Su· and bond an:.dpot.on notes E Meeting of the Ithaca Town Board Monday,December 7,2015 at 5:30 p.m. Minutes Board Members Present:Bill Goodman,Deputy Town Supervisor;Pat Leary,Tee-Ann Hunter,Eric Levine,Rich DePaolo,and Rod Howe Absent:Herb Engman,Supervisor Staff Present:Susan Ritter,Director of Planning,Bruce Bates,Director of Code Enforcement; Mike Solvig,Director of Finance, Judy Drake,Director of Human Resources; Paulette Terwilliger,Town Clerk; Jim Weber,Highway Superintendent and Susan Brock,Attorney for the Town 1.Call to Order - Mr.Goodman opened the meeting at 5:30 p.m. 2.Report of Tompkins County Legislature and Ithaca Common Council - None 3.Public hearing regarding a local law modifying the planned development zone associated with the South Hill Business Campus Mr. Goodman opened the public hearing at 5:31p.m.There was no one present and the hearing was closed. TB Resolution 2015-138:SEOR:Proposed Local Law No.6 of 2015 Amending Zoning Chapter 271 Of The Town Of Ithaca Code.Titled Zoning:Special Land Use Districts.To Include The Name Of The South Hill Business Campus In The Title Of Section 271-13, Simplify The Findings.And Modify And Expand The Permitted Uses In Planned Development Zone No.12 Whereas, this action is the enactment of a local law amending Chapter 271 of the Town of Ithaca Code, Titled Zoning: Special Land Use Districts, to include the name of the South Hill Business Campus in the title,simplify the findings,andmodifyand expand the permitted usesin Planned Development Zone No.12;and Whereas,this is a Type I Action for which the Town of Ithaca Town Board is acting as Lead Agency inan environmental review with respect tothe enactment of this local law;and Whereas,the Town Board, at its regular meeting held on December 7,2015 has reviewed and accepted as adequate the Full Environmental Assessment Form (EAF),Parts 1,2 and3, for this action,preparedby theTown Planningstaff;now,therefore,be it Resolved, that the Town of Ithaca Town Board hereby makes a negative determination of environmental significance in accordance with Article 8 of the Environmental Conservation Law, 6 NYCRR Part 617 New York State Environmental Quality Review, and Chapter 148 Environmental Quality Review of the Town of Ithaca Code for the above-referenced action as TB 12-09-2015 Pg 1 Full Environmental Assessment Form Part 1 -Project and Setting Instructions for Completing Part 1 Part 1 is to be completed by the applicant or project sponsor. Responses become part of the application for approval or funding, are subject to public review, and may be subject to further verification. Complete Part 1 based on information currently available. If additional research or investigation would be needed to fully respond to any item, please answer as thoroughly as possible based on current information; indicate whether missing information does not exist, or is not reasonably available to the sponsor; and, when possible, generally describe work or studies which would be necessary to update or fully develop that information. Applicants/sponsors must complete all items in Sections A & B. In Sections C, D & E, most items contain an initial question that must be answered either "Yes" or "No". If the answer to the initial question is "Yes", complete the sub-questions that follow. If the answer to the initial question is "No", proceed to the next question. Section Fallows the project sponsor to identify and attach any additional information. Section G requires the name and signature of the project sponsor to verify that the information contained in Part 1 is accurate and complete. A. Project and Sponsor Information. Name of Action or Project: South Hill Business Campus Planned Development Zone (PDZ) Modifications Project Location (describe, and attach a general location map): 950 Danby Road; Tax Parcels 39.-1-1.22 and 39.-1-1.1 BriefDescription of Proposed Action (include purpose or need): Modifications to the PDZ includes simplifying the findings, modifying and expanding permitted uses, and providing the name "South Hill Business Campus" in the PDZ title. Specific changes to the PDZ are described in the attached draft local law and in the edited (redlined) copy of the original PDZ language. These modifications were initiated by Town staff in consultation and cooperation with the Managing Partner and the Property Manager for the South Hill Business Campus. The proposed changes include simplifying the findings, modifying and expanding permitted uses and providing the name "South Hill Business Campus 11 in the PDZ title. The proposed modifications were initiated by planning staff in response to SHBC's need to obtain variances in recent years for uses that appeared appropriate for the site (i.e. radio station and associated antenna), and this provided an opportunity to generally revisit and evaluate the effectiveness of the overall PDZ language that was written over a decade ago. Many of the proposed new and expanded uses broaden and clarify existing uses. For example 11 health and wellness practices" were added to 11 medical and dental 11 in B.(3), and 11 facilitieS 11 was added to B.(2). Some proposed uses are completely new and unrelated to current uses, including the permitting of 11 0utdoor events" B.(9); drive-through facilities for banks and financial institutions B.(1); places of worship B. (21); building mounted electronic transmission facilities/antennas that do not exceed more than five feet above the highest roof line of the building B. (19); and allowing greenhouses as an accessory use E.( B). All of these uses can be easily accommodated on the site without posing impacts to any neighboring properties. The expansive +/-50 acre PDZ provides ample space for outdoor events and for installation of a greenhouse. The site is well situated to handle traffic with its location along Route 96B, a NYS highway, and with two ingress/egress access points that are both traffic light controlled and with abundant on-site parking. The cleared and developed portions of the site adjoin an Industrial Zone to the south and an Office Park Commercial Zone to the north. The back of the PDZ (west side) contains a wooded area, several hundred feet wide, adjoining a Low Density Residential Zoned area along Stone Quarry Road. Directly across the street (Danby Rd.) is the Ithaca College campus. The only use that cannot be accommodated within the current facility is new permitted use C.(4) 11 Dwelling units11 • Permitting this use at SHBC could potentially serve a need for additional housing on South Hill and provide housing for tenants of the facility or others looking to live in relative close proximity to downtown Ithaca (+/-1 mile away). Ithaca College is the second largest employer in Tompkins County and the addition of housing within easy access could serve staff or even students. Currently, however, NYS DEC will not allow residential uses within the current SHBC facility due to contamination issues associated with past manufacturing activities. The site is undergoing remediation and until DEC changes the facility's status, dwelling units would only be allowed if a new building were constructed on the nonrestrictive portions of the site. The addition of dwelling units as a permitted use could potentially spur new development at the SHBC site, in addition to other PDZ modifications, as described above. Approximately five years ago SHBC presented a sketch plan proposal to the Town for the addition of several new buildings. At that time the 1 facility was at 90% occupancy. Following the recent recession the facility lost tenants and as a result they did not pursue the expansion plans. That could change as the occupancy at SHBC continues to rebound and with zoning modifications that encourage new opportunities for growth at the facility. As described above in paragraph 2, the facility's location is very suitable to expansion given the size of the PDZ, the uses and zoning on neighboring properties, and the ability to accommodate traffic into and on the site. Additionally, the Town is conducting a pedestrian corridor study along Route 968 in hopes of better accommodating pedestrians in the corridor, including the SHBC site, with sidewalks, crosswalks, and other amenities. Any proposed new development within the SHBC PDZ, whether spurred on by the addition of permitted uses through the proposed zoning modifications, and/or by the improved economic conditions, would be evaluated thoroughly through the Town's site plan review process and SEQR determination. Item marked as "other impacts~~ in Part 2 of the LEAF would be of particular attention in any future development of the site. Through the environmental review process these potential impacts, including grading and physical alteration of the site, water quality, flooding, aesthetics, and traffic would be evaluated. Each would be considered and examined through the SEQR process and their impacts determined for significance. 2 TOWN OF ITHACA Public Works Department Months of October/November Board Report December 7,2015 Town Board Meeting Roads: • Said goodbye to long time employee, Larry Salmi, who retired on October 30th. Two seasonal employees ended their work with the Town on November 6th. Completed interviews for the internal promotion of an MEO to the vacant HEO position. Interviewed for laborer position and hired Travis Mills who started the permanent position on November 9^^^. Stone was stockpiled for 2016 projects. Sign work, pothole repairs, and shoulder repairs on Calkins Road were performed. Brush and limbs were trimmed back at various locations in Town. Paving of Hackberry and Spruce Lanes. Installed driveway culverts on Pinewood Drive, Northview Road. All ditch maintenance projects were hydro-seeded. Screening of salvaged surge stone, topsoil, blacktop grindings and creek gravels was done in our stockpile areas. Completed the drainage project on Elm Street Extension. Completed drainage work at the LDS Church on Lexington Drive. Lawn restoration will be completed in the spring. • Completed fall brush and leaf pick up. Brush pile was ground into mulch. Staff members attended Defensive Driving training. All snow plow drivers attended One Person Plowing training. Provided assistance to the Towns of Ulysses and Newfield. Provided brush chipping at Lakeview Cemetery. Installed new section of guiderail on lower curve of Culver Road. Guiderails were repaired on Elm Street Extension and West King Road as result of motor vehicle accidents. One early season snow event was responded to with an application of road salt. Took delivery of 950 tons of road salt. Parks, Trails, and Preserves: • Weekly site inspections were performed. • Continued to maintain all town parks, trails and facilities. • Final mowing of all sites was completed. • Leaf blowing and removal was completed at sites as needed. • Hazardous tree removals at various park and trail sites and various locations in Town proceeded. • Paving at Troy Park was completed. • Community service project at Valentino Field was completed. Mulch was spread and infield clay was spread and leveled. • Turfgrass maintenance was performed at Valentino Field. The ballfield was aerated, lime was spread and fertilizer applied. • Invasive species removal and tree removal along the Eastern Heights Park drainage ditches was completed so that ditch maintenance could be done. • Our contractor began woody invasive species control and elimination work at the East Ithaca Preserve and the East Ithaca Recreation Way (Game Farm Trail). Helped organize a new volunteer group to assist in planting native trees and shrubs in the areas being actively managed. The group planted 100 native trees and shrubs of various species along the trail using tree shelter tubes to protect the plants. • The compost pile was turned monthly. • Completed the repair of headstones at the Inlet Valley Cemetery. • Completed annual inspection of Pine Tree Preserve with representative of the Finger Lakes Land Trust. Facilitated volunteers doing plantings and trail maintenance. • Winter close-up of West Hill Community Garden and Tutelo Park was completed.
