At a regular meeting of the Town Board of the Town of Ithaca , Tompkins County, New York , held at the Town Hall , 215 North Tioga Street , there were present : PRESENT: Catherine Valentino , Supervisor; Mary Russell , Board Member ; Carolyn Grigorov, Board Member; David Klein , Board Member; Bill Lesser, Board Member; Tom Niederkorn , Board Member. Call to Order: The Supervisor called the meeting to order at 5 : 33 p . m . , and led the assemblage in the Pledge of Allegiance . Supervisor Valentino — I thought it would be appropriate , as with ships , to christen this building tonight as Ithaca Town Hall . Forevermore , it should never be referred to again as the "Old Post Office". The Town Board and Department Heads enjoyed a toast of sparkling grape juice to honor the first Town Board meeting held in the new Town Hall. Supervisor Valentino — I would like to thank Mr. Walker for all the hours he put in helping us put this project together. I would also like to thank Mrs. Noteboom . She had us very organized during our move to the new facility. We were able to find our files and start serving the community quickly. I would also like to thank Mrs. Drake for the time she spent organizing our security system and other relevant systems . Ms . Titti also deserves special recognition for the work she put in on our computers and networking . I have been proud of our entire staff . Many, many times they have worked very hard , they are - productive and give me the information I need when going to meetings and making presentations . They know what I am talking about . Their efforts help the Town of Ithaca have a good standing with other municipalities because of their work . I was never prouder of our staff than I was during our TOWN BOARD PAGE 2 AUGUST 7, 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED move . Every employee put forth -great effort in getting us moved . They did whatever had to be do to get us here without complaints . We are fortunate to have such an outstanding staff" . Councilman Lesser — I would like to recognize Supervisor Valentino for having the vision to seeing that this was possible , and to see the transformation of this building into a fine Town Hall . Agenda Item No 4 — Report of Fire Commissioners : Bob Romanowski , Ithaca Fire Commissioners - I would like to congratulate the Town on the new facility. It is a great way to start the new century. The review of the Ithaca Fire Department 2001 budget proposal will take place at the Board of Fire Commissioners regular monthly meeting , Tuesday, August 8t' . The department has been asked to submit various budget scenarios , and to submit negative three percent and zero percent increases . Both would require layoffs or specific cuts . We will submit our special budget with provisions that cope with reality. The Fire Department has a website with an address of www. ifd@baka . com . The site has been updated with new information , graphics and the general appearance . This year we are discussing having a " Medal Day". The concept includes presenting all significa fire department awards on the same day. it will provide a greater opportunity to focus on t significance of the achievement of fire department personnel . The event would be held the same d as the fire department Memorial Service at the City Cemetery on the Saturday ending Fire Preventio Week, (October 14" There are some people who have gone "out of their way" to serve Ithaca and the Town of Ithaca . I think this "Medal Day ' is appropriate . We need to dedicate an entire day to memorial services and presentation of awards to deserving people . The City Disaster Plan resolution has gone to the County Board to redefine the Tompkins County Emergency Management Group . The County Communications and 911 program are progressing slowly. There have been many roadblocks . The Ithaca Fire Department position statement regarding the 800- megahertz communication system appears on the website . The Fire Department' s position as to street blockages is that such actions interfere with direct and timely actions to providing emergency service to affected areas . It jeopardizes the safety and well being of some of our citizens . I talked with Supervisor Valentino regarding an unexpected truck purchase for about $300 . 00 There would be substantial savingsn in ordering it now. The timing is such that the price w guaranteed if order before August 16 It is a much lower price than normally charged . TOWN BOARD PAGE 3 AUGUST 7, 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED Due to factory scheduling , delivery will not be for another 1 . 5 years . Bonding and provisions will be on a seven year schedule . The Ithaca Common Council unanimously passed a resolution approving the purchase without discussion . Supervisor Valentino — Under our agreement with the City, any capital expenditure in excess of $25 , 000 has to be approved by the Town Board . Mr. Romanowski — Payment for the truck will not be due for at least one year. Supervisor Valentino — The City is going to bond the expense of the truck . Their rationale is that ordering now gives them substantial savings . They were able to get an agreement when they purchased two fire trucks last year that they could purchase another fire truck this year at the same price . According to City figures it will save over $52 , 000 by purchasing the truck at this time . There is a truck in the fleet that needs to be replaced . Mr. Romanowski — The truck needing replacement is a 1972 pumper. The body is failing apart even though the pump mechanism still works . The purchase of this new truck is necessary. We will save about 16% , Supervisor Valentino has the detailed information . Supervisor Valentino — I will pass the information to board members for their review . We can consider a resolution later in the meeting after they review the information . I did not receive the information until this afternoon . Councilman Lesser —What is the 7 year replacement cycle ? Mr. Romanowski — We have a replacement cycle for equipment depending upon the life span of the equipment. Some are longer than 7 years . The small squad cars are on a smaller replacement basis . This area is hard on large pieces of equipment which have to travel up and down the hills . Keeping the equipment in working order is a maintenance intensive process . Councilman Niederkorn — Has the fire department practiced around the road barriers? Do they know how they will get around them if there is a fire in certain locations? Mr. Romanowski — If there is an emergency in that area it necessitates finding out which side the barrier is on . Then they have to figure out a route that is most efficient . It is one of the reasons why public safety should come first . The Fire Department agreed to a 90- day trial with the barriers in place . It is beyond the 90-day trial . The Fire Department 's position is that it is something that should be addressed . There should be alternatives . It takes an extra 2 or 3 minutes to go around the barriers , and that could be too late . Other Business : Supervisor Valentino — Kevin Kauffman sent a thank you note to staff and board members for the `sympathy card sent to him upon the passing of his son . TOWN BOARD PAGE 4 AUGUST 7 , 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED I would also like to thank Mr. Carvill for his hard work helping us to keep on track of our expenses f . the new Town Hall . 1 should have mentioned it earlier. The move to the new facility was a great team effort . Additional Agenda Item No 1 — Modification to Easement at 114 West King Road : Henry Theisen , 34 Clinton House — Thank you for putting this issue on the agenda with such short notice . We are under pressure to have a closing , which we cannot have until we resolve the easement . This is a matter of a sewer pipe underground across the property. When my client bought the property, there was no recorded easement. She did not know that there was an underground sewer pipe when she bought the property in 1972 . In 1988 , they built an addition to the house and still did not know about the sewer pipe at that time. It was not discovered that the sewer pipe existed until recently. The surveyor showed that it was present . I have discussed this with Attorney Barney and would like to ask that the Town agree that if anything happens with the sewer pipe , such that it needs to be repaired , instead of excavating the pipe that it be relocated around the house . Until that point in time , the owner of the house would not take any action to ask that the pipe be removed . Attorney Barney — I have talked with Mr. Walker and there is a sewer line under the house . The was an easement that was not recorded . Mr. Theisen 's suggestion would be a reasonab accommodation to the situation . It was unclear if this could be done without affecting the use of the line . The grade might be a problem . Mr . Walker — I think that we could work around it . We could still get a minimal grade . Attorney Barney — The proposed resolution authorizes the Town Supervisor and the Town Engineer to execute a modified easement . It would allow the pipe to be maintained in its current location until such time as it needs to be moved . The easement would be granted to move the line 20 feet east . Mr . Theisen — The new location should have a provision that should it become necessary to excavate the pipe that the Town restore the ground to its former standard . Councilman Klein — If we had to move the pipe would we need an easement from the neighbors ? Attorney Barney — The GEIS map looks as if the deck is on the property next door . The rest of the map suggests that there is about 12 feet between the corner of the deck and the property line . It would be adequate to put a line in . The line would run along the property line . It would be a narrow area . Councilman Klein — Is that a reasonable engineering practice? TOWN BOARD PAGE 5 AUGUST 7, 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED Mr. Walker — We could get it around the deck . We would have to put a manhole on the corner of the turn . It would not be a problem . Councilman Klein — How deep is the pipe? Mr. Walker — The pipe in the area is about 9 feet deep . We would not remove the existing pipe . There is a 95% chance that we will not have to touch the pipe . If we had to replace it , we would realign it and work from the ends . I do not think that we would be excavating the pipe . Councilman Lesser — In the language it states , "temporary easement with the continued existence of a pipeline under the house" . Who determines when the temporary ends? Attorney Barney — I think we can modify it to state that it remains as long as there is no need to deal with the pipe . I do not think we would need to dig further into the ground . I would like to add to the fifth resolved , " if it becomes necessary to repair or replace the sewer line , the Town would absorb all expense" . This sewer line was done as part of the South Hill Sewer Project. It was the basis for the consolidation of all sewer and water districts in the Town of Ithaca . It was estimated at one level . When the bids came in , because of the rock and expense , the individual assessments would have been astronomical . In the excitement of trying to deal with the issue of value and cost some of the easements were not filed . Resolution No. 112 - Modification to Easement 114 West Kinq Road. WHEREAS, the Town of Ithaca received an easement for the installation of a sewer line from Clayton Poole dated April 10, 1968 relating to a sewer line across premises known generally as 114 West King Road, Ithaca, New York; and WHEREAS, the sewer line for which the easement was obtained was indeed installed across the property; and WHEREAS, it now appears that the written easement itself was not recorded in the Tompkins County Clerk's Office; and WHEREAS, subsequent to the installation of the sewer line the house located on 114 West King Road was, in 1988, expanded pursuant to a Building Permit issued by the Town of Ithaca, which addition was constructed over the sewer line unbeknownst to the then owners of the property; and WHEREAS, this situation has recently come to the attention of the owner of the property who has requested that because of the failure to record the easement, the Town modify the easement by agreeing to move the sewer pipe if necessary in the future; and TOWN BOARD PAGE 6 AUGUST 7 , 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED WHEREAS, the Town is willing to agree to such modification, NOW, THEREFORE, it is hereby RESOLVED, that the Town Board of the Town of Ithaca agree to the modification of the easement relating to the sewer line on 114 West King Road, such modification to consist of the granting of a permanent easement for the pipeline as laid outside the bounds of the house, a temporary easement for the continued existence of the pipeline under the house, and an agreement on the part of the Town that should it become necessary to do so to repair or replace the sewer line the Town would, in the future, at the Town 's expense, relocate the portion of the line under the house approximately 20 feet eastward so that the line would be physically outside the foundation for the house and the deck, all as shown on a map entitled "Map of Survey No. 114 West King Road, Town of Ithaca, Tompkins County, New York " dated July 8, 2000 made by Robert S. Russler, Jr. ; and it is further RESOLVED, that the Town Supervisor and Director of Engineering are each authorized to execute such agreements or modifications to easements as either of them may deem necessary or appropriate, in consultation with the Attorney for the Town, to effectuate the intent of the foregoing resolution. Agenda Item No 12 — Resolution of Appreciation to James Ainslie, Former Planninq Board Member : See Attachment # 1 . Supervisor Valentino — He was a valuable member of the Planning Board . His point of view will be greatly missed . Resolution No. 113 - RESOLUTION OF APPRECIATION TO JAMES AINSLIE. WHEREAS, JAMES AINSLiE was appointed to the Town of Ithaca Planning Board effective May 10, 1993, and has served continuously on the Board since that date; and WHEREAS, Mr. Ainslie has chosen to retire from further service as Member of the Planning Board effective June 30, 2000; and TOWN BOARD PAGE 7 AUGUST 7, 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED WHEREAS, during many of those years Mr. Ainslie was designated specifically as the representative of Agricultural interests on the Board; and WHEREAS, during his more than seven years of service, Mr. Ainslie has demonstrated an ability to balance the needs of the Town with the needs of development applicants, has intelligently and capably utilized and applied the planning processes of the Town; has ably represented the point of view of those citizens of the Town involved in agricultural pursuits as well as the general citizenry as a whole, and has, with wisdom and wit diligently attended to the business of the Planning Board in all its ramifications to the Town and its citizens; and WHEREAS, the Town of Ithaca is indebted to Mr. Ainslie for his outstanding service as a Planning Board Member and wishes to express its appreciation to him for his service; NOW, THEREFORE, BE IT RESOLVED that the Town Board of the Town of Ithaca, on behalf of the Town, its citizens and residents, expresses its sincere gratitude to James Ainslie for his diligent and exemplary service to our community. Adopted Unanimously this 7th day of August, 2000. enda item No. 13 — intermunici al Recreation Partnership Program : Supervisor Valentino — I am pleased with the proposed agreement . This is truly a partnership that is not completely dependent upon the City of Ithaca Youth Bureau . It makes it open to being able to look at other providers , and being cost effective. Everyone has spent a great deal of time and effort to bring this together. Councilwoman Russell and I would like a vote of approval on the agreement so that we can move forward with our other partners . Councilwoman Russell — We are looking for an increased contribution from the County in this proposal . Supervisor Valentino — We are hopeful that this will go through . It brings the County in as a real partner, as it should be. It does not increase the contribution of the Town of Ithaca . Councilman Klein — It states , "for 2001 the Recreational Planning Group recommends that the $ 185 , 000 in net operating costs of programs be split four ways . The Town of Ithaca would contribute one quarter of the cost . The City would contribute one quarter and the County would contribute one quarter. The smaller municipalities would share the cost of one quarter". upervisor Valentina — We currently give close to $ 160 , 000 . After we pay the program cost , the alance of it for this year will offset the cost of the facilities . The City, Town and County will look to TOWN BOARD PAGE 8 AUGUST 7 , 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED hire a consultant to evaluate the facilities and help us make them cost effective . The Town ' s shar would be $5 , 000 . It is an increase over what we spent before . This group spent a lot of time looking at the facilities before we reached this agreement . We have a lot of good background information . We narrowed the scope of what a consultant would have to do . A consultant would be a great service to the community. Councilman Lesser — Are the expenditures ongoing costs that do not cover most of the facilities? Supervisor Valentino — This proposal adds up to $ 185 , 000 . It covers the programs run by the Recreation Partnership . It also includes some of the facilities cost and administration . Councilman Lesser — Does it include routine maintenance of facilities , but not major replacements? Supervisor Valentino — Correct . It does not include capital costs . The Partnership decided that we needed to separate program costs from capital costs . We needed to look at the programs and what they cost. Then we would hire a consultant to look at the facilities to determine what we need to do from there . We have traditionally paid towards the facilities . It works out that almost half of the participants ar from the Town of Ithaca . We did not want to see the facilities shut down . It would be an over increase of $5 , 000 , if the County is willing to help with the consultant . Councilman Niederkorn — What is the position of the smaller municipalities ? Supervisor Valentino — The Town of Caroline is part of the agreement . Danby is looking at the agreement favorably. We have discussed this at the Municipal Officers' Association . We have a good feeling that the other municipalities are looking at this favorably. Councilwoman Russell — We worked hard to make sure that this was what they wanted . We are hopeful that they will support it . We are also communicating with the Town of Lansing in hopes that they will look favorably on joining the Partnership . Supervisor Valentino — The Town of Lansing and the Town of Newfield are the only two municipalities that do not belong to the Partnership . The Town of Lansing is beginning to talk about it . They seem to be leaning towards joining the Partnership . There has been some interest expressed from Newfield that we have not heard before . It would be a wonderful thing if we could get every municipality to join . Councilman Niederkorn — The Town of Dryden has made contributions , but have their Supervisor or Board members participated ? TOWN BOARD PAGE 9 AUGUST 7 , 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED Supervisor Valentino — Their Town Clerk has been at the meetings on a regular basis . She has kept them informed . Their Supervisor has been at the Tompkins County Municipal Officers' Association meetings . Resolution No. 114 - Approval of Proposal for Recreation Partnership Program WHEREAS, Catherine Valentino, Town Supervisor and Mary Russell, Councilwoman have presented a proposal entitled the RECREATION PARTNERSHIP, A Proposal for the Future drafted by the Inter-Municipal Recreation Planning Group to the Town Board for their review and consideration of approval; and it WHEREAS, the Town Board has discussed and reviewed the said proposal; now therefore be RESOLVED, that the Town Board of the Town of Ithaca hereby approves the terms and conditions outlined in the said RECREATION PARTNERSHIP, A Proposal for the future. MOVED Councilwoman Grigorov, SECONDED Councilwoman Russell, a vote on the motion resulted as follows: Supervisor Valentino, aye, Councilwoman Russell, aye; Councilwoman. Agenda Item No. 14 - Purchase of Audio/Recording Equipment for Town Hall • Mr. Walker - The board had a proposal from a local retailer in the packet . It is about $5 , 000 less than the other proposal . They have looked at the site . We can save some money with the microphones as we have more floor stands for the microphones than we first thought . We could get the price down to about $8 , 000. Supervisor Valentino - I think that this would be an adequate system . Councilman Klein - We will have wall cabinets and speakers mounted on the wall . Could you describe the system ? Mr. Walker - We will have microphones similar to the microphones on the stands . Part of cabling will go through trays under the tables . The cables will run under the floor to the back corner. The cabinet will be a steel cabinet with its back permanently attached to the wall . It can be opened from the front door to access the controls . The entire cabinet can be opened to access the wiring . The wiring will come up through the conduit , through the baseboard and into the cabinet. It will not be visible . The speaker wires will run along the top of the windowsill and be out of sight . TOWN BOARD PAGE 10 AUGUST 7 , 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED The architectural feature on the wall of the board room does limit placement of the speakers . Th proposal is to have two speakers facing the court . The only microphone wire will be leading out to the public microphone . The amplifier on the courtside will sit in a cabinet behind the clerk station . There will be four microphone jacks installed in the base of the judges' bench . A microphone wire will be at each table . A microphone jack will serve the witness area . Another microphone wire will serve the jury area . Councilman Klein — Will the recording system tie into it? Mr. Walker — Yes . We are looking at a shelf under the table or small unit that would sit on the table . We can use the same tape recorders . Councilman Klein — What about the assisted listening devices? Mr. Walker — If we have to provide them there will an output on the amplifiers . Councilman Klein — Mr. Frost , are we required to have assisted listening devices? Mr. Frost — They have to be available . They do not need to be permanent in the room . Mrs . Mr. Walker — Yes . I have been getting the documentation together. Agenda Item No. 16 — Apply for Grant for Agricultural Land Preservation Program : Mr. Kanter — There was a proposed resolution in the packet . We have a short time frame as grant applications are due August 31st. We are not sure which property will be included in the application . We have put the worse case scenario money amount in the resolution . We would like the board to authorize applying for the grant in an amount not to exceed $276 , 375 in State funds . Our local share would be $92 , 925 . The local share can include cash contributions , as well as " in kind" contributions . We are working on what properties would be included , but it is likely it will be less than this amount . The amount in the resolution would include seven parcels totaling 458 acres of land . Supervisor Valentino — Does this include all the properties we have appraisals for? Mr. Kanter — No . There are several other options looked at that would include different combinations . They are less than the worse case money scenario . Councilman Lesser — What is the likelihood of getting the grant? Are the numbers based on the assessed evaluations? Mr. Kanter — For most of the properties the numbers are based on appraisals that have been completed . There has not been an appraisal on one property that one was based on assessed value . We also factored in the 10% escalated cost . It will take time for the State program to be set up . It would then be another year before the purchases happened . This year the State program is not requiring completed appraisals in order to qualify. The appraisal on many of the properties which have not been done can be done later. The likelihood of obtaining the grant is hard to determine . Grants are going to be very competitive . There are a number of communities in the state that are beginning to participate in the program . We have received good feedback from state officials , and they have encouraged us to apply. Councilman Niederkorn — What kind of flexibility is built into this ? Could the money be spent on one parcel ? Are we limited to what we apply for and not go beyond that? Mr. Kanter — We will be limited to what we applied for, and to the specific properties . The state will inspect the properties . The state will be approving it based on their evaluation and criteria . They also look at the overall plan . Councilman Niederkorn — Do we have farmers willing to sell acreage for a certain amount of money? Councilman Lesser — At one point someone mentioned additional funding from a foundation and a non -public source . Is that progressing ? Is that an aspect of this proposal ? Mr. Kanter — That issue is progressing separately. We are . hesitant to include it within the terms of local matching funds. We do not know if it will be successful . We would be able to use it in conjunction or separately from this application . There is close to $83 , 000 in our reserve fund for this program . Councilwoman Russell — Could we count the donations as part of the 25% local match ? Mr. Kanter — We could count it towards this 25 % local match , or use it for future applications . Mr. Carvill — Does the amount of our reserve funding strengthen the potential of our getting th grant? Mr. Kanter — Yes . Supervisor Valentino — It shows our ability to be able to move forward . Mr. Carvill — Within the 2000 budget there is $25 , 000 appropriated . If the board would like to increase the reserve then this might be the appropriate time to take action . Mr. Kanter — I think that we have sufficient funds in the reserve for the current application . We could wait later in the year to transfer other monies . Supervisor Valentino — I think we can wait . We do not need to strengthen this proposal at this point . Councilwoman Russell — We do have a gap . The amount quoted is $92 , 000. The amount in the reserve is $82 , 000 . Is that a problem ? Mr. Kanter — It would be including the most number of properties . We can add in the grant budget the staff time and legal fees . Resolution No. 118 - AUTHORIZATION TO APPLY FOR STATE GRANT FOR AGRICULTURAL LAND PRESERVATION PROGRAM. I think that it is based on a form resolution that the State Retirement system sends out with their announcement that it is available . It is an election by the Town to offer it . It is an election by the employee if they choose to take it . It is relatively descriptive . Councilman Lesser - Does this give Town employees an option as made available by the State? Attorney Barney - The State has adopted an opportunity for employees to get one month 's additional credit of service for each year they have been employed if they elect to retire. The previous test was that you would have to show that the person would be replaced by someone whose salary would cost no more than 50% of the salary of the person who is retiring . Mrs . Drake - The Town has to show that they can save 50% over two years with this program . Councilman Lesser - Is it being done to extend benefit to our employees ? in some cases it can be a benefit to the employer. Mrs . Drake - It does give a benefit to the employee if they opt to retire . They can earn up to 3 years more credit . Someone with 27 years of service could retire at 30 years without having an _v reduction . It is also a benefit to the Town . The Town pays the cost of the extra benefit . It ca be paid in a lump sum or over a five year period . Councilman Klein — Do we know what our potential expenditure is? Mrs. Drake — There is one Highway employee who is looking at it seriously. Otherwise , we would not have brought it before the board . Councilman Klein — Will this have a saving to the Town ? Mrs . Drake — It is based on a percentage of his final average salary. We have an option of paying it in one lump sum or over five years . if he does not retire now because of the incentive , he is likely to retire next year. We are giving him the opportunity to retire between October and December with the opportunity to get three more years of service . Supervisor Valentino — Is he a longtime employee? Mr. Noteboom — He has worked for the Town since 1988 . He has been in the system much longer. He worked for Cornell for 24 years . He has over 30 years service . Councilman Klein — If he takes the early retirement there is a cost to the Town . Supervisor Valentino — We would be able to hire an entry- level person at considerably less than wh this person was making . We have always offered this benefit to our employees . Attorney Barney — I do not think that the cost is a large amount . The percentages of the payroll are about 1 %. The three year benefit might be 3 to 4% of his pay. Mrs . Drake — We think that it will cost the Town between $ 10 , 000 and $ 15 , 000 . Mr . Carvill — Historically, for a former employee we have paid an average of $ 18 , 000 to capture the years of service for the early retirement benefit . Mrs . Drake — That particular person had a much higher salary . It would not be paid until we pay our annual bill in December of 2001 . Councilman Lesser — Does it work by whoever this individual is employed by at the time of retirement picks up the amount of the twelve years of service? Would Cornell contribute? Attorney Barney — The Town would pick up the amount of the incentive . Cornell has already contributed . Supervisor Valentino — I do not have a problem with adopting this . We hire at entry level salaries th people who replace people who take advantage of the early retirement incentive . Kanter — Materials were included in the packet . We asked the consultant to submit a proposal , and they did so in a timely manner. The total services they are proposing to provided would be covered by the $50 , 000 that Cornell is paying the Town . The proposal looks exactly like what we talked about at the interview. Supervisor Valentino — The Committee is recommending that we hire Benchmark Environmental Engineering , Mr. Kanter — The only condition in the resolution is that we need to give Cornell the opportunity to interview and talk with our perspective consultant before we hire them , but Cornell can only make recommendations to us about the consultant . Councilman Klein — They do not have a right to reject the consultant . Mr. Kanter — Our consultant does not have a right to reject the Cornell monitoring plan . This is on an advisory basis and a courtesy to Cornell . Councilman Lesser — Does this layout an appropriate three year objective? Mr. Kanter — Yes . It is a five year agenda . Years four and five are very minor. Years one and thre are the most important years of monitoring . I am comfortable with the proposal as it is outlined . would use this as a basis for drawing up the contract with them . Councilman Klein — What kind of contract do we have to enter into? Mr. Kanter — We need to enter into a consultant contract. Councilman Klein — They have requested a $5 , 000 retainer. Attorney Barney — When we dealt with the University we needed to have the money in hand so we could disperse it out . Mr . Kanter — At the interview, Benchmark indicated that they would be billing on a quarterly basis based on hours they worked during the past quarter. They also indicated that they would be willing not to submit an invoice until after we have had Cornell 's initial deposit into our escrow account . Councilman Lesser — If the project survives the three year hurdle , is it likely to be permitted into the indefinite future? Mr. Kanter — Yes . That is one alternative . Attorney Barney — It is a five year renewable permit . Mr . Kanter — The permit expires in March 2003 . The permit was issued before the project started . We have not signed the contract . If we get negative feedback from Cornell after their review of the consultant , we are not bound to hire the consultant . Attorney Barney — We do not want to sign the contract until we have feedback from Cornell . Mr. Kanter — We would provide Cornell with the same materials that we received . WHEREAS, the Town of Ithaca and Cornell University entered into an agreement in a letter dated June 10, 1998, whereby Cornell University will reimburse the Town up to $50, 000 towards the costs of a consultant/scientist chosen by the Town to provide an independent review of the impacts of the operation of the Lake Source Cooling system on the Cayuga Lake water quality; and WHEREAS, the Town of Ithaca now desires to hire a consultant to provide the above- described services, and has circulated a Request for Qualifications from interested consulting firms and scientists. and WHEREAS, the Town has received qualifications statements from several potentially qualified consulting firms, and based on those statements, has conducted an interview with Benchmark Environmental Engineering & Science, located in Buffalo, N. Carried unanimous'!y. The board took a brief recess from 7: 10 p. m, until 7.35 p. m. Agenda Item No. 15 Cont' d : Mr. Walker — Change orders 1 , 29 3 and 4 have been approved and paid . Change order 5 is listed separately because it is the structural foundation for the Buffalo Street ramp . It is a large number. It did not include the fact that the contractor replaced the wall twice . It was their mistake . We are not paying for it . Change order 6 is the re-working of the east wall . The masonry metal on line 8 is the back wall of the workroom . The wall between the loading dock and workroom did not have enough detail . There was additional work that needed to be done once they stripped the existing material . We had to put new lintels in . As they dismantled some items , they found there was not active support for the doorways that were being installed . We had to rebuild the structures . The mezzanine wall is the mechanical mezzanine room that is Over the conference room and offices on the side wall . It called for an additional wall between our mechanical space and the Post Office space . This space is above the Post Office space . The wall between the two spaces is made of 518" sheet rock on both sides . We added a third wall in the space . We extended the wall down to the end of the building 20 feet , and added a door. The architects did not take into account that we had an extension toward the elevator shaft that was not required . This gave better functionality and had a reduction in the cost . They had to build abo half as much wall . ., TOWN BOARD PAGE 23 AUGUST 7 , 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPROVED The access ladder to the mezzanine is a protective ladder in the hallway. There are no provisions for a permanent ladder in the contract . Access to the area is not frequent , but we do have our rooftop unit that is accessed through the mezzanine to a roof hatch . It has shut down twice in the last two weeks because of power outages , and we have had to reset it . The roof deck replacement and additional work are extensions of roofing that was bad along the parapet wall that we had to replace . The cost is less than what we would have paid for a unit price . As part of the agreement with the Post Office , they are paying for part of the sidewalk replacement because it was bad before we bought the building . We realigned the stone gutter and flashing of the stumpers on the existing part of the building . The detail proposed was not going to work. Upon inspection of the gutters , everything was in good shape . We decided not to incur additional cost for a change order because the detail was not going to work right . It was about twice the amount the architect estimated . There were a number of items needing additional finishing work . The windows were tipped at odd angles. The contract called for them to be repainted . It did not call for them to be reset or for trim work to make sure they closed tightly. Supervisor Valentino — It looked unfinished without the trim . ,Mr. Walker — The next item is extra work to enclose the ductwork over the curved feature . The ductwork is in the upper part of the yellow wall . It is high in the mezzanine. It is not balanced between the two sides . It was off center. We boxed it in to make it centered . Supervisor Valentino — When we found out that there were no it mechanicais" behind the mezzanine I wanted the curved feature to be removed . I had a big debate with the architects over it . I gave in to them when I should not have. I do not understand the features . Mr. Walker — The Post Office did not level their floor so our brick placing was going to be wrong . That needed to be corrected . The Post Office has to do some concrete work , and I am going to send a letter to the Post Office suggesting that they reimburse us for it . The extra work to the Buffalo Street ramp dealt with the additional telephone conduits that went through the form work for future cable . There was also a storm drain that was not shown on the drawings that they had to form around . The additional drywall trim work was beyond the contract . That work included boxing in and finishing the columns . There were some unfinished spaces we came across during demolition . Item 7 is for the drywall for the wall across from the Clerk' s Office . The wall was going to have post office boxes exposed . We are not going to be getting the post office boxes within the next two or TOWN BOARD PAGE 24 AUGUST 7 , 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED three months . There were holes in the walls and the floors that the general contractor is patching . There is some debate about which trade is responsible for it . I will talk with each of the contractors . There was some extra trim work on the curve feature . The hardwood trim on top of the wall in the boardroom will be about $2 , 000 . Councilman Klein — Are we getting a credit on the steel handrail ? Mr. Walker — Yes. We are getting a $2 , 400 credit for the handrail . We are still negotiating because there are some items they did not do that we should be getting credit for. Councilman Lesser — Was there something from our last meeting regarding the Post Office not providing something for the wall between the spaces? Mr. Walker — There is a hallway between the old loading dock and the emergency exit for the Post Office . Under our negotiations we were going to finish the back wall with brick cross . Our finish was going to end at the corner, which we did . The Post Office does not remember agreeing to finish the wall . Supervisor Valentino — I remember having a meeting to discuss the wall . I do not know if 4V received a letter agreeing to it . wl Mr. Walker — We are sending a claim letter to the Post Office regarding the sidewalk and the curbing they were to put in to support the brick that they did not do. We could also include the brick for the wall . Councilman Lesser - Is the sidewalk repair a separate project ? Mr. Walker — We had a parking lot landscaping item in the project. We did not do any of it under the general contract. We hired a contractor to do the sidewalk . The work is complete . The City provided new granite curb and our contractor set it . I am going to send a letter to the City asking if they are going to pay us for the labor to put it in . It was a total of $ 17 , 000 . It included setting the curb . We are not going to spend the $6 , 000 budgeted for landscaping . We are going to do it ourselves . The Post Office owes us $2 , 500 for the sidewalk as there were portions which were bad prior to our purchase of the building . The City cited them for the sidewalk . Councilman Lesser — Are there other associated costs ? Mr . Walker — This is most of it . We are still negotiating some of the figures which might be reduce There is a letter from the general contractor suggesting that we delayed the work enough that it co. Since we are still waiting for the roof for our boiler entrance in the back, they have not mentioned anything about us delaying them . The doors arrived the week before we moved in . The HVAC contractors sent me a letter saying that we delayed them , but we did not get the rooftop unit design and the curb unit from them , that delayed everyone else . He gave us a letter for extra costs . I am going to respond . The air conditioner has quit twice . We are still waiting for training on how to run the system . Councilman Klein — Where is the main control ? Mr. Walker — The main control is in the rooftop unit . There is another control that runs the boiler in the basement . The rooftop unit has a communications port. We are able to plug a computer into it and talk to it . We are getting the software from Carrier . Supervisor Valentino — The change orders are not final . We are still negotiating . Attorney Barney — The board should wait to consider approval of these change orders until the next meeting so that there are final figures . Supervisor Valentino — Are some of the numbers final figures ? Mr. Walker — Change Order 5 is complete. It is not going to change. Supervisor Valentino — We can approve Change Order 5 and then wait on the others . Is the change order for the electrical work final for $7 , 634 . 07? Mr. Walker — Yes . It is finalized . Supervisor Valentino — We can approve the electrical change order as well . Mr . Carvill — I have expenditures of $ 1 , 058 , 000 the Town Board has already approved . Mr. Walker has the total general construction cost at $ 1 , 065 , 000. The net change order is an increase of $6 , 541 . The total of everything is approximately $25 , 000 above the residual we have left . Supervisor Valentino — Some of these items have been paid . Change orders 1 through 4 have been approved and paid . Mr. Carvill — The general construction contract is already budgeted at $ 1 , 058 , 000 . The total that is presented here is $ 1 , 065 , 000. In the general construction contract there is $34 , 000 remaining to be spent . Mr. Walker — We are within the budgetary limitations of the capital project . The remaining portion is 25 mph . We are requesting a 30 mph speed limit from the end of Caldwell Road to the Dryden town line . The City speed limit on Maple Avenue is 30 mph . The County has a speed limit on Pine Tree Road . It makes sense to include our portion of Maple Avenue , n have a speed limit posted , Supervisor Valentino — Maple Avenue does of p p Councilwoman Russell — Is the speed limit on Forest Home Drive going to be increased ? Mr. Noteboom — No . There is not a posted speed limit on that section of Forest Horne Drive . The remaining portion from Cornell to East Avenue , to the upstream bridge is 25 mph . The portion to the Dryden town line and Route 366 is 55 mph . The Town of Dryden has put trails off Forest Home Drive and are requesting a reduced speed limit at 30 mph . Cornell Public Safety asked us to consider the reduction of the speed limit . Councilwoman Russell — I do not understand the second "Whereas" . It was requested that we acknowledge some of the owners of those properties . We could take a picture and say how much we appreciate people taking the extra effort . Councilman Niederkorn — There is a nice fence on Coddington Road where there are alway beautiful flowers . Supervisor Valentino — We could highlight some areas in the Town . It will acknowledge people wh have done something visually pleasing . Councilwoman Russell — We would need their approval to put their picture in the newsletter. Supervisor Valentino — We need to include fall brush and leaf pick- up dates . Councilman Klein — We might want to include an article about the Lake Source Cooling consultant . Mr . Mrs. Drake — We had two crossing guards on Warren Road who worked two different shifts. One was for the DeWitt School and the other for the Northeast School . We will be moving one of the crossing guards down to this location and leaving the one crossing guard to do a double shift on Warren Road . We are not hiring anyone new. Supervisor Valentino — Will it be additional hours ? Mrs . Drake — It will be two additional hours for Mr. Schrier per day. Councilman Klein — It was suggested that we install "No Standing" signs on Winthrop Drive . We have had " No Parking" signs installed . There are many people who sit in their cars . Councilwoman Russell — Where would people be able to pick-up their children ? Councilman Klein — They can pick them up down the road . There is a right angle bend in the road . The sidewalk is across the bend . Supervisor Valentino — Does the school provide any parking ? Councilman Klein — They did add a pull-off area a few years ago , and then they installed "No Parking" signs near the crossing area . Mr. Noteboom — We would need to amend the Traffic Ordinance to place those signs . Then on page 24 , we start talking about Agenda Item No . 17 , Culvert Repair, Page 27 jumps back to Agenda Item No , 16 . Mrs . Noteboom — That is what happened . We went back to it . Councilman Lesser — We raised an issue and then went back to the proceeding one for a similar consideration . Councilman Klein — Page 28 ends the discussion . It states to see Resolution No ' s . 95 and 97 above . I think that it was amended . I am not sure that we went back to the resolution . I think I know what we discussed . Supervisor Valentino — We used to attach the actual resolution . Mrs . Noteboom — The resolutions are included in the body of the minutes . Supervisor Valentino — Are they the resolutions that we passed ? Mrs . Noteboom — Yes . The resolutions included in the minutes are the resolutions that were approved by the board . We use a different format for the mail-out . It eliminates additional paper. Councilman Klein — The Culvert Repair Policy resolution stated that we adopted the policy as granted . It is written with the provision that the Highway Superintendent can modify the policy. The Driveway Policy is drafted , but the Highway Superintendent needs Town Board approval . Attorney Barney — The amendments should be in the policy itself . The intention was that the special circumstance was to be added to the policy. Mrs . Noteboom — On Page 23 , Resolution Numbers 95 and 97 are shown . There were technically two resolutions because of the discussion , The original motion , Resolution Number 95 , was the two "Whereas" and the "Resolved". Then there is the amendment in bold . The original motion does not include the amendment in bold . Then I showed the amendment as being part of the complete resolution . Attorney Barney — The resolve related to the deviation is an amendment to the policy itself . It was not to be put into the resolved . We amended the policy and not the resolution . We could have the minutes show that the policy was amended and the policy was adopted . Supervisor Valentino — We did not amend the resolutions , we amended the policy. Councilman Klein — I think that the date for the one- way southbound is incorrect . The traffic counts are being done in September. The road will be one-way in October. Mr . Noteboom — I do not think that we changed the dates in the resolution . We run into the risk of snow towards the end of October. Traffic counts then become very difficult . Councilman Klein — We were going to do traffic counts in September. Then the road would be one - way in October. The resolution states September 1st to November 1St. Councilman Lesser — I do not think that we formally amended the resolution . Mr. Kanter — I think that it was understood from the discussion . Supervisor Valentino — I think we should postpone the approval of the minutes until next month . d. Appointment Interviewing Committee — Planning Board Member: Councilman Klein — We have two Planning Board Members willing to serve on the committee , but n Town Board Members . Supervisor Valentino — We already decided on the two Town Board members . Councilman Klein — One of the members from the Planning Board was just appointed . Attorney Barney — This is a follow- up of the 1998 contract . This is the third fire engine on the same contract . The urgency is that they had a fixed price for one year. Supervisor Valentino — I do not think they asked us to approve the purchase of the two other fire engines . Attorney Barney — If we are going to be billed for it and pay it , we need to have a voice in the expenditure . Resolution No. 128 - Purchase of New Fire Enpine/Pumper Vehicle by the City of Ithaca Fire Department. BE IT RESOLVED, that the Town Board hereby approves the purchase of a third new fire enginelpumper vehicle at a cost not in excess of $385, 000. 00, by the City of Ithaca Fire Department; and be it further RESOLVED, that the Town Board agrees that the purchase of the said fire enginelpumper vehicle be paid for by the use of serial bonds, the amortization of which shall be added to the Fire Department Budget, a proportion of which shall be paid by the Town in accordance with the existing fire contract between the City of Ithaca and the Town of Ithaca . Mr. Noteboom - They are a group of people prune trees and shrubs for various people . Councilwoman Grigorov - There are certified pruners in the City. Mr. Noteboom - They work with the . City a lot , and the City might train them . Councilwoman Russell - Are we still trimming South Hill Trail with our machinery? Mr. Noteboom - No . We are not . This is a group of volunteers who pruned for three days . Councilwoman Russell - Are we sending a crew out to prune by hand ? Mr. Noteboom - Yes . We do mow the South Hill Trail . We are cautious about how we do it . Councilman Niederkorn — Do we have any liability for the people trimming ? Attorney Barney — It is always a possibility. Mrs . Drake — Any medical claim they would have would be paid by their individual health insurance first . The amount their health insurance did not pay our Workers Compensation would pay. Mr . Noteboom — Many of these groups have their own liability insurance . Attorney Barney — There is an age limit for persons using motorized equipment . We should not have teenagers using chain saws . c. Director of Engineering — See Attachment #6 Councilman Lesser — At the last meeting we talked about the demolition of the condemned house . There was some question about the asbestos shingles . Do we have an estimate for that demolition ? Supervisor Valentino — We have some information . d. Director of Planning — See Attachment #7 e . Director of Building/Zoning — See Attachment #8 Mr. Frost — We issued a fireworks permit for Ithaca College . TOWN BOARD PAGE 37 AUGUST 7, 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED We recently started to contact asbestos contractors for the demolition of the house on Stone Quarry Road . The neighbor of the property is willing to purchase the property, and is willing to demolish the building himself. There is no guarantee that this person will win the bid to purchase the property. at the auction on September 16"' . The board might want to wait to get estimates on the demolition until the auction is over to see if the neighbor purchases it since he is willing to remove the house . Attorney Barney — I think it would be wise to wait . Mr. Frost — I would like to see the building come down before the first snow, as the snow will likely take the building down . I received a letter July 19th from the principal of Boynton Junior High School . He informed us of their intent to install signs similar to the sign at the High School . The sign is approximately 8' feet by 5 feet . It is going to say Boynton Middle School and have changeable letting . I talked with Attorney Barney about this and the school district officials maintained that they are not subject to local codes . The sign ordinance would allow a sign of 24 square foot . This sign is about 40 square feet . We wanted to ask if the school is exempt from zoning regulations, Attorney Barney — I did some research . it is clear that we cannot exclude schools by zoning . It is not as clear that this cannot be regulated in some respect . The board would be able to say that the sign should not exceed the sign limits or they should get a sign variance . The school district officials could decide not to follow the sign ordinance . I do not know if the Town Board would want to take on a course of action . I think that we should send them a letter thanking them for their courtesy, but they are in violation of the law. The maximum size they can have without a variance is 24 square feet . Councilwoman Grigorov — What is the size of their current sign ? Mr. Frost — I do not know. It is located in the City. It might be close to 40 feet . The sign ordinance would exempt any sign for a public building that is an identification sign . In another section of the ordinance we allow signs without a permit and set forth limitations . In this case , it is 24 square feet . It would allow an institution to have their name and other information , but at a size not to exceed 24 square feet . Supervisor Valentino — Does Ithaca College comply with our sign ordinances ? Mr. Frost — The front and rear entrance signs state Ithaca College . They do not have information on them . If the sign were to say Boynton Junior High School they would not have any regulations . Attorney Barney — Ithaca College's sign is an identifying sign , it is exempt . TOWN BOARD PAGE 38 AUGUST 7 , 200 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED Mr. Kanter — They are private institutions as opposed to public schools . Mr. Frost — We could not regulate when BOCES built . Attorney Barney — I found a case involving an authority. The case went to the Court of Appeals . They upheld the regulation of certain aspects of what the authority was doing . The leading case in the area is when Cornell was going to put some programs in the Cornell Heights area . The Court of Appeals said that we could not preclude them , but we could regulate them . We are not treating them differently. We are saying there is a uniform policy throughout the Town that the sign not exceed 24 square feet . Mr. Frost — There are other schools in the area that have similar signs that large . Councilwoman Russell — They can make their case to the Zoning Board of Appeals . Attorney Barney — When the sign was put up in Lansing there were no regulations . Supervisor Valentino — Which part of Boynton is in the City and which portion in the Town ? Mr. Frost — The building is entirely in the Town . Supervisor Valentino — They could always elect to put the sign elsewhere so it is in the City. Councilman Niederkorn — I think it is important to know the size of the sign in front of the high school . Councilman Lesser — It is not inappropriate to say that this is the law and it applies to everyone . We could encourage them to come in and apply for a variance. Councilman Niederkorn — If they choose to ignore it , are we going to sue them ? Attorney Barney — We could make that decision at that point in time . Councilman Niederkorn — I think it is silly to restrict the size because the law says the sign is that size . Attorney Barney — If Niederkorn & Associates wanted to put up a 40 square foot sign then you would have to come in and get approval . Councilman Niederkorn — The gray area is with the school . Attorney Barney — There is a "gray area". I do not know for sure if we can regulate it . I do not know if the board wants to spend the money to establish a principle . Councilman Niederkorn — I do not think we should be so rigid . Budget Officer — See Attachment #9 Mr. Carvill — The end of the report is an estimate of where Fund Balance will be at the end of the year. Monies usable and available to us at the beginning of 2001 . Supervisor Valentino — They are estimates, but they are reliable . g. Human Resources Specialist — See Attachment #10 h. Attorney for the Town . Attorney Barney — We have been named in another lawsuit. Evan Monkemeyer is seeking to reduce his assessments . There is no particular reason I know of that the Town of Ithaca should be a party or the defendant in the action . The County controls the assessment . I have spoken with the attorney involved and suggested that we should not be named as defendants . Mr. Monkemeyer wants the Town named as a defendant. I need authorization from the Town Board to send a letter demanding that the Town be deleted as defendants . If not , we will request it to the court and ask that the Town be given sanctions for their unwillingness to do so . Councilman Klein — We do not have anything to do with the assessments . Attorney Barney — We would if it were assessments on our unit charges for water and sewer. The complaint is that the County has the property assessed at $90 , 000 and he thinks it should be $75 , 000 . 1 would like the board to pass a resolution to authorize our office to defend the Town to seek removal from the lawsuit . Agenda Item No. 24 — Review of Correspondence — See Attachment # 11. Supervisor Valentino — We do not have an address to send a response letter. It is the Town Clerk ' s legal obligation to make sure we see the correspondences . Agenda Item No 25 — Work Plan Priorities for 2001 : Supervisor Valentino — I asked staff to think about priorities which are work plans beyond our normal, duties . a. Town Supervisor. Supervisor Valentino — We need to do a review of our local laws and ordinances . We need to figure out if some are obsolete and should be eliminated as there are some that might need changes . W need to make sure that the laws and ordinances that have been passed fit our goals - and t Comprehensive Plan . We need to try to complete an outline and plan for Five Year Capital Planning . I would also like to begin thinking about the renovations that need to be done to the Highway facility. Councilwoman Russell — We need to finish the Zoning Ordinance . Mr. Kanter — We are going to look at the Subdivision Regulations after we finish the Zoning Ordinance . Councilwoman Russell — We could do some investigation into the codification of those ordinances . We could have them indexed . Mrs . Noteboom — I think that we could develop our own indexing system . We are developing one that is simplified and easy to do . Councilwoman Russell — We have not done it . Mrs . Noteboom — We were waiting until we moved and all records were inventoried first . Supervisor Valentino — We need to review the ordinances first . We need to get them in some type order . Is this something we do every year? Supervisor Valentino — We do this every year. We usually have one meeting devoted to the priorities list . We were unable to this year because of the move . Councilman Niederkorn — How do you arrive at what the priorities are going to be? If there are fi{teen priorities and we can only realistically do seven , how do we decide? Supervisor Valentino — The Town Board has to help us decide it . We look at what we can realistically and financially do. Staff will make recommendations of things we think are reasonable that we can accomplish . We fit them in during our budget process . This is the beginning of our budget process and some items are not budgeted . They are our work plans for the year. We started this process when I became Supervisor. Councilman Lesser — I would support the completion of the revision of the Zoning Ordinance . I would like to see us set up a systematic process of assessing traffic flows in the Town . A lot of our decisions deal with traffic . We do not have much information on traffic . It is a substantial task . We need to decide what is going to be done . Mr. Noteboom — We need funding for transportation studies. That was part of the Comprehensive Plan that was postponed . Mr. Kanter — It has been listed on the priority plan in prior years . We need a committee to focus on the traffic. The Capital Planning Committee has really made progress in establishing a 5-Year Capital Plan . If it were not for the committee , we would not have a plan established . Supervisor Valentino — We need to set up a Transportation Committee to establish the system . Councilwoman Russell — Do we have members appointed ? Mr. Kanter — We do not have members appointed for a Townwide Transportation Committee . We have a committee with Cornell , the Town and Forest Home, but that committee does not involve all portions of the Town . Councilman Niederkorn — Supervisor Valentino , do you have the update of the Comprehensive Plan on your priority list? Supervisor Valentino — No. Councilman Niederkorn — I would like it to be added to the list . It is an important item . The Comprehensive Plan says it is to be reviewed every five years . It has been seven or eight years . Councilman Klein — We have finished the draft chapters . We are finishing the map . Staff has been able to put together understandable landuse maps . We are getting close to completion . We should be able to begin public hearings in the fall . Councilman Lesser — What is the process of public hearings ? Does it come before the Town Board or Planning Board ? Mr . Kanter — We are behind our original schedule for this year. We had projected that we would have already reviewed the draft chapters . It might take at least three meetings . Councilwoman Russell — We have deferred some decisions . We need to work them out . Mr. Kanter — We need to have the revisions reviewed by the Planning Board , Agricultural Committee and Conservation Board before we present it to the public. It will take three to four months to get to that point. Supervisor Valentino — It will be part of the 2001 work plan for the Codes and Ordinances Committee Mr. Kanter — The review of the Comprehensive Plan is separate . It would not be a Codes a Ordinances Committee program . A lot of the work that is being done on the zoning revision h brought up questions about the Comprehensive Plan which may require some revisions . We harp not discussed. . mapping the new business zone on West Hill . If we were to do something like that , we would have to do something with the Comprehensive Plan to make it consistent . We also need to do a periodic review of the Comprehensive Plan . It would be fairly lengthy work to program it into a work plan . Councilman Klein — The review and maintenance of the Comprehensive Plan is sent to the Planning Board . The Town Board adopts it . Mr. Kanter — It is also a Planning Department work program . Supervisor Valentino — We have to see how many priorities we can accomplish with the staff we have in each department . Councilman Lesser — I would like to identify more sources of information on various points to come in . I am referring to our decision at our last meeting regarding the clothing sales tax. We did not have any information . There must be someone who has had experience with developing a system for sources of information . TOWN BOARD PAGE 43 AUGUST 7 , 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11, 2000 - APPROVED - APPROVED - APPROVED We received copies of the Forest Home Newsletter. They have indicated that they are planning on various traffic calming measures and diverting traffic north . It will come before this board at some point . We need to look ahead . We need to know information about it before we can make decisions . Supervisor Valentino — I think that we can get information on traffic . Mr. Kanter — Ruth Mahr has talked with Councilman Klein about their plan to hire a consultant to do a traffic calming study. They intend for the Town to be involved . Supervisor Valentino — We need more than recommendations . Councilwoman Grigorov — Who is paying for it? Mr. Kanter — They are applying for a grant . They do not know what they are going to do if they do not get the grant . Supervisor Valentino — I have included in my budget $2 , 000 for the study. Councilwoman Grigorov — Will that set a precedent for other neighborhoods. Supervisor Valentino — Forest Home is a very well organized neighborhood association . They have a newsletter. If every community in this Town took as much interest in their own neighborhood as the people in Forest Home , it would be a wonderful asset . If they are willing to do the work , we should be willing to help . I am willing to help any neighborhood organization that is willing to do the same legwork as Forest Home . Why wouldn 't we ? Councilman Lesser — We need to be willing to give them serious consideration . Supervisor Valentino — We need to encourage more neighborhoods to be involved . Councilman Klein — I think that we need to get our website up to date . We could have a lot of information on the website . We could include agendas and minutes . Supervisor Valentino — We do not have anyone on staff right now that has the time to do it . it is a very time consuming project . Councilman Lesser — We need to figure it out . There are a lot of people who look to the web for information . They have a right to expect it there . If we do not have one we can be severely criticized . Mrs . Noteboom — i think that is true . There are also other considerations of the website . It is not just putting information on it to be there . The Records Management Advisory Board has discussed it . There are some liability issues that we need to look at . We need to investigate them . Councilman Klein — We could include the schedule of our meetings . They are typed up anyway. Noteboom — We were starting to get the website established at the old Town Hall . We could p it on a disk and transport it into the website . With the move and the new networking system , we have not been able to update it . Councilwoman Russell — Ms . Titti has been very busy hooking up everyone 's computers . She is trying to learn the new networking system . Supervisor Valentino — We can put it on the priority list . Our bigger priority right now is to get our computers up and running on the network. b. Town Clerk/Receiver of Taxes/Records Management Officer —See Attachment # 12. Mrs . Noteboom — Our priorities are dictated by statue . We do the daily work of providing services to the residents. Supervisor Valentino — It is nice to have the records in order. That has improved over the last four years . c. Highway Superintendent: Mr. Noteboom — We have been talking about mapping capabilities at the Highway facility. We woui like to be able to access maps from Town Hall . I talked with the Capital Planning Committee . M Titti has presented to the board the networking so that we can access the records . I would like encourage it . We would not have to get new software at the Highway facility. We need informatio to do our job . it is difficult when residents call us and we do not have the information . Mr . Kanter — Once Highway has the GIS system , we will need to program what we need from it . Some of what Mr. Noteboom might need may not be in an accessible form . Mr. Noteboom — I have listed the standard work items . I would like to complete the Town Safety Manual . We need to have a transportation plan . We could systematically repair roads with a plan , and the Town Board would feel more comfortable . Supervisor Valentino — Would the transportation plan fit in with the Transportation Committee ? Mr . Noteboom — I could see a Transportation Committee starting to work on a transportation plan . d. Director of Engineering — See Attachment # 13. Mr . Walker — We have two major joint municipal projects . One is the Integrated Water System which needs to get going . The second project is the Joint Sewer System Capital Plan which we need to fully understand expenditures for. We want to get proactive rather than reactive . TOWN BOARD PAGE 45 AUGUST 7 , 2000 APPROVED - APPROVED - APPROVED - SEPTEMBER 11 , 2000 - APPROVED - APPROVED - APPRO11✓ED We would like to implement a Townwide Storm Water Management Plan . This will be done in conjunction with the Highway Department. The Environmental Protection Agency will be requiring us to have storm water discharge permits . The West Hill hospital sewer needs to be replaced within the next year. Supervisor Valentino — We have a memo from Mr. Brocon about some of the problems in that area . West Hill water and sewer system is a high priority. Mr. Walker — Our pump station is about 20 years , and it needs to be reinforced . If our current pump station were to break down , we would not have a back- up system for the hospital . A pump station might possibly be located in the Mecklenburg Road area or Elm Street Extension . The pump station coming off the City water line will be worked into the integrated water system . Supervisor Valentino — We cannot take the tank down to repaint it or to inspect it . It is the one tank in our system that does not have a back up . The hospital is on that line . That is a real priority. Councilman Klein — We also need to repair the hospital sewer. Councilwoman Grigorov — Will we be working with the City to do repairs? Mr. Walker — We are working with the City on jointly used sewers . I have been talking with Mr. Fabbroni about different routes that we could use . We did not do anything with the sewers a few years ago because we thought there was going to be a subdivision that would have allowed us to create a new route and jointly build a sewer. I do not think it will happen . The Cayuga Cliffs Development Corporation became involved with the Paleontological Research Institution expansion . They did not want storm water on their land . Councilman Lesser — The old hospital is going to be sold . Do we have the right or responsibility to improve the sewer system for the building ? Mr. Walker — They would need site plan approval . If they were going to increase the load significantly over previous use we would need to improve the system . They are proposing light industrial use . Their load will not be any greater. Councilman Niederkorn — Will the construction project be part of the capital improvements program ? Mr. Walker — Yes . Councilman Niederkorn — We need establish the capital improvements program . The contents of the program would be the sewer and water lines , and roads . Hopefully, with our 5 Year Capit Plan we can start planning so we are not reacting to situations . We can be proactive on knowing what is coming . We know what we need to start. A plan would help a lot with water, sewer, highway and parks , and open space . e. Director of Planning —See Attachment # 14. Mr. Kanter — We have been working on the Zoning Ordinance , and put aside working on our other ordinances. We would like to work on a Water Resources Protection Ordinance and an Outdoor Lighting Ordinance . They need to be completed . We need to clean up and update our Town ordinances to get them up to date and consistent . We would like to review the subdivision regulations and the environmental review law. They will not take a lot of time , but they need review. We are going to continue the Agricultural Land Preservation Program . The one capital project proposal is to provide funding additional monies into the 2001 budget . It should be something that is showing in the budget every year. Park and Trail planning and design projects is a priority for 2001 . We can work on the William an Hannah Pew Trail . We also need to work on the Inlet Valley Park. These directly relate to the 5 Yea Capital Plan . Councilman Niederkorn - I noticed the format of Mr. Kanter's priority list . Is this the format that is going to be used by the Capital Improvements Committee? Mr. Kanter — Yes . We have the standard project description form . We also have a criteria evaluation form that we have been using to rate projects . Councilman Niederkorn — Have you gone beyond 2001 ? Mr. Kanter — Yes . Supervisor Valentino — I think that the Capital Projects Committee has been doing a good job . We have a criteria description that we can go through . We are able to look at the projects and give them a type of priority. It has given us a good foundation to move forward on a good plan . Councilman Lesser — Are we working on filling the position of Assistant Town Planner? Mr. Kanter — We are working on it . We might have an action to consider at the next Town Board meeting . Councilman Klein — The position description for Assistant Town Planner includes planning trails . I there a need to have a landscape architect background to that ? Mr. Hebdon in Engineering has been doing a wonderful job taking it to a final detailed level . Mr. Walker — We need a good planner to plan out the concepts . We have the capability in - house to do the final design . Mr. Schoch has excellent expertise in detail of features . We do not have an overall planner who can put the packages together. f. Director of Building/Zoning — See Attachment #15. Mr. Frost — We need to have an open burning ordinance . We did have a committee . I would like to see a new committee formed to deal with the open burning ordinance . I copied last year's 2000 priorities . There are several items that we have accomplished . There are some items that we have not finished . I need to work on illegal apartments that we became aware of . , Many buildings that were assessed as a single-family residence have had apartments and need to be reviewed . Drake — The list is continuing from last year. We are still waiting for the integrated water system to be finalized . I have looked into affirmative action . The County is developing a diversity plan . I would like to wait and see how they address the issue . There is a professor at Cornell who might use the Town of Ithaca as a project . My highest priority is the purchase of the Human Resource Information Management software . I have had this on my list for two years . We have been waiting for the move to the New Town Hall and for connection to the computer networking system . Supervisor Valentino — How much will it cost? Mrs . Drake — It varies . It can be as inexpensive as $ 1 , 000 , and as expense $5 , 000 . Supervisor Valentino — Have you looked at which ones you would like ? Our payroll program allows us to do only so much . We are looking at software that would allow me to have more information on personnel . Supervisor Valentino — We need to develop training schedules . We provided a lot of training a few years ago . Mrs . Drake — I am going to have management training in the fall . Some of it is ongoing training that we need to have scheduled . We have an old personnel policy for elected and appointed officials from 1984 . We need to update and create a manual directed towards elected and appointed officials . They would still need to know our harassment policy. They do not need the entire personnel manual . It would be a condensed version . Supervisor Valentino — Are we close to completing the integration of our personnel manual with the Southern Cayuga Lake Intermunicipal Water Commission ' s personnel manual ? Mrs . Drake — Yes . It will be going to their Personnel Committee for their first review . Then it wi come back to our Personnel Committee with their comments . Hopefully, it will be finalized by the en of the year. Supervisor Valentino — It will be more efficient for us . There are some items that they still need to do differently. We have most of the policies the same for both entities . h . Budget Officer: Mr. Carvill — I would like to research new accounting software . I am concerned about our software package with Williamson Law Book . We need to be able to look at balance sheets and trial balance . We need to be able to look at day to day cash receipts and disbursements . I would like to make budget modifications and have that budget be on - line in "real time" . We will have the capacity with the network system , but are having problems with integrating the system with payroll . The cost for new software is between $80 , 000 and $ 100 , 000 for an up-to-date system that will allow what is needed . I am not sure that the system that we were looking at is user friendly. There are many systems available , but I think that priority is going to take a "back seat" for the year 2001 . Supervisor Valentino — The Williamson Law Book software is not quite the way we world like it to be . Mr . Carvill — They are expanding , but they are unable to do capital budgets . The State is changing the way to account for Capital Planning . I have a massive amount of accounting changes from th State . Someone from that program has offered to talk with the Town , They might want to use the Town as a model to try their capital planning software . Supervisor Valentino - I want them to understand what our State mandates are . Councilwoman Russell - I think Mr. Carvill should be at the meeting when Cornell comes to the meeting. Mr. Carvill - it cost the Southern Cayuga Lake Intermunicipal Water Commission (SCLIWC ) approximately $35 , 000 for their new system . We have upgraded for the past five years with zero cost . Williamson has made upgrades and made changes to accommodate us . Councilwoman Russell - The software that Cornell is working on should be targeted towards governments . They do not have the same issues. as far as State mandates , t fupervisor Valentino - It would be appropriate for Mrs. Drake and Mr. Carvill to come to the meeting . rs. Drake - We have been working with Williamson Law Book, and they are trying to develop both our programs on a Window basis . It would help us with getting it to work on a network. The Town of Ithaca operates with the reality that , "yes we are government", but government is big business . Our budget is big business . Silverline is ready to start building the new bridge . John Lampman, the Tompkins County Engineer and inspector for the bridge replacement, has told me that the bridge construction project is on schedule and everything is going well at this time . Renwick Heights Road The Town has started construction on Renwick Heights Road . The only problem we have had so far is we got a little over zealous trimming some trees in front of one house on the street. The residents on Renwick Heights Road had asked us to trim the branches and trees back to open up the sidewalk and allow the light from street lights to get through . We will finish this project in August. :Park Lane Storm Water Management We have completed the East Side at 112 Park Lane . The catch basin that will split the water has been installed . The pipe and plunge pools up to what was going to be Circle Drive are installed and the lawns restored . This has reinforced the washout areas between Eastern Heights Drive and Park Lane . A series of plunge pools are being built on the West Side of Park Lane to slow down the water . We will begin to connect the pipe parallel to Park Lane . Warren Road Tompkins County Highway Department is working on Warren Road . The County has been working from the Village of Lansing' s end of Warren Road first. The county will maintain two way traffic on the first portion of the project then maintain single lane traffic for the remainder of the project. Ward Hungerford said that he plans to have the top on Warren Road by the time school opens . They will then be grinding the asphalt out from BOCES to Hanshaw Road . Youth Build Program The Youth Build Program is part of Tompkins County Community Action and is funded through the Economic Opportunity Council . The program hires youth between the ages of 16 to 19 . The Youth Build Program provides these youth with work experience . The group of young workers that we had this year has been very good . They were able to stain the play structure, spread wood chips, trim all the shrubs, and install two benches at Tudor Park . They also installed two bicycle gates on South Hill Agenda Item 22b Trail and stained them. We have two wood chip trails in Iacovelli Park on which they spread wood chips . Citizen Pruners The Citizen Pruner' s group trimmed along South Hill Trail the week of July 31 to August 'l . We explained to them how we wanted South Hill Trail to look and they took it from there . The days that they trim are Monday and Wednesday evening and then on Thursday morning . Federal / State Public Assistance Tompkins County, along with others, has been approved for Federal Emergency Management Assistance (FEMA) for the storms that hit the area during the period of May 3, 2000 through June 30, 2000 . After reviewing the Highway records, the Town maybe eligible for assistance from these storms . There is a meeting on Wednesday August 9, 2000 to review the assistance program . Highway personnel will be attending this meeting . Upcoming Projects As noted above, Renwick Heights Road and Park Lane will be worked on during the month of August . We will also begin work on Tareyton Drive . The Engineering Department is completing the final grading plan for Iacovelli Park . Lay out of the future play lawn and basketball court area will then be done on site so we can continue the grading and filling in those areas . ■ :Park Mowing ■ ROW Mowing ■ Road Surface Treatment ■ Ditching ■ Jet .Rodding ■ Water and Sewer Repairs Town Engineer' s Report for 8/7/00 Town Board Meeting EARTH FILL PERMITS No new fill permits were issued in the month of July. WATER PROJECTS Integrated Water System Final project planning and design work on improvements for the integrated water system is on hold until completion of the revised SCLIWC agreement. SEWER PROJECTS The SJS partners are continuing to work on the revised agreement. The Town Engineer has been working with the other municipal Engineers and the SJS attorney on technical details of the agreement. The City of Ithaca has provided an enumeration of the projects on jointly used Intermunicipal sewer mains that have been completed since 1997 . The Town Engineer has asked for additional details regarding these projects to allow a recommendation to the Town Board regarding financial participation in these projects. TOWNHALL The Town of Ithaca has officially occupied the new A Town Hall at 215 North Tioga Street. All Construction Contracts have received notice of substantial completion with a number of punch list items to be fmished before final acceptance. A final project report detailing changes and project costs is being prepared for the August 7 Town Board meeting. The general contractor for the Post Office continued to make slow progress on the Post Office Project. Completion of that work is expected this fall. Tuly 18, 2000 Meeting: Ainslie/Singer Subdivision — Modification, Hayts Road: The Planning Board granted Preliminary and Final Subdivision Approval for the proposed modification of the previously approved subdivision of a 57. 7 + / - acre parcel on Hayts Road into six lots on Town of Ithaca Tax Parcel No. 24-5-2, AG Agricultural District. The 57. 7 + / - acre farm parcel is now proposed to be subdivided into six residential lots consisting of three 4 + / - acre lots, one 2. 1 + / - acre lot, one 20 . 7 + / - acre lot, and one 22. 8 + / - acre lot. CURRENT PLANNING DEPARTMENT PROTECTS The following are accomplishments or issues that have been dealt with over the past month. SEOR Reviews for Zoning Board : One SEQR review for the Zoning Board was done since the July report: Montessori School Addition Modifications, Extension of Special Approval and variances, 120 East King Road, R-30 Residence District . Codes and Ordinances Committee: The Committee met on July 26, 2000 and went on a field visit to business zoned areas in the Town . The August meeting will be scheduled toward the end of the month due to vacation schedules (to replace the regular meeting date of August 16th. The tentative agenda includes a report on the July 26' field trip, a discussion regarding additional Zoning map revisions (other than business zones), and review of the draft, revised Zoning chapters (dated Sept. 15, 1999), Capital Projects Committee: The Committee met on July 28, 2000. Discussion continued regarding 2001 capital project proposals. Additional proposed 2001 capital project descriptions were provided by the Highway Department. The next step will be to submit project descriptions to the Town Board for discussion at the August Board meeting. The next Committee meeting is tentatively scheduled for September 6, 2000 . North Campus Gateway Committee: The Committee met on July 11 , 2000 to continue discussion of alternative improvements for the Gateway. Revised traffic model results indicated the possible need to look at alternative Gateway configurations to minimize projected traffic volume increases during the afternoon peak hour at the Pleasant Grove / Hanshaw Road intersection . The next meeting is tentatively scheduled for August 8th, 2000 . ITCTC Planning Committee: The ITCTC Planning Committee met on July 18, 2000. Reports were provided on a number of items, including the NESTS Transit Study follow-up, the Freight Study, and the upcoming TIP (Transportation Improvement Program) update process. ITCTC Freight Study: Study proposals will be reviewed by the Freight Study subcommittee on August 2, 2000 . Consultants - Lake Source Cooling Monitoring: The Town Board subcommittee interviewed a prospective consultant who would assist the Town in monitoring the impacts of Cornell' s Lake Source Cooling system. The Town Board will consider authorization to hire this consultant at the August meeting . The capital project description is for continuation of the PDR Program in conjunction with the Agricultural Land Preservation program. With approximately $ 82, 845 in the Park and Open Space Reserve and a grant application about to be submitted to the State for Bond Act funds , the Planning Department is requesting that the Board consider authorizing an additional $50, 000 in the 2001 Budget for the on-going PDR program. This would ensure the availability of local matching funds in the event that the grant application is successful, and would allow some level of development rights acquisition if grant funding is not available . The attached update of work plan priorities is really a status report on the progress of the 1999-2000 work plan. Many of the items are continuations of work in progress or work that has not yet begun . The highest priority is of course the completion of the revised Zoning Ordinance and Map . At this point , it looks like this work will continue into 2001 . Once this work is completed , the Codes and Ordinances Committee can begin work that has been deferred on other code and regulation updates and enactment, as listed on the work plan . It is always interesting to see what has been accomplished and what remains. It is my understanding that the intent of this year' s "priorities" discussion is to exclude the routine and to concentrate on major goals or plans which involve money. Nonetheless, I am attaching last year' s priorties memorandum for your scrutiny. Still outstanding and of concern to me is the list of illegal apartments which originated from the Tompkins County Assessment Department. In most cases, I have established that the units are not occupied. In all cases, the property owners are aware of their violations. As we have recently discussed the one main priority for 2001 , including the routine functions of my department, is to reestablish a new committee to prepare an open burning ordinance. Frost, Director of Building and Zoning SUBJECT: Building/Zoning Department Priorities for 2000 1 submit the following priorities work plan for the year 2000 (the priorities considered first and foremost, the Town ' s liabilities incurred by the office' s lack of action or neglect in enforcing its assigned local and state rules and regulations): 1 ) Continue to conduct fire safety inspections and issue Operating Permits according to the fire safety inspection schedule set up for the department. Maintain proper documentation of all activities. 2) Review building permit applications, conduct site inspections and reinspections with regard to compliance with the New York State Uniform Fire Prevention and Building Code and reference standards. Regulate the use of buildings with or without Certificates of Occupancy or expired Building Permits. Maintain proper documentation . Ensure Planning Board and Zoning Board conditions of approvals are met by property owners. 3 ) Respond to all requests and complaints in a timely fashion, bringing complaints to a legal conclusion, while maintaining proper documentation . In this regard the following were outstanding unresolved properties that were violations and priorities for 1999. The status of these are noted, with the pending items becoming high priorities for the year 2000 .
