many times . I have mentioned the possibility of the trail . They seem supportive of the project . Councilman Klein - Is it a larger distance from the homes than the South Hill Trail ? Mr. Noteboom - It depends . The majority of the trail will be a greater distance . Some of the homes on the South Hill Trail are very close to the trail . Mr. Kanter - There will be concerns about buffering and screening . It will need to be addressed during the design process . Councilman Niederkorn - It would be a serious problem if we passed a short EAF and there is a lot of public criticism . WHEREAS, this action is the construction of the William and Hannah Pew Bikeway, including the funding; design. construction , and land acquisition for this project, which involves the construction of a 10 foot wide off- road bicycle and pedestrian path extending from the intersection of Pine Tree Road and Honness Lane southeasterly approximately 0. 75 miles to Tudor Road in the Eastern Heights residential area,, construction of a transitlpedestrian plaza at the Pine Tree Road/Honness Lane terminus of the Bikeway; addition of an asphalt walkway on the east side of Pine Tree Road and 4foot wide bicycle lanes on the shoulders of Pine Tree Road between Honness Lane and Snyder Hill Road; and additional intersection improvements at Pine Tree Road and Honness Lane; and WHEREAS, this is an unlisted action for which the Town of Ithaca Town Board is legislatively determined to act as Lead Agency in environmental review with respect to the construction of Town parks and trails; and WHEREAS, the Town Board; at its regular public meeting held on November 9, 2000, has eviewed and accepted as adequate the Short Environmental Assessment Form, Parts i and Il for this action; now therefore be it RESOLVED, that the Town of Ithaca Town Board hereby makes a negative determination of environmental significance in accordance with the New York State Environmental Quality Review Act for the above referenced action as proposed and; therefore, neither a Full Environmental Assessment Form, nor an Environmental Impact Statement will be required. The second resolution is one that the State requires be attached to their agreement , The resolution does not allow for the fact that we have to wait for 30 days to see if there is going to be a permissive referendum . Engineers and Surveyors, that meets or exceeds the criteria stated in Outline for Survey for a boundary survey of the 60 foot right-of- way and the 80 foot wide topographic survey; and WHEREAS, the total cost of providing the requested boundary and topographic survey given by T. Motion carried unanimously. Agenda Item No. 22 - Discussion Regarding Route 366 Bridge Reconstruction . Supervisor Valentino - Mr. Noteboom has traffic counts for the board . Have they been given to Mr. de Argon ? Mr. Noteboom - Mr. Kanter and I met with Mr. de Argon 's office . We tried to simplify the numbers so that they made sense . We listed each road the traffic counter were located . The numbers the board is seeing north and south on each road in the two different scenarios are the p . m . peak counts . We noticed that in the different scenarios the daily counts changed . The p . m . peak numbers was not showing much of a difference with a one way south or a two way road . It was showing that things did not change a lot on Caldwell Road or traffic going through Forest Home . The daily counts changed significantly . Councilman Lesser - How are drivers adjusting their patterns? Mr. Noteboom - Drivers seemed to spread it out over a longer period of time . It was not good for Forest Home . Some of the traffic moved from Judd Falls Road to Caldwell Road . The model came out quite accurate according to the actual counts . The model does not show daily counts . It shows p . m . peaks . I am seeing that the one way south scenario is not a good scenario . We need the tw, way road . Councilwoman Russell - Mr. Noteboom , do you feel confident that this is enough data to make tha judgement? Mr. Noteboom - I do not think we are going to get better data . Councilman Lesser - It is good that we collected this data . We have some hard information of which to make a decision . Councilwoman Russell - We need to make two decisions . The State has a separated pedestrian walkway design that goes over Cascadilla Creek , north of the roadway . The State is asking us if we would want them to do that design and if we are willing to maintain the bridge . We need to decide it tonight . The State had asked us to decide it by November 1st . I asked them for an extension while Supervisor Valentino was out . They agreed to extend it until after this meeting . They do want a response . If they do not get a response , the default response would be to put the pedestrian traffic on the main bridge . Mr. Noteboom - The bridge will be 10 feet wide and be concrete sealed . The walkway they have proposed is not ADA approved . The grades are too steep . Councilwoman Grigorov - Is it still legal if it does not meet ADA requirements? Would we need to plow it or salt it during winter months ? Mr. Walker - I do not believe Judd Falls Road meets ADA requirements . It is too steep . Mr. Noteboom - We would probably plow the bridge . We do plow Game Farm . We leave a portion of it for cross country skiers . This would be a main access to Cornell . The bridge would be expensive to replace in the future . It should last 50 to 75 years . Councilwoman Russell - It does create a safer situation for pedestrians and bicyclists . Councilman Lesser - Is part of the abandoned portion of Judd Falls Road going to be left for the trail ? Councilman Klein - They are not clear on it . otupervisor Valentino - The abandoned Judd Falls Road would become part of this . ouncilman Klein - Are they going to build something to continue the sidewalks ? Councilwoman Russell - They are going to tear up part of the pavement and leave some of it for the trail . Councilman Klein - The sketch shows a fairly wide road . Councilman Niederkorn - Would the Town be responsible for the Judd Falls Road portion ? Mr. Noteboom - We would be responsible if it is part of a walkway . We could attempt to tell Cornell that it is part of the access to their campus . They could take it over. Councilwoman Russell - It is their property . We could discuss it with them . Councilman Niederkorn - Do we plow the South Hill Trail ? Mr. Noteboom - We do not plow the South Hill Trail . The East Hill Recreation Way is plowed by the Town . Supervisor Valentino - It is dangerous having people walking and riding bikes in the intersection . It is good suggestion for us to talk with Cornell . Councilman Lesser - The portion of Judd Falls Road that is going to be retained as a portion of a ne road does not have a path . Councilman Klein - It looks like on the new portion of Judd Falls Road that there are stripped bike lanes . Councilman Lesser - The State seems to be very accommodating to our requests , but it would be useful to have it verified . Councilman Klein - We endorse option 2 and are committing to own and maintain a separate pedestrian and bike bridge . Supervisor Valentino - We want to make sure there is a lane where it can connect back with the walkway . Mr. Noteboom - It appears that there are 4 foot shoulders on the road . It appears there are 11 foot driving lanes on the road . I am not sure that we want it . Councilman Klein - What would you like? Mr . Noteboom - Town roads are typically 10 foot wide driving lanes . Mr . Kanter - The State does not care if the road is one way or two way . It would be easier if we ha made the decision for one way upfront . They would have been able to build a smaller road . If w decided to make it one way southbound we would be able to do so , Councilman Niederkorn - We need to include our concerns about the foot path on the abandoned portion of Judd Falls Road . Supervisor Valentino - I do not know if we can require it . We should request that the pavement on the Old Judd Falls Road be reduced to 10 foot walkway to be consistent with the path , We need to have the shoulder marked where the two pedestrian paths join . We also request that the new Judd Falls Road portion be 10 foot driving lanes . RESOLUTION NO. 179 - ROUTE 366 CONSTRUCTION. Employees would be able to get a bigger installment up front and have reduced installments later if they chose to do so . It gives them more options than what they currently have . It does not incur any cost to the Town . Resolution No. 180 - Approval to Amend and Restate the Model Deferred Compensation Plan. WHEREAS, the New York State Deferred Compensation Board (the `'Board'), pursuant to Section 5 of the New York State Finance Law ("Section 5') and the Regulations of the Deferred Compensation Plan for Employees of the Town of Ithaca (the "Model Plan ') and offers the Model Plan for adoption by local employers; and WHEREAS, The Town of Ithaca, pursuant to Section 5 and the Regulations, has adopted and currently administers the Model Plan know as the Deferred Compensation Plan for Employees of the Town of Ithaca; and WHEREAS, effective January 1 , 2000, the Board amended the Model Plan to include modifications required by the U. S. We put together a price of what it would cost to deliver a machine . The Town of Caroline owns a machine , but they do not have the ability to move it the school . Supervisor Valentino - The Town of Caroline had an old machine they were willing to donate to the school . The school might have fixed the old voting machine . Councilwoman Grigorov - Do you want more board members on the interviewing committee? Drake and I decided to put in another advertisement and extend the time . There are some goad applications ; but so far none with the right combination . Supervisor Valentino - Have we received any applications for the Planning Board ? Mr. Kanter - We have not received any applications . Agenda Item Flo . 25 - Electinct to Provide Additional Pension Benefits of Section 41j of the Retirement and Social Security Law . Supervisor Valentino - The State has recently decided that we can take accrued sick time and convert it to their credits for pension . It would be at the maximum of four months of service . We have one person retiring who would like to take advantage of it . He has always been can his wife 's health insurance . He would lose the sick time he has accrued for being a good employee . I would like to offer this to the employees . There probably would not be too many that would take advantage of it . Supervisor Valentino - We do that now . Mr. Noteboom - Our maximum hours for sick time is 960 hours . Supervisor Valentino - The Town 's maximum for sick time is 120 days . They would receive a credit of four extra months . Attorney Barney - We need to include a maximum of 120 days into the resolution . Mr. Carvill - Is it 120 working days ? Supervisor Valentino - Yes . Councilman Klein - It is interesting that they divide the number of days by 30 days . We do not work 30 days per month . We work 20 days per month . The calculation should be divided by 20 days . Otherwise , the employee is short changed by 50% , It could be as much as 6 months . Mr . Noteboom - Thirty days of sick time equals one month according to the State requirements . Mr. Carvill - Could we make it 120 working days versus 30 consecutive days? It might be why we are going to 165 days , Councilman Lesser - I do not know if our system keeps track of accumulated sick days beyond 12 We would need to change our procedures . Mr. Kanter - I did not realize that at a certain point the numbers stop . I do not know if there are very many people where that is the case . They would need to be working for the Town a long time . Councilman Lesser - We should say that if you have accumulate 120 days we will credit you 165 days . Attorney Barney - The board might want to adopt this resolution the way that it is . Then the board could adopt a separate resolution that states , " For the purposes of calculations of the 30 days equals one month , we use the calculation that 20 days equals one month '" . Mr. Carvill - We talked about this resolution . The State said that we needed the resolution yesterday . Resolution No. 182 - Authorization to Provide for Section 4 1 of the Retirement and Social Securit Law. Resolution No. 1 83 - RESOLUTION ESTABLISHING THE MEANS OF CALCULATING SICK TIME FOR PURPOSES OF RETIREMENT BENEFITS EXTENSIONS PURSUANT TO RETIREMENT AND SOCIAL SECURITY LAIN SECTION 41 (J). WHEREAS, the Town Board has adopted a resolution permitting retiring employees to apply accrued and unused sick days to obtain additional service credit for retirement benefit calculation urposes pursuant to Retirement and Social Security Law Section 41 (j); and WHEREAS, the normal maximum permitted accrued sick days for Town of Ithaca employees s 120 days; and WHEREAS, the for Town of Ithaca purposes, only work days are accrued (i. e, a work month is normally 20 - 22 days); and WHEREAS, the NYS Retirement System calculates the monthly equivalent of unused sick days as 30 sick days (i. e. each 30 days of accrued sick leave may be utilized by the employee to acquire one month of additional service credit) , and WHEREAS, the Town Board would like its employees to have the maximum benefit authorized by Section 41 (j) which is 5 and Yz months additional service based upon 165 accrued and unused sick days ( 165 days divided by 30 days) ; NOW, THEREFORE, BE IT RESOLVED by the Town Board of the Town of Ithaca that for the purpose of calculating the additional service benefit as permitted by Section 41 (j) of the New York State Retirement and Social Security Law, the maximum number of sick days that may be accrued is 165, rather than 120; and it is further RESOLVED, that for all other purposes, the maximum number of sick days permitted to be accrued remains at 120. Motion carried unanimously. Agenda Item No. 26 - Draft Agreement Changes for the Joint Sewer Partnership and Legal Requirements for Changes to Governing Structure . Councilman Lesser - Do we have a map of the service area? It makes a reference to an appendix. Councilwoman Russell - We do not have one . Everyone has been asking for it . Councilman Lesser - When we have surplus capacity it is required that the capacity be sold within the system to someone within the system that is requesting it . How is the price of that capacity determined ? Supervisor Valentino - There is a formula that is followed . The engineers went over a formula . The agricultural land is causing a lot of problems . The problem with the current partners , with the exception of the City and the potential partners , is the concern that the way it is formulated on what can happen with agricultural land has other municipalities making internal decisions on how a municipality wants to deal with their land use . Some of us feel that it is over stepping the bounds of having that kind of control over another municipality . I do not think that we are questioning it . would be nice to look at the agricultural lands . We do a good job of preserving open space . W would not want the City of Ithaca or another municipality imposing their will and making decisions th we feel are our rights to make . t The City is causing us a great deal of grief over their concern for sprawl . They seem to think that some of the rest of us will not do a good job . Councilwoman Grigorov - The basic interests of the municipalities are different . Supervisor Valentino - They want everything to happen in the City, but they do not have enough room . Councilman Lesser - They are not very hospitable . Councilman Conley - Do they prefer that we not have any businesses ? Councilwoman Russell - The City prefers that they have control . It is set up so that we would delegate our decision making authority over what happens over sewer hook ups to the agricultural lands . We would delegate the authority to the Sewer Board . It would be a board of joint entity . Supervisor Valentino and I have been objecting and making clear that we do not consider it appropriate for the Town of Ithaca . Councilwoman Grigorov - The drawback to extending sewer service is sprawl . TOWN BOARD PAGE 47 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED t tupervisor Valentino - Sometimes extending sewer eliminates sprawl . We can concentrate where e sprawl is going to be . We are going to have bigger sprawl without sewer. We would also have aekage plants , which Cornell is proposing . Councilwoman Grigorov - Would the control be that they would not hook people up to sewer in certain areas? Councilwoman Russell - The agricultural lands would be shown on a certain map . We would add an additional layer of review by the sewer board before any development could take place . It gives the ability of the municipalities to exempt certain agricultural lands that they are planning to be developed . It is going to be a tough decision and tough negotiations . It is setup to be an unanimous decision of the sewer board . Supervisor Valentino - The City could veto it . The City would not consider anything that did not give them the veto power. Councilwoman Grigorov - I would not be in favor of the veto , but the review might be a good idea , Councilwoman Russell - We are making clear that we do not want lands in the Town of Ithaca to be included . Supervisor Valentino - The City has been talking about keeping the northeast portion of the Town out of the charter area . We disagree . The Town has been a partner from the beginning . All of the Town of Ithaca should be included in the charter area . We are not willing to accept having part of the Town parcels not included . We do not think the Town of Ithaca should have to have another municipality dictating how we deal with our open space and agricultural lands . The other municipalities feel the same . The Village of Lansing , Town of Lansing , and the Village of Cayuga Heights have just started to look at the agreement . Councilman Klein - What is the status of the Cayuga Heights Treatment Plant ? It serves our northeast area . Councilwoman Russell - It has not been dealt with in this agreement . We are working on a separate agreement . Cayuga Heights had indicated that they are not sure if they want to be a partner to this agreement or if they want to be included with a separate contract . Councilman Lesser -What is the position on phosphate removal ? Supervisor Valentino - Cayuga Heights position is that they are willing for the phosphate removal component of this to be added to their sewer plant as long as they do not have to pay anything for it . Otherwise they do not seem to care less if they are polluting the lake or not . Councilwoman Grigorov - Why should they not pay for it ? TOWN BOARD PAGE 48 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 ; 2000 - APPROVED - APPROVED - APPROVED Councilwoman Russell - Cayuga Heights wants the grant money . They are not interested in th project if they do not receive the grant money , if Supervisor Valentino - Cayuga Heights operates okay when it is dry . Once it starts to get wet , they start having problems . Councilwoman Grigorov - I do not think the Cayuga Heights Board hears the engineer's position . Supervisor Valentino - Most of the discussions are between Ron Anderson and Brett Cross . I have been trying to contact Walter Lynn . He is a member of the Bolton Point Commission and a member of the Village Cayuga Heights Board of Trustees . I thought if we could get a chance to talk with him it would open the doors for the rest of the Trustees to hear the discussions that have been happening . At some point Cayuga Heights is going to have to be involved . Councilwoman Grigorov - I do not think the residents of Cayuga Heights know about it . Supervisor Valentino - They have no idea . Councilman Niederkorn - Do you get the feeling that the State is going to allow you to keep talking ? Supervisor Valentino - No . Mr. Walker - This agreement is between the current partners . We have not extended it to the othe partners . There is another round of discussions on this model if we expand the partnership . Supervisor Valentino - This does include how it would expand with the other partners . We are waiting for their comments . Mr. Walker - The fallback is that Dryden is the only municipality within the existing partners that has the potential for going outside the service area . The other municipalities would be outside the charter area . Councilman Lesser - Is there any concern that there might be some preemption of development? If the agreement does seem appropriate that within the municipality the municipality decides their own development priorities . If one of the member communities decides to develop rapidly , under the mandatory sale process , other municipalities are required to sell their capacity to them . It means that at some point in time that one community might be developed by the time the communities with sole capacity may choose to develop . There would be no excess capacity remaining to purchase . Then we would be in another expansion phase . Is a system like this setting up where there could be tension or jealously among communities based on their difference in priorities of development? Supervisor Valentino - We can only sell capacity when we determine what is excess . Councilman Lesser - My understanding is that if you are not using it , it is declared excess and you are required to sell it if someone chooses to purchase it . It is not a choice . We might want to think about what the consequences would be when there is a bigger mix of communities with differen approaches . Councilman Lesser - It would put communities in the difficult situation where you do not want another community to decide how you want to develop your own lands . The issue is the mandatory requirement to sell your capacity . If a community chooses to pay for the cost of maintaining capacity, perhaps they have the right to pay for the opportunity to reserve capacity for the future . If they choose to sell it they can . Supervisor Valentino - It is a good point . Mr. Walker - We have a lot of excess capacity . We could utilize the extra capacity by extending the charter into the northeast . We would not have to buy it . Councilwoman Russell - We should be able to calculate a projected growth . Mr. Walker - The projected growth in the 1980s was based on full development of West Hill . It is not going to happen . We have come up with amending the projected need . Supervisor Valentino - Most of the agreement we are in agreement on . The governance of the joint system is very close to the Bolton Point model . We would probably be abandoning the SJS committee . It would be set up to be a governing board . It would have the annual audit component by law . It is written in the agreement so that we make sure it happens . It has a treasurer set up like Bolton Point so that there is oversight of the municipal funds . The three original partners have agreed on those issues . The outstanding issue is the agricultural lands . Councilwoman Russell - We also have the issue with Cayuga Heights . Supervisor Valentino - We have made a lot of progress . I talked with the potential partners about the governance portion . They will probably be okay with it . We wanted the board to start looking at the agreement and giving us feedback . The northeast area of the Town of Ithaca is currently served by the Cayuga Heights Plant . The City does not want this area included in the charter. The City wants us to pay rate and a half for the area . We do not think we should pay rate and a half because we have been a partner since the beginning . The entire City is in the charter area . They have expanded the chartered area for Dryden who was a late comer to the agreement . We want to know why is the Town of Ithaca being disadvantaged . Agenda Item No . 27 - Consent Items . We are going to be taking over the area of land behind Sam Peters . We hope the State is going to rebuild the truck turn around area . We will need a Town Board resolution to accept the other portion of the road from the County . We might need to rename the portion of the road . Mr. Noteboom The State would also like us to take over the truck brake inspection portion of th road . We do not know why we should . I asked the State to research any agreements that were made with the County . Councilman Klein - Public Works has been discussing Lake Shore Park . It is nearly complete . The pavilion is not up . Councilwoman Russell - Lanny Joyce approached me and said their architect wanted us to make sure we wanted a pavilion . The architect felt the park was quite attractive . He felt it would look nice with a few scattered picnic tables rather than a pavilion . Councilman Klein - It is a small park . Supervisor Valentino - The pavilion would over power the area . Councilman Klein - Benches would look nice instead . Councilman Lesser - The board should visit the park before the next board meeting . Councilwoman Russell - They are having an open house November 30th . They will be running buses rom Stewart Park because there is no parking . They will be giving tours of the facility . Councilman Klein - The Public Works Committee has been discussing if we want to name the park . We should include it on our next agenda . Supervisor Valentino - We should have a policy on how we name parks . Councilwoman Grigorov - The 10 had their dinner at Wells College . It went very well . The Secretary of State spoke . Councilman Lesser - The groups who set the priorities and issues about water quality had agricultural as a concern . Councilman Conley - There is agricultural land around the lake . Cayuga County is one large farm . Supervisor Valentino - Some of the major agricultural businesses are major polluters . I do not think we think of them in the same way as other industries . Councilman Lesser - There is regulation . The question is how effectively is it enforced . Councilwoman Russell - The public scoping session on the Cornell Incinerator is scheduled for November 15th . There is no incineration technology at all in their proposed action . It is kept as an TOWN BOARD PAGE 54 NOVEMBER 9 , 2000 APPROVED - APPROVED - APPROVED - DECEMBER 11 . 2000 - APPROVED - APPROVED - APPROVED alternative to be considered . The proposed action would put into place two outlying hydrolosis units for treatment of carcus waste . The steam sterilization unit is for treatment of the regulated medica waste . Ruth Mahr does deserve a lot of credit . She made everyone aware of the issue . Otherwise we would have a regulated medical waste incinerator at Cornell . Supervisor Valentino - The Town of Ithaca deserves credit for holding Cornell accountable . We would not participate unless it was a meaningful committee . We forced the committee to be put together the way we wanted it . Councilwoman Russell - The community members and the Biosafety Engineer at Cornell argued that the incinerator should be eliminated from alternatives and have the second hydrolosis unit for the back up . We had a meeting about the Lake Source Cooling project . They showed us preliminary data . The graph did not indicate that there is any impact that they can see at this point . It has only been up and running since this summer. It is not long term data . We were given the chance to say we would like to see sorne data from the sample point south of the lake source out fall . They did not distribute the table that they showed us . They want to be certain about their data before they distribute it . Our consultant wanted to see more ready access to the data . Our consultant also has comments on the monitoring plan . Mr. Kanter - The consultants are putting together a letter to Cornell . It reiterates the requests fo more detailed data as soon as possible . They understand why the data is not being made full available . There is a lot of data and our consultants have not had complete access to it . Councilman Klein - Are they in any violation of our agreement? Mr. Kanter - There is no timing specified in our agreement . We need to be able to have our consultants make some good judgements . Councilwoman Russell - Cornell has not completely gone through the data to make sure they are comfortable . Mr. Kanter - Our consultants were disappointed . They felt the data was not being shared . My impression of the data sharing group is that it is not the forum for the detailed data . They are almost a public relations committee . The real analysis would occur behind the scenes and our consultant would be able to get the data and scrutinize it . Councilwoman Russell - Cornell is willing to do an annual report . Our consultant is not satisfied with having to wait until the annual report . Mr. Kanter - The first step is to have our consultant follow through with the letter. Councilwoman Russell and I will be reviewing the letter. If we are not confident that we will be seeing detailed data soon , then we would have to move onto the next step . Councilwoman Russell - The summer mode is a lot higher. It flows 32 , 000 gallons per minutes . Right now they are only running it 7 , 000 gallons per minute . Mr. Walker - We have a two claims from two of the contractors on the Town Hall project . The first one is from the HVAC contractor. He has an attorney involved now . They have filed a formal notice of claim . I talked with the contractor this afternoon . They would like an opportunity to talk with myself and members of the board to see if we can work something out without going through a more formal process . The general contractor also contacted me . He was trying to be more forceful . He also wanted an opportunity to talk with me and members of the board . Would any board members be willing to meet with myself and the contractors ? We would be meeting with the contractors separately. Councilman Klein - Have you responded to them ? Mr. Walker - I have responded to them . I have included reasons to why the project was delayed , but not at fault of ours . The basis for the delay is related back to the asbestos removal and the Postal work . I spent a lot of time going back through our inspection logs . We have very detailed records of everything . We have included times , the number of persons an site . We lost a couple of weeks because of the asbestos and we leveled the floor. It did throw schedules off a little . I do not think it was beyond a reasonable level . Our windows were not on site until June 7'" . They said they could not order the windows until they measured the hales . The windows were going in the back of the building . They were new holes . The Buffalo Street ramp was not finished until June 14'" the first time . The Justices' woodwork did not arrive until June 7± . We did not get doors until July 10t" . The elevator was not replaced until June 15'" The elevator was internal , but was not delivered until May . The duct work for the attic did not have anything to do with the asbestos removal . We were generous with them by not penalizing them for running over time . The architect expressed the concern a number of times that they did not have enough people on the job . I am not sure if the board would want to pay any more for a settlement . I would have one of the architects present at the meeting . We worked closely with the architect and the contractors to make the job go smoothly . The HVAC and Plumbing contractor had his lawyer send us a letter when we were not behind on the payments . O `.G ✓] W W i r, •G' 1p r- 00 :G tp i:6 d CD Agenda Item 29c _ HIGHWAY DEPARTMENT' S MONTHLY REPORT, OCTOBER TOWN OF ITHACA TOWN BOARD MEETING, NOVEMBER 9, 2000 1- Tareyton Drive The drainage and paving project on Tareyton Drive has been completed . The residents seem to be satisfied with the results . Park Lane Storm Water Management The drainage project on Park Lane is nearing completion. We paved Park Lane with base material and re-profiled the road so that water would flow in the directions that we wanted it to . We are hoping to have good weather this fall so that we can make the final connections on this project. In the spring we will be able to topsoil and seed the affected areas . We will then put the top surfaces on Park Lane and John Street. Renwick Heights Road Three items still need to be addressed on Renwick Heights Road . There is a stone wall that is being built to protect the toe slope in Renwick Creek . We have a stone mason that we contracted to do this portion of the project. We also have contracted the realignment at the end of the sidewalk at the end of Renwick Heights Road to match the existing sidewalk . The third item that we need to attend to is to protect a fire hydrant that we disrupted during construction at the intersection of Renwick Heights Road and Renwick Drive . Town-wide Brush Pickup Brush pickup this year went very well and was accomplished in three days . The storm we had earlier in the year brought down a lot of trees and brush and we spent time then cleaning up . This probably contributed to the lower volume of brush that we had to pick up . We are working with FEMA to be reimbursed for our expenses for the storm related clean up . Renwick Drive Bridge The Renwick Drive Bridge is finally open . They have had trouble getting rustic guide rail but should have received it by the Board meeting. The bridge looks great and is more functional than the old bridge . October 3 , 2000 Meeting : Van Nederynen Two-lot Subdivision, 1485 Mecklenburg Road : The Planning Board granted Preliminary and Final Subdivision Approval for the proposed two lot subdivision at 1485 Mecklenburg Road, Town of Ithaca Tax Parcel No . 28- 1 - 1 .2 , Agricultural District. The existing 47 .35 +/- acre parcel will be divided into two parcels, one 5 +/- acres and one 42 . 35 +/- acres . Gordon Van Nederynen and Lewis Stanley Van Nederynen, Owners/Applicants ; Mark G . Modification to Cluster Buffer Setback — Lot 5 Westwood Hills Subdivision , 124 Woolf Lane : The Planning Board considered a request for modification of the cluster buffer requirements for Lot # 5 in the Westwood Hills Subdivision located at 124 Woolf Lane, Town of Ithaca Tax Parcel No . 23 - 1 - 11 . 118, Residence District R- 15 . The proposed modification would allow an above ground pool and a deck to remain within the 30 foot rear setback, and to allow the southeast corner of the house to be located 14 .4 +/- feet from the side lot line where 15 feet is required . Doris Singer, Owner; Timothy Ciaschi, Agent (former owner). The Planning Board granted a modification allowing the side yard setback to be reduced from 15 feet to the existing 14 .4 foot setback, but did not approve the modification for the rear yard buffer setback. The Board suggested that the applicant, who also owns the adjacent property to the rear of Lot 5 , convey a strip off of that parcel to add back the required buffer onto Lot 5 (which would require subdivision approval by the Planning Board) . [Note : The applicant is currently submitting an application for subdivision approval to convey a strip of land to the owner of Lot 5 .] Cornell University — Wilson Lab — Addition of Temporary Modular Offices, Route 366 : The Planning Board granted Preliminary and Final Site Plan Approval and issued an affirmative recommendation to the Zoning Board of Appeals Regarding Special Approval for the proposed addition of temporary modular facilities (until 2008) to serve the Wilson Laboratory Synchrotron, located off NYS Route 366, Town of Ithaca Tax Parcel No. 63 - 1 - 8 .2, Residential District R-30. The proposal includes construction of 7, 056 +/- square feet of temporary modular office space and the relocation of 37 parking spaces . Mr. Johnson also presented the Town with a copy of the updated UNA Inventory, which will be kept in the Tioga Conference Room/Library in Town Hall . Cornell Plantations Horticultural Center, Caldwell Road and Forest Home Drive : The Planning Board granted Preliminary and Final Site Plan Approval for the proposed renovations to the Cornell University Plantations Horticultural Center, located off of Caldwell Road and Forest Home Drive, Town of Ithaca Tax Parcel No . 67- 1 - 8, Residence District R-30 . The renovations include interior and exterior modifications to accommodate Cornell Plantations staff. No site work is planned . SEAR Reviews for Zoning Board : Six SEQR reviews for the Zoning Board were done since the October report: ( 1 ) request for approval to enlarge a non-conforming house by adding a wood deck on the rear of the building, 1431 Slaterville Road, Residence District R- 15 , Aung San, Appellant; (2) request for sign variance to change non-conforming canopy signs and equipment identification signs at East Hill Citgo, 301 Pine Tree Road, Business District " D" , Robert P . Andree, Appellant; (3 ) request for special approval for proposed addition of temporary modular office facility at Wilson Lab Synchrotron, and to extend special approval for previously approved modular facility, Dryden Road, Residence District R-30, Cornell University, Appellant; (4) request for variance to conduct retail business in Light Industrial District (property was originally developed and used for retail business), 618 Elmira Road, David Axenfeld, Appellant; ( 5 ) request for variance to maintain and expand artist studios in an accessory building (also height variance), 203 Pine Tree Road, Residence District R- 15 , Stan and Maryann Bowman, Appellants; and (6) request to enlarge a non-conforming house with the addition of a second floor, 918 East Shore Drive, Residence District R- 15 , Timothy and Linda Hinkin, Appellants . Codes and Ordinances Committee : The Committee met on October 18, 2000 . The agenda focused on a review of the site plan checklists that will be incorporated into the Zoning Ordinance . Committee members suggested a number of revisions to the existing checklists, and a new checklist for sketch plans was developed/revised . The Committee began a discussion of the residential zone chapters of the Zoning Ordinance, which will continue at the next meeting, which is scheduled for November 15 , 2000 . Capital Projects Committee : (The next meeting is scheduled for December 6th, 2000 . ) North Campus Gateway Committee : The Committee met on October 3rd and November 1st, 2000 to review additional model results and to discuss future steps necessary to advance a Gateway proposal . The Committee has agreed in concept on a number of recommendations intended to improve traffic circulation and safety in Cornell ' s North Campus area and vicinity. Recommendations include a new access road adjacent to " A" Lot connecting Pleasant Grove Road and Jessup Road, a number of intersection improvements, such as addition of stop signs and realignment at certain intersections, pedestrian safety improvements, and other enhancements . The Committee hopes to meet again in early to 2 mid January to review a draft package of recommendations, and subsequently to produce a " final " report outlining goals, recommendations and summary of impacts on the surrounding road system . Site Plan Compliance and Inspections : Recent site inspections have included Summerhill Apartments ( Summerhill Lane) and St. Catherine ' s of Siena Church — Parking Lot ( St . Catherine ' s Circle) . Newsletter: The Fall 2000 Newsletter was completed and mailed the week of October 2nd . Historic Resources Survey: The Cornell Historic Preservation class is working on the inventory of the West Hill area. One student dropped out of the class, which means there will be some properties that the class may not get to this semester. The class presentation is tentatively scheduled for Tuesday evening, December 12th (time to be determined) in the Town Board meeting room . Lake Source Cooling Monitoring — Consultant : An agreement for consulting services with Benchmark Environmental was completed and signed . Representatives from Benchmark and the Town attended the Lake Source Cooling Data Sharing Group meeting on October 30th . Benchmark will be following up with Cornell and NYS Dept. of Environmental Conservation (DEC) to check on availability of monitoring data and review and comment on the Monitoring Plan that has been submitted to DEC . TCAD Economic Development Coordinating Committee : The Director of Planning attended the quarterly meeting of the Economic Development Coordinating Committee on October 12 , 2000, and presented a summary/update of economic development related activities in the Town of Ithaca, including the PDR/Agricultural Land Preservation Program , the Zoning Ordinance revision project, and the opening of the new Town Hall in downtown Ithaca. Personnel — Planner Vacancy : Advertisements for the vacant Planner position have been circulated, and a number of resumes have been received from interested candidates . Resumes will be reviewed and screened . The next step will be to set up interviews with the most qualified candidates . Filename : l 7plan\townbd\tpreport 1100 .doc Town Board Meeting 11 /09/2000 Agenda Item Number 29 (f) Human Resources Specialist Report for October 2000 Personnel Committee : Attached are the Final minutes from the September 27th meeting of the committee . The Committee has been looking into Long Term Disability Insurance and Group Term Life Insurance as other benefits for the employees . The disability insurance would have to be paid in full by the employer without employee contribution . The life insurance could be a contributory plan but there are minimums set for employer contribution and participation . The revision of the Personnel Manual is in the process of being completed . The next step will be for -it to go on to SCLIWC' s Personnel Committee for their review . Finishing the manual has been held up some as the committee has discussed the health insurance contribution levels for retirees and for part time employees . Safetv Committee : At the last meeting the committee reviewed and edited Town Hall ' s Evacuation Plan to bring it up to date with the new facility. The group also walked through the building to look at fire exit signs and where evacuation maps should be put up . The committee also discussed Hepatitis A and B shots . It was determined that the Hepatitis A shot was the most important for Highway , Water and Sewer because of the chance of encountering human waste . Hepatitis B is encounter through blood or saliva , which there is a lower risk that Town employees would come in contact with . Wellness Program : The town ' s annual wellness fair was held on October 27th . There was a great turn out at all three locations . At the last minute that Town was also able to offer the flu shot , which previously we weren ' t going to be able to offer until November. The employees where offered for free : blood pressure screening , cholesterol screening , glucose screening , flu shot , and body fat analysis . Next month I will be able to better provide you with the total cost of offering this fair. Training and Development: The Intermunicipal Training and Development Group , which consists of the County, City and Town , has begun to develop a training curriculum for Supervisors that will focus on the development of core competencies . These include such things as ; oral communication , written communication , interpersonal skills , leadership , managing a diverse workforce , team building and many others . This training will be set up to go over 1 to 2 years with supervisor being able to pick and chose topics . ATTACHMENT # 8 Personnel — Civil Service : Advertised in October was both the Town Clerk position and the Planner position . Interviewing shall start in November. Commercial Insurance : The Ithaca Agency has sent out for quotes for 2001 coverage to five companies . In 2000 the Town paid around $42 , 000 for its commercial liability insurance . Due to a tightening insurance market the Town is looking at its largest hike in insurance rates in over the past five years . The quotes that have come back so far are in the $65 , 000 range , which is about a 54% increase for the town . From what the representatives are saying , this raise is in no reflection to our claims , but in reflection of the insurance market . Workers ' Compensation : The Town received the audit for the time period of July 1 , 1999 through June 30 , 2000 . This is when the workers' compensation company looks at actual salary and payroll numbers versus the estimated numbers that they used to bill us . From the audit the Town has to pay the difference from what was billed in June 1999 from the actual calculated cost by the audit. After careful examination of the audit , I found several errors , such as including Bolton Point employees and having others in the wrong code . The Town will be receiving a re-audit in the next week . From this re-audit the Town will then have to pay the difference to PERMA . This amount should be minor since our original audit amount was only $ 1 , 099 . 1 attended a free seminar put on by PERMA regarding investigating accidents . The main emphasis was on reducing the " Risks" involved . "Stop telling the employees to be safe , start stopping the risks . " Risks can be measured , but safety has to be judged . Identify — Predict — Decide — Execute . Disability Insurance : There is nothing new to report . Health Insurance : Open enrollment has begun for January 1 , 2001 . The Dental Insurance rates have not changed from the previous two years . The renewal contract for this will be presented to the Board at the December meeting . Michelle Bruce , Univera , was present at the Wellness Fair to discuss with the employees the changes that are going into effect for 2001 coverage . The Town currently has 3 employees who are listed on the HMO-CNY policy through Blue Cross Blue Shield . With the zip code restriction being lifted from Univera , I will be recommending to the Town Board not to renew the HMO-CNY policy for the year 2001 . The three employees have been alerted to the chance that they will not be able to continue there coverage through HMO-CNY for next year. Submitted By : Judith C . Tioga St . , Ithaca , New York , there were present : Members : Supervisor Catherine Valentino ; Dani Holford , Senior Typist ; Larry Salmi , Heavy Equipment Operator, Support Staff : Judith Drake , Human Resources Specialist . Others : Paul Tunison , General Manager, SCLIWC . Call to order: 12 :05 p . m . Agenda Item #2 : Minutes approved . Agenda Item #3 : Persons to be Heard : none . Agenda Item #4 : Discussion Long Term Disability and Life Insurance Quotes , Mrs . Drake explained the Life Insurance quotes and long -term Disability insurance quotes . (See attached sheet) The life insurance would be above and beyond the life insurance we have with New York State and Local Retirement System as an active employee . She explained that there is a death benefit with the retirement system . The death benefit for tier 1 employees is not paid after the employee retires . This would be life insurance above and beyond anything they would get through the retirement system . Mrs . Drake explained the death benefit is the annual salary at time of death times the number of years of service up to a maximum of three years would be paid out to the beneficiary . Maybe we do not need this other life insurance . $25 , 000 , to be realistic , is going to pay for some other costs that someone is not prepared to take on at the time . Mrs . Holford said she never understood how it worked with New York State Retirement System . Mrs . Drake gave the example : If you were making $20 , 000 . 00 basically you would receive $60 , 000 . 00 . Mrs . Valentino asked everyone understood the death benefit . Mrs . Holford remarked that some employees did not realize that their sick time would go to pay health insurance when they retire , therefore there might be employees who do not understand the New York State Retirement System death benefit. Mrs . Drake commented that once the Personnel Manual is finished then we should have some sessions of running back through some of the different points in the Personnel Manual that deal with the benefits . Mrs . Valentino suggested a summary sheet be made of just the benefits and then have a staff meeting to make them clearer to the employees . Mrs . Drake said FINAL FINAL FINAL that maybe it is something that could be done every year as a refresher of what is in the Personnel Manual . We should be doing that for sexual harassment and anti - harassment and those policies yearly. Mrs . Drake explained that she goes over the Personnel Manual section by section with new hires . However, someone who was hired ten years ago , there have been many changes in the Personnel Manual in that time . Returning to the discussion of life insurance , Mrs . Drake said the proposal for the insurance would be a contributory plan if we want to offer this to the employees . If they want life insurance , they would contribute toward it . There are some specifications ; the employer contribution must equal at least 25 % of the cost , at the minimum . At least 75 % of the eligible employees must enroll , which is a high percentage . These are some of the points the Committee members should consider. The Committee considered the premiums reasonable . Mrs . Valentino said the Committee should look at the policies to see what they cover and if they are good policies . Mrs . Drake said she would have to go over the policies with Mr. Gibson . Mrs . Valentino explained the Cornell University policy for life insurance for their employees . If the employee retired he or she would pay the cost themselves . Mr. Salmi stated that one of the benefits of life insurance is that there would be no health stipulations . Mrs . Drake explained that there is an age reduction . At 65 it would be at one amount and at 70 another reduction in benefit . The premium would remain the same but the amount of coverage would decline . The Committee wanted to explore the possibility of offering life insurance to the employees further. Mrs . Valentino asked Mr. Tunison if he thought SCLIWC would be interested in participating in such a program . He said he thought they might but additional disability insurance would be more important to the employees there . Mrs . Drake said that these are just some of the possibilities she has looked into . It will come back to the point Councilman Lesser made at the last meeting . "Where is the Towns and Bolton Points threshold on what is the percentage they want to pay for benefits vs . salary. " Mrs . Valentino asked what is the ratio of benefits to salaries ? Mrs . Drake said she did not know off the top of her head but thought the benefits were around 30% of our salaries . She said that 35 % is a general guideline . Mrs . Drake stated that the long term disability for active full time employees , full - time being at least 30 hours , assuming 100% contribution by the employer, would start within 90 days of the employees disability . Short time disability would cover the 90 days . She said that this would depend on the employee staying on long term disability for a period of time . Maximum monthly benefit is $3000 . 00 . The minimum monthly benefit is $ 100 . 00 . The total for the year for all employees would be $8200 . 00 , which averages out to $ 133 per employee per year. Mrs . Valentino said this depends on how good a benefit the disability policy would be . Mrs . Drake said these figures depend on 100% employer payment of the premium with minimum participation by employees being 100% . Mr. Salmi asked if we have ever had an employee that if we had had the insurance he would be covered . Mrs . Drake said we have had such an employee . Valentino asked how this effects Worker' s Comp . Mrs . Drake stated that Worker' s Comp covers on the job incidents and the long -term disability would be off the job situations . The same as our short-term disability that we have , that is state required and it pays up to a maximum of $ 170 a week . Mrs . Valentino said we would need to look at what the different levels are and how much we think our employees would actually collect . Based on our salary ranges to see if it is worth that kind of investment. Mrs . Drake said the rate would only be guaranteed for two years so as our payroll went up every two years the rate would definitely go up . She said that she just wanted to show the Committee where the numbers are coming in . She said she would get more detail from Mr. Gibson . Several companies are already offering long -term disability to their employees . Mrs . Valentino stated that she doubts the Town would want to pick up both life insurance and long -term disability . It comes down to what do the employees feel is more important to them . Or if the Town picks up the long-term disability to meet the 100% requirement , we could offer the life insurance to the employees . They would pay the premiums themselves . Mrs . Drake said one of the things that needs to done is a survey of the employees to find out what they would be interested in at different rates . Mrs . Valentino commented that it would depend on the program . If it means that the Town is paying $ 133 for each employee and they are only going to realize a small sum per month , then it would not be cost effective . Mrs . Drake stated that Mr. Gibson contacted 11 companies and got seven back . Basically they all use the same forms . She said she would talk to Mr. Gibson and get more details . Mrs . Drake stated that the Committee would have to look at the use of the long-term disability . If the Town paid premiums for ten years and it was not used it is a waste of money . The Committee discussed the Town adopting the program of self- insurance . Cornell University and the City of Ithaca are self- insured . Mr. Salmi said he would like to have Mrs . Drake investigate the self- insurance . In thinking back there were only two employees who have passed away during the period they were employed by the Town . And there was only one employee that he could recall that retired on disability . The $8200 premium would go a long way toward self- insurance . Also , contact Tompkins County and the City of Ithaca concerning pooling insurance . Mr. Tunison commented that once the municipality is in such programs , they are in them forever. Discussion of Retiree' s Health Insurance Percentages Mrs . Drake said there was one point she would like to report to the Committee . Regarding the retiree ' s going to individual plan instead of family plan . Once she talked to our Univera representative again she heard another aspect that made it not a good thing to do . The only benefit we could do would be to have their percentage , based on years of service , is applied to a family plan . It is the only thing that could be done to help the retiree who has to have a family plan . Mrs . FINAL FINAL FINAL Drake explained presently the Town only pays the percentage on the individual plan and the retiree makes up the difference for a family plan . If the percentage were paid for the retiree on a family plan it would help . The Committee discussed the options of having an individual policy , having an employee and spouse or an employee , spouse and one child or having a family policy. Mrs . Drake said that there was no justification to change from offering an individual plan and a family plan . Mrs . Valentino stated that the Committee might look at the cost of paying the percentage based on years of service for the retiree ' family plan as well as the individual plan . The Town only has retired couple that has individual plans and they both worked here . The Committee felt that it would be worth investigating . Discussion of Part-time Employees ' health Insurance Contribution Percentages Mrs . Drake said another item to be considered by the Committee is the percentage that part-time employees pay for health insurance . The policy we have in effect now is anybody that works between 18 . 75 hours and 37 . 5 pay 50% . What we are looking at is changing that to a prorated amount . Anyone is working less than half time could obtain health insurance by paying the full premium . The City of Ithaca and Tompkins County and some other towns consider 32 . 5 hours full-time . The Town has only 2 part-time employees now. We are looking at having prorated health insurance premiums for part-time employees . The Committee can think about setting another hourly amount that would be considered full -time . The reason for the Committee considering this change is because there are more people possibly wanting to work half-time positions or being able to stay at home and work split positions . Mrs . Drake said she was thinking how these policies would relate and be fair to all . Mrs . Valentino said that it would be better to propose thresholds rather than a prorated percentage . Mrs . Drake said the draft of the Personnel Manual is going slowly. Maybe she could give Bolton Point a draft 2 . Mr. Tunison said as long as they do not have to review it twice . He could present the changes from the original . At least the Bolton Point Personnel Committee could make proposals that they might like to see included in the new Personnel Manual , Mrs . Drake suggested Committee members Mrs . Holford and Mr. Salmi contact employees to find out which programs they prefer between the long-term disability and life insurance . It is a pleasure to come to work in our beautiful new facility and the graciousness of the Board for the gifts is much appreciated . Web site : Our web designer, Mike O ' Cello , has resigned . He trained Mike Smith , our Environmental Planner, lon the web design application Microsoft Front Page that the Town ' s website is built . We hope to maintain the site with his help and that of Carrie Whitmore , who transcribes the Town Board minutes . We hope to continue to add new features to the site such as projects that the Town is current involved in and highlights from this month ' s Open House , Network : Equipment rotation scheduling has begun with five Compaq Deskpro Ex PCs phasing out three year old Deskpro 4000s . The machines that are being replaced will be used in the Records Management Library and Research rooms , for the Town Justices and at the workstation which is just to the left of the entrance to the PEZ support staff area . This "floating workstation " could be used for Committee members , staff that may be working with the public and need to refer to data on the network or other needs as they arise .
