At a regular meeting of the Town Board of the Town of Ithaca, Tompkins County, New York, held at the Town Hall , 126 East Seneca Street, Ithaca, New York, there were present : PRESENT : Catherine Valentino , Town Supervisor; Carolyn Grigorov, Councilwoman ; David Klein , Councilman ; Ellen Harrison , Councilwoman ; Edward Conley, Councilman ; Mary Russell, Councilwoman . EXCUSED : John Wolff, Councilman . ALSO PRESENT : Joan Lent Noteboom , Town Clerk; John Barney, Attorney for the Town ; Fred Noteboom , Highway Superintendent ; Daniel Walker, Director of Engineering ; Jonathan Kanter, Director of Planning ; Andrew Frost, Director of Building and Zoning ; Alfred Carvill , Budget Officer. CALL TO ORDER: Supervisor Valentino called the meeting to order at 5 : 31 p . m . , and led the assemblage in the Pledge of Allegiance . AGENDA ITEM NO, 4 = REPORT OF FIRE COMMISSIONER: Robert Romanowski - The Ithaca Fire Department's personnel report as of December 30 , 1997 showed a total of 91 volunteers for the year, with 34 volunteers active and 26 on probation . Class two has 22 personnel , and class three has 9 personnel . Career people includes 1 Chief, 1 Deputy Chief, 5 Assistant Chiefs , 8 Lieutenants, and 45 Fire Fighters. There are three Fire Fighters on leave or light duty. There are five staff members which include a Fire Alarm Superintendent and four office personnel . Next month the 1997 summary of all calls in the Town of Ithaca will be provided . Information from the Chiefs office related to fees, permits , and revenues for the City of Ithaca Fire Department follows : "The following proposal was designed to illustrate the nature and extent of changes proposed for the City Fire Prevention Code Chapter 181 in response for the call of additional revenues. These changes are in some cases significant and should not be considered lightly. Additionally, as the subject of revenues within the Fire Department is a sensitive one, there is an expectation that increased revenue generated by the Fire Department will benefit the Fire Department. The Ordinances proposed here are offered as examples of the nature of the legislation that would need to be developed . They are not presented as finished language. Many other changes to Section 181 will also need to be made in order to update the Code and/or accommodate the new additions discussed in the document. " Since the Town of Ithaca is also part of the Fire District, I am not sure which topics will have an effect on the Town . I thought the Town Board and Mr. Frost would be interested in these changes . TOWN BOARD MEETING 2 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Councilwoman Mary Russell - Where are these proposed changes to the Code coming from? Mr. Romanowski - The Fire Chiefs office is proposing these changes in response to calls for up dating the Code to increase revenue for the Fire Department. This will include talking to the people who use the services to suggest they start paying for them . In other words, they would not be able to ask taxpayers for increase and funds when services are being given to benefit certain people and not others. This would cover topics such as permits and permit ifees, additions to other classes of permits, and associated fees for place of assembly permits. This is just work in progress at this point. If this concerns the Town comments should be submitted for a further discussion . Councilwoman Russell - Does the proposal include the false alarm ordinance in the fee proposal? Mr. Romanowski - Fees for avoidable false alarms. The first six avoidable false alarms per calendar year would be at no charge . Each additional avoidable false alarm would be $ 150 . 00 per run . Councilwoman Carolyn Grigorov - What is an avoidable false alarm? Mr. Romanowski - The activation of an alarm system through mechanical failure, malfunction , improper installation , or the negligence of the owner, user, employees , or contractors/agents. False alarms constitute nearly 50 percent of the 3 , 000 emergency runs that are made annually by the Ithaca Fire Department. Although the False Alarm Ordinance has been considered there has been resistance for a variety of reasons . Some of these reasons are still valid , including but not limited to the effect on other efforts to reduce false alarms, potential cost protective systems being shut off or isolated , and the energy invested in assessing charges to repair the system . On the other hand , the number of alarms calls for action . Consequently, an ordinance that imposes fines on an escalating basis but recognizes benefited efforts to maintain fire protective systems should be properly advocated . AGENDA ITEM NO. 3 - REPORT OF TOMPKINS COUNTY BOARD OF REPRESENTATIVES : Tim Joseph - The Tompkins County Bridge Program includes the rehabitilation of the upstream Forest Home Bridge and the West King Road bridge over Buttermilk Creek. It also includes the replacement of Renwick Drive bridge over Pleasant Grove Brook. Superintendent Fred Noteboom - The Town of Ithaca will only be involved with the Renwick Drive project. I have not heard the extent of the project yet. Mr. Joseph - This program has the Town of Ithaca listed to spend $ 16 , 000 for the Renwick Drive Bridge, and the County to spend $ 325 , 000 . It also has the Town of Ithaca listed to spend $ 126 , 000 on West King Road . Supervisor Valentino - The Town did not know about the West King Road amount. Councilman Klein - Who would be in charge of the Forest Home Bridge? Mr. Joseph - The County would totally complete the Forest Home Bridge. Councilman Klein - What is the nature of the work for the Forest Home Bridge? Mr. Joseph - It would be a rehabitation project. Councilman Klein - Would the County be changing with the design of the bridge? TOWN BOARD MEETING 3 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Mr. Joseph - " No. " Supervisor Valentino - The Town needs to discuss the West King Road bridge with the County. Councilwoman Ellen Harrison - Is there a time frame for these projects? Mr. Joseph - The County has a time frame for all the bridge projects . Supervisor Valentino - Has the Town signed a bridge contract for any bridge work? Superintendent Noteboom - I do not think there are any maintenance agreements in place for these bridges. Mr. Joseph - This is just a planning document that the County Planning Department is working on . Councilman Klein - The Town has planned to do Caldwell Road . Mr. Joseph - This program is just for bridges . Councilman Klein - Closing the upstream bridge ties into the Caldwell Road project. Mr. Joseph - One of the major committees of the County Board for this year is the Intermunicipal Cooperation Committee. It is a successor to the Rural Urban Committee since that committee did not move things along as much as the County Representatives hoped for. It is a new committee with an upgraded status with instructions from the chair to make more things happen this year. AGENDA ITEM NO. 7 - REVIEW OF CORRESPONDENCE . A. Ithaca Beer Company - See attached letter. The Town Board reviewed a letter received from Dan Mitchell , President of the Ithaca Beer Company, regarding the intent to establish a micro-brewery at 606 Elmira Road . Be Charles E. Moynihan , P . E. , NYSDOT - See attached letter. The Town Board reviewed a letter received from Charles Moynihan , Regional Director for the NYSDOT, in regards to the school speed limit for the Montessori School on East King Road . The Town Board had a brief discussion on the supervision of students crossing the road . The Town will write a letter to the Montessori School asking how they supervise the children crossing the road , then the Town can write a letter to the State with that criteria . C. Barry A. Stevens, P. E. , NYSDOT as See attached letter. The Town Board reviewed a letter received from Barry Stevens, Regional Traffic Engineer for the NYSDOT, in regards to a traffic study being completed for the West Haven Road area . D. Ithaca Pennysaver - See attached letter. The Town Board reviewed a letter received from William Irwin , President of the Ithaca Pennysaver, in regards to their preparation of a Community Directory for Ithaca and the surrounding communities . TOWN BOARD MEETING 4 JANUARY 12, 1998 APPROVED - FEBRUARY 9. 1998 E. Victor Goldberg , Snow Removal - See attached letter. The Town Board reviewed a letter received from Victor Goldberg in regards to snow removal efforts this winter. AGENDA ITEM NO. 8 - CONSIDER ACCEPTANCE OF 1997 ANNUAL FINANCIAL REPORT OF TOWN CLERK : RESOLUTION NO. T : Motion made by Councilwoman Harrison, seconded by Councilwoman Russell that the Town Board of the Town of Ithaca hereby accept and approve for permanent filing the 1997 Annual Financial Report of the Town Clerk. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye , Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye. Motion carried unanimously. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 9 - CONSIDER ACCEPTANCE OF 1997 ANNUAL FINANCIAL REPORT OF TOWN JUSTICE : RESOLUTION NO. 2: Motion made by Councilman Klein, seconded by Councilman Conley that the Town Board of the Town of Ithaca hereby accept for permanent filing by the Town Clerk, the 9997 Annual Financial Report of Town Justice Raymond Bordoni. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye ; Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye. Motion carried unanimously. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 10- APPOINTMENT OF DEPUTY SUPERVISOR BY TOWN SUPERVISOR. RESOLUTION NO. 3: Motion made by Supervisor Valentino, seconded by Councilman Conley that the Town Board of the Town of Ithaca hereby appoints Councilwoman Carolyn Grigorov as Deputy Town Supervisor for the year 9998. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye ; Councilman Klein , aye ; Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 11 - CONSIDER RATIFICATION OF APPOINTMENTS BY THE TOWN SUPERVISOR: Supervisor Valentino - I had discussions with Councilwoman Russell , Councilwoman Grigorov, and Fred Wilcox (Chair of the Planning Board ) , about the Planning Committee. I have concems about the revisions of the Town 's Zoning Ordinance. I would like to see the Zoning Ordinance revisions completed this year. It will be a major task. I do not want to do anything that will upset or slow down the flow of progress that has been made to move the Zoning Ordinance forward . I am concerned about the Planning Committee' s work in progress . There have been a lot of scheduling problems trying to set up a Planning Committee meeting . I have a suggestion to disband the Planning Committee and enlarge the size of the Codes and Ordinances Committee. The combined members could work on the TOWN BOARD MEETING 5 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Zoning Ordinance together. Councilman Klein would be the Chair of the enlarged Codes and Ordinances Committee. Councilman Klein - The Codes and Ordinances Committee would only be expanded by two more people. Supervisor Valentino - Phil Zarriello of the Conservation Board was also interested in serving on the Codes and Ordinances Committee along with the Planning Committee members who would move into that Committee. Councilman Klein - There has been confusion and overlapping between the two Committees. It makes sense to expand the Codes and Ordinances Committee to work together as one Committee on those issues. Supervisor Valentino - It makes sense to have the Zoning Ordinance flow through the Codes and Ordinances Committee so it is coordinated in a better fashion . Councilwoman Harrison - It sounds like a reasonable approach . My concern is trying to get the Codes and Ordinances Committee through the Zoning Ordinances . There has not been a lot of deliberation over some of the policy issues. That is where the Planning Committee has gone overboard . As long as the deliberative work is done the subcommittee work makes sense . I would hate for the Town to get this done within a year and not spend the time really thinking about the important issues, such as the Agriculture Zones. Supervisor Valentino - I would like to make sure there is progress being made and that people are not spending time at meetings and then regrouping to do it all again . Councilwoman Russell - My initial reaction is also positive, and my concern is similar to Councilwoman Harrison ' s . I feel the Planning Committee was taking responsibilities and initiative to make sure the Comprehensive Plan was being implemented when changes were being made . Now that responsibility will fall completely on the Codes and Ordinances Committee. Supervisor Valentino - Those members would need to make sure that keeps happening by referencing the Comprehensive Plan . The Town Board briefly reviewed the Committees in the proposed resolution . RESOLUTION NO. 4: Motion made by Supervisor Valentino, seconded by Councilwoman Grigorov that the Town Board of the Town of Ithaca hereby ratifies the appointments of individuals to the various Town of Ithaca Committee 's made by the Town Supervisor, Catherine Valentino. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 6 - PRESENTATION : TOMPKINS COUNTY AREA DEVELOPMENT - ECONOMIC DEVELOPMENT STRATEGY FOR TOMPKINS COUNTY: TOWN BOARD MEETING 6 JANUARY 12, 1998 APPROVED - FEBRUARY 9. 1998 Barbara Blanchard - This is the first meeting of a tour of the Tompkins County Town and Village Boards to discuss the economic development strategies. Martha Armstrong distributed a packet of information to the Town Board which has a survey and a mission statement of the Plan . Approximately a year ago, the County commissioned the Tompkins County Area Development to be the contract/consultant to prepare an economic development plan for Tompkins County. That was a direct choice as opposed to having some government office within the County be the economic development lead agency. All the people who made that decision felt that was the best way to move forward. There are a lot of people involved in this. There is a Committee that involves a large strategic Planning Committee. The Committee does not meet very often , but there are a number of other groups that are working on a number of aspects. It was determined that the Economic Development Plan should be for the public and private sector. It should include activities that would move the economy towards greater vitality, stability, diversification , and equity in a way that would foster culture and ecological integrity. This means that the plan should define projects for the short term as well as things to be accomplished over a long term basis. We want to have things included in this plan that would give us guidance on how to develop employable skills and opportunities for all the people in the County no matter what their range of ability. We want to focus on activities that will help people improve their economic status by increasing their earning power. We want to continue to expand the efforts to retain existing businesses and to support their development and expansion . fe' The Town Board should appreciate this as elected officials and staff people who are responsible for budgets . We want this plan to give us guidance on allocating economic development funds and the kinds of initiatives that increase financial resources. We want this plan to find what kind of gaps there are in economic development services to see if we can identify the areas that have duplication of services to eliminate them . The time frame for doing all this will be immediate. We hope to have most of this planning activity underway with good draft material and ideas by the middle of this summer. In the packet the Town Board received there is a schedule that outlines how this plan is organized . When looking at the schedule there are a lot of things that are happening simultaneously to get this plan done . We want to be actually doing things. The survey was distributed to a large strategic planning committee of 25 people who represent industrial and business leaders and elected officials from the community. All of these people have participated in this survey. The City of Ithaca has their own economic development strategy planning that is included in the County's plan . The City also has their own strategic planning committee, and they have taken the survey. All the surveys will be distributed to Town and Village Board Members, plus any staff people interested in participating . The more people, ideas, and attitudes collected the better. We would like to have these surveys collected as soon as possible. One of things we are moving forward on at the same time we are doing the economic development plan is the area of electric power. As most people know the electric power deregulation is going to be a new world for us. That world will open up in approximately one year. There is an Electric Power Committee in a partnership with Tioga County. There is a consultant working with Tioga County to help fund this activity. We are hoping to put the wheels in motion to make information available to everyone about what power deregulation is . Most specifically, Tompkins County wants to play a role but they are not sure what that will be to benefit each municipality involved . We are going to be developing a plan to do that. The Chair of the Electric Power Committee has written to all the mayors and supervisors to let them know we are engaged in this , and to ask that we have an opportunity to talk with them about what we think is possible . We are trying to be proactive because we know that there are a lot of people who i TOWN BOARD MEETING 7 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 will be making inquiries about the power companies. We believe that, as municipalities, there is strength in the number and we can do things together. The purpose of the letter was to let people know this. We are going to have two group discussions for elected officials in the County. One is scheduled for Thursday, February 19th from 7 : 00 p . m . - 8 : 30 p. m . at the Old Jail Conference Room . The other is scheduled for Tuesday, February 24th from 7 : 00 p. m . - 8 : 30 p. m . at the Transit Center Conference Room . We would like to have at least one Town Board Member to volunteer to participate in those discussions. We would ask the Town Board to identify someone to participate. We are hoping to have a group of eight or nine people at each meeting along with the City officials. The main point of these meetings would be to discuss the Town ' s opinion . We would like people to know that economic development is happening . Councilwoman Grigorov - Is this funded by the County? Ms. Blanchard - Yes. The County made a substantial investment in the Tompkins County Area Development program (TCAD) during 1997 . They have pledged to continue this in 1998 and 1999 . AGENDA ITEM NO. 5 = PERSONS TO BE HEARD : There were no persons to be heard . AGENDA ITEM NO . 12 - CONSIDER APPOINTMENT OF THE ATTORNEY FOR THE TOWN FOR 1998 : RESOLUTION NO. 5: Motion made by Councilman Klein, seconded by Councilwoman Grigorov that the Town Board of the Town of Ithaca hereby agrees to confirm the arrangements discussed and presented for the appointment of the Attorney for the Town, for the year 1998 as per the attached letter of understanding as presented by John C. Barney, Esq. , of the firm Barney, Grossman, Roth & DuBow. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye , Councilman Klein , aye , Councilwoman Harrison , aye ; Councilman Conley, aye ; Councilwoman Russell , aye. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 13 - CONSIDER 1998 TOWN BOARD APPOINTMENTS : RESOLUTION NO. 6: Motion made by Supervisor Valentino, seconded by Councilwoman Russell that the governing Town Board of the Town of Ithaca hereby appoints the following individuals to serve on the Town of Ithaca Agriculture Committee for the Terms of Office indicated retroactive to January 1 , 1998. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye , Councilman Klein , aye , Councilwoman Harrison , aye , Councilman Conley, aye ; Councilwoman Russell , aye. Motion carried unanimously. (NOTE : Formal adopted resolution is hereto attached . ) RESOLUTION NO. 7: Motion made by Supervisor Valentino, seconded by Councilwoman Grigorov that the governing Town Board of the Town of Ithaca hereby appoints the following individuals to serve as Town of Ithaca representatives for the Terms of Office indicated retroactive to January 1 , 1998, on the Joint Youth Commission. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 14 = CONSIDER RENEWAL OF AGREEMENT WITH TOMPKINS COUNTY TO ASSIST IN PARTIAL COVERING OF THE COST OF TRANSIT AND HEALTH AND HUMAN SERVICES PROGRAMS : The Town Board had a brief discussion on the contract agreement with Tompkins County. The Town Board had concerns about the money being expended for these programs and the amount to be reimbursed back to the Town . The Town has discussed this several times with the County and the City. RESOLUTION NO. 8: Motion made by Councilman Conley, seconded by Councilwoman Russell that the Town Board of the Town of Ithaca hereby authorizes and directs the Town Supervisor to execute the 1998 Agreement with Tompkins County Transit and Health and Human Services Programs. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO . 15 = CONSIDER DESIGNATION OF DELEGATES TO THE ASSOCIATION OF TOWNS OF THE STATE OF NEW YORK 1998 TRAINING SCHOOL & ANNUAL MEETING : RESOLUTION NO. 9: Motion made by Councilman Klein, seconded by Councilman Conley that the governing Town Board of the Town of Ithaca hereby appoints Catherine Valentino, Town Supervisor as the Official Delegate; and Carolyn Grigorov, Councilwoman as Alternate Delegate on behalf of the Town of Ithaca at the NYS Association of Towns Annual Meeting. A vote on the resolution resulted as follows : Supervisor Valentino, aye ; Councilwoman Grigorov, aye ; Councilman Klein , aye ; Councilwoman Harrison , aye , Councilman Conley, aye , Councilwoman Russell , aye. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO, 16 - CONSIDER RESOLUTIONS TO BE CONSIDERED AT THE ASSOCIATION OF TOWNS OF THE STATE OF NEW YORK 1998 TRAINING SCHOOL & ANNUAL MEETING : This agenda item will be deferred until the February Town Board Meeting . AGENDA ITEM NO . 17 - CONSIDER ABANDONMENT OF WILLIAMS GLEN ROAD AS A TOWN ROAD : Councilman Klein - Did the Town ever own this land? Attorney Barney - As far as I can tell this land was never conveyed to the Town . There were old deeds that made reference to it as a street back in the 1920 's. Just to eliminate any possible question that there might be some right to the Town of Ithaca the thought was to abandon the road . Superintendent Noteboom - I agree that the Town should abandon Williams Glen Road . TOWN BOARD MEETING 9 JANUARY 12, 1998 APPROVED - FEBRUARY 9. 1998 Councilwoman Russell - In other discussions about abandoned roads , such as a portion of Judd Falls Road , it was clear that the adjoining landowners had to consent to the abandonment of the road . Doesn 't that apply here? Attorney Barney - That is when there is a user, and Williams Glen Road does not have a user. The Town can abandon any claim to this road and then it will be up to the landowners to work out. Superintendent Noteboom and the Town Board Members signed an official agreement to file in the Town Clerk's office for the abandonment of Williams Glen Road . AGENDA ITEM NO. 18 - CONSIDER AMENDMENT TO RETIREE HEALTH INSURANCE PORTION OF THE PERSONNEL MANUAL : Supervisor Valentino - Attorney Barney provided the Town Board with information on the Personnel Manual . The Personnel Manual , at the present time, is adequate under the law regarding the retiree health insurance benefits . AGENDA ITEM NO. 19 - SET PUBLIC HEARING DATE TO CONSIDER AMENDING LOCAL LAW NO . 1 - 19969 A " LOCAL LAW INCREASING THE PARTIAL TAX EXEMPTION FOR REAL PROPERTY OWNED BY PERSONS WITH LIMITED INCOMES WHO ARE 66 YEAR OF AGE OR OVER" : Attorney Barney - The State raised the permissible limits last year. The Town Board adopted a local law last year to increase the rate to be consistent with what the State permitted . The State adopted new legislation this year, but it does not increase the rates. The question is whether the Town Board wants to exclude the determination of eligible incomes of veteran disability benefits . A year ago, the State also adopted legislation which authorized subtracting out and calculating incomes based on unreimbursed health insurance costs through passage of a local law by a local government. Ed Hughes of the Tompkins County Assessment Office recognized it would be difficult to administer those health care cost and rely on people asking for reimbursements. Mr. Hughes was very careful to say that it is a policy issue for the Town Board . If the Town Board wishes to allow those medical deductions, County Assessment would do their best to accommodate the Board's wishes . If the Town Board wishes to change the law as it applies to residents of the Town of Ithaca and allow those deductions, then the Town needs to draft a local law. If the Town Board does not want to, then there would be no action needed . Councilwoman Russell - I am not sure how much extra work it would be for the County to track these medical deductions . Attorney Barney - People could incur a lot of medical bills during the year. It comes down to an honor system . The Assessment Office would be making sure these bills have not been reimbursed . Supervisor Valentino - People used to claim the medical expenses on their income tax returns , but it is not possible to do now. Councilman Klein - Do all sources of income qualify, such as Social Security, Disability, etc. ? Attorney Barney - It is basically all income , but there are some that are excluded . TOWN BOARD MEETING 10 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Supervisor Valentino - The Town Board could leave this matter as it is, or have a public hearing to see what the public 's opinions are . Councilman Klein - A public hearing would be the sensible move. I know that prescription drugs for the elderly people could be extremely costly, those not paid by Medicare. The elderly could spend hundreds of dollars on prescription drugs and medical expenses that medicare does not pay for. Some drugs are not reimbursable. Town Clerk Noteboom - The STAR program will be effective in 1999 for Town and County taxes. Councilman Klein - The Office of the Aging may have information on whether this would be beneficial for the elderly. Councilwoman Harrison - If the Local Law is drafted to say that we would allow medical exemptions, and no one comes to the public hearing , could the Town Board at that point make changes? Attorney Barney - "Yes. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO . 21 = APPOINTMENT OF INTERVIEWING COMMITTEE FOR PLANNING BOARD POSITION : Attorney Barney - The Town Board could adopt a local law superseding State law by making the the term of office for a Planning Board member from seven years to one, three , or five years. Councilwoman Harrison - It makes it hard to recruit people for a seven year term . The Town Board should pass a new local law changing that policy. TOWN BOARD MEETING 11 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Councilman Klein - There are seven people on the Planning Board , and every year there should be a person up for review. That is the way it was in the past. The Town Clerk and Town Supervisor should research this information to see what the actual policy is . Councilwoman Harrison - If the Town Board changes the term for new members, there should be a public hearing about a proposed local law for new appointments. Town Clerk Noteboom - The Town Board has a Special Town Board Meeting on January 26th . At that time the Board could vote to set a public hearing after the information has been reviewed . The public hearing could be held in February. The Board could also appoint a new member to the Planning Board if they so desired . Councilwoman Russell - What do other Towns do? Attorney Barney - The Law states that if there is a five person Planning Board the term of office is five years. If there is a seven person Planning Board then the term of office is seven years. Those laws have been changed in municipalities. It is no longer a law of general application , the law allows the Town Board to develop their own local law to change the term . On Caldwell Road , there have been discussions as to whether it is appropriate for the Highway Department to do the reconstruction or should it be sent out to bid . Especially if there is a fair amount Storm Water Management repair work and Capital Projects for 1998 . We are looking at having Cornell University participate in the Caldwell Road project. Superintendent Noteboom - It is a legal requirement before money is expended that the Town Board approve the Agreement of the Expenditure of Highway Monies. Councilman Klein is talking about amending this agreement. This agreement can be amended any time during the year. Director of Engineering Walker - The Highway Superintendent could contract for Caldwell Road , but the Town will still need to spend money. Councilman Klein - I just wanted to bring to the Town Board 's attention that there could be adjustments to this agreement. Superintendent Noteboom - The Caldwell Road issue has not been settled yet. TOWN BOARD MEETING 12 JANUARY 12, 1998 APPROVED - FEBRUARY 9. 1998 Supervisor Valentino - This agreement meets the requirements that the Town Board wants to set aside funds to be expended for improvements. The improvements could be changed at anytime. Attorney Barney - If Caldwell Road is done as a bid , this resolution would not preclude that. The money needs to be expended for that purpose. Be Highway Superintendent as See attached . Councilman Klein - It looked like the Town 's roads were in better shape than the Cayuga Heights roads after the last storm . Superintendent Noteboom - The Town did not have the snow buildup that was noticed on other roads around the County and City. Councilwoman Harrison - Is this an unusual number of water main breaks? Superintendent Noteboom - "Yes. " Councilwoman Russell - Why would the Town be abandoning the pressure regulated valves (PRV) at Joanne Drive and Eastern Heights Drive? Director of Engineering Walker - It has not worked for many years. The system has undergone a few changes on how it operates with the Snyder Hill Water Tank When the system was first installed they thought they would need to reduce the pressure for the lower properties, but they did not have to. The distribution system was changed on the lower part of Snyder Hill Road so it feeds from a lower tank. There are not any high pressures for that area . It is not cost effective to put a second tank in to feed those properties. PRVs are high maintenance items , and when they tend to stick they cause problems. Superintendent Noteboom - The Highway Department has been able to regulate these repairs. We have been able to throttle the water main breaks to provide service to customers during normal working hours. We have not been able to do that in the past. We never had a control on when they were done, and now we can control some of those factors . TOWN BOARD MEETING 13 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 c. Director of Engineering - See attached . Councilwoman Harrison - In the paragraph referring to Mecklenburg Heights it states "Water supply improvements are under design and may provide the Town with an opportunity to reinforce the West Hill water system . " Could you clarify that statement? Director of Engineering Walker - The Mecklenburg Heights property will be served with water from an existing 12 inch water main that runs across the top of the Ciaschi parcel from the West Haven Road and Trumansburg Road water tank. During the comprehensive planning study with the City of Ithaca we recognized some weaknesses in the Town 's system that we did not know about. The 80 year old water tank on Trumansburg Road feeds the whole West Hill . Bringing this water line into Mecklenburg Heights would run a third of the way closer to a tank on Oakwood Drive in the City. The City would be interested in having the Town use that tank site as another pumping station point to pump into the West Hill system . It would take stress off other portions of the City, and also give the Town a second supply point to feed the existing infrastructure . This is not a new tank, but it would fit in well with a new tank design . It would basically be a second feed point to the existing system . Councilwoman Harrison - Would it have any pressure implications, and how high on West Hill could this service provide water? Director of Engineering Walker - It would provide the Town an opportunity to install a pump which would have a higher lift than we have now. The Town could fill a tank that was on Mecklenburg Road from this pump station . That may be 100 feet in elevation higher than the Trumansburg Road tank. Councilwoman Harrison - Are there any implications for extending the water service area? Director of Engineering Walker - If a tank were installed it should be placed on the first major rise above City Lights on Mecklenburg Road to provide adequate pressure to West Haven Road , and pressurize EcoVillage and the Ciaschi parcel . Councilwoman Russell - This would solve the problem which existed when they had the EcoVillage fire? Director of Engineering Walker - "Yes . " Councilwoman Harrison - In terms of the drainage study, a survey issued elevations and drainage to go under the storm water management? Director of Engineering Walker - There is an existing channel capacity that the survey work done on the northeast is about . The other portions an evaluation of the potential peak flows by the watershed taking into account the drainage areas. We are in the process of developing an existing condition of hydrology evaluation . We have done some of this work with the Colleges. There will be an estimate of peak flows for different frequency of storms, from existing conditions to channel capacities for existing conditions . Councilwoman Harrison - I assume that will be in place where the existing channel capacity and the existing watershed conditions are inadequate? This refers to neighborhood meetings. Supervisor Valentino - Those meetings are setup for February and March . Councilwoman Harrison - Those meetings will help identify problems , and also study the proposed improvements? TOWN BOARD MEETING 14 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Supervisor Valentino - "Yes. " Director of Engineering Walker - Superintendent Noteboom and I have been working on critical areas, such as Christopher Lane and Brandywine Drive . Some of the work in question concerning capacity issues also have stability issues. Councilman Klein - What is the schedule for reviewing the storm water management with the Town Board? Director of Engineering Walker - The Public Works Committee will be reviewing the preliminary report. It will be given to the Town Board at the February meeting with a public meeting being held in March . The northeast area people submitted a lot of comments, and now they want an update. D. Director of Planning on See attached . Director of Planning Kanter - The Planning Staff is back to full capacity. The Town Board may want to start thinking of new articles for the Newsletter to be completed during the first quarter of the year. The Cornell University Lake Source Cooling Project will be going before the Planning Board on January 20th for review of public access and building design . The Department of Environmental Conservation (DEC) has just issued the statement of findings on the project. Councilwoman Harrison - I received a call from a resident concerned about Big AI 's Hilltop Quikstop and drainage into Owl Gorge. Is this of any concern ? Director of Planning Kanter - The Planning Board discussed the drainage issues. There will be a storm water retention area on Big AI 's property which is not there now. This will be an additional retention area . The Planning Board asked Big AI 's to look into the possibilities of additional filters for the catch basins. Big AI 's received preliminary approval . They will come back with more details for final approval . E. Director of Building/Zoning - See attached . Director of Building and Zoning Andrew Frost - The Building Department issued a permit to Ithaca College for their new Center for Music . The Town Board was supplied with a 1997 year to date revenue collection report for various categories for the Building and Zoning Department. Those numbers are compared to the 1996 numbers . The revenues for 1997 were close to what the 1996 revenues were. Councilman Conley - On Marcy Court where the Town was talking about bringing transportation through , was a building permit issued for that lot? Director of Building and Zoning Frost - "Yes . " Councilman Conley - There is another building lot on Whitetail Drive, the last one. Was that issued a building permit? Director of Building and Zoning Frost - That was also issued a building permit. Councilman Conley - That sets up a situation . Two of the condo buildings were having serious water problems . They are cutting down the rest of those trees on those lots. The neighbors behind them are TOWN BOARD MEETING 15 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 concerned about water. It comes back to the drainage situation . Mr. Frost was going to supply maps to review so the Town Board could get easements to have the ability to clear in that area . Superintendent Noteboom - That was for the drainage system below. Have there been problems in that area? Councilman Conley - The problems are related to construction . People on the upper banks had the most problem with water, but most of it was due to collapsing pipes from construction installation . F. Human Resources = See attached . G . Financial Report = See attached . Town Budget Officer Alfred Carvill - The numbers in the summary report are reflective of the entire operating year ending December 31 , 1997 . This is probably the most important time of the year in which budget financial figures actually portray a picture . They communicate something to us that is pretty effective to use in coming years. From a financial position , some of the questions at this time of the year include : Are the budget estimates that were put into the budget realistic , and have the actual expenditures the Town incurred for the operating period been cost effective? Have the public services of the Town , and acts to provide the taxpayers been consistently provided? Are we keeping in focus? IPThe report that was supplied to the Town Board indicates some positive features to address all of those economic or financial questions. Looking at the Operating Funds, six percent of the budgeted revenues received exceeded the budget revenues overall last year. Correspondingly, the expenses have decreased simultaneously by six percent. This is being carefully monitored on how the Town is utilizing monies. In examining the fund balances , is the equity of the Town more on a liability side than it is on a receivable side? Are the receivables flowing to the Town from State or Federal or local agencies on a basis that the Town could receive those revenues at the time we meet our operating expenses? The answer to that is a very positive one. The cash portion of the summary clearly indicates that the Town fund equity of each of the operating funds is comprised of cash meeting all revenue that was anticipated for 1997 . The Town received all the money we expected to get. At the end of the year we were able to develop the operating expenses without owing anyone for the 1997 expenses . It is luxury to say that the Town has all cash . Interest earnings exceeded the Town 's budget by 62 percent. The budgeted amount of $ 178 , 000 was exceeded by $ 110 , 000 . The Town was able to generate $288 , 000 of interest earnings from a $900 , 000 real property tax levy. (NOTE : Formal adopted resolution is hereto attached . ) TOWN BOARD MEETING 16 JANUARY 12t 1998 APPROVED - FEBRUARY 911998 AGENDA ITEM NO . 24 = REPORT OF TOWN COMMITTEES : Councilman Conley - What is happening with the purchase Post Office as a new Town Hall? Attorney Barney - The Post Office is still for sale. The Town of Ithaca has submitted a fully signed purchase offer with all the changes that were discussed to Mr. Welch around the end of 1997 . Mr. Welch stated that it would take a month to go through the legal and operational segments by the Postal Service officials. Mr. Welch thought it would go through without any problems, but he was not sure. The Town is waiting to hear from Mr. Welch . Supervisor Valentino - Progress is going slowly. Director of Engineering Walker - There is a Town Hall design meeting scheduled for January 15th , but to have that meeting the contract with HOLT Architects needs to move ahead . This agreement was originally made in October 1997 , but we had to stop the work in December. Councilman Klein - I would like to have Supervisor Valentino sign the agreement and authorize some of the work to proceed . Attorney Barney - Supervisor Valentino has already been authorized to do that. Town Clerk Noteboom - The Town has an agreement, but the agreement is only for a certain amount. Director of Engineering Walker - That amount was $28 , 900 for the schematic design phase. Councilman Conley - Once the schematic design phase is completed , the Town would be able to look at the space? Director of Engineering Walker - The schematic design would give us a basic layout of the building space , and a cost estimate that would be the basis for the final fee. Councilman Klein - Basically, the Town would be risking $28 , 000? If for some reason the Post Office purchase falls through the Town would be out $28 , 000 in architect fees . Attorney Barney - The question is the time frame when the Post Office signs the purchase offer agreement. They have approximately nine months worth of remodeling work from the time this offer is accepted before the Town could get into the building . Supervisor Valentino - When the Postal Service starts their remodeling project the Town can still move ahead with our project. Attorney Barney - The question is , does the Town wish to start now or start after a contract is in hand? If the Town moves ahead now, we will be coming to a holding point until the Post Office does their part. The question is does the Town want to risk the $28 , 000 now by starting in January 1998 , or wait until there is a contract in hand? I do not have a problem either way. Councilman Klein - The architects have been asked to wait several times. They have staff allocated for the project. I would opt for continuity to get the project started . The worst that could happen is that we would finish the working drawings and hold off going out to bid until the Post Office moves into their space. TOWN BOARD MEETING 17 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 Supervisor Valentino - The Post Office Officials during discussions have indicated that once the closing is done they could start moving quickly. Director of Engineering Walker - The Post Office Officials could get a design together and ready for contract documents within 30 to 60 days . There needs to be a lot of interfacing between the Post Office architects and the Town architects. The Town needs to be ready to move when the Post Office is moved . Town Clerk Noteboom - There is a standing resolution authorizing the Town Supervisor to enter into a contract with HOLT Architectural Services in accordance with the proposal . The agreement is to be approved by the Town Supervisor with the advice of the Town Engineer and the Attorney for the Town . That contract has never been fully executed . The Town Board only authorized expenditures under the contract as seen in September 1997 . Further payments were to be subsequently authorized . Attorney Barney - The Town is not committed to that contract unless we sign the contract. The Town Board should start the schematic design phase. Councilman Conley - The Town needs to start the schematic design phase to stay at a steady pace. The Town Board was in agreement to start the schematic design phase at this time. Councilwoman Russell - The Recreation Partnership will be meeting this week. The Cornell Community Waste Management Advisory Committee has had one meeting this year. Councilwoman Harrison - The Cornell/Town Transportation Committee met today, and discussed Caldwell Road . They also discussed scheduling a meeting to urge coordination of bike issues . between the City, Town and Cornell University. Councilman Klein - The Public Works Committee met on December 4, 1997 , and the minutes were supplied to the Town Board , Mr. Kanter gave a report on the Codes and Ordinances Committee. At the next Codes and Ordinances Committee meeting we will be looking at the draft cell tower ordinance and the sexually explicit business ordinance. Director of Planning Kanter - At the last meeting of the Codes and Ordinances Committee, the revised draft of the Agricultural Zones was distributed . That will be discussed at the next meeting . The Town Board had a brief discussion on the cell towers in the area. Councilman Klein - After the next Codes and Ordinances Committee meeting the draft Zoning Ordinances will be available in February. The Water and Sewer Benefit Assessment Committee is looking to finish their work soon , and will be meeting on February 12th to look at scenarios with simplified formulas . The Committee is moving in the right direction . Supervisor Valentino - The Northeast Subarea Study is moving along . The people for the Working Committee have been chosen . They have a training session this Saturday. Councilwoman Harrison - What is happening with Ithaca College in regards to rezoning South Hill? Director of Planning Kanter - Meetings will be set up for further discussions . TOWN BOARD MEETING 18 JANUARY 12, 1998 APPROVED - FEBRUARY 9, 1998 AGENDA ITEM NO. 25 - EXECUTIVE SESSION : Motion made by Councilwoman Grigorov, seconded by Councilman Conley to move into Executive Session to discuss possible litigation and personnel issues. (NOTE : Formal adopted resolution is hereto attached . ) AGENDA ITEM NO. 27 = DISCUSS A PROPOSAL FOR DETERMINING FINANCIAL RESPONSIBILITY OF ANY FUTURE BPWS TREATMENT PLANT EXPANSION PROJECT : Supervisor Valentino - Shirley Raffensperger, Jim Shugg , and I are looking for advice on how we deal with the future expansion of the Plant. If at some point we need to expand the plant we need to look at what municipality is going to be using that consumption . The Town of Ithaca is not using any of it or will not be need it over a period of time. There is a formula that has not been totally defined . It is most likely that the Town of Lansing and the Town of Dryden will need the expansion so they will pay for that based on a formula . The Town of Ithaca may be paying a small portion if we anticipate that we would be needing some of that growth instead of just allocating it. Right now it is set up on a first come first serve situation where whoever needs the capacity can use it . At some point we may need some outside users, but it would probably be 30 years before the Town needs it. At least getting some recognition from the other partners that the ones who are going to be using and needing that capacity are the ones that are going to be paying for it would be helpful . Councilwoman Harrison - That sounds great. Supervisor Valentino - We are only asking for conceptual agreement as this point. If all the partners agree then they would want to go back and do more specific work, and work with the attorney to get the language. Is this enough information conceptually to tell Ms. Raffensperger and Mr. Shugg to move forward? Director of Engineering Walker - Some of the language in the draft plan is confusing . The text has covered several points. There has been some sensitivity by the Town of Lansing that they owe for current capacity. Each municipality has contributed a certain amount towards capital costs. That is what the first table is showing on the third page . The Town of Ithaca has put in 52 percent of the capital costs , the Town of Dryden has put in 4 percent, and the Town of Lansing has put in 8 . 7 percent . The Town of Lansing is where the greatest growth is right now. Their growth is bringing them close to using the consumption they have purchased based on a 6 million gallon per day plan . The Town of i TOWN BOARD MEETING 19 JANUARY 12, 1998 APPROVED - FEBRUARY 9 1998 Lansing is sensitive that if they exceed their capacity now, but the plant does not need to be rebuilt, they do not want to put money into expansion or into a fund or buy capacity from the other users. This draft plan is a compromise saying that we are not going to buy additional capacity if they exceed the portion they have paid for already. Not up front, but in the event that the plant needs to be expanded we are going to revise the formula for whose needs have to be met and what proportion they will pay for on the expansion . Councilwoman Russell - Is that reflected in the second table? Director of Engineering Walker - The second table is an estimate. The fact that the Town of Ithaca will have 20 percent of the responsibility for a plant expansion will probably not happen . The Town of Ithaca has 3 million gallons per day capacity that we have paid for. I do not see the Town using more than 3 million gallons per day in the next 20 years. Councilwoman Grigorov - Could that be written into the agreement, that the Town of Ithaca will not need more capacity? Director of Engineering Walker - The intent here is to say that only the users who have exceeded what they have already paid for will be required to pay for additional capacity. Supervisor Valentino - We are not sure that the Town of Lansing will go along with that proposal . Councilwoman Grigorov - What happens if the Town of Lansing does not go along with it? Supervisor Valentino - The Commission would need to review it again and try to come up with another alternative. Councilman Klein - What happens if the City of Ithaca ends up in this? Supervisor Valentino - That needs to be sorted through , but the partners need to first make a decision about more capacity. Town Budget Officer Carvill - Is the Town 's contribution 52 . 4 percent? Supervisor Valentino - No, that is the Town ' s share of ownership . Director of Engineering Walker - That is the Town 's current consumption also. The capital debt has been retired . The proposed terms are virtually identical to those that were in effect for 1997 . The proposal is as follows : 1 , I agree to serve as Attorney for the Town for the year 1998 and such additional periods as the Town Board may wish , subject to termination at any time as set forth below. 2 , Services would be on an " as needed" basis and as requested or directed by the Town from time to time . Until otherwise directed, the services would include attendance at meetings of the Town Board, Planning Board , Town Zoning Board of Appeals, Town Codes and Ordinances Committee and Town Staff; advising Town governing bodies and individuals including the Town Supervisor, Planning Board Chair, Zoning Board Chair, and Codes and Ordinances Chair on legal matters ; advising Town staff on legal matters ; review of legal documents ; preparation of requested local laws , agreements , resolutions , and other legal materials ; negotiating contracts on behalf of the Town ; representing the Town on litigated matters (when feasible , authorization for such representation will usually be sought from the Town Board before appearing for the Town, although occasionally emergency representation may occur after consultation with the Town Supervisor) ; assisting Town bodies and staff in connection with legal matters relating to development proposals , environmental matters , etc . ; i Honorable Catherine Valentino January 7 , 1998 Page 2 responding when appropriate to legal issues or questions posed by Town residents in relation to matters pending before a Town agency ; and providing such other duties as general counsel to the Town as may be requested or directed. 3 . Where appropriate , matters might be delegated to other lawyers in my office when the expertise , economies , or time constraints make such delegation desirable from the Town ' s perspective . 4. Generally , the fees for the services would be calculated on an hourly basis . Occasionally, when we determine that perhaps more time was spent on a matter than might seem appropriate for the result obtained , the fee may be reduced. On rare occasions , and after consultation with the Town, when the time spent is not truly reflective of the value of the benefits obtained by the Town, we might request an upward adjustment for that particular matter. 5 . For 1998 , the hourly rate will be $ 130. 00 for partners and $ 105 . 00 for associates . This represents approximately 15 % off our normal hourly rates (for existing non- municipal clients our basic rates in 1998 are expected to be $ 155 . 00 per hour for partners and $ 120. 00 per hour for associates - new non-municipal clients may be charged higher rates) . If the Town chose to continue us for ensuing years , it would be our intention to bill at a similar discount from normal hourly rates as then in effect. 6 . The arrangements outlined in this letter may be ended at any time by either party for any reason , or for no reason at all . One of the essential elements of a successful client- attorney relationship is mutual comfort with each other. If that does not exist, the Town should not have to wait until the end of a year to seek other counsel. Obviously, if a change were being contemplated by either of us , we would hope that whoever is deciding to end the relationship would provide as much lead time as possible to the other so appropriate adjustments and transitions might occur, but lengthy advance notice is not a required precondition to severing the relationship . In the event of such severance , we would cooperate fully in transferring files and information to the counsel chosen by the Town and would, of course , expect to receive the agreed compensation up through the completion of the transition. If the arrangements stated above meet with the Town ' s approval, perhaps it would be wise to execute duplicate copies of this letter for our respective files . A space for such action is provided below . Staff worked on year end tasks . Preparations for the year end Town Board meeting were made . A tour of the Town Hall was conducted for the members of the Teen Center. Approximately, thirty individuals walked through the building . Tax Collection : The 1998 Tax Bills totaling a number of 5 , 029 were received from Tompkins County prepared for mailing and sent . The total warrant is $7 , 755 , 673 . 44, with the Town of Ithaca's portion being $3 , 708 , 360 . 98 . Betty F. Poole and Mary Saxton , Deputy Town Clerk' s did an outstanding job preparing the tax bills for mailing . A special thanks to other staff members who helped . Records Management: The latest Records Management Disposition Listing starts the preliminary tasks that will be undertaken during the New York State Program for the Conservation and Preservation of Library Research Materials grant . Respectfully submitted , Joan Lent Noteboom Town Clerk/Receiver of Taxes I i I Agenda Item 23b HIGHWAY DEPARTMEN1 S MONTHLY REPORT, DECEMBER 1997 TOWN OF ITHACA TOWN BOARD MEETING, JANUARY 12, 1997 Highway Superintendent' s The following is a list of water main breaks and the costs to repair (Equipment, Labor, and Materials) . 12/ 11 Salem Drive/ Winston Court $ 21047.85/ $237.50* 12/ 12 Troy Road $ 904.88 12/ 17 Wildflower Drive. $ 298 .59 12/ 21 Sapsucker Woods Road $ 803 .55 12/ 22 Christopher Circle $ 785 .52 12/ 23 Kay Street $ 684.20 * This break was on a Sunday, consequently the larger amount and the extra $237.50 du ring regular hours for road patching. Other water projects include abandonment of PRV at Joanne Drive and Eastern Heights Drive and rehabilitation at the Troy Road Pump Station. These total hours are 70 and 197 respectively . According to Cornell Universitv Weather statistics, between December 30 and 31, Ithaca received 21 " of snow. The other storm, on December 11 , produced 8" of snow. Consequently, we worked 431 . 75 hours of regular time and 432.5 over time hours on snow removal. One hundred and fifty-nine tons of salt/ ICE BAN MAGic were used. Our general impression is that our mixture of salt and ICE BAN MAGic has helped out. The Town is applying less salt and still getting the good results . The mixture kept the snow from bonding to our roads . The roads tended to clear off as soon as they were plowed. We will continue to monitor it use and evaluate the results we are achieving. The balance of the time was spent on machinery repairs and repairs around town such as : Repairs to guide rail, filling pot holes, cleaning ditches, removing obstruction, and finishing leaf pick ups, etc. We worked 1,058 hours on General Repairs . We spent 268 .5 hours of time on cutting a tree on Maple Avenue (eve worked with NYSEG to take the tree down) and Hopkins Road and final leaf collection. Permanent Improvement projects consumed 83 .5 hours of 7me . We spent 167 hours of time on machinery- maintenance/ repairs . Agenda Item 23b Parks Maintenance Manager' s Final leaf pickup work, totaling 60 hours was completed in early December. Various tree removals at several parks, water tanks, and road required 129 hours . Snow removal at walkways and bikeways totaled 65 hours . In addition, Parks staff helped during night shift for 80 hours . Wood shop projects were worked on during spare time for 51 hours. Haul materials Qhk b Town Engineer' s Report for 1 /12/98 Town Board Meeting DEVELOPMENT REVIEW Sanctuary Drive Monitoring of drainage and sediment control measures continues. Ithaca College Construction of the HSHP and the Nfusic Center building improvements continue to be monitored for stormwater management impacts. Ithacare Court Street Companies , the General Contractor, has continued with site construction. Phase II erosion and sediment control improvements are in place as the mass earth work is nearing completion and the site drainage improvements are being installed. The water main boring under Danby Road and water service installation has been completed and a recommendation to accept the watermain will be made to the Town Board after as-built drawings and test results are received by the Town Engineer. Mecklenburg Heights The preliminary site plan and subdivision sketch plan has been reviewed and recommendations made to the town Board and Planning Board regarding the proposed rezoning and subdivision. The watershed analysis and drainage plan provided by the developer has been reviewed and the controls proposed on the preliminary plan are appropriate for the site . Final design will require additional detail and coordination with the City of Ithaca and State DOT to ensure that down stream drainage systems will not be adversely effected. Water supply improvements are under design and may provide the Town with an opportunity to reinforce the west hill water system. EARTH FILL PERMITS Five Mile Drive, Immaculate Conception The site is being utilized for the disposal of material dredged from the flood control channel under the Corps of Engineer' s rehabilitation project. The channel excavation has been completed and final grading and site restoration will be completed in the spring of 1998 . Sediment control measures on the site will be maintained over the winter. FLOOD CONTROL CHANNEL REHABILITATION PROJECT Phase II of the Cayuga Inlet Flood Control Channel rehabilitation project is substantially complete, with channel excavation complete and temporary construction facilities removed. Final site cleanup and restoration will be completed in the Spring of 1998 . TOWN ENGINEERS REPORT 11 / 6 / 97 PAGE .2 WATER PROJECTS The Town Engineer is continuing to work with the City Engineer and SCLIWC member municipal engineers on the engineering evaluation to include the entire water infrastructure for the area. The Buttermilk Falls Road Water Main replacement is substantially complete, with only site restoration work remaining to be done in the spring . Planning on a water connection and pump station at the City of Ithaca Oakwood Dr. water tank is underway, to determine the feasibility of working with the Mecklenburg Heights Proposal to reinforce the West Hill water supply grid. SEWER The Buttermilk Falls Road Sewer extension is substantially complete, with only site restoration work remaining. STORNIWATER Development of the Townwide watershed evaluation is continuing. Base maps were developed utilizing the digital planimetric map . Processing of the field data and development of the watershed model for the Northeast Ithaca area is underway . The model will result in recommendations for drainage improvements that will be incorporated into the 1998 work plan. A preliminary evaluation of the data and watershed analysis indicates that infrastructure improvements for stormwater management will be primarily capacity improvements for the existing road drainage system. Some stormwater detention may be recommended prior to additional development of the area. The Town Engineer is evaluating the large undeveloped parcels in the area for potential stormwater management facility sites. Prior to finalization of a stormwater management plan of work for the Northeast area, the draft plans will be reviewed by the Town Board and the public will have an opportunity to review the plan. The public will have an opportunity to ask questions and make comments at a public meeting to be scheduled. TOWN ENGINEERS REPORT 11 / 6 / 97 PAGE 3 TOWNHALL The schematic design process for the renovation of the Tioga Street Post office is scheduled to start on January 15 with a meeting with Doug Look of HOLT&C . Town department heads will meet with the Supervisor prior to that meeting to review the space needs evaluation that was completed several years ago to incorporate the program changes that the Town Board and Supervisor have initiated over the past two years. Mecklenburg Heights, Mecklenburg Road - Determination of significance of environmental impact The Planning Board, at its meeting of December 16, 1997, began its environmental review of the Mecklenburg Heights development proposal on Mecklenburg Road. The project would consist of 56 apartment units in seven buildings on a 9 . 12 + / - acre portion of Tax Parcel No . 27-1 -13 . 12, adjacent to the Town of Ithaca / City of Ithaca boundary . Consideration of determination of significance of environmental impact will continue, tentatively at the January 20, 1998 Planning Board meeting, pending the submission of additional information regarding the proposed entrance driveway on Mecklenburg Road. Ithaca College Observatory, Danby Road The Planning Board granted Preliminary and Final Site Plan Approval at the January 6, 1998 meeting for the proposed construction of an observatory at the Ithaca College campus near the top of South Hill, approximately 300 feet south of the existing water tower . The Planning Board also recommended that the Zoning Board of Appeals grant Special Approval for the proposed observatory (for an educational use within an R-30 Residence District) , Big Al' s Hilltop Quikstop, 1103 Danby Road The Planning Board granted Preliminary Site Plan Approval and Preliminary Subdivision Approval at the January 6, 1998 meeting for the proposed reconstruction of Big Al' s Hilltop Quikstop, to include demolition of the existing fuel pump island and convenience store and construction of new fuel pump islands with canopy and a + / - 3,330 square foot convenience store, new curbing and entrances, new parking areas , and replacement of the existing post sign, located on Danby Road at the intersection of the East King Road extension, Business District "C" . Holcomb Subdivision, 141 Northview Road The Planning Board granted Preliminary and Final Subdivision Approval at the January 6, 1998 Planning Board meeting for the proposed subdivision of approximately 0 . 145 + / - acres from an existing 1 .0 + / - acre parcel to be conveyed to the owners of the adjacent lot, R-15 Residence District, CURRENT PL A JNING DEPARTMENT PROTECTS The following are significant accomplishments or issues that have been dealt with over the past month . SEOR Reviews for Zoning Board : Three thddtha aaCoEeQ e Observator and Big ms' s Board were completed, two of which were for b Hilltop Quikstop described in the above Planning Board reviews, and a third SEAR review regarding a request for a variance in order to operate a push cart food service business at the existing Eddydale farm stand, 827 Elmira Road, Residence District R-30, Barbara Kazyaka, Appellant; Alfred Eddy, Owner . Codes and Ordinances Committee: The Codes and Ordinances Committee met twice in December . On Thursday, December 11th, the Committee discussed possible approaches for regulating cellular / communication d business (adultt entertainment uses)preliminary On aft iente regulation regarding sexually or Wednesday, December 17, 1997, the Committee continued discussion of comments received on the revised Zoning Ordinance ca draft of a further revised Agricultural di baed to town boards and committees . In addition, Zone was distributed at the meeting for the Committee' s review . The next meeting is scheduled for Wednesday, January 21 , 1998 , Planning Committee : The December Planning Committee meeting was cancelled due to lack of a quorum . A revised draft Agricultural Zone was prepared by staff, based on Planning Committee discussions , and was forwarded to the Codes and Ordinances Committee for review . Town of Ithaca Cornell University Transportation Committee : The next Committee meeting is scheduled for January 12, 1998 . The agenda will include follow-up discussions on possible Caldwell Road and Maple avenue improvements, a status update on the Northeast Subarea Study, and a follow-up discussion regarding pedestrian crosswalks . Northeast Subarea Study: The Client Committee is in the process of selecting members for the Working Group . A public information meeting was held on December 4, 1997 at the DeWitt Middle School , and a workshop with prospective Working Group 2 i Milli members was held on December 15, 1997,, at the Transit Center . The Client Committee met on January 7, 1998 to select Working Group members . A special training workshop for Working Group and Client Committee members is tentatively scheduled for Saturday, January 17, 1998. MPO Planning Committee: The annual joint Planning and Policy Committee meeting was held on December 16, 1997, Officers for both committees were elected to serve in 1998. The 1998 / 99 work program was briefly discussed, and will be discussed in more detail when the new MPO Director, Fernando DeAragon, arrives on January 17th . Historic Resources Survey: The Cornell Historic Preservation class had scheduled a presentation on December 10th of their semester study results of the southeast sector of the town, but the presentation was cancelled due to weather conditions. The students are planning to reschedule their presentation sometime early in the upcoming semester . Annual Report for 1997: Work on the Planning Department' s Annual Report for 1997 has been initiated and is targetted for distribution and discussion at the January 26, 1998 special Town Board meeting . This course was offered to us by Lovell Safety Management. We may be receiving a small break in our automobile insurance coverage because almost all of the Town employees have received this certification in 1997 . Health Insurance : Most of the month was spent on the health insurance open enrollment meetings held at different times throughout the month at the Highway garage and at Town Hall . We had 3 people leave Blue Cross/ Blue Shield and join PHP . We also had a couple of people opt for insurance coverage through PHP that in the past had no coverage through the Town . We also had 1 individual who switched from BCi' BS to the Health Guard Blue HMO plan . Personnel Committee Meeting December 16 , 1997 : The committee approved the July 29 , 1997 minutes (see attached copy of approved minutes .) This personnel committee meeting was very well attended by the Highway Department employees . At that meeting the employees presented Supervisor Valentino with a petition to have weekly pay checks . Supervisor Valentino explained that based on the cost comparison done on weekly versus biweekly paychecks that the Town Board would probably not look favorably on weekly paychecks . The subject was also brought up about a Thursday pay day instead of Friday . I did a poll of the employees for their option of Thursdays or Fridays . The result of the poll was that Friday was preferred by the majority . There was a discussion of the future goals of the committee for 1998 . It was decided to have the meetings only quarterly unless their is a topic that needs to be taken to the committee sooner . One of the projects for the committee this year is to review our benefits offered versus other Ithaca area businesses and municipalities . Human Resources Office : I have completed the normal daily functions of the office . The Town Clerk and I met with our new representative , John Kuehns from Sprague Insurance Company . We met to review the liability insurance coverage for the Town for 1998 . Mr. Kuehns and I will be working together more often during the year to make some adjustments for 1999' s coverage .
