At a special meeting of the Town Board of the Town of Ithaca, Tompkins County, New York held !,at the Town Hall , 126 East Seneca Street , there were present: PRESENT: Catherine Valentino , Supervisor; Carolyn Grigorov, Councilwoman ; David Klein , Councilman ; Ellen Harrison , Councilwoman ; Ed Conley, Councilman . EXCUSED : Mary Russell , Councilwoman ; John Wolff, Councilman . i PRESENT: Joan Lent Noteboom , Town Clerk; John Barney, Attorney for the Town ; Daniel Walker , Town Engineer; Fred Noteboom , Highway Superintendent; Jonathan Kanter, Director of Planning ; Al Carvill , Budget Officer; Judith Drake , Human Resource Specialist . Call to Order: The Supervisor called the meeting to order at 10: 00 a. m . , and led the assemblage in the Pledge of Allegiance. Agenda Item No 3 . PERSONS TO BE HEARD. Supervisor Valentino - Town Justice Clarence Larkin asked to have the opportunity to address the Town Board . Justice Clarence Larkin - Michelle Townley has worked as a Data Entry Clerk in my portion of the court . She resigned yesterday to accept a position as the Court Clerk for the Town of Ulysses. She worked twelve hours a week and became more than a Data Entry Clerk. She filled in for the Court Clerk and was able to handle the telephone calls . Before Michelle resigned , the Court Clerk worked 7: 00 a'. m . to 6 : 00 p. m . Monday, Thursday and Friday; and 7: 00 a. m . to 10: 00 p. m . on Tuesday and Wednesday. Those hours are too much for the Court Clerk, find myself doing the Court Clerk' s work. I answer the phone , pick- up the mail , make bank deposits, write correspondence , research cases , schedule cases and take papers to police agencies . At the end of 1998 , the Ithaca Town Court sent the State of New York in excess of $203, 000. This amount represents how busy the court is . Dryden sent in $ 185 , 000 and they have -two full time clerks . Lansing at $95 , 000, has two full time clerks . The Town is in need of another Court Clerk. This position is available and does not need to be created . This is an exempt position . I know there is not money in the budget, but I ask that the budget be amended to include financing this position . The hours of work for this position each week should start at thirty . Those weekly hours can then be reviewed in six months . TOWN BOARD MINUTES ; :. Justice Larkin - She was; scheduled for twelve , but was working more. Councilwoman Grigorov - How many hours a week does the Court Clerk work? Justice Larkin - The Court Clerk is working over fifty hours a week . When the Court Clerk was o vacation , Michelle would sit with me at the bench . I paid her $20 . 00 to $40 . 00 from my pocket . Supervisor Valentino - The Court Clerk was hired to fill two part time positions for the two justices . We had a meeting concerning this before she was hired . The discussion concluded that this was going to make the court more efficient , and I made a promise that I would update the court equipment . There was an understanding at that time that there would be no need to hire additional help . This would be taken care of with those funds. It was agreed rent was not going to be paid because the Town was going to update the equipment, (computers , copy machine) , and take care of the things that need to be done . i I have talked with Justice Ray Bordoni and he is not in favor of hiring another person to fill a position . He feels it is not needed at this time . At this point , I feel it would not be appropriate for the Town Board to provide extra funding without doing more research . When I responded to Justice Larkin ' s letter, (see attached letter, Attachment #1, from Justice Larkin and response of Supervisor Valentino), I said not to hire anyone because the position had not been approved by the Town Board and any person he hired would not receive a salary . I was shocked to find out that an advertisement was placed in the Ithaca Journal for this position . It was an inappropriate advertisement that did not meet the requirements of the Town . There was no authority for the advertisement to be placed . I have a bill for $ 171 for that advertisement , and I have 'a letter of complaint from the District Administrative Judge. jr Justice Larkin - That letter has nothing to do with the funding of the court. It is a separate matter. Supervisor Valentino - I think it has to do with the number of hours worked , and the way you are arranging your court . Justice Larkin - The way I arrange my court is my business . The District Administrative Judge can talk to you about the separation of powers. Supervisor Valentino - That is what I am talking about . That needs to be done. I askedr Mr. Carvill give me a summary of what funds the Town has committed to the Town Justices: Over the last y we have expended over $ 122 , 000 upgrading the courts to make them more efficient . Some of th money was spent in 1997 and some in 1998 . TOWN BOARD MINUTES PAGE 3 DECEMBER 31 , 1998 APPROVED = APPROVED = APPROVED - MARCH 8, 1999 - APPROVED - APPROVED - APPROVED The court received . upgraded software, new computers, and equipment needed for the court. At this point , I can not justify any further expense to the Town Board. . A replacement should be hired for Michelle, but we should work together to review any other staffing situations to see what needs to be done. Justice Larkin - Currently; the Court Clerk can not access Justice Bordoni' s computer. We tried to get remote access , but it was denied by Mr. Carvill . Supervisor Valentino - I said that I would look into it. Justice Larkin - The Court Clerk can not access information from Justice Bordoni' s computer. . She has to travel to Justice Bordoni's house to obtain information and then relay it later on . That is not efficient . The State mandates that each town have two Justices to the court and that the town fund the costs. The court fines and fees are not intended to cover court costs. I sent in $ 156 , 000 and Justice Bordoni sent in $47, 000. My court is three times as busy as Justice Bordon. i ' s, Michelle . earned $ 1.0 . 65 an hour for twelve hours a week. I am aware of the financial constraints the Town must operate under. I take great pride in being a Town of Ithaca Justice . This new position does not need to be created , it only needs to be funded . Attorney Barney - The Town does not have to create a job description . There is an existing job description . The Town Board determines what positions there are in the Town of Ithaca and whether they are to be funded . The position has to be created within the Town , but does not need to go through civil service. Justice Larkin - The Court Clerk does not need to be refunded . for mileage , even though it is deserved . Since the Town Court address has been listed as 615 Elm Street Extension , my home , I have had intruders coming into my driveway and at the back of my house . The County Sheriff patrols the house and a security system is being installed . I have had a series of hang- up phone calls at night . I now have an unlisted number. It is harassment. Councilman Klein - Why is there a discrepancy between your workload and that of Justice Bordoni ? Justice Larkin - It depends upon when the person is to appear before the court . Tuesday night appearances are my responsibility, and Wednesday night appearances are Justice Bordoni ' s , Supervisor Valentino - The officers writing the tickets decide which night the person is to appear before the court . We have talked about alternating which night the Justices sit . Justice Larkin - Justice Bordoni deals more with civil and small claims cases . Those cases do not develop fines or penalties . i TOWN BOARD MINUTES PAGE 4 DECEMBER 31 , 1998 APPROVED - APPROVED - APPROVED - MARCH 8, 1999 - APPROVED - APPROVED - APPROVED Councilman Klein - We need to get a computer modem hook- up between the two computers so that the Court Clerk is not driving between the two homes. How do we get the justices to equalize their workload? Justice Larkin - I think it is the same in every Village and Town Court in the County. Councilman Conley - Much of the time it is easier for police officers to reach Justice Larkin for arraignments. Attorney Barney - Instead of Justice Larkin taking all the arraignments , every other arraignment could be given to Justice Bordoni . Justice Larkin is complaining he needs more help because of the workload , one of the answers is to balance out the workload . The number of cases also needs to be looked at. Supervisor Valentino - The Town Board needs to review it . We cannot make a decision today on whether or not to create a new position . Justice Larkin - We will need to tell anyone considered for the position what the pay and hours of work are . Supervisor Valentino - You are not authorized to hire anyone with a salary beyond what you were paying Michelle. Justice Larkin - An hourly wage of $ 10 . 65 an is not enough . The person who mows my lawn is paid $ 12 . 00 an hour. Supervisor Valentino - You will need to talk to Mrs. Drake about the classification . There is a range and classification for the job position that is consistent with the County's wages. Councilwoman Harrison - There are a number of things that need to be looked at . The Town Board operates by looking at a situation carefully before making a decision . There is current authorization to hire a part time person at a rate of pay Justice Larkin feels is not adequate . Justice Larkin needs to work with Mrs . Drake to hire that person soon so that the court can keep functioning . He also needs to cooperate fully with trying to help this Board understand the problems that need . to be addressed . The rate of pay is largely determined by looking at the civil service classification . The Town Board and Supervisor Valentino have spent a great deal of time looking at rates of pay to create equality among positions. It is unrealistic to expect the Board to approve a new position . Councilman Klein - I hope we can fund the cost of a computer modem to connect the two computer Alfred Carvill , Budget Officer - I have expended hundreds of hours in telephone communications, researching computer hook- up and links , software management , and acquisition of computers at the request of the Town Justice. At no juncture , have I denied or refused funding for communications. TOWN BOARD MINUTES PAGE 5 DECEMBER 31 , 1998 APPROVED - APPROVED - APPROVED - MARCH 8, 1999 - APPROVED - APPROVED - APPROVED To date , we have . expended nearly $2 , 000 for telephone systems, of which 50% of that was for hooking up computer modems. We accommodated the Justice by my calling Albany to research having segregated lines , having hook- ups from one facility to the other and for a direct dial- in so that communications could be scrambled to. any location . We were unable to do that without installing dedicated telephone lines independent to each home so that the computer could be available twenty- four hours a day, and the lines would be void of any other communications. When discussing this and the cost with the Court Clerk , we decided it would be wise to preserve the funding until we move into the new building when there is a network system . I have expended a great deal of time trying to accommodate the needs of the court. I have never denied an expense . Supervisor Valentino - I have held up the computer modem connection because of the expense. Councilman Klein - Can the computer access be solved without a dedicated line? Mr. Carvill - The. problem is within the software . It is not a network user software . It will take special programming to do that. It can be done , but it will cost money. Councilman Klein - The Court Clerk spends a great deal of time ' driving back and forth . For a one year time period there would be a cost benefit with improved efficiency. Justice Larkin - If the work of the Justices were divided equally, the burden on the Court Clerk will be , the same. Attorney Barney - Justice Larkin' s feeling of the need for additional clerk services is in part based upon the volume of business he is doing . Justice Bordoni is saying he does not need additional help . ' One way to alleviate some of the need for additional clerk time is to put more of a burden on Justice Bordoni . PERSONS TO BE HEARD = Cont' d : John Yntema, Member of Town of Ithaca Conservation Board - Are appointments to boards made in executive session or is the public able to attend? Supervisor Valentino - The appointment is always public . Discussions are sometimes held in executive session . Attorney Barney - The appointment is a public action . If there is discussion that involves personal matters or confidential matters , it can be done in executive session . Councilwoman Harrison - There will be some discussion about appointments in today's executive session . Agenda Item No 14 = EXECUTIVE SESSION : i TOWN BOARD MINUTES PAGE 6 DECEMBER 31 , 1998 APPROVED - APPROVED - APPROVED - MARCH 8, 1999 - APPROVED - APPROVED - APPROVED Motion made by Supervisor Valentino , seconded by Councilman Klein to enter into an Executive Session to discuss personnel , and to receive legal advice from the Attorney for the Town related to litigation . Carried unanimously. The Board entered Executive Session at 10 : 35 a . m . Motion made by Supervisor Valentino , seconded by Councilman Conley to resume regular session . Carried unanimously. The Board resumed regular session at 11 : 25 a. m . Agenda Item No. 5 = Aauointments : a. Planning Board . Supervisor Valentino - Gregg Bell' s term on the Planning Board expires as of today. Councilwoman Harrison - The Interview Committee interviewed two candidates for the Planning Board seat, Candice Cornell and George Conneman . We found both candidates to be acceptable , and put both names forward to the Town Board . Supervisor Valentino - I have reviewed the Interviewing Committee' s report and results . I recommend the appointment of George Conneman to the Planning Board . Councilman Klein - I checked a reference for Mr. Conneman . I am confident he will be a good member of the Planning Board . Councilwoman Harrison - The Interview Committee felt he would be a sound contributor to the decision making process of the Planning Board . Councilman Conley - Did the Interview Committee consider re-appointing Gregg Bell ? Councilwoman Harrison - Yes . We discussed whether we should have an interview with Mr. Bell . We felt that having had some discussions about his effectiveness and how he has served in the past , that there was not a strong interest in his potential re-appointment. We decided not to interview him . Jonathan Kanter, Director - of Planning - The associate member . is not a voting position . Mrs. Noteboom - Eva Hoffmann has sent a letter requesting reappointment . Mr. Kanter - Elizabeth deProsse is willing to be re-appointed , but would prefer being an associate member. She is willing to continue as an official member until another candidate is found . There are two new candidates and the Conservation Board has sent a recommendation for full appointment . I suggest Kara Hagedorn , Eva Hoffmann , Leo Kruksuniv, and Elissa. Wolfson be appointed through 2000. ' Elizabeth deProsse could fill the vacancy with a term ending in 1999. Councilwoman Harrison - Are associate members formal? Ethics Board. Councilwoman Grigorov - Deborah Gregg lived in the Town of Ithaca when she was first appointed , but she now lives on Turner Place. Mrs . Noteboom - Our local law states allows members to live within Tompkins County. Supervisor Valentino - Shirley Raffensperger cannot serve on the Ethics Board because it has been determined it would be a "conflict of interest" with her appointment on the Southern Cayuga Lake Intermunicipal Water Commission . Beverly Livesay has volunteered to serve as the democratic member. We still have a vacancy for a republican member. Mrs. Noteboom - There are two positions open , one democrat and one republican . We need a republican member. The Ethics Board reviews the disclosure statements with the Attorney and I present at their official meeting . Supervisor Valentino - There is a quorum with the republican seat open . Mrs . Noteboom - The Ethics Board voted at their last meeting in November to appoint Debor Gregg as Chair. The local law requires that the . Agenda Item No 9 - Review/Aoaroval for Filing of the Town Justice Audit: Mr. Carvill - There are a variety of audits that an auditor uses. This is a cash receipts audit . This shows if the documents are handled properly , the receipts get remitted , and if we get the quarterly report. ' This is not a financial report. It is a review of checkbooks and the internal structural of the court system . That is what they are reporting on . These procedures are being followed . There are two recommendations included in the resolution . This gives us a clean report about the surplus money of former Town Justice Merton Wallenbeck being turned over to the town for follow- up. Supervisor Valentino - We do not receive financial sheets? Councilman Klein - This is a review of monthly bank records . Mr. Carvill - This was an audit for a period of two and half years that cost the Town $2 , 800. In prior years , it cost$ 7, 800 . This is more favorable to what we are reporting on based on the amount of work. Agenda Rem No 10 Tompkins County Board of Representative Adopting Guidelines/Allocation of Celebration Funds : Supervisor Valentino - Earlier in the year the County Board decided that each township was entitled to certain funds for celebrations . The Town was entitled to approximately $2, 500 . Receiving this revenue became more trouble than it was worth . We were turned down for funding on the historic signs . Other townships have had the same problems. I have asked the County to not allocate this money in the future, but rather have them use the money for tourism within the County. The Integrated Sewer Committee is meeting on a weekly basis to try and work through our grant approvals . The Integrated Water Committee is also going to be meeting weekly. It looks as if we will be able to reach partnership with the City of Ithaca and Cornell . The Cable Commission will be negotiating the contract . In Recreation Partnership negotiations , the Town has told the City that we will not enter into another agreement with them unless it is a Joint Activity Fund and that the recreation funds do not go through the General Fund of the City. The Youth Bureau is not really receptive to this . The Town has taken the same position concerning the negotiations on the Fire Contract . The Fire Chief is delighted to move the money to a joint fund . He has had problems figuring out where the money is coming from and going to . Councilman Klein , would you be willing to serve on the Fire Contract Negotiating Committee? Councilman Klein - How intensive will it be? I 1 = i TO : SUPERVISOR VALENTINO TOWN BOARD MEMBERS FR : CLARENCE LARKIN , TOWN JUSTICE DA : DECEMBER 15 , 1998 RE : 1999 ITHACA TOWN COURT BUDGET The purpose of this letter is to address the 1999 Budget for the Justice Court . I personally had no input on the proposed budget ; left out of the loop , so to speak . I am chalking this up to a simple break down in communication . Not withstanding the fact that I had no input , the reality of the matter is that the proposed court budget does not reflect the financial needs of the court . To reflect on the court activity during this 11 month period of 1998 , the Larkin half of the court sent the New York State Comptroller in excess of $ 142 , 000 , and Judge Bordoni ' s half of the court sent $ 43 , 000 , totalling $ 185 , 000 to date . By the end of 1998 , the total should easily show + / - $ 200 , 000 , of which approximately 30 to 35 % of this is returned to the Town . This is unprecedented for any town , village or county court in Tompkins County . I use these amounts as a barometer of the court ' s activity . Clearly , the Ithaca Town Court is the busiest Town , Village or County Court in the County . While the Ithaca Town Court stands at $ 185 , 000 , with one full time clerk , Dryden Town Court stands at $ 167 , 000 with two ( 2 ) full time court clerks and Lansing at $ 87 , 000 with two ( 2 ) full time court clerks . Currently , Michelle is granted 4 hours per day for three days . Michelle is an outstanding worker but physically has been unable to keep up with the workload , leaving Betty to work up to 14 hours per day . Further , Michelle has submitted her resignation effective December 31 , 1998 , to become the full time Court Clerk for the Town of Ulysses Town Court . A reasonable approach would be for me to appoint an additional full time court clerk now . However , it may be a better time to consider this move when the court has it ' s own court facilities in the new Town Hall . It is vital that Michelle be replaced by a competent person with expanded hours . Therefore , as head of the Department , I am creating the position of As Court Clerk at the rate - of $ 12 . 00 per hour with a thirty hour week , to begin January 1 , 1999 . The assistant court clerk would be able to perform all of the duties of the court clerk at any time . Further , Clerk Poole should be compensated for her mileage . She spends an inordinate amount of time on the road to the court office , to Town Hall , to Judge Bordoni ' s and then all over again . ATTACHMENT # 1 1999 Budget Town Court Memo One further comment . I personally have spent a lot of money renovating a portion of my home , which had no heat , electric , no work space , into a workable court office to accommodate the necessary equipment and supplies to run the court efficiently and effectively . Further , as a result of being personally harassed by persons unknown , but certainly court related , I must invest in a security system not only for my personal protection but , for the , protection of the court operations and equipment . I am looking for monthly rental income of $ 350 to compensate me for the cost of the conversion to the court offices and for the intrusions on my personal privacy . I consider the creation of the Assistant Court Clerk position and compensation set in stone . In 1998 , Town Justice expenditures for the A1110 appropriation line items totaled $72 ,454 . 57 with an additional amount of approximately $20 , 525 expended for employee fringe benefits . Your revenues for 1998 are $59 , 037 . For 1999 , we have appropriated $73 , 700 for the A1110 appropriation line items with an additional amount of approximately $22 ,400 for employee fringe benefits . Court revenues do not cover your costs , and the Town of Ithaca has been subsidizing your budget. Also , these costs do not include Town of Ithaca staff time to accommodate the Town Justice' s . Generally, the fees for the services would be calculated on an hourly basis. Occasionally, when we determine that perhaps more time was spent on a matter than might seem appropriate for the result obtained, the fee may be reduced. On rare occasions, and after consultation with the Town, when the time spent is not truly reflective of the value of the benefits obtained by the Town, we might request an upward adjustment for that particular matter. 5 . For 1999 , the hourly rate will be $ 135 .00 for partners and $ 110.00 for associates. This represents approximately 15 % off our normal hourly rates (for existing non- municipal clients our basic rates in 1999 are expected to be $ 160.00 per hour for partners and $ 125.00 per hour for associates - new non-municipal clients may be charged higher rates) . If the Town chose to continue us for ensuing years, it would be our intention to bill at a similar discount from normal hourly rates as then in effect. r 61 The arrangements outlined in this letter may be ended at any time by either party; for any reason, or for no reason at all. One of the essential elements of a successful client-attorney relationship is mutual comfort with each other. If that does not exist, the Town should not have to wait until the end of a year to seek other counsel. Obviously, if a change were being contemplated by either of us, we would hope that whoever is deciding to end the relationship would provide as much lead time as possible to the other so appropriate adjustments and transitions might occur, but lengthy advance notice is not a required precondition to severing the relationship . In . the event of such severance , we would cooperate fully in transferring files and information to the counsel chosen by the Town and would, of course , expect to receive the agreed compensation up through the . completion of the transition. If the arrangements stated above meet with the Town ' s approval, perhaps it would be wise to execute duplicate copies of this letter for our respective files . Acaenda Item No. 4 - Report of Fire Commissioner. Robert Rowmanowski , IFD - The County Capital Budget is in place for Phase I , of the 800 Megahertz Trunking Radio System. There has been no change in the number of volunteer fire fighters which is an ongoing problem . There will be a public hearing , Tuesday, January 12, 1999, on the Place of Assembly Occupancy Ordinance. A questionnaire was mailed to . former volunteers to find out why they decided to no longer be volunteer fire fighters. Most responded with positive reasons. Some responses were housing costs, training , issues, and an overload of the number of hours required to be a volunteer fireman. One response stated there was a personality conflict, Commissioner Jahn asked that a discussion take place at the January meeting regarding Ithaca College's lack of financial ' contribution for fire service. I have been instructed to speak to Supervisor Valentino concerning this matter. upervisor Valentino - Mayor Cohen and representatives of Ithaca College and I will be having a eeting to address the issue . Mr. Rowmanowski - I have received numerous telephone calls protesting the tax rate per thousand for fire protection in the Town of Ithaca. I explained that the Commissioners do not set the rate, and sales tax revenue has been used as a partial subsidy to keep the rates in previous years lower. The amount of sales tax has decreased which results in the rate having to be increased . A number of TOWN BOARD MINUTES PAGE 2 JANUARY 11 , 1999 APPROVED - APPROVED - APPROVED - FEBRUARY 8, 1999 - APPROVED - APPROVED - APPROVED callers were concerned about the part time coverage of Station Number Six. The lack of financial help from Ithaca College was also mentioned. Callers were also asking what the City of Ithaca tax payers are paying for fire protection compared to the Town of Ithaca taxpayers. The last concern stated was the general lack of business investments in the Town and City Ithaca to stabilize property values and tax burdens. I explained the amount of fire protection a municipality has reflects on the fire insurance rate that they are charged. Since the Town and City of Ithaca have a high rating, the insurance rates per thousand of assessed value is much lower than other municipalities. There was a court decision made on retrofitting fire alarms before 1984. The provision requiring fire alarm systems in buildings with multiple housing was defeated. Owners who have retroactively fitted fire alarm systems have had a lessening of fire damage. The fire suppression rate is higher. There are more calls for medical emergency services than for fire calls. Fire calls are between 5%-10% of all calls. Councilwoman Grigorov - Have there been a number of fires at retrofitted locations? Mr. Rowmanowski - No. Most of the fire call responses to Cornell or the East Hill area have been of short duration. The amount of fire damage has been much less. Year end statistics are not ready, and will be forwarded to the town when they are ready. Councilman Klein - Would it be appropriate for Mr. Rowmanowski to participate in the Fire Contract negotiations? Mr. Rowmanowski - I would be willing to help with the negotiations. Supervisor Valentino - The next meeting of the Tompkins County Municipal Officer's is January 19, 1999, at the Lehigh Valley House at 6: 00 p. m. If anyone is interested in going please notify me. I received a phone call from a resident of Circle Lane regarding their water and sewer benefit assessments on their tax bills. We had corrected their tax bill last year, but the bills are wrong again this year. There are changes which were forwarded to the County that were not made. Would the Town Board give me the authority to issue refunds for the bills that were ' not corrected as they should have been? Attorney Barney - Do we know which properties and the amount? Supervisor Valentino - We do not have that information tonight. Attorney Barney - They should be approved by a formal authorization of the Town Board, Councilman Conley - Is this something that was submitted to the County and not handled right? This has . happened before. Changes are made and they send the Town a sheet showing it is changed. Some time between when the corrections are acknowledged and when they appear on the tax bill the correction is not recorded. At first the employees at the County would not admit there were any mistakes . t They keep insisting that it has been corrected, but it has not. ouncilwoman Russell - Were the changes made to the Special Benefit Assessment correct? aniel Walker, Town Engineer - In general , all the reductions went through. The ones missed had e new formula applied and had been given special exemptions. The special exemptions had not been checked again . Councilwoman Russell - Did this happen to all parcels served in the Agricultural District? Mr. Walker - There were only a couple in the Agricultural District that saw a reduction. We are trying to keep track of parcel counts. There were 40-50 extra parcels the County showed due to the aged exemptions and the STAR Program, The County created sub-parcels from the large parcels. Mrs. Noteboom - I received notification from the Assessment Department that they will be sending over an order to correct the roll . There are several parcels eligible for veteran and senior citizen exemptions that were over evaluated or not evaluated. I have explained the property owner must pay the ,bill entirely, then be given the refund. I was told that in regards to veteran and senior citizen exemptions corrections, I am to create new tax bills and send them to the property owners. I received instructions to prepare six new tax billings because of apportionment's prior to the bills being sent out. They were completed and sent. The County sent me a facsimile of those same apportionment's today. They could not remember if they had been sent to us. Councilman Conley - Are other towns having the same problem? Mrs. Noteboom - Yes. Agenda Item No. 5 - PERSONS TO BE HEARD. (See Attachment #1 ) sor Valentino - The Coddington Road Community Center representatives contacted me about receiving a letter of support for the property additions they want to make. We decided to wait to write such a letter until we had knowledge that their septic system would support the improvements. Since , then they ' have given us information from the County saying that their septic system is adequate. Does the Town Board want me to write a letter of support? Councilwoman Harrison - Would we send a letter of support for other such. organizations? Supervisor Valentino - Yes. We have done it for others. Councilwoman Grigorov - I would not be enthusiastic about supporting something in another area. Councilman Conley - The Community Center is talking about adding more students and functions. Councilwoman Russell - The traffic and parking will need to be reviewed. Supervisor Valentino - The addition to the parking lot would not be for long-term parking. Most of the traffic would be parents picking up and dropping off their children. The parking problem occurs when sports events are held there. Fred Noteboom, Highway Superintendent - We have talked about additions to the parking lot. They have also talked with the County, and have applied to the TIP program to include the Coddington Road Community Center. We are now considering raising the exits for a better line of sight. Councilman Conley - Are they asking for funding. from the Town? Jonathan Kanter, Town Planner - On the bottom of their letter they mention the Town Budget process . b. Nell Mondy, Honness Lane. Supervisor Valentino - Councilman Conley will be serving on the Safety Committee. I would like to wait to make the appointment to the Cayuga Lake Watershed Management Intermunicipal Organization . Councilwoman Russell - Are there any appointments needing to be made to the Joint Youth Commission? Mrs. Noteboom - We have one seat open . A gentleman contacted us expressing his interest in serving, but said he would not be able to until the spring . He will contact us then if he is able to serve . Supervisor Valentino - I am having a meeting January 12, about the contracts for youth services recommended by the Joint Youth Commission . The Commission is going to make recommendations for youth programs this year which are not through contracts with the City of Ithaca Youth Bureau. The Commission members also wanted to have discussions before the Recreation Partnership meeting with Mayor Cohen. This is the final year for funding of the Recreation Partnership. Even though the Joint Youth Commission is separate, in some ways they reflect on each other. We want the Recreation Partnership budget to be accounted for within a Joint Activity Fund so that we can monitor the money. We want to see a new arrangement of how things are done. The City of Ithaca is not as willing to go to a joint fund for the Recreation4Partnership as they are for the fire contract. Supervisor Valentino - Is there a change in the income limits this year? Mrs. Noteboom - There is a change in the income limits and is directly related to how the STAR Program is set up. Ed Hughes stated he would provide me with numbers within the next week. Councilman Conley - Does this automatically qualify people who have signed up for the STAR Program? Mrs. Noteboom - No. Everyone will receive the benefit of the STAR Program beginning next year if they have filled out the form the County sent a few weeks ago. The STAR only affects school taxes . for senior citizens until the 2000 tax year. This program is different. This is an exemption for senior citizens with limited incomes allowed under state legislation a long time ago. The STAR legislation is new and has a three year time limit. Councilman Conley - Do they need to apply separately for this and the STAR program? Mrs. Noteboom - Yes. They do need to apply separately. If this proposed local law is passed and a senior citizen has already received this benefit previously, they would automatically be eligible for the exemption of this amended law. Councilwoman Russell - STAR will affect our real property tax rules. Mrs. Noteboom - The State of New York will pay the cost of reducing assessments on each parcel for the next three years. The state will reimburse the municipality for the loss of tax revenue because of the reduction of the assessment through the STAR program . We have some employees outside the area . covered under PHP , but are able to get health insurance on their own. Councilman Klein - Is it a direct cash payment? Judith Drake, Human Resource Specialist - Insurance carriers will only accept payment from a business or town under a contract. . Supervisor Valentino - We would need to set up a system where the employee shows us they have paid the premiums and then reimburse the employee. Will we need to fill out an Internal Revenue 1099 form for the payments? Attorney Barney - That would need to be researched. The problem is they have town officials tracking the time they spend each week on town business. . That means rather large pay checks. They are asking for an average of the salary instead. Councilwoman Russell - The volunteer service resolution asks for a reduction in the time required for I i ning and certification of volunteers. Will it be safe to cut back on training for volunteer services? uncilman Conley - One of the problems volunteers are have is the amount of training the State is uires. The time commitment to get this training makes it almost impossible for anyone to do ything other than be a volunteer. People have to be unemployed to attend all the training. Supervisor Valentino - There are many associations in favor of this resolution passing because the time commitment has caused them to lose many volunteers. Councilwoman Grigorov - Two years ago there was a seminar on Town/Village Justices. If there is another session this year someone should go. There are state guidelines for the size of the courtrooms. They have spent a fair amount of oney on the project. There is a total of $45, 000 needed to complete the study. We have been sked to adopt a resolution requesting that the County complete the study. Councilwoman Harrison - This data would tell whether there is water located at a certain location, not about the water quality. Mr. Kanter - This is not in the County Budget. What happens if the County wants the communities supporting it to invest money? Is the Town Board prepared to invest in this? Supervisor Valentino - It is something the County has budgeted before. Some of the things we are supposed to do throughout the year might change some. Mr. Noteboom There are no plans to change anything there. The Town of Dryden is doing more work. They are putting in a gutter system and bikeways on the hillside. They also have plans to put in trails. It seems like the appropriate time to work on our portion so that it blends in with theirs. I talked with Jim Schug and met with Dave Putman about the project. upervisor Valentino - Did we already complete the project on Maple Avenue? Councilwoman Harrison - We talked about the project a lot, but it has not been started . Councilwoman Russell - Is this an inclusive list of improvements to be made this year? Mr. Noteboom - It is not all inclusive. There are no parks and trails in this because it is highway money. We do not know where we are going yet with the parks and trails. I have applied to the TIP program with the state for some of the work. Councilman Conley - Is that with Cornell or Forest Home? Supervisor Valentino - It is in the NESTS study area. Councilman Klein - Is there a sketch plan? Mr. Walker - Cornell University has a plan to redo a portion of Campus Road between Tower Road and Caldwell Road this summer. They are planning to rebuild the road surface and put in longer curbs. There will not be as many curb cuts from a lot into the road. They are going to take a chunk out of the ' median strips that go between the different parking lanes so that there will be a circulation road within the parking lot. We are going to coordinate our design on Caldwell Road with their design. We may talk them into doing that portion of Caldwell Road out to Route 366. It will be three lanes between Campus Road and Route 366 so there will be left turn lanes and a median. Resolution No. 12 - Agreement for the Expenditures of Highway Monies. Supervisor Valentino - We should include the status of the Town Hall . Mrs. Noteboom - There should be an article on the STAR Program explaining it is available to all tax payers next year. Councilman Conley - Should we provide information on the projects we anticipate doing during the construction season? Mr. Noteboom - It is important to notify the neighborhood. We have sent out a letter to residents of the Saranac Way and Deer Run areas because it will be one of our early spring projects. Supervisor Valentino - We should include an article about the process the Town needs to go through for reducing speed limits. It will help the public to better understand that the Town Board does not have any power related to the decision . Mr. Kanter - We are thinking of initiating a new series on overall functions of the Town . In each newsletter we would focus on a department. This would include the functions, staff, and contacts within the department. Councilwoman Russell - A short article letting people know the services available from the Coddington Road Community Center should be included. Supervisor Valentino - How many have you had in the Town of Ithaca? Mr. Walker - We had one on New Year's day, one Saturday, and one Sunday. Mr. Noteboom - There was a break on Snyder Hill last night. It caused the most problems. Mr. Walker - Snyder Hill is the only break we have done in the middle of the night. The drainage systems started wetting the floors. Working in the dark slows everything down. We also happened to hit a sewer line when doing the back fill . The one on New Year's Day was discovered the Thursday before. It was not causing any problems and the water was going into the ditch . c. Director of Engineering. (See Attachment #8) Mr. Walker - I have a schedule for the Post Office renovations. They are in their design stage. I am meeting with them January 19, 1999 at 11: 00 a. m. They have incorporated the comments we made at the last meeting . I have not been able to find anyone who knows the status of their design. Councilman Klein - What does the time frame look like? Mr. Walker - The designs will be done by the end of February. We are looking at bidding the job in May with construction starting in June. It will be completed by October 25. July 1 , is the Towns occupancy date. I do not know if the Post Office will complete their project by that date based on the progress they are making so far. We are going to be starting some work even if they are not totally out. We will need to negotiate with them because they are not going to meet their deadline. Councilman Klein - Legally, they do not have to allow us to do any worts until July 1 . fr. Walker - We are hoping to bid the job and then start construction. The roofing construction will e the first thing we start. louncilman Klein - We should be prepared to start construction July 1 . Mr. Walker - We can do the roof repair without interfering with anything the Post Office is doing . We are working on the integrated water system . Things are moving ahead smoothly. (See Attachment #9) Mr. Kanter - The Water Resources Committee had a meeting on December 8, 1998. People were invited to comment on the draft of the Water Resources Ordinance. We are still waiting for comments anyone else would like to submit. The next step is to do a revised draft of the Water Resources Ordinance, and then submit it to Codes and Ordinances for review. e. Director of Building/Zoning. (See Attacment #10) Mr. Frost - At the next meeting I will discuss construction activity and building permits for this - past year. We have not been able to complete the annual report. We had four fires in the month of December. Two were major and one did result in the loss of life. That makes two deaths in the last two months. We have had two more fires in the first week of January. Supervisor Valentino - Is this more than we usually see? Mr. Frost - In the winter we have more electrical fires. Councilwoman Russell - Where was the death? Mr. Frost - The death occurred at the Gray Haven Motel in a two family home on the motel's property. A transient person had been there eleven days. He was cooking something late in the night and fell asleep. It was an interesting fire in that the building was well insulated and air tight. The fire began from cooking oil on the stove. It burnt itself out. The gentlemen woke-up, tried to get dressed and get out, but did not make it. We think the fire occurred about 3: 00 a. m . on a Saturday morning. No one heard or saw anything. Someone walking by about 1 : 00 p. m . . later that day noticed the windows were charcoal looking and called 911 . Fire Department personnel department broke into the apartment. There was no smoke. I have pictures of the fire. f. Human Resources Specialist. (See Attachment #11 ) Mrs.. Drake - We are compiling the final count of persons attending Michael Ocello's retirement dinner. If any of you are interested, please let us know. g. Budget Officer. Al Carvill , Budget Officer - All cooperative funds have exceeded their revenue expectations, and all funds have under expended what was budgeted . Interest rates are a major concern as income productivity because of the loss of sales tax revenue. Fund balances are very strong . There was more in water than sewer. 'The residual of the . sewer debt of the bond is more proportioned to sewer than water. There was the historical adjustment of $215, 000 on the BAN ( Bond Anticipation Note) . that was paid and recorded incorrectly in 1995. That created another increase of cash in the . sewer fund. irecting and correcting some of these are some of the things Mr. Walker and I have worked on. We ave been processing rapid billing for services being rendered, and reimbursement for repairing xpenditures. We will continue to see i in 1999 the same proportionate ratio as in 1998. Supervisor Valentino and 1 tried to maintain a 15-20°x6 fund balance. The Town of Ithaca should go into the year' 2000 healthy. Councilman Conley - How many employees have direct deposit of their payroll checks? Mrs. Drake - About 60% of the payroll is direct deposit. Councilman Conley - How long before the pay day does the money need to be there? Mrs. Drake - We need, to have it there by 9: 00 a. m. Wednesday morning for a Friday morning payroll . Mr. Carvill - A good question is how much interest income we are losing on cash flow we give the bank. The amount of that is relatively small . Councilman Conley - The County will not go to direct deposit. They say they have a $2. 3 million dollar payroll . They feel the two days would cost them too much. Mr. Carvill - It is a negotiable item for services with the bank. That account could be a clearing account. Our desire' to to add one multi-purpose room and to fix the building we have, is driven by our Board' s commitment to: 1 . ensure long term viability of CRCC by providing a multi- purpose room adaptable to a wide variety of program uses 2 . provide more after school program spaces for elementary aged children of working parents . As you know , we started the After School Program at South Hill School and nurtured it into independence from us. For some time now, that program now hasA waiting list, as does Belle Sherman 3 . to expand multi-generational and whole family programming 4 . make our facilities handicapped accessible. We are looking for private as well a public agency funding sources. and we would like to be able to say that the Town supports ,our efforts. In particular, if we seek funding from the Appalachian Regional Commission, whose fundable program goals match our goals very nicely, we will need Town as well as County support. We need support in general, perhaps a statement from you, or the planner, or perhaps a resolution from the Town Board. (We do not need i support for a specific design as this stage, and indeed, we are not in any way seeking to "end run" the Town' s planning/ zoning review process.) I realize that sewers in relation to our program expansion are topic of debate. All of our toilets are low flow. Last Dec. ( 1997) , John Andersson, Dir. of The Environmental Health Div . of Tompkins County reviewed our proposed addition and declared our present septic system adequate for our new , proposed plan and uses . This is reported in our project easibility study (Jan. 1998, Schickel Architects) . However, since that time , we have increased the size of our proposed multi-purpose room to make it large enough to house 24 (instead of 18) after- school program spaces . We were concerned about the impact of this increase on our septic system and again asked Mr. Andersson to evaluate the adequacy of our - more - ATTACHMENT # 1 septic system in light of the new programs . We also asked him to comment on procedures/costs of constructing a new system, should our present system fail at some time in the future. He has written back and I have enclosed a copy of his response, for you to share with the Town Board. I will contact you in the next few months for a letter of support after I meet with the Appalachian Regional Commission people. Meanwhile, because funding is hard to find, we are trying to think of spaces in the greater South Hill/Belle Sherman areas where we might be able to initiate and operate an After School Program: If you have any thoughts or suggestions about places we could try, I ' d love to hear them. Morrissette: I ''am responding to Louise Mudrak's letter asking the impact on the sewage system if the CRCC provides for 24 children in the after school program instead of 18 as proposed in 1997 . This is only a small increase . I calculated the sewage system design flow using the actual average water use from 1997 , which was about 250 gallons per day (gpd) . Designing for peak flows of about 15 times the average, a system with a design of at least 375 gpd was needed. The existing system has a design flow of 450 gpd. We were told in 1997 that the system was serving about 30 full-time persons. Adding 24 children for 2-3 hours a day would increase the full-time equivalent by 12 . Thus a systern now needs to serve 42 full-time people, or 1 .4 times the olds 1-14 times 375 or is 525 gpd design needed. However, since all toilets are now low flow units , the design can be reduced by 20% , resulting in a design flow of 420 gpd, which is close to but less than the 450 gpd existing system. It is hard to calculate the impact of the occasional community meeting, but the system should be able to handle infrequent higher flows. In summary , we do not consider the increase a conversion of dse needing a new sewage permit, and we expect the system to function well. However, one never knows how long any system will last. Wl;.n the system fails, as it will someday , the procedure to replace it starts with an application for a sewage system construction permit. We will then determine the proper design flow based on recent water use and building use; investigate the site for the replacement system, and if all is satisfactory issue a permit to build a new system. We can not estimate the cost of a replacement system; if you want an approximate cost you could ask a contractor for the price range of a sand filter to serve a 4 bedroom house . However, the cost is dependent many things like location , size , whether a pump is needed, if septic tanks need to be replaced, and type of downstream system. It is better to keep the existing system functioning as long as possible by pumping the septic tank regularly (every 2- 3 years), repairing water leaks, and not flushing chemicals or solid wastes into the system. -more- ATTACHMENT # 1 JRecycled paper CRCC 13aug98 p2/2 As part of the Day Care facility, the, kitchen is inspected regularly by our staff. In 1997, when I spoke with Mr. Schickle, I asked for plans of the new kitchen and was advised they were not complete but we would receive them. We have not yet. Please send us the kitchen layout, with the listing of the exact model and size of equipment to be installed, along with a description of the type and frequency of foods to be prepared. Recently the Ithaca Town Board passed an ordinance that permits adult entertainment businesses to operate in two locations in the Town. Both of these sites are in the Inlet Valley area and are very close to the neighborhood that I live in. One of these sites is close to a state park and the second is near a school. It does not seem fair that both locations are in one section of the Town of Ithaca and next to places where children learn and play with their families. Would any of you Board Members like to see this type of business located in your neighborhood? I would appreciate it if you would explain your decision to me. I have five topics I wish to address : First : The , lead story In the latest edition of the town ' s news letter by Mr. Kline was of great interest, however, it is my opinion , that once again the town income property owners have been shortchanged . Charges 'for water and sewer within this current formula adopted by the town board on September 81h , do not level the playing field for the town income property owners , who , for years have been over paying for water and sewer service, they will continue to do . the same. Example : persons who live in large single family homes with six bathrooms and six members in the household , will be charged a ONE UNIT TAX for water and sewer service plus use ^.harges , just as in the past. However, an income property, consisting of four separate units . jith fours full bathrooms and two half bathrooms total , while occupied by only five tenants for the entire building , will still be required to pay a FOUR UNIT TAX for water and sewer service plus use charges . Is this a new formula ? No . Is this equitable and fair for the income property 'owner? No. All charges and fees should be based solely upon usage, not the number of units in a building or on a property . Second . A cost increase of 63 cents per thousand dollars of assessed property value for fire protection is unacceptable . The town has been , and continues to be, held hostage by the city of Ithaca and it ' s fire regimen . I am sure you are aware that for the last ten years , the single largest increase in the town tax rate has been for fire protection . The town has never received from the Ithaca fire department what it was paying for and probably never will . The Ithaca fire department is doing and giving less , while at the same time, telling the Town of Ithaca and city more is needed . When the fire department does not get what the l eh list calls for, they revert to the long standing hot button topic " it 's a life safety issue" nking this is sure to sway all involved to cave in to their demands. This pattern must me to an end . Much closer scrutiny needs to be placed on the internal workings of the department . It is , in my opinion , nothing more than a management problem . You and others should be very surprised in what is found with regards to staffing and personnel , assuming access is ever gained . However, I feel you are on the right track in your exploration of other options for fire protection . Do not be bullied, the city of Ithaca needs _ ,ie Town of Ithaca more than the Town of Ithaca needs the city Ithaca . ATTACHMENT # 3 Third . Since purchasing a Sapsucker Woods Rd . four unit income property in 1990 , and abiding by the OWNER OCCUPANCY deed restrictions imposed by the Town of Ithaca . I have witnessed taxes increase at a factor many times greater than the rate of inflation , witnessed no improvement in services delivered to my property, ( after repeated attempts to have the ditch in front of my property cleaned ) while property values decline faster than other income property in the town . Why? Owner occupancy deed restrictions imposed by the Town of Ithaca . Given the Town of Ithaca ' s inability and or unwillingness to enforce the existing owner occupancy deed restrictions as written , which were established , albeit for no other reason , than to " make things tough for Rocco Lucente" this is a direct quote from a town board member who helped draft the restriction . I would like to suggest the Town of Ithaca begin exploring options , which would remove the owner occupancy deed restrictions from the Sapsucker Woods Rd four unit . homes . There are many ways the town of Ithaca could exercise measures of control to assure the quality of living in this the area , if this is really what the Town of Ithaca is concerned about. Owner occupancy has not worked ; existing deed restrictions have done little more than expedite the devaluation of real property values and forced people to loose their property, this is not what zoning was adopted to do. I would like to purchase additional units , but that is not possible with the zoning laws as written . Removing the owner occupancy deed restrictions, would be a simple and logical way for the Town of Ithaca to help increase the property values . In addition to reversing a prior boards shortsighted policies, avoid an extended and costly legal entanglement , which ultimately , the town knows is forth coming and will not win . This would be beneficial for all parties involved. Fourth . I have become extremely concerned about the amount of Town resources and funds , which have been earmarked for the parks department . At a time when revenues are declining , assessments are fallings does the expansion of the parks department , however well intentioned , need to be at these levels of funding ? Closer scrutiny of the parks department with a focus on the level of funding and service .provided is critical . Fifth : Purchase of the Post Office for the new town hall , even though , not the first choice was a great accomplishment , I commended all persons involved . I look forward to your input . Town Clerk's Monthly Report December 1998 Presented : Town Board Meeting , January 11 , 1999 Town Clerk : A great deal of activity in the office occurred as a result of the normal increase in dog license sales during December. Deputy Town Clerk, Mary Saxton completed the reference listing of persons who serve on various Town of Ithaca Boards and Committees. This reference was reviewed by the Town Supervisor and was very helpful in determining the needed appointments for 1999. All other daily functions were performed , including preparations for two Town Board meetings in the month . All letters to those individuals appointed to various boards and committees , by the Town Board on December 31 , 1998 have been sent, along with a certified copy of the Resolution of Appointment. Tax Collection : The 1999 Town and County Tax Bills were sent to property owners on December 31 , 1998 . Preparation of the billings was extensive this year as it was necessary to separate those billings to be sent to the escrow agent, TransAmerica . Tompkins County neglected to encode this agent properly on their computer software so the billings did not properly reflect where the bill should be sent. Even though this created a more extensive sorting process , it actually enabled us to 'sort the billings according to changes of address and names received after the taxable status date . Often times we receive correspondence from property owners asking us to change the name or address at the next billing cycle . Tompkins County has not been able to accommodate these requests on a timely basis. We keep those requests during the year, and when time permits , " pull the bill" before mailing and send it according to the correspondence . The mistake by Tompkins County of not encoding the escrow agent benefitted some of our taxpayer's even though it took more staff time . We were also able to sort for numerous billings to the same property owner, i . e . Cornell University, Ithaca College , etc. Any property owner receiving more than three billings received them in a large bundle rather than separately by bulk mailing . This saves in I ostage , and staff time later on when we have to search for a billing which was not received by owners with numerous properties . Thus far, the tax season is off to a good start. Staff, as usual , are ".rising to the occasion " , and assuming their duties in an exemplary manner. We have rolled this project over to 1999 . We will be able to do a more complete project in 1999 . We have submitted the paper work for Tompkins County Soil and Water Conservation grant on Dewitt Pond. We will be submitting the work for Christopher Lane in January . We have not heard from them but will be contacting them this month. The West King Road bridge project has been completed except for the paving, which will be completed in the Spring of 1999 . We are not satisfied with the guide rail on the southwest approach to the bridge, though. The guide rails that were installed do not adequately protect the traveling public from the gorge when the road is slippery. We will be working with the County to rectify this. Deputy Highway Superintendent's We were able to finish the storm water management project on Christopher Lane in December. This took 380 hours of time . There are a few " finishing touches" to be done in the spring. Other projects worked on in December included trimming and cutting brush and trees. These projects took 105 hours of time . Several General Repairs projects, which took 632.5 hours of time, include work at the Highway facilities, patching roads, and sign maintenance. Maintenance of the Town' s fleet took 184 hours of time . There were two water main breaks, one on Blackstone Avenue and one on Winthrop Drive . These, along with other water main maintenance; took 283 .5 hours of time. Of those hours, 39 were overtime. Sewer maintenance took 16 hours of time. We did, towards the end of the month, have the opportunity for snow removal. This took 353 . 5 hours of time . 30 hours of that time was overtime . Because of the unusually dry, warm weather, the Highway crews were able to start locating the utilities on Saranac Way . This street is scheduled to be repaved in 1999. ATTACHMENT # 7 Agenda Item 18b This work took 40 hours of time . Along with this, we were able to put in underground drainage pipe in W . King Road . This took 146 .5 hours . Parks Maintenance Manager' s During December most of the work done in the Parks was general maintenance of the parks and trails . This took 305 hours of time . We did work on brush and tree removal on the South Hill Trail, along with some clearing at the Iacovelli Park site. These endeavors took 48 hours of time. Again, because of the snow fall during the end of the month, we spent 81 .5 hours of time on removal of snow and ice on the trails. Tanuary Projects 1 . Snow Removal 2. Tree and Brush Removal 3 . Town Engineer's Report for 1 /11/99 Town Board Meeting GENERAL Mike Ocello retired on December 26, 1998, taking advantage of the latest early retirement option offered_by the Town. With his retirement, the position of Assistant to the Town Engineer has been eliminated To replace that position an entry level engineering position has been created with the title of Civil Engineer. This position has been filled by promoting Chuck White from Engineering Technician into the Civil Engineering position. Chuck has been working for the Town as the Water and Sewer Engineering Technician for more than three years and will continue to be an important part of the Engineering staff in the new position. The Engineering Technician position should be filled by the end .of January. The Town engineers staff has continued to work with the records management staff on the development of a network plait to serve the town staff. This has been a very cooperative experience and is working well. DEVELOPMENT REVIEW Sterling House and Cottage, Trumansburg Road at Bundy Road The Contractor has completed installation and testing of the 8" w•atermain and building services. This water main will serve both parcels and includes the fire hydrants necessary to protect the buildings. After receipt of the record drawings the Town Engineer will recommend acceptance of the watermain to the Town Board. Construction of the sanitary sewer main is also nearing completion. This sewer main will also serve both Sterling properties and will serve the Perry house plus potential development above the Sterling site. After completion and testing this sanitary sewer main will also be dedicated to the Town. EARTH FILL PERMITS No new earth fill permits were issued during December. WATER PROJECTS The Town Engineer is continuing to work with the Integrated Water Supply Committee consisting of representatives of the City, the S.C.L.I.W.C. and Cornell University Utilities. The O'brienand Gere Engineers Comprehensive Water System Evaluation report, issued in October 1997 has provided a recommendation on how the three separate water systems could be connected and operated as one system and how this maybe a way to reduce water supply costs for our customers. The Committee has been meeting frequently and during January will be meeting weekly to develop a draft agreement for implementation of an integrated system. The Town Engineer' s staff is preparing an engineering report covering the inspection and recommendations for replacement of the Warren Road water main. This is an old cast iron water main with a history of frequent breaks. The existing main is also along the edge of pavement in the existing shoulder of Warren Road, and will be under the pavement for the rehabilitated roadway in many locations. The replacement proposal is to replace the watermain completely and relocate it to the west side of the right of way outside the pavement and shoulder. This work would be coordinated with the County plans to reconstruct Warren Road in 1999. ATTACHMENT # 8 TOWN ENGINEERS REPORT 1 / 11 /99 PAGE 2 SEWER PROJECTS The Town Engineer' s staff is preparing an engineering report covering the ' inspection and recommendations for replacement of the Warren Road sewer main. A video inspection has been completed, and confirms that the sewermain has numerous joints with root intrusion and other defects. Based on this information the Town Engineer is preparing a proposal and recommendation to replace and/or reline the sewer main This work would take advantage of the County plans to reconstruct Warren Road in 1999 . Staff has been working to improve our sewer maintenance maps and data base by inputing information from the current paper record drawings into Arc View electronic files. STORMWATER Development of the Townwide watershed evaluation is continuing. Base maps were developed utilizing the digital planimetric map. TOWNHALL The Town Hall final design is now back on track after finalization of the purchase of the Tioga Street Building. The Architect has been given comments on the preliminary design and is developing a final design and contract document schedule that will allow us to move ahead with construction as soon as the Post Office has completed their work. The Town Engineer is also working with the Post Office to coordinate their design effort and the various. reviews the Town will have for the project. Thomas Associates, the USPS architect, is completing design drawings for the new Postal Store and entrance on Tioga street. They are proposing a glass atrium which will incorporate an emsting window on the 1960's addition as the actual entrance into the building space and a landscaped walk way from the main sidewalk. The design appears to be consistent with historic preservation standards of additions which complement the axisting structure. Said modifications include converting vacant restaurant space on the lower level of the Inn to guest rooms and rearranging the floor layout of the second level, replacing an existing fence surrounding the pool area, constructing a new retaining wall and walkway at the east end of the main building (Building A), and other modifications . Town of Ithaca Tax Parcel No . 62-2-13 .7, Business District C . December 15, 108 Meeting: (Cancelled due to lack of agenda items) CURRENT PLANNING DEPARTMENT PROJECTS The following are accomplishments or issues that have been dealt with over the past month. ATTACHMENT #9 SEOR Reviews for Zoning Board : One additional SEQR review, for the Zoning Board was done since the December report, which was for the Best Western University Inn modifications described above as a December 1st Planning Board agenda item . Codes and Ordinances Committee : The Codes and Ordinances Committee met on December 16, 1998, and discussed the most recent draft of the revised zoning chapter regarding special permits and special approvals. A revised draft chapter on site plan approval was also distributed, which incorporated discussions from previous meetings . The Water Resources Ordinance Committee met with various Town boards and officials on Tuesday December 8 , 1998 to discuss the preliminary draft of the proposed water resources ordinance. The meeting was well attended and' provided a forum to initiate discussion and feedback regarding the proposed ordinance. Individuals have been asked to submit additional comments in writing, after which a revised draft will be prepared for discussion with the full Codes and Ordinances Committee. The next meeting of the Codes and Ordinances Committee is scheduled for January 20, 1999 . Proposed agenda items include review of the most recent draft of the revised zoning chapter regarding non-conforming uses; discussion regarding the 1999 work plan, including strategies and timetable for completing the comprehensive zoning revisions; and preliminary discussion regarding possible revisions to the Zoning map . Northeast Subarea Transportation Study (NESTS) : The Client Committee met on December 4, 1998, and the Working Group met on December 10, 1998. The primary progress involved a presentation by the consultant regarding results of the modelling of the road network to analyze possible alternatives (such as the construction of a new by-pass road to divert traffic from residential neighborhoods). Several conceptual alignments for a possible north-south connector road have been identified and analyzed . The preliminary modelling results indicate that such a by-pass road would reduce traffic growth enough in residential areas to make it worthwhile to pursue as an option. The Director of Planning has been involved in meetings of a sub-committee looking at cross-cutting alternatives, which include . the by-pass road mentioned above, as well as other localized connector roads and paths . Neighborhood liveability has become a primary concern of the study . A subcommittee has been formed to look into ways to improve liveability through such means as traffic calming, land use planning options, transit accessibility, etc. The Director of Planning is also involved in this subcommittee . Both the Client Committee and Working Group have discussed the possibility of extending the timeframe to complete the NESTS Study. It has been agreed that an extension through March 1999 is necessary and acceptable to all involved (but no longer than March since Working Group members have committed significant time and efforts to this study) . Details of funding, consultant contract extensions, etc. will have 2 to be worked out with the ITCTC . The proposed revised timeframe for project completion is as follows: Tan . 21 , 1999: Working Group meeting to work on alternatives and draft recommendations. Feb. 11 , 1999: Working Group meeting to finalize draft recommendations, review draft report prepared by consultant. Feb. 25 , 1999: Final public meeting to present draft recommendations. March 4, 1999: Working Group meeting to consider revisions (if any) to draft recommendations based on public comments. Direct consultant to finalize report. March 25 , 1999 (tentative date) : Joint Working Group / Client. Committee meeting to present and discuss . final report and study recommendations . The Client Committee will continue to meet during the remainder of the study period . The next Client Committee meeting has been scheduled for January 8, 1999 at 9 : 00 a . m . MPO joint Planning / Policy Committee Meeting: The year-end joint meeting of the ITCTC Planning and Policy Committees was held on December 15, 1998. It was announced that the TEA-21 Enhancement reimbursement program would be initiated sometime in January. Bicycle and pedestrian paths and facilities are an important element in this program. The Town of Ithaca Planning Department hopes to submit an application for the William and Hannah Pew Trail proposal in East Ithaca (which had been previously submitted in the last ISTEA grant cycle - it was determined to be j eligible, but didn' t make it high enough on the priority list to get funded - hopefully i this time we' ll do better) . The ITCTC% will play a major role in pre-screening project proposals in this reimbursement program and forwarding recommendations to the State selection committee. [An initial call letter regarding this program was received by the Planning Department on December 30th and Planning staff will attend a workshop on program and application guidelines to be sponsored by ITCTC on January 13, 1999 at 10: 00 a.m. ] The ITCTC is looking into the possibility of establishing a new staff position to oversee and update the new travel demand model program that was developed this past year . The Policy Committee authorized the ITCTC Director to proceed with developing a job description and propose the position in the upcoming ITCTC budget proposal, and bring these back to the Policy Committee in March 1999 . There was considerable discussion regarding the use of the travel demand model and how applicable it would be to a localized street network such as in a specific 3 neighborhood in the City of Ithaca . It was clear from the discussion that the model is not capable of, nor was it intended to be able to analyze detailed changes in a local street pattern, without first developing a sub-model tailored to the specific area in question . The model is a regional "macro" model, intended to forecast impacts of changes in a large area (i . e., Tompkins County) . It was pointed out that a major portion of the NESTS project involved developing a sub-model for the NESTS study area . The same would be true for the City of Ithaca or a portion of the City: However, it was agreed that the model will be very useful for the ITCTC to help evaluate areawide changes and to work with interested municipalities in utilizing the model. Historic Resources Survey: The Cornell Historic Preservation class gave a presentation on December 8, 1998 regarding their survey work for the Fall 1998 semester, which covered the northeast area of the Town of Ithaca. Survey work has thus been completed for about half of the land area of the Town. Planning staff will continue to work with the Cornell Historic Preservation planners to organize the work that has been completed so far onto final inventory sheets. Met with Charlie Gibson and Jan Jaynes , Ithaca Agency , to discuss the new insurance plan . Held open enrollment meetings for health and dental insurance for January 1 , 1999 effective date . SAFETY COMMITTEE MEETING : ? At the December 3rd meeting it was determined that the committee needs to meet monthly in 1999 to really get up and operating . It was discussed that the committee needs to focus on one topic at a time. Therefore, the committee is going to start with developing a Fire and Safety Manual pthat will be distributed to all the employees as a guide when completed . Next meeting is scheduled for January 7th . PERSONNEL COMMITTEE MEETING : The December 8th meeting was postponed . A 1999 schedule has not been set as of yet.
