Green St., City of Ithaca. Board memters present were: Supervisor William B. Kerr, Councilman Harry Baker, Councilman A.W. McElwee, Councilman Frank Bishop, and Councilman Joseph N. I^ayer, Jr. Also present were: Attorney James Buyoucos, Highway Sup't. Harion Horey, Assessor B. J. Wells, Engineer James Dunlap, Mrs. Mclellan, Mrs. Smith, Mr. Beese and other residents of the north east interested in sidewalks. APPRCVAI. OF MINUTES Councilman Bishop offered the following resolution and moved its adoption: BESCLVFD, that the minutes of the May 10, 19^5 town hoard meeting be approved. Seconded by Councilman Mayer Ayes - Kerr, Mayer, Bishop end Baker Moes - 0 Carried. Councilman McFlwee arrived. RKSOIUTION - BOBHOWING AGAINST CFRTTFICATFS OF DEPOSIT Supervisor Kerr explained that when state aid payments are late it sometimes becomes necessary to borrow against funds the town has deposited in certificates of deposit. Councilman Mayer offered the following resolution and moved its adoption: RESOLVED, that the Supervisor be authorized to borrow money against certificates of deposit up to the amount of the outstanding deposits, providing that it is first determined whether it is more economical to borrow than to cash the cert ificate of deposit. ■Seconded by Councilman McElwee Ayes - Kerr, McElwee, Baker, Bishop end Mayer Noes - 0 Carried. EXTENSTOW OF WATER LINE TO ROY COMPTOW PROPERTY Supervisor Kerr offered the following resolution and moved its adoption: WHEREAS, a written petition, dated October 5> 19^4 was presented to the Town Board for the extension of the South Hill Water District to Include the Hoy Compton property on Rich Road and WHEREAS, a Public Hearing on such extension was held on November 9, 1964, at which time the Supervisor was authorized to enter into and execute a contract with the City of Ithaca providing for water service to the said district herein established upon payment of all fees end expenses by Roy Comp ton, the Petitioner, and WHEREAS, the City of Ithaca now needs written approval of such extension, now therefore BE IT RESOLVED, that such approval be sent to Mr. Vincent P. Hannan, Ass't, Sup't. of Public Works, City of Ithaca. Seconded by Councilman Mayer Ayes - Kerr, Mayer, Baker, McElwee, and Bishop. Noes - 0 Carried ROAD NEAR NORTHEAST SCHOOL Councilman McElwee offered the following resolution and moved its adoption: RESOLVED, that on approval of Mr, Marion Money, Sup't*. of Highways, the five hundred dollars ($500.) deposited by Mr. Otto Schoenfeld for the construction of Wlnthrop Dr. near the new northeast school be returned to Mr. Schoenfeld, Seconded by Supervisor Kerr Ayes - Kerr, McElwee, Bishop, Baker and Mayer Noes - 0 Carried 22 n WALKWAY NFAR NORTHKAST SCHOOL Councilman McElwee offered the following resolution end moved its adoption: RESOLVED, that the town will undertake from the general fund to build a walkway for 500 feet more or less within the road right of way on the wouth side of Wlnthrop Dr. from Warren Road to the new shcool with the understanding that the school district construct the remaining walkway across school property to connect with the walk entering from Christopher Circle. Seconded by Councilman Bishop Ayes - Kerr, Baker, Bishop, Mayer and McElwee Moes - 0 Carried A group of citizens from the northeast area were present to ask the board to donsider taking action now to acquire land across Cornell property (north of Tareyton Rd., Muriel Street area) and across Schoenfeld property, so that eventually children might be able to walk to the school by this route. USE OF CITY ZFROX MACHINE Councilman McElwee offered the following resolution and moved its adoption: WHEREAS, the City of Ithaca has at the present time a Zerox Copier located in the City Clerk's office and WHEREAS, the City has agreed to make available to the Town of Ithaca the use of this copier at a llO.OO per month minimum fee (any charge over this amount at the rate of 7^ a copy up to 500 and a copy in excess of 500), now therefore BE IT RESOLVED, that the Town agrees to pay the City of Ithaca for the use of this Zerox copier for a one year period beginning June 1, 1965. Seconded by Councilman Mayer Ayes - Kerr, Mayer, Bishop, McElwee and Baker Noes - 0 Carried. | j INCREASED INSURANCE COVERAGE - HIGHWAY AND COY GLEN BLPGS. TheRbbert Eoothroyd Agency notified the town that a recent appraisal indicated that the Highway Bldg. should be raised by $2,580, end the Coy Glen Bldg, should be Increased by ^^120, The annual increase in premlms is ^15.00. Council man McElwee offered the following resolution end moved its adoption: RESOLVED, that the Eoothroyd agency be advised that the Town Board desires the extra coverage on the Highway and Coy Glen Buildings that they have recommended. Seconded by Councilman Mayer Ayes - Kerr, Mayer, Baker, Bishop and McElwee Noes - 0 Carried. BESOT.UTICN - WITHDRAWAt. FROM COUNTY INSURANCE PLAN Supervisor Kerr stated that the Town Board must notify the County during June if they wish to withdraw from the County Compensation Insurance Plan. A private carrier has given the town board an estimate of |1296.71 per year for coverage. It has been estimated that the Increase in County tax might amount to .'JZOO. per year, but the board felt the saving over the present cost of ^{6ll0.05 per year was substantial. Councilman McElwee offered the following resolution and moved its adoption: RESOLVED, that Supervisor Kerr be authorized to notify the Tompkins County Board of Supervisors that effective Jan. 1, 1966, the Town of Ithaca intends to withdraw from the County Workmen's Compensation Plan and BE IT FURTHER RESOLVED, that negotiations be made for coverage from a local insurance carrier. AWARDING OF BID FOR NORTHEAST SE^^^ER DISTRICT Councilman McElwee offered the following resolution and moved Its adoption: WHEREAS, on May 3, 1965, bids were received for the Construction of Sanitary Sewers for the Northeqst Sewer District; WHEREAS, the Town Board has carefully considered the " Engineer's Report on these bids, and; WHEREAS, the Town Board has further considered the bids received: NOW, THEREFORE BE IT RESOLVED; that the contract for construction be awarded to the lowest responsible bidder Howard & Sprague, Inc., at an estimated contract sum of $356,930-00 and that specification Pages l-c-4(X), l-C-4.l(X) and 1-C-4,2(X) dated June 7, 1965 replace Pages 1-C-^(R)(X) and 1-C-^»1(X) In the contract documents* Seconded by Supervisor Kerr Ayes - Baker, Mayer, Bishop, McElwee and Kerr Noes - 0 Carried. PUBLIC HEARING - LOCAL LAW ^2 Supervisor Kerr offered the following resolution and moved Its adoption: HESOLVED, that a Public Hearing be held at ^:15 P.M., Monday, July 12, 1965 In the Town Offices, 3rd Floor, 108 E, Green St., City of Ithaca to hear all persons Intereste In the adoption of Local Law #2, which In general will be an ordinance to regulate excavations within any town highway. BE IT FURTHER RESOLVED, that the steps as set forth In Local law #1 be followed for the adoption of this local law. Seconded by Councilman Baker Ayes - Kerr, Baker, Bishop, Mayer and McElwee Noes - 0 Carried. NORTHEAST SEWER DISTRICT - CONTRACT WITH THE VILLAGE A letter from Mr. Roger Sovocool, Attorney for the Village of Cayuga Heights Indicated that agreement has been reached In the matter of a contract between the town and village for sewage disposal except for the consideration of the policy of hook-on. There were questions raised as to an ordinance to control hook- on, and also the saving of space on the line for later hook-on. Supervisor Kerr feels that the new sewer ordinance now being considered would be the fairest method. The requirements as set forth in that ordinance would probably require that all new construction hook on Immediately, any residence with a septic system breakdown would be required to hook on, and all residences would be connected by 10 years. It was the sense of the board that It v/ould not be right to charge for reserving space on the line for later possible use. The Supervisor was authorized by the Board to confer with Mr. Sovocool In regards to these matters. WARRANT Councilman Bishop offered the following resolution and moved Its adoption; RESOLVED, that the General Fund Bills #218 through #2^8 In the amount of $2^,^83-21 and Highway Fund Bills #157 through #186 In the amount of $9,^13-22 be paid. Attention was called to bill #2^2, a bill from the N.Y, Telephone Co. for $56.55- Included In the bill were toll calls totaling $16.90 for calls made by the Census Supervisor while she was working out of this office on census taking In Dryden, Lansing and Candor, It was suggested that the Census Bureau be contacted to try to collect this amount of the bill. Seconded by Councilman Mayer. Ayes - Kerr, Mayer, Baker, McElwee and Bishop Noes - 0 Carried. PUBLIC HEARINGS - NEW WATER AND SEWER DISTRICTS Mr. James Dunlap of Lozler, Inc. was present to show the board maps they had prepared for the proposed water and sewer districts In the Northwest and South Hill areas of the town and the sewer districts In the Slatervllle Rd., Pine Tree Rd., Snyder Hill and Honness Lane areas of the town. Description of the districts will be prepared for the July meeting and public hearings ordered at that time. BRIDGE REPAIR - FOREST HOME DRIVE Councilman McElwee stated that the plans of the State call for the widening of the bridges on Forest Home Drive. He felt that before any plans are finalized, the Planning Board, Town Board and area residents should meet to voice recommendations for n n ADVERTISI'^G FOB BID - SAND AND GRAVEL Councllrasn T'lcElwee offered the following resolution and moved Its adoption: RESOLVED, that Nr. Narlon Norey, Highway Sup*t. be authorized to draw up specifications for sand and gravel and to advertise for bids for the same. Seconded by Councilman Bishop Ayes - Kerr, Baker, Bishop, Mayer and McElwee Noes - 0 Carried. APPOINTMENT TO PLANNING BOARD Councilman Bishop offered the following resolution and moved its adoption: RESOLVED, that Walter Schwan of l6 Muriel Street be appointed to replace Mr. Gordon Waring on the Town of Ithaca Planning Board for a term to expire 12/31/65. This resolution is subject to a permissive referendum pursuant to the provision of Article 7 of the Town Law. The Town Clerk Is hereby authorized to take all necessary steps to comply with said article. Seconded by Councilman Baker Ayes - Kerr, Baker, Bishop, Mayer and McElwee Noes - 0 Carried 24 FINAL OHDEB ESTABLISHING DISTRICT - ELT.TS HnT.T.nw ROAD SEWEE Councilmsn ycElwee offered the following resolution and moved its adoption: WHERFAS a map, plan and report relating to the establish ment of the proposed Ellis Hollow Road Sev;er District, prepared by competent engineers, duly licensed by the State of New York, was duly presented to and filed with the Town Board an Order was duly adopted by the Town Board on the 8th day of January, 1965 for the hearing of all persons interested in the matter on the 15th day of February, 1965, at ^:3C DfClock F.N. on that day at the City Council Room of the City Hall in the City of Ithaca, Tompkins County, New York, and a hearing by said Board having been duly held at such time and place and it having been duly resolved and determined, on the 15th day of February, 1965, following such hearing that the Notice of Hearing was published and posted as required by lew and was otherwise sufficient and that all the property and property owners within the proposed district were benefited thereby, and that all of the property and property owners benefited are Included within the limits of the district end that the establishment of such district was in the public interest and it having been further resolved and determined that the establishment of a sewer district as set forth in the aforesaid map, plan and report as approved, and that the improvement therein mentioned be constructed, and the boundaries of the district having been then and there finally determined and set forth and described In the said Resolution, and it having been further resolved that said Resolution was subject to a permissive referendum as provided in Section 209-e of the Town Law, and application having been thereafter and on the 17th day of February, 1965i duly made in duplicate to the State Department of Audit and Control 6t Albany, New York, for permission to create such district as more fully provided for by Article 12-A of the Town Law, and the State Comptroller having duly made an order in duplicate dated April 9, 1965. granting permission for the creation of the district; and one copy of such order having been duly filed in the office of the State Department of Audit and Control at Albany, New York, and the other in the office of the Town Clerk of this Town, and the Town Clerk having duly presented such order to this Board at its first meeting held after the said order was filed with him, end it further appearing that within ten days after the adoption by the Town Board of the aforesaid Resolution the Town Clerk caused a Notice of said Resolution to be posted and published in the manner provided for by Section 90 of the Town Law which Notice contained the date of the adoption of the Resolution, and a copy of .such Resolution, and which Notice specified that such Resolution was adopted subject to a per missive referendum, and it further appearing that more than thirty days have expired since the adoption of the aforesaid Resolution, and that no petition subscribed and acknowledged by any person or persons qualified to vote upon the proposition has been filed with the Town Clerk and the Town Clerk having filed a certificate stating such fact In the Office of the Tompkins County Clerk and in the Office of the Department of Audit and Control at Albany, New York, it is hereby ORDERED, that a sewer district be established in the said Town of Ithaca, Tompkins County, New York as described in the order of the State Comptroller aforesaid, to be designated as the Ellis Hollow Road Sewer District of the Town of Ithaca, Tompkins County, New York, and it is further ORDERED, that the maximum amount proposed to be expended for the said improvement and for the acquisition of the necessary lands and easements is Ninety Thousand Dollars (190,000,00) and it is further ORDERFD, that the said district be of the following description and boundaries, to wit: ALL THAT TRACT OR PARCEL OF LAND situate, lying and being In the Town of Ithaca, Tompkins County, New York, more pa-rtlcu- larly bounded and described as follows: Beginning at a point, said point being the Intersection of the centerline of Mitchell Street and the east corporation line of the City of Ithaca; (1) thence, northerly along the east corporation line of n n the area. Supervisor Kerr was authorized to contact State officials to determine what plans had been made, and Councilman McElwee was authorized to contact Cornell University officials for their suggestions. ADJOURNMENT Councilman Baker offered the motion for adjournment at 6:50 P.M. Seconded by Supervisor Kerr Ayes - Kerr, McElwee, Baker, Bishop and Mayer Noes - 0 Carried. The Supervisor's monthly report was submitted and filed. Evelyn S. Puess, Town Clerk OPENING OF BIDS FOR SAND AND GRAVEL Bids submlteed for sand and gravel were opened on June 16, 1965 at 2:00 P.M. One bid was submitted from Landstrom Sand and Gravel Co., RD 1, Mewfield, N.v., 1486?. The bid was as follows: Clean bank run gravel - P^r cu, yd. Crushed bank run gravel -•'^1.25 per cu. yd.
