HomeMy WebLinkAboutLL 03 of 2010 NY Bd Fire Underwriters Code Changes TOWN OF ITHACA LOCAL LAW NO. 3 OF THE YEAR 2010 A LOCAL LAW REMOVING REFERENCES TO THE NOW-DEFUNCT NEW YORK BOARD OF FIRE UNDERWRITERS IN CHAPTERS 125 (BUILDING CONSTRUCTION AND FIRE PREVENTION), 221 (SIGNS), 225 (SPRINKLER SYSTEMS)AND 270 (ZONING) OF THE TOWN OF ITHACA CODE Be it enacted by the Town Board of the Town of Ithaca as follows: Section 1. Chapter 125 (Building Construction and Fire Prevention) of the Town of Ithaca Code, Section 125-5, entitled"Construction inspections,"is amended by deleting subparagraph D(3) and replacing it with the following: "(3) Certificates from appropriate electrical inspection persons or agencies, as determined by the Town, certifying that the electrical work is in compliance with all applicable laws, codes, rules and regulations." Section 2. Chapter 221(Signs) of the Town of Ithaca Code, Section 221-9, entitled"Sign construction," is amended by deleting subparagraph B(1) and replacing it with the following: "(1) Lighting fixtures and wiring shall conform to the requirements of the National Electrical Code and other applicable codes and regulations, and shall have the approval of an appropriate electrical inspection person or agency, as determined by the Town." Section 3. Chapter 225 (Sprinkler Systems) of the Town of Ithaca Code, Section 225-2, entitled"Definitions and word usage,"is amended by deleting the first sentence of the definition for"Approved Sprinkler System" in subsection A and replacing it with the following: "APPROVED SPRINKLER SYSTEM—A sprinkler system that meets the requirements of the New York State Uniform Fire Prevention and Building Code and the standards of the National Fire Protection Association or other nationally recognized approval organization, as determined by the Town Code Enforcement Officer." Section 4. Chapter 225 (Sprinkler Systems) of the Town of Ithaca Code, Section 225-6, entitled"Exception,"is amended by deleting the text in this section and replacing it with the following: "Notwithstanding the terms of this chapter, sprinklers shall not be required to be installed in spaces where the discharge of water would be hazardous. In such places, other fire- extinguishing equipment shall be provided that meets the requirements of the New York State Uniform Fire Prevention and Building Code and the standards of the National Fire Protection Association or other nationally recognized approval organization, as determined by the Town Code Enforcement Officer." April 12,2010 1 Section 5. Chapter 270 (Zoning), Article XXVI(Special Regulations) of the Town of Ithaca Code, Section 219.1, entitled"Solar collectors and installations," is amended by deleting the first sentence in subsection D and replacing it with the following: "All solar collector installations must be performed by a qualified solar installer, and prior to operation, the electrical connections must be inspected by a Town Code Enforcement Officer and by an appropriate electrical inspection person or agency, as determined by the Town." Section 6. Chapter 270 (Zoning), Article XXVI(Special Regulations) of the Town of Ithaca Code, Section 219.4, entitled"Small wind energy facilities," subsection D, entitled "Safety standards," is amended by deleting subparagraph 5 and replacing it with the following: "(5) All small wind energy facilities shall be installed by a qualified wind energy installer, and prior to operation, the electrical connections and structural integrity must be inspected by a Town Code Enforcement Officer and by appropriate electrical and structural inspection persons or agencies, as determined by the Town." Section 7. In the event that any portion of this law is declared invalid by a court of competent jurisdiction, the validity of the remaining portions shall not be affected by such declaration of invalidity. Section 8. This local law shall take effect upon publication of the local law or an abstract of same in the official newspaper of the Town, or upon its filing with the New York Secretary of State, whichever is the last to occur.
