A regular meeting of the Town Board of the Town of Ithaca
was held at ^:00 Monday, August 9, 1965 in the Town Offices,
108 E. Green St., City of Ithaca,
Board members present were: Supervisor William B. Kerr,
Councilmen A. W, McElwee, Frank Bishop, Harry Baker end Joseph
Mpyer.
Also present were: B. J, Wells, Assessor; Marlon Money,
Highway Sup't.; Thomas Wiederkorn of the Greater Ithaca Regional
Planning Board and Otto Schcenfeld, Developer,
APPROVAL OF MINUTES
Councilmen Mayer offered the following resolution and
moved its adoption:
RESOLVED, that the minutes of the July"12, 1965 meeting
be approved.
Seconded by Councilman Bishop
Ayes - Kerr, Bishop, Baker, McElwee and Mayer
Noes - 0 Carried.
BOND BESOL-UTION - NORTHEAST SEWER DISTRICT
The following resolution was offered by Councilman McElwee,
who moved its adoption, seconded by Councilmen Mayer, to-wit:
BOND RESOLUTION DATED AUGUST 9, 1965.
A RESOLUTION AUTHORIZING THE CONSTRUCTION OF A SANITARY
SEWER SYSTEM TO SERVE THE NORTHEAST SEWER DISTRICT IN THE
TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK, AT A MAXIMUM
ESTIMATED COST OF $605,000., AND AUTHORIZING THE ISSUANCE
OF $605,000. SERIAL BONDS OF SAID TOWN TO PAY THE COST
THEREOF,
WHEREAS, by proceedings heretofore duly had and taken
pursuant to Article 12 of the Town Law, the Town Board of the
Town of Ithaca, Tompkins County, New York, has duly established
the Northeast Sewer District in said Town; and
V/HEHEAS, it is now desired to authorize the construction of
a sewer system to serve said Sewer District and to provide for
the financing thereof in accordance with said proceedings; NOW,
THERE BE IT RESOLVED, by the Town Board of the Town of Ithaca,
Tompkins County, New York, as follows:
Section 1. The construction of a sanitary sewer system to
serve the Northeast Sewer District in the Town of Ithaca, Tompkins
County, New York, substantially in accordance with the map and
plan accompanying the petition for said District, is hereby
authorized at a maximum estimated cost of $605,000.
Section 2. The plan for the financing of such maximum
estimated cost is by the issuance of $605,000. serial bonds of
said Town, hereby authorized to be issued therefor pursuant to the
Local Finance Law.
Section 8. It is hereby determined that the period of
probable usefulness of the aforesaid specific object or purpose
is thirty years, pursuant to subdivision ^ of paragraph a of
Sectionll.OO of.the Local Finance Law. It is hereby further
determined that the maximum maturity of the serial bonds
herein authorized will exceed five years.
Section The faith and credit of said Town of Ithaca,
Tompkins County, New York, are hereby irrevocably pledged to the
payment of the principal of and interest on such bonds as the
same become due and payable. There shall be annually apportioned
and assessed upon the several lots and parcels of land within
said Northeast Sewer District which the Town Board shall determine
and specify to be especially benefited by the improvement, an
amount sufficient to pay the principal and interest on said bonds
as the same become due, but if not paid from such source, all the
taxable real propoerty in said Town shall be subject to the levy
of ad valorem taxes without limitation as to rate or amount
sufficient to pay the principal of and interest on said bonds

as the same shall "become due.
Section Subject to the provisions of the Local Finance
Law, the power to authorize the Issuance of and to sell bond
anticipation notes In anticipation of the issuance and sale of
the serial bonds herein authorized, including renewals of such
notes, is hereby delegated to the Supervisor, the chief fiscal
officer. Such notes shall be of such terms, ftrm" and contents,
and shall be sold in such manner, as may be prescribed by said
Supervisor, consistent with ^he provisions of the Local Finance
Law,
Section 6. The validity of such bonds may be contested only
if:
1) Such bonds are authorized for an object or purpose for
which said Town is not authorized to expend money, or
2) The provisions of law which should be complied with at
the date of publication of this resolution are not substantially
complied with, and an action, suit or proceeding contesting such
validity is commenced within twenty days after the date of such
publication, or
3) Such bonds are authorized in violation of the provisions
of the Constitution.
Section 7 This resolution, which takes effect immediately,
shall be published in full in the ITHACA JOURNAL, the official
newspaper of said Town, together with a notice of the Town Clerk
in substantially the form provided in Section 81.00 of the Local
Finance Law.
The question of the adoption of the foregoing resolution was
duly put to a vote on roll call, which resulted as follows:

Councilman McElwee voting Aye
Councilman Mayer voting Aye
Councilman Baker voting Aye
Councilman Bishop voting Aye
The resolution was thereupon declared duly adopted.
PROPOSAL FOB A GENERAL PLAN FROM REGIONAL PLANNING BOARD
Thomas Niederkorn of the Regional Planning Board was present
to propose to the Town Board a study that would give a general
overall development plan for the town. He stated that requests
are coming in for recommendations regarding recreation areas,
sub-division plans and overall development plans. He feels that
the town needs a general comprehensive plan at this time.
Supervisor Kerr stated that he felt the sub-division re
gulations of the town are defective and that there were problems
in drainage in some areas; also that park areas needed to be set
aside, but that the Town Board recognized these problems and
would not benefit as much from money spent on an overall plan
as they might from spending the money on roads etc.
Mr. Niederkorn said that the overall plan would update maps,
show where roads should go and give developers guide lines.
Councilman McElwee felt that studies showing population densities
and areas that should be set aside for commercial developments
(especially in the southern part of the town) would be useful.
Councilman Bishop stated that he was in favor of planning and
felt that an overall plan for the future would be worthwhile.
Councilman ^§yir* stated that he'd like to have all of the in
formation now at hand compiled and evaluated before more is
done. Councilman Baker felt that the topography of the town
is such that developers should file plans for approval and
at that time the Board could decide whether or not the plan was
OK for the area.
Councilman McElwee proposed that the idea of a general
overall plan be referred to the Town Planning Board for their
recommendations and then be reconsidered by the Town Board.
ROADS - NORTHEAST AREA
Correspondence from Cayuga Heights Fire Chief Roger A. Morse
celled attention to the condition of roads in the Northeast area
of the town; particularly Salem Drive. Supervisor Kerr stated
that the next year's highway budget would include money to rebuild
roads in that area.
WALKWAY - NE SCHOOL
Highway Sup't. Morey reported that the road to the new

Northeast School had been topped and an extra width added to
accomodate a walkway. It was recommended that a White line be
painted to divide the walk and the road.
PARK AREAS ABOUND WATER TANKS
Supervisor Kerr recommended that the Park Committee give
thought to the idea of using the area around water tanks as
picnic and playground areas.
NEW WATER AND SEWER DISTRICTS
Lozier's has reported that the proportioning of costs in
the proposed new water and sewer districts is still in question
and it is expected that descriptions of the districts will be
prepared and submitted at a later meeting.
ESSEWD - TELEKETER ^
The Board authorized the Supervisor to proceed vjith the
purchase and installation of a telemeter for the East State Street
Extension Water District tank off Pine Tree Road,
PUBLIC HEARINGS SCHEDULED - ANENDMENTS TO ZONING ORDINANCE
Councilman Bishop offered the following resolution and
moved its adoption:
RESOLVED, that the Town Board hold public hearings at
^:15 P.M. and at ^:30 P.M. on Monday, Sept, 13, 1965 in the
Town Offices, 3nd Floor, 108 E. Green St., City of Ithaca,
for the purpose of hearing all persons interested in the
following changes in the Zoning Ordinance:
1. Article XIII - Section 59, Pf?ge 23
Change Sub a. to read as follows:
a. One mobile home may be placed on a vacant lot in a
residence or agriculture district for use as temporary
housing during the construction of a permanent dwelling
on said lot for a period not to exceed 18 months, unless
such'period be extended by permission of the Town Board,
provided that said trailer shall be occupied by the owner
of record of said lot. Said trailer must be removed ^
upon the completion of construction althoufrh the l8 [
month time limit may not have fully expired.
2. Article XIII - Section 70, page 25
Delete the following after the word "with", line 1, page 25^
"the construction of improvements on the lot or of"
Add at the end of Section:
"Any normal building operation in connection with a
legal building permit, such as excavation, filling, or
grading, shall be excepted from the provisions of this
Section,"
Seconded by Councilman Mayer

BUILDING INSPECTOR
The Town Board suggested that other communities be contacted
to find out what steps are taken to assure that construction is
built according to State Building Codes. The Town of Ithaca now
requires a statement to be signed when a building permit is
issued stating that the Building Code will be followed, but no
follow through is made.

NESD - CONTRACT WITH VILLAGE
Supervisor Kerr reported that the sewer contract for the
Northeast Sewer District would be considered at the meeting of
the Village of Cayuga Heights Board on Thursday, Aug. 12, 1965.
EMPLOYEES' RETIREMENT
Changes in law allows suspension of member contributions to
the State Retirement system and makes the employer liable for
an amount that will provide the benefits heretofore payable from
members' contributions. The Board felt the contributory plan
best and took no action.

ESTIMATED COSTS IN RENWICK HEIGHTS SEWER DISTHICT
nr. FrRnk Llguorl of the Tompklns County Health Department
requested an estimate of the operating expenses in the Renwick
Heights Sewer District so that application could be made to the
state for partial reimbursement.
Supervisor Kerr offered the following resolution and moved
its adoption:
RFSCIVED, that Supervisor Kerr be authorised to submit an
advance estimate of operation and maintenance costs associated
with the Renwick Heights Sewer District located in the Town of
Ithaca and
BE IT FURTHER RESOLVED that such estimate be for the year
1/1/65 tp 12/31/65 based on the actual costs of the district
for the fiscal year 196^.

WARRANT
Councilman Mayer offered the following resolution and moved
its adoption:
RESOLVED, that General Fund Bills #29^ through #32? in the
amount of |2,906.58 end Highway Fund Bills #233 through #261 in
the amount of $5,188.39 be paid.

REIMBURSEMENT - SOUTH HILL WATER DISTRICT
Councilman Mayer offered the following resolution and moved
its adoption:
WHEREAS, this board is informed that an error was made in
the 1965 Special District Assessment Roll for the SHWD, namely;
PARCEL 52-1-25 was erroneously assessed for 136 feet of
frontage and 1+1 units; whereas the charge should have been for
100 feet of frontage and one unit only, now
THEREFORE BE IT RESOLVED that $22,60 be reimbursed to
William Savey, owner of parcel 52-1-25.

. APPOINTMENT - CROSSING GUARD
Councilman McElwee offered the following resolution and
moved its adoption:
RESOLVED that Shirley Wilkinson of 53? Warren Road be
appointed as crossing guard to replace Mrs. Jean Firestone.
She will guard the crossing nearest the new Northeast School

NEW PICKUP TRUCK
Councilman McElwee offered the following resolution and moved
its adoption:
RESOLVED, that Highway Superintendent Marlon Morey be
authorized to drew up specifications and advertise for bids for
a new pick-up truck for the highway department.

SIGNING OF WATER PERMIT BLANKS AND ISSUANCE OF EXCAVATION PERMITS
Councilman Bishop offered the following resolution end moved
its adoption:
RESOLVED, that Mrs. Jane Ames, Sec'y. be authorized to sign
water pemlt application blanks for Supervisor Kerr, and that Mrs,
Evelyn Fuess, Town Clerk be authorized to issue Highway Excavation
Permits.
Seconded by Councilman Mayer

Noes - 0 Carried.
