Mr. Howe will not be splitting the duties of Supervisor as Mr. Goodman hadwith Supervisor Engman, but will be available to sign checks when necessary and cover any absences. Mr. Goodman moved the appointmentwith Ms. Learyseconding;unanimouswith Mr.Howeabstaining. 4.Consider re-appointment of Town Officials Mr.DePaolo asked about the Marriage Officer appointments and Mr.Goodman and Ms. Terwilliger explained that anyone can ask the Town Board to appoint them as a marriage officer and in fact, Ms. Leary had done just that in order to officiate a friend's wedding. The town does not pay anything to them but there is an honorarium of up to $75 wherejudges charge $100 and clergy significantly more. Ms.Terwilliger stated that it is a convenience for people and she enjoys doing them. Mr. DePaolo asked how many she has done if she charges and Ms. Terwilliger stated that she does approximately 15 a year and does charge. She added that it had been more in the past but people have found that anyone can get ordained online and perform the ceremony and she does a third at town hall and others at parks and waterfalls. Ms. Brock added that if the board had any other questions, it is explained in NYS Domestic Relations Law. Ms. Hunter asked that the Town Historian submit a written Annual Report. TB Resolution 2016 -OOIa:Reappointment of Paulette Terwilliger as Town Clerk of the Town of Ithaca Be it resolved the Town Board re-appoints Paulette Terwilliger as Town Clerk of the Town of Ithaca fora term continuing until the 1®^day of January next succeeding the next biennial Town election to wit,January 1, 2018. Goodman and PauletteTerwilliger, who meet all the qualifications required by the Domestic Relations Law, have requested that the Town Board appoint them as Marriage Officers,now,therefore,be it Resolved that the Town Board of the Town of Ithaca hereby appoints William D. Goodman and Paulette Terwilliger as Marriage Officers for the Town of Ithaca, for which there will be no salary or wage,from the date hereof until January 1,2018. Moved:Eric Levine Seconded:Tee Ann Hunter Vote: Ayes - Howe,Goodman,Hunter,DePaolo,Leary, Levine and Bleiwas 5.Discuss and Consider Approval of Town Board Meeting Schedule for 2016 TB Resolution 2016 -002;Set Dates for 2016 Meetings of the Town Board Whereas the Town Board of the Town of Ithaca meets on the first Monday following the first Tuesday of each month at 5:30 p.m. and Whereas the Town Board also sets aside the fourth Monday of each month for an additional meeting;these second meetings are commonly called study sessions which begin at 4:30 and are held in a smaller meeting room.These study sessions focus on reports from committees and presentations to the board with action items added only when necessary and Whereas the Town Board also sets aside the first Thursday in October for a meeting at 5:30 whose sole focus is the review and discussion of the Preliminary Town of Ithaca Budget,now therefore be it Resolved that the Town Board hereby approves the following schedule: Town Board Meeting Jan 11,2016 Page 3 of 24 January ll"'and 25"^ February 8^''and 22"^^ March and 21'^ April 11"'and 25'" May 9'"No second meeting due to Memorial Day June 13'" and 27'" July 11'"and 25'" August 8'"and 22"" September 12'"and 26'"late due to Labor Day October 6'"Thursday -Budget Meeting October 17'"and 31^'late due to Columbus Day November 7'" and 21" December 12'" December 30'"Year-end meeting if needed Special time 11:00 a.m. Moved:Tee Ann Hunter Seconded:Pam Bleiwas Vote:Ayes -Howe,Goodman,Hunter,DePaolo,Leary, Levine and Bleiwas 6.Discuss and Consider 2016 Association of Towns'Resolutions and Consider Designation of 2016 Official Delegate and Alternate Delegate for the New York State Association of Towns 2016 Annual Meeting Mr. Goodman asked the Board about any changes to the proposed resolutions from the ACT and he stated that he did not like the reference in the second proposed resolution that refers to electric and fuel-efficient cars bringing revenue down. He suggested that it be changed to look for other sources of revenue and not single out fuel-efficient vehicles as a cause of revenue loss; he thought it was more from a decrease in gas prices than fuel efficiency and we want to promote efficiencies and alternate fuels. Ms. Hunter asked about the Capital Projects funding and Mr.Goodman thought that referred to the State using funds to pay for debt service rather than capital projects funding. Ms.Hunter asked about the lack of mention regarding mass-transit after the first whereas and Ms. Brock responded that it doesn't fall under the type of funding talked about in this resolution but she could supply a contact for Ms. Hunter to talk to someone about that. TB Resolution 2016 -003:Naming of Official Delegate and Alternate for the Year 2016 to the New York State Association of Towns Annual Meeting and Support for Reported Resolutions Whereas, the NYS Association ofTowns Annual Meetingwill be held in New York City and Whereas,the Town of Ithaca is a member in good standing with the NYS Association of Towns and is eligible to have voting rights at the said meeting and TownBoardMeetingJan 11,2016 Page4 of 24 Whereas, it is necessary for the Town Board to appoint an Official Delegate and Alternate who will have voting rights on behalf of the Town of Ithaca at the said meeting and Whereas, the Town Board has reviewed the Reported Resolutions from the Association of Towns of the State of New York dated November 20, 2015 and received January 4, 2016, now therefore be it Resolved, that the Town Board of the Town of Ithaca hereby appoints Tee Ann Hunter as the Official Delegate and Bill Goodman as the Alternate Official Delegate on behalf of the Town of Ithaca at the 2016 NYS Association of Towns Annual Meeting; and be it further Resolved that the Town Board of the Town of Ithaca does hereby approve the Reported Resolutions submitted by the Association of Towns with the following change: Resolution #1 Highway,Bridge and Transportation Funding,fourth resolved, delete "due to fuel efficient, hybrid and electric vehicles."So as not to single out efforts at efficient vehicles and alternative fuels and the implication that the decrease in revenue is solely from those. Moved:Bill Goodman Seconded:Rod Howe Vote:Ayes -Howe,Goodman,Hunter,DePaolo,Leary, Levine and Bleiwas 7.Discuss and Consider Board and Committee Membership and/or Chair Appointment(s) Mr. DePaolo talked about having talked to the Planning Board about a development plan and talked about it from a policy perspective and was rebuked for it and so he asked if there is any place for a dialogue between policy makers and the Planning Board rather than having this wall between the two in order to discuss policy goals annually so if there is any doubt on the Planning Board's part on what the intent of the policies that the Planning Board sometimes struggles to interpret, they would know. We have always been told that the Planning Board does not want the appearance of meddling or imposing our authority on the Board, but there is some value to having some kind of avenue to have discussions and answer questions about policies and their intent and establish a sense of connection between the two boards.Ms.Hunter was in favor of it saying she only sees the Planning Board members at town social functions and it would be nice to hear their thoughts and let them hear ours about what is happening with the implementation of the new zoning and code.She added that it would be good to have the Zoning Board involved also and give them both an update on the progress and where we are in it. Ms.Hunter stated that she understands it is not the Town Board's place to talk about individual projects, necessarily, but it is important to have a sense of what they are doing and for them to have a sense of what we are doing. Mr.Goodman stated that we have the right as citizens to go before the boards and speak and Mr. DePaolo said that isn't the issue, the assumption is that one is still there as a Town Board member also. Mr.Goodman thought it was a good idea and Ms.Ritter thought something sponsored by the Planning Committee might be good. Mr. DePaolo added that he quite often Town Board Meeting Jan 11,2016 Page 5 of 24 hears at Zoning and Planning Board meetings that "our hands are tied, this is what we have to do even if there is something else we might like to do." and without any dialogue with the Town Board, there might be some legislativechanges that might make it easier for everybody. TB Resolution 2016 -004;Planning Board Member and Planning Board Chair Appointments Whereas, theTown Board recommendsthatJon Bosak be reappointed to his current position as a regular member,and Whereas, theTown Board recommendsthat Liebe MeierSwain be appointed as a regular member, filling the vacancy for a term ending December 31,2021,and Whereas, the Planning Board has recommended that Fred Wilcox be reappointed as Chair of the Planning Board for 2016, now therefore be it Resolved, that the Town Board hereby re-appoints Jon Bosak as a regular member of the Planning Board for a term beginning January 1, 2016 and ending December 31, 2022; and be it further Resolved,that the Town Board hereby appoints Liebe Meier Swain as a regular member of the Planning Board for a term beginning January 1, 2016 and ending December 31, 2021; and be it further Resolved, that the Town Board hereby re-appoints Fred Wilcox as Chair of the Planning Board beginning January 1,2016 through December 31, 2016. Encroachment Licenses,and Stormwater Operation.Maintenance and Reporting Agreements Whereas the Town routinely enters into certain easements granted to the Town or,encroachment licensesgrantedby theTown, andStormwaterOperation,Maintenance and Reporting agreements for routine matters such as, but not limited to, the placement and maintenance of public and private sewer and water lines, encroachments into Town easements, and the construction,operation and maintenance of private stormwater facilities, and Whereas such easements, licenses and agreements as listed above are often required by the Town PlanningBoard as conditions of approvalfor a project, and they are often reviewed by various Boards,Committees,the Attorney for the Town and/or department heads, and Whereas such matters as listed above require a Town official's signature and, now therefore be it Resolved that the Town Board of the Town of Ithaca hereby authorizes the Town Supervisor to execute on behalf of the Town, until the 2017 Organizational Meeting of the Town Board,water, sewer, stormwater and access easements granted to the Town, and Stormwater Operation, Maintenance and Reporting agreements,wheresuch easementsand/oragreementsare required by the Planning Board or Zoning Board of Appeals as conditionsof approval for a project and, be it further Resolved that the Town Boardof theTown of Ithaca hereby authorizesthe Town Supervisor to execute on behalf of the Town,until the 2017 Organizational Meeting of the Town Board, encroachment licenses granted by the Town where structures encroach into Town easements or property, provided the licenses require the removal of all or any part of the encroachments as the Town in its sole discretiondeemsnecessaryfor the exerciseof the Town's rightsor to respond to an emergency or other circumstance. Mr.Goodman reportedthat theCounty is using the money they added to their budget for parks after we decreased our contribution will be usedtofunda feasibility studywiththeCityon whethertheCountyshouldbe fundingparks. Discuss and Consider Authorization for Certain Expenditures by the Superintendent of Highways without Prior Town Board Approval Mr. DePaolo asked what the net effect of this authorization is; is it that anything over a certain amount is required to be competitively bid or is that only in certain instance?Mr.Weber responded thatit is for equipment thathasbeen identified in thebudgetandpurchasedthrough the bidding process to be able to sign the purchase contract without coming back to the town board and save time. Mr. DePaolo responded that he understood that but what else and is there and are they subject to competitive bids or at his discretion. Mr.Goodman talked about the new zoning that is moving forward and noted that the Planning Department has been working on a report and guide which he would like to bring to a study session to discuss and then form a working group with himself as the representative from COC and Mr.DePaolo as the representative from Planning Committee to work with staff to get into the details and nitty gritty of drafting the new Form Based Code.This will be a huge Town Board Meeting Jan 11,2016 Page 23 of 24 undertaking and hopefully we can be a little faster than the last time the Comprehensive Plan was adopted. He added that in the meantime, there may be some Planned Development Zones that will need to be done for areas that area already further in the planning process such as Cornell's plans for East Hill and the South Hill area around East King Road. Mr. Goodman reminded the board that there will be Form Ithaca meetings January 27"^ - 29^^ at the Country Inn and Suites talking about the Charrette ideas for the area with Form Ithaca. The public is invited and the consultants are trying to move forward with a realistic proposal and draft zoning for the area. Mr. DePaolo wanted to make sure the residents in the area are aware of these meetings and he hopes the group wants to hear from the people who will be affected. He stated that the one he went to a few months ago was predominantly planners and the like and essentially Form Ithaca was preaching to the choir instead of to the people affected. Mr. Howe added that the word "charrette" may be off-putting to some who don't know what the word is and therefore don't think it applies to them. He stated that the Economic Development Committee had a lot of positive feedback from people they invited and they were very pleased the town wanted to listen to them. Mr. Goodman reported that the draft Sign Liiw and the discussion regarding Transportation Corporations for water and sewer are the main topics for the January study session and in February the Conservation Board has requested time to discuss deer management and the study they sent out last month. Ms. Terwilliger reported that the renovation is almost finished; we are waiting for the sound panels but it is coming along nicely and the target date of January 21^' is still on track. Ms. Ritter reported that the draft EIS is in the next stage of review; it is undergoing a determination of adequacy which means if it has addressed the concerns in the scoping document. The City Planning Board is acting as the lead agency and they have invited the Town Planning Board to take part in this and they have the document and have until early March to review it. Once that happens, it will be ready for public review and will be disseminated then. The document is two full 6" binders. The Town can make comments that the City will take under consideration. The Town will be doing its own Findings Statement at a later point in the process and we will be very busy with this. Ms. Bleiwas reported that she attended the training for New Officials put on by the AOT and it was very informative and a great for meeting other new officials and networking. 18.
