HomeMy WebLinkAboutTB Minutes 1965-05-10Kay 10, 1965 The regular meeting of the Town Hoard of the Town of Ithaca was held Konday, May 10, 1965 at ^:00 P.M. in the Town Offices, 108 E. Green St., City of Ithaca, Board members present were: Supervisor William B. Kerr, Councilmen Frank Bishop, Joseph Mayer, Harry Baker, and Andrew W. McElwee. Also present were: Attorney James Buyoucos, Highway Sup't, Marion Moray, Assessor H. J. Wells, James Dunlap and Mrs. E. McLellan. APPROVAL OF MINUTES Councilman Mayer offered the following resolution and moved its adoption: RESOLVFD, that the minutes of the April 12, I965 meeting be approved. Seconded by Councilman Baker Ayes - Kerr, Baker, Mayer and Bishop Noes - 0 Carried LIGHTING COHTRACT Mr. James Lacy of the New York State Electric and Gas. Corp. was present to present the street lighting contract for the street lighting at the intersection of the new state Route #13 and Route #3^ In the Town of Ithaca. This includes the lighting to be installed by the State and approved by the Town Board at the October 5» 1962 meeting of the board plus six additional lights on Lake Shore Drive and North CayUga St. Extension. The total annual cost to the town will be !ft2,585-00. Councilman Bishop offered the following resolution and moved its adoption: RESOLVED, that the written contract submitted by the New York State Electric and Gas Corporation for lighting the streets end public places of the Town of Ithaca, dated May 10, 1965, be, and the same hereby is, approved, and that the Supervisor and the Clerk of this Board be, and they hereby are, authorized, empowered and directed to execute the same in the name and in behalf of the Town of Ithaca. Seconded by Councilman Mayer Ayes - Kerr, Bishop, Baker and Mayer Noes - 0 Carried. LOCAL LAW #1 A public hearing was held at 4:15 P.M. to hear all persons interested in the adoption of Local Law #1. Noone was present to be heard and the hearing was closed. Councilman Mayer offered the following resolution and moved its adoption: RESOLVED, that the following be adopted as Local Law #1 of the Town of Ithaca: A local lew providing for public notices relating to adoption of local laws. Be it enacted by the town board of the town of Ithaca as follows: Section 1. No local law shall be adopted by the town board of the Town of Ithaca until a public hearing has been held there on in its final form before such board not less than three nor more than thirty days after public notice has been given of the time and- place of the holding of such public hearing. Such notice shall be given by the town clerk by causing the same to be published once in the official newspaper of the town. Such notice shall contain the title of the proposed local lew and a brief explanatory statement thereof. Section 2. The town clerk shell cause to be printed or otherwise reproduced copies of such proposed local law and shall, not later than the day such notice is published, post one copy together with the notice of hearing in a conspicuous place in his office and shall also make copies of such proposed local law available at his office for inspection by and distribution to any interested person during business hours. n 19 Section 3« Th© town clerk shall forthwith upon the adoption of a. local law by the board post a copy thereof In a conspicuous place In his office and shall, within ten days after such adoption, cSuse the local law, or an abstract thereof describing the same In general terms, to be published In the official newspaper of the town. Section k. Proof of publication of the notice of public hearing required by section one hereof and proof of the posting and publication required by section three hereof shall be filed In the office of the town clerk. Section Each local law shall be numbered consecutively beginning with number one for each calender year. When a local law Is finally adopted, and certified copies thereof are required by section twenty-seven of the municipal home rule law to be filed in the offices of town clerk, the state comptroller and the secretary of state, the town clerk shall accordingly assign to such local lew Its appropriate number. Section 6. This local law shall take effect immediately. Seconded by Councilman Bishop Ayes - Kerr, Bishop, Wayer and Baker Noes - 0 Carried NORTHEAST SEWER DISTRICT BIDS The apparent low bidder on the Northeast Sewer District is Howard and Sprague of Blnghamton, N.Y. The board delayed the awarding of the bid until the June 7th meeting so that details In regards to Insurance coverage could be worked out. SEWER CONTRACT WITH VILLAGE The board authorized Mr, Kerr and Attorney Buyoucos to consult with Attorney Roger Sovocool to discuss the contract between the town and the village for the northeast sewer district, COMPENSATION INSURANCE The Boothroyd Insurance Company notified the town that they could provide Compensation Insurance for the employees for a total sum of §1,296.71 a year, A decision whether to stay with the County plan or withdrew will be made at the June meeting. The board took no action on a request from Mr. Ivor Hanson of Carey Insurance Co, that he be allowed to participate in the distribution of commissions oh the Board of Education In surance coverage. They felt this request should be made direct ly to the Boothroyd Agency, Councilman McElwee arrived. ROAD FROM WARREN ROAD TO MURIEL STREET Supervisor Kerr explained to the Board that a possibility of opening a street to connect Warren Road and Muriel Street had been considered when It was known that the Kubota house at 206 Muriel St, was for sale. To make room for a road this house would have to be moved and also land would have to be obtained from the Murray property on Warren Rd. The estimate received from the Dexhelmer Company for moving the Kubota house - was §5000, and the board felt the cost might be prohibitive. No further action was taken at this time. CORRESPONDENCE Letters from the State Traffic Commission Indicated that the requests for studies of speed restrictions In the Renwlck Heights and the Pine Tree Road area had been received. Investigations will be conducted in the near future, WARRANT Councilman Mayer offered the following resolution and moved Its adoption: RESOLVED, that the Highway Fund Bills #128 through #156 In the amount of 2^^3.88 and the General Fund Bills #l66 through 20 #217 In the amount of §7,574.73 be paid. Seconded by Councilman Baker Ayes - Baker, WcElwee, Bishop, Wayer and Kerr Noes - 0 Carried. The Supervisor's monthly report was submitted and filed. The meeting was adjourned at 5:45 P.M. Evelyn S, Fuess Town Clerk n BIDS SUBMITTED - NORTHEAST SEWER The bids for the construction of the Sanitary Sewer System for the Northeast Sewer District, Town of Ithaca were opened at 2:00 P.M. May 3» 1965 in the Town Clerk's Office, 3rd Floor, 108 E. Green St., City of Ithaca, N.Y. Present were: Supervisor Wm. B, Kerr, Councilman Harry Baker, James Dunlap and Wm, O'Boyle from Lozier's Inc. and representatives from the companies submitting bids.
