MINUTES OF MAY 23 , 19 9 4
The Members read the minutes from May 23 , 1994 . The meeting
came to order at 7 : 50 PM . The changes / corrections to those minutes
are as follows : the first paragraph , seventh sentence . " The Master
P lan . . , " , should be , The Board in the past has seriously thought
of recommending putting that area back in Residential since another
location for. Commercial was decided on , " In the last paragraph ,
first page , " Champlaine " should be " Champlain " ( in three locations ) .
K ays made the motion to pass the minutes as amended , Peter seconded .
The minutes passed unanimously .
ZONING ORDINANE
The Members continued to work on updating the existing Zoning
O rdinance for the Town of Ulysses . Before the Members began , David
stated that the Area Variance / Use Variance portion of the Ordinance
needs to be re - done based on the recent ' 92 statutory changes . The
Members agreed .

The Planning Board addressed Section 4 , SPECIAL PERMIT . They
began their evening ' s work with a rough draft of proposed changes
from their previous meetings .
SPECIAL PERMIT
After much discussion , the changes to the SPECIAL PERMIT
section are as follows :
The word " concrete " has been deleted from the sentence " In
d eciding whether to grant a SPECIAL PERMIT , The Board of Zoning
Appeals shall be furnished by the applicant ( concrete ) data on
t he following : "
a ; impact of proposed use on the neighborhood ( traffic burden ) . . .
The Members deleted ( traffic burden ) .
Item b . demand on municipal resources . . . the Members added ( traffic ,
parking , police and fire protection , water and sewer , etc . )
Item e . noise level , has been changed to " e . sensory levels
( noise , light , odor , etc . ) .
In number 1 . , the word " ameliorate " has been changed to " mitigate " .
It should now say " The applicant shall provide details of steps
proposed to mitigate any and all detrimental factors identified
in the above analysis .
Number 2 . should say „ The Board of Zoning Appeals shall consider
steps proposed by applicant to mitigate the identified detrimental
factors and / or to require certain conditions be met to accomplish the
mitigation .
Number 3 . will remain the same , except " ameliorating „ will be replaced
by " mitrgatrngll .

ARTICLES III AND IV
The Members moved on to ARTICLE III , Establishment of
D istricts . The parenthesis surrounding " ( R - 1. A ) , ( R1 - B ) " . . .
have been deleted .
The Board continued on to ARTICLE IV , USE REGULATIONS .
R1 -A should say :
R1 - A Single family , plus accessory apartment ( lot up to 2 acres ) .
Far a habitable outbuilding apartment the floor space shall
not exceed 40 % of the total floor space of the primary dwelling .
R1 - 5 should say :
Fl - B Lot above 2 acres , single family plus accessory apartment
or a duplex . For a habitable outbuilding apartment , the
floor space shall not exceed 60 % of the total floor space
of primary dwelling .
R2 should say :
R Multiple dwelling units ( 3 families or less , minimum 1 acre
per unit ( note - serereO areas ) . The setback will be graduated
depending on the number of units . Height restriction - R1 - A ,
R1 - 13 : 30 feet maximum . ( Additional height allowed only by
SPECIAL PERMIT . )
The Members decided to re - locate the Minimum Frontage Setback to
the other Section that discusses it in general .
R3 should say :
R3 Multiple dwelling units ( four families or more ) - not to exceed
50 feet in height . If eewered , no more than 251 of the lot may
be covered by improvements . Anything permitted in R2 .
D avid commented that there is a whole section that the Members
have not dealt with , and that is lot sues and setbacks .
P eter suggested that they needed to have consistent information
for every district . It should be done in a tabular form . A table
( like the City of Ithaca has ) needs to be created , then change that
into words after the fact . Making TO the numbers is the hard part .
We ' re trying to make TO each number in isolation . Krys said that they
all agree that it is important to be consistent . David said that it is
an interesting idea , but he would not bn able to get to that before the
Fall .
D avid requested that each Member be given a copy of two pages
from Planning News , Spring , 1994 . It discusses lot sizes and Residen -
tial density ,
The next two meetings will be June 27th and July 25 , 1994 , at
the Town Hall at 7 : 30 PM .
The meeting adjourned at 9 : 30 OM .
