It appeared to be the consensus of the Board that the contractor
should be held liable for this expense inasmuch as the line
was not laid the necessary depth.
Town Engineer-- More than ever before it now is the contention
of the Boardthat a Town Engineer is much in need to keep in
contact with the rapid development which is now taking place
in the Town and that construction specifications and acceptable
practices are adhered to, to aid in the elimination of any
malconstruction which might prove to be detrimental to the
Town in the future. The Board members were asked to recommend
eligible candidates for this position and report at the next
meeting.

The following are minutes of a Regular Meeting of the Town
Board held in the Town of Ithaca Offices at lOo East Green
Street, City of Ithaca at 4:00 P.M. Monday, February 12, 1968.
PRESENT: Supervisor William B. Kerr, Councilmen Andrew W.
FTcElwee, Joseph N. Mayer, Jr. , and Harry N. Gordon.
ABSENT: Councilman Harry U. Baker
Also Present: Lozier Engineer James Dunlap, Attorney James
V. Buyoucos, Planning Board Chairman Noel Desch, Zoning Officer
David Cowan. Journal'Reporter Roger Langley, Clerk Myrtie Hewitt,
Major Fisher from West Hill, Mrs. Hardesty from Dryden.
RESOLUTION I87 - ACCEPTANCE OF ROADS
EASTERN HEIGHTS SUB-DIVISION
RESOLVED by the Town Board to accept roads in the Eastern
Heights sub-division more specifically known as Joanne Drive,
Regency Lane and the completed part of Eastern Heights Drive
subject to liability of Eastern Heights, Inc. to complete
roads in accordance with Town of Ithaca specifications.
BE IT FURTHER RESOLVED that the developer is hereby required
to deposit a minimum of $2000.00 in escrow to guarantee the
subject roads to be completed to the specifications set for
regulation town roads in the Town of Ithaca.

RESOLUTION I88 - WATER & SEWER LINES

Slaterville Road Sewer)
The Town Board discussed the matter of water and sewer in the
Eastern Heights subdivision and it was decided that upon
completion of all installations in all roads Eastern Heights,
Inc. would accept instrument If necessary , to confirm title
of these facilities in the Town upon the understanding that
all tests have been made and installations approved.

RESOLUTION 189 -ACBEPTANCE OF SEWER LINE
EASEMENTS
Eastern Heights3 Inc.
RESOLVED that the Town Board accepts the easement for the
sewer line from Eastern Heights, Inc. along westerly side of
lots 1 thru 6 of block 12 as shown on the map entitled "Profile
of rear lot sewer for Joanne Drive made by John S. MacNeill, Jr.,
dated January 23, I988.

RESOLUTION I9O - WATER & SEWER LINES
Eastern Heights, Inc.
RESOLVED that upon filing of a certificate by John MacNeill,Jr.
Engineer, that he has inspected and approved the installation
of sewer and water lines installed by Eastern Heights, Inc.
and has run the proper infiltration and pressure tests that
the Town upon the filing of such certificate accepts and will
maintain those portions of the sewer and water lines covered
by said certificates without further action.

RESOLUTION I9I - ADOPTION OF ZONING ORDINANCE
By resolution of the Town Board of the Town of Ithaca duly
adopted at a Regular Meeting duly called and hel on'the 12th
day of February, I988, the existing zoning ordinance was amended,
revised and as thus amended and revised was re-enacted and re-
adopted in its entirety as set forth below. Changes and
revisions of the existing Zoning Ordinance consist essentially
of Art. 1, Sec. Definition^of Family and paragraph 11,
Definition of Boarding and Rooming House, Art.IX, Site Plan
Approval, Sec. 46 and 46-a.l, Art. XIV, Sec. 75j 3^^ paragraph,
as to building permit fees. Art. XIV, Sec. 80, the requirement
of submission of Amendments to the planning Board and the
Board of Appeals for a report is omitted.

RESOLUTION 194 - VOTING MACHINES
The Board authorized that advertising for bids be placed for
two (2) new voting machines at an approximate cost of $1653.
each.

RESOLUTION 195 - MIMEOGRAPH MACHINE
RESOLVED to authorize the Clerk to place an order for a new
mimeograph machine at a state price of approximately $200.
from Duplicating Products, Inc., a local business firm.

RESOLUTION I96 - SPRUCE WAY-THAWING FROZEN WATER
LINES
VOTED resolved to authorize payments of bills for thawing water
lines in Spruce Way during January in the following amounts:
Bill Auble Construction Company $128^.00
Ames Welding 307.50
Be It Further resolved to authorize Attorney Buyoucos to
write a letter to the developer of Spruce Way, Mr. Savey or
to his attorney requesting reimbursement in the amounts
preceding since the debt was incurred by inadequate depth
installation of the water line by the developer.

Planning Board"
VOTED resolved to re-appoint Reginald Collins, 997 Taughannock
Blvd. to the Town Planning Board for a term of six years.

RESOLUTION I98 - RESOLUTION OP AWARD
SECOND SOUTH HILL WATER DIST.(I966)
WHEREAS, on January 15) 1988, bids were received for the
construction of Watermains and Appurtenances, Pumping Facilities,
Valve Vaults, and Storage Tank Foundation for the Second South
•Hill Water District (19S6)-Contract 1302-10A;
WHEREAS, the Town Board has carefully considered the Engineer's
Report on these bids, and^
WHEREAS, the Town Board has further considered the bids
received and the type of construction offered;
NOW, THEREFORE BE IT RESOLVED: that the best interests of
the Second South Hill Water District will be served by using,
on the west side of Danby Road, approximately 2,000 feet
of 6" watermain in lieu of 8" watermain, one 6" gate valve in
lieu of one 8" gate valve and deleting 4 fire hydrants and
four 6" gate valves;
AND BE IT RESOLVED, that the contract for construction be
awarded to the lowest responsible bidder: Marcelletti and Son
Construction Co.. Inc. Webster, New York at an estimated
contract sum of $380,^75.00 aJ^d Optional Items 430-0 and 431-0,
which will be used as required during construction, subject to
completion of legal requirements and expiration of applicable
time periods required with respect to the resolution increasing
the maximum amount to be expended for the construction of the
improvements in said District,

TOPICS OF DISCUSSION
Town Engineer-The Board interviewed Mr. Stanley T. Nadolski
from Cortland, New York for the position of Town Engineer. No
action was taken at this time.
Proposed Highway Master Plan--Noel Desch
Noel Desch, Chairman of the Town Planning Board presented a
projected Highway Master Plan to the Town Board for their
consideration and comments. Before scheduling a Public Hearing
to adopt the proposed map Mr. Kerr suggested it be presented
to the County Board for their comments and suggestions before
such Public Hearing be held.

RESOLUTION 199- NOTE RENEWAL-Ellis Hollow Road
Sewer District
Voted resolved that bond anticipation note heretofore executed
by the Town of Ithaca in the amount of $90^000 pursuant to
provisions of resolution authorizing construction of a Sanitary
Sewer System to serve Ellis Hollow Sewer District shall be
renewed at 3.55^ interest and the Supervisor is hereby authorized
to execute such renewal and such other instruments and take
such other steps as may be legally requested to effect such
renewal. Motion made by Councilman Mayer, seconded by Council
man Gordon that this resolution be adopted.. Duly passed.

RESOLUTION 200- SLATERVILLE ROAD SEWER DISTRICT
Final Estimate
Votfed resolved that C.N.Y. Pipeline Constructors Corporation^,
contractor for the Slaterville Road Sewer District be paid the
sum of $19^128.00 of the final gross estimate of $37^326.38
and that a 5^ retainer of the total construction figure
($3635967.57) or $18,198.38 be withheld to guarantee adjustments
and repairs in conjunction with this project to the satisfaction
of both the Engineer and the Town of Ithaca. i
