HomeMy WebLinkAboutLL 15 of 2011 Rezone a Portion of TP 33.-3-2.2 (Ithaca Beer land swap) TOWN OF ITHACA LOCAL LAW NO. 15 OF THE YEAR 2011 A LOCAL LAW AMENDING CHAPTER 270 OF THE TOWN OF ITHACA CODE TO REZONE A PORTION OF TAX PARCEL #33.-3-2.2 LOCATED OFF OF MANCINI DRIVE FROM LOW DENSITY RESIDENTIAL TO LIGHT INDUSTRIAL Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Rezoning of Lands. Chapter 270 of the Town of Ithaca Code, titled "Zoning," is amended by rezoning the land described on Schedule A incorporated into this local law from its present zoning classification of Low Density Residential Zone to Light Industrial Zone. Section 2. Amendment of Zoning Map. The official zoning map of the Town of Ithaca, dated December 11, 2006, as amended to date, is hereby further amended by rezoning the land described in this local law in the manner set forth in this local law. Section 3. Partial Invalidity. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 4. Effective Date. This local law shall take effect immediately upon its filing with the New York Secretary of State. Schedule A Description of Property Being Rezoned ALL THAT TRACT OR PARCEL OF LAND situate in the Town of Ithaca, County of Tompkins, State of New York,being bounded and described as follows: COMMENCING at a point marked by an iron pin found on the westerly highway line of NYS Route 13A - Five Mile Drive at the southeasterly comer of lands reputedly of Sosebee & Demarest(Instrument No. 532696-001); RUNNING THENCE South 63° 18' 49" West along the southerly line of said premises reputedly of Sosebee & Demarest (Instrument No. 532696-001) and along the northerly line of a private drive known as Mancini Drive a distance of 5 90.10 feet to a point marked by an iron pipe found; RUNNING THENCE South 58° 20' 32" West along the northerly line of a private drive known as Mancini Drive a distance of 88.04 feet to a point marked by an iron pin found; Adopted November 7,2011 1 RUNNING THENCE North 31° 02' 01" West along the northeasterly line of premises reputedly of Ferrara Realty, Inc. (872/5) a distance of 217.44 feet to a point marked by an iron pin found at the TRUE POINT OF BEGINNING; RUNNING THENCE South 58° 57' 58" West along the northwesterly line of said premises reputedly of Ferrara Realty, Inc. (872/5) a distance of 507.60 feet to a point marked by an iron pin found; RUNNING THENCE North 33° 40' 45" West a distance of 64.24 feet to a point marked by an iron pin set; RUNNING THENCE North 58° 57' 58" East a distance of 510.56 feet to a point marked by an iron pin set; RUNNING THENCE South 31° 02' 01" East a distance of 64.17 feet to a point marked by an iron pin found,which point is the TRUE POINT OF BEGINNING; Said parcel contains 0.750 acres and is designated as Parcel B on a map entitled, "SUBDIVISION PLAT SHOWING LANDS OF MITCHELL VENTURES, LLC, LOCATED ON NYS ROUTE 34/96 & NYS ROUTE 13A, TOWN OF ITHACA, TOMPKINS COUNTY, NEW YORK," prepared by T.G. Miller, PC, dated July 18, 2011, revised August 26, 2011, a copy of which was filed in the Tompkins County Clerk's Office on September 8, 2011 as Instrument Number 580343-001, and which is incorporated herein by reference. BEING A PORTION OF THE PREMISES conveyed to Mitchell Ventures, LLC by deed dated June 25, 2010 and recorded June 30, 2010 in the Tompkins County Clerk's Office as Instrument Number 561024-005.
