TOWN OF ITHACA
TOWN BOARD HINUTES
JANUARY 8, 1965
The organization meeting of the Town Board of the Town of Ithaca
was held on Friday, January 8, 1965 in the Town Office, 3nd Floor,
108 E. Green St., City of Ithaca.
Board members present were: Supervisor William E. Kerr, Council-
men Frank Bishop and Andrew W. NcElwee.
Also present were: Highway Superintendent Marion Morey, Assessor
Robert J. Wells, Attorney James Buyoucos.
APPOINTMENTS
Councilman Bishop offered the following resolution and moved its
adoption:
RESOLVED, that Roger Sovocool be appointed to the Zoning Board of
Appeals for a four year term.
Seconded by Supervisor Kerr

Noes - 0 Carried
Supervisor Kerr offered the following resolution and moved Its
adoration:
RESOT,VFD, that Mr. James Buyoucos be appointed as Attorney for
the Tovm for the year 1965.
Seconded by Councilman McFlwee
Ayes - Kerr, McFlwee and Bishop
Noes - 0 Carried.
Mr. Loran Marion, in a letter written to the board, requested that
someone be appointed to replace him as member of the Town Planning
Board. Mr. Marion's term expired Dec. 31, 196^, Mo decision was
! ; reached as to a successor.
No eppointmen+was made to fill the vacancy of Town Engineer,

Councilman ?''cElwee offered the following resolution and moved its
adoption:
RESOLVED, that the Ithaca Journal be designated as the official
Town newspaper for the year 1965,

Councilman McFlwee offered the following resolution and moved its
adoption:
RESOLVED, that the Supervisor shall submit to the Town Clerk within60 days after the close of the fiscal year a copy of his report to
the State Comptroller; and be it further RESOLVED, that a summary
of this report be published in the Ithaca Journal,

OPENING OF COMPETITIVE BIDS
Supervisor Kerr offered the following resolution and moved its
adoption:
RESOLVED, that the Town Clerk be authorized to open competitive
bids on public works and purchase contracts required to be
advertised by law.

PURCHASES TO -^500. - HIGHWAY DEPARTMENT
Councilman Bishop offered the following resolution and moved
its adoption:
RFSCIVFD, that the Highway Superintendent be authorized to make
purchases up to '^500. for tools and small supplies.

FIXING OF SALARIES
Supervisor Kerr offered the following resolution and moved Its

SPEED LIMIT CHANGES
Notices from the State Traffic Commission notified the Board of
changes in speed limits as follows:
1) Establishment of a ^0 MPH speed limit on Lake Road, Route 3^>
between Station 0 (northerly City Line) on SH ^5^ ^nd Station 11
(0.2 miles north of Cayuga Street Extension) on SH 1330, a
distance of 0,8 miles.
Z) Repeals the 25 MPH speed limit on that portion of Triphammer
Road, a county road, outside of the Village of Cayuga Heights,
between the northerly Ithaca city line and the easterly projection
of the northerly Cayuga Heights village line, a distance of 0.8
miles.

PUBLIC HEARING - ELLIS HOLLOW ROAD SEWER DISTRICT
Supervisor Kerr offered the following resolution and moved Its
adoption:
RESOLVED, that a Public Hearing on the Ellis Hollow Sewer District
be held in the Common Council Room, Ithaca City Hall, 108 E.
Green St., Ithaca at 4:30 P.M. on Monday, February 15i 1965-
RE5CLUTI0N AND ORDER
In the Katter of the Establishmetib of the Ellis Hollow Road
Sewer District in the Town of Ithaca, County of Tompklns, State
of New York, pursuant to Article 12-A of the Town Law
WHEREAS a map, plan and report have been prepared, In
such manner and in such detail as has heretofore been
determined by the Town Board, relating- to the establishment
of a Sewer district in the Kitchell Street Extension - Ellis
Hollow-Judd Falls area of said Town, and
WHEREAS, such map, plan, and report have been duly filed
in the Town Clerk's Office in said Town; and
WHEREAS said map, plan, and report were prepared by Lozier
Engineers, Inc., competent engineers, duly licensed by the
State of Mew "Vork, showing the boundaries of the proposed
p* district, a general plan of the sewer facilities bo be con
structed, and a report of the proposed method of operation;

WHEREAS said map shows all outlets and the terminus and
course of each proposed main sewer, together with the location
and a generel description of all public works required in
cluding such lands and easements, if any, to be acquired, and
WHEREAS the boundaries of the proposed district are more
particularly set forth and described hereinafter in Schedule
A, and
WHEREAS the improvements proposed consist of the construct
ion and installation of sewer mains, sewer laterals, manholes
and appurtenances for the purpose of supplying a public sewer
system to the properties in the proposed district, and which
system shall be connected with and drain into the City of Ithaca
sewer system; and
WHEREAS the proposed method of financing the cost of said
improvement consists of the Issuance of serial bonds of said
Town to mature in annual installments over a period not exceed
ing thirty (30) years. The cost of constructing the foregoing
improvements shall be assessed- by the Town Board in proportion
as nearly as may be to the benefit which each lot or parcel will
derive therefrom, and
WHEREAS the maximum amount proposed to be expended for said
improvement and for the acquisition of the necessary lands and
^ easements is NINETY THOUSAND DCLIARS, (^90,000.00) and
n WHEREAS said map, plan and report describing said Improve-
' ment are on file in the Town Clerk's Office, for public inspect
ion,
NOW, on motion of Supervisor Kerr, and seconded by Council
man Bishop, it is hereby
ORDERED that the Town Board of the Town of Ithaca shall
meet and hold a public hearing at 108 E. Green St., City Hall
Common Council Room in the City of Ithaca, on the 15th day of
February, 1965 st 4:30 P.F. on that day, to consider said
map, plan, and report, and to hear all persons interested in
the subject thereof concerning the same, and to take such
action thereon as is required or authorized by law.
The adoption of the foregoing order was duly put to a
vote and upon roll call, the vote was as follows:

Franklin C. Bishop, Councilman voting aye
Andrew W. EcElwee, Councilman voting aye
The order was thereupon duly adopted.

Ellis Hollow Road Sewer District
Town of Ithaca, Tompklns County, New York
1 ALL THAT TRACT OR PARCEI OP lAND situate, lying and being
' in the Town of Ithaca, Tompklns County, New York more particularly
bounded and described as follows:
Beginning at a point, said point being the intersection of
the centerllne of Mitchell Street and the east corporation line
of the City of Ithaca;
(1) thence, northerly along the east corporation line of
the City of Ithaca a distance of 1^5 feet, more or less, to
a point lying in the westerly extension of the north boundary of
parcel 59-1-3;
(2) thence, easterly along aforesaid extension and the
north boundary of parcel 59-1-3 snd parcel 59-1-2 a distance
of 329 feet, more or less, to the northeast corner of parcel
59-1-2;
(3) thence, southerly along the east boundary of parcel
59-1-2 a distance of 138 feet, more or less, to the north
right-of-way line of Ellis Hollow Road;
(4) thence, easterly along the northe right-of-way line
of Ellis Hollow Road a distance of 1,^29 feet, more or less,
to the southwest corner of parcel 62-1-1;
(5) thence, northerly along the west boundary of parcel
62-1-1 a distance of ^26 feet, more or less, to the northwest
corner of parcel 62-1-1;
(6) thence, easterly along the north boundary of parcel

to the centerline of Judd Falls Road;
(7) thence, northerly along the centerline of Judd Falls
Road a distance of 460 feet, more or less, to a point being
the centerline intersection with Eaple Avenue;
(8) thence, easterly along a line parallel to the south
boundary of parcel 63-1-3 3 distance of 1,590 feet, more or less,
to a point lying in the east boundary of parcel 63-1-3;
(8a)thence, southerly along the east boundary of parcel
63-1-3 s distance of 470 feet, more or less, to the southeast
corner of parcel 63-1-3;
(8b) thence, easterly along the north boundary of parcel
62-2-1 a distance of 259 feet, more or less, to the northeast
corner of parcel 62-2-1;
(9) thence, southerly along the east boundary of parcel
62-2-1 and parcel 6l-l-2 a distance of 1,473 feet, more or less
to a point being 150 feet southerly of and measured at right
angles to the centerline of Ellis Hollow Road;
(10) thence, westerly along a line parallel to, 150 south
of and measured at right angles to the centerline of Ellis
Hollow Road a distance of 1,920 feet, more or less, to a point
lying in the south boundary of parcel 6O-I-6;
(11) thence, westerly along the south boundary of parcel
60-1-6 a distance of 490 feet, more or less, to the south
west corner of parcel 60-I-6;
(12) thence, northerly along the WFst boundary of parcel
6O-I-6 a distance of 300 feet, more or less, to the centerline
of an unnamed drainage course;
(13) thence, westerly along the various courses of the
centerline of the unnamed drainage course a distance of 1,200
feet, more or less, to a point lying in the east boundary of
parcel 59-2-18;
(14) thence, southerly along the east boundary of parcel
59-2-18 and parcel 59-2-19 s distance of 257 feet, more or less,
to the southeast corner of parcel 59-2-19;
(15) thence, westerly along the south boundary of parcel
59-2-19 end westerly extension thereof a distance of 657 feet,
more or less, to a. point lying ih the east corporation line of
the City of Ithaca;
(16) thence, northerly along the east corporation line of
the City of Ithaca a distance of 935 feet, more or less, to the
point of beginning;
All as shown on a map of the proposed Ellis Hollow Road
Sewer District as prepared by Lozier, Engineers, Inc. dated
October 2, 1964, and revised October 13, 1964, drawing number
12763; 3nd said parcel numbers referring to Tax Hap, Town of
Ithaca, Tompkins County, approved by State Board of Equalization
and Assessment, Harch 27, 1964, tax maps dated II/I/63.
PUBLIC HEARING - SOUTH HILL REZONIHG
Councilman HcFlwee offered the following resolution and
moved its adoption:
RFSOLVFD, that a Public Hearing be held at 5:00 P.H. on
Honday, February 15, 1965 in the Common Council Room, City
Hall,"108 F. Green St. to hear all persons interested In the
proposed rezoning of a 29 acre tract located east of the Danby
Road and north of King Road Fast. The proposed rezoning of

subject parcel to include one section ^5^ f'eet by 550 feet to
be rezoned from residential to Business "C" and the balance of
the tract to be rezoned from residential to multiple residence.
The description is as follows:
"Being all that tract or parcel of property shown as parcel
^3-1-2, with exception, on the Tax Kaps of the Town of Ithaca,
filed in the office of said town, and being more particularly
described as follows: Beginning at a point located approximately
1165 feet scaled northerly from the intersection of the c/l of
the Danby Road and the c/l of the King Road Fast and proceeding
easterly a distance of 1200 feet to o point scaled to a point and
thence northerly approximately parallel to the c/l of the Danby
Road, a distance of approximately 1200 feet to a point and thence
westerly approximately 1157 feet scaled to a point in the c/l of
Danby Road and thence southerly along the c/l of the Danby Road
a distance of 1250 feet scaled to the point or place of beginning.
Subject parcel being bounded north, east and south by remaining
lands of H. Koni^eyer and on the west by the Danby Road."

Councilman Bishop offered the following resolution and
moved its adoption:
RFSOLVFD, that Highway Fund Bills through #399 snd
#1 through #28 in the amount of .§5^^0.00 be paid, and General
Fund Bills #^93 through ^^02 and #l through BkO (with the
exception of #1?) in the amount of $^386.65 be paid, (Bill
#17 in the General Fund was for the rent of a Safety Deposit
Box, which the Board feels is not now necessary with the vault
available in the new office)

PARKING SPACE
Assessor R. J. Wells asked and received permission to
spend money from his budget to pay for a perking space in a
city parking lot, if such space is available.
FEBRUARY NEETING
The regular meeting in February will be held on Fonday
February 15, since many of the Town Officials will be attending
the Association of Towns meeting in New York City on February
8,9 snd 10.
Supervisor Kerr's monthly report was submitted and filed.
The meeting was adjourned at 6:05 P.N.

APPROVAL OF XINUTFS
The minutes of Town Board meetings are mimeographed and
mailed to each Town Board member as well as to the Planning
Board and Zoning Board members. V.hen the minutes of a meeting
indicate that previous minutes have been approved it means
that they are approved as mimeographed and mailed. The
minutes as they appear in this minute book are copies of the
mimeographed minutes.
